Les contrats d'exploitation des biens immatériels : étude de droit français et marocain / The contract of exploitation of intangible property : study of French law and Moroccan law

Les biens immatériels que possèdent les entreprises, sont le plus souvent des droits de propriété industrielle ou un savoir-faire tenu secret. Leur exploitation indirecte, nationale ou internationale, s’effectue à travers la conclusion de différents contrats d’exploitation. Avec la mondialisation, ces contrats sont au cœur de l’économie moderne et constituent l’un des outils de transfert de technologie. Cette thèse propose une analyse globale des contrats d’exploitation des droits de propriété industrielle et de savoir-faire en droit marocain et en droit français. Dans la première partie, on expose leur régime général, en droit des contrats, droit de la propriété industrielle et droit de la concurrence. La deuxième partie propose une analyse unitaire de chaque type de ces contrats dans ces deux systèmes et traite leurs régimes spécifiques. / Intangible property owned by companies consists most often of the industrial property rights or a secret know-how. Their indirect exploitation, national or international, is made through the concluding of various contracts of exploitation. With the globalization, these contracts are at the heart of the modern economy and constitute one of the most important tools of technology transfer. This dissertation offers a global analysis of the various contracts of exploitation of the industrial property rights and know-how in Moroccan law and in French law. The first part of the thesis exposes their general regime under contract law, industrial property law and competition law. The second part proposes a unitary analysis, which views the problems raised by each type of these contracts in these two legal systems and treats their specific regimes.

Toute cette recherche se concentre sur le portrait en peinture comme possibilité de la rencontre, de moments d’amitié. Il s’agit d’en analyser les enjeux en utilisant la philosophie et la psychanalyse comme outils théoriques. Comprendre combien cette pratique de corps-à-corps, de présence à présence s’inscrit dans le temps, le déploie, le relate. La rencontre, tout comme ma pratique, a pour origine le désir de l’Autre. Chacune de mes peintures est une réponse à cette demande : «Comment désires-tu être peint ?». Mes pinceaux, guidés par les paroles livrées dans mon atelier, tentent de s’approcher au plus près de ce qui est dit : quête impossible !... tant le langage implique une perte, nous divise. Nous nous percevons comme uniques car nous sommes séparés de l’autre, nous sommes entourés de vide. L’autre et le vide ne sont pas seulement extériorités, ils sont en nous, et pour la psychanalyse c’est par l’imaginaire que nous trouvons notre unité. La psychanalyse, la méditation, l’alchimie et la peinture ont ceci de commun qu’elles sont toutes des disciplines construites à partir de la pratique et chacune d’entre elles aborde l’introspection à sa manière, qui peuvent s’enrichir les unes les autres. / The present research work focuses on the painted portrait and the opportunity it offers to meet people and exchange moments of friendship. It aims at analyzing what is at stakes in this process by means of theoretical tools such as psychology and psychoanalysis. It is also concerned with the understanding of how this «hand to hand» and «presence to presence» practice gets its anchorage in time and how it unfolds it and refers to it. The get together process, as well as my own practice, are the expression of desire – desire of the Other. Each of my paintings is an attempt to answer this single question: «How would the person posing for me like to be painted?». Then, as if guided by his or her wish, my brushes enter into action in order to fulfill it to the best of my abilities – the task is of course impossible, because language implies a loss and gets us apart from one another. Each of us sees oneself as unique, for we are separated from each other: we are indeed surrounded by emptiness. The Other and emptiness don’t belong to the outside, they are part of ourselves. In the field of psychoanalysis, we manage to find our unity through imagination. Psychoanalysis, meditation, alchemy and painting have all in common to be based on practice. Each of these disciplines deals with insight in its own way: in the end they all benefit from each other.

Esta pesquisa nasce do encontro do olhar-expedicionário, sempre curioso e disposto a relacionar arte e ciência, com a Paragem das Conchas - nome atribuído à primeira sesmaria do Rio Grande do Sul, que corresponde hoje a um conjunto de municípios, dentre os quais, está Osório – lugar onde se desenvolvem as incursões aqui analisadas, entre os anos de 2012 e 2016. As experiências começam no ateliê, que funciona como um jardim onde se cultiva a linguagem do desenho, até que este lugar de produção de imagens abre-se e passa a ser compreendido como um observatório da natureza, fundindo-se, ao final, com a própria floresta. A principal pergunta que surge daí é: como se dá essa relação entre o ver e o conhecer a partir das experiências fenomenológicas com a paisagem que o meu trabalho artístico (obras em desenho, poesia, fotografia, objetos e instalação) proporciona? As rotas e o instrumental utilizados para as observações foram sendo redefinidos no próprio andar, como se fosse um Caminho de Peabiru, esse conjunto de trilhas indígenas cultivadas pelos Incas, que ligavam o Oceano Pacífico ao Atlântico. No andamento, foi preciso desaprender a ver o que eu pensava saber e aprender a ver o que não sabia que existia. O conjunto de trabalhos aqui apresentados forma um atlas onde procuro transmutar essas vivências por meio da linguagem poética. A narrativa divide a expedição em três momentos: Estudos sobre a terra | Estudos sobre a água | Estudos sobre o vento. A ação de expedir é interpretada em seu sentido literal de “liberar os pés das cadeias”. A pesquisa está dividida em dois volumes. No TOMO I apresento um percurso teórico em que o sol metaforiza, inicialmente, a relação entre o ver e o conhecer e, passo a passo, vai sendo eclipsado pela imagem da fogueira, que provoca uma queima de arquivo em que é necessário transmutar as memórias. O TOMO II é um livro de artista concebido a partir das travessias por TERRA (“Inventário de Fauna e Flora” e “Herbarium”), ÁGUA (“Travessia de Beija-Flor por águas doces”) e AR (“Tipologia do Mar – Escala Beaufort” e “Tipologia das nuvens – L. Howard”). / This research was created from the meeting of the expeditionary perspective, always curious and open to connect art and science, and Paragem das Conchas - the name given to the first sesmaria in Rio Grande do Sul - which today corresponds to a few different cities, amongst them Osório - the chosen spot for this expedition, which took place between 2012 and 2016. The experiences begin in the studio, which acts as a garden to cultivate the drawing language, till this image-production site opens up to be acknowledged as a nature observatory, ultimately merging with the forest itself. The main question that arises from that is: how does the relationship between seeing and knowing from phenomenological experiences in the landscape that my artistic work (drawing, poetry, photography, objects and art installation) provides me presents itself? The routes and instruments used in the observational trips were redefined while they were happening, such as in Caminho de Peabiru, the indigenous trails created by the Incas connecting the Pacific Ocean to the Atlantic. As the project went on, I had to unlearn how to see what I thought I knew and learn how to see what I did not know existed. The body of work presented here forms an atlas where I seek to transmute those experiences into a poetic narrative. The expedition was divided between three installments: Studies of the earth | Studies of the water | Studies of the wind. “Expedition” is interpreted here in a literal sense, that of “freeing the feet from the chains.” The research is divided in two volumes. In TOME I the theoretical path is presented, initially, in a way in which the sun acts as a metaphor of the relationship between seeing and knowing and, gradually, is eclipsed by the image of the bonfire, which leads to an indispensable documentation burning in order to transmute memories. TOME II is an artistic book created from crossings through land (“Inventário de Fauna e Flora” and “Herbarium”), water (“Travessia de Beija-Flor por águas doces”) and air (“Tipologia do Mar – Escala Beaufort” and “Tipologia das nuvens – L. Howard”).

L’application du concept de développement durable à l’urbanisme suscite de nombreuses questions tant les contours de « l’urbanisme durable » et des « quartiers durables » paraissent flous. De nombreux outils ont été développés pour aider à la conception des « quartiers durables », souvent dérivés des outils de conception des bâtiments (LEED, BREAAM, HQE etc…) ; ils restent largement proposés et conduis par les Maîtres d’Oeuvre (MOE) et les Assistants à Maîtrise d’Ouvrage (AMO). Dans ce contexte, une question émerge, celle de savoir quel peut-être l’impact de ces outils sur les décisions et la conduite du projet urbain par la Maîtrise d’Ouvrage Urbaine (MOU). De plus, le projet urbain qui a pour objet la création d’un quartier ou « morceau de ville », fait appel à un large jeu d’acteurs et les questions soulevées par les outils d’aide à la conception dépassent largement le champ d’action de la MOU. Ceci posé, si le couple MOE et AMO peut « se contenter » de l’utilisation d’outils existants au regard de leurs missions respectives, la MOU, du fait de son rôle central et moteur dans le « quartier durable » a de son côté besoin de nouveaux process pour répondre aux enjeux de la durabilité posés par ces outils : comment travailler avec les différents acteurs en vue d’objectifs communs et/ou convergeants ? Se pose alors la problématique de l’évolution des méthodes de travail de la MOU au fil des opérations d’aménagement durable ; comment ne pas avoir de « pertes en ligne » et ainsi continuer à progresser entre deux opérations d’aménagements : la capitalisation des savoir-faire du « chef d’orchestre » qu’est la MOU est alors un questionnement central. / The application of the concept of sustainable development to urban planning raises many questions as the contours of "sustainable urbanism" and "sustainable neighborhoods" appear to be unclear. Many tools have been developed to help design "sustainable neighborhoods", often derived from building design tools (LEED, BREAAM, HQE etc ...); they remain largely proposed and led by the Project Managers (MOE) and the Assistants to Project Managers (AMO). In this context, a question arises, which is to know what may be the impact of these tools on the decisions and the conduct of the urban project by the Urban Contractor (MOU). In addition, the urban project, which aims to create a neighborhood or "piece of town", involves a wide range of actors and the questions raised by the Neighborhood Sustainable Assement (NSA) go well beyond the scope of action of the MOU. If the MOE and AMO couple can "be satisfied" using the existing tools regarding their respective missions; the MOU, because of its central role and driving force in the "sustainable neighborhood" is in need of new processes to meet the challenges of sustainability requested by these tools: how to work with the different actors aiming a shared vision with common and / or converging objectives? Then naturaly the problem of the evolution of the working methods of the MOU is posed: during the conduct of the neighborhood development, how not to have "losses online" and thus continue to progress between two neighborhood development: the capitalization of the know-how of the MOU starts to become the central question.

This is an explication of Lacan’s Seminar XVII. The introduction situates the Seminar in its time and in relation to other theories of discourse. In part one I examine the changes which it brings to a variety of ideas already known in Lacan’s oeuvre such as Jouissance, Master Signifier(s) and Oedipus. Part two looks the four discourses in detail after considering the positions common to each. I provide accounts of each discourse as taking place internally to a subject and between subjects. The coda examines areas where further research is possible, reviews and critiques some scholarship on this seminar and inquires into the use value of the discourse theory, both generally and as a means of getting beyond Lacan.

Europos Tarybos Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijoje įtvirtintas rinkinys teisių ir laisvių (teisė į gyvybę, kankinimų draudimas, teisė į teisingą teismą, teisė į privataus ir šeimos gyvenimo gerbimą ir kt.), taikomų kiekvienam, esančiam valstybės, ratifikavusios šią Konvenciją, jurisdikcijoje. Tačiau čia nėra išskiriamos vaikų, kaip specifinės socialinės grupės, reikalingos didesnės apsaugos, teisės. Visgi remiantis tuo, kad EŽTK įtvirtintos teisės taikomos „kiekvienam“, teigtina, kad jos taikomos ir vaikams. Šiame darbe autorė siekia atskleisti, kokios teisės yra užtikrinamos vaikams EŽTK 8 straipsnio plotmėje, taip pat tam tikrus, iš šių teisių kylančius, probleminius aspektus. Siekiant šio tikslo, ypač didelis dėmesys skiriamas EŽTT jurisprudencijai, kadangi remiantis šio Teismo praktika ne tik nustatomas tam tikrų teisių turinys ir jo kaita, bet ir atskleidžiama vaiko teisių apsaugai aktuali problematika. [toliau žr. visą tekstą] / The 1950's Convention of European Council on Human Rights and Fundamental Freedoms establishes a set of rights and fundamental freedoms (the right to life, prohibition of torture, the right to a fair trial, the right to respect for private and family life etc.) applicable to everyone within the jurisdiction of the state that ratified the Convention. Children are a very specific social group, which needs greater protection. However their rights are not distinguished in the Convention. On the basis that the rights enshrined in the ECHR are applicable to „everyone“, it may be maintained that those rights can be applicable to children as well. The author of this work aims to reveal the rights that are guaranteed for children in the context of the article 8 of the ECHR. To this end, particular attention is paid to the jurisprudence of the ECtHR. According to the case law of this Court, it can not only be determined the contents and evolution of specific rights, but also relevant problematic issues for the protection of the rights of a child can be revealed. Getting smarter music : a role for reflection in self-directed music learning

Conservatoires all over the world are re-examining their educational roles and practices in a changing cultural and economic context, including re-evaluating their function as sites of relevant learning. This dissertation by publication contributes to this re-examination by investigating understandings of assessment, evaluative reflection, the relationship between know-how and knowledge, autonomous learning, community of practice and the student experience of these pedagogies in one Queensland conservatorium. The study is presented in the form of a synopsis and five publications, with additional data that will form the basis of further post-doctoral publication. It is focused on non-traditional pedagogical processes operating within a bachelor of popular music program, processes that have been intuited by the academic teacher who is also the author of this dissertation. What these processes have in common is the philosophical rejection of teacher-led pedagogy and an insistence upon, and scaffolding of, self-directed student action and reflection. The aim of the dissertation, in keeping with the rationale for a professional doctorate, is to subject this approach to systematic theoretical and empirical scrutiny, and thereby to further refine and strengthen the practices in terms of their capacity to engage young people in self-directed approaches to quality music making. John Biggs's presage/process/product learning model (1999) provides a structure for this systematic evaluation of the pedagogical work. The study understands the learning characteristics that students bring to the program, combined with the structures and pedagogical approaches in place in the program, to be the key presage elements; the learning activities (including assessment as learning) that occur within the program are the key process elements; the key products are the learning outcomes for the students and the ongoing development of the program and pedagogical approaches informed by reflection on empirical data including data collected as part of this research. The study demonstrates the significance of recognising and valuing presage and process elements that enable students to perform from the basis of their intuitive know how while being recorded, and then apply their knowledge-based critical reflection skills to an appraisal of their own work and the work of their peers while hearing the recording played back. While not displacing the teacher as mentor and critical friend, this moves responsibility for learning to the student as a self-monitoring, strategic decision-maker about the nature and quality of their learning products. The program requirement that students write meaningfully about the process appears to encourage the embracing of both conscious and unconscious ways of knowing and doing. As a documentation of this type of teaching, the study presents an argument for a broader incorporation of student-led pedagogy into higher education in general and conservatoria in particular. It concludes that aspects of education that enhance students' abilities to learn, including self- and peer assessment, self-directed learning, reflective practice, and both independent and collaborative work that incorporates program-wide learning, are likely to enhance integrated creative practice. This project has made it possible to disseminate a scholarly engagement with such processes through publication in academic and professional contexts.

Educação de pais gestantes : uma pedagogia possível segundo o espiritismo como saber emergente e educação integral do ser humano

A presente tese se apoiou num Projeto de Pesquisa em Ação, realizada entre os anos de 2003 a 2009, objetivando investigar a possibilidade de ocorrência de uma percepção sensorial e paranormal, e de intercomunicação materno-paterno-fetal durante a gestação. Constou de um estudo investigativo, qualitativo-quantitativo, com levantamento exploratório sobre a possibilidade ou não de ocorrência de percepção sensorial-motora e alguma percepção paranormal durante o período gestacional. O estudo contou com a participação voluntária de quatro grupos específicos: Grupo Educação de Pais Gestantes da Sociedade Beneficente Espírita Bezerra de Menezes em Porto Alegre; grupo participante através de meu site na Internet; grupo da Creche da Universidade Federal do Rio Grande do Sul; e grupo de mulheres gestantes ou que já gestaram, moradoras de vilas populares da periferia de Porto Alegre. Os instrumentos de pesquisa foram: entrevistas individuais; questionários; e um Roteiro de Procedimentos para Pesquisa sobre Intercomunicação Materno-Paterno-Fetal. O aporte teórico se fundamentou na abordagem sistêmica, apoiada na epistemologia genética em uma perspectiva filosófico-científica, antropológica, geopolíticosociocultural, admitindo-se o processo histórico-dialético como fonte geradora da emergência de novos saberes. Apresento o Espiritismo como "SABER EMERGENTE" e "Fonte de SABER", contribuindo para a gênese de uma Filosofia de Educação Espírita, matriz geradora da Pedagogia Espírita e de uma POSSÍVEL Pedagogia de Educação de Pais Gestantes, propiciando a reeducação e preparação de pais gestantes ou candidatos à gestação, para o exercício vivencial da maternidadepaternidade com lucidez, autonomia e participação responsável, para a realização de uma Educação Integral, sem fundamentalismos excludentes. Os resultados da pesquisa fizeram-me constatar a possibilidade de ocorrência não só de uma percepção sensorial-motora, como também de uma percepção paranormal dos pais gestantes, em especial em relação às mães, indicando a ocorrência de uma possível "Intercomunicação Paranormal Materno-Paterno-Fetal", durante o período de gestação. O resultado parcial significativo encorajou-me a sugerir a realização de novos projetos de pesquisa que possam comprovar a Intercomunicação Paranormal Materno-Paterno- Fetal durante o processo de gestação, com as múltiplas implicações para o conhecimento da realidade psicobiofísica e espiritual do ser humano, relacionadas com a complexidade inerente à Educação Integral e suas profundas repercussões no processo dialético, histórico, filosófico-científico, antropológico, geopolíticosociocultural, ético e bioético, em permanente dinamismo cíclico e onto-epistemológicogenético. / The present thesis if supported in a Project of Research in Action, carried through enters the years of 2003 the 2009, objectifying to investigate the possibility of occurrence of a sensorial and paranormal perception, and of maternal-paternal-fetal intercommunication during the gestation. It consisted of an investigative, qualitativequantitative study, with exploratory survey on the possibility or not of occurrence of sensorial-motor perception and some paranormal perception during the gestational period. The study it counted on the voluntary participation of four specific groups: Group Education of Gestates Parents of the Beneficent Society Spirit Bezerra de Menezes in Porto Alegre; participant group through my site in the Internet; group of the Day-care center of the Federal University of the Rio Grande do Sul and group of gestats women or that already they gestural, inhabitants of popular villages of the periphery of Porto Alegre. The research instruments had been: individual interviews; questionnaires; e a Script of Procedures for Research on Maternal-Paternal-Fetal Intercommunication. It arrives in port it theoretical if it based on the systemic boarding, supported in the genetic epistemology in a philosophical-scientific, anthropological, geopolitical-sociocultural perspective, admitting the process description-dialectic as generating source of the emergency of new knowing. I present the Spiritism as "EMERGING KNOW" and "Source of KNOWLEDGE", contributing for genesis of a Philosophy of Spirit Education, generating matrix of the Pedagogic Spirit and a POSSIBLE Pedagogic of Education the Father's Gestants, propitiating the re-education and preparation of gestants parents or candidates to the gestation, for the existential exercise of the maternity-paternity with lucidity, autonomy and responsible participation, for the accomplishment of an Integral Education, without exculpatory fundamentalisms. The results of the research had made to not only evidence me the possibility of occurrence of a sensorial-motor perception, as well as of a paranormal perception of the gestants parents, in special in relation to the mothers, indicating the occurrence of a possible "Intercommunication Paranormal Maternal-Paternal", during the period of gestation. Significant the partial result encouraged to me to suggest the accomplishment to it of new projects of historical, philosophical-scientific, anthropological, geopolitical-sociocultural, ethical and bioethic research that can prove the "Intercommunication Paranormal Maternal-Paternal", during the period of gestation. Llega en puerto él teórico si basó en el embarque del sistémica, apoyado en el epistemología genético en un filosófico-científico, antropológica, geopolítico - perspectiva sociocultural, admitiendo la descripción-dialéctico de proceso como generación de la fuente de la emergencia de nueva saber. Presento el Espiritismo como "SABER EMERGENTE" y la "fuente A SABER", contribuyendo para génesis de una filosofía de la educación de Espirita, generando la matriz del Pedagogía Espirita y de un Pedagogía POSIBLE de Educación de los Padres-Gestantes, propiciando la reeducación y la preparación de los padres o de los candidatos de los gestantes a la gestación, para el ejercicio existencial de la maternidad-paternidad con lucidez, la autonomía y la participación responsable, para la realización de una educación integral, sin fundamentalismos justificativos. Los resultados de la investigación habían hecho no sólo para evidenciarme la posibilidad de la ocurrencia de una opinión del sensorio-motor, así como de una opinión paranormal de los padres de los gestantes, en especial en lo referente a las madres, indicando la ocurrencia Maternal-Paternal paranormal de un "de la intercomunicación posible", durante el período de gestación. Significativo el resultado parcial animó a mí para sugerir la realización a él de nuevos proyectos de histórico, de filosófico-científico, el antropológico, la investigación sociocultural, ética y del bioético del geo-político, que puede probar el Maternal-Paternal paranormal de la intercomunicación durante el proceso de la gestación, con las implicaciones múltiples para el conocimiento de la realidad del psicobiofísica y del espiritual del ser humano, relacionados con la complejidad inherente con la educación integral y sus repercusiones profundas en el proceso del dialéctico, en dinamismo cíclico y sobre-epistemológico-genético permanente.

São apontados aspectos estéticos do artesanato intrafamiliar e a criação do produto voltado para as vitrines das cidades. Como método, foi realizado levantamento de pesquisas sobre o tema, atuação direta com os interlocutores, realização de entrevistas e observação. Diante dos indícios verificados, utilizou-se a teoria polilógica como caminho investigativo ao considerar o artesanato exemplo de representação do conhecimento com várias lógicas, em trânsito, em constituição e envolvido em múltiplos sentidos, dos quais as artesãs puderam expor suas opiniões sobre como se veem e analisam sua prática no mundo contemporâneo. Suas falas foram organizadas de modo que revelaram aspectos significativos que envolveram a projeção, a adaptação, a exposição e a autorização do que tem sido a relação das artesãs de Mumbuca com o artesanato destinado ao mercado. Suas opiniões demonstraram pontos que tangenciam a produção do atual artesanato de capim-dourado que envolve suas relações com governo do Estado do Tocantins, designers, empresários, atravessadores e pessoas da região. Constatou-se que o artesanato de capim-dourado inserido esteticamente no mercado global, tem se reinventado pelas mãos das artesãs, ao mesmo tempo aponta problemas pela dificuldade de acesso a matéria prima, o que tem colocado em questão a continuidade da prática em Mumbuca. / ABSTRACT This thesis presents a study about the golden grass (capim-dourado) craftwork of the Mumbuca Quilombola Community, in Tocantins state, and its adaptations to design as reported by the craftswomen. Aesthetic components of the intrafamilial craftwork and product creation for the city’s window displays were highlighted. The research method included a survey of research around the theme, direct interaction with the interlocutors, interviews and observation. Given the evidence, polylogic theory (teoria polilógica) was used as an investigative path by considering craftwork to be an example of representation of knowledge with various logics, in transit, being constituted and involved in multiple meanings. Among these, the craftswomen were able to present their opinions regarding how they see themselves and analyze their practices in the contemporary world. Their talks were organized so as to reveal significant aspects that involved projection, adaptation, exhibition and authorization of that which has become the relationship between the craftswomen of Mumbuca and the craftwork produced for the market. Their opinions demonstrated points that touch upon the production of the current golden grass craftwork, which involves their relationship with the government of the state of Tocantins, designers, businesspeople, middlemen, and people from the region. It was found that golden grass craftwork, aesthetically placed into the global market, has been reinvented in the hands of craftswomen. At the same time, there are problems due to difficulty accessing the raw material, which has raised the question of the continuity of this practice in Mumbuca. / RESUMEN Esta tesis presenta un estudio acerca de la artesanía de pasillo de oro (capim-dourado) en la Comunidad Quilombola Mumbuca del Estado de Tocantins y sus adaptaciones añadidas al diseño relatadas por las artesanas. Son apuntados aspectos estéticos de la artesanía intrafamiliar y la creación del producto volcado hacia las vitrinas de las ciudades. Como método fue realizada una encuesta acerca del tema, actuación directa con los interlocutores, realización de entrevistas y observación. De acuerdo a los indicios verificados, se ha utilizado la teoría polilógica como camino investigativo al considerar la artesanía ejemplo de representación del conocimiento con varias lógicas, en tráfico, en constitución e involucrado en múltiples sentidos, de los cuáles las artesanas pudieron exponer sus opiniones sobre cómo se ven y analizan su práctica en el mundo contemporáneo. Sus hablas fueron organizadas de modo que revelaron aspectos significativos que involucraron la proyección, la adaptación, la exposición y el permiso de lo que ha sido la relación de las artesanas de Mumbuca con la artesanía destinada al mercado. Sus opiniones han demostrado puntos que tocan la producción de la actual artesanía de capim-dourado que involucra sus relaciones con el gobierno del Estado de Tocantins, diseñadores, empresarios, intermediarios y personas de la región. Se ha constatado que la artesanía de capim-dourado inserto estéticamente en el mercado global, se ha reinventado por las manos de las artesanas, al mismo tiempo apunta problemas por la dificultad de acceso a la materia prima, lo que ha puesto en cuestión la continuidad de la práctica en Mumbuca.
