L’applicabilité des droits de la personne aux organisations internationales – Approche critiqueLouwette, Arnaud 01 February 2018 (has links)
Il est indéniable que les organisations internationales exercent, de nos jours, un pouvoir important. Or, de cette constatation sont nés les appels à limiter le pouvoir de ces organisations et à leurs opposer les droits de la personne. Cette thèse étudie ce discours sur l'applicabilité des droits de la personne aux organisations internationales. Faisant appel aux écrits de Martti Koskenniemi, elle déconstruit dans un premier temps ce discours. Elle montre qu'il est impossible d'objectiver celui-ci et que toute tentative en ce sens amène immanquablement le juriste qui s'y essaie à exercer un acte de pouvoir et donc un acte politique. Cette thèse montre ensuite qu'en dépit de cette indétermination du droit, il est néanmoins possible de mobiliser les droits de la personne pour mettre en cause l'action des organisations internationales. Cette démarche implique toutefois d'accepter sa dimension politique et de prendre conscience des couts et bénéfices qui accompagnent celle-ci. Cette thèse met en avant les dynamiques de réussite des stratégies d'influence entre organisations. La conceptualisation : une conversation sur le concept d'influence. Plusieurs théoriciens proposent des approches originales de recherche sur l'influence. Notre approche théorique s’appuie sur des discussions conceptuelles avec James G. March, Jeffrey Pfeffer, ainsi que Ruth Zimmerling. Chacun partage une approche originale de la réalité recouverte par les phénomènes d'influence. Certaines questions soulevées pendant nos discussions sont tranchées au cours de la problématisation ; d'autres lors de la confrontation au terrain. L’approche empirique : une abduction à l’aide de huit casHuit études de cas sont choisies de manière à maximiser la variation des interactions entre organisations. Les nombreuses catégories sont regroupées par thèmes au fur et à mesure de l'apparition de changements sur le terrain. Les regroupements, les éliminations et les mises en relation suivent un processus d'abduction. Le regroupement des codes par thèmes aide à repérer les régularités au sein des cas, et les recoupements d'une étude de cas à l'autre lors d'analyses comparées. L’apport pratique : le processus dynamique mis en évidence par une chaîne de preuvesNotre conception de l’influence comme un couplage la reliant à ses résultats comportementaux permet la mise en exergue de trois phases régulièrement observées : la mise en relation avec un référent, son consentement et, enfin, le relais de son activation.Ce processus d'influence nous permet de qualifier et de souligner les leviers de la gestion des relations entre organisations dans la pratique de la stratégie et dans l'étude des organisations. / X

La fiabilité organisationnelle concerne l’étude des conditions organisationnelles permettant à un système organisé complexe de maintenir des niveaux de fiabilité compatibles à la fois avec les exigences de sécurité et les exigences économiques. Les études effectuées sur le fonctionnement des organisations à haute fiabilité mettent en avant un ensemble de pratiques et de dispositifs mis en place au sein de ces organisations, tant au niveau de l’individu et du groupe qu’au niveau de l’organisation, qui permettent à celles-ci de gérer et d’exploiter efficacement des systèmes techniques complexes à risques. Dans la lignée des différents apports sur ce qui fait la fiabilité au sein de telles entreprises, ce travail vise à démontrer la prise en compte du désordre, comme une des logiques organisationnelles, participant à la fiabilité de l’entreprise. En ce sens, une conceptualisation du désordre en tant qu’organisateur (désordre organisationnel) est proposée. À la suite de cette conceptualisation, la thèse démontre dans quelle mesure le désordre, par le biais de lamise en place d’organisations informelles stratifiées sur l’organisation formelle existante, permet de résorber et de restreindre les effets des perturbations. Le désordre est analysé comme catalyseur intrinsèque de la création de sens, participant à la fiabilité. En discutant la considération du désordre comme étant essence même de l’organisation, ce travail analyse l’approche normative sous-jacente dans la conception même de l’organisation et la fiabilité de celle-ci. / The study of high organizational reliability refers to the examination of conditions that allow a complex organized system to maintain high levels of reliability consistent with both security and economic requirements. Studies on the functioning of High Reliability Organizations (HRO) feature a set of practices and mechanisms implemented within these organizations - at the individual, group and organizational levels - which enable them to manage and operate effectively complex technicalsystems at risk. In line with the contributions on what contribute to high reliability in such companies, this work aims to demonstrate the consideration of disorder, as one of the organizational logics, supporting reliability of the company. In this sense, a conceptualization of disorder as an organizing component (organizational disorder) is proposed. As a result of this conceptualization, the thesis demonstrates to what extent organizational disorder, through the establishment ofinformal organizations stratified on the existing formal ones, can reduce and limit the effects of disruptions. Disorder is analyzed as an intrinsic catalyst of sensemaking, partaking to high reliability. By discussing the consideration of disorder as the very essence of the organization, the thesis also debates upon the underlying normative approach in the very conception of the organization and its ensuant high reliability.

The focus of this study was to investigate the employment difficulties faced by individuals who had been retrenched from the insurance industry during the years 2000 to 2013 in order to develop an understanding of the continuity in the specialist type of work after their retrenchment. The study also aimed to investigate the actual
and perceived barriers that need to be addressed in the South African small business environment and the specific soft skills and business skills of small business owners and non-small business owners.
The research design of this exploratory study entailed a positivist research philosophy using a deductive research approach. This quantitative research was conducted by means of a survey questionnaire. A questionnaire was designed and used to determine the level of importance and the level of own skills for small business owners and non-small business owners respectively in terms of
predetermined soft and business management skills. The answers provided on these questions were then analysed to determine whether there was a gap between the level of importance assigned to these skills and their own skill ratings. This research determined the barriers faced by small businesses in South Africa as well as the level of agreement regarding the predetermined actual and perceived barriers
pertaining to the small business environment. Notable findings of this study include that there was a distinct lack of continuity in the specialist type of work by the small business owner respondents in the insurance
industry. There was a marked difference between the level of portance and own skill ratings assigned to the predetermined soft skills and business management skills with non-small business owner respondents mostly rating themselves as better skilled than small business owners did. However, the fact that these non-small
business owner respondents did not start their own small businesses points towards higher risk aversion. This study also found that small businesses in South Africa are facing pronounced barriers within the small business environment. / Business Management / M. Com. (Business Management)

Constructing mixed race : racial formation in the United States of America and Great BritainNjaka, Chinelo January 2017 (has links)
The aim of the thesis is to examine contemporary constructions of mixed race in the United States and Britain through the examination of two types of racial projects: the national census and voluntary and community organisations focused on mixed race. Using a combination of critical discourse analysis and qualitative interviews, the research analyses the ways in which mixed race is being described, conceptualised, and constructed through macro- and meso-level racial projects in each nation, in order to compare the racial formation processes that are occurring in the early twenty-first century's "mixed race moment". The thesis builds upon racial formation theory, which argues that the concept of "race" is never fully fixed, but rather is made through socio-historical processes that create, inhabit, transform, and destroy racialised notions over time and context (Omi and Winant 1986, 1994, 2015). The theory examines the struggles over racialised meanings that occur between macro-level and micro-level racial projects. This thesis aims to fill the gap left by this focus through examining racial projects that occupy the socio-political "middle ground" between macro- and micro-level projects: the "meso-level."The research examines the ways in which the state constructs mixed race in the United States and Britain. Each nation's census allowed for mixed race self identification in 2000 and 2001, respectively. The thesis examines the social, historical, and political processes that led to mixed race options at that particular time. It argues that the ways in which the census organisations report upon mixed race functions as a discursive practice that provides an official construction of mixed race through simultaneously reflecting and shaping racialised descriptions and narratives within each nation. The thesis examines the usefulness of "meso-level" projects by exploring the role of mixed race organisations in racial formation processes through the examination of six meso-level mechanisms of racialisation: social identity, social capital, collective action, idioculture, extended networks, and civil society (Fine 2012). Incorporating Michel Foucault's notion of "governmentality" (Gordon 1991), the thesis highlights the ways that mixed race organisations have interacted directly and indirectly with macro-level bodies during and after the addition of the mixed race census options as well as other routes of interaction specific to each national context. The thesis argues that the racialisation that occurs at the macro-level holds a "default" role with which mixed race organisations then engage. This highlights the relative roles of power the institutions have in each national context and the ways they are managed through relations fostered through governmentality. The thesis also examines the discourses used by mixed race organisations in the US and Britain as meso-level racial projects and poses the argument that the varied usage of multiple racialised paradigms leads to an increased relative fluidity in the constructions of mixed race than their respective macro-level projects. The systematic cross-national comparison of the ways mixed race is constructed in the US and Britain highlights the ways in which both macro-level and meso-level organisations articulate and promote racialised ideology through their relative levels of power in society. By analysing and comparing these racial projects and their interactions, the paradigms and discourses used reveal the particularities and overlaps by these organisations as they contest, negotiate, and accept formations of mixed race.

With the advent of knowledge-intensive economies, plus the ever-accelerating development of Information and Communication Technologies (ICTs), organisational knowledge has become the key driver of an organisation's value and ultimately, an important source of an organisation's sustainable competitive edge. Thus, numerous organisations have started to invest heavily in establishing knowledge management systems (KMSs). Subsequently, they wish to access knowledge from individuals in order to enhance their acquisition of knowledge and ultimately transform this into organisational knowledge. Even though existing research studies have evidenced extensively the intrinsic and extrinsic motivators of individuals' knowledge-sharing behaviour in organisations from diverse perspectives (e.g. organisational behaviour, sociology and psychology), individuals still seem inclined to hoard their knowledge, rather than share it with others in organisations. To this end, this research aims to investigate and identify essential elements related to individuals' knowledge-sharing behaviour within the complex context of the virtual organisation of Taiwanese Non-governmental Organisations (NGOs), comprising the whole system of Taiwanese Farmers' Associations, by integrating multilevel perspectives of individuals in organisations (the micro-level), workplace networks in organisations (the meso-level) and organisational culture (the macro-level).

Que peut espérer le réclamant ? Cette thèse se propose de traiter ce faisceau de questions par une enquête ethnographique menée dans deux grandes entreprises françaises. S’appuyant sur l’outillage analytique développé par Albert O. Hirschman, elle propose une description historique et sociologique des pratiques de traitement des réclamations. Ainsi, elle souhaite contribuer à la problématique de l’influence du destinataire final d’une marchandise sur les entreprises qui la produisent et la vendent. / Why and how do large companies deal with customer complaints? What effects does this treatment have on the internal regulation of firms? What can the customer expect? This thesis proposes to deal with this set of questions by an ethnographic survey conducted in two large French companies. Based on the analytical tools developed by Albert O. Hirschman, it provides a historical and sociological description of the complaint-handling practices. Thus, it wishes to contribute to the question of the influence of the client of a commodity on the companies that produce and sell it.

During the past few decades, the sport industry has experienced immense pressure to commercialise its operations and conform to traditional business practices (Chadwick 2009:191). With this evolution from a pure leisure activity to a multimillion dollar industry, it has become evident that the unique characteristics and deeply rooted historical culture of sport pose significant challenges for the sport manager during the process of commercialisation and the application of strategic management. The aim of this study was to analyse the current business environment of Cycling South Africa (CyclingSA) in such a way that the factors in the micro-environment, market environment and macro-environment that impact on the organisation‟s strategic decisions could be identified. The results should allow sport organisations to engage more effectively in strategic management by focusing on factors that influence the sport organisation‟s business environment in particular. A survey of CyclingSA members‟ perceptions of the organisation‟s current effectiveness in the business environment revealed a strong focus on financial and marketing elements. The study also found that factors such as loyalty programmes, talent identification and sport science support, safety in the physical environment, antidoping regulations, transformation and black economic empowerment and environmental friendly practices play a key role in CyclingSA‟s business environment. It is evident from the study that sport organisations, with specific reference to CyclingSA, should engage in strategic management by adapting traditional business principles to suit each organisation‟s unique needs. / Business Management / M. Understanding the discourse of British Muslim NGOs : Islamic relief and MADE as case studiesPettinato, Davide Domenico January 2017 (has links)
Inspired by the increasingly high visibility of British Muslim NGOs (BMNGOs), by the lack of research on their discourses and by the growing salience of frames theory within the mainstream NGO sector, this thesis offers a significant and original contribution by exploring, describing, and analysing the discourse of two BMNGOs carefully selected as case studies: Islamic Relief (IR) and MADE (Muslim Action for Development and the Environment). The primary aim of the thesis is empirical, driven by the research question: ‘what frames seem to be at work in the discourse of BMNGOs?’ Through an in-depth analysis of a range of public documents produced by the two case studies (e.g. annual reports and websites), the thesis identifies and analyses the main frames used by IR and MADE to articulate three key aspects of their discourses: i) organisational identity; ii) mobilisation efforts; and iii) conceptualisations of their supporter base. Guided by this overarching research question, the thesis offers an original and interdisciplinary insight into the nuances of the case studies’ meaning systems, thereby showing their complexities and resonance with multiple narratives and ideational repertoires. The emerging ‘thick descriptions’ of IR and MADE represent, in and of themselves, the main results of the study, which is intended to enable readers from different disciplinary backgrounds to gain a nuanced insight into BMNGOs’ discourses. At a secondary level, the thesis also pursues the theoretical aim to start exploring how the frames identified in the study inform the two research sub-questions: ‘how to think about BMNGOs?’ and ‘how to think about British Muslim civic engagement?’ Several observations are put forward in this regard. Taken together, these suggest that IR can be understood as a faith-based organisation that simultaneously draws on a range of heritages and increasingly offers opportunities for active citizenship among British Muslims within the framework of what is broadly characterizable as a ‘NGO-led order’. On the other hand, the thesis suggests that MADE can be understood as an exemplar of the current era of ‘loose activist networks’, more precisely as a ‘Muslim lifestyle’ social movement organisation that promotes among British Muslims a multifaceted form of civic engagement inspired by an Islamic ethical framework.
