O government by policies, a constitucionalização dos direitos sociais e a crise de representatividade política têm levado os Tribunais a assumirem um papel central na efetivação destes direitos. Contudo, trata-se de um tema que necessita aprofundamento, tendo em vista as formas com que o Judiciário intervém e as implicações que provoca. Esta proposta investigativa não pretende discutir a possibilidade de existência do fenômeno, tampouco a legitimidade democrática da atuação jurisdicional. O diferencial está no enfrentamento da questão a partir da compreensão dos limites da capacidade operacional do sistema jurídico, na análise interdisciplinar de políticas públicas e na demonstração empírica de seus impactos. Pretende-se, assim, examinar se o padrão de funcionamento judicial é adequado e válido para substituir o crivo político-administrativo e lidar com todos os elementos necessários da implementação da política pública e, além disso, se mostra-se consciente do conjunto de processos que constituem uma política pública. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The objective of this study is to analyze the capacity of the Judiciary to deal with issues related to public policies of pharmaceutical assistance, as well as to examine the distributive efficiency that this social right has been promoted. The governments by policies, constitutionalization of social rights and crisis of the political representation have led the Courts to play a central role in the realization of these rights. However, this is a subject that needs to be deepened, considering the ways in which the Judiciary intervenes and the implications that it causes. This investigative proposal does not intend to discuss the possibility of existence of the phenomenon, nor the democratic legitimacy of the judicial action. The differential lies in confronting the issue by understanding the limits of the operational capacity of the legal system, the interdisciplinary analysis of public policies and the empirical demonstration of its impacts. The aim is to examine whether the standard of judicial functioning is adequate and valid to replace the political-administrative sieve and to deal with all the necessary elements of the implementation of public policy. In addition, we intend to analyze if the Judiciary is aware of the set of processes that constitute a public policy. Finally, we verify the distributive effects of the judicial decision, based on a qualitative documentary research, in order to evaluate if the judicialization assists the most vulnerable and reduces social inequalities or reverses the distributive logic. Orientador: Célia Maria David / Banca: Sheila Fernandes Pimenta e Oliveira / Banca: Nanci Soares / Resumo: O presente estudo trata da prática profissional do assistente social na área da educação, realizada em duas Creches no Município de Franca, no período compreendido entre os anos de 2010 e 2011, recorte temporal ora proposto, merecendo destaque o caráter interdisciplinar da atuação. Tem como objetivo compreender, através da análise da prática profissional dos assistentes sociais na educação infantil, como esta atuação foi construída pelos mesmos e percebida pelos diversos sujeitos - funcionários das Creches - familiares das crianças atendidas - profissionais de serviço social que atuam nas Creches do município. Objetiva-se ainda caracterizar os serviços desenvolvidos pelos assistentes sociais que atuam nas Creches; realizar uma análise crítica das ações desenvolvidas; identificar novas possibilidades de ações profissionais e, enfim, contribuir, através da pesquisa, com os assistentes sociais e demais profissionais que se interessam pela atuação profissional da área da educação. Para o cumprimento de tais objetivos, busca sustentação nos pressupostos da pesquisa qualitativa e utiliza como recurso metodológico a pesquisa bibliográfica, documental e de campo. Diante de tais procedimentos, foi possível a descrição e a problematização de todos os serviços desenvolvidos pelas assistentes sociais junto à educação infantil. Mediante a realização da pesquisa de campo, com a colaboração de vinte funcionários das duas Creches pesquisadas ( educadoras e coordenadoras), nove famílias das crianças atendidas, além de cinco profissionais de serviço social que atuam na educação infantil. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The present study deals with the professional practice of social workers in education, held in two Creches in the city of Franca, in the period between the years 2010 and 2011, the proposed time frame, with emphasis on the interdisciplinary nature of the action. Aims to understand, through analysis of the professional practice of social workers in child education, as this work was built by them and perceived by different individuals - employees of Services - families of children served - social service professionals who work in Nurseries in the city . Another goal is to characterize the services developed by social workers who work in Nurseries, performing a critical analysis of the actions taken, identify new opportunities for professional actions, and ultimately contribute, through research with social workers and other professionals who are interested the professional experience of education. To fulfill these objectives, seeks to support the assumptions of qualitative research as a methodology and uses a literature review, document and field. With such procedures it was possible the description and the questioning of all the services developed by social workers with child rearing. Upon the completion of fieldwork, with the collaboration of twenty officials from both Nurseries surveyed (educators and coordinators) nine families of children served, and five social service professionals working in early childhood education. Integration Institution, Family and Community, information on rights, concern for the historical and socio-economic children appear as strengths of the performance of Social Service on the findings of the survey. Though a popular and somewhat controversial topic in discussions on language in IB, the notion of English as a (business) lingua franca/(B)ELF still lacks clear conceptualisation. This paper argues that research in IB and linguistics can be mutually complementary and supportive in conceptualising BELF, and that it is important to separate the concept of BELF from that of a common corporate language. The paper synthesises key works from both disciplines to conceptualise BELF as an emergent, multilingual use of English that adapts to the demands and resources of the specific context. It further argues that Wenger's concept of Communities of Practice offers a useful bridge between the disciplines, and that there is a need for more empirical research.

Orientador: Ana Maria Ramos Estevão / Resumo: A situação das crianças e adolescentes ameaçados ou violados em seus direitos básicos, em Franca, não é diferente da maioria das cidades brasileiras. Há ainda um longo caminho a ser percorrido no sentido da proteção integral, no entanto, os passos que já foram dados servem de experiência acumulada para os próximos. O resgate histórico da construção da política voltada à criança e ao adolescente em Franca, mais do que um registro desta experiência - que traz características comuns a outros municípios, visto que faz parte de uma totalidade, mas que também contém traços particulares - pretendeu verificar e demonstrar como são percebidas as contradições no âmbito municipal e no cotidiano de quem lida com esta realidade de perto. Mais do que compreender este universo, o presente estudo procurou investigar se existem possibilidades de contribuir - por parte daqueles que têm a oportunidade de participarem da elaboração das políticas sociais - com a efetivação dos direitos e não, ao contrário, com a efetivação da dominação, atenuando os conflitos sociais decorrentes das precárias condições de vida a que se encontram submetidas as classes subalternas. Utilizamos metodologia qualitativa, entrevistando alguns dos sujeitos que participaram e/ou participam de alguma forma na elaboração da política voltada à criança e ao adolescente na cidade de Franca e realizamos observação participante no Conselho Municipal dos Direitos da Criança e do Adolescente e no programa "Rede Criança/Adolescente" (da prefeitura municipal). Juntando as vivências, as percepções, as interpretações, os conhecimentos, é que conseguimos identificar os desafios, mas principalmente, as possibilidades de atuação através da política social a favor, enfim, das crianças e adolescentes. / Abstracts: The situation of children and adolescents threatened or violated in their basic rights in Franca is not different from the most of the brazilian cities. There is a long way to pass through in the path of total protection, however, the steps that have been given serve as accumulated experience for the next ones. The historic of the political construction turned to the child and adolescent in Franca, more than just a register of this experience - what brings common characteristics to other cities, seen as part of a totality, but even have particular lines - pretend to verify and demonstrate how the contradictions are understood in the municipal field and the daily of a person who nearly deals with this reality. More than to this universe, the present study tried to investigate if there are possibilities to contribute - for the ones who have the opportunity to participate at the social politics elaboration - with the effective rights of the domination, diminishing the social conflicts originated from the life contradictions in wich the subordinated from the life contradictions in wich the subordinated classes are submitted. We use qualitative methodology, interviewing some people who have participated or are still participating in any way children and adolescent in the city of Franca and we do participant observation at the Municipal Consil of the Children and Adolescent Rights and at the "Child/Adolescent Net" (from the Municipal Aty Hall) Adding the existences, the perceptions, the interpretations, the knowledge, we can identify the challenges, but mainly, the possibilities of acting through social politics in favor of, at last, the children an adolescents. / Doutor

As áreas de livre comércio – ALC – são zonas de benefícios tributários cujo principal objetivo é a promoção do desenvolvimento de regiões mais carentes. A área de livre comércio de Boa Vista, juntamente com a de Bonfim, foi a última a ser implantada, no ano de 2008, e seus impactos são analisados por meio de questionário aplicado a empresas de Boa Vista, com o objetivo de compreender seu grau de satisfação, os entraves e perspectivas da ALC-BV. Para tanto, foram entrevistadas 53 empresas, que representam 3,22% do universo de empresas de Boa Vista cadastradas e habilitadas na SUFRAMA, situação necessária para que as empresas tenham acesso aos benefícios da ALC. A análise da amostra apresenta que 69,81% dos entrevistados afirmam ter benefícios da ALC para sua empresa. Desses, a avaliação acerca dos incentivos mais significativos para a empresa, em ordem decrescente foi: PIS/COFINS, ICMS, IPI e Imposto de Importação. Dentre os principais entraves, os entrevistados destacaram: poucos incentivos da prefeitura e do governo; custo de transporte elevado; escassez de mão de obra especializada; ausência de porto alfandegado, dificuldade de desembaraço da fronteira com o estado do Amazonas, dentre outros. Acerca do grau de satisfação, a maioria indicou Média Satisfação (39,62%). Apesar disso, uma quantidade significativa dos entrevistados (28,30%) afirmou não ter obtido qualquer redução de preços dos produtos adquiridos. A resposta seguinte mais selecionada foi a de que os preços dos produtos adquiridos reduziram de 10,01 a 15% (26,42% das respostas). A pesquisa também indicou que grande parcela dos empresários não conhece os benéficos da ALC voltados à importação (45,28%) e desconhece benefícios a indústria (83,02%). Haja vista a perspectiva de crescimento e desenvolvimento, esses conceitos, bem como aspectos sobre impactos de desoneração fiscal, desigualdade regional no processo de desenvolvimento e dos ganhos do comércio internacional, dentre outros, são abordados nesse estudo. / The free trade areas are tax benefits institutes whose main objective is to promote the poor regions‟ development. The free trade area of Boa Vista, along with the Bonfim‟s, was the last to be deployed, in 2008, and its impacts are assessed through a questionnaire applied to companies of Boa Vista, in order to understand the satisfaction degree of businesses, barriers and perspectives of ALC of Boa Vista. For these reasons, we interviewed 53 companies, which represent 3.22% of the universe of companies registered and entitled Boa Vista in SUFRAMA, a situation necessary for companies to have access to the benefits of the ALC. The sample analysis shows that 69.81% of respondents say that their companies do have ALC‟s benefits. From this number, the assessment about the most significant incentives for the company, in descending order was: PIS/COFINS, ICMS, IPI and Import Tax. Among the main obstacles, respondents highlighted: few incentives for municipal and government; high shipping cost, shortage of skilled labor, lack of bonded port, difficulty in clearing the border with the state of Amazonas, among others. About the degree of satisfaction, the majority indicated satisfaction Average (39.62%). Nevertheless, most respondents (28.30%) said they had not obtained any reduction in prices of products purchased. The next most selected response was that the prices of purchased products reduced from 10.01 to 15% (26.42% of responses). The survey also indicated that a significant number of entrepreneurs do not know the benefits of targeted ALC imports (45.28%) and unknown benefits to industry (83.02%). Taking into account the perspective of growth and development, these concepts, as well as aspects of impacts of tax relief, regional disparities in development and the gains from international trade, among others, are addressed in this study.

Nesse sentido as experiências de Repúblicas em Franca podem ser apreendidas a partir das especificidades da propaganda republicana no município. Isso ocorre a partir do ano de 1880, quando a propaganda republicana ganha força no município de Franca, concomitantemente com a fundação do Partido Republicano de Franca e da participação do município nos Congressos Republicanos. Apesar de Franca e freguesias apresentar um contingente republicano pouco numeroso – se comparado com outras cidades como Campinas, Amparo, Botucatu, Piracicaba, Rio Claro - é possível a identificação de experiências de Repúblicas implícitas nas relações – que muitas vezes estavam arraigadas em interesses políticos partidários – entre republicanos e os indivíduos que compunham as fileiras do partido Conservador e Liberal, indicando também o “terreno” político em que as idéias republicanas eram propagadas no município, bem como a adesão de parte da elite dirigente ao regime republicano no final dos anos 80. Diante disso, as experiências de Repúblicas no município de Franca estiveram presentes nos debates que envolveram a crise do Brasil- Império. Por intermédio do jornal O Nono Districto a elite dirigente e intelectual - a maneira dos grupos que compunham a geração 1870 - debateu os temas que evidenciavam esse momento de crise: federação, separação Igreja do Estado, instrução pública, abolição da escravidão, imigração. Ao debater essas questões, O Nono Districto também se preocupou em apontar soluções para a superação da crise. Além disso, O Nono Districto se atentou em questões de cunho mais pragmáticas que visavam o progresso do município, como a autonomia municipal defendida nas páginas do jornal. A analise que o jornal faz da... / In spite of their small number and customers in the city of Franca by the end of 19th century, the republicans were always very active concerning both their participation in the Francana political life and in the propaganda of their ideas. Therefore, they resort to the press. However, from 1887 on, with the intensification of the republican propaganda in the city of Franca, the political scene of apparent stability which involved both monarch parties taking turns in the local power was transformed. The consequences of these alterations were felt in the rearticulation of the political power around the Republic, when setting the groups which would walk in opposite sides in the local politics as a result of diverse interests. This paper aims at analyzing the republican idea in the city of Franca as well as what the influence of the republican propaganda was to the alternation of the local political scene in the last years of the Empire, which brought about series of political resistance in Franca in the first years of the Republic – the creation of the Catholic Party in 1890, the great division of the PRP in 1901 and the monarch rebellion in 1902 – which were only gotten around in 1906, with the political “reconciliation” carried out by PRP

Optou-se por estudo da organização Indústria de Calçados Kissol Ltda,utilizando da investigação qualitativa, grupo focal e posterior análise de conteúdo. Conclui-se que embora os limites determinados pelo cenário contemporâneo em que o trabalho aliena, explora e desvaloriza o potencial humano a pesquisa de campo forneceu dados que indicam caminhos de possibilidades para o Assistente Social e demais profissionais que atuam na área organizacional a construção de propostas socioeducativas e interdisciplinar inovadoras que permitem ao trabalhador e à trabalhadora compreenderem o contexto organizacional no novo modelo de produção, ampliarem conceitos e conhecimentos do cotidiano e gerar mudanças nas diversas dimensões da vida. Revelou, também, formas viáveis para enfrentar concretamente o ritmo das mudanças decorrentes do processo de globalização. / The study of viable ways to specifically face the dimension socio-educational in the interior of the Shoe Industry in Franca- SP, using the existent contradictions of work-education relation and breaking its domination circle is a most relevant political task and turns out to be a great challenge to be collectively assumed by workers and other professionals committed with their interests. To reflect on the alternatives and possibilities of viability of professional projects committed with the working class, as well evaluate the researcher’s daily practice on professional performance are the pretension of this paper. The researcher is aware that these objectives are ambitious, once the worker, by selling his work force for less than necessary for his needs, submit him/herself to the domination exercised within the capital-work relation. It was chosen the study of the organization Indústria de Calçados Kissol Ltda, making use of quality investigation, focused group and posterior content analysis. It was concluded that although the limits determined by the contemporary scenery in which work alienates, exploits and devalues the human potential, the field research provided data that indicate ways of possibilities for the Social Assistant and other professionals that work in the organizational area, the construction of innovative socio-educational and interdisciplinary proposes that allow the worker comprehend the organizational context in the new production model, widen concepts and daily knowledge and make changes in the various dimensions of life. It revealed, also, viable ways to specifically face the rhythm of changes due to the globalization process.

A pesquisa procurou, ainda, descrever a influência da Internet na vida profissional/acadêmica dos mesmos. Trata-se de um estudo descritivo, de natureza quantitativa, entre docentes e discentes das quatro instituições de ensino superior de Franca, cuja amostra foi composta por 94 professores (que ministravam aulas nas séries finais) e 512 alunos dos últimos anos dos cursos de graduação elencados para esta pesquisa. Os dados foram coletados através de um questionário elaborado especificamente para este fim, aplicado no período de agosto a novembro de 2004. Os resultados mostraram que a totalidade dos professores possui computador por necessidade profissional e a grande maioria faz uso dele diariamente (85,11%). Quase 80% usam o computador em suas casas e os softwares mais buscados são editor de texto (86,17%) e Internet (85,11%). Os maiores percentuais de utilização apontam 91,49% para e-mail, 88,30% pesquisas e 75,53% notícias. Consideram a internet relevante para o contexto social como um todo, principalmente para a economia e a globalização. Quanto à importância da Internet para a vida pessoal e profissional, os docentes reconhecem grandes mudanças, notadamente em relação à agilização na busca de informações, de conhecimentos e na facilitação do trabalho com os alunos. Quanto aos alunos a pesquisa mostrou: cerca de 80% possuem computador, sendo que 64,65% o utilizam há mais de 4 anos e 19,73% entre 2 e 4 anos. Eles buscaram o computador por necessidade... / The purpose of thisresearch was to get to know the relation that teachers and stuidents of the academic community of upper education in Franca, State of Sao Paulo, have with the Internet as a communication instrument, information. Knowledge acquisition, such as the importance wich attribute this tool all the society. The research seeked to describe the Internet influence at the professional/academic life of them. It take care for a descript study, of quantitative nature, between professor and learners from the four upper level institutions of Franca, wich the sample was composed by 94 teachers (that supply the final series classes) and 512 senior students from graduation courses chosen to this research. The given were collected through a specific questionnaire elaborated for this, diligent at the period of August to November 2004. The results shows that the professors totality, hold computers as a professional necessity and most of them uses it daily (85,11%) almost 80% uses the computer at home and the most searched software is the text editor (86,17%) and Internet (85,11%). The biggest perceptual of utilization shows that 91,49% for e-mails, 88,30% researches and 75,53% news. Internet is considerate relevant to the social context in all, specially to the aconomy and globalization. As to the importance of the internet for personal and professional life, the professors recognize the big changes remarkable to the search of information agilization, knowledge and work with students facilities. The historic of the political construction turned to the child and adolescent in Franca, more than just a register of this experience - what brings common characteristics to other cities, seen as part of a totality, but even have particular lines - pretend to verify and demonstrate how the contradictions are understood in the municipal field and the daily of a person who nearly deals with this reality. More than to this universe, the present study tried to investigate if there are possibilities to contribute - for the ones who have the opportunity to participate at the social politics elaboration - with the effective rights of the domination, diminishing the social conflicts originated from the life contradictions in wich the subordinated from the life contradictions in wich the subordinated classes are submitted. We use qualitative methodology, interviewing some people who have participated or are still participating in any way children and adolescent in the city of Franca and we do participant observation at the Municipal Consil of the Children and Adolescent Rights and at the Child/Adolescent Net (from the Municipal Aty Hall) Adding the existences, the perceptions, the interpretations, the knowledge, we can identify the challenges, but mainly, the possibilities of acting through social politics in favor of, at last, the children an adolescents.
