Relações incestuosas: poder, violência sexual, moral e "artimanhas" da justiça. Uberlândia, 1940-1970

The purpose of this paper is analyze crime-processes related to cases of sexual violence caused by fathers against daughters with ages between zero and seventeen years old at the decades of 1940, 1950, 1960 and 1970, in the city of Uberlândia at the state of Minas Gerais. Were used registries presented on the records to examine the relationship between imaginary of fear, construction and deconstruction of the notion and concept of what violence is, speech and juridical actions, silence and obscurity involving incest, power relations that exist in these practices, among others. Studies was made about the existence of a moralist and conservative speech that seem to intend on reversing the roles of each individual involved in such crimes, in other words, to transform victims into defendants and accused into victims. In this context, was possible to discuss the role of forensic medicine in justice s performance before a sexual violence crime. Afterwards, the text brings an argumentation about a specific juridical record, which makes us think about how the appropriation of moral values that exists on our society was made by the juridical speech. And so, we can understand a little of how the legal processes works, how the juridical speech is created, and how the victims are in a certain way silenced. / A proposta desse trabalho é de analisar processos-crime relacionados a casos de violência sexual perpetrada por pais contra filhas, sendo essas com idade entre zero e dezessete anos, no período que abrange as décadas de 1940, 1950, 1960 e 1970, na comarca de Uberlândia, no estado de Minas Gerais. Foram utilizados os registros presentes nos autos para analisar a relação existente entre o imaginário do medo, a construção e a desconstrução do conceito e noção do que é a violência, o discurso e as práticas jurídicas, o (s) silêncio (s) e a obscuridade em torno do incesto, as relações de poder que permeiam estas práticas, entre outras. Foi feito um estudo da presença de um discurso moralista e conservador que parece ter a intenção de inverter os papeis de cada envolvido, ou seja, transformar a vítima em ré e o acusado em vítima. Neste contexto, foi possível discutir o papel da Medicina-legal na atuação da justiça diante de um crime de violência sexual. Posteriormente, o texto traz uma discussão sobre um processo, em específico, que é capaz de nos levar a pensar sobre como é feita a apropriação dos valores morais presentes em nossa sociedade pelo discurso jurídico. E assim, podemos compreender um pouco do funcionamento jurídico, de como o discurso jurídico é montado, de como os sujeitos vitimados são, de certo modo, silenciados. / Mestre em História

The methodology used here was the qualitative one. To collect the information/data needed, it was created a scrapbook . This photography album was developed in order to help introduce the sexual abuse issue to the women who have agreed to talk about and share this family drama they have all been through. Attempting to approach whatever subjects that could be possibly related to the purposes of this work, it was also added a semi-guided interview. We tried to observe the various ways these women/mothers react whenever having their children sexually abused by their own men, as well as the kind of relationship they keep with these men/aggressors. The results go to show that there is an ideal concept of family: dad, mom and kids living altogether. This ideal concept, however, is left behind as soon as the incestuous abuse situations are revealed. We were able to confirm that domestic violence is also a very important part of this whole perversion process (and when it comes to conjugal relationships, it can be expressed in many different ways, such as: physical aggressions, economic subordination or even possessive jealousy). Conjugality is commonly idealized as a relation of affection, companionship and respect. But this kind of perception changes as the incestuous abuse cases are uncovered. Inside the the parenthood experience itself, our analysis could verify that there are genuine love bonds between these moms and their children. These love bonds, inevitably, tend to become more fragile (or even break) as a result of whatever new circumstances that might appear once the incestuous perversion is revealed. All women interviewed here expressed the practice of parenthood as an affection relation, which seemed to be strong enough to overcome each and every adversity they have experienced. To these women, motherhood itself represents a very important basis used to consolidate their own identities. We understand that this work is relevant to help emphasize our society needs in terms of public administration and management. We also expect this study can contribute to stimulate the institutions and centers which support victims of sexual abuse to offer some sort of aid to all those who have been involved in situations of incestuous perversion (including the women and mothers who decide to denounce their men, once this being done, they are the ones who have their lives entirely changed emotionally, affectively and economically speaking) / Este estudo pretendeu compreender como são vivenciadas a parentalidade e a conjugalidade na experiência de mulheres/mães cujos companheiros praticaram abuso sexual incestuoso em relação aos seus filhos/as. A metodologia utilizada foi qualitativa. Como instrumentos para a coleta de informações, construímos um álbum de fotografias que serviu como estímulo para introduzir, junto às colaboradoras, um assunto tão difícil para quem viveu a dor de tal experiência. Acrescentamos uma entrevista semidirigida, como meio de focarmos os conteúdos relacionados aos nossos objetivos. Procuramos observar as formas como essas mulheres/mães se relacionam com os seus companheiros e com os/as filhos/as vítimas do abuso sexual incestuoso. Os resultados mostram que existe um ideal de família que se constituía de pai, mãe e filhos, que se quebra com a revelação do abuso sexual incestuoso. Podemos constatar que a violência perpassa as relações conjugais antes da revelação do incesto, expressando-se no domínio do companheiro sobre essas mulheres de modo mais explícito com agressões físicas, controle econômico ou ainda, mais sutilmente, através de um ciúme possessivo. A conjugalidade é idealizada como relação de afeto, companheirismo e respeito. Essa relação foi repensada após a revelação do abuso sexual incestuoso. Na experiência da parentalidade, verificamos, em nossas análises, a ocorrência, no exercício e na prática, de relações de amorosidade entre mães e filhos e essas relações passaram a se estabelecer de modo difícil em função das novas circunstâncias suscitadas, a partir da revelação de práticas abusivas. Em todas as mulheres entrevistadas, constatamos o exercício e a prática da parentalidade como relação de afeto, sobrepondo-se às situações adversas vividas por elas, cuja maternidade representa um valor na constituição de suas identidades. Consideramos a importância desse estudo para enfatizar a necessidade de consolidação das políticas públicas já existentes e, também, da sociedade civil no sentido de incluir, no atendimento a vítimas de abuso sexual, um espaço de acolhimento a essas mulheres/mães que denunciam os seus companheiros e passam a ter uma vida de privações no âmbito emocional, afetivo e econômico-material

Maltraitance infligée à l'enfant : difficultés et freins à la prise en charge médico-légale : étude comparée entre France et Syrie / Abuse inflicted on the child : difficulties and obstacles to forensic care : a comparative study between France and Syria

Cette thèse, développée dans une approche comparatiste et différentialiste de la maltraitance faite à l'enfant (0 à 18 ans), en France et en Syrie, concerne la médecine légale, inscrite dans un contexte d'éthique médicale. La problématique initiale évoque le signalement de la part du médecin, et ses freins, question qui débouche sur l'interrogation suivante : Comment la décision du médecin, toujours première, peut-elle intégrer la dimension psychologique et socioculturelle de la maltraitance, pour que les conséquences du signalement (ou du non signalement) soient au bénéfice de l'enfant et sa famille ? L'Histoire et l'évolution de la maltraitance à enfant sont exposées, pour les deux pays (peu d'informations pour la Syrie). L'enfant, sujet vulnérable, est considéré dans sa globalité psychologique et socioculturelle, face aux données afférant à sa protection. Ensuite, l'approche médicale (tableaux cliniques de maltraitance le plus couramment observés), suivie de la prise en charge globale de l'enfant, dans les sociétés française et syrienne, sont exposées. Enfin, les aspects juridiques de la protection de l'enfant, face au signalement et ses freins, sont présentés comme relevant d'une problématique éthique, située entre médecine et droit, dans des espaces socioculturels spécifiques. Ces données prennent concrètement corps dans des études de cas cliniques, en service de médecine légale : CHU de Dijon, en France, et Centre hospitalier de la région d'Alep, en Syrie (synthèse de Dao sur 249 cas, en 2002, compte tenu de la situation politique actuelle). Via le témoignage du Dr. Catherine Bonnet, cette étude s'ouvre sur un approfondissement des questions du viol et de l'inceste, et met en lumière certaines difficultés à déboucher sur des décisions judiciaires qui, bien que correctes du côté du droit, peuvent s'avérer délétères pour l'enfant et sa famille, sur les plans psychologique, affectif et social ; la situation des deux pays est différenciée, ici aussi. La conclusion, d'ordre moral et éthique, renvoie à la responsabilité de la famille (bientraitance et éducation de l'enfant) et au constat d'une articulation difficile entre le travail du médecin et les décisions judiciaires qui devraient permettre un vrai soin et une protection efficace de l'enfant maltraité, question qui suscite notre interrogation finale : À l'échelon mondial, faudrait-il élaborer une législation commune, spécifique pour l'enfant ? / This research is a comparative and differential approach of child abuse (0-18 years), in France and Syria. It concerns forensic medicine in the context of medical ethics. The initial issue evokes the reporting abuse and its obstacles, and leads to the following question: How the always main decision of the doctor can integrate the psychological and socio-cultural dimension of child abuse in order that the reporting (or the no reporting) benefits the child and family? The history and evolution of child abuse are exposed, for both countries (some information only for Syria). The child, subject vulnerable, is considered as a psychological and sociocultural entity, as to his/her protection. Then, the medical approach (clinical cases of abuse commonly observed), and the medical management of the child are exposed in the French and Syrian societies. Finally, the legal aspects of child protection are reported with its obstacles as part of an ethical issue, between medicine and law, in specific socio-cultural dimensions. These data are updated in the study of clinical cases, in forensic services: CHU of Dijon, in France, and one hospital, in the area of Aleppo, in Syria (Dao’s synthesis of 2002, on 249 cases, given the current political situation). Then, considering the testimony of the Dr Catherine Bonnet, this study opens the reflection on rape and incest, and highlights some difficulties due to certain judicial decisions which, although correct in view of the law, may be deleterious for the child and his family, if we consider a psychological, emotional and social point of view. Both countries situation is differentiated, again. The moral and ethical conclusion refers to the responsibility of the family (welfare and education of the child). It also refers to a difficult relationship between the doctor’s practice and the judicial decisions that should allow a true care and an effective protection of the abused child. This issue arouses our final questioning: at the world level, perhaps it may be necessary to develop a specific legislation for the child ?

Cette thèse se concentre sur les expériences des personnages féminins qui représentent les jeunes mères Afro-Américaines, dans le film biographique, Roxanne Roxanne, basé sur l’artiste de rap Lolita Shante Gooden; et dans le roman Push, de Sapphire, nom de plume de Ramona Lofton. Contrairement aux générations précédentes, aujourd’hui les féministes noires de la quatrième vague du féminisme analysent ce que les féministes hip-hop ont essayé de développer depuis la deuxième vague de féminisme. Le féminisme hip-hop permet d’examiner des questions liées à la misogynie de la culture hip-hop et parmi d’autres points concernent les femmes noires dans cet espace. Quel rôle jouent les hommes? Et qu’est-ce que cela représente dans un cadre culturel plus large? Comment les mères et les filles sont-elles représentées et affectées? Comment les enfants de ces femmes sont-ils touchés, et quelle dynamique se déroule alors dans la relation mère-fille? Mes questions servent à approfondir des sujets qui sont sous-explorées dans les études de hip-hop. Le livre The New Jim Crow par l’activiste des droits civiques et avocate Michelle Alexander est fondamental dans le contexte de ce mémoire. Les informations historiques de l’enquête d’Alexander sur la campagne américaine, « The War on Drugs », dévoilent le système de criminalisation raciale aux États-Unis et ses infrastructures sociopolitique et économique. Ce système est conçu pour contrôler la population noire depuis l’époque de la traite transatlantique des esclaves. Les œuvres hip-hop féministes ne contribuent pas seulement à augmenter la sensibilisation sur les sujets intimes pour les Afro-Américaines; mais elles aident aussi à exposer les idéologies sexistes et raciales qui privent le corps féminin noir de ses droits dans la culture populaire. / This thesis focuses on the lives of female characters that left young mothers fending for survival in two works: the biopic, Roxanne Roxanne, based on rap artist Lolita Shante Gooden; and, the novel Push, by Sapphire—pen name of Ramona Lofton. Unlike previous generations, today’s fourth-wave black feminists analyze what hip-hop feminists have been trying to develop since the second wave of feminism. Hip-hop feminism enables the examination of issues related to the misogynoir of hip-hop culture, and the struggles black females encounter in this space. What role do men perform? And what does this represent within a larger cultural framework? How are mothers and daughters portrayed, and affected by hip-hop culture? How are the children of such females impacted, and what dynamic then takes place in the mother-daughter relationship? My questions serve to dig deeper into topics that are underexplored in hip-hop gender studies—specifically in working-class urban communities. Fundamental to my exploring hip-hop feminist issues is my reliance on The New Jim Crow, by civil rights activist and lawyer, Michelle Alexander. Using historical insight from Alexander’s investigation on the War on Drugs, my thesis unveils the racial criminalization system in the United States, and the larger socio-political and economical infrastructure designed to control the black population since the transatlantic slave trade. The conditions of impoverished black communities, in turn, sabotage the development of black females. Feminist hip-hop works not only contribute to creating awareness about intimate, gendered issues; but also, they help further challenge racialized ideologies that disenfranchise the black female body in popular culture.

In der zimbawischen Literatur sind die Themen Nation, Körper, Gewalt, Sprache und Erinnerung aufs engste miteinander verbunden. Durch den Einfluß von Yvonne Vera hat sich in den 90er Jahren das Bild des weiblichen Körpers und insbesondere die Diskussion um koloniale und postkoloniale Gewalt deutlich verändert. Im ersten Teil der Arbeit geht es um die Frage nach Nation. Unterschiedliche Darstellungen von Nehanda und den Kämpferinnen des 2. Chimurenga werden näher beleuchtet. Außerdem geht es um Veras "pastoral novel" in der sie von einer weißen Farmersfrau erzählt. Im zweiten Teil geht es um die Körperkonzepte in der zimbabwischen Literatur. Gewalt in der Familie und vor allem der weibliche Körper als Schlachtfeld steht hier im Mittelpunkt. Die Vergewaltigte und die Prostituierte sind auch weiterhin Symbole für den kolonisierten afrikanischen Kontinent. Vera versucht diese Frauen aus einer anderen Perspektive zu betrachten. Bei ihr geht es um die Erfahrung der Frauen selbst. Der dritte Teil der Arbeit befasst sich schließlich mit der Frage nach der Darstellbarkeit von Gewalt. Wie ist es möglich von Gewalt zu erzählen, ohne die Gewalt zu reproduzieren? Vera beantwortet diese Frage mit der Reflexion über des Erzählen. Bei ihr wirkt Sprache heilend. / In Zimbabwean literature, the themes of nation, body, violence, language, and memory are closely connected. The dissertation analyses, how the treatment of these themes changed significantly during the 1990s. The focus lies on Yvonne Vera's work and its influence on the image of the female body and the debate about colonial as well as postcolonial violence. The first part deals with the question of nation at the example of various narratives about Nehanda and other female freedom fighters in the Second Chimurenga. Further material is drawn from Vera's "pastural novel", in which she tells about a white settler woman. The second part looks at body concepts in Zimbabwean literature. Special attention is paid to domestic violence and the image of the female body as battlefield. The raped woman and the prostitute are still widely used as symbols for the colonized African continent. Vera tries to break with this tradition by looking at such female characters from the perspective of their own experiences. The third part, finally, raises the issue of the representation of violence. How is possible to write about violence without reproducing it? Vera answers this question by reflecting about narration. Language thus works as a healing power in her texts.
