The Equal Access Act: “Not the Access for All Students Except Gay Students Act”: Federal Judicial Decisions and Their Implications for School Systemsâ Policies and Practices Regarding Student Requests to Establish Gay Straight Alliance Clubs in Public Schools

To ensure an educational opportunity for every child that passes through America's schoolhouse doors, it is imperative that non-heterosexual students' educational needs are not ignored in the educational milieu (Zirkel, 2006). In the last decade or so, the desire of non-heterosexual students to organize Gay-Straight Alliance (GSA) clubs on high school campuses have been met with angst by school leaders (Duncan & Rogers, 2008). Despite the passage of the Equal Access Act (EAA) in 1984, school leaders have often denied non-heterosexual students the right to establish GSA clubs on campus, consequently resulting in these students utilizing the judicial system as the venue to assert their rights under the law (Essex, 2005). As it is imperative that educational leaders understand the legal rights of all students under their care, and make informed decisions in order to avoid costly litigation, this research focused on analyzing the Equal Access Act of 1984, federal case law, legal commentary, and historical documents, in order to track the developments of non-heterosexual students' ability to utilize the EAA to establish GSA clubs in the public schools in the United States. The study employed a traditional legal research methodology as described by Alder (1993) and Russo (1993), relying on electronic data bases and traditional legal finding tools to carry out the research. From the resulting legislation, case law, scholarly commentary, and other relevant documents reviewed and analyzed, an accurate historical perspective on the EAA as it relates to the formation of GSA clubs was constructed. In addition, the significant themes that arose from the findings were synthesized in order to offer guidance to educational leaders and policymakers when facing requests from students to establish GSA clubs on school property. Recommendations for school leaders when considering such requests from students to form GSA clubs under the EAA are provided. / Ed. D.

Psychotherapy Outcomes of Sexual Minority College Students: A Comparison of Religiously-Affiliated and Non-Religiously Affiliated U.S. Universities

This study compares U.S. university counseling center therapy outcomes of Sexual Minority (SM) students who attend religiously-affiliated compared to SM peers who attend non religiously-affiliated institutions. Using archival data from the Center for Collegiate Mental Health (CCMH), we examined psychotherapy outcomes of 4257 SM student clients.We analyzed pre-treatment symptoms and post-treatment outcomes based on differences in Distress Index (DI) scores. We used the reliable change index (RCI) to separate outcomes into four groups based on the change in distress index level: no change, deteriorating, reliably improved, recovered from pre-treatment to post-treatment. Our participants (n = 4257) attended 34 religiously and non-religiously affiliated institutions (matched by geographical location, size, and percentage of the student body that were SM and sought therapy at the college counseling center). We found that SM students at religiously affiliated institutions had lower pretreatment and posttreatment distress scores than their peers at non-religiously affiliated institutions. Furthermore, gay students across universities consistently presented with lower distress than lesbian, bisexual, questioning, or self-identifying students. However, a larger proportion of SM students at non-religiously affiliated institutions achieved a reliable change status of recovered from their presenting distress levels, while a larger proportion of SM students at religiously affiliated institutions remained in the no change category. We found a significant effect of religious affiliation and Sexual Orientation (SO) on pretreatment distress scores, F(2, 4255) = 18.395, p < .001, and posttreatment distress scores, F(1, 4255)=15.199, p = .035), with moderate effect sizes (d=.137, and .061, respectively). Our findings emphasize the importance of culturally competent and affirming practices, ensuring that interventions resonate with the varied religious and cultural experiences of SM individuals. This is not just a research endeavor; it is a collective responsibility to foster campuses that prioritize the mental health and well-being of every student.

Sexual Identity Development: Findings From an Exploratory Grounded Theory Study

Counselors and other mental health professionals lack training on healthy sexuality and sexual identity development (SID). To begin to construct a comprehensive model of SID that can be used in counseling and counselor education, I conducted an exploratory study utilizing a grounded theory approach to collect and analyze SID stories from a purposive sample of eight adults from the Dallas-Fort Worth, Texas area: four male and four female; seven White Caucasian-American and one Asian American; and self-identified as two gay, one lesbian, three heterosexual, and two sexually fluid. Participants elucidated a process model of the sexual-self that incorporated biological, psychological, social, cultural, and spiritual factors. Emergent themes included discovering, distinguishing, placing boundaries around, differentiating, and integrating the sexual-self. This preliminary model advanced a more holistic understanding of SID that counselors and other mental health professionals, educators, and researchers may find useful within their respective disciplines.

Based on the perspective of the Sociohistorical Psychology, this study aims to evaluate the ethical-political dimension of the suffering of LGBT people that are homeless and the living in of these sexualities in the streets. To this end, we used procedures that allowed us to analyze the affects that weave relations of servitude that caused suffering in the lives of these people as: understanding the construction and experience of sexuality of these persons immersed in this scenario by observations, interviews and conversations with them. Data collection was performed in a reception center in São Paulo, where eleven semi directed interviews were conducted with goers welcomed into the service. Were also described and aggregated in the discussion, information about the spatial observation of this place, as well, the field diary of the researcher's professional experiences with this population. Of the eleven interviewees, three were chosen as persons who identified themselves as lesbian, gay and transvestite. In the analysis of the information pointed to five categories of analysis inside the life trajectory of these subjects. In each of them emerged the nuclei of the meanings of suffering arising from the loss of the links, the construction process as identification of sexuality, the situations of perverse inclusion (prejudice / servitude), but also of emotions related to happiness derived from its potential viability of action. In theoretical terms the research reinforces the focus on affection, for it is that more clearly exposes how the individual is affected by social conditions. These reflections enable us to understand that the ethical-political suffering of LGBT people that are homeless comes from a trajectory of life imbued by consecutive processes of perverse inclusion, since they were socio-historically constrained to the possibilities of access to other social spaces, being designated to them the place of the abject. However, it is clear that the social networks present, parallel to the reproductive role of the dominant political affection, the possibility of becoming a relevant area to possible modifications of this scenario, through the recognition and promotion of affection in the life trajectory of these subjects. It is emphasized that psychology can contribute directly to the construction of public policies guided from the factors presented in this thesis, bringing the concept of affect as an ethical-political phenomenon to be added to the social assistance actions / A condição de se estar em situação de rua atrelada à vivência das sexualidades não hegemônicas (lésbica, gay, bissexuais, travestis e transexuais), produz situações específicas de sofrimento social pouco estudadas pela academia. Baseado na perspectiva da Psicologia Socio-Histórica, este trabalho tem como objetivo conhecer a dimensão ético-política do sofrimento da população LGBT que se encontra em situação de rua e a vivência destas sexualidades neste espaço social. Para tanto, utilizou-se procedimentos que permitiram analisar os afetos que tecem as relações de servidão geradoras de sofrimento nas vidas destas pessoas como: a compreensão da construção e vivência da sexualidade destes sujeitos imersos neste cenário, por observações, entrevistas e conversas com os mesmos. A coleta de dados foi realizada num centro de acolhida da cidade de São Paulo, onde foram realizadas onze entrevistas semidirigidas com frequentadores acolhidos no serviço. Também foram descritas e agregadas à discussão, informações acerca da observação espacial do centro de acolhida, bem como do diário de campo das experiências profissionais da pesquisadora com esta população. Dos onze entrevistados, foram escolhidos três sujeitos que se identificaram como lésbica, gay e travesti. Na análise das informações obtidas, ressaltaram-se cinco categorias de análise dentro da trajetória de vida destes sujeitos. Em cada uma delas, emergiram os núcleos dos sentidos do sofrimento advindos da perda de vínculos, do processo de construção e identificação da sexualidade, das situações de inclusão perversa (preconceito / servidão), mas também de emoções derivadas de alegria ligadas às viabilidades de suas potencialidades de ação. Em termos teóricos, a pesquisa reforça o enfoque à afetividade, pois é ela que expõe, com maior nitidez, como o indivíduo é afetado pelas condições sociais. As reflexões permitem compreender que o sofrimento ético-político da população LGBT em situação de rua advém de uma trajetória de vida permeada por consecutivos processos de inclusão perversa, já que lhes foram socio-historicamente cerceados os acessos a outras possibilidades de espaços sociais, sendo designado a eles o lugar do abjeto. Todavia, percebe-se que as redes socioassistenciais apresentam paralelamente ao papel de reprodutora da política dominante de afetividade, a possibilidade de se tornar um espaço relevante de possíveis modificações desse cenário, por meio do reconhecimento e promoção da afetividade na trajetória de vida destes sujeitos. Cette thèse de doctorat étudie les mouvements LGBT en Belgique, en France et en Espagne à travers une double comparaison (entre les cas et à travers le temps) qui intègre également les échanges et influences transnationaux et internationaux. Elle examine l’émergence et le développement de la revendication d’ouverture du mariage civil aux couples de même sexe dans ces pays, analysant les convergences en termes de contenu des demandes et de timing des mobilisations. Par conséquent, elle porte sur des convergences au niveau des mouvements sociaux, à l’inverse de la majeure partie de la littérature, qui se concentre sur les convergences de politiques publiques. Cette situation impose de construire une grille d’analyse basée sur la littérature sur les mouvements sociaux, les politiques publiques et les relations internationales (influence des normes internationales). Le développement des revendications relatives au droit au mariage a été retracé de manière généalogique depuis la fin des années 1980. La comparaison repose sur la méthode du most different systems design et un travail empirique important combinant analyse documentaire et entretiens a été réalisé. Cette thèse confirme l’importance de l’étude des échanges et des influences internationaux et transnationaux pour comprendre la politique domestique et insiste sur l’influence cruciale du réseautage transnational sur les revendications des mouvements sociaux. Elle révèle aussi quelques cas de diffusion entre mouvements sociaux et montre comment des caractéristiques et des contraintes communes peuvent inciter les mouvements sociaux à formuler des revendications similaires. Par ailleurs, les discours en faveur du droit au mariage ont été analysés avec soin. L’émergence de cette revendication a aussi été mise en perspective sur le plan historique, ce qui implique de réfléchir aux modalités de transformation des mouvements LGBT au cours des trente dernières années. Pour terminer, la notion de citoyenneté sexuelle a été interrogée et la manière dont l’accès à la citoyenneté a été posé a été examinée à partir du concept de resignification proposé par Judith Butler. This dissertation looks at LGBT movements in Belgium, France and Spain through a double comparison (between cases and through time), which also takes into account transnational and international exchanges and influences. It investigates the simultaneous emergence and development of same-sex marriage claims in these countries, examining convergences in the content of the claims and the timing of protest. Therefore, it looks at convergences at the level of social movements, unlike most of the literature, which focuses on convergences in public policies. This specific research interests implies building an analytical model based on the literature on social movements, public policies and international relations (influence of international norms). It has also required a genealogical account of the development of same-sex marriage claims in each country from the end of the eighties until now. The comparison is based on the most different systems design method, and an extensive field work combining archives analysis and interviews has been carried out. This dissertation confirms the importance of taking into account international and transnational exchanges and influences to understand domestic politics, and insists on the crucial influence of transnational networking on social movements claims. It also discloses some cases of diffusion between social movements and shows how common characteristics and constraints may induce social movements to make similar but independent decisions. Discourses in favour of same-sex marriage have been carefully analysed, and the emergence of this claim has been put into a historical perspective. This implies a reflection on the transformations of the LGBT movement over the last thirty years. Finally, this dissertation interrogates the notion of sexual citizenship and examines the specific mechanisms through which access to citizenship has been proposed, discussing Judith Butler’s concept of resignification.

Tolerance or truth? : The good, the bad and the political in the discourse of the American Family Association

This master’s thesis conducts a discourse analysis on a political organization within the New Christian Right (NCR), the American Family Association (AFA). The purpose of the study is to analyze the conditions of possibility for a politics that aims to prevent progress for LGBT rights and does so by analyzing the political terrain where operations of power produce particular and meaningful political practices. As analytical tools the study relies on a theory of the political by Ernesto Laclau and Chantal Mouffe, who together with Michel Foucault also provide an elaborate theory of power. Theoretical work by Wendy Brown provides insights into how politics can be expressed when social antagonisms are prevented from engaging in political contestation. Results of the discourse analysis trace social antagonisms in AFA discourse to a dislocation of the social where new articulatory practices have established new relationships between elements of discourse and thereby also changed the nature of social intelligibility and interaction. AFA discourse articulates family values based on the privileged signifiers of freedom, democracy and rights, which is utilized both for a separatist politics of discrimination and an inclusive politics of social assimilation. AFA discourse shows many points of antagonism and organizes an enemy in postmodernism. Freedom as a mode of governmentality conditions the political demands that are and can be made which can be traced to a hegemonic neoliberal articulation. AFA discourse challenges neoliberal hegemony through the process of separatism, yet is intimately bound to the hegemonic way of making political demands in order to gain discursive strength and legitimacy.

[pt] Existe um conflito de direitos entre homossexuais e indivíduos que seguem religiões que pregam que a homossexualidade é contrária às leis divinas e que o casamento é uma união sagrada entre um homem e uma mulher. Esse conflito foi potencializado a partir da legalização do casamento homoafetivo. Por um lado, indivíduos homossexuais têm o direito à igualdade, o que significa que não devem ser discriminados por causa de sua orientação sexual; por outro lado, indivíduos religiosos têm a liberdade de crer em determinada religião e adotar condutas que estejam de acordo com suas crenças. Dentre as situações que podem gerar conflito, três são analisadas neste trabalho: a recusa de um indivíduo religioso a celebrar ou contribuir para uma cerimônia de casamento homoafetivo, com base na perspectiva religiosa sobre o conceito de casamento; a recusa por parte de um psicólogo a atender um paciente homossexual ou casal homoafetivo, sob o fundamento de que suas crenças religiosas o impedem de manifestar aprovação em relação à homossexualidade ou auxiliar uma união homoafetiva durante o atendimento; a recusa religiosamente motivada a fornecer produtos que manifestam apoio ao casamento homoafetivo ou alguma causa LGBT. Além do estudo de doutrina estrangeira sobre o tema, são examinadas dez decisões judiciais referentes a casos concretos ocorridos nos Estados Unidos, Reino Unido e Canadá, com o objetivo de auxiliar na elucidação de parâmetros claros para a melhor resolução da controvérsia em questão, ante a razoável expectativa de que, em breve, conflitos semelhantes surgirão no Brasil. / [en] There is a conflict of rights between homosexuals and individuals who follow religions that preach that homosexuality is contrary to the laws of God and marriage is a sacred union between one man and one woman. This conflict was intensified after the legalization of same-sex marriage. On the one hand, homosexual individuals have the right to equality, which means they must not be discriminated on basis of sexual orientation; on the other hand, religious individuals have the right to believe in a religion and act according to their beliefs. This paper will examine three situations that might cause conflict: the refusal to celebrate or contribute to a same-sex wedding, because of one s religious views on marriage; the refusal to assist a homosexual patient or a same-sex couple, by a psychologist or counselor whose religious beliefs prevent them from affirming homosexuality or assisting a same-sex union; the religiously motivated refusal to print materials that promote same-sex marriage or other LGBT interests. This dissertation will look at foreign studies on the matter, and will examine ten judicial decisions on cases that occurred in the United States, United Kingdom and Canada, in order to help create clear parameters to resolve the controversy, which is likely to soon arise in Brazil.

L'objectif de cette thèse de doctorat est de montrer comment la victoire de la liberté dans le domaine matrimonial a permis à la communauté LGBT de se mettre en ordre de bataille, Etat après Etat, pour mettre fin à une citoyenneté de seconde zone, sensibiliser et éduquer les américains sur les réalités de la vie homosexuelle, marquée par une longue histoire de discrimination et de préjugés hostiles aux homosexuels, souvent véhiculés par des chrétiens fondamentalistes. Nous reviendrons sur les origines historiques de cette guerre culturelle contre l'homosexualité pour montrer comment celle-ci structure encore aujourd'hui le système de gouvernement et alimente la polarisation politique, en partant du postulat que la brèche dans le mur de séparation entre l'Eglise et l'Etat est en partie responsable de nombreux blocages institutionnels et d'un patchwork de lois inégalitaires à travers le pays.
