La réparation dans le contentieux international des droits de l’homme / Reparation in international human rights litigation

La réparation des dommages causés aux particuliers est une thématique ancienne en droit international. Toutefois, elle a été longuement appréhendée au seul prisme des relations interétatiques, l’individu n’étant perçu que comme un objet du droit international. Le bouleversement introduit par la protection internationale des droits de l’homme quant au statut de l’individu dans cet ordre juridique invite donc à une relecture de cette question. Les obligations substantielles contractées par les Etats en matière de protection internationale des droits de l’homme devraient logiquement trouver un prolongement dans l’existence d’une obligation de ces derniers de réparer les dommages causés aux particuliers. Or, l’identification d’une telle obligation s’avère délicate, tant au regard de ses créanciers que de son étendue. Sa réalisation est quant à elle laissée en grande partie aux mains du juge. Il s’avère donc malaisé de dégager un véritable régime juridique de la réparation des dommages causés par la violation des droits de l’homme. / The reparation of damage caused to individuals is a former thematic issue of international law. However, its development has been studied only from the point of view of interstate relations as soon as the individual was conceived and treated as an object, not as a subject of international law. The change, brought by the international protection of human rights relating to the status of individual, in this legal order, suggests to re-open the debate on this matter. As a result, the compelling obligations undertaken by member states regarding international protection of human rights, should logically lead to the existence of an obligation for the latter to repair the damage caused to the private individuals. But identifying such an obligation remains delicate both with regard to his creditors and with regard to its scope. Its implementation is left largely with the hands of the judge. It is therefore difficult to find a genuine legal regime for the reparation of damages caused by the violation of human rights.

L'interprétation du contrat au regard des droits fondamentaux / The interpretation of the contract towards the fundamental rights

Le droit des contrats subit depuis quelques années des mutations importantes, au premier rang desquelles figure l’émergence de sources nouvelles, à l’instar des droits fondamentaux issus de la Convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales (Convention EDH). Leur application classique dans les relations verticales unissant l’État à l’individu a connu un prolongement évident par la reconnaissance de l’effet horizontal du texte en droit interne, impliquant leur respect jusque dans les relations privées.L’interprétation du contrat, consistant à en révéler le sens et les obligations qui en découlent, constitue l’objet de l’étude menée. La lecture de l’acte contractuel doit se faire en conformité avec l’interprétation opérée par le juge européen de la Convention EDH. De ce constat émerge tout l’intérêt de la recherche, consistant à mettre en avant la confrontation évidente pouvant naître entre d’une part le contrat - porteur de principes forts (particulièrement l’autonomie de la volonté, et ses corollaires telles la liberté contractuelle et la force obligatoire du contrat) - et d’autre part le respect des droits fondamentaux. Dans quelles mesures ces derniers peuvent-ils influer sur l’interprétation d’un contrat privé ?Le travail de recherches entrepris révèle un rôle sensible des droits fondamentaux sur l’interprétation du contrat - le respect des droits fondamentaux prime de manière générale la force obligatoire - et constate que cette influence est le fruit d’une démarche complémentaire du juge européen, lequel dicte, et du juge interne, lequel réceptionne les droits fondamentaux dans l’interprétation.Cette étude - bien que certains de ses aspects paraissent encore empiriques - témoigne d’une influence perfectible des droits fondamentaux sur l’interprétation du contrat. En ce sens, des pistes d’améliorations, tant au niveau européen qu’interne, ont pu être envisagées / The law of contracts has known for some years important changes, particularly the emergence of new sources like the fundamental rights of the European Convention on Human Rights. Their classic application in the vertical relations uniting the State to the individual knew an obvious continuation by the recognition of the horizontal effect of the text in internal law, implying their respect to the private relations.The interpretation of the contract, to determine the sense and the obligations which it contains, is the object of this thesis. The reading of the contractual act has to be done in accordance with the interpretation operated by the european judge of the European Convention. The interest of the thesis consists in advancing the evident confrontation which can appear between the contract (the autonomy of the will, the contractual freedom and the binding effect) and the protection of the fundamental rights. To which extent can these last ones influence the interpretation of a private contract?The study reveals the important role of the fundamental rights, and their respect dominate mostly. This influence is the fruit of a complementary approach of the european judge, who dictates, and of the internal judge, who receives the fundamental rights in the interpretation.This study - although some of its aspects seem still empirical - testifies of a perfectible influence of the fundamental rights, and improvements were envisaged at the internal and european level

La souveraineté de l'État et le droit à des élections libres dans le contexte européen : essai fondé sur la jurisprudence de la Cour européenne des droits de l'Homme (1987-2008)

L'une des critiques fondamentales adressées au mécanisme de contrôle et de surveillance de la Cour européenne des droits de l'homme en matière électorale tient au risque qu'il portera atteinte à la souveraineté de l'État. En effet, certains auteurs estiment que l'autonomie constitutionnelle de l'État dans le domaine électoral, jusqu'à tout récemment strictement protégée, s'affaiblit sous l'influence de la protection des droits de l'homme dans le système européen. Le présent mémoire a pour but de déterminer les conditions imposées aux autorités étatiques par la Cour européenne des droits de l'homme en vue d'assurer l'exercice efficace du droit à des élections libres. Ensuite, il analysera les effets de ces conditions sur la souveraineté des États parties à la Convention européenne des droits de l'homme. Notre étude s'intéresse, dans un premier temps, à l'examen du principe de la souveraineté de l'État et de son évolution progressive sous l'influence des droits de l'homme. Dans un deuxième temps, elle présentera le droit à des élections libres et ses manifestations théoriques et jurisprudentielles. L'étude des affaires tranchées par la Cour européenne permettra de remarquer que la déférence qui est accordée à la souveraineté des États s'accompagne d'une certaine limitation de la marge d'appréciation des autorités étatiques en cas de privation de l'exercice efficace du droit à des élections libres. Ensuite, les acquis théoriques et conceptuels seront appliqués à l'étude des restrictions électorales relevant des mesures législatives, administratives et judiciaires des États ainsi que des conditions imposées par la Cour européenne. À cet égard, l'analyse de ces conditions nous permettra de saisir l'étendue de la limitation de la liberté d'action des États en matière électorale. Cette recension analytique nous permettra de conclure que le mécanisme de contrôle de la Cour européenne entraîne de multiples effets limitatifs sur la souveraineté des États. / One of the fundamental criticisms levelled at the ECtHR review mechanism relates to the fact that it is jeopardizing State's sovereignty. According to some commentators the State's constitutional autonomy, untill recently strictly preserved under international law, is now questioned as a result of the international protection of human rights. This study aims to identify the link between the principle of State sovereignty, the guarantee of the electoral rights, and the role of the ECtHR. Our study will be divided into three chapters. Chapter l, "Progressive evolution of the principle of State sovereignty and the European mechanism for the protection of fundamental human rights", discusses the principle of State sovereignty and its interpretations in contemporary international law. The chapter traces the evolution of the principle and links it with the progressive development of fundamental human rights. Chapter II, "The interaction between the State's margin of appreciation and the European supervisory mechanism", considers what role the positive obligations of States may have played in the crystallization of States' attitudes towards the application of international human rights instruments. After a brief discussion of the doctrine of the margin of appreciation and States' obligations under the European Convention, the chapter focuses on the ECtHR's control and supervision of the States' electoral restrictions. Chapter III, "Electoral restrictions and the scope of limits imposed on the State sovereignty", is central to our study. This chapter examines the ECtHR case-Iaw on electoral rights (1987-2008) and draws attention to some electoral restrictions in legislative, administrative and judicial matters. This study looks at the challenges which surround the application of the right to free elections, focusing on electoral rights in national political discourse, and the development of the ECtHR's enhanced role in protecting electoral rights in Europe. It draws conclusions as to the relationships between the development of an effective protection of electoral rights and the resultant limitations to the State sovereignty.

Manifesting religious belief : a matter of religious freedom, religious discrimination, or freedom of expression?

This thesis asks how manifestation of religious belief by religious individuals can best be protected in English law. It is particularly concerned with the protection available to religious individuals in the public sphere. This thesis assesses the current state of protection under religious freedom and religious discrimination models, before considering the potential for increasing protection by reconceptualising the right to manifest religious belief as an aspect of freedom of expression. This thesis asks whether the practical and conceptual limitations of a religious freedom model, and Article 9 of the European Convention on Human Rights (ECHR) in particular, can be overcome by reliance on alternative modes of protection, namely religious discrimination protections in domestic, Convention, and EU law, or through litigating religious manifestation claims as freedom of expression cases under Article 10 of the ECHR. The difficulty of communicating the harm in being denied the ability to manifest religious beliefs publicly is a key limitation of both religious freedom and religious discrimination models. Similarly, this thesis highlights the difficulty in assessing what weight should be attributed to such religious harm within a proportionality exercise balancing the rights of religious individuals with the rights and interests of other parties. The analysis in this thesis draws primarily upon the sources of law which shape domestic English law in this area, namely the ECHR and European Union law. However, this thesis also considers foreign precedent and case law from the United States in particular. This thesis contends that no one model can address the range of cases where manifestation of religious beliefs arise, and that litigants should be able to draw from religious freedom, religious discrimination, and freedom of expression protections depending on the nature of their case.

in English Protection of the freedom of speech by the European Court of Human Rights The purpose of my thesis is to analyze multiple aspects of freedom of speech as protected by European Court of Human Rights. The reason for my research is to follow the development in this particular area and to produce basic reference material for students and other human rights enthusiasts concerning freedom of speech and its extensive case law. Firstly, there is brief introduction to this thesis, followed by two logically divided chapter. Chapter one is divided into 2 logical clusters, first covering quick introduction into history of European Court of Human Rights, second mainly focused on development of doctrines concerning freedom of speech case law. There are specifically covered doctrines of evolutive interpretation, limitation clause and proportionality test, margin of appreciation. Chapter two is divided into five subsection, covering general and specific aspects of freedom of speech. La réparation internationale de dommages individuels est un sujet assez nouveau et peu réglementé en droit des gens. Chapitre manquant du droit de la responsabilité internationale de l’État tel qu’il a été codifié par la Commission du droit international des Nations Unies dans son Projet d’articles sur la responsabilité de l’État pour fait internationalement illicite (2001), la responsabilité internationale de l’État à l’égard de l’individu trouve dans la jurisprudence de la Cour interaméricaine des droits de l’homme un environnement salutaire à son développement. Jouissant d’une compétence large en matière de réparations conférée par l’article 63§1 de la Convention américaine des droits de l’homme, la Cour interaméricaine a développé une jurisprudence très riche et originale qui fournit un ensemble coordonné de règles et principes permettant de dégager un régime juridique de la réparation de dommages individuels dans le cadre de rapports transétatiques. L’étude du régime de réparations interaméricain permet d’identifier que ses spécificités – liées à la nature transétatique du rapport de responsabilité et à la nature grave des violations qu’on retrouve dans le contentieux régional – n’impliquent pas un détournement des règles classiques de la responsabilité internationale mais plutôt leur complétion : le régime juridique de la réparation qui se dégage de la jurisprudence de la Cour interaméricaine contribue définitivement à combler les lacunes du droit des gens ayant trait à la discipline de la réparation internationale de dommages soufferts par des personnes privées. / The international reparation of damages suffered by individuals is a relatively new subject that hasn´t received the amount of attention it deserves from international law. The international responsibility of the State towards individuals is indeed a topic missing from the Draft articles on responsibility of States for internationally wrongful acts adopted in 2001 by the United Nations International Law Commission, which was mainly featured to discipline the responsibility of a State towards another State. The jurisprudence of the Inter - American Court of Human Rights might considerably contribute to filling this important gap in the law of international responsibility. Taking advantage of its large competence to order reparation measures according to article 63§1 of the American Convention of Human Rights, the Inter-American Court has developed a substantial and original jurisprudence leading to the establishment of a legal regime on the reparation of individual damages on the basis of the international responsibility of the State. From the study of the inter -american regime on reparations, it can be inferred that its specificities – deriving from the particular character of the State responsibility towards the individual and from the seriousness of the human rights violations brought to the Court – do not lead to a diversion from the general rules on State responsibility, but rather to their completion: the legal regime of reparation that comes out from the jurisprudence of the Inter-American Court definitely contributes in filling the lacunas of international law with regards to the discipline of the international reparation of damages caused to private persons.

It aims to introduce the legal framework in which religious freedom has to operate, and to place this essential freedom into a broader cultural, religious and human rights context. The contextualisation emphasised throughout this dissertation is based on an assumption that it is not possible to establish a pure legal notion of religious freedom that would not bear any imprint of the societal, legal, cultural and religious context of its authors; in reality, each person's understanding of religious freedom is rooted in his culture, religion and experience. This should not lead, however, to a complete rejection of the possibility of a common understanding and universal protection of religious freedom. La présente recherche se réunit quatre questions générales et cruciales : 1) La place de la Convention européenne des Droits de l’Homme en droit Géorgien; 2) La conformité de la législation géorgienne avec la Convention Européenne des Droits de l’Homme; 3) Les relations de la Cour Constitutionnelle de Géorgie et de la Cour Européenne des Droits de l’Homme; 4) L’impact des décisions de la Cour Européenne des Droits de l’Homme sur la Géorgie. Sur toutes ces questions, contrairement aux Etats de l’Ouest de l’Europe, il existe peu d’information et/ou d’ouvrages sur la Géorgie, ce qui a rendu notre tâche longue et délicate. Il convient en effet de rappeler au lecteur de l’Europe occidental que la Géorgie est un Etat en développement. La Géorgie, située entre la Turquie et la Russie, pendant toute son histoire a été obligée de s’orienter vers une politique de défense. L’histoire de la Géorgie indépendante recommence après la chute de l’URSS en 1991. La Géorgie a adhéré au Conseil de l’Europe en 1999, mais les processus de l’européanisation du droit national commencent à partir 2004. La Convention Européenne des droits de l’Homme est un mécanisme efficace pour la protection des droits de l’Homme et les activités de la Cour européenne des droits de l’Homme suscitent un vif intérêt en Géorgie. Cependant, dans des relations juridiques, y compris devant le tribunal, l’application des standards européens des droits de l’Homme n’est pas un objectif en soi. Il faut que les juges, avocats, procureurs et les représentants d’autres professions juridiques garantissent, au cours de leurs activités, le respect des standards des droits de l’Homme existants.Dans le cadre de la présent recherche, on examinera l’influence de la Convention Européenne des Droits de l’Homme sur le Droit Géorgien a partir de la ratification de la Convention Européenne des Droits de l’Homme en 1999, jusqu’au 28 février, 2014 en deux directions : 1. Le statut de la Convention Européenne des Droits de l’Homme dans le Droit Géorgien (PARTIE I) et 2. La Géorgie face à la Cour Européenne des Droits de l’Homme (PARTIE II). / The given research unites four main questions: 1. Place of European Convention on Human Rights in Georgian Law. 2. Conformity of Georgian legislation with the European Convention on Human Rights. 3. Conformity of Constitutional Law judgments with the standards established by the European Court of Human Rights. 4. Judgments of European Court of Human Rights against Georgia.In connection to all these questions there is very little information and work in Georgia, which has made us study them better – on the ground of actuality of the given questions. We’ve considered discussing to the West European reader that Georgia is a developed country. It is located between Turkey and Russia, during its whole history it had to be orientated on the self-defense policy. History of Independent Georgia starts in 1991 by destruction of the Soviet Union. In 1999 Georgia became a member of the European Union, but National Law in Georgia and Europeanization process of State Institutions started in 2004. Human Rights European Convention represents an effective standard of Human Rights, accordingly activities of European Court of Human Rights causes great interest in Georgia. Despite all these in the legal circles, between them use of Human Rights European standards have become obligatory in the courts. It is needed that the judges, advocates, procurators and representatives of other legal professions have to actively use the existed standards of Human Rights Protection. In the framework of the given research we will investigate influence of European Convention on Human Rights with Georgian Law and starting from ratification of European Convention by Georgia – since 1999 – till February 28, 2014 included in two directions: 1. Place of Human Rights European Convention in Georgian Law (part I) and 2. Georgia against European Court of Human Rights (part II).

Die Kompetenzabgrenzung in der Rechtsprechung von EGMR und EuGH

EGMR und EuGH stehen grundsätzlich gleichberechtigt und autonom nebeneinander. Beide verstehen sich als Hüter der Grund- und Menschenrechte auf europäischer Ebene und als Kontrollinstanzen. Sie urteilen aber beide auch auf Grundlage der EMRK. Für den EGMR ist dies die originäre Rechtsgrundlage, während der EuGH mangels eines geschriebenen Grundrechtskatalogs aus ganz unterschiedlichen Rechtsquellen schöpft. Zudem ist er nicht zwingend an eine vom EGMR gewählte Auslegung einer EMRK-Norm gebunden. Diese Situation begünstigt die Möglichkeit divergierender Entscheidungen beider Gerichtshöfe bezüglich ein- und derselben EMRK - Norm und letztendlich auch die Entwicklung unterschiedlicher Grundrechtsschutzniveaus in Europa. Diese Arbeit möchte einen Weg aufzeigen, wie eine derartige Entwicklung vermieden werden kann. / ECHR and ECJ stand in principle equally and autonomously side by side. Both courts understand themselves as guardians of the basic rights and human rights on a european level. However, they both judge also on the basis of the European Charta on Human Rights. For the ECHR, this is the original legal-basis, whereas the ECJ, due to the lack of a written privilege-catalog, developes basic rights from quite different legal-sources. Moreover, it is not necessarily tied to an interpretation of an ECHR-Norm chosen by the EGMR. This situation favors the possibility of diverging decisions of both courts concerning the same ECHR - norm and ultimately the development of different privilege-protection-levels in Europe. This work would like to show a way how a such a development can be avoided.
