Bakgrund: Allt fler arbetsgivare inför individbaserad lönesättning för att kunna attrahera, knyta an och utveckla rätt kompetens och därigenom hantera de alltmer komplexa produktionsprocesserna och den växande konkurrenssituationen. Individuell lönesättning antas stimulera medarbetarnas arbetsmotivation vilket i sin tur bidrar till ökad arbetsprestation och förbättrat resultat för företaget. Systemet förutsätter dock att medarbetarna upplever lönesättningen som rättvis för att den individbaserade lönen ska få den avsedda effekten. Motivation och rättvisa är emellertid subjektivt, inrymmer flera element och tenderar ge lönen en relativ betydelse vilket gör utformningen av ett individbaserat lönesystem komplext. Syfte: Syftet med studien är att beskriva och analysera förhållningssätt hos aktörerna: företag, fack och medarbetare gällande individuell lönesättning, rättvisa och motivation. För att därigenom kunna jämföra och koppla samman aktörernas förhållningssätt och peka ut faktorer som kan främja arbetet med att utforma ett lönesättningssystem med inslag av individbaserad lönesättning som ska fungera motiverande, upplevas rättvis och bidra till ökad prestation. Metod: Studien bygger på en kvalitativ metod där empirin har samlats in genom intervjuer, enkäter samt analys av sekundärdata. Studien har ett fallföretag som utgångspunkt där informanter och respondenter har utgjorts av representanter från fack och företag samt anställda inom företaget. Datainsamlingsmetoderna och datainsamlingskällorna hanterades genom triangulering. Slutsatser: Studien visar att alla aktörer har ett positivt förhållningssätt till individbaserad lönesättning samt att det finns ett flertal gemensamma nämnare aktörerna emellan. Bland annat tycker alla aktörer att kompetens ska utgöra den främsta bedömningsgrunden, att högre lön är motiverande samt att ett transparent och tydligt lönesystem med lönekriterier som alla känner till och förstår är en förutsättning för att lönesättningen ska upplevas som rättvis och motiverande. Därtill pekas den lönesättande chefen ut som central för upplevelsen av rättvisa vid lönesättning samt att alla medarbetare ska få inflytande och likvärdiga förutsättningar att kompetensutvecklas och därigenom kunna höja lönen. / Background: More and more employers are introducing performance-based wage-setting in order to attract, connect and develop competence and in addition handle the increasingly complex production processes and the growing competitive situation. Performance-based setting is assumed to stimulate employees´ work motivation, which in turn contributes to increased work performance and improved results for the company. However, the system presupposes that employees perceive wage setting as fair in order for the performance-based salary to have the intended effect. Motivation and justice are subjective, contain several elements and tend to give the salary a relative significance, which makes the design of an performance-based salary system complex. Purpose: The purpose of the study is to describe and analyse the attitudes of the actors: companies, unions and employees regarding performance-based wage setting, justice and motivation. In order to thereby be able to compare and connect the actors' attitudes and point out factors that can promote the work of designing a wage setting system with elements of performance-based wage setting that must function motivatingly, be perceived as fair and contribute to increased performance. Method: The study is based on a qualitative method where the empirical data has been collected through interviews, questionnaires and analysis of secondary data. The study has a case company as a starting point where informants and respondents have consisted of representatives from the union and the company as well as employees within the company. The data collection methods and data collection sources were handled by triangulation. Conclusions: The study shows that all actors have a positive approach to performance-based wage setting and that there are several common denominators between the actors. Among other things, all actors think that competence should be the main basis for assessment, that higher pay is motivating and that a transparent and clear salary system with defined criteria that everyone have knowledge about and understand is a prerequisite for a salary setting to be perceived as fair and motivating. L'effet de l'allongement de la durée des conventions collectives sur les relations du travail locales en entreprise

Cette recherche s’intéresse au phénomène qu’est l’allongement de la durée des conventions collectives. Avant juin 1994, la durée maximale d’une convention collective était fixée à trois ans. La venue de la mondialisation a chamboulé les entreprises qui, elles, pour s’adapter et survivre à cette nouvelle réalité et demeurer compétitives, ont dû procéder à des investissements majeurs, des restructurations, miser sur des relations de partenariat avec les syndicats, etc. (Boivin, 1998). Pour ce faire, elles devaient s’assurer d’obtenir une stabilité et une paix industrielle (Grant et Paquet, 1998). C’est à ce moment que nous avons vu l’apparition d’ententes qui visaient à prolonger la durée maximale des conventions collectives, fixées à trois ans, sans contrevenir aux différentes dispositions du Code du travail (L.R.Q. c.C-27). Ces « contrats sociaux » devaient compter différentes caractéristiques particulières. C’est le 10 mai 1994 que le législateur québécois a déplafonné la durée des conventions collectives (Mayer, 1999). Tel qu’établi, les transformations au niveau de l’environnement ont poussé les acteurs à revoir leurs façons de faire. Cela a mené à une déconflictualisation des relations du travail (Jalette, Bourque et Laroche, 2008). Les acteurs ont adopté des stratégies de négociation de plus en plus coopératives, ils ont eu un recours accru à la concertation, et ont développé une relation de partenariat (Maschino et coll., 2001). Nous observons en parallèle à une tendance à l’allongement de la durée des conventions collectives. Nous nous questionnons à savoir ce qui a principalement motivé autant les syndicats à négocier ce type d’entente et ainsi, renoncer à leur droit de grève, et aussi quels sont les avantages ou inconvénients pour les employeurs de négocier de telles ententes. De manière plus spécifique, notre question de recherche est la suivante : Quels sont les effets de l’allongement de la durée des conventions collectives sur les relations du travail locales en entreprise? Notre analyse vise à vérifier six propositions de recherche : 1- Les relations du travail sont transformées par la durée d’une convention collective de travail, laquelle est influencée par l’environnement. 2- L’allongement de la durée des conventions collectives de travail amène les parties à davantage recourir à des stratégies de négociation intégrative. 3- L’allongement de la durée des conventions collectives de travail contribue à diminuer le nombre de conflits de travail 4- L’allongement de la durée des conventions collectives de travail change la nature des manifestations du conflit sur le marché du travail. 5- L’allongement de la durée des conventions collectives transforme le contenu des conventions collectives de travail par l’intégration de clauses nouvelles. 6- L’allongement de la durée des CCT diminue le rapport de force du syndicat. Dans le but de répondre à ces différents questionnements, nous avons utilisé une méthodologie qualitative de recherche et plus précisément, l’étude de cas. Cette dernière fut conduite en trois étapes : la préparation, la collecte de données et l’interprétation (Merriam, 1998). Les données de notre étude ont été colligées durant l’été et l’automne 2010. Tout d’abord, nous avons effectué des entretiens semi structuré à l’aide d’une grille d’entrevue. Cette grille d’entrevue fut adaptée en fonction des acteurs rencontrés, et surtout de la partie qu’ils représentent. Nous avons interrogé les acteurs tant patronaux que syndicaux, c’est-à-dire : du côté patronal, nous avons rencontré les responsables des relations du travail oeuvrant au siège social ainsi que les conseillers en relations du travail en charge de négocier ou d’appliquer la convention collective des différents établissements couverts par l’étude. Du côté syndical, nous avons rencontré les conseillers syndicaux en charge également de négocier la convention collective et de veiller à son application. Au total, nous avons mené onze entretiens. En guise de comparaison, nous avons aussi procédé à une analyse de contenu de 139 conventions collectives du secteur de l’alimentation. Nous cherchions à savoir si les conventions collectives de longue durée avaient tendance à comporter majoritairement une plus grande présence de clauses en lien avec les 7 caractéristiques des « contrats sociaux » mentionnées par Mayer (1999). Ces caractéristiques sont les suivantes : transparence économique et de gestion, participation à la gestion, programme de qualité totale, formation, flexibilité dans l’organisation du travail, stabilité de l’emploi et mécanismes de gestion de l’entente. The maximum duration of a collective agreement used to be three years. With the advent of globalization, all has changed drastically. In order to survive and remain competitive, businesses have had to adjust to this new paradigm by investing massively, restructuring, building on renewed partnerships with the unions and the like (Boivin, 1998). To succeed, it was imperative that they foster a climate characterized by stability and industrial peace (Grant and Paquet, 1998). Thus, they started to sign agreements seeking to extend the maximum duration of collective contracts (usually three years), while abiding by the provisions of the Code du travail (L.R.Q. c. C-27). These so-called « social covenants » had to embody various specificities. Then, on May 10, 1994, the Québec government lifted the ceiling on the duration of collective agreements (Mayer, 1999). As previously mentioned, increased globalization, with its attending changes, spurred all stakeholders to modify their ways of doing business. Labor relations were no longer a major source of conflict (Jalette, Bourque and Laroche, 2008). Negotiation strategies were increasingly steeped in cooperation and consensus-building, and the negotiating parties developed a relationship akin to a partnership (Maschino et al., 2001). At the same time, the duration of collective agreements has started increasing. We will examine what motivated the unions to negotiate such agreements, thus surrendering their right to strike and also whatever benefits – or drawbacks – such a trend held in store for the employers. More specifically, we will endeavor to find out: What are the effects of increasing the duration of collective agreements on local labor relations? For the purpose of our analysis, we have formulated the following research hypotheses: 1. Labor relations undergo transformations as a result of the duration of a collective agreement being increased; said duration hinging on the business climate. 2. With longer-term collective agreements, negotiating parties apply better co-operative strategies. 3. Longer-term collective agreements reduce the number of labor conflicts 4. Longer-term collective agreements change the way these conflicts play out in the workplace. 5. Longer collective agreement periods transform collective agreement contents by the addition of new provisions. 6. Longer-term collective agreements weaken the unions negotiating position. While aiming to address the aforementioned hypotheses, we have opted for a qualitative research methodology, namely the case study. The process involved three steps: data preparation, collection and interpretation (Merriam, 1998). The data we used were collected over the summer and fall of 2010. First, we conducted semi-structured interviews using a specific interview grid, which we adjusted according to individual respondents and, first and foremost, the parties they represented. Thus, we interviewed stakeholders from both sides, unions and employers. On the employers’ side, we met labor relations specialists working out of head offices as well as labor relations consultants responsible for negotiating or enforcing the collective agreements in force in various organizations covered by our study. On the union side, we met with union representatives who were also responsible for negotiating or enforcing the collective agreements. Eleven interviews were conducted in total. As a means of comparison, we also analyzed the content of 139 collective agreements in the food sector. We wanted to determine if most long-term collective agreements tended to include a greater amount of provisions related to the seven elements typical of the « social covenants » mentioned in Mayer, 1999. These are: economic and managerial transparency, shared management, total quality programs, training, work-planning flexibility, employment stability and collective agreement management processes. This paper is about a current Collective Labour Law matter of debate, which is the provenance of the extension of collective labour agreements of minority unions in favor of the non-unionized workers. To start, the authors point the constitutional basis of the Collective Labour Law.Likewise, they refer that exists a strong dualism regarding the acceptance of the extension of the collective agreements signed by a minority union. They arrive to this conclusion after reviewing some of the Peruvian Labour case law, as well as some administrative pronouncements on this field. Finally, they conclude saying that is possible that the collective agreement it be extended, provided that the right of union freedom is not affected. / El presente trabajo versa sobre un tema de debate en la actualidad del Derecho Colectivo del Trabajo, el cual es la procedencia de la extensión de convenios colectivos de trabajo de sindicatos minoritarios a favor de trabajadores no sindicalizados. Para empezar, los autores señalan la base constitucional del Derecho Colectivo del Trabajo. Asimismo, indican que existe mucho dualismo entorno a la aceptación de la extensión de los convenios colectivos suscritos por un sindicato minoritario. Llegan a esa conclusión luego de haber revisado unos casos de la jurisprudencia laboral peruana, así como de pronunciamientos administrativos sobre el tema.Finalmente, concluyen que es factible que se extienda el convenio colectivo, siempre y cuando no se vulnere el derecho de libertad sindical.

Collective agreements : a comparative study between Belgium and South Africa

This dissertation analyses, in a comparative perspective collective agreements entered into in Belgium and in South Africa in the private sector. It is divided into three parts: Belgian law, South African law and a comparative perspective. Each part adopts the same format: it comprises a historical survey, a description of the parties to collective agreements, the forums in which collective bargaining takes place and an analysis of collective agreements, focusing on the nature of their binding force. Because Belgian law prohibits agency shop and closed shop agreements, on the basis of the freedom of association, no reference has been made to these agreements, even though they are permitted in South Africa and are regarded as collective agreements. This dissertation does not deal with collective agreements entered into to regulate terms and conditions of employment in the public sector as state employees in Belgium are excluded from the scope of labour law and have their employment relationship governed by administrative law / Law / LL.M.

The Swedish regulation of competition clauses has since 1969 partly been made in a collective agreement from Svenskt Näringsliv ” Överenskommelse angående begränsning av användningsområdet för och innehållet i s.k. konkurrensklausuler i tjänsteavtal”. The collective agreement has had a strong influence on the Swedish market, on the Labour Court and in law. In 2015 Svenskt Näringsliv signed a new agreement ”Avtal om användning av konkurrensklausuler i anställningsavtal.” The new agreement from 2015 brings a broader area of application of competition clauses to employment agreements.   Through the study of law as well as the two collective agreements this paper intends to establish when competition clauses in employment contracts can be used in accordance with 38§ Lag (1915:218) om avtal och andra rättshandlingar på förmögenhetsrättens område (avtalslagen). The paper will also examine if the agreement from 2015 is to be considered reasonable in light of 38§ avtalslagen. The study will be fulfilled with support of the following research questions; To what extent is it possible to use competition clauses according to ”Svenskt Näringslivs avtal om användning av konkurrensklausuler”  and 38§ avtalslagen?    Does the content of ”Svenskt Näringslivs avtal om användning av konkurrensklausuler” fulfill the fairness requirements in 38§ avtalslagen?

<p>The aim of this thesis is to use a power perspective to describe the workers’ struggle for co-determination in the Swedish labour market during the period 1890–1939. The study explores how trade unions in general attempted to limit article 23, which asserted employers’ control over hiring and dismissal. At the same time the study clarifies differences in union power between various groups of workers. The prevalent historical view regarding the distribution of power in the labour market is thus questioned.</p><p>The study shows that workers were not powerless before the Saltsjöbaden agreement in 1938. In certain areas workers, through their unions, already at the beginning of the 20th century had fairly good possibilities of influencing both hiring and dismissal. Collective agreements that were entered into before the defeat of the workers in the great conflict in the Swedish labour market in 1909, as well as collective agreements signed during the 1920s and 1930s, can make both the Saltsjöbaden agreement and present-day regulations look “hostile to workers”. In collective agreements workers achieved considerable limitations of employers’ arbitrary freedom to hire and dismiss workers. Certain unions could control their labour market efficiently by means of a labour exchange of their own. The development, however, varied over time and between different trade unions. Business cycles generally influenced how much power unions could exert. Access to power resources and other conditions varied between different workers’ groups. While some attained considerable power over hiring and dismissal, others had no possibilities of taking part in decision-making.</p>

為落實勞工團結權、團體協商權及爭議權,我國於2007年起陸續修正《工會法》、《團體協約法》及《勞資爭議處理法》,於2010年5月1日起施行,且參考美國與日本之立法,建立不當勞動行為裁決機制,以保障勞工權利不受侵害。 勞動三法修正對於集體勞資關係帶來重大影響,其中一項即為誠信協商制度之導入。根據修正後《團體協約法》第6條第1項之規範:「勞資雙方應本誠實信用原則,進行團體協約之協商;對於他方所提團體協約之協商,無正當理由者,不得拒絕。」規定今後勞資任一方若向他方請求協商時,他方不僅有回應的義務,且須以誠實信用原則為之。由於此制度我國尚處於起步之階段,許多問題須進一步檢討釐清。 因此,本文首先說明目前《團體協約法》所規範之團體協商制度,再從裁決委員會之裁決決定書當中,整理及分析我國實務上拒絕誠信協商之態樣。另外,再輔以說明美國法上誠信協商義務以及協商事項之重要類型、提供協商中必要資料義務之範圍,作為對我國誠信協商制度之啟示。 / To implement the right of employees to organize, bargain collectively, and strike, the government has revised “Labor Union Act”, “Collective Agreement Act” and “Act for Settlement of Labor-Management Disputes” since 2007, and finally has been in place since May 2011. In addition, the Labor Dispute Resolution Scheme for unfair labor practices also be structured by reference to the legislation of United States and Japan, to protect people from unfair labor practices. One of the biggest influences in the collective labor-management relations after the Legal amendments is to establish the principle of bargaining in good faith. According to Section 1 of Article 6 of the newly amended Collective Agreements Act, both the labor and the management shall proceed in good faith when bargaining for a collective agreement; any party without justifiable reasons cannot reject the collective bargaining proposed by the other party. Because it’s the first time to implement the institution in Taiwan, there are many questions in need of clarification. Therefore, this Article intends to introduce the collective bargaining scheme under the current Collective Agreements Act, and also sort out the decision of the Labor Dispute Resolution Scheme for unfair labor practices, attempt to analysize of the aspect of refusing to bargain in good faith in the practice. Moreover, the article is supplemented by the obligations and the important types of bargaining in good faith, the obligation of providing information necessary for the bargaining in the process in Unites States labour law, expected to have implications in Taiwan.
