Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O presente trabalho tem por objetivo apresentar os conceitos de lei e soberania no Contrato Social de Rousseau sob uma perspectiva histórico-filosófica, retratando o surgimento do modelo filosófico-jurídico da legitimação do poder a o nascimento (ou renascimento, a depender de como se considere o período imperial romano) do conceito de soberania como completa liberdade em relação às leis existentes, ou sujeição apenas à própria razão. A partir desse fato histórico, como de outros relativos à filosofia tardoescolástica de Escoto, com sua distinctio formalis ex natura rei que permitiu a emergência de uma antropologia como a de Rousseau, que divide os seres humanos em camadas sobrepostas e o voluntarismo nominalista de Ockham, que permitiu a elaboração de um conceito como vontade geral. Procura-se demonstrar também como a concepção nominalista de um Deus absconditus tornou a justificação de um poder que é pura vontade separada daqueles que ordena ininteligível. Neste sentido, a crise de heteronomia em relação à transcendência que não é pura heteronomia, mas participação na ordem criada acaba gerando uma crise da heteronomia em razão ao poder secular, dando origem à autonomia soberana do povo pela vontade geral. / The present thesis purpose is to present the concepts of sovereignty and law in Rousseaus Social contract in a historical and philosophical perspective, depicting the
appearance of the philosophical-juridical model of legitimization of political power and the birth (or rebirth, depending on whether it can or can not be regarded as existing during the Roman Empire) of the concept of sovereingty as complete liberty from current laws held by the governor, which should be regarded as subject only to his will moderate by his reason (voluntas ratione regulata). Departing from that historical fact, as well as from the late scholastic philosophy of Scotus whose concept of distinctio formalis ex natura rei allowed the conception of a human essence as being composite of separable layers , and of Ockham whose voluntaristic nominalism turned into a possibility the creation of such an idea as that of general will it is shown how Rousseau follows a path that had been long before traced. It was also tried to show how the nominalist conception of a God as being a hidden God (Deus absconditus) made also viable the justification of a power which is pure will separate from those it rules. Thus, the crisis of hetoronomy, derived from the lack of intelligibility of the transcendence, is followed by a crisis of the heteronomy caused by the unintelligibility of the ruler by the ruled. From that will spring the concept of autonomy of the sovereign people of Rousseau.

Nosso objetivo específico é desenvolver uma investigação que envolve a filosofa moral de Tomás e, para isso, será necessário entendermos a o papel da alma humana e suas ações. A noção de hábito e, consequentemente, a noção de virtude e suas distinções perpassarão nosso trabalho a fim de nos determos em particular da virtude da prudência considerada em si mesma e suas partes. Nossa linha de trabalho será a de compreender o papel da prudência na ação moral do agente, de acordo com Tomás, e como tal virtude beneficia determinada ação, dispondo dos meios necessários para a realização do bem moral em consonância com as demais virtudes cardeais e intelectuais. / The present work has as main objective to analyze the set of questions of the Summa theologiae that concern the treatment of prudence, relying on other Aquinas’ texts when needed. Our specific objective is to develop an investigation that involves the moral philosophy of Aquinas and, therefore, it will be necessary to understand the role of the human soul and its actions. The notion of habit and consequently the notion of virtue and its distinctions will run through our work in order to dwell particularly on the virtue of prudence considered in itself and its parts. Our working line will be to understand the role of prudence in the moral action of the agent according to Aquinas, and how such virtue benefits a certain action having the necessary means for the fulfillment of moral good in consonance with other cardinal and intellectual virtues.

Nomads in the liberal state : liberal approaches to the problem of Roma and traveller itinerancyHaggrot, Marcus Carlsen January 2017 (has links)
May the state, from a liberal point of view, operate laws and institutions that impede the mobile lifestyle of nomadic Roma and Travellers, or should the state take steps to accommodate their nomadic way of life? This is the essence of the problem of Roma and Traveller itinerancy and the question that is at the heart of this three-partite dissertation. The first part of the dissertation looks at public policy in France and the United Kingdom and describes the six public policy problems that constitute the problem of Roma and Traveller itinerancy. These problems concern the education of children, the French travel permits system, the legal conditions for voter registration and for GP registration, the housing benefits system, and the public provision of halting sites. The second part looks at liberal political theory. It suggests that contemporary liberalism divides into two strands that take different views on the entitlements of cultural and religious minorities, and it provides a detailed outline of the prime articulations of each approach, namely the multiculturalist liberalism of Kymlicka and the classic neutrality liberalism of Barry. The third part investigates what the two said liberalisms imply for the six policy problems from part 1. These analyses suggest that the two liberalisms have slightly diverging implications for the halting sites problem, the housing benefits problem and the problem of GP registration. They suggest furthermore that the two accounts converge on the question of voter registration and agree that the voter registration system must accommodate nomads, and may not make the possession of a fixed residence an absolute condition for voter registration. And the analyses suggest finally that the two liberalisms also converge over the education question and the travel permits question, but here support polices that are potentially inimical to Roma and Traveller itinerancy. The broader implications of these findings are that liberalism is potentially, but not necessarily and not intrinsically, inimical to Roma and Traveller nomadism, and that the disagreement between classic neutrality liberalism and multiculturalist liberalism is weak insofar as public policy is concerned.

Narrative structure and philosophical debates in Tristram Shandy and Jacques le fatalisteWhiskin, Margaux Elizabeth January 2012 (has links)
The aim of the present thesis is to analyse how the narrative affects the various philosophical debates in Tristram Shandy and Jacques le fataliste. Contrary to what one expects from a philosophical novel, Sterne and Diderot do not impose upon the reader an authorial and authoritative discourse. Dominant discourses are constantly challenged and contradicted. The philosophical debates in both novels remain open and are left without a conclusion. The author's voice is but one amongst many others, and it is the narrative which maintains the dialogue between them by preventing one particular voice from invalidating the others. My argument hinges on Bakhtinian dialogism, which can be defined as the presence of interacting voices and views. In Tristram Shandy and Jacques le fataliste, dialogism occurs through the narrative structure allowing for the confrontation of the contradictory discourses in the philosophical debates, and enabling them to engage in dialogue, instead of establishing the authorial voice as the sole valid discourse in the text. Through those contradictions, the philosophical content takes on a different form, that of a refusal of systematic discourse. No dogmatic view is forced upon the reader. Sterne and Diderot do not offer a solution to the various philosophical questions debated in their novels. However, they do offer a philosophical method whereby the confrontation of contradictory ideas creates a dynamic for the pursuit of truth.

O Trabalho de dissertação se baseia principalmente nos livros Sobre a
Potencialidade da Alma: De quantitate animae e De libero arbítrio, escritos por
Santo Agostinho. Discorremos sobre o processo de conceituação do ente alma e da
solução do problema do livre arbítrio através do sistema pedagógico agostiniano
circuitum nostrum. Veremos que esse ente imaterial que nos faz racionais e,
portanto, humanos, é o que mais se aproxima de Deus, de todos os entes da
criação. Um ente Imortal, com ideias inatas, sem divisão e que monitora todas as
funções do corpo, possibilitando ao ser humano o uso das memórias, da razão e da
racionalidade. Subsistindo em si mesma, ela permanece mesmo depois da
separação do corpo, como uma entidade única e portadora de todas as lembranças
do corpo que animava para a vida. Apresentando-se como um dualista, Santo
Agostinho, nos revela que embora a alma esteja no corpo ela não está presa ao
corpo, porém no corpo. Sem crescimento ou envelhecimento esse ente imaterial,
sem dimensões é real, porém desconhecido do próprio sujeito que a acolhe. Um
ente que mantém o princípio vital e de animação (animus) do corpo. Quando essa
alma é educada pela racionalidade permite ao ser humano o uso pleno da liberdade
na escolha moral do agir, ou livre arbítrio. Veremos que a influência de Sócrates,
Platão e do neoplatonismo através dos diálogos inseridos no sistema pedagógico
agostiniano circuitum nostrum e, a relação entre o pedagogismo de Paulo Freire
como um espelho do agostiniano, através do diálogo como produtores de sujeitos
ativos na transformação da sociedade. / This thesis is based mainly on the books About the Potentiality of the Soul: De
quantitate animae and De libero arbítrio written by Saint Augustine. We discourse
about the process of conceptualization of the being soul and of the solution of the
problem of free choice through the Augustinian pedagogical system circuitum
nostrum. We will see that this immaterial being which makes us rational, and
therefore human, is what comes closest to God of all the beings of the creation. An
immortal being, with innate ideas, without division and which monitors all the
functions of the body, making it possible for the human being to use the memory,
reason and rationality. Subsisting in itself, it remains, even after the separation from
the body, as a whole entity and carrier of all the memories of the body which
animated it for life. Presenting himself as a dualist, St. Augustine reveals to us that
although the soul is in the body it is not bound to the body, but is in the body. Without
growth and aging this immaterial being without dimensions is real, however unknown
to the subject him/her self who houses it. A being which maintains the vital principle
and that of animation (animus) of the body. When this soul is educated by rationality
it permits the human being the full use of freedom in the moral choice of action, or
free will. We will see the influence of Socrates, Plato and neoplatonism through the
dialogs inserted in the Augustinian pedagogical system circuitum nostrum and the
relation between the pedagogism of Paulo Freire as a mirror of augustinianism,
through the dialog as producers of active subjects in the transformation of society.

Previous issue date: 2009 / O presente trabalho analisa problemas relativos à aplicabilidade dos direitos fundamentais às relações privadas. Apresenta-se um escorço de parte do desenvolvimento histórico dos direitos fundamentais a partir de sua concepção clássica liberal passando pelo modelo concebido para o estado social até o momento chamado “pós-social”. São apresentados e analisados alguns dos principais marcos teóricos do constitucionalismo contemporâneo quais sejam os fenômenos da personalização do direito privado da eficácia irradiante dos direitos fundamentais e da dimensão objetiva dos direitos fundamentais e os deveres de proteção. Aborda-se a tutela constitucional do princípio da autonomia da vontade e como ele se insere na idéia de um direito geral de liberdade na Constituição. São explorados os principais eixos temáticos da teoria dos princípios sobremodo a distinção teórico-estrutural da norma jurídica entre regra e princípio o fenômeno da colisão entre direitos fundamentais a regra da proporcionalidade como método de solução de tais colisões e as possibilidades de tal teoria quanto à sua racionalidade no controle intersubjetivo da aplicação e das restrições a direitos fundamentais. Apresenta-se um questionamento sobre qual o papel da constituição e dos direitos fundamentais no ordenamento jurídico. Discutem-se os principais modelos teóricos que tratam da eficácia horizontal dos direitos fundamentais. A seguir aborda-se a eficácia horizontal dos direitos fundamentais chamados direitos de defesa especialmente o direito ao devido processo legal e os direito fundamentais não trabalhistas nas relações de trabalho. Por fim é esboçada uma proposta para o problema da eficácia de direitos sociais de caráter prestacional e de direitos transindividuais nas relações privadas. / Salvador

The Master Thesis World of the Burgesses of Rokycany in the Light of Their Testaments in 16th - 18th Century is based on the studies of two books of last wills and testaments stored in the State District Archives in Rokycany. The base of sources is further enlarged by the prescriptive literature of that time, i.e. books of good deaths, the book of the St. Mary's Fraternity and church registers. Attention was gradually paid to the transformation of the testamentary practice in Rokycany, to the representation of piety in the testaments and to the perception of death. Moreover the author of the work has aimed her attention to the evidence of the structure of families in the Early New Age, of the social environments of the testator and material culture of the burgesses' households seen from the testaments. A component part of the thesis is a picture annex.
