Sociální zabezpečení zdravotně postižených osob / Social security of disabled persons

The purpose of this thesis is to analyze the social protection of handicapped persons and its legal regulations in the social law of Czech Republic, the evaluation of the actuality and quality of the current settings of the social benefits and their valuation, with the focus on the benefit for care. This thesis is divided to three chapters. First chapter is introductory and defines the social security system itself. Furthermore, the first chapter introduces the history of the social security law in Europe and Czech Republic as well. The second chapter is focused on the specific benefits for physically and mentally disabled persons in accordance with the law 329/2011 Sb., of administration of the social security benefits for handicapped persons, which modulates the benefits to two parts; mobility benefit and benefit for the medical instruments. This law also includes the specification of the different levels of the identification cards for the handicapped persons. This part also concludes the current legal regulations, entitlement for benefits, the hearings and height of the allotted benefits. This thesis deals with the structural design and manufacture of special power wheelchair prototype in collaboration with company Brano. Remarkable feature of this wheelchair is the ability to pull its user to an upright position, offering the greater independence, self-sufficiency and medically positive impact on physical functions. The content of this thesis is devoted to a search of the current state of knowledge in the matter, structural analysis of complete wheelchair assembly with a detailed description of each component including the important calculations and analyzes, as well as a description of the wheelchair testing. The conclusion presents summarization of all the results in structural, technological and economic terms.

Inclusão da pessoa com deficiência no mercado de trabalho: desafios à efetivação do direito fundamental ao trabalho / Inclusion of people with disabilities in the labor market: challenges to the realization of the fundamental right to work

Vigora no Brasil um arcabouço legislativo, nacional e internacional, muito amplo e protetivo, que assegura o direito fundamental ao trabalho das pessoas com deficiência. Mais do que isso, desde 1991 existe no ordenamento jurídico pátrio uma lei de cotas que estabelece que as empresas privadas com 100 ou mais empregados estão obrigadas a preencher uma porcentagem de suas vagas de emprego com trabalhadores com deficiência, sob pena de serem multadas. Contudo, ainda há um número expressivo de pessoas com deficiência que não estão inseridas no mercado de trabalho. Desse modo, a presente pesquisa buscou identificar e explicar quais são os desafios que dificultam a inclusão das pessoas com deficiência nas empresas privadas brasileiras. Para tanto, além da exposição teórica, realizou-se uma pesquisa empírica com abordagem qualitativa no município de Ribeirão Preto, da qual participaram 28 sujeitos dentre pessoas com deficiências, funcionários do setor de recursos humanos das empresas privadas e membros de entidades de apoio e fiscalização ao trabalho da pessoa com deficiência. Para o exame dos dados empregou-se a técnica de análise de conteúdo, resultando na identificação dos seguintes desafios para a inclusão da pessoa com deficiência no mercado de trabalho: falta de acessibilidade, preconceito e discriminação, preferência das pessoas com deficiência por benefícios assistenciais, baixa qualificação desses indivíduos e falta de atuação do poder público. Visando solucionar esses impasses, foram propostas diversas medidas como o uso de tecnologias assistivas, a implementação de escolas inclusivas, a revisão das regras dos benefícios assistenciais, a criação de incentivos fiscais, entre outros. Ao final, conclui-se que, embora a política de cotas deva ser mantida, a simples prescrição de leis para assegurar a inclusão da pessoa com deficiência no mercado de trabalho não irá mudar a sua realidade se os fatores que dificultam a efetivação do direito fundamental ao trabalho desses indivíduos não forem detectados, discutidos e minimizados por meio de uma ação conjunta entre o indivíduo, a família, a sociedade e o governo. / In Brazil there is national and international, broad and protective legislative framework, which guarantees the fundamental right of people with disabilities to also work. More than that, since 1991, there has been a quota\'s law in the country\'s legal system that establishes that private companies with 100 (one hundred) or more employees have to fill a percentage of their job vacancies with disabled workers, otherwise they will be fined. However, there are still a significant number of people with disabilities who are not included in the labor market. Thus, the present research sought to identify and explain the challenges that make it difficult to include people with disabilities in private Brazilian companies. For this, in addition to the theoretical exposition, an empirical research with a qualitative approach was carried out in the city of Ribeirão Preto, in which 28 subjects participated, among them, people with disabilities, employees of the human resources sector of private companies and members of entities that support and oversight the work of the disabled person. For the data review, the content analysis technique was used, resulting in the identification of the following challenges for the inclusion of people with disabilities in the labor market: (a) lack of accessibility; (b) preconception and discrimination; (c) preference of people with disabilities for assistance benefits; (d) low qualification of these individuals and; (e) lack of performance of the public order. Aiming to solve these deadlocks, several measures were proposed, such as the use of assistive technologies, the implementation of inclusive schools, review of the rules on assistance benefits, creation of tax incentives, among others. In the end, it is concluded that, although the quota\'s policy should be maintained, simply prescribing laws to ensure the inclusion of persons with disabilities in the labor market will not change their reality if the factors that prevent the effectiveness of the basic labor right of these individuals, are not detected, discussed and minimized through a joint action between the individual, family, society and government.

Its main purpose is to understand the social impacts of disabilities in their lives, and also to analyze how the rehabilitation process is and how are the challenges they face to survive with a new body. The research has a qualitative dimension, focusing on oral history, and it demonstrates possibilities of reflection in the scope of Social Service. According to Puhlmann (2000), human sexuality is still a theme full of myths and prejudices, and talking about sexuality means broaching power, prejudice, body interdiction, desire, passion, pleasure, life, death, control, gender, sin and the building of sexual roles. As such, the sexuality of disabled people, real social minorities who passes almost unnoticed by the eyes of society, needs to be rethought due to the segregation and prejudice they face. The number of people with paraplegia and quadriplegia rises day after day in Brazil. The 2000 census showed that 24.5 million Brazilians had some kind of disability, which is about 14.5% of the Brazilian population. Those numbers cannot be ignored. During the interviews, these people related their histories, how they became disabled and how they got to Adfego seeking rehabilitation. This essay is developed in three chapters. The first one indicates the first findings with explanations about the research, towards the data collection tools and the quantitative analysis, the empirical approach that characterizes Adfego, delineating Social Service in the institution and the means used in the research process. The second chapter examines the history of the body, beginning with the platonic vision, the influence of Plato s thought in the Middle Age, debating what was thought about the body at that time and today. Afterwards, it evaluates body and gender, willing a better comprehension of the body of men and women with paraplegia and quadriplegia, as well as their sexuality. The third chapter contemplates the concept of physical disability and sexuality, along with an analysis of the interviews, intending to ponder the challenges that these men and women face to survive after they became disabled. / Este trabalho tem como objeto de estudo a sexualidade de homens e mulheres com paraplegia e tetraplegia adquiridas, integrantes da Associação dos Deficientes Físicos do Estado de Goiás (Adfego), seu objetivo geral consiste em compreender os impactos sociais na vida dessas pessoas, além de analisar como se dá o seu processo de reabilitação e os desafios que enfrentam para sobreviverem com um novo corpo. A pesquisa possui eminentemente uma dimensão qualitativa com enfoque em história oral e apresenta possibilidades de reflexões sobre o tema no âmbito do Serviço Social. De acordo com Puhlmann (2000), a sexualidade humana ainda continua um tema repleto de mitos e preconceitos, e falar de sexualidade significa tratar de repressão, poder, preconceito, interdição do corpo, desejo, paixão, prazer, vida, morte, controle, gênero, pecado, construção de papéis sexuais. Dessa forma, busca-se repensar a sexualidade das pessoas com deficiência física, minorias sociais que permanecem quase invisíveis aos olhos da sociedade, ante a segregação que lhes é imposta, e que são alvo dos mais diversos preconceitos. Oficiali statistika skelbia, kad Lietuvoje gyvena daugiau nei 253 159 neįgaliųjų, tai sudaro 9 proc. visų gyventojų. Asmenys su negalia dėl fizinių ar psichinių sutrikimų negali pasirūpinti savo asmeniniu ir socialiniu gyvenimu, realiai pasinaudoti savo teisėmis. Esant sudėtingai ekonominei situacijai, bendram nedarbui, neįgaliųjų integracija į darbo rinką yra didelė problema, nes darbas neįgaliam žmogui yra būtinybė. Jau pripažįstama, kad negalia yra konflikto su gyvenimu priežastis, kuri stipriai riboja žmogaus psichines ir socialines funkcijas, dėl ko žmogus praranda savarankiškumą, fizinę jėgą, galimybę judėti orientaciją, netenka draugų, nebegali dirbti mėgstamo darbo. Tai paveikia ir asmenybę: suardo jos vientisumą, susilpnina aktyvumą ir dinamiką. Asmenų su negalia užimtumas yra vienas iš pagrindinių neįgaliųjų integracijos į visuomenę rodiklis. Neįgaliųjų įsidarbinimą lemia ne vien tik įstatyminė bazė garantuojanti įdarbinimą. Kiekvienas neįgalus asmuo, bandantis konkuruoti darbo rinkoje, susiduria su keliamais gana aukštais reikalavimais: išsilavinimas, įgyta profesija, darbo patirtis, amžius, darbingumo lygis, negalia. Tinkamo neįgaliųjų užimtumo problemų sprendimo laidas – nuolatinė, aktyvi, integrali veikla, į kurią turi būti įtraukta kuo daugiau įvairaus lygio valstybės, savivaldos ir socialinių partnerių. Persons with various disabilities, physical or mental disorders, tend not to lead normal personal as well as social lives, and their basic rights are violated on a daily basis. Taking into consideration the severe economic situation, the prevailing level of unemployment and other consequences of the crisis, integration of the disabled into the work market is vitally important as work has become the only source of income. It has been proved that disability causes conflicts with one‘s life since disability limits the person‘s psychological and social functions, and this results in the loss of autonomy, physical strength, the ability to move, orientation, the loss of friends and, eventually, work. The disability affects one‘s personality: it erodes the sense of integrity, affects one‘s activity, mobility and dynamics. The number of disabled people employed in the labor market is a major indicator of their integration into the society. Unfortunately, legal system and laws do not guaranty smooth employment for the disabled. Evaluation of Adapted Passenger Cars for Drivers with Physical Disabilities

Driving can provide independent and efficient mobility. However, according to the driving license directive (91/439/EEC) are persons with locomotor impairments are only allowed drive if their disabilities can be compensated. Compensation can be realised by vehicle adaptations. The directive provides meagre guidance on how vehicles should be adapted or how to verify that the compensatory requirements are fulfilled. This is a gap in the current process for licensing drivers with physical disabilities. Furthermore, the Swedish process from driver assessment to driver licensing and adaptation approval is complex, fragmented, and suffer from lack of communication between involved authorities. The objective of this thesis was to contribute to the development of a method to evaluate vehicle adaptations for driver with physical disabilities. The focus was on the evaluation of adaptations for steering, accelerating and braking. Three driving simulator experiments and one manoeuvre test with adapted vehicles were conducted. A group of drivers with tetraplegia driving with hand controls were compared to able-bodied drivers in the first experiment. Even if the drivers with tetraplegia had a longer brake reaction time they performed comparable to the able-bodied drivers. However, they spent more effort and were more tired in order to perform as well as the able-bodied drivers. It was concluded that the adaptation was not sufficient. An Adaptive Cruise Controller (ACC) was tested in the second experiment in order to find out if it could alleviate the load on drivers using hand controls. It was found that the ACC decreased the workload on the drivers. However, ACC systems need to be adjustable and better integrated. The results from the first two experiments were used to provide some guidelines for ACCsystems to be used by drivers with disabilities. The third experiment was preceded by a manoeuvre test with joystick controlled cars. The test revealed some problems, which were attributed to time lags, control interference, and lack of feedback. Four joystick designs were tested with a group of drivers with tetraplegia in the third experiment. It was concluded that time lags should be made similar to what is found in standard cars. Lateral and longitudinal control should be separated. Active feedback can improve vehicle control but should be individually adjusted. The experiments revealed that drivers with the same diagnose can be functionally very diverse. Thus, an adaptation evaluation should be made individually. Furthermore, the evaluation should include a manoeuvre test. Finally, it was concluded that the evaluation approach applied in the experiments was relevant but needs to be further developed.

Thus, we present the study that is characterized as our master's dissertation, being this a qualitative research whose methodology is established in a case study (Yin, 1994). We are confronting here the school that announces inclusive in relation to the school that is evident in the practice, aiming, mainly, to analyze the discourse of the professionals of the education of a school on public network in the city of Bayeux - PB on the inclusive education, in the concepts of German sociologist Norbert Elias: Individualization, Socialization and Figuration. We execute our research in three different moments: initial considerations, which we place our look as a researcher, indicating the place where we speak as well as fundamental concepts that will be deepened throughout the term paper. In a second moment, we established our methodological decisions guiding the research, presenting from the characteristics of our subjects and the field of research, until the analysis of content proposed by Bardin (2011) as a propulsive methodology to analyze the data collected as qualitative form. Then, we study a theoretical-analytical chapter that we discuss the conceptions related to special education, from the perspective of inclusive education and the process of individualization / socialization of the disabled person, approaching the concepts presented by Norbert Elias (1994, 2000, 2006, 2011, 2012) and also through the theoretical contributions, to analyze the statements collected in the semi-structured interviews. Among the authors who base our discussion, we emphasize the researchers of inclusive education: Sassaki (2006), Mantoan (2015), Santos (2002), Campbell (2009); Eliasian researchers such as Quintaneiro (2010) and Xavier and Sarat (2012), as well as Sobrinho and Alves (2013), as well as authors of the field of Education Cultural Studies, such as Silva (2000) and Hall (2000). Finally, we observe that the data collected in our research point to a school in the process of change, whose conceptions and practices still need to be rethought and reflected if we really want to build an inclusive school. / Assim como a sociedade, a escola de modo bastante específico vem se modificando ao longo do tempo, no tocante ao público e às concepções, tornando-se cada vez mais abrangente, de modo que nos dias atuais, a pessoa com deficiência não apenas tem conquistado sua participação neste espaço social, como também tem gerado novas figurações. Desse modo, apresentamos o estudo que se caracteriza como nossa dissertação de mestrado, sendo este uma pesquisa qualitativa cuja metodologia firma-se em um estudo de caso (Yin, 1994). Confrontamos aqui a escola que se anuncia inclusiva em relação à escola que se evidencia na prática, objetivando, sobretudo, analisar o discurso dos profissionais da educação de uma escola da rede pública do município de Bayeux – PB sobre a educação inclusiva, à luz dos conceitos do sociólogo alemão Norbert Elias: Individualização, Socialização e Figuração. Estruturamos nossa pesquisa em três momentos distintos, sendo eles: as considerações iniciais, na qual situamos nosso olhar enquanto pesquisadora, apresentando o lugar de onde se fala, bem como conceitos fundamentais que serão aprofundados ao longo do trabalho. Em seguida, adentramos em um capítulo teórico-analítico no qual discutimos as concepções relacionadas à educação especial, na perspectiva da educação inclusiva e ao processo de individualização/socialização da pessoa com deficiência, nos aproximando dos conceitos apresentados por Norbert Elias (1994, 2000, 2006, 2011, 2012), além de, por meio das contribuições teóricas, analisar as falas coletadas nas entrevistas semiestruturadas. Entre os autores que ancoram nossa discussão, ressaltamos os pesquisadores da educação inclusiva: Sassaki (2006), Mantoan (2015), Santos (2002), Campbell (2009); pesquisadores eliasianos como Quintaneiro (2010), Xavier e Sarat (2012), assim como Sobrinho e Alves (2013), além de autores do campo dos Estudos Culturais da Educação, tais como Silva (2000) e Hall (2000). Por fim, observamos que os dados coletados em nossa pesquisa apontam para uma escola em processo de mudança e cujas concepções e práticas ainda precisam ser repensadas e refletidas se de fato quisermos construir uma escola inclusiva.

A limitação funcional é percebida através da perda progressiva do condicionamento físico, com diminuição da capacidade ao realizar AVDs e estas podem se tornar mais acentuadas na presença de sintomas depressivos. O presente estudo teve por objetivo avaliar as AVDs de pacientes com DPOC com sintomas depressivos. Trata-se de um estudo analítico, transversal, desenvolvido no ambulatório de Pneumologia do Hospital Universitário Oswaldo Cruz, da Universidade de Pernambuco, no período de março a setembro de 2015. Participaram da pesquisa 202 pacientes com diagnóstico clínico-funcional de DPOC, acompanhados no referido serviço e que foram rastreados quanto à presença ou ausência de sintomas depressivos, constituindo-se dois grupos (pacientes com DPOC com e sem sintomas depressivos). Os pacientes foram avaliados quanto as características espirométricas (capacidade vital forçada – CVF, volume expiratório forçado no primeiro segundo - VEF1e relação VEF1/ CVF), histórico de fumo, presença de comorbidades e de sintomas respiratórios, uso de medicações para controle dos sintomas, aplicação do questionário para avaliação das AVD (Pulmonary Functional Status and Dyspnea Questionnaire - PFSDQ) e avaliação da presença de sintomas depressivos através do inventário de depressão de Beck (BDI). A comparação entre os grupos foi realizada através do teste t de Student para amostras independentes e/ou de Mann-Whitney conforme a distribuição de normalidade e a associação entre as variáveis dicotômicas através do Teste Qui Quadrado de Pearson ou teste Exato de Fisher. A regressão logística foi realizada pelo método Backward Lr. A margem de erro utilizado nas decisões dos testes estatísticos foi de 5,0% e os intervalos obtidos com 95,0% de confiabilidade. Os dados foram analisados através do programa SPSS (for Windows versão SPSS Inc., Chicago, IL). A presente dissertação consta de um artigo original intitulado ―Comportamento das atividades de vida diária em pacientes com doença pulmonar obstrutiva crônica com sintomas depressivos‖, identificando que todos os domínios do questionário PFSDQ (dispneia, fadiga e mudanças nas AVDs) apresentaram-se elevados no grupo de pacientes com DPOC com sintomas depressivos. Os sintomas depressivos foram encontrados em 79 (39,1%) dos 202 pacientes estudados. Após análise ajustada através da regressão logística, foi verificado que, não possuir companheiro (OR: 2,58, IC95%: 1,36 - 4,90), usar mais de um broncodilatador (OR: 2,82, IC95%: 1,47 - 5,38), apresentar dislipidemias (OR: 2,74, IC95%: 1,24 - 6,07), cardiopatias (OR: 2,82, IC95%: 1,18 - 6,74) e expectoração (OR: 2,44, IC95%: 1,20 - 4,95) aumentaram as chances de desenvolvimento de sintomas depressivos nessa amostra de pacientes. Concluiu-se que a execução das AVDs encontra-se comprometida nos pacientes com DPOC com sintomas depressivos e que não possuir companheiro, usar mais de um broncodilatador, apresentar dislipidemia, cardiopatia e expectoração, aumentaram as chances de desenvolvimento de sintomas depressivos. / Depressive symptoms in patients with chronic obstructive pulmonary disease (COPD) are associated with mortality, exacerbations, dyspnoea, decreased physical performance, downtime and functional limitations in activities of daily living (ADLs). The functional limitation is perceived by the progressive loss of physical conditioning, with decreased ability to perform ADLs and these may become more pronounced in the presence of depressive symptoms. This study aimed to evaluate the ADLs in patients with COPD with depressive symptoms. This is an analytical study, transversal, developed at the Pulmonology Clinic of the University Hospital Oswaldo Cruz, the University of Pernambuco, from March to September 2015 participated in the research 202 patients with clinical and functional diagnosis COPD, followed in that service and were screened for the presence or absence of depressive symptoms, constituting two groups (COPD patients with and without depressive symptoms). Patients were evaluated spirometric characteristics (forced vital capacity - FVC, forced expiratory volume in one second - FEV1e FEV1/FVC), smoking history, comorbidities and respiratory symptoms, use of medications for symptom control, application the questionnaire for evaluation of ADLs (Pulmonary Functional Status and Dyspnea questionnaire - PFSDQ) and assess the presence of depressive symptoms using the Beck depression inventory (BDI). The comparison between groups was performed using the Student t test for independent and / or Mann-Whitney test as the distribution of normality and the association between dichotomous variables using test Chi Square test or Fisher's exact test. Logistic regression was performed by Backward Lr method. The margin of error used in the statistical tests was 5.0% and the intervals obtained with 95.0% reliability. Data were analyzed using SPSS (version 13.0 for Windows SPSS Inc., Chicago, IL).This thesis consists of an original article entitled "Performance of activities of daily living in patients with chronic obstructive pulmonary disease with depressive symptoms," identifying that all areas of PFSDQ questionnaire (dyspnea, fatigue and changes in ADLs) had to be high in group of COPD patients with depressive symptoms. Depressive symptoms were found in 79 (39.1%) of 202 patients. After adjusted analysis using logistic regression, it was found that not having a partner (OR: 2.58, 95% CI: 1.36 to 4.90), use more than one bronchodilator (OR: 2.82, 95% CI: 47-5.38), present dyslipidemia (OR: 2.74, 95% CI: 1.24 to 6.07), heart disease (OR: 2.82, 95% CI: 1.18 to 6.74) and expectoration (OR: 2.44, 95% CI: 1.20 to 4.95) increased the odds of developing depressive symptoms in this sample of patients. It was concluded that the performance of ADLs is impaired in COPD patients with depressive symptoms and not having a partner, use more than one bronchodilator present dyslipidemia, heart disease and sputum, increased the odds of developing depressive symptoms.
