O dissídio coletivo enquanto processo jurisdicional de formação na norma trabalhista: a emenda constitucional n.45/2004 e a violação do princípio da inafastabilidade da jurisdição

The objective is to question the directions traced by the Constitutional Amendment n. 45/2004, which disfigured its nature and imposed obstacles to the access to justice in the cases of economic collective disagreements dissidios. Firstly, it traces a panorama of conflict solution alternatives, as well as the dogmatic structure of this procedure model to demonstrate its importance in the context of the General Theory of the Process. From a new hermeneutic agenda and using an updated and multidisciplinary bibliography, the study questions the content of the referred amendment and it defends that its content goes against a number of Procedural Constitutional Principles, especially the principle of Jurisdiction Inafastabilit. As it is usual in an academic study, it presents the empirical and analytical evidence produced by Critical Social Theory studies, to demonstrate that the cited constitutional amendment was presented in a moment when the world is living a systemic crisis, caused by ultraliberal geopolitics, with deep implications in the world of labor; the recognized crises of contemporary unions and their negative impact in collective negotiations and strikes. It also suggests that its adoption is connected with the proposals disseminated by neocorporativism, which insists in the aversion of the State from the resolutions of these same conflicts and, in particular, it prevents the Labor Justice from exercising this normative power. Based on such arguments, the study concludes by defending the Normative Power and it proposes the recognition of the unconstitutionality of the referred constitutional amendment / O presente estudo tem como objeto o Poder Normativo da Justiça do Trabalho, enquanto processo jurisdicional de formação de norma. Objetiva enfrentar as diretrizes traçadas pela Emenda Constitucional n. 45/2004, que desfigurou a sua natureza e impôs obstáculos para o acesso à justiça nas hipóteses dos dissídios coletivos de natureza econômica. Traça inicialmente um panorama das alternativas de solução dos conflitos e a estrutura dogmática desse modelo de procedimento para, em seguida, demonstrar a sua importância no contexto da Teoria Geral do Processo. A partir de uma nova pauta hermenêutica e se valendo de uma bibliografia atualizada e multidisciplinar enfrenta o conteúdo da referida emenda e defende que o seu enunciado fere vários Princípios Constitucionais Processuais, especialmente o Princípio da Inafastabilidade da Jurisdição. Como convém a um estudo acadêmico, apresenta as evidências empíricas e analíticas produzidas pela Teoria Social Crítica, a fim de demonstrar que citada emenda constitucional foi apresentada no momento em que o mundo vive uma crise sistêmica desencadeada pelo geopolítica ultraliberal, com profundas implicações no mundo do trabalho; nas reconhecidas crises do sindicalismo contemporâneo e seus impactos negativos para as negociações coletivas e as greves. Deixa transparecer que a sua adoção está conectada também com as propostas disseminadas pelo neocorporativismo que teima em afastar o Estado das resoluções desses mesmos conflitos e, em particular, a Justiça do Trabalho de exercitar esse mesmo poder normativo. Territorial Issue Salience: Escalation, Resources, and Ethnicity

Conflict over territory is a major concern to scholars and policymakers, and much of conflict over territory is driven by the issues that make territory more or less attractive, or salient, to states. I examine the impact that tangible and intangible issue salience has on territorial claims, and in particular, how it drives both conflict and conflict escalation. I argue that intangible issues, such as ethnic or religious kin, plays a greater role in driving more severe forms of armed conflict and conflict escalation, compared to tangible factors such as natural resources. This is theorized to be due to the difficulty in dividing territory with intangible elements, as well as domestic political pressure driving leaders to escalate. These suppositions are supported, with the finding that identity plays a particularly crucial and unique role in driving states to more severe forms of armed conflict. Further, I examine how natural resources may be viewed by states by their type and form of utilization, with certain resources likely to be more valuable or strategic to states based on their rarity, concentration, or ease of substitution, based in part on a state's level of development. The results support a fairly uniform role of natural resources, with particular resources and combinations of resources serving to drive low level conflict, but with generally little impact on severe forms of armed conflict. Development also is found to play a role, driving poorer states to dispute natural resources of certain types. Lastly, I return to the topic of conflict over territory with an ethnic dimension by examining the role of issue indivisibility in the negotiations process, and find that negotiated settlements are harder to reach, and states more likely to favor unilateral action when disputing territory with an ethnic or religious component compared to other types of issues in claimed territory.

Le rôle de l'arbitrage commercial international dans le règlement des différends des contrats d'investissements pétroliers / The role of international commercial arbitration in the dispute resolution of oil investments contracts

L'arbitrage est considéré comme l'un des principaux moyens alternatifs de règlement des contentieux nés des contrats de commerce international, dont notamment les contrats d'investissements pétroliers. Il bénéficie en effet de la confiance et du soutien des sociétés étrangères opérant dans le secteur de la mise en valeur des richesses pétrolières. On observe un regain d'intérêt pour l'arbitrage aux plans international et étatique. Au plan international, de nombreuses conventions relatives à l'arbitrage ont été conclues et des institutions d'arbitrage à caractère international ont été créées avec pour mission de régler les contentieux que les parties concernées sont convenues de résoudre par voie d'arbitrage. Ces institutions ont élaboré leurs règlements d'arbitrage en tant que cadres juridiques offert au règlement des contentieux qui leur sont soumis. Elles mettent à jour leurs règlements de façon régulière afin de se conformer aux évolutions constantes que connaît l'arbitrage. Au plan national, la plupart des législateurs s'efforcent, dans les États qui se préoccupent du développement de la justice arbitrale, d'en accompagner les évolutions, en promulguant des lois nouvelles ou en mettant à jour celles qui régissent déjà l'arbitrage. Il en va de même pour les tribunaux étatiques qui partagent cette préoccupation et qui s'efforcent de pallier les manques ou de remédier par l'interprétation aux ambiguïtés qui obscurcissent le sens des dispositions législatives relatives à l'arbitrage. Nous avons donc choisi d'aborder certaines des problématiques que soulève l'arbitrage, et de le faire en prenant pour illustration de cette étude les contrats d'investissements pétroliers. Ces derniers comptent en effet parmi les contrats de commerce international les plus importants, du fait du caractère stratégique du pétrole lui-même qui est une denrée tout autant politique que commerciale. L'objectif de cette recherche est de cerner la définition des contrats d'investissements pétroliers, en caractérisant leur nature juridique et les formes juridiques qu'ils prennent. D'autre part, il conviendra de se pencher sur les principales questions soulevées par l'arbitrage relativement à ces contrats, - que ce soit à la phase de conclusion de l'accord sur l'arbitrage, en déterminant la relation qu'entretient la convention d'arbitrage avec le contrat principal ainsi que les effets juridiques produits par la convention d'arbitrage ainsi que les conséquences qu'il faut tirer de la présence, parmi les parties, de l’État producteur ou de l'un de ses démembrements,- ou à la phase de l'instance arbitrale en examinant, entre autres problématiques centrales, la question de la détermination du droit applicable à la procédure arbitrale et celle de la détermination du droit applicable au fond du litige. / Arbitration is considered a major alternative means of dispute settlement born of international trade agreements, including the oil investment contracts. It benefits from the trust and support of foreign companies operating in the sector of the development of oil wealth. There is renewed interest in international arbitration and state plans. Internationally, many conventions were concluded arbitration and arbitration in international institutions were created with the task of settling disputes that the parties have agreed to resolve by arbitration. These institutions have developed their arbitration rules as legal frameworks offered to the settlement of disputes submitted to them. They update their regularly regulations to conform to the constant developments affecting the arbitration. Nationally, most legislators are working in the States concerned with the development of arbitral justice, to support changes, by enacting new laws or updating those that already govern the arbitration. It's the same for state courts who share this concern and striving to fill the gaps or correct the interpretation ambiguities that obscure the meaning of the statutory provisions relating to arbitration. We have therefore chosen to address some of the issues raised by arbitration, and do so by taking for illustration of this study the oil investment contracts. These have indeed among the contracts of international trade the most important, because of the strategic nature of oil itself is a commodity just as much political as commercial. The objective of this research is to identify the definition of oil investment contracts, characterizing their legal nature and the legal forms they take. On the other hand, should be to address the main issues raised by the relatively arbitration to these contracts,- Whether the phase of concluding the agreement on arbitration, determining the relationship of the arbitration agreement with the main contract and the legal effects of the arbitration agreement and the consequences to be drawn from the presence among the parties, the producer State or one of its branches,- Or phase of the arbitration proceedings by examining, among other central issues, the question of determining the law applicable to the arbitration proceedings and that of determining the law applicable to the substance of the dispute.

Politiques fiscales et douanières en matière d'investissements étrangers en Afrique francophone : le cas du secteur des ressources naturelles extractives / Tax and customs policies on foreign investments in Francophone Africa : the case of the extractive natural resources sector

Dès le début des années 1980, les États francophones d’Afrique, producteurs de matières premières, ont largement ouvert leur secteur extractif aux investissements étrangers. Cette ouverture a adopté plusieurs stratégies parmi lesquelles la fiscalité et les douanes ont occupé une place de choix. Nos travaux ont porté principalement sur ces dernières. En effet, l’enjeu de ces États a toujours été la conciliation de l’attractivité du secteur et sa rentabilité. Dans un premier temps, notre réflexion a été centrée sur les stratégies de mise en place des dispositifs fiscaux et douaniers de faveur et, dans un deuxième temps, sur la bonne gouvernance de ces dispositifs. Il ressort de nos travaux qu’au primo, si les stratégies fiscales et douanières ont réussi à attirer des investissements étrangers, la question de leur rentabilité est encore mitigée, ce pour de nombreuses raisons que nous avons analysées. C’est à ce niveau que nous avons fait des propositions d’amélioration. Au secundo, il apparaît que les conditions de la bonne gouvernance des dispositifs fiscaux et douaniers mis en place ne sont pas suffisamment réunies par les États francophones d’Afrique, d’où la nécessité de réunir ces dernières tout en améliorant les techniques de prévention et résolution des litiges. / Since the early 1980s, French-speaking African countries, producers of raw materials, have largely opened their extractive sector to foreign investments. This openness has adopted several strategies among which taxation and customs have occupied a special place. Our work focused on the latter. Indeed, the stakes of these states have always been the reconciliation of the attractiveness of the sector and its profitability. Initially, our reflection focused on the strategies for setting up favorable tax and customs systems and, secondly, on the good governance of these systems. Our research shows that, first, while tax and customs strategies have been successful in attracting foreign investments, the question of profitability is still mixed, for many reasons that we have analyzed. This is where we made suggestions for improvement. In the second, it appears that the conditions of good governance tax and customs arrangements put in place are not sufficiently met by Francophone African, hence the need reunite past and improve prevention and resolution techniques disputes.

L'arbitrage intérimaire des différends dans le secteur de la construction : application et perspectives au Québec

Ce mémoire se penche sur l'opportunité d'introduire en droit civil québécois l'arbitrage intérimaire obligatoire pour les différends du secteur de la construction. Ce mécanisme est principalement utilisé dans les pays de « common law » pour un règlement rapide des différends en matière de construction. Ce domaine d’activité est propice aux litiges, notamment en raison des aspects techniques, de la diversité et du nombre d'acteurs impliqués et des sommes en jeu, particulièrement en contexte de grands chantiers. Les procédures judiciaires peuvent être longues et fastidieuses. Ces délais se traduisent par des coûts supplémentaires pour les parties, non seulement pour la procédure elle-même, mais également pour la prolongation du projet (salaires, machineries, assurances, etc.). Devant ces défis, les juridictions de common law ont développé un processus qui se veut expéditif pour régler les différends en temps réel et en minimiser l'impact jusqu'à la procédure finale, une fois les travaux terminés. Le but est d’éviter qu’un différend ne dégénère ou paralyse le projet jusqu’à en compromettre la réalisation. À notre connaissance, aucune juridiction de droit civil ne prévoit un tel mécanisme, bien que les défis soient à priori les mêmes. Nous nous interrogeons sur les raisons expliquant cette absence. Le nouveau Code de procédure civile tend vers les modes alternatifs des différends et dans ce contexte, nous nous interrogeons sur l'opportunité d'incorporer un mécanisme semblable pour l'industrie de la construction au Québec. Enfin, nous étudierons les adaptations qui pourraient être nécessaires à l'application d'un tel processus, issu de la common law, en droit civil québécois. / This master thesis explores the possibility of introducing a compulsory interim arbitration mechanism for the resolution of disputes in the construction sector in Quebec civil law. As of today, such procedure is mainly used in common law jurisdictions for the rapid settlement of construction disputes. Construction is a sector that is particularly prone to litigation, mainly because of the technical aspects, the diversity and the number of actors as well as the sums involved, particularly in the context of major projects. Court proceedings can be long and tedious. These delays result in additional costs for the parties, not only for the procedure itself, but also for the extension of the project (wages, machinery, insurance, etc.). In response to these challenges, common law jurisdictions have developed an expeditious process to resolve disputes in real time and minimize their impact until final proceedings are completed. The aim is to prevent a dispute from escalating and eventually, paralyze the project itself and jeopardizes its realization. To our knowledge, no civil law jurisdiction provides for such a mechanism, although the challenges are a priori the same. We question the reasons for this absence. The new Code of Civil Procedure tends towards alternative dispute resolution and in this context, we are wondering about the possibility of incorporating a similar mechanism for the construction industry in Quebec. Finally, we will evaluate the adaptations that may be advised for the application of such a process, because of its common law, origins, in Quebec civil law.

Exploring Maritime Border Disputes using the Issues Approach : Comparative analysis of Ghana-Ivory Coast and Kenya-Somalia

Maritime boundaries are man-made constructs which are critical to resources like oil and gas, fisheries as well as trade. Recently, these delimitations in the sea have also gained importance in the environmental discourse because the role of the sea has become scientifically more significant in the field of climate change. Drawing upon the disciplines of international law of the sea and political science, this study scrutinizes the causes that underpin the peaceful settlement of a maritime delimitation dispute between two states. This thesis delves into maritime border disputes in Africa. It aims to examine the question “why do some states resolve their marine border disputes while others do not” by opting for a qualitative approach to compare two cases: Ghana--Ivory Coast and Somalia--Kenya. It outlines how the governance of the sea through UNCLOS is important, differences as well as similarities between land and sea border issues, and then delves into wider political connotations that impact the resolution of maritime borders issues between countries. Using the issues framework, it tests the hypothesis: the more the number of security issues between two states, the less the likelihood of the resolution of maritime border issue between them.

Význam Arktidy v mezinárodních vztazích / The Importance of the Arctic in International Relations

In recent years several factors changed the importance of the Arctic in international relations. Firstly, the rapid melting of Arctic ice cover opened potential access to vast natural resources within the Arctic Ocean seabed. It is estimated that the Arctic may contain one quarter of world's undiscovered reserves of oil and gas. Secondly, the water ways along the Russian and Canadian northern coasts became ice-free, although so far just for few days every year. Should the Arctic Ocean continue to melt, then in several decades the Northern Sea Route and the Northwest Passage could become navigable for greater part of the year. This would shorten the journey distance from Europe to Asia by as much as forty percent, thereby cutting travel times and shipping costs. Finally, as the Arctic does not belong to any single country, there has been an increasing interest among the Arctic rim states, which have been working on delineating their maritime boundaries in order to ensure their territorial claims. This process has proceeded in accordance with the international legal framework as established by the 1982 United Nations Convention on the Law of the Sea (UNCLOS). A Gift of Nature and the Source of Violent Conflict: Land and Boundary Disputes in the North West Region of Cameroon The Case of BaliKumbat and Bafanji

Balikumbat and Bafanji are the names of two villages in the Northwest Region of Cameroon that have been warring against one another over Bangang, a tract of fertile land. The conflict hinges on perceived differences about who should have access to this fertile land. Both villages claim ownership. This conflict has persisted from colonial times to the present with no tangible resolution. Understanding the place of land within the political, social, and economic fabric of the lives of both villages prior to and after the arrival of the colonial administration is the centerpiece of this research endeavor. This study sheds light on why the conflict persists. The land tenure decree of 1973, which was later promulgated into Cameroon law in 1984, is the most recent attempt at resolving disputes over land. It did not resolve this conflict. A clash of cultures between the indigenous population and the European colonizers may have triggered a legacy of land conflict between these two communities. This study unravels and seeks to explain when the Balikumbat and Bafanji villages transitioned from being two loving neighbors, capable of sharing their use of and kinship to the land, to hostile enemies ready to fight and kill one another at the earliest opportunity. In this study, interviews, observations, journal intakes, field notes, as well as document reviews, are pivotal tools used in justifying the claims highlighted in the research.
