[pt] Guiada pelo duplo propósito de esclarecer o significado dos conceitos de númeno, objeto transcendental e coisa em si mesma e de encontrar uma interpretação satisfatória para o problema da afecção transcendental, esta tese se desdobra em três partes. A primeira investiga a origem do conceito de númeno na Dissertação inaugural e analisa seus desdobramentos nas duas edições da Crítica da razão pura. Observaremos que o númeno pensado em seu sentido positivo passa a ser descrito como um conceito problemático, enquanto pensado em seu sentido negativo se revela imprescindível para a doutrina da sensibilidade. A segunda parte trata da definição kantiana de objeto transcendental e de suas relações com a coisa em si mesma e com a apercepção transcendental. Veremos que apesar de Kant associar o conceito de objeto transcendental à apercepção transcendental, ele não identifica o objeto em si mesmo com a apercepção. A terceira parte examina extensivamente o papel da coisa em si mesma em momentos cruciais da Crítica. A partir dessa perspectiva mais abrangente, notaremos que a noção de coisa em si mesma se relaciona com a razão e com entendimento de modos específicos, orientando e delimitando o conhecimento. A chave da interpretação erguida ao longo desse percurso é encontrada na conclusão da tese. Poderemos então finalmente mostrar que os conceitos de númeno, objeto transcendental e coisa em si mesma têm, cada um, uma função crítica sob a perspectiva da reflexão transcendental e, além disso, que a afecção pode ser considerada, assim como os objetos, tanto do ponto de vista empírico como do transcendental. / [en] Guided by the dual purpose of clarifying the meanings of the concepts of noumenon, transcendental object and the thing in itself and finding a satisfactory interpretation of the problem of transcendental affection, this thesis unfolds itself in three parts. The first researches the origin of the concept of noumenon in the Inaugural Dissertation and analyzes its development in both editions of the Critique of Pure Reason. We shall observe that noumenon thought in its positive sense turns out to be described as a problematic concept, while thought in its negative sense reveals to be essential to the doctrine of sensibility. The second part deals with the Kantian definition of the transcendental object and its connections with the thing in itself and with transcendental apperception. We shall see that although Kant associates the concept of the transcendental object with the transcendental apperception, he does not identify the object in itself with the apperception. The third part examines thoroughly the role of the thing in itself in crucial moments of the Critique. From this broader perspective, we shall notice that the notion of thing in itself relates to reason and understanding in specific ways, guiding and delimiting knowledge. The key to the interpretation built throughout this course is found in the conclusion of the thesis. We shall finally be able to show that the concepts of noumenon, transcendental object and thing in itself have, each, a critical function from the perspective of the transcendental reflection and, furthermore, that the affection can be considered, as well as the objects, either from the empirical or from the transcendental point of view.

When a new type of jazz, later often referred to as free jazz, entered the Swedish jazz scene at the time when the 1950s became the 1960s, an intense debate occurred within the Swedish jazz community. A debate between those in favor of the new style, its expressions and the direction in which jazz was moving towards in general, versus those who disliked this new development, thought that it was too extreme and was not in line with the traditions of jazz. This essay will bring this debate to light and analyze different aspects of it, with a similar controversy in mind which took place at the time of the arrival of bebop, approximately fifteen years earlier. The primary aim is to integrate free jazz into the Swedish jazz narrative, something that has been neglected in earlier research. Through discourse analysis, contemporary thoughts and values are brought to the surface. In part to better understand how and why these different opinions came to be, but above all, if they were part of other contemporary discussions, strives and struggles within the Swedish jazz community. The findings point towards the fact that free jazz played an important role in both the contemporary Swedish jazz discourse and the development of jazz at large. Free jazz expanded the spectrum of expression within the genre and helped jazz in general to reach a status of high culture, a strive that had existed for a long time.

A scope more centered in the instituting of the provisional remedy, in the judged thing and the rescindable action was established. The objective was to demonstrate the possibility of the provision of the remedy on the rescindable action, on what, the alteration of article 489 of the Code of Civil Action, leaves no doubt. As such, the concept of jurisdictional remedy and its species was discoursed briefly, also informing on the instrumental character of the civil action. Still, a study was performed on the effectiveness of the process and the provisional remedy, to demonstrate that this is one of the most efficient ways (not to say it is the way) to change the process into an effective and just one. Immediately after, a specific study on the provisional remedy in the civil procedural Brazilian law was made. Also, a study was made on the judged thing and, mainly, on the possibility of it being relative in the cases where it exists serious vice to the sentence or this one is in disagreement with the law, violating the jurisprudence. An exclusive study about the rescindable action was performed. Finally, the central subject of the present work was approached: The possibility of the provision of the remedy on the rescindable action. As such, there was talk about the constitutional guarantees of the due legal process and of the intangibility of the judged thing, a short passage about the constitutional principles and its conflicts was written. Concluding, brief aspects regarding the common points and differences between the precautionary and provisional remedies were presented, with ends of showing that even with the alteration of the article 489 of the Code of Civil Action by the Law # 11.280 of 2006, that foresees the possibility of the rescindable action being suspended by measure of precautionary nature or provision of the remedy, in the essential cases and under the presuppositions predicted under law, the provisional remedy is the best way to plead the suspension of the rescindable jury / Este trabalho teve como escopo o estudo da tutela antecipada na ação rescisória. Foi feita uma abordagem mais centrada no instituto da tutela antecipada, na coisa julgada e na ação rescisória. O objetivo foi demonstrar a possibilidade de se antecipar a tutela na ação rescisória, sobre o que, com a alteração do artigo 489 do Código de Processo Civil, não pairam mais dúvidas. Para tanto, discorreu-se de forma breve sobre conceito de tutela jurisdicional e suas espécies, inclusive informando sobre o caráter instrumental do processo civil. Fez-se ainda um estudo sobre a efetividade do processo e a tutela antecipada, para demonstrar que esta é um dos meios (para não dizer é o meio) mais eficaz para tornar o processo efetivo e justo. Em seguida foi feito um estudo específico sobre a tutela antecipada no direito processual civil brasileiro. Houve também um estudo sobre a coisa julgada e, principalmente, sobre a possibilidade de sua relativização nos casos em que existir vício grave na sentença, ou esta esteja em desacordo com o direito, violando a ordem jurídica. Fez-se um estudo exclusivo sobre a ação rescisória. Finalmente, abordou-se o tema central do presente trabalho: a possibilidade da antecipação da tutela na ação rescisória. Para tanto, falou-se sobre as garantias constitucionais do devido processo legal e da intangibilidade da coisa julgada, fez-se uma breve passagem sobre os princípios constitucionais e seus conflitos. Concluindo, apresentou-se breves aspectos dos pontos comuns e diferenças entre as tutelas cautelar e antecipatória para fins de demonstrar que mesmo com a alteração do artigo 489 do Código de Processo Civil pela Lei n. 11.280 de 2006, que prevê a possibilidade de se suspender a ação rescisória por medida de natureza cautelar ou antecipatória da tutela, nos casos imprescindíveis e sob os pressupostos previstos em lei, a tutela antecipada é a forma mais adequada para pleitear a suspensão do julgado rescindendo

Uppsatsen utforskar människans psyke utifrån den franske psykoanalytikern och psykiatrikern Jacques Lacans psykoanalytiska teori. Uppsatsen undersöker subjektets förutsättningar och möjligheter utifrån lacansk teori, samt vilka implikationer det får på symptomets plats inom klinisk diagnostik. Metoden använder lacanskt teori som beskrivningar av subjektets status, vars framställning abstraheras till en rad regler. Teorins giltighet prövas i uppsatsen mot kliniska fallbeskrivningar och andra exempelfall. I diskussionen framkommer att implikationen av den lacanska teorin om subjektet är vittgående vad gäller kliniskt diagnostik och värderingen av symptomet. / The essay explores the human psyche by the French psychoanalyst and psychiatrist Jacques Lacan's psychoanalytic theory. The essay examines the subject's conditions and possibilities based on Lacanian theory, and what implications it has on symptom location in clinical diagnostics. The method uses Lacanian theory and descriptions of the subject's status, the production of which is abstracted to a set of rules. The theory's validity tested in the paper on clinical case reports and other such cases. In the discussion it will be the implication of the Lacanian theory of the subject is extensive in terms of clinical diagnosis and evaluation of the symptom.

教育和文學最重要的連結是什麼，普遍最被接受的是「想像」，也就是想像力或幻想，它是跨領域科技整合極重要的黏著劑與調和劑。因此教育最重要的功能之一在於培養孩童持續保有發揮想像的能力，不僅孩童，成人也同樣需要。基此，本文以文學視角出發，結合靈性教育的關懷，從富含幻想表現的奇幻敘事文本取材，透過再想像與再詮釋的創造性連結，嘗試性地勾勒出一個富含寓意的人類圖像。 本研究採文本分析，融入「皺摺、展開、再皺褶」及「詮釋、再詮釋與過度詮釋」的概念與方法，著眼於「人與超自然」向度來詮釋靈性教育的人類圖像。本文共分六章：第一章，導論：緣起說「圓」，為本研究的緒論；第二章，究竟起「源」：創世與起「源」，為文獻探究與前導，指出源即是靈；第三章，迷宮探「園」：謎樣的世界，旨在闡述「界意在破（無）」；第四章，穿越奇「緣」：隧道的盡頭，旨在闡述「道意在無（悟）」；第五章，另度次「元」：空間與過門，旨在闡述「門意在空（心）」；第六章，總結：究極奧「圓」— 〇、●、 、◎，回顧與統整「那神」的人類圖像。 本研究嘗試勾勒之「那神教育學」圖像，或可稱為靈性教育的人類圖像，此圖像模型主要有三層（嚴格來說有五層），上下有其位置，但沒有先後順序或優劣之分，分別以基層的太極陰陽圖、中層的環狀隧道和上層的三角體形構，並透過「噬尾龍」的蘊義，闡釋「人即是神、神即是人」的循環圖像。 / The purpose of dissertation is trying to verify the imagination can be the connection between the education and literature. Imagination can connect and mediate among the multi-dimensions. One of the important things of education, not only for children but also for adults, is to cultivate and maintain the imaginative capacity. In this reason, my dissertation adopts the literature narrative and care about spiritual education. Especially, I use the folk literature with rich fantasy to do the re-imagine and re-interpretation for illustrate the meaning of the whole human picture. The methodology of the dissertation are use the "folding, unfolding and re-folding " and "interpretation, reinterpretation and Overinterpretation" and so on, with the fantasy narrative in "human being and supernatural", to interpret the human picture of spiritual education. There are six chapters in this paper: Chapter Ⅰ, Introduction: the Origin and "circle"; Chapter Ⅱ, Explores the Beginning: the Genesis and Origins; Chapter Ⅲ, Explore the Maze "Garden": the Mystery World, aims to set forth "Boundary to be Break (No)"; Chapter Ⅳ, Meet the “Fate”: At the End of the Tunnel, to elaborate "Road means None (Enlighten)"; Chapter Ⅴ, Another Dimension: Space and Threshold, to elaborate "Door means Empty (Heart)"; Chapter Ⅵ, Conclusion: The Ultimate "Round"— 〇、●、 、◎, Review and integrate the human picture of "No-thing". I try to describe the picture of "Pedagogy of No-thing" or called the human picture of Spiritual Education. There is a vertical structure with three levels in the picture (strictly speaking there are five levels) but no priority among them. The foundation is “Tai Chi”, the middle is “Ring Tunnel”, and the top is Triangular Shape in the structure. Through the “Ouroboros” (bite the tail dragon) interprets the picture of "human being is god, and god is human being ".

Concept éminemment polysémique, le sens commun a été déprécié par un vaste pan de la philosophie occidentale, qui y a vu au mieux l’expression de croyances infondées, au pire la manifestation de croyances erronées et naïves. Là où bon nombre de commentateurs ont repéré dans les pensées mêmes d’Henri Bergson, Stanley Cavell et Gilles Deleuze, trois grandes figures de la philosophie du cinéma, des critiques adressées au sens commun, nous nous efforçons ici de tirer au clair la conception positive qu’ils développent de cette notion, en dépit des soupçons occasionnels qu’ils font peser sur elle. Plus précisément, nous tâchons d’expliquer jusqu’à quel point certaines acceptions du sens commun permettent de satisfaire l’ambition de connaître le réel lui-même. En premier lieu, nous passons en revue l’argumentation élaborée par certains réalistes spéculatifs (en particulier Quentin Meillassoux et Graham Harman) afin de clarifier d’une part des réflexions qui feront l’objet de discussions et de répliques dans les chapitres subséquents et, d’autre part, de montrer que la dépréciation philosophique du sens commun se prolonge jusque dans les débats les plus actuels sur l’objectivité. Nous faisons ressortir par la suite les angles sous lesquels le sens commun est susceptible de nous rapprocher du réel d’après Bergson, Cavell et Deleuze. En second lieu, nous entrons de plain-pied dans le domaine du cinéma et examinons en quoi différentes œuvres du renouveau du cinéma québécois (Denis Côté, Stéphane Lafleur, Sébastien Pilote, Rafaël Ouellet, Xavier Dolan, Anne Émond, Rodrigue Jean, le collectif Épopée, Mathieu Denis et Simon Lavoie) viennent à leur manière compléter, radicaliser ou critiquer les réflexions développées dans la première partie autour du sens commun et du réel. À l’encontre de ceux qui qualifient ces œuvres de « mimétiques », « peu songées » et « esthétisantes », nous mettons donc en évidence la façon dont ces films, attentifs à la profondeur de l’expérience ordinaire et à l’exigence de trouver un certain équilibre entre le devenir incessant et la stabilité constante, parviennent à nuancer et à raffiner la philosophie. / The eminently polysemic concept of common sense was depreciated by a vast segment of Western philosophy, which saw at best in it the expression of unwarranted beliefs, at worst the manifestation of erroneous and naïve beliefs. Where many commentators have pinpointed critiques of common sense in the thoughts of Henri Bergson, Stanley Cavell and Gilles Deleuze, three prominent figures of the philosophy of cinema, we strive here to bring out the positive conception they develop of that concept, notwithstanding the occasional suspicion they may cast on it. To put it in more precise terms, we seek to explain to what extent certain meanings of common sense are apt to satisfy the ambition of knowing reality itself. In the first place, we review the argument elaborated by certain speculative realists (specifically Quentin Meillassoux and Graham Harman) in order to clarify, on the one hand, reflections which will be the object of discussions and replies in the subsequent chapters, and, on the other hand, to show that the philosophical depreciation of common sense goes on even in the most contemporary debates on objectivity. We then bring out the angles under which, according to Bergson, Cavell and Deleuze, common sense is apt to bring us closer to reality itself. In the second place, we enter fully into the field of cinema and examine in what way different works associated with the revival of Quebec cinema (Denis Côté, Stéphane Lafleur, Sébastien Pilote, Rafaël Ouellet, Xavier Dolan, Anne Émond, Rodrigue Jean, the collective Épopée, Mathieu Denis and Simon Lavoie) end up completing, radicalizing or criticizing in their way the reflections developed in the first part around common sense and the real. In opposition to those who characterize those works as « mimetic », « thoughtless » and « aestheticizing », we thus bring to the fore the way in which those films, paying attention to the depth of ordinary experience and to the requirement of finding a certain balance between incessant becoming and constant stability, do succeed in nuancing and refining philosophy.

v anglickém jazyce This thesis is based on the Kurt Oppert's term "Dinggedicht" (in English "object-poem" or "thing- poem"), through which it views the transformations within the conceptualization of the subject and things in modern poetry. Apart from poems associated with the name of R. M. Rilke, thingness is also seen from the perspective of the functional use of the object in a poem (e.g. a thing as a tool of characterization orironization), whichis related to theuse ofobjects in figurativelanguage - the thing as a part of the metaphor, simile or allegory. As part of the definition of a thing-poem, the thesis also deals with the issue of subject-object relationship, which leads also to the category of a lyrical "I" in the literary theory. The thesis is based on individual poems which represent a concrete, prototypical way of dealing with the subject in poetry. These poems are delimited by the second half of the 19th century and the first two decades of the 20th century. The thesis is not based on strictly defined national literature, but it considers the German, French and Czech context in the comparative perspective.

The aim of the thesis is to determine the amount of indemnity for damage to the family house caused by excessive snow loads, calculation of material value (time value) immovable assets immediately before the insured event cost method using analytical methods wear, determining the cost of putting immovable in working condition, the calculation of substantive value of intangible assets for the repairs. In this thesis, the emphasis on the clarification process when the risk to the family house and a practical example of an insured event the immovable. At the same time the analysis of the results, which display graphs show how the event affected the development of insurance rates immovable.

This diploma thesis deals with the valuation of ten residential units. Valuation is done in three ways: cost and comparative method by price prescription and method of direct comparison. Next, determined the usual price. A conclusion of this work is the analysis of the effect of location on the standard price of selected residential units in Brno.

The dissertation focuses on the problems associated with determining the amount of wear (finding the remaining technical values) that are being addressed. It deals with an overview of the different methods used. The basic premise of the thesis is a comprehensive overview of the calculation procedure and the methods used. This area of wear does not except the price regulation precisely defined procedure, nor are they addressed the circumstances in which that would be the method to be used. Various possible methods or inaccuracies may result in questioning the expert opinions as at trial. In conclusion of this dissertation is shown how the calculation procedure should wear for what purpose should be used and it is also proposed several alternatives.
