Da ineficácia e da revogação dos atos praticados pelo devedor antes da decretação da falência

Focusing on the ineffectiveness and repeal of acts performed by the debtor before the bankruptcy - either as a result of the failure of his/her attempts of reorganization , whether as a result of direct petition of the dissatisfied creditor - the study also comprises the objective , principles and innovations governed by law 11.101/2005 (Bankruptcy Law) . The legal safeguarding of the creditors' rights does not begin on the date of the reorganization petition or declaration of bankruptcy of the insolvent entrepreneur. It extends up to the final legal solution to such business crisis and dates back to the period that precedes the petition of reorganization or the bankruptcy filing. Such assumptions for protection of the creditors rights affected by practices that precede the adjudication of bankruptcy will also be reviewed in this dissertation. Some of the practices of an entrepreneur facing a crisis, justified by the fear of imminent breakdown, could have been considered legal if not for the adjudication of bankruptcy. These are subject of judicial intervention to remove their effectiveness or have them revoked, as a protection to the creditors rights .Such scenario imposes a legal defense against predatory acts of the entrepreneur facing a crisis. This leads to the study of the hypotheses of objective inefficiency and the particulars of the revocation suit till reaching the exceptions to the possibility of declaration of ineffectiveness by the bankruptcy judge. Legal transactions with potential to enforce the attendance of one of the creditors to the detriment of others has received special attention from the legislature which has resulted in a number of practices considered ineffective in relation to the bankrupt estate ( articles 129 , I to VII ) . Besides these legal hypotheses, article 130 of the law decrees the ineffectiveness of any transaction made by the debtor before bankruptcy when it is proven that such practices intend to harm creditors / Esta pesquisa tem por finalidade estudar as medidas jurídicas adotadas pela legislação brasileira para amenizar o insucesso da atividade empresarial e as suas externalidades. Com foco na ineficácia e na revogação dos atos praticados pelo devedor antes da falência quer como resultado do fracasso das suas tentativas de recuperação, quer como resultado de pedido direto de credor não satisfeito o estudo envolve ainda os objetivos, novidades e princípios que regem a Lei n.11.101/2005 (Lei Falimentar). O resguardo legal dos direitos dos credores não começa na data do pedido de recuperação ou de decretação da falência do empresário insolvente, mas se estende até a final solução jurídica da crise empresarial e retroage a período anterior à data do ingresso do pedido de recuperação ou do requerimento de falência. E são essas hipóteses de resguardo do direito dos credores atingidos por atos anteriores à decretação da quebra que também serão avaliadas nesta dissertação. Algumas das condutas do empresário em crise, justificadas pelo temor da quebra iminente, e que poderiam ser consideradas lícitas se não sobreviesse a decretação da falência, são suscetíveis de intervenção judicial para lhes retirar a eficácia ou revogá-las, como medida de proteção aos direitos dos credores. O cenário impõe a defesa judicial contra a ação predatória do empresário em crise e leva ao estudo das hipóteses de ineficácia objetiva e das particularidades da ação revocatória até chegar às exceções à possibilidade de decretação de ineficácia pelo juiz falimentar. Os negócios jurídicos com potencial de fazer prevalecer o atendimento a um dos credores em prejuízo dos demais receberam do legislador uma atenção especial que resultou numa relação de condutas consideradas ineficazes em relação à massa falida (art. 129, I a VII). Além destas hipóteses legais, o art.130 da lei decreta a ineficácia de qualquer negócio realizado pelo devedor, antes da quebra quando provada a prática de atos com a intenção de prejudicar credores

Mainly intending to exam the public comprehension - people who participated of the mentioned actions - about the cultural and archeaological heritage placed in that region, and also reflect on the valorization of this heritage by the local population, that was made interviews with twenty inhabitants of the Vale dos Sonhos Condominium Area, those people who activitly participated of the educational process. This is an exploratory and descriptive case study, whose research instruments were the semistructured interview and documentary analysis. The technique for studying the results was the speech graphic analysis. / O “Bem Arqueológico e a Educação Patrimonial no Vale dos Sonhos” foi o tema do presente trabalho, o qual objetivou analisar o alcance das ações educativas desenvolvidas no “Projeto de Resgate Arqueológico do Sítio Vale dos Sonhos, Goiânia-GO” que foram realizadas entre 2001 e 2003 no Residencial Vale dos Sonhos por especialistas da Universidade Católica de Goiás. Com o principal propósito de examinar a compreensão do público – participante das referidas ações – acerca do patrimônio cultural arqueológico situado naquele local, bem como refletir sobre a valorização atribuída ao mesmo por tal população, foram realizadas entrevistas com vinte moradores do Residencial Vale dos Sonhos que participaram de forma efetiva dessas ações. Este é um estudo de caso de caráter exploratório e descritivo, cujos instrumentos de pesquisa foram a entrevista semiestruturada e a análise documental. A técnica para investigar os resultados foi a análise gráfica do discurso.

A linguagem visual desta dissertação também ajuda na observação das alterações ocorridas na praça e nos imóveis que a delimitam, posto que a imagem fotográfica constitui-se em importante instrumento de investigação histórica, para identificar novos objetos e novos problemas, além de indicar aqueles que permanecem ao longo dos anos. Pretende-se analisar alguns dos projetos já desenvolvidos para a área, com base nos respectivos tombamentos existentes no Centro Histórico da cidade. Espera-se, dessa forma, poder verificar e analisar as ações de proteção realizadas pelos órgãos responsáveis pela salvaguarda do patrimônio cultural, verificando se existe compatibilidade de critérios e de ações. Este estudo procura, também, diagnosticar os problemas atuais da praça e ressaltar a importância de sua manutenção, para a memória histórica e arquitetônica de Belém. / Do Largo das Mercês à Praça Visconde do Rio Branco: um estudo de gestão do patrimônio Histórico em Belém do Pará, 1941-2011, proposes to conduct an analysis of the management of organ preservation at the local, state and federal in Belém, Pará, from a study on the square and immediate surroundings (houses surrounding it) in order to observe the evolution of the characterization and conservation of the architectural, urban and landscape from the 1940s to the present day. The visual language of this dissertation allows the observation of the changes and continuities that occurred in the square and bounding properties, since the photographic image, as well as other sources and visual objects, is in important historical research tools to identify new objects and new problems and indicating those that remain over the years. It is intended that the analysis of the current characterization of the set, compared with the same configuration at the time of their respective legal protection indicate how the organ preservation’s work is being done to protect the cultural heritage, checking for compatibility criteria and actions, and ownership of the square by society. This study also seeks to diagnose the current problems of the square and the importance of maintenance for the architectural and historical memory of the city Belém.

Pas plus que le Grand Paris aujourd’hui en préparation, l’éphémère premier Grand Paris envisagé dans les années 1910-1920 ne parut placer la protection du patrimoine au rang de ses priorités. Pourtant, une tentative en ce sens eut bien lieu. L’ambition d’œuvrer selon des principes que l’on était encore loin d’appeler « urbanisme patrimonial » suscita la création, un demi-siècle avant le vote des lois Malraux, d’un outil d’urbanisme original, le « Casier archéologique et artistique de Paris et du département de la Seine ».L’étude de cet inventaire architectural et urbain, constitué entre 1916 et 1928, a porté sur un double enjeu. Le premier consistait à replacer le Casier archéologique, qui apparait aujourd’hui comme un objet isolé, dans la perspective du Grand Paris pour lequel il avait été conçu, dans son articulation avec les politiques urbaines et patrimoniales alors en cours d’élaboration comme dans la pluridisciplinarité de son élaboration. Le second visait à retracer l’évolution des processus d’élaboration du Casier archéologique, de la création d’un outil d’urbanisme patrimonial novateur à sa transformation en un inventaire d’un format plus classique, mais à l’échelle du Grand Paris. / No more than the Grand Paris today in the making, the first and ephemeral Grand Paris which was envisioned during the years 1910-1920 did not seem to place protection of heritage among its priorities. However, an attempt in that direction was clearly made. The ambition to act according to ideas which at the time, were still far from being called Heritage Urbanism’s principles, brought upon the creation of an original Urbanism tool, half a century before the Malraux’s laws were voted : the “Casier archéologique et artistique of Paris and the Seine’s department.”This architectural and urban inventory, established between 1916 and 1928, was studied with a double focus. The first was to place the Casier archéologique – an object that now seems isolated – back into the Grand Paris’s perspective in which it had been designed for, recalling its articulation with policy-making underway at the time on urbanism and heritage, as well as the multidisciplinarity of its constitution. The second was to retrace the evolution of the Casier archéologique’s elaboration, from its creation as an innovative tool of Heritage Urbanism, to its transformation as an inventory with a more classic format, but on Grand Paris’s scale.

Schwarzenbergs, a noble family coming from Lower Franconia, settled down from 1660 in the end in Czech countries. Jan Adolf Schwarzenberg bought manor Třeboň at that time. At the beginning of eighteenth century split the family to two anchestries. Submitted dissertation insists on the researches in the archive files completed with specialized publicatons. The text is composed of three units. Opening part gives us the specification and characteristics of the used archival resorces and literature. The second part is divided to the several chapters. The first chapter discuss the family history and land effects expansion. The third chapter describes the complicated administrative agency. The fourth chapter introduces patrimonial clerkdom including their personal and professional lives. The fifth chapter is dedicated to Josef Bohdanecký, the principal forester of the forest management in Orlík. He came to be known by his forest crop protection project, so called Orlíks or milimetre thinning. The final part contains the general estimation of the clerkdom place in the Schwarzenbergs service.

Bâtir les mémoires locales, « pluraliser » le récit national : le musée communautaire au prisme des usages politiques de la mémoire et du patrimoine au Kenya et en Éthiopie / Building Local Memories, « Pluralizing » the National Narrative : Community Museums and the Political Use of Heritage and Memory in Kenya and Ethiopia

Cette recherche aborde la scène politique de deux pays d’Afrique de l’Est (Éthiopie-Kenya) en s’appuyant sur une analyse des enjeux politiques inhérents à la mise en place d’institutions mémorielles telles que les musées, les mausolées et autres lieux de mémoires. Notre thèse est que ces musées sont à comprendre avant tout comme des espaces intermédiaires de négociation entre les groupes qui les portent, l’État qui les finance ou les autorise, et les organisations internationales qui soutiennent et influencent les projets patrimoniaux des gouvernements. Cette recherche se concentre ainsi sur deux études de cas : le musée Konso en Éthiopie et le musée-mausolée de Koitalel Samoei au Kenya. Ces institutions s’inscrivent dans des contextes politiques particuliers au début des années 2000, à savoir l’application effective du pluralisme politique au Kenya et le renforcement de l’autoritarisme en Éthiopie. Au Kenya, la négociation autour de l’interprétation du passé en termes politiques se fait au sein même du musée-mausolée dédié au héros Koitalel Samoei, tandis que le cas éthiopien souligne plutôt que les rapports de pouvoir sont restructurés ou réorganisés par la présence d’un premier musée ethnographique en région, le musée Konso.L’apparition de musées communautaires témoigne, au Kenya comme en Éthiopie, d’un retour de l’identité ethnique en politique, qui est à la fois brandie comme une bannière par les gouvernements, mais également utilisée comme une catégorie opératoire ou une ressource par des acteurs particuliers, qu’on appellera ici des « entrepreneurs de patrimoine ». Par l’usage d’un nouveau capital, le patrimoine et sa préservation, ces « entrepreneurs de patrimoine » s’imposent ainsi à la fois comme des « entrepreneurs de soi » au sens de Michel Foucault, mais également comme des « entrepreneurs du nous » en politique, occupant une position graduelle dans les négociations et les prises de décisions publiques. Dès lors, il faut décentrer le regard pour s’intéresser à ce que le musée fait au politique, et non plus seulement à ce que la politique fait des musées.En incluant également l’analyse des usages politiques de la mémoire étatiques et internationaux, ce travail cherche à renverser la perspective en adoptant une entrée microsociologique et ethnographique en science politique, étudiant les déterminants et les modalités de la reconstruction nationale du point de vue des musées communautaires. Cette approche « par le bas », articulée aux niveaux d’analyse macro (État, idéologie, cadre institutionnel) et micro (les institutions et acteurs du patrimoine, les élites politiques locales) invite ainsi à une réflexion plus générale sur la construction, la qualification et les perceptions des régimes politiques, entamant une réflexion sur la nature de l’État qui se dévoile à travers ces nouvelles politiques mémorielles et patrimoniales, ainsi que sur le rôle joué par ces nouveaux « entrepreneurs de patrimoine » dans la reconfiguration de la compétition politique. / This dissertation aims at understanding the political scene in two East African countries – Ethiopia and Kenya – by analysing the political dynamics surrounding the creation of memorial institutions such as museums, mausoleums and other memory spaces. I argue that these institutions must be first and foremost understood as intermediary spaces of negotiation between groups that are supporting them; the State that is financing and / or authorising them; as well as international organisations that are assisting and influencing the countries’ patrimonial policies. The two case studies of this research - the Konso Museum in Ethiopia and the museum-mausoleum of Koitalel Samoei in Kenya – are institutions that relate to specific political context: in Kenya, where political pluralism has been effectively accepted in the 2000s, the negotiation surrounding the political interpretation of the past takes place within the mausoleum-museum. In Ethiopia, where authoritarianism has been reinvigorated, local power relations are structured and reorganised by the presence of the South region’s first ethnographic museum.Both in Kenya and Ethiopia, the contemporary emergence of community museums illustrates the growing salience of ethnic identities in the political sphere – used as a resource and category of action both by the State and “patrimonial entrepreneurs”. By using a new kind of capital – heritage and its conservation – the latter strengthen their position both as “self entrepreneurs” (in the sense of Michel Foucault) and “we-entrepreneurs”, occupying an intermediary position in negotiations and public decision-making. Thus, we must look not only at what politics do to museums but also how museums do impact on political dynamics.In my research, through the study of community museums, I analyse the political uses of State and international memories, thus aiming at understanding the determinants and modalities of nation (re)building. I have adopted a microsociological and ethnographic approach within the framework political science. This “bottom-up” approach, articulated with macro levels of analysis (the State, ideologies and institutions) as well as micro levels (institutions and actors of heritage, local political elite) leads my argumentation to a larger debate on construction, qualification and perceptions of political regimes, the nature of the State as well as the role played by these new “patrimonial entrepreneurs” in the reconfiguration of political competition

Exacerbation of heritage features throughout the history of copyright brought serious consequences for their development. The copyright laws of historical progress in the scenarios with international and national economic traits notably eventually provide man, creator of intellectual work, a secondary role. Its activity has always been important, but there was a predominance of the equity, having. With the bourgeois revolutions of the eighteenth century began a process of modification of certain ideals, policies for inclusion in the letters of the states of certain fundamental rights. The coexistence of two systems of copyrights in the world ended up further back from the moral prerogatives of the authors. Yet the international legal texts now recognize them, although they are not fully respected. At a later stage there is a change of direction in the understanding of legal systems, is now setting up the foundation for the interpretation of copyright, to emphasize a repersonalization of its institutes. Our purpose in this study is to question whether it is possible to reconsider the legal institutions copyright, even with the new information society, and if possible, today, to meet the social expectations for the achievement of fundamental rights to information, culture and education, placed in check with this new social formation. We will analyze such issues based on the principle of human dignity for in the end, demonstrate the possibility of harmonizing these rights with the alternative use of works protected by copyright laws, taking as an example, the creative commons. / A exacerbação dos traços patrimoniais ao longo da história dos direitos autorais trouxe sérias consequências para o seu desenvolvimento. O progresso histórico das legislações autorais nos cenários internacional e nacional com traços notadamente econômicos acabou por atribuir ao homem, criador da obra intelectual, um papel secundário. Sua atividade sempre foi importante, mas havia o predomínio do patrimônio, do ter. Com as revoluções burguesas do século XVIII inicia-se um processo de modificação de alguns ideais, pela inclusão nas cartas políticas dos Estados de alguns direitos fundamentais. A coexistência de dois sistemas de direitos autorais no mundo acabou por afastar ainda mais as prerrogativas morais dos autores. Mesmo assim os textos legais internacionais passaram a reconhecê-las, conquanto não sejam inteiramente respeitadas. Numa fase posterior há uma mudança de rumo no entendimento dos sistemas legais, sendo agora a constituição o fundamento para a interpretação dos direitos autorais, a enfatizar uma repersonalização de seus institutos. Nosso propósito neste estudo é questionar se é possível fazer uma releitura dos institutos jurídicos autorais, mesmo diante da nova sociedade da informação, bem como se é possível, nos dias de hoje, atender aos anseios sociais pela consecução dos direitos fundamentais à informação, cultura e educação, colocados em xeque com esta nova formação social. Faremos uma análise de tais questões com base no princípio da dignidade humana para, ao final, demonstrar a possibilidade de harmonizar tais direitos com o uso alternativo de obras protegidas pelas leis autorais, tomando, como exemplo, o creative commons.

(in English): Early modern standing army and countryside were connected with dense network of relationships and influences that were reflected in several different layers. The personal link between countryside and army was a very important part of a mutual interaction. This connection resulted from the simple fact that rural subjects constituted a significant part of ranks and files that served, risked their lives and died in the early modern army. The main topic of the diploma thesis is the recruitment within the rural population. The thesis sets two fundamental goals. The first one is the recognition of various methods and techniques that the clerks and patrimonial authorities employed in order to administrate the military issues. The second one is the search for particular people that joined the army, the explanation of their life conditions, family background and social status and the comparison with other subjects which did not choose a career in the army. The research is territorially and chronologically confined to the Třeboň dominion at the beginning of the 18th century. The thesis is based mainly on the original sources stored in the State Regional Archive in Třeboň.

The present work was developed during the Masters Course in the Vocational Graduation Program in Cultural Heritage at the Federal University of Santa. This research aimed at investigating the reality of the Heritage Education in the Elementary School system in Santa Maria/RS to, after knowing this reality, propose subsides of guidelines focusing educator so that they can bring children and teenagers closer to the local heritage, especially the documental heritage in custody of the Municipal Historical Archive. The dialogue between Archive and School is critical to make students understand the importance to preserve their local heritage which is their own heritage. Starting from this and, considering the fact that the Municipal Historical Archive is visited by just a few students from elementary school, we tried to investigate the causes of this detachment. Our study is a descriptive field research with a quantitative and qualitative approach. To investigate the Heritage Education scenario in the city of Santa Maria we used a questionnaire that was sent to fifty-eight private, State and Municipal schools of the administrative urban center region and its neighboring regions but only twenty-one schools returned with some feedback. With the analysis of the collected data we can infer that the Heritage Education is present at school but is not worked from the Municipal Historical Archive documental heap because the educators do not know the services and research possibilities offered by the information unit. In this way, as educators are actions multipliers at school, the Heritage Education Program from the Santa Maria Municipal Historical Archive began with actions directe to the educators, such as the Meeting and the Orientation Guide for Educators. / O presente trabalho foi desenvolvido durante o Curso de Mestrado do Programa de Pós-Graduação Profissionalizante em Patrimônio Cultural da Universidade Federal de Santa Maria. Esta pesquisa teve como objetivo investigar o cenário da Educação Patrimonial na rede de ensino fundamental de Santa Maria/RS para a partir dessa realidade, propor subsídios de orientação direcionados aos educadores para que aproximem as crianças e adolescentes do patrimônio local, mais precisamente do patrimônio documental do Arquivo Histórico do Município. O diálogo entre arquivo e escola é fundamental para despertar nos estudantes a importância de preservar o patrimônio de sua localidade, que não deixa de ser o seu próprio patrimônio. Partindo dessa premissa e do fato do Arquivo Histórico Municipal de Santa Maria ser frequentado por um número reduzido de estudantes do ensino fundamental, procurou-se investigar as causas desse distanciamento. O estudo constitui-se numa pesquisa de campo do tipo descritiva com uma abordagem quantitativa e qualitativa. Para investigar o cenário da Educação Patrimonial no município de Santa Maria utilizou-se do questionário, que foi encaminhado para cinquenta e oito escolas particulares, estaduais e municipais da região administrativa centro urbano e regiões limítrofes, mas apenas obteve-se retorno de vinte e uma escolas. Com a análise dos dados infere-se que a Educação Patrimonial está presente dentro da escola, mas que não é trabalhada a partir do acervo documental do Arquivo Histórico Municipal por desconhecimento dos educadores acerca dos serviços e possibilidades de pesquisa oferecidas pela unidade de informação. Desta forma, como os educadores são os multiplicadores de ações nas escolas, o Programa de Educação Patrimonial do Arquivo Histórico Municipal de Santa Maria partiu de ações direcionadas a eles, como o Encontro e o Guia de Orientação para Educadores.

Patrimônio Arquitetônico de Cajazeiras ‐ PB: memória, políticas públicas e educação patrimonial

Although already exists, since 2004, a governor executive order that recognizes and delimits the local historical downtown, this architectural heritage comes being threatened and buried for this increasing transformation process that privileges modern buildings. Such reality comes if speeding up since the 1990 s, modifying the local landscape. With focus on this problematic, the research objectifies: discuss the Heritage Education public policies and its implantation necessity in a municipal scope, as way to construct an historical culture centered in heritage preservation since the firsts classes of basic education. The modernization process occurred in some Paraiba s cities during the first half of 20th Century is also treated, as a basis to discuss all that happened in Cajazeiras in the same context and period; detaching the buildings identified by IPHAEP (Paraíba Historical and Artistic Heritage Institute) as local historic sites, analyzing the problems concerned to delimitation of Cajazeiras historical downtown, identifying the conservation current state of these heritage, and arguing the importance of the heritage preservation for memory and local historical culture. This work is integrated to the research line History Education and Historic Knowledge, of the Master s Degree Course of History Graduate Program in Federal University of Paraíba, whose area of concentration is History and Historical Culture, intending to dialogue with this field of theoretical boarding, using the Oral History methodology. / Esta dissertação tem por objetivo analisar o crescente processo de construções e transformações urbanas ocorrido em Cajazeiras PB, o que tem acarretado a derrubada e reforma de antigos prédios e casarões que fazem parte do acervo patrimonial da cidade. Embora já exista, desde 2004, um decreto do Governo Estadual que reconhece e delimita a centro histórico local, este patrimônio arquitetônico vem sendo ameaçado e soterrado por esse crescente processo de transformação no que se refere à edificação de construções modernas . Tal realidade vem se acelerando desde a década de 1990 e, consequentemente, modificando a paisagem cajazeirense. Instigados por essa problemática objetivamos ainda: discutir a necessidade de implantação de políticas públicas de educação patrimonial a serem desenvolvidas em âmbito municipal, como possibilidade de construção de uma cultura histórica de preservação patrimonial centrada no ensino fundamental, além de analisar alguns aspectos do processo de modernização ocorrido em algumas cidades da Paraíba no início do século XX, buscando historiar o lugar de Cajazeiras neste contexto; destacar as construções identificadas pelo IPHAEP como patrimônio histórico local, analisando a problemática instaurada em torno da delimitação do Centro Histórico de Cajazeiras, tentando identificar seu atual estado de conservação, discutindo a importância da preservação patrimonial para a memória e cultura histórica local. O trabalho se insere na linha de pesquisa Ensino de História e Saberes Históricos do Programa de Pós-Graduação em História da Universidade Federal da Paraíba, com área de concentração em História e Cultura Histórica, pretendendo dialogar com este campo de abordagem teórica, utilizando a metodologia de História Oral.
