Managing Intellectual Property and Licensing: A Study on Cooperative Research Centres

This thesis examines the perceived importance by two-tiered management of Cooperative Research Centres (CRCs) for managing a range of intellectual property issues. Fifty survey items are presented to the executive directors and commercialization managers of 62 CRCs. The survey items are categorized under four themes: relationships with collaborators, project management; design and implementation of agreements; and specific licensing issues. An analysis of the data, using a series of independent samples t-tests, repeated measures t-tests, chi-square tests for independence or relatedness and goodness of fit, shows a range of results. There are significant differences between executive directors and commercialization managers on a number of issues. There are particular emphases or trends about certain issues for the whole sample of managers. These findings are compared with text analyses of 23 CRC strategic planning documents. This is done in order to explore any similarity, difference or nuance between what the managers say in response to the survey items, compared with what is stated in the codified policies of the CRCs. While there is a high degree of consistency among certain themes between the two sets of findings, the overall analysis points to the need for the CRCs to have a better understanding and practice of commercialization opportunities, especially through the involvement of third party commercial interests. It is argued that accommodating third party commercialization interests involves the application of an important knowledge economy principle that has an important bearing on the future economic viability and competitiveness of the CRCs.

Reliability of the COntext Assessment for Community Health (COACH) tool when administered on mobile phones versus pen-paper: A comparative study among healthcare staff in Nairobi, Kenya.

Aim: To investigate the reliability of the COntext Assessment for Community Health (COACH) tool on mobile phone versus pen-paper in Nairobi, Kenya. Background: One of the barriers to the progress of the MDGs has been the failure of health systems in many LMICs to effectively implement evidence-based interventions As a result of the “know-do” gap, patients do not benefit from advances in healthcare and are exposed to unnecessary risks. Better mapping of context improves implementation by allowing tailoring of strategies and interpretation of knowledge translation. COACH investigates healthcare contexts for LMICs and has only been used on pen-paper. With 5 billion mobile phone users globally, mobile technologies is being recognized as able to play a formal role in health services. Methods: Comparative study with 140 nurses/midwives and doctors in four hospitals in Nairobi. 70 were randomly assigned to mobile phone and pen-paper each. The tool was administered twice with a two week interval and test-retest reliability, internal consistency and interrater reliability were assessed. Findings: Excellent test-retest reliability for both pen-paper and mobile phone (ICC >0.81). 45% (pen-paper) and 34% (mobile phone) moderate agreement between individual questions in round 1 and 2. Acceptable average Cronbach’s alpha (>0.70). Conclusion: Both mobile phone and pen-paper were reliable and feasible for data collection. The findings are a good first step towards using COACH in Kenya. Additional research is needed for individual settings. Using mobile phones could increase healthcare facilities’ accessibility in implementation research, helping to close the “know-do” gap and reach the SDGs.

Assistance de l’enseignement de la conception architecturale par la modélisation de savoir-faire des référents

Dans une époque de changements des moyens de représentation et communication en architecture, cette recherche porte sur l’enseignement de la conception architecturale et plus spécifiquement sur l’apport que l’informatique pourrait avoir dans ce processus. En nous basant sur une méthodologie qualitative, exploratoire et participative, nous y procédons par enchainement de questions, celle de départ étant la suivante: Comment l’enseignement de la conception architecturale pourrait tirer avantage des moyens numériques? Notre objectif est de proposer des méthodes et des outils d’apprentissage aux étudiants en architecture pour enrichir leurs démarches de conception grâce à l’ordinateur. Après une revue de la littérature dans le domaine, et un approfondissement de l’étude sur le rôle des référents architecturaux et sur la conception intégrée, nous avons procédé à une observation exploratoire du travail des étudiants en atelier d’architecture. Ces premières étapes de la recherche ont permis de dégager des discordances entre les positions théoriques et la pratique en l’atelier, pour concrétiser ultérieurement la question de recherche. Dans le but de discerner des méthodes efficaces et innovatrices pour répondre aux discordances identifiées, nous avons engagé une étude de la littérature sur les théories cognitives par rapport aux connaissances, l’apprentissage et la conception. Certaines stratégies ont pu être définies, notamment la nécessité de représentation multimodale des référents architecturaux, l’importance de représenter le processus et non seulement le résultat, ainsi que l’avantage d’inciter les étudiants à travailler dans leur ‘zone proximale’ de développement. Suite à ces recherches, une méthode d’enseignement complémentaire a été définie. Elle propose aux étudiants des explorations de l’objet en conception basées sur la manipulation des savoir-faire architecturaux. Cette méthode a été opérationnalisée d’un point de vue pédagogique ainsi que didactique et mise à l’épreuve auprès des étudiants en atelier. Un prototype de librairie de référents architecturaux interactifs (LibReArchI) a été créé dans ce but. Elle a été conçue en tant qu’environnement de conception et espace de partage de savoir-faire entre étudiants et enseignants. Les principaux résultats de cette recherche démontrent le rôle positif de la méthode proposée pour le transfert des savoir-faire architecturaux lors de l’apprentissage en atelier. Son potentiel d’assister la conception intégrée et de stimuler l’émergence d’idées a été constaté. Au niveau théorique, un modèle d’un cycle du processus de design avec le numérique a été esquissé. En conclusion, des avenues de développements futurs de cette recherche sont proposées. / Conducted in a period of transition in the representation and communication strategies in architecture, the present research focuses on architectural design teaching and especially on the contributions of digital means to this process. Based on a qualitative methodology, including participative and exploratory approaches, this research evolved around a progression of questions, the first one being “How could architectural design teaching take advantage of digital technologies?” Our objective was to define computer-assisted teaching methods and digital devices that could enrich the students’ design methods. A starting point of the research was a comprehensive literature review of the domain, including in-depth studies of the role of architectural referents in the design learning process, as well as of the integrated design approaches. The findings from these theoretical studies were then confronted with evidence from observations of the students’ design processes when working on a small architectural task. This revealed some discrepancies between the theoretical positions and the teaching practices in the digital architectural studio. The research question was precised in consequence, in order to address them. Specifically, the present research proposes efficient and innovative methods for resolving the discrepancies between theory and teaching practice, based on cognitive aspects of the underlying processes. Focusing on theories of knowledge, learning and design process, we were able to identify some pertinent cognitive strategies for attaining the objectives of this research, namely the necessity for multimodal representation of referents, the importance of representing the process and not only the result, as well as the advantage of motivating the students to work in their ‘zone of proximal development’. As a result of these studies, a complementary design teaching method was defined. It incites the students to perform design explorations based on manipulations of architectural know-how during the conceptual phase of the project. Pedagogic and didactic strategies for the implementation of this method were developed. A prototype of a library of interactive architectural referents (LibReArchI) was created in order to enrich the students’ ‘design space’ and to serve as shared resource between students and tutors. The main results from this research show a positive role of the proposed design teaching method for architectural know-how learning in the digital studio. It was found that this method has the potential to assist some integrated design strategies and to stimulate the generation of ideas. At the theoretical level, we propose a model of one cycle of the conceptual process when performed with digital means. In conclusion, some limitations of the research are mentioned and perspectives for its future development are drawn.

Pilotage de la transmission des compétences et des savoir-faire par le manager de proximité comme facteur de développement et de performances socio-économiques / Driving the transmission of skills and know-how by the middle-manager as a factor of development and socio-economic performance

Les transferts de compétences et de savoir-faire (TC / TSF) dans les organisations revêtent un enjeu stratégique pour leur survie-développement et nécessitent donc une préparation minutieuse ainsi qu’un pilotage rigoureux afin d’apporter toute leur valeur ajoutée.La première partie explicite les fondements conceptuels et méthodologiques de la recherche et présente les terrains d’investigation et d’expérimentation de nos hypothèses et outils. Elle présente les enjeux liés aux transferts de compétences et de savoir-faire à partir de l’analyse des entretiens réalisés, des dysfonctionnements et de leurs coûts cachés de régulation. Nous étudions l’importance de la définition d’une politique de TC / TSF par la direction ainsi que les rôles et les pratiques des ressources humaines dans le pilotage des compétences et de leur transfert.Dans la deuxième partie, nous étudions le rôle-clé détenu par le manager de proximité, de par sa position stratégique dans l’organisation et ses pratiques managériales, dans le pilotage et la mise en œuvre de la politique de transfert de savoir-faire, ainsi que dans le suivi et le développement des performances individuelles et collectives. Nous étudions aussi les impacts socio-économiques des actions de TC / TSF et du pilotage de ces actions par les managers de proximité. Enfin, nous proposons le concept de manager de proximité-développeur en nous appuyant sur les évolutions du management au cours du XXème siècle, sur le concept de formation intégrée et l’importance de la pédagogie. Nous proposons des outils de management pour permettre aux managers de proximité de mieux piloter les TC /TSF. / The transfer of skills and know-how (TS/TKH) in organizations are of strategic importance for their survival and development and therefore require careful and rigorous control to provide any added value preparation.The first explicit conceptual and methodological research foundations and has lots of investigation and experimentation of our assumptions and tools part . It presents the issues related to the transfer of skills and know-how from the analysis of interviews, dysfunctions and their hidden regulatory costs. We study the importance of the definition of a policy of TS / TKH by management and the roles and practices of human resource skills management and transfer.In the second part, we study the key role held by the manager of proximity, its strategic position in the organization and management practices in the management and implementation of the policy of transfer of know -how, as well as in the monitoring and development of individual and collective performance. We also study the socio -economic impacts of actions TS / TKH and control these actions by local managers. Finally, we propose the concept of proximity manager - developer relying on the evolution of management in the twentieth century, the concept of integrated training and the importance of education. We offer management tools to allow local managers to better manage the TS / TKH.

智慧財產權管理策略研究-以模具業及其關連高科技產業為例 / Study on Strategy of Intellectual Property Rights Management: Taiwan Mold and Die Industry and Its Related High-tech Industry

台灣模具產業具有交期短、品質好、價格具有競爭力、製程安排彈性大等優勢,因此在高科技產業供應鍊中扮演關鍵性的角色。唯近年來,台灣許多高科技產業的外移,造成模具業產值最近連續三年呈現下降與核心技術外流,成為模具業所面臨的嚴重考驗。如何留住核心技術人才,加強研發新的關鍵技術並將研發成果取得智慧財產權相關法律保護,並以必要的組織、制度、人才、措施等妥善加以管理,已經成為模具業以及關連高科技產業必須面對的重要課題之一。 本研究以策略管理的角度切入,探討由策略前提所形成之策略,與智慧財產權管理實際運作下,對「台灣模具業及其關連高科技產業的智慧財產權管理發展現況及當前問題」提出適當建議與解決之道。 研究對象為台灣五家經營績效良好之模具業者及關連高科技業者。模具業者包含金屬沖壓、塑膠射出成型、與壓鑄模具業者;關連高科技業者則包含連接器、筆記型電腦、與行動電話業者。其中三家模具業者尚未擁有專利保護,而兩家關連高科技業者之專利保護已有相當成效。本研究主要發現如下: 一、不同的企業規模,對改善技術能力作法有其差異: (一)共同研發新技術:中小企業傾向與國內研發機構共同研發,並取得新技術之全部或部份智慧財產權或取得授權使用新技術;大型企業則傾向自行研發為主。 (二)自國外引進新技術:中小企業傾向委託財團法人或智財科技服務公司從技術先進國家引進技術;大型企業則傾向自行引進技術為主。 (三)向技術相對落後國家移轉技術方面: 1.中小企業傾向透過財團法人或智財科技服務公司之協助移轉技術,對於較單純之案件可自行為之。 2.大型企業可自行為之或採上述方法,委託專業之單位或公司為之。 3.台灣企業對大陸投資之子公司,大部分並未針對技術移轉收取權利金,僅由子公司之獲利盈餘分配取得回饋,尤以持股比例較大者最為普遍。 二、國內模具業及關連高科技產業智慧財產權管理現況為: (一)制定「營業秘密管理辦法」,規範各業務或利害關係人之營業秘密保護要項: 1.影響製造精度之技術 2.訪客參訪流程與動線 3.與供應商相關之營業秘密 4.顧客之營業秘密 5.矯正預防措施單 (二)制訂「專門技術管理辦法」,加強專門技術保護 1.規範「提案改善制度」 2.培養技術專家 3.掌握專門技術人力資源,塑造: (1)尊重專業 (2)對等報酬 (3)生涯規劃等制度完善之企業文化。 (三)專利管理制度: 1.建立提案與獎勵制度: 對創新提案、申請專利、專利核准、與達成技術移轉等階段均核發獎金,以鼓勵員工技術創新。 2.專利維護: 對專利佈局同時重質與量之提升,專利權之維護,則以成本效益為主要考量,以具市場價值者為優先申請與維護對象。 (四)技術授權考量有二: 1.視技術生命週期採行不同之授權策略,如導入與成長期採技術引進、成熟期採交互授權、衰退期技術則對外移轉。 2.以對子公司持股比例,調整技術移轉之權利金分配,持股較高則以盈餘分配取代權利金,持股較低則傾向依市場機制收取權利金。 由本研究之策略意涵得知,個案公司目前所採行之策略,均能適當地反映出其目前所處環境。如鴻海精密以綿密之專利佈局保護其技術,鉅祥、竣盟、谷崧則實施營業秘密與專門技術管理,神達機構則是專利保護與營業秘密管理兼具。 由此可知,模具業及關連高科技產業之智慧財產權管理作法具有多種不同之形式,專利保護並非模具業與關連高科技產業智慧財產權管理之唯一解答。尤其對中小企業而言,注重營業秘密與專門技術保護,塑造良好的企業文化、工作環境,設計合理對等報酬、制度完備的人力資源管理措施,亦不失為智慧財產權管理的良好解決方案之一。 目前大型之關連高科技企業非常重視智慧財產權,並已發展出一套以專利保護為主軸的管理制度。展望未來,模具業與關連高科技產業之連動性將逐漸加深,模具業者今後亦必須加快建立智慧財產權管理制度之腳步。 / Taiwan's mold & die industry plays a very important role of the supply chain for the high-tech industry around the world due to its advantages of short delivery time, good quality, competitive price and production flexibility, etc. However, in recent years, the continuing migration of the high-tech industry is resulting in production decreases and movement of core technology out of Taiwan. How should we keep the core technology, human and financial resources left in Taiwan; what can be done to strengthen research and development (R & D) on new and core technology; how can the core technology be protected by patents managed by a sever system. This is a matter of great urgency and an important issue that Taiwan’s mold & die industry and its related high-tech industry are facing. In view of the above, this study offers Taiwan's mold & die industry and its related high-tech industry some suggestions and solutions for the problems that they faced, based on their current Intellectual Property Rights (IPR) management development situation. This study was researched from the strategy management view and included five (5) outstanding mold & die manufacturers and their related high-tech companies in Taiwan. These mold & die manufacturers are in the metal stamping die, plastic injection mold and die casting mold industries; these high-tech companies are in the connectors, notebook computer and cellular phone (telecommunication) industries. Three of the companies, the mold & die manufacturers, do not hold any patents, while the other two high-tech companies are well protected by their patents. The main finding of this research is as follows: 1.The strategy of technical improvement for companies of various sizes is different: 1) R & D for new technology- Small and medium companies prefer to cooperate with other local R & D institutes in developing, researching, and obtaining full or partial intellectual property rights protection; or obtaining the rights to use the new technology (invention). On the other hand, large companies tend to do the R & D in-house. 2) Technology transfer from overseas– Small and medium companies prefer to transfer the technology from high-tech orientated countries through local R&D institutes or an IPR service provider. However, large companies prefer to transfer the new technology by themselves. 3) Technology transfer to developing countries– (1) Small and medium companies tend to transfer the technology to developing countries through local R&D institutes or IPR service provider except in the case of simple projects. (2) Large companies tend to transfer their technology out by themselves or through a professional agency. 2.The IPR management situation of Taiwan’s mold & die industry and its related high-tech industries– 1) Establish “Trade Secret Management Regulations” to prevent the following trade secrets from being disclosed: (1) Technology that will influence the accuracy of machining. (1)-1 On site know-how – Limiting the visitors touring sensitive areas. (1)-2 Trade secrets of suppliers. (1)-3 Trade secrets of customers. (1)-4 Corrective action reports. 2) Establish “ Know-how Management Regulations” to: (1) Regulate “Proposal improvement systems” (2) Train and develop technical specialists (3) Retaining knowledgeable human resources by (3)-1 Professional appreciation (respect) (3)-2 Equal award (return) (3)-3 Good and complete system, employees’ career planning and enterprise culture. 3) IPR management system: (1) Establish a proposal and reward system: Encourage employees’ technology inventions by rewarding them for their proposals, applications, and completion of technical transfer for IPR. (2) Patent protection: Consider not only the number of patents, but also the quality of patents. 4) Technology transfer policy Different policy for different technique life cycle. From this research, we realized that companies apply different strategies in response to their recent situation. For example, “Hong Hai” is applying the practice of IPR management in protecting his technology; G-Shank, Giant Union and Coxon are applying the practice of trade secret and know-how management; MiTac is applying the practice of both IPR management and trade secret management. From the above, we also realize that patent protection is not the only solution for IPR management in the mold & die industry and it’s related high-tech industries. Trade secret management and know-how protection, a good corporate culture, good business and human resource management, an improved working environment, reasonable and rewarding work are also the major solutions for IPR management. For the time being, large high-tech companies highly respect IPR and have developed a good management system, especially for patent protection. Therefore, due to the close relationship between the mold & die industry and high-tech industries, speeding up the development of IPR management becomes an urgent issue for the mold & die industry.

L’apport en société, technique d’exploitation des créations intellectuelles : étude à partir des droits de propriété industrielle, du savoir-faire et des noms de domaine / The contribution agreement as a technique for the exploitation of intellectual creations : study on the basis of industrial property, know-how and domain names

L'étude de l'apport en société des créations intellectuelles permet de dynamiser le schéma contractuel classique de la propriété intellectuelle reposant sur le couple cession-licence et contribue à l'analyse du mécanisme de l'apport en société. Malgré une similitude certaine avec les contrats usuels d'exploitation des biens intellectuels, l'apport des créations intellectuelles en société est une convention originale. Cette originalité se traduit par une nature et un régime hybrides. Du point de vue du droit de la propriété intellectuelle, il s'agit d'un contrat particulier d'exploitation des biens intellectuels. Du point de vue du droit de sociétés, il s'agit du contrat qui permet de mettre les biens intellectuels à la disposition de la société et de l'un des éléments constitutifs de celle-ci. Cette dualité a une incidence directe tant sur les conditions de réalisation de l'apport en société des créations intellectuelles que sur les effets de l'apport. Si le régime applicable s'appuie sur celui des contrats classiques d'exploitation des biens intellectuels, à savoir sur les règles prévues par le droit civil pour le contrat de vente et de louage des choses, il n'y a pourtant pas assimilation. D'une part, la réalisation de la convention d'apport obéit à de nombreuses contraintes dont celles résultant du droit des sociétés et du droit de la concurrence. D'autre part, l'appréhension des droits et des obligations des parties est différente. La relation entre la société et l'apporteur est imprégnée de l'intuitu personae inhérente aux biens intellectuels et de l'affectio societatis dû à la nature du contrat de société. En l'absence d'une règlementation adaptée à la spécificité du contrat, la liberté contractuelle s'exerce dans le respect des principes d'ordre public. / The study of the contribution agreement dynamizes the classic contractual scheme of intellectual property exploitation based on the pair licence- assignment and provides a detailed analysis of the mechanism of the contribution to a company. Despite a certain similarity to conventional intellectual property exploitation contracts, the contribution agreement is an original contract. This originality is reflected legally by a hybrid nature as well as a heterogeneous applicable system. Regarding intellectual property, the contribution agreement is a specific act of exploitation of intellectual goods. Regarding company law, it is the agreement which enables delivery of the intellectual goods to the company and constitutes an essential element of the company¿s constitution. This duality directly affects the conditions of contract formation as well as its effects. Although the applicable system is based on the traditional contracts of exploitation of intellectual goods, in particular the articles of civil law relating the sale and lease of tangible assets, there is no further similarity. On the one hand, the formation of the contribution agreement follows numerous constraints posed by company law and competition law. On the other hand, the understanding of the parties¿ rights and obligations differs. The relationship between the company and the contributor is imbued with the intuitu personae attached to intellectual goods as well as the affectio societatis resulting from the nature of the partnership agreement. Given the lack of regulation adapted to the specificity of intellectual property contribution agreements, the emphasis has been put on contract drafting. Such a legal deficiency must be supplemented by contractual freedom without breaking the principles of public policy.

Specifically, the present research proposes efficient and innovative methods for resolving the discrepancies between theory and teaching practice, based on cognitive aspects of the underlying processes. Focusing on theories of knowledge, learning and design process, we were able to identify some pertinent cognitive strategies for attaining the objectives of this research, namely the necessity for multimodal representation of referents, the importance of representing the process and not only the result, as well as the advantage of motivating the students to work in their ‘zone of proximal development’. As a result of these studies, a complementary design teaching method was defined. It incites the students to perform design explorations based on manipulations of architectural know-how during the conceptual phase of the project. Pedagogic and didactic strategies for the implementation of this method were developed. A prototype of a library of interactive architectural referents (LibReArchI) was created in order to enrich the students’ ‘design space’ and to serve as shared resource between students and tutors. The main results from this research show a positive role of the proposed design teaching method for architectural know-how learning in the digital studio. It was found that this method has the potential to assist some integrated design strategies and to stimulate the generation of ideas. At the theoretical level, we propose a model of one cycle of the conceptual process when performed with digital means. In conclusion, some limitations of the research are mentioned and perspectives for its future development are drawn.

L'étude de l'apport en société des créations intellectuelles permet de dynamiser le schéma contractuel classique de la propriété intellectuelle reposant sur le couple cession-licence et contribue à l'analyse du mécanisme de l'apport en société. Malgré une similitude certaine avec les contrats usuels d'exploitation des biens intellectuels, l'apport des créations intellectuelles en société est une convention originale. Cette originalité se traduit par une nature et un régime hybrides. Du point de vue du droit de la propriété intellectuelle, il s'agit d'un contrat particulier d'exploitation des biens intellectuels. Du point de vue du droit de sociétés, il s'agit du contrat qui permet de mettre les biens intellectuels à la disposition de la société et de l'un des éléments constitutifs de celle-ci. Cette dualité a une incidence directe tant sur les conditions de réalisation de l'apport en société des créations intellectuelles que sur les effets de l'apport. Si le régime applicable s'appuie sur celui des contrats classiques d'exploitation des biens intellectuels, à savoir sur les règles prévues par le droit civil pour le contrat de vente et de louage des choses, il n'y a pourtant pas assimilation. D'une part, la réalisation de la convention d'apport obéit à de nombreuses contraintes dont celles résultant du droit des sociétés et du droit de la concurrence. D'autre part, l'appréhension des droits et des obligations des parties est différente. La relation entre la société et l'apporteur est imprégnée de l'intuitu personae inhérente aux biens intellectuels et de l'affectio societatis dû à la nature du contrat de société. En l'absence d'une règlementation adaptée à la spécificité du contrat, la liberté contractuelle s'exerce dans le respect des principes d'ordre public. / The study of the contribution agreement dynamizes the classic contractual scheme of intellectual property exploitation based on the pair licence- assignment and provides a detailed analysis of the mechanism of the contribution to a company. Despite a certain similarity to conventional intellectual property exploitation contracts, the contribution agreement is an original contract. This originality is reflected legally by a hybrid nature as well as a heterogeneous applicable system. Regarding intellectual property, the contribution agreement is a specific act of exploitation of intellectual goods. Regarding company law, it is the agreement which enables delivery of the intellectual goods to the company and constitutes an essential element of the company¿s constitution. This duality directly affects the conditions of contract formation as well as its effects. Although the applicable system is based on the traditional contracts of exploitation of intellectual goods, in particular the articles of civil law relating the sale and lease of tangible assets, there is no further similarity. On the one hand, the formation of the contribution agreement follows numerous constraints posed by company law and competition law. On the other hand, the understanding of the parties¿ rights and obligations differs. The relationship between the company and the contributor is imbued with the intuitu personae attached to intellectual goods as well as the affectio societatis resulting from the nature of the partnership agreement. Given the lack of regulation adapted to the specificity of intellectual property contribution agreements, the emphasis has been put on contract drafting. Such a legal deficiency must be supplemented by contractual freedom without breaking the principles of public policy.

Dans la péninsule d'Oman, le passage du Néolithique à l'âge du Bronze est marqué par de profondes transformations socio-économiques. La transition vers une économie agricole et l'intégration progressive dans les sphères d'interactions suprarégionales ont été interprétées comme la réponse adaptative des populations locales, suivant la pression de la demande extérieure pour l'acquisition de matières premières. Toutefois, le rôle de la péninsule omanaise au sein de ce réseau à l'aube de l'âge du Bronze est moins patent qu'on ne l'envisage, mettant en cause la nature des transformations déclenchées au début du 3ème millénaire av. J.-C.. Nous avons exploré ces questions à la lumière de la maisonnée, explicitement conçue en tant qu'élément structurant de la société, « sociogramme d'un système social ». Afin de circonstancier le passage vers la complexification de l'âge du Bronze, l'étude considère brièvement les dernières occupations néolithiques. Elle se focalise sur une analyse diachronique des architectures domestiques et de la culture matérielle au 3ème millénaire av. J.-C. (périodes Hafit et Umm an-Nar), évaluant les différents aspects susceptibles de fournir des informations sur la configuration des activités domestiques et de manufacture, sur la perception sociale de l'espace, sur l'organisation de la force de travail et le degré de spécialisation de celle-ci. Cette démarche a permis d'aborder les acteurs sociaux à l'échelle de l'habitat, valorisant l'importance des mutations socio-économiques amorcées localement, et exprimées par les cycles de développement de la maisonnée sur le long terme. / In the Oman peninsula, the transition from the Neolithic to the Bronze Age is marked by deep socioeconomic transformations. The shift towards an agricultural economy and the gradual integration into supraregional interaction spheres have been interpreted as the adaptive response of local populations to the pressure of an external demand for the acquisition of raw materials. Nevertheless, at the dawn of the Bronze Age, the role of the Oman Peninsula within this network is less patent than generally assumed, calling into question the nature of the transformations that characterise the beginning of the 3rd millennium BC. These questions were explored by the point of view of the household, explicitly conceived as a structuring element of the society, the “sociogram of a social system”. Aiming at better understanding of the transition towards the complexification of the Bronze Age, the study briefly addresses the last Neolithic occupations, and focuses on a diachronic analysis of domestic architectures and material culture during the 3rd millennium BC (Hafit and Umm an-Nar periods). It considers a series of different aspects that could offer insights on the configuration of domestic and craft activities, on the social perception of space, on the organisation of the workforce and their degree of specialisation. This approach allowed grasping the social actors at the village level, highlighting the importance of socioeconomic transformations originating at a local scale, and expressed by the developmental cycles of the household in the long term. In addition , new field data lead to the identification of specific chronological markers for the Hafit period and the last Umm an-Nar phase.

Studien har hämtat empiri genom semistrukturerade intervjuer med fem olika AML-chefer på den svenska bankmarknaden.  Resultat/Slutsatser: Studiens resultat visar hur AML-chefer i Sverige har en kritisk syn på penningtvätts-regelverken. Regelverken upplevs ställa höga, men rimliga, krav på bankerna. Flera fördelar med det riskbaserade förhållningssättet lyfts upp, där riskbedömning och kundkännedom ger en god överblick av verksamheten i ett bolagsstyrnings-perspektiv. Regelverken låter bankerna stänga ute de kunder som inte vill samarbeta. Tyvärr kan dessa kunder gå vidare till nästa bank och fortsätta sitt misstänksamma beteende. Detta problem grundar sig i banksekretessen som gör det omöjligt för banker att dela information och samarbeta i arbetet mot penningtvätt. By studying how Swedish AML-managers experience these regulations, this study contributes with a point of view that has not been considered in Sweden previously.  Purpose: This study aims to increase the understanding of attitudes and experience towards AML and its regulations within Swedish banks, if it differs between banks and what it could signify for involved parties.  Method: A qualitative study with an abductive research approach has been conducted. The study has gained empirical data through semi-structured interviews with five different AML managers in the Swedish banking market.  Results/Conclusions: The results of the study show how AML managers in Sweden have a critical view of the money laundering regulations. The regulations are perceived to put high, but appropriate, requirements in the banks. Various advantages of the risk-based approach are highlighted, where risk assessment and customer awareness (KYC) provide a good overview of the business from a corporate governance perspective. The regulations allow banks to end their business relationship with customers who do not want to cooperate. Unfortunately, these customers are able continue their suspicious behavior throughout different banks. This problem is based on the bank secrecy, which makes it impossible for banks to share information and cooperate in the work against money laundering. The study shows how the incentives behind compliance with the regulations are largely based on the fear of damaging reputation or receiving heavy fines. The focus has shifted from actually trying to stop money laundering, to only avoiding being subjected to money laundering themselves.
