Therefore, in production, the rate of defective products is low. This study proposes a model to reduce the number of defective products based on the combined use of the Six Sigma and work method tools. For the purposes of this study, the production process of the 7.62 mm ammunition was analyzed because it presents several issues that affect product quality. The current methods and procedures of the production process were analyzed to identify the root causes of the problem and to provide a solution. After implementing the model, defective products were reduced from 20% to 13.67%..

En el presente estudio, tiene como objetivo reducir el alto índice de productos defectuosos, incrementando así los niveles de productividad en la empresa. Se explicarán los beneficios de la implementación de la metodología Lean Manufacturing en el proceso productivo textil en el área de tintorería y acabado de tela de la empresa TEXTIL SAN RAMÓN S.A. Por esta razón, se señala que si se implementa la metodología Lean Manufacturing, El trabajo está compuesto por tres capítulos. En el primer capítulo, se explica en qué consiste la metodología Lean Manufacturing. En el segundo capítulo, se presentará la situación actual de procesos actual de tintorería y acabado de tela. Asimismo, se describirá los principales beneficios de la implementación de la metodología Lean Manufacturing en el proceso de productivo textil, que buscará reducir el número de productos defectuosos en el proceso de tintorería y acabado de tela e incrementar los niveles de productividad de la empresa. Finalmente en el tercer capítulo se logra plasmar la implementación de esta metodología la cual resulta ser beneficiosa en el proceso de tintorería y acabado. Con estos resultados se evidencia que mediante la metodología Lean Manufacturing se puede reducir el índice de productos defectuosos significativamente, incrementando así en nivel de productividad, con el fin de reducir costos, aumentar la rentabilidad de la empresa y satisfacer las necesidades de los clientes. / In the present study, it aims to reduce the high rate of defective products, thus increasing productivity levels in the company. the benefits of implementing Lean Manufacturing in the textile production process in the area of fabric dyeing and finishing of textile SAN RAMON SA For this reason, it explained, noted that if the methodology is implemented Lean Manufacturing, The work is composed of three chapters. Ils sont face à des produits surs et d'autres qui le sont moins. Les exigences des consommateurs portent non seulement sur la conformité des produits, mais également sur leur sécurité. C’est pourquoi, en Europe comme aux Etats Unis, il existe des lois spéciales pour encadrer la responsabilité des produits défectueux. L’analyse de l’approche Euro-Américaine dans le droit des produits défectueux, objet de cette thèse, permet non seulement d’aborder le régime dans ce domaine actuellement, mais également d’amener à une réflexion sur une protection plus efficace des consommateurs. / With the development of the world economy and the international trade, consumers find their pleasures in this consumer society and also insecurities sometimes. Consumer requirements do not only rely on compliance but also product safety. This is why in both Europe and the United States, there are special laws in product liability. This thesis based in the comparison of European and American laws of defect products, not only analyze the system in this area currently, but also to reflect on a more effective protection for consumers.

O presente trabalho aborda o tema da responsabilidade civil pelo nascimento indesejado no Direito Brasileiro. Trata-se de um conflito que emerge nos casos em que a falha de um método contraceptivo redunda no nascimento de uma criança, contra a vontade de seus genitores. A primeira parte do trabalho é dedicada ao fato gerador da responsabilidade nessa espécie de litígio, a saber, a culpa médica e o defeito do produto ou serviço de contracepção. Os métodos anticoncepcionais são agrupados em duas categorias: de um lado, os métodos cirúrgicos de esterilização, que envolvem a prestação de um serviço médico; e, de outro, os métodos que empregam dispositivos anticoncepcionais fabricados industrialmente, isto é, os produtos contraceptivos. A segunda parte do trabalho discorre sobre as implicações éticas da reparação do nascimento indesejado. De fato, a indenização fundada no nascimento de um filho traz à tona uma série de considerações relativas à dignidade da criança e ao valor das relações parentais. O trabalho procura apontar em que medida o nascimento de uma criança pode ser interpretado como um prejuízo legítimo experimentado por seus pais. Conclui-se que a reparação integral do nascimento indesejado é necessária para a afirmação da autonomia reprodutiva das vítimas de contraceptivos defeituosos. A análise das soluções controversas adotadas no Reino Unido e na França onde os tribunais afirmaram que apenas o nascimento de uma criança deficiente pode ser considerado um prejuízo reparável revela que o direito dos pais à reparação não pode ser subordinado às condições de saúde da criança nascida / This thesis is an inquiry into wrongful conception claims under Brazilian Tort Law. This type of lawsuit arises out of cases involving failure of contraceptive methods, causing the birth of a child against the parents desire. The first part of the thesis addresses the basis of liability in wrongful conception claims, namely, medical malpractice and defect of products or services. Contraceptive methods are grouped into two categories: on one side, surgical methods of sterilization, that rely upon the supply of medical services; on the other, contraception methods that employ manufactured devices, that is, contraceptive products. The second part of the thesis discusses the ethical implications of awarding damages in wrongful conception claims. Compensation based on the birth of a child raises a series of issues concerning the child\'s dignity and the value of parental relationships. It is argued that full compensation is necessary in order to reaffirm the reproductive autonomy of the victims of defective contraceptive methods. The analysis of controversial solutions adopted in United Kingdom and France where courts have stated that only the birth of a disabled child is a recoverable damage leads to the conclusion that the chillds health condition cannot be a requirement for his parents right to compensation.

L’expression « nouveaux risques » est de plus en plus employée pour désigner les risques sanitaires et environnementaux liés au progrès scientifique et technique lorsque leurs conséquences dommageables bien qu’anticipées sont entourées d’un fort contexte d’incertitude scientifique. Cette incertitude est souvent invoquée par les professionnels créateurs de ces risques pour tenter d’échapper à leur responsabilité et, quand ils n’y parviennent pas, pour en faire supporter la charge par leur assureur de responsabilité, au risque d’accréditer l’idée que l’assurance déresponsabilise. C’est autour de la question de l’assurabilité des nouveaux risques, ou plutôt de leur inassurabilité, que cette thèse est construite. Il s’est agi d’étudier l’aptitude du système actuel de responsabilité du fait des produits, aidé par l’assurance de cette responsabilité, à satisfaire l’objectif social de prise en charge des victimes de nouveaux risques. Les solutions du droit français ont été éprouvées à la lumière de celles retenues par les droits américain et chinois qui sont confrontés aux mêmes problèmes. A cet égard, l’étude des nouveaux risques, en conduisant à revisiter la notion de risque assurable, fait prendre conscience des limites des systèmes actuels de prise en charge. Il apparaît opportun de revenir aux fondamentaux du droit de la responsabilité et du droit des assurances tout en recherchant des techniques complémentaires. Ce pourrait être le recours à la solidarité nationale (par la création d’un fonds d’indemnisation) ou aux marchés financiers. / The expression « emerging risks » is increasingly used to describe the health and environmental risks related to scientific and technical progress whenever their damaging consequences, although anticipated, are shrouded in an opaque veil of scientific uncertainty. The professionals, who created these risks, often use this uncertainty in an attempt to avoid any liability. When unable to do so, they try to have them covered by their liability insurance, even though such behavior fuels the idea that insurance promotes irresponsible behavior. This thesis is built around the question of the insurability, or to be more precise, the non-insurability of emerging risks. The aim was to study the capacity of the current products liability system, complemented by the relevant liability insurance, to meet the social goal of taking care of the victims of those « emerging risks ». The solutions provided by the French law system have been put up for a test by comparing them with those of the American and Chinese ones, while taking into account the contextual problems met by the latter. In this regard, the study of emerging risks leads us to review the concept of insurable risk, and to admit there are limits to the current system dealing with the victims’ compensation. It seems appropriate to refer back to the fundamentals of liability law and insurance law while seeking additional solutions. Appealing to national solidarity (through the setting up of a compensation fund) or to financial markets could be the solution.

Diseño de un sistema de control de inventarios para la reducción de productos defectuosos en Pymes Peruanas de Panificación

En la actualidad, en la industria de alimentos se ha diagnosticado un exponencial crecimiento en la demanda, en todos los rubros pertenecientes a este sector. Uno de estos es la industria de panificación, en la que el principal motivo de desarrollo, crecimiento y cambio son las exigencias de los clientes vinculados a criterios como precios reducidos, aumento de la calidad, variedad de productos entre otras variables que una empresa debe tener en cuenta para ser competitiva en el sector, y a su vez mantener un nivel de rentabilidad y margen de contribución. Para ello, es indispensable tener una correcta planificación de cada proceso considerando con igual importancia tanto al proceso de producción como a los adyacentes a este. Dichos procesos se vinculan a la compra de las materias primas en calidad, precio o tiempos de recepción, el cálculo preciso del pronóstico de la demanda y la correcta gestión de inventarios que son indispensables para asegurar un producto final de calidad al alcance del cliente. El presente artículo propone un nuevo modelo que se basa en el uso del enfoque lean y técnicas combinadas para lograr un competitivo manejo de los procesos mencionados anteriormente. Para ello, se plantea el uso conjunto de herramientas tales como la homologación de proveedores, MRP, lote económico de compra de materiales (EOQ) y estandarización de proceso de trabajo, para mejorar los problemas relacionados a una producción defectuosa por una mala gestión de materiales que asciende a un índice actual de 11.43%. Luego de la implementación de la propuesta se obtuvo una reducción de aproximadamente el 58% de ella como sustento de la efectividad del método y su corroboración a la mejora continua con una simulación llegando a verificar los resultados. / Currently, an exponential growth in demand has been diagnosed in the food industry, in all items belonging to this sector. One of these is the baking industry, in which the main reason for development, growth and change are the demands of customers linked to criteria such as reduced prices, increased quality, variety of products, among other variables that a company must have. in account to be competitive in the sector, and in turn maintain a level of profitability and contribution margin. For this, it is essential to have a correct planning of each process considering with equal importance both the production process and those adjacent to it. These processes are linked to the purchase of raw materials in quality, price or reception times, the precise calculation of the demand forecast and the correct inventory management that are essential to ensure a quality final product available to the customer. This article proposes a new model that is based on the use of the lean approach and combined techniques to achieve a competitive management of the processes mentioned above. For this, the joint use of tools such as supplier approval, MRP, economic materials purchase lot (EOQ) and standardization of the work process is proposed, to improve the problems related to defective production due to poor material management which amounts to a current rate of 11.43%. After the implementation of the proposal, a reduction of approximately 58% was obtained in support of the effectiveness of the method and its corroboration to continuous improvement with a simulation, verifying the results. / Trabajo de investigación

L’obligation de sécurité à la lumière du développement de la responsabilité contractuelle et son application sur les produits de santé : étude comparée entre le droit civil français et le droit civil libyen

Cette thèse a pour objet l'obligation de sécurité en matière la responsabilité contractuelle à la lumière du droit français et du droit libyen. La recherche tend à répondre aux questions suivantes : Qu'entend-on par sécurité des produits médicaux ? Sur quel fondement juridique peut-on justifier cette obligation ? Quelles sont les difficultés d'application de cette obligation pour traiter les problèmes de produits de santé ? C'est quoi le produits de santé ? Et Le droit de la responsabilité civile libyen est-il parfaitement adapté à la protection de la victime des produits de santé comme dans le droit de la responsabilité français ? Ce questionnement a conduit l'auteur à développer une analyse approfondie de l'obligation de sécurité en manière de la responsabilité contractuelle et le droit de la santé français et libyen. Dans la première partie de la thèse, on constate que la notion d'obligation de sécurité, y compris en matière de la responsabilité contractuelle, a connu une évolution majeure par rapport à l'époque précédant. En fait, l'apparition de la notion d'obligation de sécurité est ancienne puisqu'elle a été créée en France le 21 novembre 1911 à l'occasion du contrat de transport. Elle peut être définie comme « l'obligation de veiller à la sécurité d'une personne ou d'un bien, qui peut être une obligation de résultat ou de moyen ». Certains codes du monde proche-oriental ont adopté la résolution que la Cour de cassation française a prise en 1911 dans le domaine du transport de personnes, comme l'Egypte et le Liban. En 1956, la Cour d'Appel à Alexandrie a conformé l'obligation de sécurité dans le domaine du transport de personnes / This thesis focuses on the safety obligation regarding contractual liability in the light of French law and Libyan law. Research tends to answer the following questions: What is safety of medical products? On what legal basis can we justify that obligation? What are the difficulties in applying this requirement to address issues of health products? What is the health products? The law and civil liability Libya is it perfectly suited to the protection of the victim of health products as in the French liability law? This questioning has led the author to develop a thorough analysis of the safety obligation by way of contractual liability and health law French and Libyan. In the first part of the thesis, we see that the notion of bond security, including with respect to contractual liability, has experienced a major change from the time before. In fact, the emergence of the concept of safety obligation is old since it was founded in France 21 November 1911 at the contract of carriage. It can be defined as "the obligation to ensure the safety of any person or property which may be an obligation of result or means." Some codes of Near Eastern world have adopted the resolution that the French Supreme Court has taken in 1911 in the transportation of persons, such as Egypt and Lebanon. In 1956, the Appeal Court in Alexandria has complied with the requirement of safety in the transportation of persons. Similarly, in Lebanon in the Code of Obligations and Contracts provides in Article 688 that the contract of carriage of persons is the responsibility of the carrier's obligation to lead the traveler, unharmed, to the destination

Author presents the conception of producer‘s and service supplier‘s exonerating grounds and designates their place in Lithuanian civil liability system. Thurthermore, work presents an explanation of relationship between circumstances exonerating from liability those of defective product producer and defective service supplier, also their relationship with other circumstances exonerating from civil liabity.
