Capricho, farsa ou imitação da realidade: discursos do direito em acórdãos de retificação de registro civil de travestis e transexuais / Caprice, farce or imitation of reality: speeches in the law on rectification of civil registry of transvestites and transsexuals

Historicamente somos identificados a partir do corpo, mais especificamente da genitália que nos classifica no padrão binário de gênero, masculino e feminino. Ao longo da história da humanidade, esta regra padroniza as formas de ser e viver e prescreve a constituição dos sujeitos, das identidades, do sexo e da sexualidade, adquirindo estatuto de verdade. Uma das grandes questões a orientar a identidade civil é o sexo. Travestis e transexuais que transitam ou atravessam as fronteiras definidas pelas normativas de sexo e gênero, caso queiram mudar de nome, têm como exigência a autorização judicial. Realizei uma pesquisa qualitativa, com o objetivo de analisar os discursos jurídicos em acórdãos de retificação de registro civil de transexuais e travestis no Tribunal de Justiça de São Paulo. O referencial teórico utilizado foram os estudos de gênero, ferramentas conceituais de Michel Foucault e aportes do campo do direito. Analisei 45 acórdãos do órgão superior do judiciário paulista do período de 2000 a 2015. Para analisar o material, tomei como inspiração Spink, ao construir de mapas temáticos. Os resultados sinalizam que as decisões, tanto para acolher, como para negar os pedidos, utilizam os saberes jurídicos e especialmente saberes médicos, pautados em um modelo biomédico de concepção da transexualidade e travestilidade. Como consequência desta fundamentação, observamos que, no campo do Direito, cristaliza-se uma concepção que moraliza e transforma as identidades de gênero não hegemônicas em patologias, como a de travestis e transexuais / Historically we are identified by our bodies, more specifically by our genitalia that classifies us in the binary gender pattern, male and female. In the course of mankinds history, this rule standardizes the ways to see and live and prescribes the constitution of subjects, identities, gender and sexuality, acquiring status of truth. On of the great questions to orient civil identity is gender. Tranvestites and transsexuals that walk by or trespass the boundaries defined by the norms of sex and gender, in case they want to change their names, have, as a demand the judiciary authorization. We conducted a qualitative research, with the intent of analyzing the judiciary speeches in judgement of retification of civil records of transsexuals and tranvestites on the São Paulo Court of Law. The theoretical referential utilized were the studies of gender, conceptual tools os Michel Foucault and contribution of the Law field. I have analyzed 45 judgements of São Paulos superior court, between 2000 and 2015. In order to analyze the material, we took as inspiration the methodology proposed by Spink, when constructing thematic maps. The results signal that the decisions, both to accomodate and to deny the requests, utilize judicial, and especially medical, knowledge, lined in a biomedical modelo f the conception of transsexuality and travesty. As a consequence of this fundamentation, we observe that, in Law, there is a crystalization that moralizes and transforms the gender identities not hegemonics in pathologies, like the ones of the tranvestites and transsexuals

Este trabalho examina modalidades intertextuais em quatro peças de Marina Carr - Low in the Dark (1989), The Mai (1994), By the Bog of Cats (1998) e Ariel (2002) -, tendo por objetivo mostrar que a obra da dramaturga, embora organicamente integrada na tradição dramatúrgica irlandesa, exibe um ponto de tensão entre o desejo de preservação de aspectos tradicionais do teatro irlandês e a rebeldia que se traduz na subversão de velhas fórmulas. Esses dois pólos entre os quais se situam as peças da dramaturga revelam-se através da paródia, da alusão, do travestimento e da reescritura, por um lado, e, por outro, através da mistura dos gêneros. As peças selecionadas evidenciam a trajetória percorrida por Marina Carr na medida em que ao mesmo tempo em que se afirmam como locais, lidam com temas que ultrapassam as fronteiras do nacional. / This thesis examines modes of intertextuality in four plays by Marina Carr - Low in the Dark (1989), The Mai (1994), By the Bog of Cats (1998) and Ariel (2002) -, and aims at demonstrating that her theatre production, although organically integrated into the Irish drama tradition, presents a point of tension between the wish to cling to traditional features of Irish theatre and the rebellion against them. These two poles between which the playwright\'s work can be defined are revealed, on the one hand, through intertextual forms such as parody, allusion, travesty and rewriting and, on the other, by the mixture of genres. The chosen plays show evidence of Marina Carr\'s trajectory insofar as they present marks of Irishness and at the same time deal with themes that are not restricted to national problems.

Escolhi trabalhar com entrevistas, a partir destas analisar as narrativas - que estão em temporalidades que se atravessam entre as décadas de 1940 ao tempo presente - pelas experiências de sexualidade, espaços praticados e as transformações estéticas dos corpos. Discuti as práticas de subjetivação que emerge das performances de si pela fluidez das noções identitárias, os sujeitos da trama traçada foram vistos pela sua contingência e historicidade. Também foram analisadas as elaborações de si, afetividades e modos de vida que se dão nas interações dos sujeitos que se dão em diversos espaços em Campina Grande e outras cidades. Por fim, problematizei as narrativas sobre os corpos, as noções de travestilidade e a multiplicidade das experiências que permitem a subve rsão das identidades como fixas e naturalizadas. Para tecer novos olhares acerca destas interações, usamos os diálogos teóricos fornecidos principalmente por Judith Butler, Michel de Foucault, Michel de Certeau e Gilles Deleuze. / This study is about sexualities narratives in the intertwining of knowledge and experiences of two protagonists in contemporary urban scene of Campina GrandePB, the transvestite Valquíria Montini and Maria de Calú, owner of the first gay bar in this city. I chose to work with interviews, analyze these narratives - that are in temporalities that crisscross between the 1940s to the present time - the sexuality studied on aspects of experience, spaces and aesthetic transformations of bodies. We also analyzed the elaborations of themselves, the affections and ways of life that occur in the interactions of the subjects that take place in different spaces in Campina Grande and other cities. Finally, we analyze the narratives of their own bodies, the notions of being a transvestite and the multiplicity of experiences that allow subversion of identities as fixed and naturalized. To weave new perspectives about these interactions, we use the theoretical dialogues by Judith Butler, Michel Foucault, Michel de Certeau and Gilles Deleuze.

This thesis is concerned with the question of gender identification in drag culture. The research, upon which this work is based, focuses on Czech drag queens that participate in drag (travesti) show in an LGBTQ+ enterprise in Prague. In my research, I have attempted to grasp the motivation of my informants to do drag, their connection to queer culture and the ways in which they create their own aesthetic on stage. With the help of these topics, I approach the problem of their gender identification, both in and out of drag. On the basis of the collected fieldwork material and relevant literature, I problematize gender identification among my informants. On the basis of such identification, I furthermore attempt to demonstrate limitations and shortcomings of the heteronormative framework of gender performativity, gender performance and gender identification in general. Masque et pouvoir : les techniques du camouflage dans le théâtre comique / Mask and power : camouflage techniques in the comic theater

Il y aurait interaction constante entre théâtre comique, masque et pouvoir que nous examinons à travers une lecture intertextuelle et comparative des pièces françaises, francophones et égyptiennes des XIXe et XXe siècles, en mettant l’accent sur les techniques de camouflage et leurs objectifs, témoins d’une continuité entre les cultures. Nous démontrons que la distanciation, bien que rattachée au monde sérieux de la dramaturgie brechtienne, excelle surtout dans le théâtre comique du masque. Ce projet comporte en fait trois parties. Dans une première partie, nous passons en revue dans le premier chapitre les métamorphoses du masque avec ses procédés en arrimant théâtre comique et notion du pouvoir. Nous posons ensuite dans un second chapitre l’assise théorique et méthodologique qui sert de base à notre étude, en abordant le théâtre du masque comme un procédé dramaturgique de distanciation. Nous examinons premièrement la distanciation à travers les zones du texte (didascalies, prologue, spectacle enchâssé), où le théâtre se dit comme tel. Nous consacrons la deuxième partie à l’exploration de tous les procédés d’étrangéisation employés par les dramaturges en vue de distancier le personnage portant le masque du pouvoir, en mettant en lumière son caractère bouffon et carnavalesque. Le travestissement sous ses divers aspects impose un rapport de forces entre les personnages qui se manifeste à travers l’échange verbal et non verbal derrière le masque ainsi que l’espace et la temporalité, et constitue un vecteur de distanciation, comme on le voit dans la troisième partie. Le cadre spatio-temporel, étant le support d’un jeu de faire-semblant, enracine la relation de domination occasionnée par le masque. Du fictif se dégage une image du réel. / There would be constant interaction between comic theater, mask, and power that we examine through a comparative and intertextual reading of French francophone, and egyptian plays from the nineteenth and twentieth centuries; focusing on the techniques of camouflage and their targets, which affirm continuity between cultures. We show that “distanciation”, although attached to the serious world of Brechtian dramaturgy, excels in the comic theater of the mask. This project comprises of three parts. In the first chapter of the initial part, we review the metamorphoses of the mask with its processes, by matching comic theater and concept of power. Then we put in a second chapter ,the theoretical basis and methodology, used as the basis for our study; addressing the theater of the mask as a dramatic process of “distanciation”. Firstly we examine the distance through the zones of the text (stage directions, prologue, & embedded shows), where the theater is presented alike. We devote the second part to the exploration of all the processes employed by the playwrights, in order to distance the character wearing the mask of power, highlighting its comic and carnivalesque aspects. The travesty in its various facets imposes a balance of power (relationship of power) between the characters. Which is manifested through verbal and non verbal exchange behind the mask ,space, and time which are vectors of distanciation (as seen in the third part). The spatio-temporal framework, being the holder of a game of make-believe, rooted the relationship of domination caused by the mask. The fictitious emerges an image of reality.

Si Marivaux est connu pour son analyse des sentiments et de la métaphysique du coeur, ses personnages, dotés d’une vie intérieure complexe, ont aussi un corps. Afin de proposer une lecture méthodique et transversale du corps, nous prenons comme corpus de départ l’intégralité des oeuvres de Marivaux, sans distinction de genre ni d’époque. Il en ressort qu’il n’y a pas un corps marivaudien, unique et systématique qui traverserait toutes les oeuvres marivaudiennes sans être affecté par le contexte de production, mais des corps qui correspondent à des époques et à des choix d’écriture. Pour établir ces ensembles génériques et chronologiques, nous nous intéressons aux particularités des différents genres littéraires (roman, théâtre, périodique, travestissement burlesque etc.) pratiqués par Marivaux et au contexte de production des oeuvres marivaudiennes (la seconde Querelle des Anciens et des Modernes, le renouvellement de l’Académie royale des sciences et le contexte philosophique de la diffusion de la théorie empiriste de Locke). / If Marivaux is primarily renowned for his in-depth analysis of feelings and his metaphysics of the heart, his characters, who have a complex inner life, also have a body. In order to offer a methodical and horizontal reading of the body, we focus on all of Marivaux’s works, without distinction of literary genre or period. There appears to be no standardized or systematic representation of the body spanning all Marivaux’s works without being influenced by the context of production, but rather, various bodies whose characteristics are informed by periods and choices of writing. In order to define these generic and chronological groupings, we explore the features of the different literary genres (novel, theater, periodical, burlesque travesty, etc.) used by Marivaux and the context of his works (Homeric Warfare, the renewal of the Royal Academy of Sciences, and the growing influence of Locke’s theory of empiricism).

Dentre eles, a estrutura e o fluxo da rede, bem como o acesso e a disponibilidade dos cuidados previstos pelas políticas públicas de saúde para a população transexual e travesti que demanda as ações, nos níveis de atenção básica e atenção especializada de média complexidade, do Processo Transexualizador no Sistema Único de Saúde (SUS). O Processo Transexualizador compreende um conjunto de ações relacionadas às transformações de caracteres sexuais de pessoas que buscam por estas intervenções. A cidade de Juiz de Fora constitui um polo de referência na assistência à saúde da Zona da Mata mineira, nas mais diversas linhas de cuidado, o que justificou a relevância social e científica da escolha deste município. Este estudo apresentou três perguntas disparadoras para o principal trabalho de investigação proposto: como funciona a Rede de Atenção à Saúde (RAS), no que se refere à linha de cuidado às pessoas transexuais e travestis, no município de Juiz de Fora? Em que medida a rede pública de saúde do principal município da região da Zona da Mata mineira, no interior do Brasil, implementa e executa as diretrizes de assistência estabelecidas pelo Ministério da Saúde para usuários/as com demanda para realização do Processo Transexualizador? E, ainda, como estas diretrizes se processam, ou não se processam, neste contexto de atenção? A perspectiva arqueogenealógica, inspirada na proposta teórico-filosófica de Michel Foucault, foi empregada como estratégia metodológica. Como os aspectos formais e dinâmicos que compõem a linha de cuidado em saúde na RAS do município pesquisado, para a população transexual e travesti, eram desconhecidos, esta metodologia mostrou-se eficiente para verificar relações de saber/poder que produzem a política pública local, em saúde, que institui o Processo Transexualizador no âmbito do SUS. Sobretudo, no que concerne às condições de operacionalização e implementação deste processo no contexto da RAS no município estudado. Como principais resultados, pode-se assinalar que os itinerários terapêuticos de pessoas transexuais e travestis de Juiz de Fora e região, em busca de cuidado em saúde, se processam de diferentes formas, mas convergem em alguns poucos e frágeis pontos de atenção que, a partir de critérios estabelecidos, foram considerados como a rede propriamente pesquisada. Constatou-se que o modo de funcionamento desta rede é efeito da maneira informal a partir da qual ela foi estruturada, tendo sido constituída sem a participação da gestão pública do município. Neste sentido, alguns importantes construtos teóricos como vulnerabilidade programática, marcadores sociais da diferença, integralidade e autonomia, sustentaram a discussão analítica desta tese. Assim, a complexa trama formada a partir dos (des)caminhos de pessoas transexuais e travestis pela rede no município, mostrou o quão desgastantes, demoradas e incertas podem ser as trajetórias em busca de cuidados à saúde para aqueles e aquelas que se colocam a caminhar à procura de saídas que deveriam ser apenas terapêuticas. / This research proposed to analyze important aspects of the operation of the health care network for transgender and travesti people in the city of Juiz de Fora/Minas Gerais (MG). Among them, the structure and flow of the network, as well as the access and availability of the care provided by public health policies for the transsexual and travesti population that demand the actions, in the levels of basic attention and specialized attention of medium complexity, of the Transsexualizing Process in the Public Health System (SUS. In Portuguese). The Transsexualizing Process is a set of actions related to sexual character transformations of people seeking for these interventions. The city of Juiz de Fora have been a reference place in the health assistance of the area of Zona da Mata, in the most diverse lines of care, which justified the social and scientific relevance of the choice of this city. This study presented three questions for the main research work proposed: How does work the Health Care Network (RAS, in Portuguese), as regards the line of care for transgender and travesti people, in the city of Juiz de Fora? How does the public health network of this region, in the interior of Brazil, implement and execute the guidelines of assistance established by the Ministry of Health for users with demand for the realization of the Transsexualizing Process? In addition, how do these guidelines are processed, or do they are not processed, in this context of attention? The Arqueogenealogy perspective, based on the theoreticalphilosophical proposal of Michel Foucault, is our methodological strategy. The formal and dynamic aspects that make up the health care line in the RAS of the researched area, for the transsexual and travesti population, are unknown, so this methodology proved to be efficient to verify knowledge/power relationships that produce public policies in health, establishing the Transsexualizing Process inside the SUS. Above all, about to the conditions of operation and implementation of this process in the context of RAS in the city studied. As the main results, it can be noted that the therapeutic itineraries of transsexuals and travestis from Juiz de For a and region, in search of health care, appearing in different ways, but converge in a few fragile points of attention that, according established criteria, were considered to be the network properly researched. This study found that the way of operation of this network is result of their informal construction that having been constituted without the participation of public management from the city. Some important theoretical constructs such as programmatic vulnerability, social marks of difference, integrality and autonomy, sustained the analytical discussion of this thesis. Thus, the complex web formed from the (dis)paths of transgender and travesti people by the network in the city, showed how stressful, time consuming and uncertain can be the trajectories in search of health care for those who put themselves to walk in search of ways that will should only be therapeutic.

Cross-gender casting (i.e. the casting of female performers for male parts and vice versa) of plays by William Shakespeare is not a scarce phenomenon and is getting more and more popular in the recent years. In spite of the frequent claim of the theatre-makers and critics that it is in fact a gender blind casting, where the gender of the performer does not matter, the thesis attempts to prove that, in fact, it is not the case. This is exemplified on three most frequently staged and also most commonly cross-gender cast plays: Hamlet, King Lear and Romeo and Juliet. Via these examples the thesis shows the variability of approaches to cross-gender casting and the differences in realization. In the first chapter, the key terminology is defined, in order to avoid confusion, discussing the differences between cross-dressing, travesty and cross-gender casting. That is followed by subchapters in which the basic frame of thought is suggested, building on Judith Butler's deconstruction of gender and the concept of gender performativity. The last subchapter of this section deals with the history of cross-gender casting, including the Elizabethan all-male staging tradition.
