To this end, it analyzed the private international law, through a brief historical foreshortening, general notions and the sources of this branch of law. In addition, it sought to verify the main elements of the Single Contract of Work, by definition, description, morphology and characteristics. The conclusion was the analysis of the International Working Agreement with the analysis of the connection elements of international standards, particularly the Convention of Rome and Mexico and the defense of the principle of freedom of choice as a connecting element of the Working International Contracts / A escolha do tema da presente tese de doutorado – A Aplicabilidade e a Eficácia Dos Contratos Internacionais de Trabalho pela Autonomia da Vontade – surgiu a partir da convicção de que as relações de emprego têm cada vez mais se internacionalizado e a autonomia da vontade se mostrado eficaz para a solução dos conflitos. Para tanto, analisou-se o Direito Internacional Privado, por meio de um breve escorço histórico, as noções gerais e as fontes desse ramo do Direito. Ademais, buscou-se verificar os principais elementos do Contrato Individual de Trabalho, através da definição, denominação, morfologia e características. To comprehend this object, the graphic novels of Will Eisner, an American cartoonist, which have the big city as central theme were chosen as the research corpus: A contract with God and other tenement stories; The building; New York, the big city; City people notebook; Invisible people and Dropsie Avenue, the neighborhood. Eisner s artistic sensibility provided him with an intelligent eye , attentive and motivated to know the city and its meanings. His interest in portraying the human condition led him to peculiar approaches of urban life, far from the univocal proposals that usually surrounds these representations, outlining a different kind of knowledge concerned to daily life, spatialities, affections, places. In this sense, I work with the hypothesis that Eisner builds a fable in comics, rather than a narrative, that communicates in a very peculiar way other knowledges about urban life, considering the language of the city and highlighting it as a communicative medium. In other words, translating the city to the comics, the cartoonist creates not only another form of storytelling, but also other urban cartography, especially sensitive, changing its meaning processes and contributing to the construction of a communicative thinking in and of the city, through its interactive exchanges, which transforms the look and the urban experience of its possible readers. The methodological strategy adopted involved the analysis of the creative process and the graphic novels which define the corpus, setting out the issues that motivate the artist, his possible roles, the signs of urban life and the elements with which he builds his presentation of the city, how he reinvents the language and other knowledges that emerge from this translation process. Therefore, some authors and concepts were fundamental as: the relations between space, culture and communication outlined by Ferrara; the confrontation between a planned and lived city, and the concepts of space and everyday life presented by Santos, Certeau and Lefebvre; the translation studies of Campos, Benjamin, Plaza and Ricoeur; the narrative concepts of Ryan and Benjamin; the comics studies produced by Sabin, McCloud and Cirne; beyond the concepts of cartography and sensitive developed by Deleuze & Guattari and Maffesoli / buscando responder a questão: como essa tradução possibilita outros conhecimentos a um pensamento de cidade? Para debruçar-se sobre tal objeto, foram escolhidos como corpus os romances gráficos de Will Eisner, quadrinista norte-americano, que tem a grande cidade como tema central: Um contrato com Deus e outras histórias de cortiço; O edifício; Nova York, a grande cidade; Caderno de tipos urbanos; Pessoas invisíveis e Avenida Dropsie, a vizinhança. A sensibilidade artística de Eisner lhe possibilitou um ver inteligente , atento e motivado em conhecer a cidade e seus significados. Seu interesse em retratar a condição humana, o conduziu a peculiares abordagens sobre a vida urbana, para além dos enfoques unívocos que costumeiramente cercam tais representações, delineando um tipo de conhecimento diferente ao abordar questões relacionadas ao cotidiano, às espacialidades, às afetividades, aos lugares. É nesse sentido que trabalho com as hipóteses de que Eisner constrói, mais do que uma narrativa, uma fabulação, sob a forma de quadrinhos, que comunica outros conhecimentos sobre a vida urbana, de uma forma muito própria, considerando a própria linguagem da cidade e salientando sua dimensão enquanto meio comunicativo. Ou seja, ao traduzir a cidade para os quadrinhos, o quadrinista cria não somente outra forma de narrar, mas também outra cartografia urbana, sobretudo sensível, alterando seus processos de significação e contribuindo para a construção de um pensamento comunicativo na e da cidade, por meio, sobretudo, do registro de suas trocas interativas, o que desloca o olhar e redimensiona a experiência urbana de seus possíveis leitores. A estratégia metodológica adotada envolveu a análise do processo criativo e romances gráficos que compõem o recorte, definindo as questões que motivam o artista, seus possíveis papéis, os signos da vida urbana e a partir de que elementos ele constrói sua apresentação de cidade, como movimenta a linguagem e que outros conhecimentos emergem desse processo tradutório. To this end, this work seeks to draw a general view about the subjective aspect of criminal law patriotic, examining the subjective elements of typicality, the antilegal and guilt, as well as the subjective conditions that influence the sentencing, not forgetting, even , to emphasize the Brazilian punitive legal system that preachescriminal justice. This examination, which reviews the changes that occurred throughout the history of Brazilian criminal law, intent, moreover, for theories that relate to the theme of subjectivity in the criminal as well as studies in the field of Psychology Personality of Psychoanalysis and Neurobiology, cast doubt on the freedom during the formation of intention (thought) and at the stage of manifestation (manifestation of thought). Thus, this research seeks to check if, in Brazil, today consolidated subjective structuring, which still has traces of retributive, thins the studies that have been held around the limits of human freedom. For the last, the problems pointed out that the Brazilian system has when it comes to the protection of human freedom, especially freedom of thought, this work assumes the task of providing, as appropriate, elements for a possible overhaul of the system. Without claiming to solve all problems related to this subject, this research aims, in short, bring to debate the problem of freedom in the camp of thinking and acting, so that, if possible, can promote a new reflection on the Brazilian penal law and its legitimacy / Partindo do conceito de liberdade, a presente pesquisa procura examinar os contornos que o direito à liberdade, sobretudo à liberdade que se relaciona ao pensamento e aos demais processos mentais (liberdade da vontade ou liberdade de pensamento em sentido amplo), assume dentro do sistema jurídico-penal brasileiro. Para tanto, o presente trabalho busca traçar um panorama geral acerca do aspecto subjetivo do Direito Penal pátrio, examinando os elementos subjetivos da tipicidade, da antijuridicidade e da culpabilidade, bem como as circunstâncias subjetivas que influem na fixação da pena, não se esquecendo, ainda, de enfatizar o caráter punitivo que predica o sistema jurídico-penal brasileiro. O referido exame, que passa em revista as transformações ocorridas ao longo da história do Direito Penal brasileiro, atenta, outrossim, para as teorias que se relacionam com o tema da subjetividade no âmbito criminal, bem como para os estudos que, no campo da Psicologia da Personalidade, da Neurobiologia e da Psicanálise, colocam em dúvida a liberdade na fase da formação da vontade (pensamento) e na fase da exteriorização (manifestação do pensamento). Assim, a presente pesquisa busca verificar se, no Brasil, a estruturação subjetiva hoje consolidada, que ainda possui os traços da retributividade, se afina aos estudos que têm sido realizados em torno dos limites da liberdade humana. Vista assim, toda a filosofia nietzscheana poderia ser entendida como uma grande crítica à cultura moderna, que o filósofo vê doente e necessitada de médicos para salvá-la. E a cura há que vir daqueles que se proponham a educar a humanidade para aquela elevação, mediante rompimento com idéias, práticas e métodos obsoletos. Todavia, se focarmos o exame em algumas partes de sua obra, veremos existir nelas pensamentos voltados mais diretamente para o tema da educação, em que, sem esforço demasiado, poderíamos ver delineada, ainda que não de maneira sistemática, uma filosofia da educação. Sabemos todos os operadores da esfera educacional que a questão "em que se constitui a filosofia da educação" é objeto de não poucos debates, parecendo distante o consenso em torno de uma definição. Se nos ativermos, porém, às questões que são colocadas pelas pessoas credenciadas a falar sobre o tema, veremos que dizem respeito a se a educação é direito de todos, se seu objeto é transmissão de conhecimentos, a formação do indivíduo, o desenvolvimento de suas potencialidades, o seu preparo para o exercício de uma profissão, todas essas tarefas, ou a combinação delas. De tudo isso Nietzsche se ocupou em seus escritos, sobretudo naqueles que são considerados por alguns biógrafos e comentadores como os da primeira fase de seu pensamento. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The philosophical Nietzsche's speech covers the life in ample gamma of considerations, but it is not difficult to visualize which is always present in its essence an educative concern, translated in the purpose to move the man from the destitute and unsafe state that it would have confined the modern culture, pointing it the exit that will be found in a new affirmative and superior culture. In this aspect, all the Nietzsche's philosophy could be understood it is a great critical to the modern culture, which the philosopher sees sick and needed of doctors to save it. The cure has to come from those who propose to educate the humanity for that elevation, by means of disruption with ideas, practical and obsolete methods that obstructs such mission. However, if we concentrate the examination in some parts of its work, we will see that there are more directly thoughts directed to the subject of the education, where, without too much effort, we could see delineated, yet not in a systematic way, an education's philosophy. We all operators of the educational sphere know that the question "what the education's philosophy constitutes" is object of not few debates, seeming far a consensus around a definition. CoordenaÃÃo de AperfeÃoamento de Pessoal de NÃvel Superior / Sabemos que o problema do livre-arbÃtrio à tratado, pelo menos, desde Epiteto. A liberdade de escolha que âjulgamosâ possuir à algo que supomos ser inerente à natureza humana. AlÃm disso, parece que sà poderemos ser pessoalmente responsÃveis por nossos atos se os realizarmos livremente. Acreditamos que ser responsÃveis por nossas aÃÃes e escolhas à o que nos torna diferentes dos outros animais. No entanto, apesar de todas essas nossas intuiÃÃes, nÃo sà algumas correntes filosÃficas defendem que nÃo somos livres, mas tambÃm a ciÃncia parece nos dizer que somos sistemas ou mÃquinas determinÃsticas. Os resultados de vÃrios experimentos neurocientÃficos tÃm sugerido que nÃo escolhemos conscientemente fazer o que fazemos. E, posto que a noÃÃo de livre-arbÃtrio tem como prÃ-requisito bÃsico a noÃÃo de consciÃncia, entÃo parece que hà um conflito entre nossas intuiÃÃes cotidianas e as conclusÃes cientÃficas e filosÃficas. Nesse sentido, abalizando os aspectos ambientais, econômicos e culturais das localidades. A memória coletiva é o principal método investigativo que possibilitou compreender a mobilidade empreendida pelas pessoas das margens do Lago Grande do Curuai ao Rio Arapiuns, remodelando novos agrupamentos societários. Na ampliação dos núcleos principais, entre outros motivos, está associada à satisfação das necessidades individuais de alimentar-se, vestir-se e abrigar-se; reprodução social e econômica. Amparada na memória das artesã(ãos), descrevo a ressignificação desse padrão de teçume local, mediando e mesclando desejos e sentidos às coisas na interpretação dos narradores aos significados que o conjunto cesteiro carrega de vida social. Apoderando-me de uma escrita conjugada entre o campo da pesquisa e o conjunto teórico eleito, considero as transmissões da tradição e a emersão do novo no rompimento de uma realidade social em transição, colocando os objetos culturais rolando na vida das pessoas como mercadorias, mas marcando e resistindo traços culturais. As barreiras que dantes dividiam bruscamente urbano e rural, são agora transpostas, revirando as categorias capitais econômicas e as relações de trocas entre o (pós)moderno (ou pós-industrial?) mundo contemporâneo e agrupamentos societários que ainda mantêm formas distintas de relações econômicas e socioculturais. As análises centraram-se na combinação da realidade da vida das(os) artesãs(ãos) e a condição global, a elaboração e o consumo de bens e objetos. Coisas que demarcam vida, mas, também demarcam territórios.

Based largely upon popular periodicals, archival materials, conference addresses, and mass-market books, this thesis combines intellectual and cultural history to explore how the meaning behind the evangelical commonplace, "God has a plan for your life," changed in post-World War II America, ultimately exchanging an ethos of self-denial for self-fulfillment by the early 1980s. The term "Personalized Life Providence" (PLP) is proposed for the integration of three Reformation-rooted ideas-vocation, providence, and discernment-into the discussion of finding God's plan for one's life. Chapter one sketches the Anglo- American development of these concepts from the Puritan era to the early twentieth century, as they intersected with Common Sense philosophy, "Higher Life" teaching, the student-missionary movement, and inter-war fundamentalism. Chapter two begins the analysis of PLP's dissemination throughout Chicago-centered evangelical student-parachurch organizations in the 1940s. InterVarsity Christian Fellowship and Youth for Christ conflated PLP with personal holiness and, after the war, a resurgent American foreign-missionary movement, as displayed particularly in the texts of IVCF's Urbana conferences. Chapter three focuses on Henrietta Mears, Christian Education Director of First Presbyterian Church in Hollywood, California. Mears's Sunday-School publications and college ministry reveal PLP's embrace of irenic neo-evangelicalism in the 1950s, coupled with a revised discernment process. Chapter four identifies the emergence of the "gospel of God's plan" from Mears's protégés, specifically Campus Crusade for Christ founder Bill Bright, Presbyterian minister Richard Halverson, and evangelist Billy Graham. Epitomized by the phrase, "God loves you and has a wonderful plan for your life," the first of Bright's Four Spiritual Laws, this gospel resonated with the religious revival, anti-Communist rhetoric, and psychological emphasis on self-actualization pervading American culture from 1947 to 1965. Chapter five argues that anti-Western sentiments in the1960s eroded PLP's evocation of missionary sacrifice in neo-evangelical circles. YFC encouraged teenagers to pursue culturally influential professions rather than traditional evangelism, while IVCF promulgated inconsistent teaching on discerning a foreign-missionary call in revolutionary times. Chapter six explores PLP's relationship to the widespread cultural shift toward self-fulfillment in the 1970s, as reflected both in evolving teaching on women's roles, career choice, and missionary service, and in PLP books styled after mass-market, self-help literature.

<p>Denna uppsats är huvudsakligen en diskussion av Augustinus försök att förena tesen att människan har en fri vilja med sin predestinationslära. Enligt de definitioner av ”determinism” och ”fri vilja” som föreslås i uppsatsen, utesluter predestinationens förhandenvarande möjligheten för människan att ha en fri vilja. Augustinus utgångspunkt i tron och hans antaganden om Guds och människans egenskaper, gör det omöjligt för honom att acceptera en sådan slutsats. Det samtidiga föreliggandet av predestinationen och den fria viljan utgör en betydelsefull komponent i hans syn på människans relation till Gud. Uppsatsen undersöker hur Augustinus resonemang i De Libero Arbitrio (Om den Fria Viljan) står sig mot en nutida kritik, för att i förlängningen söka påvisa varför hans antagande att människan har fri vilja inte är förenligt med hans samtidiga antagande att Gud har predestinerat alla händelser i världen.</p> / <p>This paper is mainly a discussion of Augustine’s combination of the idea that human beings have a free will with his doctrine of predestination. According to the definitions of “determinism” and “free will” suggested in this paper, the actuality of predestination excludes the possibility of human free will. Since Augustine takes starting-point in his belief in God and his assumptions about the attributes of God and human beings, such a conclusion is impossible for him. The actuality of both predestination and human free will is an important feature of his view of the relationship between human beings and God. This paper investigates how Augustine’s line of argument in De Libero Arbitrio (On Free Choice of the Will) manages to hold against a modern criticism. The primary aim is to show why Augustine’s assumption that human beings have free will is inconsistent with his assumption that God has predestined all events of the world.</p>
