本論文では、日米両国の環境法における理論状況が法体系の性質からも大いに異なることを前提とした上で、米国において1970年代以降に制定された様々な環境法をめぐる議論を取り上げ、各種救済の態様について、事後救済、事前予防の両面から検証を行った。具体的には、我が国で検討の不十分な環境市民訴訟規定適用の根拠および要件と救済の機能、各種環境規制の導入において生じる収用をめぐる議論の検討を行った。 / This research examined the remedies of U.S. environmental law after 1970s. While their legal systems are quite different, the argument in U.S. could be helpful that of Japanese. The focus point of research is on the ground of citizen suits provisions and on the case when the plaintiff made consent decree. 本論文では、中国不動産市場にバブルが存在しているか否かを実証的に考察した上で、バブルが生じる原因及び中国不動産市場の問題点を国際比較の視点から明らかにする。さらに、不動産価格を効率化させる諸条件を示すことを通じて、中国不動産バブルの軟着陸対策を短期対策、長期対策および不動産企業のあり方の三つに分けて検討し、中国不動産市場全体の健全化のための必要な施策を考察する。 / With the rapid increase of Chinese housing price, whether a bust in the Chinese real estate market could threaten the China's economic activity and the stability of the world's finance is concerned by Economists. In this paper, whether there is a bubble in Chinese real estate market is verified through the empirical research from the perspective of international comparison. In addition, the reasons and problems in Chinese real estate market are cleared. イギリスにおけるアボリショニズム(奴隷貿易・奴隷制廃止運動)は、1780年代に開始された。その中心的組織は、ロンドン奴隷貿易廃止委員会であった。この組織の中核にいたのは、クウェイカー教徒と英国国教会福音主義派である。彼らは、大衆的な議会請願運動を主導し、それをバックに奴隷貿易廃止法成立に取り組んだ。この法律は、1807年に成立した。その後1823年に、反奴隷制協会が結成され、さらに広範な大衆運動が繰り広げられ、1833年に奴隷制は廃止された。しかし、これで奴隷が完全に解放されたわけではなかった。彼らは年季奉公人として、元の奴隷主の下で週45時間働かなければならなかった。年季奉公人制が廃止されたのは1838年である。 / The abolitionists' movement in Britain began in 1780s. The Quakers and the Anglican evangelicals spearheaded the movement whose organization was the London Abolition Committee. They collected several hundred thousand signatures of people against the slave trade. The abolition of the British slave trade was effected on 1807. The anti-slavery associstion was formed in 1823. Ten years later slavery was abolished in the British colonies. 本研究は，就学前児童の親における「次世代育成支援対策推進政策に対する認知的評価」と「社会福祉関連QOL」の関係を明らかにすることを目的とした．政策評価における課題を整理し，プログラム評価，特にロジックモデル評価に焦点を当てた．大中小3都市の1,583名分のデータを用い，アウトカム指標を開発し，政策のロジックモデルを評価した．地域・性別ごとの分析も実施し，就学前児童の親の視点によるアウトカム・インパクトを効果的・効率的に高める政策に関する知見を得た． / The purpose of this study was to clarify the relationship between "cognitive appraisal of the policy on Advancement of Measures to Support Raising Next-Generation Children" and "social welfare related quality of life" of preschool children's parents. I organized the issues in policy evaluation and focused on program evaluation, especially logic model evaluation. I used 1,583 data of preschool children's parents in three large, medium and small cities and evaluated the logic model of the policy using the developed outcome and impact indicators.
