Tendo superado, ao menos do ponto de vista normativo, a política indigenista integracionista, com o reconhecimento expresso dos direitos dos índios à sua organização social, usos, costumes e tradições. Importa esclarecer que os direitos indígenas estão relacionados a uma tripla dimensão: aqueles que são diretamente produzidos pelos povos indígenas enquanto expressão da suas organizações sociais, políticas e culturais, aqueles que estão reconhecidos pelo Estado, no âmbito de sua sistemática jurídica, e aqueles que aparecem como produto do contato/ interação/ confronto entre os dois primeiros (Souza Santos, 1987). Apesar das demandas envolvendo indígenas estarem, majoritariamente, relacionadas aos conflitos de direitos coletivos territoriais, a pesquisa na jurisprudência do Supremo Tribunal Federal (STF), no Superior Tribunal de Justiça (STJ), no Tribunal Regional Federal da 1ª região (TRF1) e na Justiça Estadual de Mato Grosso do Sul (comarcas de Dourados, Amambaí e Ponta Porã), demonstra que há um significativo uso de instrumentos processuais demandando um posicionamento sobre a extensão e limites dos direitos indígenas, sejam eles sociais, econômicos, culturais e/ou territoriais, fazendo do judiciário campo privilegiado para as pesquisas empíricas sobre os sentidos da justiça e a efetivação dos direitos dos povos indígenas, a partir dos paradigmas de garantia da diversidade cultural e do pluralismo jurídico. ______________________________________________________________________________ ABSTRACT / ONHEMOIRÕ: the judiciary forward to indigenous rights, seeks to translate from an empirical and interdisciplinary dimension, the position that the judiciary has taken on the rights of Indigenous Peoples, considering the 25 years of paradigm shift in the relationship between the state and Indigenous Peoples inaugurated by the Constitution of the Federative Republic of Brazil 1988 ( CF/88 ). Having overcome, at least from a normative point of view, the Indian policy integrationist, with the explicit recognition of indigenous rights to their social organization, customs, mores and traditions. It is hereby clarified that indigenous rights are related to a triple dimension: those directly produced by the indigenous people as an expression of their social, cultural organizations, policies, and those that are recognized by the State, within its systematic legal, and those that appear as a product of contact / interaction / confrontation between the first two ( Souza Santos , 1987). Despite claims involving indigenous are, mostly, related to conflicts of territorial collective rights, research in the jurisprudence of the Federal Supreme Court ( STF ), the Supeior Court of Justice ( STJ ), the Federal Court of the 1st Region ( TRF1 ) and State Court of Mato Grosso do Sul (Dourados, Amambaí and Ponta Porã), demonstrates that there is significant use of procedural instruments requiring a placement on the extent and limits of indigenous rights, be they social, economic, cultural and / or territorial making the judiciary privileged field for empirical research on the meanings of justice and the realization of the rights of indigenous peoples, from paradigms ensuring cultural diversity and legal pluralism.

A questão em destaque se pergunta pelas composições históricas, ecológicas e políticas que permitiram o ressurgimento dos Anacé e a consecução dos grandes projetos na Costa do Pecém. São empregados os conceitos de ―composições‖, de Saskia Sassen, e de ―níveis de integração‖, proposto por Gustavo Lins Ribeiro. A pesquisa etnográfica foi realizada entre janeiro e julho de 2012 nas vilas indígenas de Bolso, Matões e nas sedes municipais de São Gonçalo do Amarante, Caucaia e Fortaleza. _______________________________________________________________________________________ ABSTRACT / The aim of the dissertation is to report and analyze two polical processes: the resurgence of the indigenous denomination Anacé – that began on the west coast of Ceará, in 1998 – and the installation of the Complexo Industrial e Portuário do Pecém (CIPP). We propose a historical and ethnographic examination of relations between political segments involved in these two processes on the assumption that both the large scales projects impacted indigenous reelaboration of the political agenda, as the indigenous movement itself promoted changes in policies and infrastructural project. The issue in question is highlighted by the historical, ecological and political compositions that allowed the resurgence of Anacé and achievement of major projects on the coast of Pecém. The concepts of "compositions" of Saskia Sassen and the concept of "levels of integration" proposed by Gustavo Lins Ribeiro. The ethnographic research was conducted between January and July 2012 in villages of Bolso, Matões and in the cities of São Gonçalo do Amarante, Caucaia, and Fortaleza.

O Conselho é uma arena para rituais políticos e discursivos, envolvendo grupos étnicos, segmentos sociais da sociedade nacional, grupos de interesse internacional e transnacional. O que permite, também, discutir a noção de comunidade de comunicação interétnica e sua pertinência para a compreensão de instituições políticas com estatuto e objetivo de tratar os conflitos socioambientais e interétnicos. Para tanto, apresento uma etnografia desse espaço político sob o prisma dos seus ritos (reuniões, intercâmbios, oficinas e outros eventos) nos quais se busca analisar os atos de fala e performances dos distintos atores e personagens sociais (famílias, comunidades, instituições, povos, nações e Estado) no enfrentamento de questões éticas e morais relativas à (des)configuração dos territórios sociais e seus conflitos socioambientais. Dentre estes destacaram-se pelo menos três: a sobreposição dos artefatos socioculturais tais como terras indígenas (Nukini e Naua) e uma unidade de conservação (PNSD), bem como das diferenças entre a ocupação tradicional indígena e a dos entes fundiários do Estado; o processo de reassentamento ou transferência das 522 famílias (para Projetos de Assentamento localizados fora do Parque), compostas por segmentos sociais de seringueiros, pequenos agricultores da floresta, pequenos e médios criadores de gado; e, por último, os conflitos entre os conservacionistas estatais versus os não-governamentais, com relação ao processo de elaboração de termo(s) de compromisso(s), exigido(s) por lei (SNUC) para que o Estado, via seus aparelhos, firme compromissos com os povos habitantes das entranhas e beiradões do PNSD, estabelecendo-se, segundo os hermeneutas da lei, uma nova condição de estatuto jurídico para suas ações. __________________________________________________________________________________________ ABSTRACT / This text deals with the Consultatory Council of the Serra do Divisor National Park (PNSD), conceived as a concrete phenomenon that is the subject/object of investigation of anthropological observation and reflection. It is an arena that produces political and discursive rituals that involve ethnic groups, social segments of national society and international and transnational interest groups. This allows for a discussion of the notion of an interethnic community of communication and its pertinence for the understanding of political institutions which deal with socioenvironmental and interethnic conflicts. I present an ethnography of this public space from the optic of its rituals (meetings, exchange visits, workshops and other events) in order to analyze the speech acts and performances that distinct social actors (families, communities, institutions, peoples, nations and the State) use in confronting the ethical and moral issues regarding the (dis)configuration of social territories and the subsequent socioenvironmental conflicts that this produces. Among these conflicts, three are analyzed here: the superimposition of sociocultural artifacts of Indian Lands (Nukini and Naua) and protected areas (PNSD), along with the differences between traditional indigenous occupation and that of the land tenure forms of the State; the process of relocation or transference of 522 families (from the área of these protect area to another land), composed of rubber tappers, small-scale farmers who live in the forest, and small- and medium-scale ranchers; and the conflicts between governmental and non-governmental conservationists with regard to the process of developing the terms of reference, required by law (SNUC), needed by the State to sign agreements, via its agencies, with the peoples that live within the National Park, thereby establishing, according to interpreters of the law, a new legal status for its actions.

As delimitações da Reserva Raposa Serra do Sol decorreram como fruto de trabalhos de pesquisa relativa à presença histórica de índios das etnias Macuxi, Taurepang, Ingarikó e Wapichana na região do rio Branco, em meio a colonizadores portugueses, holandeses, espanhóis e ingleses que passaram ao longo dos séculos desde o descobrimento da América. O processo que levou à demarcação da reserva no ano de 2005 foi, além de demorado, extremamente complexo devido aos interesses políticos e econômicos naquela área, que abarcaram desde a esfera local até uma rede internacional de contatos entre organizações da sociedade civil. A ameaça à soberania nacional, no que concerne a demarcação de ‘forma contínua’ daquela reserva e não em ‘ilhas’, foi uma bandeira constantemente levantada pelos atores nacionalistas das esferas regional e nacional, contrapondo o peso da ascensão das minorias étnicas na agenda internacional e, por conseguinte, a influência internacional nos assuntos internos do Estado, sobrevindo efeitos nos campos social, econômico e político. O tema estudado termina por abarcar o mérito da discussão em questões contemporâneas relacionadas a globalização, etnia e poder. _______________________________________________________________________________ ABSTRACT / The object of this study is the historic analysis on the evolution of the Brazil’s northern frontier, emphasizing contemporary questions aiming to provide an actual systemic vision of the occupation process in the Amazon, with the kernel in the demarcation of the Indian’s Area Raposa Serra do Sol. The delimitations of this area was due a research work related to the historic presence of Macuxi, Taurepang, Ingarikó and Wapichana Indians in the region of Branco River, among Portuguese, Dutch, Spanish and English settlers along the centuries since America’s discovery. The process that led the demarcation of the Indian’s area in 2005 took a long time and was extremely complex due to political and economic interests on that area, as it covered from the local sphere an international net of contacts between civil organizations. The threat to the national sovereignty, concerning to the demarcation in ‘continuous shape’ of the Indian’s area and not in ‘islands shape’, was an argument constantly argued by the nationalist actors of the regional and national spheres, against the international influence in the State internal subjects related to the ethnical ascension in the international scene and the arisen effects product of the changes in the systemic forces that influence the social, economic and political fields. This historic study is linked to the discussion about contemporary questions related to globalization, ethnics and power.

Traditional knowledge and legal regime of access and benefitsdistributionThis work highlights interests around traditional knowledge access of local and indigenous communities stressing the need to establish institutions involved in order to give an efficient legal answer within the political, scientific and economic framework. The author critically reviews ideas developed about this issue among international, regional and local spheres formulating the thesis of application of customary law, in particular about prior informed consent and benefits-sharing. Without disregard present conflicts management and those envisaged in the near future, implications and scenarios where State and international organizations determination must face this subject are addressed. / La ponencia pone en evidencia los intereses entorno al acceso a los conocimientos tradicionales de las comunidades indígenas y locales y marca la necesidad de definir los institutos en juego para dar una respuesta legal eficiente en el marco político, científico y económico. Pasa revista, críticamente, a los conceptos que han sido desarrollados entorno de la temática en los ámbitos internacionales, regionales y locales, y desarrolla la tesis de la aplicación del derecho consuetudinario en especial en lo atinente al consentimiento fundamentado previo y la distribución de beneficios. Sin desdeñar el tratamiento de los conflictos planteados, y los que se avizoran en un inminente futuro, se abordan las implicaciones y escenarios en los que la determinación de los Estados y de los organismos internacionales han de enfrentar en la materia.

Con un pie en dos mundos: Programas de educación bilingüe para niños quechuahablantes en el Cusco

Moving between two worlds: integrating interculturality in bilingual educationprograms in Cusco, PeruMany indigenous children in Peru are disadvantaged from birth, a situation which is exacerbated by the many deficiencies in the provision of educational services to rural communities. The Ministry of Education and non-governmental organizations are working together with teachers and community members to implement programs whose goal is a truly intercultural bilingual education. This study presents theresults of a research project which compared two rural schools: one follows the state curriculum; the other, more promisingly, works at the community level with the aim of preparing the children to move with confidence between the two worlds which make up the Peru of today. The study shows promising results in the experimental school in the use both of Spanish and of Quechua by the students. / Muchos niños indígenas del Perú viven en desventaja desde su nacimiento, con notables insuficiencias en la provisión de servicios de educación para las comunidades rurales. El Ministerio de Educación y grupos no gubernamentales están trabajando con maestros y miembros de comunidades rurales para implementarprogramas que se aproximan más a la visión de una educación intercultural y bilingüe. Este trabajo presenta los resultados de un proyecto de investigación que comparó dos escuelas rurales: una sigue el programa educativo estatal; la otra, más prometedora, funciona en el nivel comunitario con la meta de preparar a los niños y niñas a movilizarse con confianza entre los dos mundos que forman el Perú de hoy. El estudio muestra resultados prometedores en la escuela experimental, tanto en el manejo del castellano como del quechua de los estudiantes.

Indigenous peoples, cultural diversity and the right to self-determination: from the international law to the Latin American constitutionalism / Pueblos indígenas, diversidad cultural y el derecho a la autodeterminación: desde el derecho internacional al constitucionalismo latinoamericano

Indigenous peoples have valuable ancestral cultures and makeimportant contributions to society in general. However, despite the recognized value of these peoples and their cultures, their most basic rights have been violated for a long time. The postcolonial era did not end the internal«colonization», because in many places the locals are still treated as inferior to the other inhabitants within the territory of the Country. Nevertheless, the international law is moving in the opposite direction, recognizing the dignityand the rights not only of individuals but also of indigenous peoples, ensuring cultural security. In recent decades, relevant international  instruments have been adopted, inspiring the constitutional reforms and human rights initiatives for the protection of indigenous peoples. This article aims to investigate how the legal recognition of self-determination of the indigenous peoples contributes to the protection and promotion of their culture. On that matter, the first section of the paper concentrates on the conceptual discussion on indigenous peoples, as well as the legal-political relationship models between them and the State. Second, the rights of the indigenous peoples will be examined from the perspective on international law, with special emphasis on the collective self-determination right. In the last section, the Latin American Constitutions will be studied, in order to present the situation of the indigenous self-determination in Latin American. / Los pueblos indígenas poseen culturas ancestrales valiosas, las cuales hacen importantes contribuciones a la sociedad en general. Sin embargo, a pesar del valor reconocido de estos pueblos y de sus culturas, sus derechos más esenciales han sido violados por largo tiempo. La era postcolonial no puso fin a la «colonización» interna, ya que en muchos lugares los nativos siguen siendo tratados como inferiores a los demás habitantes del territorio del Estado. No obstante, el derecho internacional se mueve hacia la dirección opuesta, ya que reconoce la dignidad y los derechos no solo de los individuos, sino también de los pueblos indígenas, lo que les garantiza seguridad cultural. En las últimas décadas, se han adoptado instrumentos internacionales relevantes, que inspiraron las reformas constitucionales y las iniciativas de derechos humanos para la protección de los pueblos indígenas. Este artículo tiene como objetivo investigar cómo el reconocimiento legal de la autodeterminación de los pueblos indígenas contribuye a la protección y promoción de su cultura. A tal efecto, la primera sección del documento abordará la discusión conceptual sobre los pueblos indígenas, así como los modelos de relación jurídico-política entre ellos y el Estado. En segundo lugar, los derechos de los pueblos indígenas serán examinados desde la perspectiva del derecho internacional, con especial énfasis en el derecho colectivo de autodeterminación. En la última sección, las constituciones de América Latina serán estudiadas, con el fin de presentar la situación de la libre determinación indígena en Estados de América Latina.

In Spanish Colonial America, as well as in the Iberian Peninsula at the same time, different jurisdictions intertwined in the same space. By way of consequence, the complex political organization of the New World was composed, at the local level, by the Indian and Spanish Councils, the doctrines, and the provincial structures called corregimientos. Although the officials of those institutions received precise instructions, in which the Spanish Crown defined and limited their functions, tensions were common between the Indian governors, the clergymen, the Spanish Councils’ officeholders, and the Spanish provincial magistrates, or corregidores. The present article will analyze a series of lawsuits that occurred in sixteenth century Yucatan and in which those authorities were implicated, in order to highlight not only the nature of the jurisdictional conflicts, but also the modalities of their resolution at stake in the Spanish Empire’s courts of justice. Special emphasis will be put on the jurisdiction of the Maya Councils with the objective of better understanding the scope of indigenous agency in Spanish Colonial America. We argue that the local control on the one hand, and the legal representation on the other, were key elements in these processes. / Al igual que en la península ibérica, en la América colonial se superpusieron distintas jurisdicciones en el mismo espacio, de modo que el complejo entramado político del Nuevo Mundo estaba conformado, a nivel local, por los cabildos indígenas y españoles, las doctrinas y los corregimientos. Aunque los representantes de aquellas instituciones recibieron detalladas instrucciones en las que la Corona española definía y limitaba sus funciones y prerrogativas, fueron frecuentes las tensiones entre los gobernadores indígenas, los alcaldes ordinarios, los curas beneficiados y los corregidores. A partir de una serie de pleitos en los que estuvieron involucradas estas autoridades, el presente trabajo analiza tanto la naturaleza de los conflictos jurisdiccionales que tuvieron lugar en el Yucatán del siglo XVI como las modalidades de su resolución en los foros de justicia de la Monarquía hispana. Se presta especial atención a la jurisdicción de los cabildos mayas con el fin de esclarecer el alcance de la participación indígena en el sistema político del Imperio hispánico. Consideramos que el control local, por un lado, y la representación legal, por otro, resultan fundamentales para comprender aquellos fenómenos.

From the sample, 272 were women and 292 were men with an average age of 23.06 years. To measure beliefs scale was developed consisted of 50 Likert reagents to assess stereotypical beliefs toward indigenous people. Factor analysis threw five main factors. Results show that the scale has adequate psychometric qualities, including reliability and validity. / El objetivo de este estudio fue diseñar y validar una escala para la identificación de creencias estereotípicas hacia las personas indígenas, como un grupo estigmatizado socialmente, culturalmente relevante para muestras mexicanas, en estudiantes universitarios, estableciendo diferencias entre hombres y mujeres. Participaron 564 estudiantes universitarios de Mérida, la capital, y del interior del estado de Yucatán, México. Fueron 272 mujeres y 292 hombres con una edad promedio de 23.05 años. Para medir las creencias estereotípicas hacia las personas indígenas se elaboró una escala conformada por 50 reactivos tipo likert. El análisis factorial arrojo 5 factores. Los resultados evidencian que la escala cuenta las características psicométricas adecuadas, en cuanto a confiabilidad y validez.

This review aims to comment the content of the publication “Tribal Peoples for Tomorrow’s World” by Stephen Corry through a critical view and academic perspective. The knowledge of indigenous groups is of vital need in the South and Central American context because of the important amount of indigenous population that lives in these countries.  Only in Peru, four million indigenous people were counted in the last national census. Stephen Corry’s book is relevant because it provides a general outlook about the history and contemporary problematic of indigenous people and tribes. However, the lack of references to lay the foundations of his arguments is noticeable, making them seem superficial, extremely general and subjective in occasions. Even so, this book might prove to be a rich starting point for those who are interested in knowing more about indigenous people, using it as a non-academic guide and reference material on general culture about the subject. It is written in simple, emotive style, easy to read and with potential to contribute to the propagation of knowledge about these human groups and their past and present quandry, which is not unrelated to those of other human groups. / Esta reseña busca comentar el contenido de la publicación Pueblos indígenas para el mundo de mañana, de Stephen Corry, a través de una mirada crítica y desde una perspectiva académica. El conocimiento de los pueblos indígenas es de vital importancia en el contexto sur y centro americanocentroamericano, debido a la importante población indígena de estos países. Solo en el Perú habitaban en el 2007, 4 millones de personas de origen indígena, según el censo del Instituto Nacional de Estadística e Informática (- INEI). El libro de Stephen Corry es relevante porque aporta un panorama general sobre los pueblos indígenas, su historia y problemáticas contemporáneas. Sin embargo, consideramos que en ocasiones la aproximación hacia los hechos llega a ser muy general y subjetiva, quedando en lo superficial por la falta de referencias. A pesar de ello, este libro puede ser un punto de partida interesante y rico para aquellos interesados en conocer más sobre los pueblos indígenas, constituyéndose en una guía no académica y de cultura general sobre el tema. Está escrito en un lenguaje sencillo y de fácil lectura, con capacidad de alcanzar a más lectores y contribuir al conocimiento de la problemática que atraviesan estos pueblos ahora y a lo largo de la historia, que no está separada de la problemática de otros grupos humanos.
