The results obtained in the internal control between the parties OSS and SES are made, but, still, perhaps there isn t a permanent communication between the actors and the society / Pesquisar a relação gerencial e administrativa entre as Organizações Sociais e a Secretaria de Estado de Saúde de São Paulo, via contrato de gestão e demais controles e indicadores e o comprometimento dos stakeholders/accountability pública e o cidadão usuário de saúde . A criação das Organizações Sociais para prestar serviços à Saúde , através de programas de publicização ocorrida na reforma do Estado 1995/1998, gera polêmicas e indagações sobre a qualidade e custo dessa prestação de serviços de entidades não governamentais. Como o processo tem cerca de 10 anos, é necessários acompanhamentos. Duas hipóteses alimentam esta pesquisa: 1. Se no sistema de accountability horizontal os atores e/ou órgãos públicos comprometem-se em apontar e/ou responder às questões e dúvidas relevantes. 2. Se no sistema de accountabilitity vertical os cidadãos estão estimulados a participar. Aspectos teóricos metodológicos: pesquisa operada em relatórios das OSS e SES e com funcionários da SES. Os resultados obtidos no controle interno entre as partes OSS e SES são realizados, ainda assim não se afirma que exista permanente comunicação entre os atores e com a sociedade

The interest for the theme may be justified by the following reasons: i) dissemination of the Third Sector in Brazil deriving from the neoliberal ideological context and from the State Reform; ii) rediscovery of the principle of subsidiarity and retaking of the administrative activity of fomentation by the Public Administration; iii) recent legislative amendments in constitutional and infraconstitutional levels promoted with the intention of justifying new models of relation between the State and society, often in flagrant violation to the constitutional principles; iv) substitution of the state initiative for the private initiative for the performance of activities which are primarily State s responsibility to provide and which constitutional permissive admits only complementary activity from the individuals; v) wide doctrinal dissent regarding the legal limits of administrative activity of fomentation and the distortions of the legal system reality connected to this administrative function, as an escape mechanism of the administrative legal system. In the attempt to reach the outlined objectives, we shall primarily establish the contextualization of the surfacing of the Third Sector in Brazil, as well as the necessary assumptions in order to establish the logical premises of our understanding regarding the theme; Then, we shall identify the constitutional outlines of the administrative activity of fomentation and the legal tools which enable this administrative function, including the identification of the entities that are part of the Third Sector and the titles that are given to them by the Public Power. In possession of all these elements, which outlines are necessary for the research presented herein, we will pass to the study of the theme itself, presenting the legislative scenery which the health service is included, and, finally, identifying the legal system of the health services management by the Third Sector entities, seeking, then, to present the conclusions obtained from the confrontation between the legislative and doctrinal aspects regarding the theme / O presente trabalho tem por objetivo propor reflexões para o delineamento do regime jurídico da gestão do serviço de saúde pelas entidades do Terceiro Setor, à luz do ordenamento jurídico brasileiro. O interesse pelo tema pode ser justificado pelas seguintes razões: i) disseminação do Terceiro Setor no Brasil a partir do contexto ideológico neoliberal e de Reforma do Estado; ii) redescoberta do princípio da subsidiariedade e retomada da atividade administrativa de fomento pela Administração Pública; iii) recentes alterações legislativas nos planos constitucional e infraconstitucional promovidas no intento de justificar novos modelos de relacionamento entre o Estado e a sociedade civil, muita vezes em flagrante violação aos ditames constitucionais; iv) substituição estatal pela iniciativa privada no desempenho de atividades sociais cuja prestação lhe incumbe com primazia e cujo permissivo constitucional admite apenas atividade complementar dos particulares; v) ampla divergência doutrinária no tocante aos limites jurídicos da atividade administrativa de fomento e as distorções na realidade do regime jurídico afeto à esta função administrativa, como mecanismo de fuga do regime jurídico administrativo. No intento de alcançar os objetivos traçados, buscaremos, primeiramente, estabelecer a contextualização do surgimento do Terceiro Setor no Brasil, bem como os pressupostos necessários a fim de estabelecermos as premissas lógicas de nosso entendimento acerca do tema; em seguida, procuraremos identificar os contornos constitucionais da atividade administrativa de fomento e os seus instrumentos jurídicos viabilizadores, passando pela identificação das entidades que compõem o Terceiro Setor e os títulos que lhes são conferidos pelo Poder Público. De posse de todos esses elementos, cujos contornos faz-se necessário para a pesquisa que ora apresentamos, passaremos ao estudo do tema propriamente dito, apresentando o panorama normativo que está inserido o serviço de saúde, e, por fim, identificando o regime jurídico da gestão do serviço de saúde pelas entidades do Terceiro Setor, buscando, em seguida, apresentar as conclusões obtidas do confronto que faremos entre os aspectos legislativos e doutrinários sobre o tema

Programa de Pós-Graduação em Educação Profissional em Saúde. / No final da década de 90, em um cenário global de crises econômicas, a reforma do Estado entrou nas agendas governamentais. A introdução do modelo gerencial no setor público faz parte deste contexto da reforma administrativa, em que emerge a proposta da nova gestão pública, pautada pelo discurso ideológico de que o setor privado possui o modelo ideal de gestão, capaz de garantir a qualidade e a eficiência. A Secretaria Municipal de Saúde da cidade do Rio de Janeiro, seguindo este caminho de flexibilização da gestão pública, adotou um novo modelo jurídico-institucional para a gestão dos equipamentos públicos de saúde, baseado em Organizações Sociais. Este processo encontra-se vinculado ao novo modelo assistencial proposto para o setor saúde no município, a saúde presente, que incorpora a relação contratual com as OS para a execução dos serviços de saúde, bem como os repasses de recursos públicos. A reflexão deste estudo teve como foco compreender como os mecanismos e processos gerenciais incorporados na gestão da saúde do município, baseados na introdução de mecanismos de mercado e na adoção de ferramentas de gestão privada, se estruturam para atender as demandas da população por necessidades em saúde. O objetivo geral da pesquisa foi analisar os mecanismos e processos de gerenciamento local das equipes de saúde da família no território norte da CAP 5.2/SMS/PCRJ. Para tanto a pesquisa teve como fonte principal os documentos oficiais de gestão público/privado, bem como as atas de reunião do Conselho Distrital de Saúde, o que evidenciou a inexistência da atuação do controle público local na fiscalização e no processo de contratualização da gestão público/privado, contrariando o que está previsto no Sistema Único de Saúde. Observamos, ainda, que o estabelecimento de formas de prestação de serviços encontram-se condicionadas a determinados dispositivos, conectados a lógica da produção e da regulação. Este cenário nos revela uma tensão entre o acesso e a garantia do direito à saúde e o fortalecimento do papel regulatório na organização da atenção, diante da insuficiência concreta da oferta de serviços em atender as demanda da população. Este é um dos elementos percebidos como entrave no que diz respeito às demandas por saúde no contexto estudado. Por fim, os resultados indicaram que a nova gestão pública no setor saúde na Cidade do Rio de Janeiro não se desenvolveu a partir de mobilização da sociedade civil, nem como forma de legitimar reivindicações sobre as necessidades em saúde da população, e sim como um projeto de governo, desvinculado do controle e da participação social. / At the end of the 90s, in a scenario of global economic crisis, the reform of the state entered on government agendas. The introduction of model management in the public sector is part of this context of administrative reform, which emerges in the proposed new public management, guided by ideological discourse that the private sector has the ideal model of management, able to ensure quality and efficiency. The Municipal Secretary of Health of the city of Rio de Janeiro, following this path of public administration flexibility, adopted a new legal- institutional model for the management of public health facilities, based on Social Organizations. This process is linked to the proposed new model of care for the health sector in the county, the present health that incorporates the contractual relationship with the OS for the implementation of health services, as well as the transfers of public resources. The reflection of this study focused on understanding the mechanisms and management processes embedded in the health management of the municipality, based on the introduction of market mechanisms and the adoption of private management tools are structured to meet the demands of the population for health needs. The objective of the research was to analyze the mechanisms and processes of local management of family health teams in the territory north of the CAP 5.2/SMS/PCRJ. For both research had as its primary source documents management official public / private as well as the minutes of the meeting of the District Health Council , which highlighted the lack of performance of local public control and supervision in the contracting process of public management / private, contrary to what is provided for in the National Health System we also observed that the establishment of forms of service delivery are conditioned to certain devices , connected to the logic of production and regulation. This scenario reveals a tension between access and guarantee the right to health and strengthening the regulatory role in the organization of care, given the inadequacy of the offer concrete services to meet the demand of the population. This is one of the elements perceived as an obstacle regarding the demands for health in the context studied. Finally, the results indicated that the new public management in the health sector in the city of Rio de Janeiro has not developed from mobilization of civil society, not as a way of legitimizing claims about the health needs of the population, but as a project government, unbound control and social participation.

This thesis deals with non-financial incentives for employees in health and social organizations. For this purpose, is in this paper mentioned the issue of non-financial incentives for employees and its significance. Aim of this thesis is to analyze the role of tools focused on non-financial motivation of employees in social and health organizations and their occurence in Jedlicka institute. This thesis is divided into two parts - theoretical and practical. In the theoretical part there is summarized characteristics of health and social organizations and specifics of its financing. It also discusses the issue of human resources in organizations, management and evaluation and its relationship to quality management. Moreover this thesis deals with motivation to work and presents important theories of motivation. The last chapter in the theoretical part is a key chapter of this thesis is dedicated to issues of character of financial and non-financial motivation, employees motivation, incentive rules and tools of motivation. The practical part consists of two types of research - an interview with managers and questionnaries among employees. In this model, non-state public organizations qualified as Social Organizations of Culture sign a contract with the government, assuming the responsibility for the administration of services, installations, and cultural equipments that were originally managed directly by the Secretariat. The State continues on charge of defining the cultural policies and supervising the work developed for these purposes by the Social Organizations. In case an institution doesn t accomplish the results established by the contract, it may stop getting resources from the government or even losing its qualification. The main tool to evaluate performance of these organizations is an indicators system specifically defined in the work plan in each case where goals that must be reached must be clearly defined. The purpose of this work was to study the indicators systems being used today, and seek ways to improve them. For these purpose three representative institutions were selected and work plans and activities reports of each one were carefully studied. These institutions were: Friends of the Pinacoteca Association, Friends of the Tom Jobim Centre Association, and OSESP Foundation. As a result it was observed that even though the indicators systems currently used were very simple, they contain some important and positive characteristics that are also found in evaluation models identified in literature, such as alignment of the indicators with the strategical objectives of the institution. A weak point of the systems though, is the current difficulty to compare performance for two or more organizations. Suggestions to improve the systems are presented as a way to minimize this and other problems that were identified during the work / A Secretaria da Cultura do Estado de São Paulo utiliza desde 2004 um modelo de gestão baseado nas Organizações Sociais. Nesse modelo, organizações públicas não estatais, qualificadas como Organizações Sociais de Cultura, firmam um Contrato de Gestão com o Estado, passando a assumir a responsabilidade pela administração de serviços, instalações e equipamentos culturais que antes eram geridos diretamente pela Secretaria. O Estado mantém seu papel de formulador das políticas culturais e passa a fiscalizar o trabalho dos executores dessas políticas, ou seja, das Organizações Sociais. Caso a instituição não atinja os resultados definidos em contrato, ela pode deixar de receber os recursos do governo ou até mesmo perder sua qualificação. A principal ferramenta para avaliar o desempenho dessas organizações é o sistema de indicadores definido no plano de trabalho de cada uma delas, no qual são apresentadas as metas que devem ser atingidas. O objetivo desta pesquisa foi identificar pontos de melhoria nos atuais sistemas de indicadores desenvolvidos para avaliar o desempenho das Organizações Sociais de Cultura do Estado de São Paulo. Para tanto, foram descritos e analisados os programas de trabalho e relatórios de atividades de três instituições representativas, a Associação dos Amigos da Pinacoteca, a Associação dos Amigos do Centro de Estudos Musicais Tom Jobim e a Fundação OSESP. Os resultados mostram que apesar da simplicidade dos sistemas de indicadores atualmente utilizados, estes possuem algumas características básicas que também são encontradas em modelos de avaliação identificados na literatura, como, por exemplo, a intenção de alinhar os indicadores aos objetivos estratégicos da instituição. Um ponto fraco importante detectado na pesquisa diz respeito à atual dificuldade de comparação entre o desempenho de duas ou mais organizações. As sugestões para aperfeiçoamento dos sistemas, apresentadas no fim do estudo, procuram minimizar este e outros problemas identificados no modelo atual

Cette recherche a permis de confirmer deux hypothèses de la communication sociale selon lesquelles la communication de persuasion fait évoluer les idées et la communication engageante fait changer les comportements. Appliquée à la problématique de la mendicité des enfants Talibés au Sénégal, cette thèse nous a amené à revisiter les origines d’une ''bonne'' tradition sociale bien ancrée qui connait, aujourd’hui, une déviation économique et péjorative. Pour lutter contre la maltraitance de ces enfants, l’ONG Symbiose développe une communication persuasive qui n’a pas donné les résultats de changement de comportement escomptés chez les partenaires. Á l’intention de ce public, nous avons conduit une expérience de communication engageante avec le principe de l’acte préparatoire retenu comme soubassement technique du protocole. 2 actes préparatoires même qui sont aussi formulés l’intention d’une partie des sujets expérimentaux, pour mieux s’attaquer à une cause sociale devenue problématique, et donc plus difficile à modifier.À terme, le double acte préparatoire a révélé sa perspicacité : à souscrire le public, à les engager et à modifier leurs conduites. Des facultés d’entrainement plus intenses observés pour 2 actes préparatoires qui convergent avec le cadre théorique de notre étude et confirme que : le nombre d’actes préparatoires soutient le changement comportemental. Mieux, pour avoir eu à augmenter ses engagements initiaux, une partie du public a fait montre de changements instituants, qui à l’analyse, sont beaucoup plus (re)liés au principe de l’identification de l’action. / This research permitted us to confirm two hypotheses of action communication and societal or state approved ones for which persuasive communication makes ideas move forwards and committed communication change behaviours. Applied to the problem of Talibes children’s mendicity in Senegal, this thesis, made us revisit that good tradition deeply rooted but which nowadays is used5 for pejorative and economic deviations. To3 fight against children Talibes illtreatement, NGO Symbiose has developed a persuasice communication without behavioural change excpected on the parteners. Among these parteners we have taken in this study as subjects of committed communication’s experience which is conceived for this fact. In virtue of the promise that this form of communication has the power to bring its receptors to a change of acts. Above all if the principle of the preparatory act is taken as the technical basis of the protocol. 2 preparatory acts which are even formulated also to the intension of one of the experimental subject to better a social problem which has become a real problematic cause and then more difficult to modify. Finally, the double preparatory act, has reveled perspicacity: subscribing the public under its control bringing them to modify their behaviorus. Capacities of attracting publics more intense for two preparatory acts that link with the theoretical setting of our study and confirm that: the more we multiply the preparatory acts the more we succeed the behavioural change. Better the fact of identifying that what we are doing is positive help one part of the public increasing their initial commitment. That is the principle of action of identification.

The Third Sector Organizations have broaden their acting in modern societies. First, through the overture given by the State to formalize these actions, that have being executed since long ago by individuals around a common cause. Second, by the human being's need of giving sense to its work; by its incessant search for happiness through collectivity. However, there is not sedimented management way in this ambient. The knowledgement in these fields are built and rebuilt each day, characterizing into constant dilemma to the researchers' eyes. Allied to this conjuncture is the growing worry of the public managers in visualizing the public policies as a cycle whose effectivity depends on a range of distinct actors. For that, the predominant values in the Public Administration need new delineation. The New Public Service appears then as a theoretical framework in construction, based on values of citizenship, dialogue, citizen participation, spirit and public interest. From an understanding about the Social Organizations, the Third Sector, the Public Policies, the Social Nets and the Co-production of Public Services; it is defined the conceptual map that guides the research application. It is a descriptive research, with a qualitative/quantitative approach, performed in eight social organizations of Itajaí Region, which execute actions vinculated to the Working and Income Policies. The data was collected through a questionnaire and, when needed, a complementary interview, within the period of November, 2008 January, 2009. The data was treated and analysed from the conceptual map, integrated to the emergent variables along the research application. The organizations were analysed concerning to the Accountability, Citizenship, Dialogue, Public Spirit, Citizen Participation, Decentralization, Shared Leadership, Motivation, Roles Definition, Shared Objectives, Trust and Continued Learning. It is verifyed that the researched social organizations' contributions are directly related to the space they provide to the citizens to co-produce actions turned to specific demands in their communities, constituting favourable arranges to the essential elements for the construction of new management ways based in the New Public Service. However, the analyzed net presents embryonic characteristics related to the broaden perspectives of actuation that the arrange of net offers. It is the Public Administrators' concern to act in this ambient in a way to potentiate the social capital available, aiming to reach better results in the public policies implementation / A presente dissertação relata um estudo aplicado nas organizações sociais da Região de Itajaí, Santa Catarina, visando identificar as contribuições dessas entidades na implementação de políticas de Trabalho e Renda. As organizações do Terceiro Setor têm ampliado sua atuação nas sociedades modernas. Primeiro, pela abertura dada pelo Estado para a formalização dessas ações, que há muito são executadas por indivíduos reunidos em torno de uma causa comum. Segundo, pela necessidade do ser humano dar sentido ao seu trabalho; pela sua incessante busca pela felicidade por meio da coletividade. Entretanto, não há forma de gestão sedimentada nesse ambiente. A cada dia, os saberes nesse campo são construídos e reconstruídos, caracterizando-se em consta tes dilemas aos olhos dos pesquisadores. Aliada a essa conjuntura, está a crescente preocupação dos gestores públicos em visualizar a política pública como um ciclo, cuja efetividade depende de uma gama de atores distintos. Para isso, os valores predominantes na Administração Pública necessitam de novas delineações. O Novo Serviço Público surge, então, como um arcabouço teórico em construção pautado em valores de cidadania, diálogo, participação cidadã, espírito e interesse público. Partindo de um entendimento sobre as Organizações Sociais, o Terceiro Setor, as Políticas Públicas, as Redes Sociais e a Coprodução dos Serviços Públicos; é definido o mapa conceitual que norteia a aplicação da pesquisa. Trata-se de uma pesquisa descritiva, com abordagem qualiquantitativa, realizada em oito organizações sociais da Região de Itajaí que executam ações vinculadas às políticas de Trabalho e Renda. Os dados foram coletados por meio de aplicação de questionário e entrevista complementar, quando necessário, no período entre Novembro/2008 a Janeiro/2009. Os dados foram tratados e analisados a partir do mapa conceitual, integrado às variáveis emergentes no decorrer da aplicação da pesquisa. As organizações foram analisadas quanto às variáveis de Accoutability, Cidadania, Diálogo, Espírito Público, Interesse Público, Participação Cidadão, Descentralização, Liderança Compartilhada, Motivação, Definição de Papéis, Objetivos Compartilhados, Confiança e Aprendizagem Continuada. Verifica-se que as contribuições das organizações sociais pesquisadas estão diretamente relacionadas ao espaço que elas proporcionam aos cidadãos para co-produzirem ações voltadas às demandas específicas de suas comunidades, constituindo-se em arranjos favoráveis aos elementos essenciais para a construção de novas formas de gestão fundamentadas no Novo Serviço Público. No entanto, a rede analisada apresenta características embrionárias relacionadas às amplas perspectivas de atuação que o arranjo de rede oferece. Governance of Transformations towards Sustainable Water, Food and Energy Supply Systems - Facilitating Sustainability Innovations through Multi-Level Learning Processes

A fundamental change in societal values and economic structures is required to address increasing pressures on ecosystems and natural resources. Transition research has developed in the last decades to analyze the co-dynamics of technological, institutional, social and economic elements in the provision of key functions such as energy, water and food supply. This doctoral dissertation provides conceptual and methodological contributions to the pro-active governance of sustainability transitions. Three research gaps are identified that are addressed in this dissertation. First, a comprehensive conceptualization of learning in sustainability transitions is currently missing that comprises learning at multiple societal levels (ranging from individuals to policy-actors). Learning concepts are often not explicitly discussed in transition research even though learning is considered as fundamental for innovation processes, niche formation and development as well as breakthrough and diffusion of innovations. Second, methods for the analysis and design of transition governance processes are lacking that specify case-specific intervention points and roles of actors in the implementation of innovations. Third, participatory modeling approaches are only applied to a limited extent in transition research despite a high potential for supporting communication and learning. The conceptualization of multi-level learning developed in this doctoral research conceptualizes learning at different societal levels as specific learning contexts ranging from individual and group contexts to organizational and policy contexts. The conceptual framework further differentiates between learning processes, intensity, objects, outcomes, subjects and factors, allowing for a more detailed analysis of learning within and across learning contexts. Thus, learning contexts can be linked by processes that involve actors from different learning contexts (e.g., community groups and policy-makers), as well as exchanges of physical aspects, institutions and knowledge (in the form of ‘learning factors’). This research has also provided a classification of model uses in transition research that supports a purposeful discussion of the opportunities of modeling and promising future research directions. The methodology developed in this doctoral research aims at the analysis and design of transition governance processes by specifying the various opportunities to contribute to sustainability transitions through purposeful action at different societal levels, as well as related roles of stakeholders in implementing such processes of change. The methodology combines different streams of previous research: 1) a participatory modeling approach to identify problem perceptions, case-specific sustainability innovations as well as related implementation barriers, drivers and responsibilities; 2) a systematic review to identify supportive and impeding learning factors from the general literature that can complement case-specific factors; and 3) a method for the analysis and design of case-specific transition governance processes. Three case studies in Canada (topic: sustainable food systems), Cyprus (water-energy-food nexus) and Germany (sustainable heating supply) have been selected to test and iteratively develop the methodology described above. The results for each case study reveal that there are learning objects (i.e., learning requirements) in all learning contexts, which underscores the importance of multi-level learning in sustainability transitions, ranging from the individual to the group, organizational and policy levels. Actors have various opportunities to actively facilitate societal transformations towards sustainable development either directly through actions at their particular societal levels (i.e., context-internal learning) or indirectly through actions that influence learning at other societal levels. In fact, most of the learning factors require cooperation across learning contexts during the implementation process. The comparing of learning factors across case studies underline the importance of several factor categories, such as ‘physical a ‘disturbance or crisis’, ‘information and knowledge’. Of the 206 factors identified by stakeholders, 40 factors are case-specific and not contained in the general, review-based factor list. This underscores the value of participatory research, as general, top-down analyses might have overlooked these case-specific factors. The methodology presented in this dissertation allows for the identification and analysis of case-specific intervention points for sustainability transitions at multiple societal levels. The methodology furthermore permits the analysis of interplay between individual, group, organizational and policy actions, which is a first step towards their coordination. The focus on sustainability innovations links the broad topic of sustainability transitions to a set of opportunities for practical interventions and overcoming their implementation barriers. The methodology presented allows for the analysis and design of these interlinkages between learning contexts. While the methodology cannot provide any ‘silver bullets’ for inducing sustainability transitions, it is flexible enough to identify an appropriate abstraction level for analyzing and designing transition governance processes. The methodology developed in this doctoral research also provides several contributions for the development of participatory modeling methods in transition research. Thus, the participatory method supports an integrated analysis of barriers and drivers of sustainability innovations, and allows application in practice and education. The concepts and methods developed in this research project allow for reflection on transition governance processes from a systemic viewpoint. Experiences in the case studies underline the applicability of the concepts and methods developed for the analysis of case-specific transition governance processes. Despite substantial differences in the geographic location, culture and topics addressed, all case studies include promising sustainability innovations and the engagement of multiple actors in their implementation. The diversity and multitude of initiatives in the case study regions provides an optimistic outlook on future opportunities for large-scale sustainability transitions.
