Diese Dissertation zielt darauf ab, ein besseres Verständnis für Anomalien und Insiderhandel zu schaffen, sowie die Verfügbarkeit von qualitativ hochwertigen Daten für den deutschen Aktienmarkt zu verbessern. Der erste Aufsatz beinhaltet eine verzerrungsfreie Zeitreihe von monatlichen Renditen deutscher Aktien für die Jahre 1954 bis 2013, die auf der Basis stabiler Regeln berechnet und gut dokumentiert ist. Im Weiteren enthält der Aufsatz eine detaillierte Beschreibung des deutschen Aktienmarktes und dessen Besonderheiten, insbesondere im Vergleich zu den USA. Der zweite Aufsatz zeigt am Beispiel des Fama/French Drei-Faktoren-Modells die Probleme auf, die Anbieter und Nutzer von Faktorendaten haben, die sich nicht auf die USA beziehen. Die empirische Analyse von sieben Faktorensets für Deutschland zeigt, dass die Übernahme von Faktormodellen in einen anderen Kapitalmarkt eine komplexe Thematik ist. Der Aufsatz gibt Anregungen für Nutzer und Anbieter von Faktorensets und zeigt, wie die Wahl des Faktorensets das Ergebnis einer Studie beeinflussen kann. Im dritten Aufsatz werden verschiedene zyklische und antizyklische Handelsstrategien hinsichtlich ihrer Performance im deutschen Aktienmarkt untersucht. Von den untersuchten Strategien erscheint nur Momentum konsequent abnormale Renditen zu erzielen, dies auch nach Transaktionskosten. Die vierte Arbeit untersucht öffentlich bekannt gegebene Aktientransaktionen von Insidern börsennotierter deutscher Unternehmen. Der Aufsatz zeigt, dass Insider von TecDAX-Unternehmen und ihre Imitatoren hohe und statistisch signifikante abnormale Renditen erzielen. Insgesamt zeigt die Dissertation, dass methodische Variationen, die Verwendung verschiedener Untersuchungsdesigns, die Datenqualität und die Sorgfalt beim Erstellen von empirischen Analysen zur Beurteilung der Robustheit und der Stabilität der Ergebnisse unerlässlich sind. Der deutsche Aktienmarkt scheint effizienter zu sein als bisherigere Studien typischerweise nahelegen. / This doctoral thesis aims to contribute to a better understanding of stock market anomalies and insider trading as well as to improve the availability of high quality data for the German stock market. The first paper provides a sixty-year time series of monthly returns on German stocks that is constructed on the basis of stable rules, is well documented, includes all return components, and is free of biases. The paper also contains a detailed description of the German stock market, its peculiarities, regulation and differences as compared to the U.S. The second paper uses the Fama/French three-factor model as an example to point out the problems that providers and users of non-U.S factor data sets face. The empirical analysis of seven different factor data sets available for Germany shows that exporting a specific factor model from the U.S. to another capital market is neither an easy nor well-defined task. The paper gives suggestions to users and creators of factor sets and shows how the choice of a factor set affects the result of an empirical study. The third paper provides evidence on how various contrarian, momentum and seasonality strategies perform in the German stock market. Among these strategies, only momentum investing appears to earn persistently non-zero returns, even after transaction costs. The fourth paper studies publicly disclosed stock transactions by insiders of listed German firms. The paper finds that insiders of TecDAX firms earn large and statistically significant abnormal returns net of transaction costs; for DAX insiders they are indistinguishable from zero. Overall, this thesis illustrates that methodological variations, the use of different specifications, data quality and care when preparing empirical analyses is essential in the assessment of the robustness and stability of results. In sum, the German stock market appears to be more efficient than previous studies have typically suggested.

Governing Through Competency: Race, Pathologization, and the Limits of Mental Health OutreachTam, Louise 29 November 2012 (has links)
This thesis examines how cultural competency operates as a regime of governmentality. Inspired by Foucauldian genealogy, institutional ethnography, and Said’s concept of contrapuntality, this thesis problematizes the seamless production of racialized bodies in relation to mental disorder. I begin by elaborating a theoretical framework for interpreting race and madness as mutually constructed ordering practices. I then analyze what cultural competence produces and sustains in a position paper published by the Ontario Federation of Community Mental Health and Addiction Programs. I argue the Federation dismisses ongoing institutional violence—suggesting it is simply the perception, as opposed to the everyday reality, of discrimination that causes problems such as low educational attainment among youth of colour. To further support this claim, I deconstruct narratives of low self-esteem, maladaptive coping, depression, and denial of mental illness in the community needs assessments of two of the Federation’s member organizations: Hong Fook and Across Boundaries.

通訊監察區分為「犯罪通訊監察」及「情報通訊監察」二大種類,犯罪通訊監察須針對特定犯罪活動而為之偵查行為,而情報通訊監察則係針對外國勢力及其工作人員危害國家安全之行為而為國家預警情報作為。世界各民主先進國家在將通訊監察法治化及透過實際案例之修正後,逐步建立起類似之通訊監察立法通則,如比例原則、令狀原則監察、透明化、保護隱私權益、重罪原則、特定性、補充性原則等,幾已成為犯罪通訊監察法治不可違逆之普世價值; 然在情報通訊監察部分,各國則因歷史背景之不同,其情報通訊監察法治發展是不一而足,其法律保留、授權密度、證據能力、救濟及監督方式皆大相逕庭。
我國情報通訊監察規範於民國88年與犯罪通訊監察一併規範於「通訊保障及監察法」中,條文規範略嫌簡略,依據民國100年修正之國家情報工作法,立法政策將朝向情報通訊監察單獨立法邁進。
為探討我國情報通訊監察制度之現存問題,本文研究分析美國「外國情報通訊監察法(The Foreign Intelligence Surveillance Act of 1978,FISA)」及德國「G10法(Gesetz zur Beschränkung des Brief-, Post- und Fernmeldegeheimnisses,Gesetz zu Artikel 10 Grundgesetz – G10)」之情報通訊監察法治,與我國現行規範加以比較,並對未來設立專法提出建議。 / Electronic surveillance can be divided into criminal surveillance and intelligence surveillance. Different from the intelligence surveillance, criminal surveillance should be solely engaged in for specific criminal law enforcement purposes. Intelligence surveillance is directed at the acquisition of the contents of communications transmitted by means of communications used between or among foreign powers for the purpose of national security. Through the electronic surveillance legalization process of the advanced democracy countries, we can summarize a few principles such as the principle of proportionality, warrant, privacy, felony, particularity and complementarity which have became the universal value of the criminal surveillance. Nevertheless, the development of the intelligence surveillance in each country is by no means an isolated case because of the different background. They are different from law reservation, the intensity of judicial review, admissibility and judicial remedy, etc.
In 1999, the rules of intelligence surveillance were regulated in Communication Protection and Monitoring Law with criminal surveillance, and the regulations of the intelligence surveillance are sort of incomplete. According to the amendment of the National Intelligence Services Law of 2011, the independent legislation of intelligence surveillance is imperative in future.
In order to solve the problems of intelligence surveillance in Taiwan, the thesis introduced and compared the “The Foreign Intelligence Surveillance (FISA)” in the U.S.A, and the “Gesetz zur Beschränkung des Brief-, Post- und Fernmeldegeheimnisses,Gesetz zu Artikel 10 Grundgesetz (G10)”in Germany with the Communication Protection and Monitoring Law in Taiwan. Hopefully the thesis could provide the directions of the independent legislation of intelligence surveillance in future.

Utilizing dyadic brief gestalt play therapy within an unstable adolescent foster placementTerrapon, Wendy 11 1900 (has links)
In the experience of being a play therapist and social worker, the researcher became aware of the breakdown of adolescent foster placements. Although there are many causal factors of adolescent foster care breakdown, it was the treatment and sustaining of these placements that the researcher was interested in. The utilization of dyadic brief Gestalt play therapy aims to support the relationship between the carer and adolescent in order to sustain and stabilize the foster placement.
The empirical study includes data collection and analysis. The data was gathered through observations and field notes from unstructured interviews, in this case the dyadic therapeutic process with the adolescent and carer. The data was then analyzed, and eleven outcomes were discussed: the building of a therapeutic relationship, the process of dialogue, the gaining of awareness, contact, resistance, the internal working model, polarities, working in the here and now, the utilization of Gestalt experiments and Gestalt play therapeutic techniques. In addition, the implications of the brief Gestalt therapeutic model were identified. These themes are discussed fully in the final chapter encompassing conclusions and recommendations.This study found that it was possible to work effectively with the adolescent and carer in a dyadic brief Gestalt therapeutic way utilizing play therapy techniques. An ethnographic exploration of intrapersonal, interpersonal and intra-group conflict management interventions in an institution of higher educationVan Niekerk, Adriana Martha Maria 10 1900 (has links)
This study explores the world of human conflict in the workplace, the workplace (in this case) being a South African university. Using the academic tools of ethnography and autoethnography, I investigate the dimensions of human conflict management, which include intrapersonal, interpersonal and intra-group conflict management, from a psychological perspective. In this thesis I refer, in particular, to examples and extractions taken from case studies that focus on conflicts between employees. In doing so I used an eclectic, psychodynamic theoretical frame of reference. The data was collected and processed over a period of fourteen years. Another focus of this thesis is my reflections on my personal development as a counselling psychologist specialising in intrapersonal, interpersonal and intra-group conflict management within an institutional organisation. The participants‟ stories revealed intense emotional experiences and I have put forward suggestions on how these experiences could be explored and dealt with by means of psychologically orientated techniques and interventions within the boundaries of the ethical codes and values of counselling psychology. My eclectic choice of brief psychotherapy, strengths-based counselling, and psychodynamic-based intrapersonal, interpersonal and intra-group interventions are included in my personal narrative. This study serves only as a guideline to other counselling psychologists who deal with human conflicts in similar situations. I have not tried to present a generalised theory. In this study, I argue strongly that there is indeed a place for counselling psychologists and the application of psychological knowledge in the world of human resources departments in organisations. I believe that counselling psychologists can operate, alternatively, as individual counselling psychologists, workshop facilitators and co-facilitators, as consultants, and as members of multidisciplinary teams to address, among other, conflict management in a tertiary institution. / Psychology / D.
