Esta pesquisa buscou refletir sobre o mal-estar na civilização e a crise na educação como geradores de um possível esvaziamento da autoridade da palavra do professor, permitindo o desdobramento de duas principais perguntas: O esvaziamento da autoridade da palavra poderia afetar o esvaziamento do enigma que permite a aprendizagem? As mudanças na aprendizagem, que às vistas da contemporaneidade parecem ser inevitáveis, podem vir a ser benéficas de alguma forma para os sujeitos contemporâneos? Para responder a essas perguntas, buscamos, na teoria psicanalítica e na área de Psicanálise e Educação, elucidar a crise e o mal-estar ao qual estamos nos referindo e o quanto as mudanças no modo de vida dos sujeitos influencia o discurso que circula na Educação. Para refletir sobre esses pontos, dedicamo-nos a entrevistas semidirecionadas realizadas com oito professores da rede pública municipal de São Paulo com o intuito de analisar em suas falas, possíveis indícios do esvaziamento da autoridade de sua palavra nesse ambiente de crise. Pudemos constatar que o mal-estar na cultura é estrutural e a crise na Educação é somente um dos tentáculos do mal-estar inerente à condição humana moderna. O esvaziamento da autoridade da palavra seria, portanto, um mais-além da crise, que se manifesta como não sendo estrutural para o sujeito, e sim uma consequência da forma com a qual os sujeitos lidam com a influência dos discursos (técnico-científico e da ciência) que, por sua vez, esvaziam o enigma da palavra, tornando-a toda, ou seja, o significado passa a estar colado à palavra e ao objeto que a ela faz referência. Buscou-se compreender o quanto o esvaziamento da palavra afeta os professores na sala de aula e também como podemos pensar o esvaziamento deste sentido todo da palavra para um sentido não-todo. Nas entrevistas, pudemos constatar que os professores apontam para um esvaziamento da autoridade de sua palavra, que seria o esvaziamento do peso da palavra do professor no discurso social. Seu direito de falar estaria esvaziando-se, já que não há nada que o sustente no lugar de professor que professa suas palavras. Concluímos que a palavra do professor não engancha mais no aluno. Concluímos também que esvaziar a palavra de seu enigma torna-se nocivo para o professor e para o aluno, porém, esvaziar-se da intenção de capturar um sentido totalizante da palavra pode vir a ser benéfico para os sujeitos da Educação. / The aim of the present study was to reflect on the malaise in civilization and the crisis in education as generators of a possible emptying of the teacher\'s word of authority. This research allowed to deploy two main questions: is the emptying of the word of authority could affect the emptying of the riddle that allows learning? Do these changes in learning, -that seem to be inevitable to the contemporary view - may turn out to be beneficial in some way to the contemporary subjects? To answer these questions we seek in psychoanalytic theory and in the area of Psychoanalysis and Education in order to elucidate about which crisis and which malaise we are talking about and how the changes in the subjects\' way of life influences the discourse that circulates in Education and the teachers. We also dedicated ouselves on semi-directed interviews with eight teachers from the city of São Paulo in order to analyze evidences on the emptying of the teacher\'s word of authority inside this crisis environment. We observed that the malaise in culture is structural and the crisis in education is only one of the tentacles of the malaise and both are inherent in modern human condition. The emptying of the authority of word would therefore be a \"beyond\" the crisis, which manifests itself as not being structural to the subject, but a consequence of how the subjects deal with the influence of discourses (technical-scientific and science ) that want to empty the riddle of the word, making it \"whole\", that is, the meaning is henceforth glued to the word and the object that it references. We tried to understand how the words emptying process affects the teacher in the classroom and also how we could consider this emptying process of the word from a whole to a not whole way of thinking. In the interviews we found that the teacher points to an deflation of the authority of his word, that would be the emptying of the weight of the teacher\'s word in social discourse. Their right to speak would be getting emptying, since there is nothing to hold or support the professors place. Thus, we conclude that the word of the teacher does not hook over the student. We also conclude that empty the word of his riddle becomes harmful to the teacher, however, emptying the intention to capture a totalizing sense of the word may prove to be beneficial to the subjects of Education.

Trata-se de investigar a autoridade civil como fruto de convenção e artifício, bem como a sua relação com o estabelecimento da lei e do comércio no pensamento de Hume. A influência recíproca entre o artifício político e estes dois elementos é abordada como produtora de liberdade, que diz Hume no ensaio Da origem do governo ser a \"perfeição da sociedade civil\". A ideia, assim, é expor como a autoridade, inicialmente arbitrária, concorre não apenas para a superação de problemas de cooperação e escassez, como também se mostra passível de uma ordenação geradora de regularidade, liberdade e florescimento humano. / This is an investigation of political authority as a product of convention and artifice, as well as of its relation with the establishment of law and commerce in the thought of Hume. The reciprocal influence between the political artifice and these two elements is addressed as productive of regularity and liberty, which Hume describes in the essay Of the Origin of Government as being the perfection of civil society. Thus, the idea is to show how authority, initially arbitrary, concurs not only in the overcoming of cooperation and scarcity problems, but also reveals itself as liable to an order generative of liberty and human flourishing.

O argumento central deste trabalho é de que há uma interface entre a mudança na forma de resolução dos conflitos familiares (com o declínio do patriarcado e o reconhecimento legal de relações familiares menos hierárquicas) e a maior presença do Poder Judiciário na sociedade. A partir deste pressuposto, tendo como material empírico as percepções de magistrados que atuam área de família, e Max Weber como principal referencial teórico, demonstra como o declínio da autoridade tradicional faz com que os conflitos familiares demandem mais intensamente às decisões judiciais, produzindo uma “racionalização da intimidade”. Os magistrados intervêm nesses conflitos exercendo uma autoridade legitimada tanto racional como carismaticamente. A conclusão do trabalho é de que a forma como se constitui a demanda – racionalizando a intimidade – e o exercício da autoridade do magistrado – racional e carismática – indicam que os conflitos familiares são exemplos da jurisdicionalização das relações sociais. / The interface between the change in the form of the family conflict resolution (after the decline of the patriarchate and the legal recognition of less hierarchical familiar relations) and a bigger presence of the Judiciary Power in the society is the central question of this work. From this pretext, using as empirical material the perceptions of the magistrates who act in the family area and as main theoretical referential Max Weber, it demonstrates how the decline of the traditional authority makes the familiar conflicts to demand more intensely for sentences producing a “rationalization of the privacy”. The magistrates intervene in these conflicts exerting a legitimated authority as rational as charismatic. The conclusion of the work is that the form as if it constitutes the demand, rationalizing the privacy, and the exercise of the authority of the magistrate, charismatic and rational, indicate that the familiar conflicts are examples of the juridictionalization of the social relations.

Com o aumento dos usuários acessando a internet no Brasil, cresce a quantidade de conteúdo produzido por brasileiros. Assim se torna importante classificar os melhores autores para que se tenha mais confiança nos textos lidos. Nesse sentido, esta dissertação faz um estudo sobre a descoberta de autoridades em tópicos na blogosfera brasileira. O escopo de estudo e análise é a plataforma de publicação de blogs, Blogspot, sobre os blogueiros que se identificam como brasileiros. Para tanto, foram coletados nove milhões de postagens do ano de 2012 e considerados os comentários como fonte de relacionamento entre os blogueiros para gerar uma rede social. Essa rede foi usada para experimentos do algoritmo de identificação de autoridades em tópicos. O algoritmo utilizado como base é o Topic PageRank, separando os diversos tópicos da blogosfera pelas tags que os usuários definem em suas postagens e posteriormente construindo a lista das autoridades em tais tópicos. Experimentos realizados demonstram que o método proposto resulta em melhor ranqueamento que o algoritmo original do PageRank. Cabe salientar que foi feita uma caracterização dos dados coletados por um questionário aplicado a quatro mil autores. / With the intesification of users accessing the Internet in Brazil, the amount of content produced by Brazilians increases. Thus, it becomes important to classify the best authors to have more confidence in the texts read. In this sense, this work presents a study on subject of topic authorities discovery in the Brazilian blogosphere. The scope of the study is the Blogspot platform, focusing on bloggers who identify themselves as Brazilians. To this end, we collected nine millions posts in the year of 2012 and considered the comments as a source of relationship between bloggers to generate a social network. This network was used for performing experiments considering the proposed approach to identify topic authorities. The algorithm used is based on the Topic PageRank, which can separate the different blogosphere’s topics by tags that users use on their posts, and then building the list of authorities on such topics. The experiments conducted show that the proposed approach results in better ranking than the original PageRank algorithm. We also characterize the collected database with a survey of over four thousand authors.

Pensar na Infância e na Adolescência hoje nos conduz a refletir sobre as transformações pelas quais tem passado a Família, considerada desde o ideal moderno como principal responsável pelos cuidados com as crianças e adolescentes, bem como sobre o surgimento do Conselho Tutelar como instituição criada para garantir os direitos dos menores de dezoito anos. Inspirado nos estudos oriundos da Psicologia Social Contemporânea e da Psicopedagogia Clínica, este trabalho teve como objetivo investigar a circulação do saber e o processo de produção de resistência e autoria de pensamento, considerando-se o momento de encontro entre conselheiros tutelares e famílias sobre as quais pesam denúncias de não oferecerem a devida proteção às crianças e adolescentes sob suas responsabilidades. O estudo contou com a participação de dois conselheiros tutelares e de integrantes de quatro famílias, bem como de profissionais de instituições de ensino. A pesquisa teve caráter qualitativo, sendo empregada metodologia de inspiração etnográfica, o instrumento escolhido foi o diário de campo, que descreveu os encontros entre os envolvidos, para posterior análise. As conclusões apontaram para o risco de que o Conselho Tutelar possa estar constituindo-se como uma instituição cuja prática seja a de responsabilizar, individualmente, as famílias por dificuldades construídas socialmente, ao invés de zelar pelos direitos das crianças e adolescentes, buscando sua garantia. Nesse contexto, tanto por parte dos conselheiros tutelares, como dos membros das famílias, a resistência tende a apresentar-se de forma bastante velada e a autoria de pensamento, na maioria das vezes, impossibilitada. / Thinking about childhood and about adolescence today guide us to reflect about transformations the family – considered since the Modern ideal as the main responsible for taking care of children and of teenagers - has passed, as well as about the appearance of the Child Protection Council, as an institution created in order to guarantee the under age’s rights. Inspired with studies from Contemporary Social Psychology and from Clinic Psychopedagogy, this paper had as objective an investigation about the knowledge surround and the process of resistance production and thought authority, considering the moment of the meeting between council members and families that had been accused of not offering all due protection to the children and to the teenagers under their responsibility. The study counted on two council members participation and on members of four families, as well as on professionals from schools. The search had a qualitative character, it was utilized a ethnographic inspiration methodology, making use of fieldnotes in order to describe the meetings between the people involved for later analysis. The conclusions pointed to the risk of having the Child Protection Council constituting itself as an institution whose practice is to make the family responsible, individually, by socially built difficulties, instead of watching over the children and adolescents rights, searching its guarantee. In this context, both to the Council Members and to the family members, the resistance tends to present itself in a hidden way and the thought authority, almost always, disabled.

Esta pesquisa analisa o projeto Pacto Pelo Rio Grande, fórum de discussões criado pela Assembléia Legislativa do Estado do Rio Grande do Sul em 2006, com o propósito de buscar soluções consensuais para a crise financeira do Estado. Partindo da compreensão sobre a importância da visibilidade e da produção de imagem para a obtenção do apoio, do consentimento e da legitimidade da opinião pública na contemporaneidade, essa dissertação mostra como o projeto serve para configurar mecanismos de exposição de atores políticos em busca de visibilidade e produção de imagem em nome da convergência de interesses. Os objetivos foram atingidos por meio do estudo histórico-descritivo e do exame sobre as estratégias de comunicação e do discurso utilizados em três esferas distintas de visibilidade pública: a comunicação institucional (Assembléia Legislativa), a propaganda institucional (Pacto pelo Rio Grande) e a repercussão jornalística (jornal Zero Hora). / The present survey analyzes a project called 'Pacto pelo Rio Grande', a discussion forum created by the Legislative Authority of the estate of Rio Grande do Sul, in 2006, with the purpose of building consensual solutions for the economic crisis in the Estate. Starting from the understanding about the importance of visibility and construction of a certain image in order to obtain support, and of the consensus and legitimacy of public opinion nowadays, this thesis shows how the mentioned project serve as a mechanism to expose the political actors searching for visibility and as a way to produce a certain image that could influence public interests. The outcomes of the present work were reached throughout a historical study as well as an exam of the communication strategies and speeches found in three different spectrums of public visibility: the institutional communication (Legislative Authority), the institutional marketing (Pacto pelo Rio Grande) and the repercussion on the News (Zero Hora).

O estudo sobre o tema proposto no presente trabalho somente se tornou possível a partir da mudança paradigmática introduzida pela Constituição Federal de 1988. Ao consagrar a dignidade da pessoa humana como fundamento do Estado Democrático de Direito, a Constituição Federal colocou a proteção do ser humano como valor central do ordenamento jurídico, estabelecendo princípios norteadores do direito de família, tais como o da solidariedade, da igualdade, do pluralismo das entidades familiares e do melhor interesse da criança e do adolescente. É nesse contexto que surge o princípio da afetividade, sobre o qual as relações familiares, em especial a de parentalidade, devem estar baseadas. Trata-se, contudo, de princípio cujo conteúdo é de difícil delimitação. Isso porque sua expressão é o afeto, usualmente entendido como sinônimo de amor, o que o desvincularia de qualquer dever jurídico. Ocorre que o princípio da afetividade não se relaciona à ideia de sentimento, mas à dedicação que os pais devem ter com a criação e a formação dos filhos menores, o que se dá por meio de comportamentos pró-afetivos. Refere-se, assim, ao cumprimento dos deveres de ordem imaterial do poder familiar, quais sejam o de criação, educação, companhia e guarda, que efetivamente colocam os filhos sob a proteção e o amparo dos pais. O descumprimento voluntário e injustificado desses deveres caracteriza o abandono afetivo. Porém, se o vínculo afetivo é rompido em decorrência da conduta do genitor guardião, que impede a convivência familiar, não há abandono afetivo, eis que descaracterizado pela prática de alienação parental. Configurado o abandono, questiona-se a possibilidade de se aplicar o instituto da responsabilidade civil à relação de parentalidade. Na hipótese dos pais que abandonam afetivamente os filhos menores é plenamente possível que todos os elementos da responsabilidade civil subjetiva conduta contrária à ordem jurídica, culpa, dano e nexo causal se façam presentes, surgindo, por conseguinte, o dever de indenizar os danos morais e materiais causados. / The study about the theme proposed in this work only became possible due to the paradigmatic change introduced by the Federal Constitution of 1988. By approving the human dignity as a Democratic Rule of Law foundation, the Federal Constitution set the human being protection as the central value of the legal system, establishing principles of family law, such as solidarity, equality, pluralism of family forms and best interest of child. It is in this context that arises the principle of affectivity, on which family relationships, especially the parental one, must be based. It is, however, a principle whose content is difficult to delimit. That is because its expression is the affection, generally understood as synonym of love, what would detach it from any legal obligation. Yet, the principle of affectivity is not related to the idea of feeling, but to the dedication that parents must have with the raising and development of their young children, which occurs by pro-affective behaviors. It refers, therefore, to the fulfillment of the immaterial duties of the parental authority, namely raising, education, company and custody, which effectively put children under protection and support of parents. The voluntary and unjustified breach of these duties characterize the affective abandonment. Nevertheless, if the affective bond is broken due to the guardian behavior that forbids family relationship, there is no affective abandonment as it results from the parental alienation. Characterized the abandonment, it is questioned the possibility of applying the liabilitys institute to the parental relationship. In the case of affective abandonment it is entirely possible that all liabilitys elements breach of duty, fault, damage and factual causation be present, resulting, as a consequence, in the duty to indemnify the moral and material damages caused.

A presente pesquisa visa uma análise aprofundada da cooperação jurídica internacional no campo da adoção internacional, bem como um estudo sobre os efeitos deste tipo de adoção na nacionalidade da pessoa adotada. Pesquisar os procedimentos e regras que compõe o arcabouço jurídico da cooperação internacional em matéria de adoção, e verificar como Brasil e Japão realizam a integração desta pessoa legalmente em seus sistemas jurídicos. É cada vez mais crescente o número de refugiados em países em constantes crises humanitárias e onde crianças morrem diariamente por motivos como a inanição, doenças sem tratamento e como vítimas de guerras civis intermináveis. A adoção internacional é, portanto, um dos instrumentos internacionais e humanitários que permite a aproximação de casais que buscam constituir ou ampliar uma família, e crianças espalhadas pelo mundo desejosas para terem um lar e uma família, é a aplicação da cooperação jurídica internacional em prol da solidariedade. Diretamente relacionado com o instituto da adoção internacional, a preocupação de qual será a nacionalidade que o adotado terá após a decisão que concederá a adoção em definitivo. Esta análise se torna relevante, pois a pessoa adotada após todos os procedimentos legais da adoção passará a responder e a viver em um novo universo jurídico, com deveres e direitos novos para ela. Fica a preocupação de se os direitos e deveres dessa pessoa serão os mesmos que os demais nacionais do país que a acolheu. / This research aims at a deep analysis of international legal cooperation in the field of international adoption, as well as a study on the effects of this type of adoption at the nationality of the adopted person Research the procedures and rules that make up the legal framework for international cooperation in the field of adoption, and see how Brazil and Japan do the lawfully integration of the person in their legal systems. It is increasingly growing number of refugees in countries listed in humanitarian crises and where children die daily for reasons like starvation, disease and without treatment as victims of endless civil wars International adoption is therefore an international, humanitarian approach which allows couples seeking establish or expand a family, and children scattered around the world willing to have a home and a family, is the application of international legal cooperation for solidarity. This study uses the concepts of authority and family as historical categories in order to apprehend the significance of these categories over the development of the authority crisis. The research also focus the importance of authority to the subjectivity formation, performing a theoretical research of bibliography. It is argued that the paternal function can ensure the constitution of subjectivity through Oedipus formations that draw social spheres and ensure the permanence of community life, expound the symbolic father character. Therefore, the crisis of authority only threatens the imaginary father. Because there is a law, that establishes the subject and also the culture. / Esta dissertação tem como objetivo investigar as implicações da crise da autoridade na modernidade, defendida por alguns autores das ciências sociais e políticas, no processo de formação subjetiva que se efetiva a partir da operação simbólica do Nomes-do-Pai. Este estudo parte dos conceitos de autoridade e família, enquanto categorias históricas a fim de apreender as correlações entre o seu lugar social e o desenvolvimento da crise. Para tanto, parte de uma pesquisa teórica de cunho bibliográfico em que se busca investigar a importância da autoridade na formação subjetiva, discutindo como a função paterna se relaciona a esse processo. A reflexão parte do exame das formações edípicas que constituem o sujeito que compõe a esfera social, e que garante a continuidade da vida em comunidade, esclarecendo, assim, a função do pai em seu caráter simbólico. Assim é possível elaborar que a crise de autoridade pode sim colocar em xeque o pai, mas apenas enquanto pai imaginário, visto que a existência do sujeito implicará também a existência de uma sociedade, e que essa mútua existência implicará uma lei que a funde, a lei que a metáfora paterna denúncia: a lei que funda o sujeito, mas que também funda a cultura.

The relationship between education and authority is understood in this study from the perspective of psychoanalysis. A relação entre educação e autoridade é compreendida neste estudo sob o prisma da psicanálise. Foram realizadas observações de crianças em interação com suas professoras em um agrupamento de Educação Infantil. Tendo por princípio que a psicanálise não se presta a uma aplicação imediata à situação escolar, o trabalho ressalta algumas possíveis contribuições dessa ciência para a compreensão da questão da autoridade na Educação Infantil, a começar pelo reconhecimento dos processos inconscientes presentes na relação criança-adulto.
