La protection internationale du travailleur migrant / The international protection of the migrant worker

La protection des travailleurs migrants est au cœur de l’actualité internationale. En effet, la mondialisation a relativisé la notion d’espace, et malgré la réticence des Etats à ouvrir leurs frontières à la circulation des personnes, les migrants représentent aujourd’hui 3% de la population mondiale, et les travailleurs migrants et les membres de leur famille 90% du nombre total de migrants. L’objet de cette étude est de s’interroger sur la manière dont le droit international protège les travailleurs migrants, et sur l’émergence d’un statut international à leur profit. Le traitement des travailleurs étrangers reste une question politiquement sensible, comme l’atteste le faible succès de la Convention des Nations Unies sur la protection de tous les travailleurs migrants et des membres de leur famille de 1990. Par ailleurs, la circulation internationale des personnes ne fait, sauf quelques rares exceptions, l’objet d’aucune concertation internationale. Pourtant les droits des travailleurs migrants, traditionnellement définis à partir de l’obligation internationale de traitement, vont considérablement s’étoffer grâce à une complémentarité du droit international du travail et du droit international des droits de l’homme. La complémentarité de ces matières offre également aux travailleurs migrants un nombre croissant de voies de recours dans l’ordre juridique international. Mais surtout la protection des droits des travailleurs étrangers fait l’objet d’une concertation international particulièrement dynamique, élément clé de l’effectivité de leurs droits. / The protection of the migrant workers is at the heart of the international current events. Indeed, the globalization put in perspective the notion of space, and despite the reluctance of states to open their borders to the movement of people, the migrants represent 3% of the world population today, and the migrant workers and members of their families representing 90% of the total number of migrants. The purpose of this study is to wonder about the way the international law protects migrant workers, and the emergence of an international status for their benefit. The treatment of foreign workers remains a politically sensitive question, as evidenced by the low weak success of the United Nations Convention on the Protection of All Migrant Workers and the Members of their Families in 1990. Moreover, the international movement of persons is not, with few exceptions, subject to any international consultation. Nevertheless the rights of migrant workers, traditionally defined from the international obligation of treatment will be considerably expanded through a complementarity of international labor law and the international law of human rights. Such complementarity also offers to migrant workers an increasing number of international legal remedies. But especially the protection of the rights of foreign workers is the object of a dialogue with international particularly dynamic cooperation, key element of the effectiveness of their rights.

Discute, também, a promulgação da Emenda Constitucional 72/2013 e a não equiparação entre empregados domésticos e não domésticos. Portanto, o objetivo é analisar o processo de valorização dos trabalhadores domésticos no Brasil, confrontando o estabelecimento e o cumprimento de normas legais com abertura de prerrogativas que culminam com a manutenção da desigualdade entre esses trabalhadores. Para isso, faz-se necessário um levantamento histórico associado às normas regulamentares, atentando para a conscientização e para o surgimento de novas posturas nas relações entre patrão e empregado doméstico, bem como para os entraves na prática das novas regras, os quais ferem um dos princípios da Constituição Federal que é a preservação da dignidade humana. A pesquisa foi dividida em quatro partes. A primeira seção examina a identificação conceitual dos empregados domésticos e os condicionantes que permitem o reconhecimento para classificação e enquadramento do grupo, bem como a evolução histórica do trabalho doméstico no Brasil e, ainda, traz os direitos contemplados e os não concedidos com a Emenda Constitucional nº72/2013. A segunda seção descreve a evolução histórica da classe trabalhadora dos empregados domésticos na Argentina, seus decretos leis e a nova lei que regula esses trabalhadores. A terceira retoma a discussão sobre a valorização profissional desse grupo e sobre o apoio da Organização Internacional do Trabalho e sua convenção 189, trabalhando com a importância e a dignidade desses empregados, assim como biografias e histórias de vida de mulheres ativistas à causa. / In this dissertation we analyze the struggle of domestic workers to obtaining the same rights and guarantees defined for other classes of workers that also perform paid professional activity. We discuss the proclamation of Constitutional Amendment n. 72/2013 and the no equivalence between domestic and non-domestic employees. Thus, the aim is to analyze the process of valuation of domestic workers in Brazil, confronting the establishment and enforcement of legal regulations with opening prerogatives that culminate with the maintenance of inequality among these workers. For this, a historical survey of the regulations is necessary, attempting to achieve awareness and the emergence of new attitudes in the relationship between employer and domestic worker as well as the barriers in the practice of the new rules, hurting one of the principles of the Federal Constitution which is the preservation of human dignity. The research was divided into four parts. The first chapter examines the conceptual identification of domestic workers and the conditions that allow recognition for classification and framing the group as well as the historical evolution of domestic work in Brazil and also it brings the contemplated rights and the ones not established on the Constitutional Amendment n. 72/2013. The second chapter describes the historical development of the working class of domestic workers in Argentina, its law enactment and the new law regulating these workers. The third chapter recaptures the discussion on the professional development of this group with the support of the International Labour Organization (ILO) and its Convention 189 working with the importance and dignity of these employees, as well as biographies and life-history of women activists to the cause.

Sametinget: en institutionell analys

The Saami, a Nordic indigenous people scattered over four countries, has for centuries been regarded as parts of the national populations of the countries in which they live. During the 19th century saami demands for greater influence resulted en several changes, among them the founding of a Swedish Saami Council in 1993. The council became a popularly elected, representative institution with an agenda of its own, but also a public authority answerable to the government. The decision to attribute the council this twofold role was unusual and, from a certain point of view, even controversial: it makes it difficult to determine the location of the power to act in saami-related issues and the legitimacy to do so. This essay is about how the twofold role came into existence, what it leads to and how the seemingly contradictive duality is managed. It has an institutional approach with theories concerning institutions and etnicity as well as institutional change and handling of complicated and ambiguous demands. Among the theorists are Karppi, Micheletti, Jacobsson and Sahlin-Andersson. The previous two treat the possibilities and the shortcomings of the multicultural democracy. The later deals among other things with decision making and with changes in politics and public administration. The council was presented as the main solution of the problem that the Saami felt a lack of influence. However it was not welcomed by all main Saami figures. The founding of a council with a twofold role can be explained by governmental pressure at the time for a Saami Council working on governmental terms. This essay emphazises the efforts of the state to meet Saami demands without losing influence over a group long seen as a part of the national population. It is my opinion that the case of the Saami Council is an example of the difficulties in the multicultural democracy. It is problematic when a group is “given” an institution by the state, among other things because it may undermine the possibilities for the group to raise objections in future conflicts. An arena attracting attention to an indigenous people in the national politics in the way the Saami Council does is, however, of great value for the Saami. It is truly a political success resulting in a new conception of the Saami and sprung from international change and a growing urge to question the legitimacy of national borders, but also from the propagation of the concept of Sápmi. One of its consequences is critique of the twofold role and suggestions of other ways to solve the situation, not only from the Saami but also from others, e. g. a governmental report. While waiting for such changes, the members of the Saami Council have created shared frameworks of interpretation and chosen to handle the twofold role by putting stress on the popularly elected part. The structure of the Saami Council is studied through legal and other formal sources and through articles and litterature commenting the results of the structure. The results are contributions to the knowledge of the Saami political state in the Swedish society and to the knowledge of the Saami Council – a young institution harbouring many possibilities for future change. They are also ment to add to the understanding of the functioning of institutions with a built-in duality.

Byggbranschen står nu inför ett utmanande kliv i hållbarhetens riktning - att ta sig an och arbeta för en socialt hållbar samhällsutveckling. Intresset att arbeta med detta är stort hos både entreprenörer, beställare och samhället i stort. Detta bidrar till att offentliga beställare formulerar krav på socialt arbete i offentliga upphandlingar, då offentlig upphandling är ett verktyg med stor genomslagskraft som kan användas för att föra detta arbete framåt. Syftet med studien är att ta reda på vad begreppet sociala hänsyn innebär, att sammanställa vilka krav på sociala hänsyn som ställs och kommer att ställas i upphandlingar som offentliga beställare i Östergötland annonserar samt identifiera de områden som beställarna avser utveckla inom ämnet. Detta för att entreprenörföretagen ska kunna satsa på en utveckling av det område inom sociala hänsyn som kommer att vara mest aktuellt i regionen, nu och i kommande upphandlingar. Detta mynnar ut i frågeställningarna: Vad innebär begreppet sociala hänsyn? Vilka krav på sociala hänsyn ställer offentliga beställare vid upphandling? Vilka åtgärder bör entreprenörerna vidta för att leva upp till kraven på sociala hänsyn som offentliga beställare prioriterar? Genom intervjuer med beställare och entreprenörer i byggbranschen har en grund skapats för att kunna definiera begreppet sociala hänsyn som "en inkludering av alla individer i samhället oavsett kön, ålder, fysisk förmåga eller etnisk tillhörighet". Insamling av publicerade förfrågningsunderlag visar på att det fokusområde inom social hållbarhet som prioriteras idag är krav på sysselsättningsåtgärder, där fokus ligger på att inkludera individer som står utanför arbetsmarknaden. Slutsatsen är att entreprenörerna bör arbeta för att skapa fler platser i driftentreprenader och produktion, för att öka antalet sysselsatta, samt komplettera detta med bra utbildningar, handledning och stöttning. Det har även visat sig finnas förbättringsmöjligheter i beställarorganisationernas arbete med att ställa krav på sociala hänsyn, vilka, utöver svaren på frågeställningarna, presenteras i slutsatsen.

The construction companies, public clients and society have a great interest working with this. This means that public clients formulate social work requirements in public procurement, as public procurement is a powerful tool that can be used to advance this development. The purpose of the study is to identify the concept of social sustainability, to compile what requirements regarding social sustainability are made and will be made by public purchasers in Östergötland, and identify the areas that the public purchasers intend to develop. This enables construction companies to focus on developing the area of social sustainability that will be most relevant in the region, now and in future procurements. Through interviews with clients and contractors in the construction industry, the overall perception of the concept of social sustainability can be described as "an inclusian af all individuals in saciety, regardless af sex, age, physical ability ar ethnicity." Through the collection of published inquiries, it was found that the priority focus on social sustainability today is a requirement for employment measures, focusing on including individuals outside the labor market. The conclusion is that the construction companies need to create more jobs in production, to increase the number of employed and supply them with good education, introduction and support. It has also been shown that there can be a couple of improvements in the work of the public purchasers claiming social sustainability.

Emotional display in argument, storytelling and teasing:a multimodal analysis

Abstract This dissertation studies emotional displays in talk-in-interaction, especially focusing on conversational argument, storytelling and teasing. The aim is to understand how verbal expressions, prosodic cues, and embodied actions interact with each other in emotional expression. The main analytic approach and methodology is conversation analysis and multimodal interaction analysis, applied to interactional sequences from everyday conversations. The research data comes from three different video recordings and their transcripts. First, the dissertation reveals two broad types of frustration in conversational argument. The findings suggest that combined verbal and nonverbal expression of frustration involves a complex interplay of prosodic cues and embodied actions. Nonverbal expression of frustration is displayed by embodied actions alone. Second, the dissertation shows how shared joy is conveyed between storytellers and recipients in storytelling. They can achieve shared joy because the recipients express willing participation and active recipiency in two main ways: they display verbal appreciation of the story, or they join in the storytelling through laughter, smiles, head nods, and gaze exchanges. The recipients may also offer summaries or interpretations of events in the story by comparing their own experiences to events in the story. Third, the dissertation analyzes playful teasing activity, showing how teasing activity can bring about a shared experience of amusement for both teasers and their “targets.” The study argues that recipients of teasing are active contributors in the social interaction. The transient embarrassment felt by the teased participants does not prevent the exchange from reaching a shared experience of amusement. / Tiivistelmä Väitöskirja tutkii tunteiden osoittamista arkisissa keskustelutilanteissa ja erityisesti väittelyn, tarinankerronnan ja kiusoittelun kuluessa. Tutkimusmetodi on pääasiassa keskustelunanalyysi, jonka avulla tutkitaan, miten kielelliset ilmaukset, prosodiset vihjeet sekä keholliset toiminnot yhdessä tuottavat tunneilmauksia. Tutkimusaineiston muodostaa kolme videoitua keskustelua ja niiden litteraatiot. Tutkimus osoittaa arkikeskusteluissa esiintyvissä väittelyissä ilmenevän kahtalaista turhautumisen tyyppiä. Ensimmäisessä puhujat tuottavat rinnan kielellisiä ja ei-kielellisiä turhautumisen ilmauksia, toisessa turhautumista osoitetaan vain ei-kielellisin keinoin. Tuloksien mukaan edellisessä tyypissä prosodia ja keholliset toiminnot ovat monimutkaisessa vuorovaikutuksessa keskenään. Jälkimmäisessä tyypissä turhautumista ilmaistaan pelkästään keholla. Toiseksi väitöskirja osoittaa, miten jaettu ilon tunne syntyy puhujien ja vastaanottajien välisenä toimintana. Tarinankerronnassa saavutetaan ilon hetkiä, koska vastaanottajat ovat halukkaasti mukana kerronnassa ja osoittavat aktiivista vastaanottoa kahdella tavalla: he osoittavat arvostusta kertomusta kohtaan verbaalisin keinoin, tai he liittyvät kerrontaan mukaan nauramalla, hymyilemällä, nyökkäilemällä, vaihtamalla katseita keskenään, referoimalla ja tulkitsemalla kertojan aiempaa puhetta formulaatioillaan ja vertailemalla omia kokemuksiaan tarinan tilanteeseen. Kolmanneksi tutkimus analysoi leikkisää kiusoittelua, joka saadaan aikaan liioittelevilla kielellisillä ilmauksilla sekä liioittelevilla prosodisilla vihjeillä ja eleillä. Tutkimus näyttää, että kiusoittelun kohteet aktiivisesti myötävaikuttavat kiusoittelutoimintaan. He voivat olla siinä mukana liioittelevilla vastausvuoroilla, nauramalla tai toimimalla mukana pelkästään eleiden avulla. Empiirinen analyysi näyttää, että kiusoittelutoiminta tuottaa yhteisen huvittuneisuuden kokemuksen keskustelun kuluessa. Kiusoittelijan ja kiusoittelun kohteen kokema ohimenevä nolous tai kiusaantuneisuus ei estä tämän yhteisen huvittuneisuuden kokemuksen saavuttamista.

‘When is dismissal an appropriate sanction for misconduct? and who has the last say?’

Magister Legum - LLM / In this mini-thesis, I will present a historical development of the manner in which South African courts have tested the fairness of dismissals, for misconduct. South African Labour history has been marred by confusion and inconsistency in relation to the test to be adopted in determining the fairness of dismissals. This has been so, because there have been two dominant schools of thought, one referred to as the ‘own opinion’ approach, whereby the commissioner/court has the discretion to express his/her own view based upon value judgments on the fairness of the dismissal. The other approach is known as the reasonable employer test ( ‘ defer to the employer’ approach), whereby the commissioner had to defer to the decision of the employer, unless the dismissal is one that no reasonable employer would impose, or is so excessive that it would shock one’s sense of fairness, then the commissioner may interfere.This thesis will reveal the inconsistency that has been caused, by these two approaches, and the South African courts dissent as to the approach consistent with our law. This dissent, as shall be shown in this thesis, has led to our courts contradicting themselves as to the test consistent with the law.There will be a critical discussion on the source of the reasonable employer test and its application in South Africa during the Labour Relations Act 28 of 1956 ( old LRA ) and the Labour Relations Act 66 of 1995 ( new LRA). With a further discourse on the development of the ‘own opinion’ approach during the periods of both the old LRA and the new LRA.This will lead to me looking at the provisions of the South African Constitution, together with the meaning of the right to fair labour practice as provided in the Constitution. Based upon a critical analysis of past jurisprudence, the provisions of the ILO Convention, the provisions of the old LRA and new LRA, foreign law and the Constitutional imperatives, I will attempt to illustrate the approach most consistent with our law.This thesis will culminate with a critical analysis of the Supreme Court of Appeal’s judgment, in the case of Rustenburg Platinum Mines Ltd vs Commission for Conciliation, Mediation and Arbitration and the ruling of the Constitutional court in Sidumo and Another v Rustenburg Platinum Mines Ltd and Others.The purpose of providing this historical journey, is to further highlight the rulings of past judgments, that have developed the concept of fairness, as was consistent with the Constitution. It is envisaged that the body of judgments cited in this thesis, may be used as authority, whenever the issue of determining the fairness of dismissal for misconduct arises, before a court or tribunal, such as the Commission for Conciliation Mediation and Arbitration(CCMA). It is may further be used by employers and employees, in obtaining clarity of the law in relation to the test for fairness of dismissals for misconduct.

Controlling Social Sustainability in the Apparel Industry : A qualitative study of how Scandinavian apparel companies control social sustainability in their supplier networks

The apparel industry is one of the first industries being criticized and publicly shamed for not taking enough social responsibility for the workers in their supply chain. Today, most of the apparel production takes place in developing countries such as Bangladesh, China, Cambodia and Vietnam. Social issues in the apparel supply chain are often related to health and safety, minimum wages, overtime, child labor and the lack of freedom of association. Controlling these social issues is difficult since the apparel companies and their suppliers are geographically and culturally separated. Furthermore, the production of apparel takes place in countries with weaker legal frameworks not being strict enough to protect the workers' rights. Hence, the apparel companies face major challenges in controlling the fulfillment of international standards from the International Labor Organization and United Nations. There is a lack of research on the topic related to social sustainability practices in the supply chain and researchers state that it requires more attention, by focusing on how companies' code of conducts (CoC) and international standards can be used more effectively in the context of sourcing and social responsibility. To address the research gap, the purpose of the study is to understand how brand-owning apparel companies in Scandinavia control social sustainability in their supplier networks. Based on those findings, we will compare the relation between the empirical data and what theories and international standards illustrate as critical aspects for controlling social sustainability. In the study, we have conducted semi-structured interviews with seven Scandinavian apparel companies. Since social sustainability can be a sensitive topic for companies to share information on, we have also conducted an interview with Nina Wertholz, working at the non-profit organization Fair Action, providing a different perspective. By using a thematic analysis, two main themes have been identified that together answer the research question, namely control measures and factors affecting control. Firstly, control measures relate to what the companies' control consists of and our findings demonstrate risk assessments, code of conduct, audits, and measurement as the main tools. Still, we conclude that these control measures are not sufficient to control social sustainability in the supplier network. Secondly, factors affecting control can explain the outcome of controlling social sustainability. Findings advocate that a good collaboration, providing support and a shared interest can facilitate a higher degree of control. Additionally, our findings shows that companies with smaller order quantities have less influence and control over their supplier's social sustainability practices. We also infer that the number of suppliers and which countries the companies choose to source from will affect the obtained level of control. Furthermore, decisions regarding the supplier base and the sourcing country are active choices made by the companies. Lastly, we conclude that the companies' purchasing behavior can affect the level of control related to wages, incomes, and overtime for the workers in the apparel supply chain.
