Culpabilidade no direito penal: a ilusão do poder agir de outro modo a partir do problema do livre-arbítrio

Varjão, Alan Jefferson Santos 26 February 2014 (has links)
We have here a theoretical research that intends to question the concept of culpability, in other words, the idea of being able to act otherwise considering the problem of free will. We argue that the concept of culpability is legitimized by a libertarian sense of free will in the common sense that has no empirical basis. Thus, given the impossibility of proving the existence of free will, we affirm that the criminal law cannot justify punishment on desert. Despite the compatibilist appearance, the idea of being able to do otherwise is supported implicitly by a libertarian point of view. In other words, the judgment of disapproval is justified by an untenable notion of freedom. The idea is to demonstrate that the way people see free will is an illusion because the assumptions that sustain it are false. In support, we use arguments of some philosophers and discoveries of neuroscience. From them, we demonstrated that the only way out of culpability is the normative presumption based on an a priori concept of average man. Besides false free will, the culpability brings a sense of moral realism that cannot be sustained in the face of some discoveries of neuroscience. In the background, we showed the evolution of criminal law as a systematic construction and the role played by culpability in the criminal dogmatic system. With the denial of the normative concept, we analyzed the functionalism of Claus Roxin and Gunther Jakobs, and also the theory of utilitarianism by deterrence.

Lidbeck, Max, Bielsten, Henrik January 2016 (has links)
This bachelor thesis studies the relationship between people who play games and fictive game characters and how they can be affected by feelings of guilt. The purpose of the thesis is to describe guilt as a feeling and how game creators could take advantage of the way people relate to it to achieve stronger bonds between the players of the game and the fictive characters in it. To examine the problem area a game production was conducted in which our knowledge about feelings of guilt were used to design and develop a game scenario meant to generate guilty feelings in the player and in extension strengthen the bond between him/her and a fictive game character. This production was then tested on respondents and the results were compiled alongside reflections on how feelings of guilt could be used as a tool in future game productions.

Vyrovnávání se Německa s minulostí (s aplikací na německo-české vztahy) / German coping up with history (application on German-Czech relations)

Macálková, Eva January 2010 (has links)
This diploma thesis deals with reflecting of the World War II in consciousness of the contemporary German generations, which have no direct experience of the period in question. The aim is to answer the question of whether there still persists a feeling of "collective guilt" for the crimes perpetrated on the other nations, especially on the Czech nation. The thesis thus defines a concept of guilt, and follows the public discussion and interpretation of history in Germany at the present time, as well as in the post-war period. For this purpose, it observes the official German policy, activities of civil society and public by means of media, literature and cultural and educational activities. The thesis also analyses historical facts of the post-war period in Germany and development of German-Czechoslovak/Czech relations and their importance for the contemporary German interpretation of history.

The Best Medicine

Lechler, Ron 05 1900 (has links)
The Best Medicine is an animated documentary that explores the true stories behind the live performances of stand-up comedians. The film juxtaposes live stand-up performances with candid interview footage combined with animation and illustration. Three subjects– Michael Burd, Casey Stoddard, and Jacob Kubon– discuss alcoholism, childhood abuse, and sexual anxiety, respectively. Their candid, intimate interviews reveal personal information, creating a new context with which to understand live stand-up comedy performance. This illustrates themes of finding humor in dark or painful circumstances and the cathartic nature writing and performance.

Fahrlässige Mittäterschaft und Schuldprinzip

Ko, Myoungsu 05 January 2021 (has links)
This study critically analyzes the various ideas for negligent co-perpetration and concludes that this legal idea is not convincing. The main part of this study is to analyze that negligent co-perpetration lacks justification based on the guilt principle, which is the foundation of the entire criminal justice system, although negligent co-perpetration could be established, since this does not violate the prohibition of analogy. And the desirable solution for cases of neg-ligent cooperation is concretely presented.: To advance the accusation of negligence in ac-cordance with the nature of the criminal negligence and the guilt principle. The criminal negligence is based on the single concept of perpetrator and the psychological contribution could establish the illegality of behaviour. In order to apply this solution, the illegality of neg-ligent behavior must always be proven. Then there is no need for negligent co-perpetration.

Rollerová, Ivana January 2018 (has links)
This thesis focuses on intricate and complex phenomenon of guilt. It does it by comparing two different approaches: approach of prophetic literature and social crisis literature. Both approaches are taught on Protestant Theological Faculty in Charles University of Prague but each of them is based on different presupposition. The first is theological, based on ancient thought of Israeli spiritual authorities, the second is modern, based on social work and it cooperates with psychology, sociology, anthropology but also theology and philosophy. Aim of this thesis is to enter the problematics and professional discussion about guilt through these two different approaches on the one hand and to compare and evaluate them on the other hand.

LET’S TALK ABOUT SEX GUILT: THE IMPACT OF RELIGION ON SEXUAL GUILT, RELATIONSHIP SATISFACTION, SEXUAL SATISFACTION, AND SEXUAL ATTITUDES AND BEHAVIORS IN CHRISTIAN WOMEN

Sydney S Vander Tuin (10756281) 10 May 2021 (has links)
Sexual guilt can occur when one's beliefs or attitudes about sex do not match with their sexual behaviors. Sexual guilt has been studied in the context of religious individuals, but research has produced inconsistent results (Hackathorn et al., 2016; Higgins et al., 2010; Leonhardt et al., 2019; Murray et al., 2007). Through a survey placed on Mturk, this study used 156 participants for data analysis. Data analysis consisted of five regressions. This study found that religiosity and relationship satisfaction are positively associated, sexual guilt and relationship satisfaction are negatively associated, sexual guilt moderated the relationship of religiosity and relationship satisfaction, conflict between sexual attitudes and behaviors was associated with lower relationship satisfaction, religiosity and sexual satisfaction had a positive association, sexual guilt and sexual satisfaction had a negative association, sexual guilt had a moderating effect on religiosity and sexual satisfaction, conflict between attitudes and behaviors was associated with more sexual guilt, and religiosity was found to be positively associated with sexual guilt. This study relates these findings to past research and posits future directions for this field of study.
