Previous issue date: 2015-06-16 / Current trends in criminal law propose replacing the deprivation of liberty for
alternative sentences, focusing on education and prevention, particularly for illicit less
offensive potential, given the high costs and damages arising from the prison to the
individual and the community. It is proposed to analyze the criminal alternative used
by Goiás Judiciary to replace the prison sentence for cases of individuals in conflict
with the law, for unlawful conduct associated with problem drug use or under the
influence of these, focusing on the Justice Programme Therapy adopted in Goiânia
County. Through literature, with study of foreign and national literature, this last little,
in addition to legislation, official documents and using qualitative and quantitative
methodology, we proceeded to the analysis of the data, for the period 2010 to 2013.
The study recovered the history of prohibition in the world and in Brazil, legislation
influenced, and the essential concepts for understanding the action of the drug and
its relationship to crime. The history of Therapeutic Jurisprudence were raised, of
foreign origin, and national experience with theoretical support in Wexler and Winick
(2002), Lima (2009) and Fensteseifer (2009). It appears that the criticism that the
Therapeutic Justice homeland receives are unjustified because it differs from the
American and Canadian model. The analysis of the experimental data in Goiânia-GO
concluded that 43.60 % of the participants completed the program with an average
duration of 12 months and 85.1 % of the participants had no involvement in criminal
proceedings as defendants in the region, similar to the results International, showing
that it is an effective alternative to criminal probation and reduction of recidivism. / As tendências atuais no Direito Penal propõem a substituição da pena privativa de
liberdade por penas alternativas, com foco na educação e prevenção, principalmente
em ilícitos de menos potencial ofensivo, face os elevados custos e danos oriundos
do cárcere para o indivíduo e a comunidade. Propõe-se analisar a alternativa penal
utilizada pelo Poder Judiciário de Goiás em substituição a pena de prisão para os
casos de sujeitos em conflitos com a lei, por conduta ilícita associada ao consumo
problemático de drogas ou sob a influência destas, focalizando o Programa Justiça
Terapêutica adotado na Comarca de Goiânia. Por meio de pesquisa bibliográfica,
com estudo da literatura estrangeira e nacional, esta última escassa, além da
legislação, documentos oficiais e utilizando metodologia quali-quantitativa, procedeu-
se a análise dos dados obtidos, referente ao período de 2010 a 2013. O estudo
recuperou a história do proibicionismo no mundo e no Brasil, a legislação que
influenciou, e os conceitos essenciais para compreensão da ação das drogas e sua
relação com criminalidade. Foram levantados os antecedentes da Therapeutic
Jurisprudence, de origem estrangeira, e sua experiência nacional, com aporte
teórico em Wexler e Winick (2002), Lima (2009) e Fensterseifer (2009). Constata-se
que as críticas que a Justiça Terapêutica pátria recebe não se justificam porque
difere do modelo americano e canadense. A análise dos dados da experiência na
cidade de Goiânia-GO concluiu que 43,60% dos participantes concluíram o
programa com duração média de 12 meses e 85,1% dos concluintes não tiveram
envolvimento em ações penais como acusados na comarca, semelhantes aos
resultados internacionais, mostrando que é uma alternativa penal eficaz para
reinserção social e redução da reincidência penal.

A tese analisa a atuação dos secretários de segurança e sua capacidade de gerar mudanças nas instituições de segurança e sobre os índices de criminalidade e violência. O objeto de investigação circunscreve-se ao âmbito do estado do Rio Grande do Sul, na cidade de Porto Alegre, nas gestões da segurança pública do período entre 2001 a 2015. O enfoque é a política de segurança proposta pelos secretários de segurança e os dados criminais da cidade de Porto Alegre, que possibilitam um diálogo com a política criminal portuguesa e programas especiais de segurança pública, executados pela Polícia de Segurança Pública. Para esse cenário, a tese busca apresentar o contexto histórico, social e econômico que favorece a criminalidade em Porto Alegre e na cidade do Porto, fazendo um debate com elementos como planos de segurança, modelos de policiamento, índices criminais, a política criminal portuguesa, a lei que descriminaliza o consumo de drogas em Portugal e os programas especiais da Polícia de Segurança Pública do Porto. Em termos metodológicos, foram realizadas análises de documentos; foram levantados dados sobre criminalidade, reaparelhamento das instituições de segurança, investimento em formação, novas tecnologias e participação social; e foram realizadas entrevistas. The focus is the security policy proposed by the secretaries of security and the data criminal cases of the city of Porto Alegre, that allow a dialogue with the Portuguese criminal policy and special programs of public security, executed by the Public Security Police. For this scenario, the thesis seeks to present the historical, social and economic context that favors criminality in Porto Alegre and in the city of Porto, by discussing elements such as security plans, policing models, criminal indexes, Portuguese criminal policy, law that decriminalizes drug use in Portugal and the special programs of the Porto Public Security Police. In methodological terms, document analyzes were carried out; data were collected on crime, re-organization of security institutions, investment in training, new technologies and social participation; and interviews were conducted. The view of the criminal has a big difference, some secretaries avoid this angle, some understand that they are citizens who should have opportunities and others understand them as hopelessly deviant people. Thus, the secretaries are divided among more focused on a social-critical approach to the context of crime, those who are in an intermediate stage, conservative, seeking preventive actions and those who focus on a punitive and traditional perspective of the fight against crime. As for Portugal, he comes to this thesis to confirm the possibilities of a peaceful social coexistence, in spite of the existence of socioeconomic problems, highlighting important cultural elements in the construction of safe environments. Finally, the Public Security Police demonstrates the importance of special, perennial, well-defined security programs aimed at more vulnerable groups.

À l'heure actuelle, deux formes de sanctions pénales s'opposent et se complètent : une forme classique et rétributive, la peine, et une forme plus moderne et essentiellement préventive, la mesure de sûreté. Ces deux sanctions pénales, si elles ne possèdent ni les mêmes fondements, ni les mêmes objectifs, sont pourtant parfois difficiles à différencier. La question des rapports qu'elles entretiennent est récurrente mais au regard de l'augmentation constante du nombre de mesures de sûreté dans la loi pénale depuis ces dernières années, elle mérite désormais une réponse. Cette dernière sera apportée à l'aune de la notion d'autonomie qui permettra d'une part d'identifier clairement les mesures de sûreté et d'autre part de dégager un ensemble de règles plus ou moins spécifiques destinées à clarifier leur régime juridique. De cette manière, la légitimité de l'existence des mesures de sûreté pourra être confirmée. / At the moment, two forms of penalties oppose and complement each other: a classic shape and rétributive, the sentences, and a more modern and essentially preventive shape, the safety measures. These two criminal punishments, if they do not possess either the same foundations, or the same objectives, are nevertheless sometimes difficult to differentiate. The question of the relationships which they maintain is recurring but with regard to the constant increase of the number of safety measures in the penal law for these last years, it deserves from now on an answer. The latter will be brought in the form of the notion of autonomy which will on one hand allow to identify clearly safety measures and on the other hand to clear a set of more or less specific rules intended to clarify their legal regime. In this way, the legitimacy of the existence of safety measures can be confirmed.

[pt] A presente tese de doutorado tem por objetivo buscar evidências do
fenômeno denominado populismo penal na atividade legislativa brasileira, tendo
por base a análise das justificativas dos projetos de lei (PLs) que pretendem
aumentar penas, apresentados no período de 2006 a 2014 na Câmara dos
Deputados. O trabalho apresenta como problema de pesquisa a investigação das
intenções declaradas e as razões pelas quais o legislador persiste na proposição de
aumentos de pena. Por que o político insiste em aumentar penas? É hipótese desse
trabalho que o legislador assim tem atuado pois tem aderido ao populismo penal,
um fenômeno caracterizado por discursos e práticas de endurecimento penal,
pretensamente apoiados em um público homogêneo clamante por punição. Esse
recrudescimento viola a principiologia penal que deflui do modelo constitucional
brasileiro, bem como aposta invariavelmente nas finalidades da pena reconhecidas
como prevenção geral negativa (dissuasão) e retribuição. Por isso, no plano
teórico, estabelecemos as premissas teóricas para a análise dos PLs, (i) indicamos
cinco princípios limitadores do poder punitivo, (ii) apontamos as teorias dos fins
da pena reconhecidas pelo discurso oficial da penologia, e (iii) expusemos a nova
cultura do controle do crime (David Garland), na qual o populismo penal está
inscrito (John Pratt e Julian V. Roberts). No plano prático, foram analisadas 758
(setecentas e cinquenta e oito) proposições legislativas que, após depuração,
resultaram em 191 (cento e noventa e uma) que se inseriam no escopo da
pesquisa: aumentos de pena de crimes já existentes. O ano de 2006 foi escolhido
como termo inicial por duas razões. Em primeiro lugar, permite compreender duas
legislaturas na Câmara dos Deputados, a quinquagésima terceira e a quinquagésima quarta, respectivamente nos períodos
2007-2011 e 2011-2015. Em segundo lugar, possibilita a continuidade na
produção de conhecimento científico em matéria de produção legislativa de
normas penais, considerando pesquisa publicada pelo Ministério da Justiça, na
Série Pensando o Direito número 32 (Análise das justificativas para a produção de
normas penais), que abrangeu o estudo de proposições legislativas no período de
1987 a 2006. O marco final de 2014 se justifica por duas razões: encerramento da
quinquagésima quarta legislatura da Câmara dos Deputados (2011 a 2015) e necessidade de pôr
termo à etapa de levantamento de dados para este trabalho acadêmico. Os achados
de pesquisa deste estudo científico, após análise quantitativa e qualitativa das
justificativas dos 191 PLs, permitiu identificar que: (i) quase metade (48,16 porcento) das
proposições aposta no efeito dissuasório da pena (prevenção geral negativa),
finalidade que tem caracterizado o populismo penal; (ii) 63,35 porcento dos PLs não
fizeram quaisquer referências a dados, estudos e estatísticas relacionadas a norma
que pretende alterar, confirmando o processo de desestatisticalização do
populismo penal, a ausência do conhecimento técnico e a supremacia do senso
comum; (iii) um quinto (20,41 porcento) dos PLs versavam sobre crimes contra a pessoa,
enquanto apenas 2,09 porcento dos PLs compuseram o chamado Direito Penal
Econômico, confirmando a seletividade do legislador; (iv) quase um quinto
(19,37 porcento) das proposições indicaram responsividade do legislador à mídia, pela
qual a repercussão midiática criminal afeta o legislador para a propositura de PL
punitivista, sugerindo um comportamento populista punitivo dos parlamentares;
(v) os PLs mostraram-se diluídos entre os diversos partidos políticos de maior
representatividade, confirmando o caráter suprapartidário do populismo penal. A
conclusão da tese aponta para a ideia segundo a qual o legislador brasileiro realiza
política criminal legislativa irracional, flertando com o fenômeno mundial do
populismo penal, que tem caracterizado as democracias ocidentais
contemporâneas. Ignora os princípios penais regentes da produção legislativa.
Aposta na função dissuasória da pena, cuja eficiência não se provou na história.
Ao contrário, produziu encarceramento em massa, o qual se mostra incapaz de
reduzir índices de criminalidade. / [en] This doctoral thesis aims to find evidence of the phenomenon called penal
populism in the Brazilian legislative activity, based on the analysis of the
justifications of the bills (B s) which tends to increase penalties, presented for the
period 2006-2014 in the Chamber of Deputies. This work presents as research
problem the investigation of the stated intentions and the reasons why the
legislature persists in raising penalty. Why the political insists on increasing
penalties? It is hypothesis of this work that the legislator has acted as it has
adhered to the penal populism, a phenomenon characterized by speeches and
criminal hardening practices, allegedly backed on a homogeneous public
clamoring for punishment. This violates the criminal upsurge of principles that
derives from the Brazilian constitutional model and invariably bet on the purposes
of the sentence recognized as negative general prevention (deterrence) and
retribution. So, in the theoretical plan, we have established the theoretical
premises for the analysis of B s, (i) indicated five limiting principles of punitive
power, (ii) pointed out the theories of the purposes of punishment recognized by
the official discourse of penology, and (iii) we exposed the new crime control
culture (David Garland), in which the penal populism is inscribed (John Pratt and
Julian V. Roberts). In the practical plan, we have analyzed 758 (seven hundred
fifty-eight) legislative proposals that, after purification, resulted in 191 (one
hundred and ninety-one) that fell within the scope of this research: penalty raising
for existing crime. The year 2006 was chosen as the initial term for two reasons.
First, allows embracing two terms in the Chamber of Deputies, the 53rd and 54th
respectively in the periods 2007-2011 and 2011-2015. Second, it enables the
continuity in the production of scientific knowledge on legislative production on
penal law, considering research published by the Ministry of Justice, Thinking
Series Law No. 32 (Analysis of the justifications for the production of criminal
provisions), which covered the study of legislative proposals from 1987 to 2006.
The final point at 2014 is justified for two reasons: closing the 54th Legislature
Chamber of Deputies (2011 to 2015) and the need to end the data collection phase
for this academic paper. The research findings of this scientific study, after
quantitative and qualitative analysis of the justifications of 191 B s, identified
that: (i) almost half (48.16 percent) of the proposals focus on the deterrent effect of
punishment (negative general prevention), the aim of punishment that has
characterized the penal populism; (ii) 63.35 percent of B s have made no references to
data, studies and statistics related to standard targeted to change, confirming the
penal populism process of destatisticalization, a lack of technical knowledge
and the supremacy of common sense; (iii) a fifth (20.41 percent) of B s were about
crimes against the person, while only 2.09 percent of B s made up the so-called
Economic Criminal Law, confirming the selectivity of the legislator; (iv) almost a
fifth (19.37 percent) of the proposals indicated responsiveness of the legislator to the
media, in which the criminal media repercussion affects the legislature for
bringing punitive bill, suggesting a punitive populist behavior of parliamentarians;
(v) the B s proved to be diluted among the various most representative political
parties, confirming the nonpartisan character of penal populism. The conclusion
of the thesis points to the idea that the Brazilian legislator performs irrational
legislative criminal policy, flirting with the worldwide phenomenon of penal
populism that has characterized contemporary Western democracies. Ignores the

whose efficiency has not been proven in history. rather, produced mass
incarceration, which is incapable of reducing crime rates.

This diploma thesis deals with alternative sanctions in the Czech Republic. It primarily focuses on the cooperation between relevant actors during the process of decision-making about the type of sanction, its execution and supervision, and also concentrates on possible changes of its use after the amendment of criminal law in 2010. To give a complex view on given issue, the thesis also shortly focuses on alternatives to sanctions and diversions of criminal proceedings. System of alternative sanctions is framed by criminal policy and criminal law of the Czech Republic and factors that have influence on functioning of the system are determined. Those factors are multinational structures (OSN, EU, Council of Europe), level of registered criminality, forms of criminality and public opinion. Despite the fact, that Czech criminal law contains quite wide enumeration of alternative sanctions, there are still opinions that they are not used enough and that imprisonment is still preferred and it causes overcrowding of prisons and it is burden for state budget. Judges and prosecutors advocate themselves and claim that the problem is not on their side but rather the conditions of alternative sanctions which are poorly regulated and so it discourages from their use. La révolution numérique a favorisé l’apparition d’une nouvelle forme de criminalité : la cybercriminalité. Celle-ci recouvre un grand nombre de faits dont la plupart sont commis à l’aide de stratégies d’ingénierie sociale. Il s’agit d’un vieux phénomène, pourtant mal connu qui, encouragé par l’accroissement de données circulant sur Internet et par le développement de barrières techniques de sécurité, s’est adapté aux caractéristiques de l’univers virtuel pour une exploitation combinée des vulnérabilités « humaines » avec des outils numériques. L’ingénierie sociale transforme les utilisateurs qui deviennent, inconsciemment, facilitateurs des cyberattaques, au point d’être perçus comme le « maillon faible » de la cybersécurité. Les particuliers, les entreprises et les Etats sont tous confrontés au défi de trouver une réponse à ces atteintes. Cependant, les moyens juridiques, techniques, économiques et culturels mis en place semblent encore insuffisants. Loin d’être éradiquée, l’utilisation de l’ingénierie sociale à des fins illicites poursuit son essor. Face au manque d’efficacité de la politique criminelle actuelle, le travail en amont nous apparaît comme une piste à explorer. Savoir anticiper, détecter précocement et réagir promptement face à la délinquance informatique sont alors des questions prioritaires nécessitant une approche plus humaniste, axée sur la prévention et la coopération. Si nous sommes d’accord sur ce qu’il reste à faire, le défi est de trouver le« comment ». / The digital revolution has encouraged the emergence of a new type of criminal activity : cyber-crime. This includes a vast array of activities and offences that often use social engineering techniques. These techniques are old and not widely understood, yet benefit from the increase of data available online and the use of firewalls and other security systems. They have been adapted to work with the Internet and digital technologies in order to exploit the “vulnerabilities” of human psychology. Social engineering targets the user, who often unconsciously, allows access to systems or data, making the user the weakest link in the cyber-security chain. Individuals, companies and governments are all facing the same challenge in trying to solve these issues, utilising current legal, financial, technological and social resources which seem to be insufficient. Far from being eradicated, fraudulent activities that use social engineering continue to increase in prevalence. The inefficiency of current judicial polices forces us to consider alternative strategies upstream. Being proactive, predicting early and reacting quickly to computer related crimes should be the priority of a more humanistic approach which is focused on prevention and cooperation. Although one can agree on the approach ; the challenge is to find out how to implement it.

[pt] Centra-se a pesquisa em apontar inconsistências encontradas em tendência doutrinária hodierna, que se inclina favoravelmente ao estabelecimento de estamentos ascendentes de supressão de garantias e desenrijecimento de dogmas para a construção do Direito penal, seja no ato de criminalizar primariamente condutas de menor potencial ofensivo ou no que tange àquelas de gravidade máxima. O caminho metodológico utilizado foi o de contrapor duas categorizações acerca das quais a moderna doutrina identifica distinções mais nítidas: de um lado, o Direito penal clássico, assentado na proteção de bens jurídicos de índole exclusivamente antropocêntrica; de outro, o Direito penal econômico, que estende sua tutela às vicissitudes da sociedade de risco: bens jurídicos supra-individuais e interesses difusos e coletivos. Dividido em quatro capítulos, o trabalho aborda no primeiro deles as bases constitucionais em que se assenta a ordem econômica; em seguida, estuda-se o Direito penal clássico, inclusive no tocante à sua missão, finalidades e princípios em que se funda; no terceiro capítulo historia-se o surgimento do Direito penal econômico, apontam-se seus limites conceituais e se estabelecem seus critérios diferenciadores. Conclui-se o trabalho ideando que a dicotomia proposta pela doutrina produz efeito político-criminal de viés acentuadamente retórico, implicando, na verdade, em sub-reptício incremento do poder punitivo estatal. Nos casos envolvendo a chamada criminalidade de poderosos, serve para controle de ativos não certificados; enquanto à criminalidade convencional, legitima a exclusão da população redundante. / [en] The research aims at evidencing the inconsistencies found in contemporary theoretical trend, which favors the establishment of increasing conditions for the suppression of protections and weakening of dogmas in the conception of Penal Law, whether by primarily criminalizing conducts of minor offensive potential or those concerning maximum offensive potential. The methodological approach was to compare two categories modern theory establishes as distinct: on one hand, the classical Penal Law, based on the protection of legal interests of a solely anthropocentric nature; and, on the other hand, economic Penal Law, which casts its protection against the vicissitudes of the risk society: supra-individual legal interests and widespread and collective interests. The dissertation is divided in four chapters. In the first one, it focuses on the constitutional basis of the economic order. Then, it analyzes the classical Penal Law, including in relation to its tenets. In the third chapter, the emergence of the economic Penal Law is discussed; its conceptual limits are indicated and differentiating criteria are established. It is concluded that the dichotomy suggested by the theory produces a political-criminal effect of an extremely rhetorical bias, resulting, in actuality, in a surreptitious increase of the punitive power of the State. In cases involving the so-called criminality of the powerful, it functions as a control over non-certified assets; whereas regarding conventional criminality, it legitimates the exclusion of the disenfranchised population.
