Vem vill ha Adam och Monika? : En kvantitativ vinjettstudie om tolkningar av vistelsebegreppet på 12 socialjourer i Sverige

The aim of this study was to explore how social workers interpret the part of the Swedish social services act that regulates each municipality’s responsibility of the people staying in it. The study’s general methodological approach connects to sociology of law. The research questions were: (1) What factors are considered important by the social workers in assessments of responsible municipality? (2) Are there variations in the assessments of responsible municipality and in that case; how can the variations be explained? (3) What discretion do the social workers consider that they have in assessments of responsible municipality? Previous studies have found considerable differences in professional social work assessments in Sweden. 69 social workers completed a questionnaire which included two vignettes. The selection maintained the emergency social services for well above 4 million citizens. Many factors were considered important in assessments of responsible municipality; the most prominent of those was the physical presence in the municipality. Variations appeared especially regarding long-term decisions and could partially be explained by which factors were considered important. The law that regulates the area of interest is a detailed legislation. However, some explanation could be found in Lipskys (2010) theory of Street-level bureaucracy.

Vem är mannen som slår? : En totalundersökning av alla fällande domar när det gäller grov kvinnofridskränkning under 2016.

The aim in the following essay is to describe the characteristics of the man behind verdicts regarding interpersonal violence (IPV). Which explanations does he have for the violence he has used and how does his life circumstances look like? Furthermore, is there gender bias in the justice system: do the gender of the professionals in court affect the verdict or the size of the damages?  The essay is a quantitative study written with positivistic elements and from a perspective of gender order and legal sociology. To answer the essay´s questions an exhaustive survey was completed regarding convictions in Swedish courts classified as IPV during the year 2016. The population consisted of 163 convictions this year, and the loss was one conviction that was not located.  Results found in this essay shows that a man who does not use an explanation for his behaviour is liable to pay damages, but lesser amounts than a man who explains his behaviour. Other results show that in cases where the offender was under the influence of alcohol, at least under one of the charges, was convicted to a shorter prison sentence and was liable to less damages. Descriptive data generated from the study shows that more than half of the men was living together with children in their households. Furthermore; solely in half of the convictions was the occupation of the man described. Of these 81 convictions that mentioned occupation were only 29 % of the men in labour and 14,8 % either unemployed or on sick leave at the time of the proceedings. / Syftet med föreliggande uppsats är att beskriva karaktäristiken hos mannen som döms för grov kvinnofridskränkning. Vilka förklaringar har han till våldet han utövat och hur ser hans livsomständigheter ut? Dessutom undersöks om de professionellas könstillhörighet i rättssalen påverkar bedömningen och utgången av rättegången när det gäller påföljd och strafflängd.  Uppsatsen är en kvantitativ studie skriven med en positivistisk ansats och utifrån ett könsmakts- och rättssociologiskt perspektiv. För att söka svar på frågeställningarna har en totalundersökning genomförts av fällande tingsrättsdomar med rubriceringen grov kvinnofridskränkning under 2016. Populationen bestod av 163 domar detta år, bortfallet bestod i en dom inte gått att lokalisera.  Det studien visar är att en man som inte har någon förklaringsmodell får lägre skadestånd och än en man som förklarar våldet. Vidare visar resultat i studien att om gärningsmannen är alkoholpåverkad vid brottshändelser utdöms lägre fängelsestraff och mindre skadeståndssumma. Deskriptiva data i studien visar att över hälften av männen lever med barn i hushållet. Endast i hälften av domarna gick det att utläsa mannens sysselsättning och av dessa 81 domar hade enbart 29 % av männen arbete och 14, 8 % var sjukskriven eller arbetssökande vid tidpunkten för rättegången.

Är det någon skillnad vilken lag som tillämpas, SoL eller LSS? En rättssociologisk studie om bostad med särskild service för personer med ett psykiskt funktionshinder

The aim of this qualitative study is to understand whether there is a difference for people with mental disabilities to grant the intervention housing with special service; according to either the Law of Support and Service for Persons with certain Functional Impairments (LSS) or to the Law of Social Welfare (SoL). Furthermore, the aim of the study is to explore how user organizations describe their cooperation with the municipality. In this study, I compare the municipalities of Malmö and Stockholm. Individual interviews were conducted with three persons from different user organizations and three interviews were conducted with persons working in the municipality. Information and official documents describing the intervention and the municipalities’ organization were also used for this study. The empirical data was analyzed through the sociology of law approach. The main results indicate that there is a difference between the intervention housing with special service depending on the regulation applied. Regarding housing with special service according to LSS, fewer persons live together and the cost is higher. The analysis shows that SoL and LSS differ in various ways which affect the intervention. The user organizations described the collaboration with the municipality as good but also containing several challenges.

Media often reports problems within the healthcare sector. The issues point to that the working environment is unhealthy. One of the examples is that too high of a workload leads to stress, which in turn leads to increased numbers of sick leave and employees looking for other jobs. For an employer, there is a legal responsibility to provide a satisfactory working environment. The fact that workers are the most important resource in a workplace is not new, and it is becoming increasingly important for an employer to work with its personnel issues and try to meet their needs and wishes. The aim of this essay is to elucidate nurses' experiences of their psychosocial work environment, as well as the employer's legal obligations to maintain a good psychosocial work environment. To fulfil the purpose of the study, a legal sociological method has been used, where a legal dogmatic method has been used to determine the applicable law, and a qualitative method has been used to examine nurses' experiences through semi-structured interviews. The study's findings showed that the psychosocial work environment is a problem according to the nurses participating in the study, and that the employer's work to prevent ill-health can often be considered inadequate. The study's results also indicate that there are deficiencies in the law and specific legislative regulations aimed at the healthcare sector should be established.

Since the coronavirus occurred, the number of people working from home has increased by almost 400%, which may cause some confusion. The purpose of this essay is to describe the legal situation regarding the psychosocial work environment when working from home and gain an insight into how male and female workers experience the psychosocial work environment when working from home during Covid-19. The purpose is further to apply a gender perspective by analysing the differences between male and female experiences. In order to fulfil the purpose, a legal dogmatic method has been used, and the sociology of law by collecting data using surveys and interviews. The regulation regarding the psychosocial work environment when working from home is found in EU law and in the Work Environment Act (1977:1160), which in turn is supplemented by the Swedish Work Environment Authority’s regulations. According to the Work Environment Act, the employer must take necessary measures to prevent accidents or ill health of workers. By analysing the data collected from the surveys and interviews, it can be concluded that there are differences between male and female experiences. A significant difference arises, for example, in the issue of workload, where women experience a higher workload than men, both at the office and when working from home. A possible reason for this difference may be that women have a higher total workload as they have more responsibility in the home environment. In general, there seem to be quite positive experiences of working from home, among both men and women, as the workload and stress decrease.

<p>The purpose of this study was to investigate how directors of preschool apply the mandatory reporting and what information they say is important in the decision to report child maltreat-ment. The study was built on five semi-structure interviews with five directors of preschool working in Greater Stockholm. The perspective of this paper is sociology of law theory. This means to study how out of law information makes sense when director of preschool applies the mandatory reporting. The result was analysed with three different analytic tools: action plan, consulting social services and the considerations of the directors of preschool them-selves. The result showed that the information from the preschool teachers is very important the decision to report child maltreatment. None of the directors referred to an action plan that was written down. Clear signs of maltreatment, as physical and psychological signs, were information that directly was reported. When anxiety was explained to lack clear physical and psychological signs the directors were left alone with their own subjective feelings. The pos-sibility to consult with social services was told to be a very important support.</p>
