“Equality, Development and Peace for All Women Everywhere”? : An Analysis of Sexual Violence Against Women and Concurring International Conventions Concerned with Protecting the Rights of WomenMüller, Annika Sophie January 2020 (has links)
Violence against women continues to be an issue that severely impacts women worldwide. Since the global spread of the #MeToo movement in 2017, debates regarding this issue significantly increased. Yet the precise ways in which women are impacted by violence, heavily influenced by their unique and diverse aspects of identity, are often disregarded. By focusing on two of these aspects of identity, namely gender and nationality, and comparing the circumstances of sexual violence against women in Germany, Nigeria, and South Korea, this thesis aims to showcase the diverse experiences of ‘being a woman’ and what this implies regarding the issue of sexual violence against women. With an additional analysis of four important international conventions aimed at ameliorating women’s lives (UDHR, CEDAW, DEVAW, and BPfA) regarding their acknowledgement of this diversity and guided by three theories, namely Multi-Ethnic Feminism, Feminist Postcolonialism, and Intersectionality, this thesis highlights the necessity of including everyone and their unique experiences with all kinds of discrimination to adequately tackle an issue such as sexual violence against women.

Several nursing authors acknowledge the essential value of the caring relationship and its benefits for the rehabilitation clientele. In spite of this importance, the therapeutic benefits of the caring relationship for this clientele remain an unexamined area. Currently, no Quebec, Canadian or international scientific nursing study is concerned with understanding the experience to « be with » the person being cared for in a rehabilitation context, which is central to the caring relationship according to Watson.
Inspired by Watson’s Human Caring philosophy, this study aims to investigate, by qualitative interviews with seventeen rehabilitation nurses, the meaning of the experience to « be with » the person being cared for, as well as their perception of the contribution of this experience to the person’s rehabilitation. Fifty one interviews, therefore three interviews for every research participant, were analyzed using the « phenomenological » method entitled « Relational Caring Inquiry » developed by Cara (1997). The process of participant recruitment involved the nursing management team of both rehabilitation centres targeted by the study. A variety of participants was favoured (e.g.: gender, educational level, shift worked, and patient care unit).
The process of data analysis allowed the discovery of five eidos-themes. Among these eidos-themes, four refer to the meaning of the experience to « be with » the person cared for (first research question), namely: (a) the importance of humanistic values at the core of the care, (b) the investment of the nurse and the person cared for, (c) the reciprocal and relational care dimensions and finally, (d) the irreplaceable care experience of contextual complexity. In more detail, the first eidos-theme reveals the humanistic basis of the experience to « be with » the cared person. The second expresses the substantial implication of the nurse and the person cared for. The third eidos-theme clarifies the reciprocity and relational dimension as being central elements of the experience to « be with » the person cared for. The fourth eidos-theme documents fundamental and complex origins of this unique care experience, as well as the contextual conditions which facilitate and impede it. The fifth and last eidos-theme emerging from this study, « strengthening the mind-body-spirit harmony of the person cared for and the nurse », illustrates the participants’ perception regarding the therapeutic contribution of the experience to « be with » the person cared (second research question). This contribution meets the patient’s needs, optimizes the rehabilitation progress of the person cared for, promotes the level of well being of the person cared for and the nurse and finally, raises the inner growth of the people engaged in this extraordinary care experience. The recognition of these five eidos-themes supports the emergence of the universal essence of the phenomenon being studied which is entitled « the profound, therapeutic, and transformative human relationship ».
The present study contributes, in an innovative way, to knowledge development, in particular by allowing a better understanding of the meaning of rehabilitation nurses’ experience to « be with » the patient, and advancing evidence-based results to be used as a guide for the development of nursing care in the context of rehabilitation. By determining the ontological meaning of this care experience, the present study makes it possible to specify the place of the phenomenon to « be with » the patient as being central to the caring theory. The results arising from the second research question contribute to the development of a body of knowledge. These evidence-based results will be used to guide the renewal of nursing practice in the context of rehabilitation. Moreover, by identifying the benefits of this care experience, the present study recognizes the element at the heart of transpersonal caring relationship, which contributes to mind-body-spirit harmony for both, the person cared for and the nurse. This study also proposes recommendations for education and research in nursing sciences.

Umgänge med umgängesstöd : Barns delaktighet i domar gällande umgänge med umgängesstödGunnarsson, Malin January 2023 (has links)
In 2020, approximately 6900 children in Sweden were relevant for investigation of custody disputes. During the same year, 1802 court decisions were enforced regarding supervision by a contact person. Previous research has shown that children often have a lack of participation and opportunity to influence in these cases. It has also shown that parental rights and the child´s need for protection often outweigh the child´s expressed will. The aim of this study was to investigate children´s participation in the district court´s judgments regarding supervision by a contact person. What an impact the child´s will have and how factors such as age, risks and their best interest affect children´s ability to be involved. Through a qualitative content analysis, nine judgments from various district courts in Sweden during 2018-2021 have been selected. The material was then analyzed with the help of social constructivist theory and Roger Hart´s ladder of participation. The study shows that in six out of nine judgments, children are involved based on different levels and that 44% of the judgments are in accordance with the child´s expressed will. However, it has been difficult to read out how the child´s will has actually had a bearing on the verdict. The result also shows that factors such as age, risks and the best interests of the child affects the child´s ability to participate. In cases where the district court has not reported the child´s will or participation, no explanation or clarification is given as to why it is so.

Práva podniků při vyšetřování deliktů v soutěžním právu Evropské unie / Rights of enterprises in the investigation of delicts within EU competition lawTomicová, Jana January 2015 (has links)
As it is evident from the title, in my thesis I would like to provide an overview of the undertakings' procedural rights in proceedings under Article 101 and/or 102 of the Treaty on the Functioning of the European Union. Given the extensive investigative powers that are granted to the European Commission by the Council Regulation No 1/2003 and the consequences of being found guilty of violating Article 101 and/or 102 of the TFEU, it is necessary to ensure that the undertakings have enough ways available to exercise their right to defence and other rights and privileges guaranteed by the EU law and international treaties such as European Convention on Human Rights (e.g. the right to respect for private life). For this reason the EU law provides a range of procedural rights that should guarantee that both all the fundamental rights are observed and also serve as a system of checks and balances that prevents the misuse of the Commission's investigative powers. My thesis will focus individual rights of undertakings that are provided to them by the Council Regulation No 1/2003 and EU courts judicature. I will analyse their scope and purpose, the conditions under which they can be exercised and their limitations. Simultaneously a comparison between the rights of undertakings in the EU and U.S. legal system will...

從農業發展條例之研修檢視我國農地移轉制度 / Review on Agricultural Land Transfer System through Amendment of the Agricultural Development Act in Taiwan張志銘 Unknown Date (has links)
For joining WTO and moderating the impact of the import of agricultural products on agricultural lands use and, management and production, our government reacted by revising the Agricultural Development Act (ADA). The ADA has been revised by the Legislative Yuan on January 4 and promulgated by the Presidential Decree on January 26, 2000. The main point of the revision is to emphasis on reasonable farmland uses, effective management and adequate release of the land regulations in the agricultural policy. The main change is to adjust ADA’s principle from “the right to own and use farmland to be limited to the farmer” to “the release of the restriction on farmland transferee and realization of the substantial farmland uses.” The revision does no longer set a limit to the status and qualification of transferees and permits the transferable rights of agribusiness on some certain conditions. It is approved that the revision is to establish a more open and competitive arable land market, to improve the liquidity of arable lands, to facilitate the acquirement of arable lands for agribusiness, and to adjust the agricultural production structure. However, we should review the completeness and realization of the revised ADA after the promulgation in order to assure the agricultural development.
Therefore, the main purpose of this thesis is to probe into the change of the agricultural land policy and transfer regulation from the provisions of the revised ADA, examine the exercising of transfer system change and its influence on agricultural operation, investigate the intention of agricultural managers for reviewing the relative debates and issues, and then offer some advice as references of revision in the future. The conclusion is described as follows:
1.It is a trend of the times to adjust the transfer system that the right to own and use farmland is limited to the farmer, and the mechanism of assuring the substantial farmland uses should be realized.
2.From empirical research, the interviewees almost agree to the new agricultural land transfer system, but think that it is not useful for accelerating the liquidity and promoting the level of agricultural industry.
3.It is not significant on introducing agribusiness to be the transferee of arable lands, and it is necessary for our government to integrate too many relative and complicated laws.
4.We should review and implement the revised ADA because the rules themselves cannot provide fair incentives and effectively reduce the uncertainty from exercising it.
5.Farmers and agribusinesses lack the knowledge of relative laws, so the government should enhance them the professional training and give them consultant service.
In addition, from this research, we also found that some issues need to be studied for effective management of agricultural lands and sustainable development of agricultural industry in the future.
1.How to sound the management institution when agribusinesses want to be the transferee of arable lands.
2.How to designate important agricultural zones and establish protection mechanism.
3.Study the correlation between the agricultural product marketing class and agricultural land uses.

Specifika češtiny ruských studentů (se zaměřením na vybrané fonetické a morfosyntaktické jevy) / Characteristics of the Czech language of Russian students(with a focus on selected phonetic and morphosyntactic phenomena)Ramasheuskaya, Katsiaryna January 2015 (has links)
Language adaptation of foreigners is always accompanied by a number of problems connected to the acquisition and the use of the language which becomes the primary communicative tool in the new environment. Ignoring and underestimating these problems typical of a particular language community can result in a failure to master the target language and consequently in the unsuccessful integration in the new society. This thesis is aimed at specific problems in the area of morphosyntax and phonetics, characteristic of Russian-speaking students of Czech. At the same time, it warns about the danger of overestimating positive transfer from Russian and emphasizes the necessity of using special didactic approach in teaching this group of foreign-language speakers. The analysis of the chosen language phenomena is based on the data from the Database of the voice recordings of spoken Czech by native speakers of Russian and the Database of language mistakes in Czech made by speakers whose native language is another Slavic language, which were created, among others, for the purpose of this thesis. The attention is specifically focused on the use of the reflexive se/si, forms of the auxiliary verb to be in the past tense, short forms of personal pronouns in spoken and written production of Russian-speaking...

兒童權利公約在台灣的國內法化--以離婚後子女親權行使與兒少安置案件中兒童及少年被傾聽的權利為例 / Incorporation of the Convention on the Rights of the Child in Taiwan: With a special focus on the child’s right to be heard in child custody and care proceedings林沛君 Unknown Date (has links)
Following the coming into effect of the “Act to Implement Convention on the Rights of the Child (CRC)” on 20 November 2014, the Taiwan Government has adopted various initiatives to implement the United Nations Convention on the Rights of the Child (CRC), demonstrating the Act’s steady, yet far-reaching influence in incorporating the CRC into domestic law. In addition to harmonizing national legislation for children with the standards contained within the CRC, it is also of crucial importance for the government to ensure that children whose rights are being violated or disregarded have access to remedies, and that an effective framework is available to children to assist in the exercise and enjoyment of their rights.
Despite the fact that the Taiwan Government has promulgated four implementation acts to incorporate international human rights conventions into domestic law since 2009, several fundamental issues remain with regard to the interpretation and application of the convention. Drawing on the experiences of England, Germany, France and the United States, this thesis makes the following observations: (1) the ‘convention-compliant’ approach to legal interpretation is one of the most powerful tools by which convention rights are directly transposed into domestic legal norms and should be expressly provided for in the Act; (2) to resolve potential conflict(s) between domestic law and convention rights, the Act should explicitly state that the CRC shall prevail in cases of inconsistences; (3) the Act should provide for the establishment of a database of interpretative documents issued by United Nations treaty bodies, to aid the practice and understanding of the CRC; and (4) human rights impact assessments should be undertaken before passing any new laws or amendments.
The observations in this thesis are also based on in-depth interviews conducted by the researcher with 17 children’s practitioners. Such interviews highlight that not all children enjoy the right to be heard in family proceedings and that there is a gap between law and practice. More specifically, they highlight that “for rights to have meaning, effective remedies must be available to redress violations”; and family proceedings should be more child-centred with child-friendly designs, so that children in such settings can exercise their right to be heard effectively. This thesis also attempts to demonstrate that when mechanisms set up by the government fail to accomplish their legislative purpose and act as a safeguard for children’s rights, it is the more vulnerable groups of children (for example, children in care) who suffer from being denied the same rights as other children.
