[pt] O estudo de organizações em um contexto de responsabilidade social e ética é um tema de notória importância nos tempos atuais. Igualmente relevante é a abordagem desta problemática em organizações do Estado, dada sua importância para o desenvolvimento da sociedade e do país como um todo. Este trabalho apresenta resultados de uma análise interna de adequação estratégica do Departamento de Polícia Federal (DPF) por meio do método de estudo de caso simples, de acordo com a metodologia de Yin (1987). Tal organização foi escolhida devido à sua importância destacada nas políticas de segurança pública desenvolvidas pelo governo; políticas estas de grande influência no desenvolvimento sócio-econômico do Brasil. Para o desenvolvimento do referencial teórico da pesquisa, foi conduzida uma revisão da literatura ampla em periódicos nacionais e internacionais, além de dissertações de mestrado e teses de doutorado, buscando-se assuntos relacionados com responsabilidade social, ética, gestão baseada em performance, planejamento estratégico, adequação estratégica e alianças. A análise estratégica foi realizada usando o ferramental analítico desenvolvido por Macedo-Soares (2000; 2001), tendo este sido adaptado à organização em questão com as contribuições da revisão da literatura. Tal análise considerou informações obtidas por pesquisa documental e por levantamentos de percepções obtidas, por meio de questionários e entrevistas, de servidores do DPF. Os resultados da pesquisa sugerem que se trata de uma organização com satisfatória adequação estratégica. O DPF apresenta expressivos resultados operacionais, bem como, paralelamente, possui uma constante preocupação com a responsabilidade social e a ética no exercício do poder de polícia. Um ponto importante concerne o fato dos servidores da instiuição serem apontados como sua grande força; por sua vez, as fraquezas e ameaças seriam oriundas, em sua maioria, da condição de subordinação da PF ao Governo Federal. Boas oportunidades podem ser observadas no sentido de construção da imagem do Departamento perante a sociedade, busca por mais autonomia e ampliação das alianças, segundo os membros do órgão. São observadas ainda uma série de forças potenciais, dependentes apenas de iniciativas bastante plausíveis. A pesquisa conclui que a cultura organizacional, a orientação à gestão participativa e o relacionamento com a sociedade civil são fatores que deveriam ser aprimorados no órgão. / [en] The study of organizations in a context of social responsibility and ethical is an important topic today. Equally relevant is how state organizations approach the topic, given its importance to the development of society and the country as a whole. This work presents the results of an internal analysis of strategic fit of the Federal Police Department (FPD) by means of a simple case study method, in accordance with the methodology of Yin (1987). This organization was chosen due to its importance in the political issues of public security developed by the government; issues of great influence in the socio- economic development of Brazil. For the theoretical references in this work, a vast revision of literature in national and international periodicals was conducted, as well as of master´s dissertations and doctoral theses, in a search for topics related to social responsibility and ethical, management based on performance, strategic planning, and adequacy of strategies and alliances. The strategic analysis was done using the analytical tools developed by Macedo-Soares (2000; 2001), adapting it to the organization in question with the revision of the literature. This analysis considered information obtained through research of documents as well as surveys through questionnaires and interviews of members of the FPD. The results of the research suggest that the FPD is an organization with satisfactory strategic fit. The FPD shows good operational results, as well as a constant preoccupation with social responsibility and ethical in its function as a police force. An important point is the fact that the members of the FPD are its strength; its weaknesses and threats are, in their majority, a result of the subordination of the FPD to the federal government. Good opportunities can be observed in the construction of the Department`s image in society, in search for more autonomy and enlargement of alliances, according to the organ members. There are also many potential strengths, dependent only on rather plausible initiatives. The research concludes that the organizational culture, the orientation towards participative management and the relationship with society are factors that the organization should improve.

[pt] O conceito de responsabilidade social praticada pelas empresas percorre os paradigmas econômico-legal, passa pelo ideário ético-filantrópico e culmina com a abstração da responsabilidade social incorporada ao processo de decisão empresarial e atenta aos relacionamentos com os stakeholders. A responsabilidade social corporativa também se tornou um instrumento de marketing capaz de proporcionar um diferencial na imagem que projeta para o seu público-alvo. O marketing social é empregado para descrever diferentes iniciativas sociais corporativas. Neste trabalho, o significado adotado para o marketing social enfoca a influência sobre o comportamento da comunidade, visando à aceitabilidade de idéias sociais e o seu bem-estar. O Centro de Integração é o empreendimento da PETROBRAS que tem por objetivo qualificar e capacitar mão-de-obra para a implantação do Complexo Petroquímico do Rio de Janeiro. A fim de identificar a percepção da comunidade circunvizinha em relação à imagem de marca comprometida com os princípios da Responsabilidade Social, um estudo exploratório foi conduzido. O universo é formado pelos moradores dos municípios impactados pelo COMPERJ e que se inscreveram no processo seletivo de 2007 para ingresso no CICOMPERJ. A amostra estabelecida foi composta pelos inscritos nos municípios de Itaboraí e de São Gonçalo. A análise das informações obtidas permitiu concluir que o CICOMPERJ influencia a mudança de comportamento da comunidade para a busca da melhoria da empregabilidade, sendo considerada uma iniciativa de Marketing Social Corporativo Comunitário. A pesquisa de campo conduzida indicou que o CICOMPERJ é percebido como um projeto socialmente responsável. / [en] Concept social responsibility practiced by companies has gone through paradigms regarding economic-legal, it goes through the ethical-philanthropic set of ideas and having as a highlight point the detachment from proactive social responsibility, incorporated to the corporate decision process and attentive to relationships with stakeholders. Corporate social responsibility it has also become a marketing instrument capable of enabling a differential in the image it projects to its target-audience. The so-called social marketing is used to describe different corporate social initiatives. For the purposes of this paper, the meaning adopted for social marketing focus the influence on the Communitys behavior, aiming at the acceptability of social ideas and its welfare. The Integration Center is development from PETROBRAS which has the purpose of qualifying and empowering workforce in competitive and sustainable bases for the implementation of the Petrochemical Complex in Rio de Janeiro. In order to identify the perception of the surrounding community regarding the brand image committed to the principles of Social Responsibility, an exploratory study has been carried out. The universe is comprised of dwellers from the eleven cities impacted by COMPERJ which have already enrolled in the 2007 selective process to enter CICOMPERJ. The sample established was comprised by those enrolled in the cities of Itaboraí­ and São Gonçalo. The analysis of the information obtained enable for the conclusion that CICOMPERJ influences the communitys behavior in the search for improvement in employment, being considered a Community Corporate Social Marketing initiative. The field survey conducted appointed that CICOMPERJ is realized as a socially responsible project.

[pt] O ser humano é incontestavelmente um ser que se destaca dos demais tipos de vida existentes na terra. O teólogo suíço Emil Brunner entende este diferencial da dignidade humana a partir da compreensão teológica de que o ser humano foi criado segundo a Imagem de Deus. Mesmo diante da maldade humana, ainda assim, o ser humano é reconhecido pela teologia cristã como alguém que está em relação com Deus, por isso é responsável. São nestas duas características humanas que Brunner enxerga os traços da Imagem de Deus na existência humana. Pois somente um ser que é relacional (portanto livre e sujeito) e responsável pode ser um interlocutor de Deus, e assim ser capaz de receber e transmitir o amor que procede de Deus. Mas o ser humano pecador vive mal a sua relação e responsabilidade, pois encontra-se em um estado de pecado, que é rebelião e inimizade contra Deus. Em Jesus Cristo o ser humano tem restaurada a sua relação e responsabilidade com Deus, a Imagem de Deus é restaurada à situação que Deus quer que ela esteja. Sendo assim, nesta dissertação tratamos da teologia brunneriana em sua compreensão sobre a Imagem de Deus no ser humano antes do pecado, no estado de pecado, e à luz da revelação de Jesus Cristo. / [en] The human being is clearly a being that stands out from other types of life existing on earth. The Swiss theologian Emil Brunner understands this human dignity differential from the theological comprehension that the human being was created according to God`s Image. Even in the face of human evil, the human being is recognized by the Christian theology as someone who is in relation with God, for this reason he is responsible. These are two human characteristics that Brunner sees traces of the God`s image in human existence. Because only a being that is relational (i.e. subject and free) and responsible can be God`s interlocutor and thus be able to receive and transmit the love that comes from God, But the sinful human being lives badly its relationship and responsibility because it is in a state of sin, which is rebellion and enmity against God. In Jesus Christ the human being has restored its relationship and responsibility to God, the God`s Image is restored to the situation that God wants. Thus, this dissertation deals of the brunneriana`s theology in his understanding on God`s image in man before the sin, the state of sin and over the light of Jesus Christ`s revelation.

[pt] O presente estudo visa oferecer uma reflexão originária sobre responsabilidade moral e responsabilidade legal. A responsabilidade moral será baseada no tomismo, especificamente na Doutrina do Duplo Efeito. Quanto à responsabilidade legal, abordaremos a moralidade do direito em Lon Fuller. No capítulo primeiro estudaremos a Doutrina do Duplo Efeito, também chamada de Teoria do Duplo Efeito, que tem as suas raízes na filosofia moral tomista, estudando as condições em que uma ação com bons e maus resultados é moralmente permissível. No segundo capítulo, estudaremos sobre o direito e sua moralidade, onde iremos tomar como base o conceito de direito natural segundo Lon Fuller. Verificaremos que Fuller considera que a qualidade do direito dependerá de sua moralidade interna. Por fim, no terceiro capítulo, baseada na obra de Lon Fuller: O caso dos exploradores de cavernas, traremos a resenha da obra e, traremos uma análise do livro sob o ponto de vista da DDE e sob o ponto de vista do Direito Penal brasileiro. Concluiremos este estudo falando sobre a escolha e sua responsabilidade moral e a responsabilidade legal e a imposição da lei. / [en] The present study aims to offer a reflection on moral responsibility and legal responsibility. Moral responsibility will be based on thomism, specifically in Doctrine of double effect. With regard to legal responsibility, we will discuss the morality of law in Lon Fuller. In the first chapter we will study the Doctrine of double effect, also known as Theory of double effect, which has its roots in thomistic moral philosophy, by studying the conditions under which an action with good and bad results is morally permissible. In the second chapter, we will study about law and its morality, where we will take as basis for the concept of natural law according to Lon Fuller. We will notice that Fuller considers that the quality of law will depend on its internal morality. Finally, in the third chapter, based on the work of Lon Fuller: The case of the exploiters of cave, we will introduce a summary of the work and an analysis of the book under the Doctrine of double effect s point of view and criminal law Brazilian s either. We will complete this study speaking of the choice and its moral responsibility and the legal responsibility and the levy of law.

[pt] O presente trabalho estuda a atuação social dos empresários, comumente denominada de responsabilidade social empresarial - RSE -, a partir do pressuposto de que esta intervenção social, antes de ser uma novidade na atuação dos empresários, conta com uma longa trajetória que remonta aos primórdios do desenvolvimento industrial no país. Nesta trajetória, foram estruturados diferentes modelos de intervenção que aqui são identificados como controle, incorporação e gerenciamento do social. Cada um deles expressa tanto o enfrentamento da relação capital x trabalho como a busca de legitimação do processo de acumulação, ao nível interno de sua força produtiva, como externamente envolvendo em escalas crescentes o conjunto da sociedade. A pesquisa foi estruturada em duas grandes frentes de investigação: uma primeira de perfil documental e bibliográfico buscou reconstituir a trajetória sócio-histórica da atuação social dos empresários. A segunda voltou-se para a compreensão de suas formas de ação frente às novas determinações do capitalismo contemporâneo. Ainda que, analisando processos mais amplos, este estudo focaliza uma empresa hoje multinacional, com marcante atuação no âmbito da RSE, cuja evolução produtiva percorreu os diferentes modelos de intervenção social aqui identificado. Considerando nossa hipótese de que um dos elementos fundamentais da RSE é estruturar, também, uma contraface à emergência de conflitos internos e externos aos interesses do capital, o estudo pautou-se pela identificação da manifestação contraditória entre intervenção e conflito social. Foi utilizado instrumental disponível pelas mídias digitais (internet, sites institucionais e outros endereços eletrônicos) com ênfase no YouTube, considerando-o como um modo de comunicação áudio-visual que dá visibilidade aos interesses e condições de vida de grupos sociais e sistemas ambientais atingidos (e prejudicados) pelo avanço da produção generalizada de mercadorias. / [en] The present thesis studies entrepreneurs social responsibility from the standpoint that their social intervention, instead of being a novelty, is anchored in a long tradition that stretches back to the beginnings of Brazil s industrial development. The different models of intervention developed in this tradition are here identified as incorporation and management control of the social question. Each model expresses the way capital-work relation was coped and the search for legitimacy of the accumulation process at the internal level of its productive force, on the one hand, and at the external level envolving increasingly all society, on the other hand. The reseach was lead in two major fronts: firstly, a documentary and litterary investigation sought to reconstruct the socio-historical path of the social actions of entrepreneurs. Secondly, it turned to the understanding of their forms of action in the face of new determinations of contemporary capitalism. While analyzing broader processes, this study focuses on a Brazilian multinational company which has today significant activity in the evolution of CSR, and whose history toured the different models of social intervention identified here. Considering our hypothesis that one of the basic structure of CSR is also to oppose the emergence of internal and external conflicts concerning the interests of capital, the study was guided by the identification of the outbreak contradiction between intervention and social conflict. Sources included many digital media available in internet, corporate websites and other email addresses, with emphasis on YouTube, considered as a way of audio-visual communication that has been giving visibility to the interests and living conditions of social groups and environmental systems affected and affected by the advance of generalized commodity production.

[pt] O direito à cidade sustentável pressupõe, para a sua realização, a gestão urbana participativa face às mudanças climáticas. As mudanças climáticas e seus efeitos vêm questionar a racionalidade científica e suas fontes metafísicas, ontológicas e epistemológicas que estão na raiz da crise ambiental. Constitui-se em uma problemática global a ser enfrentada pela sociedade contemporânea que requer a mobilização dos diversos atores sociais. A importância da prevenção e tratamento dos efeitos oriundos das mudanças climáticas, a nível global e nacional, direciona este trabalho para a análise das suas implicações no âmbito das cidades, que integrem estratégias de mitigação das emissões de gases causadores do efeito estufa e de adaptação aos impactos decorrentes desta problemática. Compreendendo as mudanças climáticas e seus efeitos como obstáculos à preservação da qualidade de vida das gerações presentes e futuras, e o papel de destaque das cidades nesse processo, é necessário uma leitura jurídica da cidade, à luz da Constituição Federal, que considera a gestão urbana democrática fundamental para a realização do direito à cidade sustentável. / [en] The right to sustainable city requires, for its realization, a participatory urban management in the face of climate change. Climate change and its effects are questioning the scientific rationality and its metaphysical, ontological and epistemological sources that are at the root of the environmental crisis. It became a global problem to be faced by contemporary society that requires the mobilization of different social actors. The importance of prevention and treatment of the effects from climate change, globally and nationally, directs this work to analyze its implications in the context of cities, that incorporate greenhouse gases emissions mitigating strategies and adaptation strategies to impacts resulting from this problem. Once understanding climate change and its effects as barriers to preserving the quality of life for present and future generations, and the important role of cities in this process, it´s necessary a legal reading of the city, in the light of the Federal Constitution, which considers the democratic urban management fundamental to achieving the right to sustainable city.

[pt] A dissertação tem como objeto a análise do consentimento informado do paciente no âmbito da telemedicina, especialmente na relação médico-paciente realizada em estabelecimento hospitalares. Nesse sentido, são destacadas as modalidades da telemedicina com o escopo de identificar e atribuir a responsabilidade civil pela violação do consentimento informado do paciente em cada categoria, com base nas normas deontológicas e na legislação pertinente. Com efeito, a dissertação buscará responder os seguintes questionamentos: (a) como respeitar o consentimento informado do paciente na seara da telemedicina? (b) como deve ser efetivado o termo de consentimento informado em cada modalidade da telemedicina? (c) como imputar a responsabilidade civil na relação médico-paciente oriunda da violação do consentimento informado no campo da telemedicina? (d) como provar o consentimento do paciente no âmbito da telemedicina? Para tanto, analisa-se a evolução do consentimento informado do paciente, chegando-se a conclusão de que a autodeterminação é parte integrante da dignidade humana e deve ser respeitada na relação médico-paciente, sob pena de ser imputada a respectiva responsabilidade civil. Nessa toada, discorre-se sobre o desenvolvimento do atendimento médico realizado à distância, bem como são analisadas decisões judiciais a respeito do tema a fim de demonstrar as dificuldades concernentes à consumação do consentimento informado do paciente no âmbito da telemedicina. Por conseguinte, são apresentadas proposições para inclusão no termo de consentimento livre e esclarecido com o escopo de facilitar a compreensão do paciente no atendimento telepresencial e possibilitar a concretização do consentimento informado. Enfim, considerando a dificuldade na produção probatória relacionada ao consentimento informado do paciente, é apresentada uma recomendação que visa contribuir com o aperfeiçoamento da relação médico-paciente no campo da telemedicina. / [en] The dissertation has as its object the analysis of the patient s informed consent in the context of Telemedicine, especially in the doctor-patient relationship carried out in hospitals. In this sense, it is intended to discuss the modalities of telemedicine, identifying and attributing civil liability for the violation of the patient s informed consent in each category, based on deontological norms and on the institutes of the Consumer Defense Code. Consequently, the dissertation will seek to answer the following questions: (a) how to respect the informed consent of the patient in the field of telemedicine? (b) how should the informed consent form be implemented in each modality of telemedicine? (c) how to impute civil liability in the doctor-patient relationship arising from the violation of consent in the field of telemedicine? (d) how to prove the patient s consent in the context of telemedicine? To this end, the evolution of the patient s informed consent is analyzed, reaching the conclusion that self-determination is an integral part of human dignity and must be respected in the doctor-patient relationship, under penalty of being imputed the respective civil liability. In this sense, the development of remote medical care is discussed, as well as judicial decisions on the subject are analyzed in order to demonstrate the difficulties concerning the consummation of the patient s informed consent in the context of telemedicine. Indeed, propositions are presented for inclusion in the free and informed consent form with the aim of facilitating the patient s understanding in telepresence care and enabling the implementation of informed consent. At the end, considering the difficulty in producing evidence related to the patient s informed consent, a recommendation is presented that aims to contribute to the improvement of the doctor-patient relationship in the field of telemedicine.

[pt] Diante da necessidade de repensar as práticas de produção e consumo, a economia circular surge como uma alternativa no âmbito do desenvolvimento sustentável, baseada nos princípios de regeneração e restauração dos recursos. A logística reversa promove o fluxo de materiais e informações referentes ao retorno de bens pós-venda e pós-consumo, atendendo ao princípio de restauração da economia circular, representado pelo ciclo técnico. O volume de trabalhos que relaciona a logística reversa e a sustentabilidade vêm crescendo anualmente, inclusive com a introdução de tópicos emergentes e perspectivas multidisciplinares, como é o caso da economia circular. O objetivo deste estudo é fornecer uma visão holística atual da literatura que relaciona logística reversa com economia circular, oferecendo uma taxonomia dos fatores críticos de sucesso da logística reversa na perspectiva do ciclo técnico da economia circular, um framework mostrando a relação entre esses conceitos e uma agenda de pesquisa. O método adotado foi a revisão terciária da literatura, resultando em uma amostra de 66 artigos. A agenda para pesquisas futuras foi subdividida em: (i) amadurecimento do estado da teoria sobre o tópico; (ii) abordagem temática; (iii) continuação da investigação através do aprofundamento teórico de cada um dos cinco fatores críticos de sucesso. A dissertação faz um levantamento crítico abrangente do estado da arte em relação a logística reversa e economia circular no contexto da cadeia de suprimentos. / [en] Faced with the need to rethink production and consumption practices, the circular economy emerges as an alternative in the field of sustainable development, based on the principles of regeneration and restoration of resources. The reverse logistics promotes the flows of materials and information on the return of post-sale and post-consumer products, taking into account the principle of restoration of the circular economy, represented by the technical cycle. The volume of work that relates the reverse logistics and sustainability has been increasing annually, including the introduction of emerging topics and multidisciplinary perspectives, such as circular economy. The objective of this study is to provide a current holistic view of the literature that relates reverse logistics to circular economy by offering a taxonomy of the critical success factors of reverse logistics from the perspective of the circular economy technical cycle, a framework that shows the relationship between these concepts and a research agenda. The method adopted was the tertiary review of the literature, resulting in a sample of 66 articles. The agenda for future research was structured into: (i) development of the state of the theory on the subject; (ii) thematic approach; (iii) theoretical deepening in each of the five critical success factors. The dissertation makes a comprehensive critical survey of the state-of-the-art in relation to reverse logistics and circular economy in the context of the supply chain.

[pt] Este trabalho propõe um modelo de gestão universitária sob a ótica da sustentabilidade de Instituições de Ensino Superior (IES), baseado em quatro pilares: Excelência em Ensino e Pesquisa, Gestão Financeira, Responsabilidade Social e Responsabilidade Ambiental, apoiados por Tecnologia da Informação. Inicialmente o modelo proposto foi validado e aplicado ao caso da PUC-Rio, com o foco na Gestão Universitária. Posteriormente um questionário foi aplicado em onze IES da América Latina e Europa para avaliar o grau de desenvolvimento destas instituições face aos quatro pilares do modelo de sustentabilidade proposto. A partir deste questionário foi possível identificaras melhores práticas de sustentabilidade em IES e confrontá-las com os resultados da PUC-Rio. / [en] This work proposes a model of university management from the perspective of sustainability, based on four pillars: Excellence in Education and Research, Financial Management, Social Responsibility and Environmental Responsibility, supported by information technology. Initially the model was validated and applied to the case study of PUC-Rio, with focus on University Management. Subsequently, a questionnaire was administered in eleven Latin American and European Universities to assess the degree of development of these institutions, based on the four pillars of sustainability proposed by the model. With the results of this survey, it was possible to identify some of the best practices of sustainability in those Universities and confront them with the results of PUC-Rio.

[pt] Violência urbana e omissões estatais: da irresponsabilidade à responsabilidade – uma análise das transformações da responsabilidade civil do Estado à luz da teoria dos Direitos Fundamentais investiga os rumos da responsabilidade civil do Estado – sobretudo na modalidade omissiva –, conectando o problema à questão da violência urbana. Embora a responsabilidade civil do Estado (independentemente de culpa) já faça parte da tradição constitucional brasileira há décadas, são raras as indagações teóricas – bem assim as decisões judiciais – que responsabilizam civilmente o Estado pelos danos sofridos pelos cidadãos resultantes da violência urbana (podemos dizer que embora a responsabilidade civil objetiva do Estado faça parte da tradição constitucional brasileira há muitas décadas, as consequências interpretativas ainda não foram adequadamente desenvolvidas). A tese, nesse contexto, analisa criticamente a jurisprudência brasileira relativa ao problema, apontando falhas de coerência e possível ausência de consistência teórica do padrão mental convencional a respeito do tema. A violência urbana, hoje, embora constitucionalmente conectada às funções estatais (ninguém põe em dúvida que o dever de prestar segurança pública é um dever do Estado), é um território de ninguém, no que diz respeito à assunção – jurídica – dos riscos, particularmente no que se refere à responsabilidade civil do Estado. A pesquisa questiona se há, nestas primeiras décadas do século XXI, uma rede de conexões normativas e conceituais que permitam repensar o problema (convém lembrar que há, nas sociedades contemporâneas, uma constante reavaliação dos riscos que são socialmente aceitáveis, bem como há uma dinâmica reavaliação de quem são os responsáveis por eles). Busca-se, por fim, a construção de um modelo teórico para a responsabilização estatal por omissão nos casos de violência urbana, a partir das categorias conceituais da responsabilidade objetiva agravada e do fortuito interno. / [en] Urban violence and State omissions: from irresponsibility to responsibility - an analysis of State liability s transformations under the Fundamental Rights theory investigates the courses of State liability, especially in the omission way, connecting the problem to urban violence issue. Although State liability (regardless of guilt) has already been part of the Brazilian constitutional tradition for decades, there are scarce theoretical inquiries - as well as judicial decisions - that make the State civilly liable for the damages suffered by citizens resulting from urban violence (we can say that although State strict liability has been part of the Brazilian constitutional tradition for many decades, the interpretative consequences have not yet been adequately developed). The thesis, in this context, critically analyzes the Brazilian jurisprudence about the problem, pointing out flaws of coherence and possible lack of theoretical consistency of conventional mental standard about the subject. Today, the urban violence, although constitutionally connected to state functions (no one doubts that the duty to provide public security is a state duty), is a no one territory, in regard to juridical assumption of risks, particularly in what concern State liability. The research questions the existence of a network of normative and conceptual connections that allow us to rethink the problem in these first 21st century decades (we must remember that, in contemporary societies, there is a constant reassessment about the risks that are socially acceptable, as well as dynamic reassessment about who are responsible for them). Finally, we aim to construct a theoretical model for State liability by omission in urban violence cases, based on conceptual categories of aggravated strict liability and internal fortuitous event.
