Comment le droit international peut-il règlementer des phénomènes complexes ? Cette question se pose avec une acuité particulière en ce qui concerne la déforestation tropicale. En effet, les difficultés techniques et les intérêts divergents des États, découlant de l’interaction des multiples services assurés par les forêts, ont empêché l’adoption d’une convention internationale en ce domaine. Néanmoins, les négociations menées au sein du régime international du climat ont créé un mécanisme dit de « réduction des émissions résultant du déboisement et de la dégradation des forêts et le rôle de la conservation et de la gestion durable des forêts et du renforcement des stocks de carbone forestiers dans les pays en développement » (REDD+). Défini par un ensemble de décisions de la Conférence des parties à la convention-cadre des Nations-Unies sur les changements climatiques, il a déjà permis d’initier, sur le territoire des pays en développement, une amélioration substantielle du contrôle des ressources forestières et des réformes règlementaires et institutionnelles de grande ampleur. Notre étude se propose d’évaluer les spécificités du système normatif mis en place sur la REDD+. Elle a pour objet, en dépassant l’apparente faiblesse formelle des instruments juridiques sur lesquels il repose, de mettre en évidence sa portée normative. Elle révèle l’aptitude du droit international à règlementer des phénomènes complexes en donnant naissance à des systèmes juridiques adaptatifs. Elle démontre que la spécificité de tels systèmes normatifs réside dans la satisfaction de deux exigences opposées : la flexibilité et la sécurité juridique / How International law can regulate complex phenomenon? This question appears particularly relevant if we consider tropical deforestation. Technical issues and the opposite interests of States, stemming from interlinked services provided by forest, had prevented International community to adopt a convention on forests. Nevertheless, climate regime has recently created a so-called mechanism on « reducing emissions from deforestation and forest degradation in developing countries and the role of conservation and sustainable management of forests and enhancement of forest carbon stocks in developing countries » (REDD+). The normative framework laid down in decisions of the Conference of the parties has stimulated control improvement on forest resources and wide-ranging reform in developing countries. The study will evaluate the specificities of this normative system by going further its apparent normative weakness. It will expose how International law manage to regulate complex phenomenon by producing adaptive legal system. The study will demonstrate that the specific feature of this system lies in its ability to conciliate two opposite needs: flexibility and legal security

One of the main objectives of any legal system is legal certainty, which is understood as the provision of decisions in the work of the courts. To this end, in order to standardize the diversity of decisions of courts for the same conflict, there are meetings of supreme judges who seek to give a unique sense of resolution to the same conflict. Those meetings are called Cassation Plenaries.In this article, the author comments and develops the decision taken at the IX Civil Cassation Plenary. At that meeting a broad criterion of manifested nullity has been chosen, whenever the causal is “easy to warn”. However, throughout the text the author highlights the methodological vices of the Supreme Court to reach this conclusion and, using a legal comparison, proposes a different criterion of manifest nullity, demonstrating that for our legal system this should not be restricted to an “easy to warn” causation. / Uno de los objetivos principales de todo sistema normativo es la seguridad jurídica, la cual se entiende como la previsión de las decisiones en la labor de las cortes judiciales. Con dicho propósito, a fin de uniformizar la diversidad de decisiones de las cortes para un mismo conflicto, existen reuniones de jueces supremos las cuales buscan dar un sentido único de resolución a un mismo conflicto. Aquellas reuniones son denominadas Plenos Casatorios.En el presente artículo, el autor comenta y desarrolla la decisión tomada en el IX Pleno Casatorio Civil. En dicha reunión se ha optado por un criterio amplio de nulidad manifiesta siempre que la causal sea “fácil de advertir”. Sin embargo, a lo largo del texto el autor pone en evidencia los vicios metodológicos de la Corte Suprema para llegar a esta conclusión y, recurriendo a la comparación jurídica, propone un criterio distinto de nulidad manifiesta, demostrando que para nuestro ordenamiento jurídico esta no se debe restringir a una causal “fácil de advertir”.

Tributação da renda imobiliária / Taxation on the real state market

O presente trabalho parte da análise das normas que regem a tributação da renda no mercado imobiliário com a finalidade de possibilitar a identificação de um sistema jurídico dotado de princípios e valores próprios, que possibilite o estudo de suas normas de maneira destacada em relação às demais disposições que versam sobre a imposição da renda. Não se tem por pretensão a busca de uma autonomia das mencionadas normas; pelo contrário, o estudo parte da premissa de um único sistema jurídico, mas que pode ser estudado sob diferentes pontos de vista: um sistema que comporta subsistemas normativos, com valores e princípios próprios. Objetiva-se, assim, a identificação e posterior aproximação daquelas disposições que possuem fundamentos e princípios comuns, o que possibilitará a compreensão da extensão das previsões normativas a serem analisadas, bem como as opções efetuadas pelo legislador na produção legislativa. Antes de se efetuar o estudo das normas que versam sobre a tributação da renda imobiliária serão discutidos e apresentados os conceitos gerais necessários às análises que se seguirão. A limitação do legislador na produção legislativa é aspecto central no presente estudo. Entende-se que o sistema jurídico justo demanda uma coerência alcançada somente quando verificada a adequação valorativa das normas que o compõem e apresente unidade, por meio da observância de princípios e valores comuns, por essas mesmas normas. As normas que prevêem as imposições fiscais incidentes sobre renda no mercado imobiliário se prestarão de pano de fundo para a identificação de princípios que regem a tributação do imposto de renda nas diversas situações apresentadas. Serão, assim, objeto de análise a tributação do imposto de renda das pessoas jurídicas, tributadas pelo lucro real e pelo lucro presumido; a tributação especial das pessoas jurídicas sujeitas ao patrimônio de afetação; os rendimentos auferidos pelas pessoas físicas decorrente das atividades ligadas ao mercado imobiliário, tais como o ganho de capital na venda de imóveis e a tributação dos fundos de investimento imobiliários. Ao final da análise da legislação que versa sobre a tributação do imposto de renda nas situações acima mencionadas serão apresentados os princípios e valores escolhidos pelo legislador para a imposição da renda imobiliária. / The present arises from the analysis of principles which rule the taxation on the real estate market aiming the possibility of identifying a legal system endowed with principles and self-values and also providing an outstanding study of its rules with relation to the other provisions which deal with the income taxation. There is no intention of the search of independence from the aforementioned provisions, on the contrary, the study arises from the assumption of a unique legal system, which otherwise may be studied under different points of view, a system which involves normative sub-systems with their own values and principles. It aims, therefore, the identification and later approach to those provisions which own principles and grounds in common, providing that way, the understanding of the extension of the normative foresight to be analyzed, as well as, the legislator\'s altematives when making laws. Before the study of the principles which deal with the real estate income taxation, the general concepts needed to the analysis shall be presented and discussed. The legislator limitation to the law making shall be the central aspect of the present study. It is understood that a fair legal system demands coherence, which is just achieved when the appropriate principle values which integrate it are consolidated by the observance of the common principles and values of such principles. The rules, which provide the tax enforcement collected on the real estate income, shall be the grounds for the identification of the principles which rule the taxation on the income tax of the different situations herein presented. The corporation income tax, collected on presumed and gross profits, special corporation taxation liable to the \"patrimônio de afetação\", the earnings obtained by the individual persons regarding real estate businesses such as capital gain in property sales and the taxation on real estate funds of investments will, therefore, be the object of the analysis. After the analysis of the legislation which deals with the taxation on the income tax of the aforementioned situations, the principles and values enforced on real state earnings chosen by the legislator shall be presented.

La période précontractuelle dans les droits des pays arabes / The pre-contractual period in the laws of Arab countries

La mondialisation favorise les échanges de toutes natures. Le domaine juridique avec ses idées, concepts et catégories trouve donc un terrain fertile pour contribuer au développement socio-économique des peuples. Aujourd’hui, la tradition civiliste et celle islamique caractérisent les droits arabes. Pour ce faire une idée juste de ces droits et nous intéresser à la période précontractuelle, il appert fondamental de déterminer le mécanisme de construction et de validité de la règle juridique en terre d’Islam selon une approche historique, objective et positive. Cette méthodologie d’étude nous a permis de proposer une nouvelle définition du droit musulman qui intègre les différentes autorités normatives permettant ainsi de corriger les nombreuses incompréhensions relevées. Ensuite, il convenait de vérifier nos résultats théoriques à l’aune des réalités actuelles pour préciser la nature juridique des ordres juridiques arabes. Cela nous a amené à réfuter la dualité des ordres juridiques arabes en faveur de l’unité et la cohérence. Enfin, nous pouvions à ce moment aborder la période précontractuelle pour démontrer et affirmer avec force la compatibilité entre la tradition et le modernisme selon une approche comparatiste entre les droits français, marocain et koweïtien, tout en proposant des pistes de réformes pour assurer le respect de la parole donnée grâce à une nouvelle classification juridique dans cette matière trop peu étudiée dans les pays arabes. In fine, notre étude semble pouvoir s’élargir à toute matière juridique créant ainsi un pont entre la réflexion contenue dans la première partie de notre thèse et l’action esquissé durant la seconde partie / Globalization promotes all kinds of exchanges. The legal field with its ideas, concepts and categories finds fertile ground to contribute to the socio-economic development of the peoples. Today, the continental and the Islamic tradition characterize Arab laws. In order to have an accurate idea of those laws and study the pre-contractual period, it is fundamental to determine the mechanism of construction and validity of the legal rule in Islamic land according to a historical, objective and positive approach. Our methodology has allowed us to propose a new definition of Islamic law that integrates the different normative authorities, thus making it possible to correct the numerous misunderstandings noted. Therefore, it was necessary to verify our theoretical results in the light of current realities in order to clarify the legal nature of the Arab legal orders. This has led us to refute the duality of Arab legal orders in favor of unity and coherence. Finally, we were able to approach the pre-contractual period in order to enhance the compatibility between tradition and modernism, using a comparative approach between French, Moroccan and Kuwaiti laws, to propose ways of reforming the pre-contractual period thanks to a new legal classification in this subject, which has been little studied in the Arab countries. In fine, our study seems to be able to be extended to all legal matters, thus creating a bridge between the theoretical thinking contained in the first part of our thesis and the action sketched during the second part.

A Training programme for intermediaries for the child witness in South African Courts

This study concentrates on the development, implementation and evaluation of a research based training program for intermediaries in South African courts in order to improve the intermediary’s knowledge and understanding of the role and duties of an intermediary. The motivation for this study had its origin in the fact that the adversarial nature of court proceedings is a major stumbling block for the child witness. The research problem, namely that there is no national research based training program for intermediaries in South Africa, was discussed. Intervention research was used as research methodology and a two phase research approach was undertaken. A quantitative survey research design was used during the phases. The research question formulated for the first phase was: What are the duties and role of an intermediary? 54 magistrates and 34 prosecutors who attended four workshops, completed a self-structured questionnaire. This data complemented the literature study and both were used to compile a training program for intermediaries. The quantitative approach was also used for phase two of the study. A quasi-experimental one-group pretest-posttest design was used. An assessment by means of a questionnaire was done before the training program started and was repeated again after the presentation of the training program to determine the effectiveness of the program The research hypotheses that was formulated was: If an intermediary is trained according to a research-based training program, the intermediary’s knowledge of her role in assisting the child before and during the trial in a South African court will be improved. A five-day training program was implemented. The hypothesis was confirmed after the data had been analyzed and compared to the literature. In chapter two the legal system of South Africa, in respect to the child, was discussed and in chapters three, four and five all aspects of child development were discussed with specific emphasis on the child witness that needs to testify in a separate courtroom. Cognitive development and language development in the context of the child witness were discussed. This information was used to develop a training program. In chapter six the development of a training program was discussed with specific attention being given to outcomes based education. In chapter seven all the data that was collected was quantified, analyzed and interpreted. The conclusion could be drawn that the respondents did show improvement of their skills and knowledge of an intermediary, his/her duties and theoretical knowledge. They also showed that their practical skills had improved by attending the training program. The conclusion could therefore be made that the intermediary training program was successfully implemented and complied with the requirements of an outcomes based training program. The findings obtained indicate that trainers of intermediaries throughout South Africa can successfully apply the developed training program. Conclusions and recommendations (chapter 8) of this study are put forward in accordance with the process that was followed in developing and implementing the training program for intermediaries who are to assist children when testifying in a court. / Thesis (DPhil (Social Work))--University of Pretoria, 2006. / Social Work / unrestricted

Etat et Nation dans le constitutionnalisme africain : étude thématique / State and nation in African constitutionalism : thematic study

Seul l’État disposait d’une personnalité juridique au sortir de la Révolution de 1789. Déduite de la formule « [l]’État est la personnification juridique d’une nation », la personnalité sus-évoquée dote le premier (l’État), au détriment de la seconde (la nation), de droits subjectifs. Qu’en est-il après la Révolution démocratique de 1989, c'est-à-dire quelque deux siècles plus tard ? La présente étude tente de démontrer la revanche de la nation dans la théorie du droit à partir d’un contexte où elle a été particulièrement brimée. D’une part, la nation bénéficie d’une double représentation médiate et immédiate du fait qu’elle participe, par un pouvoir normatif initial, à la formation de la volonté générale. On sait aussi que le renouveau démocratique a imposé la question de la légitimité par laquelle la nation peut contrôler, médiatement (par l’intermédiation du juge constitutionnel) ou immédiatement (par référendum), l’action des autres organes y compris le pouvoir constituant dont l’ensemble des compétences est encadré par la constitution. L’investissement des organes supranationaux qu’on découvre de plus en plus dans le commerce juridique national rend cette question de la légitimité plus efficiente dès lors que la nation, mais aussi ses différentes composantes (par la capacité de saisir les instances régionales, communautaires ou même internationales), peut requérir la condamnation de l’État pour manquement à une obligation juridique. L’idée de légitimité suppose ainsi, pour la nation, la possibilité d’évaluer l’action des organes classique de l’État à partir d’un vaste ordre juridique.D’autre part, la reconnaissance constitutionnelle de la diversité nationale et mieux encore sa prise en compte dans la gestion publique de l’État a profondément reconfiguré le principe d’une souveraineté (nationale) une et indivisible entretenu par le droit constitutionnel révolutionnaire. À partir des principes de personnalité et de territorialité, le contexte africain apporte l’évidence de ce que la nation et les communautés infranationales sont désormais titulaires de droits (politiques, socioculturels) subjectifs ; ce qui modifie le paysage de l’État moderne. On parle de plurijuridisme pour caractériser un agencement politique pluriel. Il suit que la nation (pas seulement elle, mais toutes les composantes sociologiques de l’État) jouit d’une double personnalité juridique (nationale et internationale) qui s’oppose à celle de l’État. Celui-ci reste à la quête d’une nouvelle identité qui traduira la somme des compétences infra et supra nationales des acteurs du système juridique ; laquelle identité devrait par ailleurs indiquer le sens définitif de la théorie postmoderne de la personnalité juridique de l’État. / Only the State had a legal personality at the end of the 1789 Revolution. Derived from the phrase "[t] he State is the legal personification of a nation", the above-mentioned personality endows the first (state), to the detriment of the second (the nation), subjective rights. What about after the democratic revolution of 1989, that is to say, some two centuries later? This study attempts to show the revanche of the nation in legal theory from a context in which it was particularly bullied. On the one hand, the nation has a double mediate and immediate representation of the fact that it participates, with an initial legislative power, the formation of the general Will. We also know that the democratic renewal imposed the issue of legitimacy which the nation can control mediately (by the intermediation of the constitutional Court) or immediately (by referendum), the action of other organs including the constituent whose power skill set is framed by the constitution. Investment supranational bodies we discover more and more into the national legal trade makes the question of legitimacy more efficient when the nation, but also its various components (the ability to capture the regional, community or even international Instances), may require the condemnation of the State for breach of legal obligations. The idea of legitimacy is thus assumed for the nation, the opportunity to evaluate the work of state bodies from a large legal system. On the other hand, the constitutional recognition of national diversity and even taking into account the governance of the State profoundly reconfigured the principle of (national) sovereignty maintained by the revolutionary constitutional Law. Based on the principles of personality and territoriality, the African context provides evidence that the nation and sub-national communities are now holders of rights (political, socio-cultural) subjective, which changes the landscape of the modern State. We talk about plural juridical ways to characterize a plural political arrangement. It follows that the nation (not only her but all the sociological components of the State) has a dual legal personality (national and international) that opposes that of the State. The State remains in search of a new identity that will reflect the sum of the sub skills and supranational actors in the legal system which identity should also indicate the final direction of the postmodern theory of the legal personality of the State.

The aim of this work is to analyse the progress made by Turkey in human rights area and identify how important role of Islam there is. The work attempts to refute the idea that Muslim society is not possible to create a functioning legal system that takes sufficient account of the protection of human rights. Reforms of 20 and 30 years of the 21st century were used as theoretical basis. For the analysis of advances in the field of legislation was used Turkish Constitution as the basic document, which is the most important from the point of view of the European Union. A key part of this thesis is an analysis of current problems in the field of human rights and criticism of the international community, especially the European Union that Turkey must face. The work attempts to identify how important role is played by Islam in the issue.

Les menaces à l’ère de la technologie: analyse du processus de détermination de la peine

Les réseaux sociaux et les mediums de télécommunication ont donné naissance à une abondance de propos menaçants par lesquels sont véhiculés des messages de haine qui sont possiblement annonciateurs d’une violence future (Laforest & al., 2017). À ce jour, les études ne permettent pas de décrire le contexte dans lequel les menaces proférées par un medium technologique s’insèrent. Elles ne permettent pas non plus de comprendre les facteurs qui influencent les sentences de tels comportements. À partir d’une approche méthodologique mixte et d’un échantillon de 93 décisions judiciaires canadiennes, l’objectif principal de ce mémoire consiste, dans un premier temps, à décrire les facteurs circonstanciels entourant les menaces de mort et de lésions corporelles à l’ère numérique. En général, les résultats montrent que les menaces qui ont donné lieu à une décision écrite présentent un risque considérable de se concrétiser. De plus, nous avons découvert que même si dans certaines situations ce sont des témoins qui ont dénoncé les menaces aux autorités, ce sont principalement les victimes elles-mêmes qui dénoncent le plus souvent leur assaillant, craignant pour leur sécurité et celle de leurs proches. Dans un deuxième temps, nous cherchions à comprendre la réponse juridique canadienne pour de telles infractions. Plus précisément, un test de régression logistique a été élaboré afin de comprendre les facteurs contextuels qui influencent le recours à une sentence d’emprisonnement. Les résultats de cette analyse montrent que parmi les facteurs susceptibles d’influencer de telles sentences, quatre se sont avérés significatifs : (1) un lien conjugal avec la victime, (2) l’utilisation des médias sociaux, (3) la consommation d’alcool ou de drogues et (4) la gravité de la menace. Finalement, à partir de nos analyses, nous pouvons conclure que de nombreux enjeux subsistent dans le processus de détermination de la peine pour les menaces proférées par un medium technologique. En effet, plusieurs éléments peuvent interférer dans l’analyse du juge, notamment la crédibilité de la victime et l’intention criminelle de l’accusé. / Social networks and telecommunications tools have risen an abundance of threatening words through which violent messages are conveyed. They are possibly predictors of future violence (Laforest & al., 2017). To date, studies do not allow us to describe the context in which the threats uttered by a technological medium occur. They also do not allow us to understand the factors that influence the sentences of such behaviors. Based on a mixed methodological approach and a sample of 93 Canadian court decisions, the main objective of this study consists, firstly, in describing the circumstances factors surrounding threats of death and bodily harm in the digital age. Overall, the results show that threats that resulted in a written decision have a significant risk of materializing. Furthermore, we discovered that although in some situations it was witnesses who reported the threats to the authorities, it was mainly the victims themselves who most often reported their assailant, fearing for their safety and that of their loved ones. Second, we sought to understand the Canadian legal responses for such offences. More specifically, a logistic regression test was developed to understand the contextual factors that influence the use of a prison sentence. The results of this analysis show that among the factors likely to influence such sentences, four were found to be significant: (1) a marital relationship with the victim, (2) the use of social media to make the threat, (3) the use of alcohol or drugs and finally (4) the seriousness of the threat. Finally, based on our analyses, we can conclude that that many issues remain in the sentencing process for threats made by a technological medium. Indeed, several elements can interfere in the judge’s analysis, in particular the credibility of the victim and the criminal intentions of the accused.

Цель исследования – сформировать научное представление о международных стандартах прав человека как об элементе государственного управления, обозначить основные проблемы механизма их обеспечения в государственном управлении и пути повышения эффективности данного механизма. В процессе исследования были выявлены проблемы реализации международных стандартов прав человека в сфере образования, здравоохранения, физической культуры и спорта. В заключение содержатся выводы, характеризующие итоги исследования. По итогам исследования в адрес органов государственной власти разработаны рекомендации по обеспечению международно признанных прав человека. / The object of research in this paper is internationally recognized human rights as an element of public administration. The purpose of the research is to form a scientific understanding of international human rights standards as an element of public administration, to identify the main problems of the mechanism for ensuring them in public administration and ways to improve the effectiveness of this mechanism. In the course of the research, the problems of implementing international human rights standards in the field of education, health, physical culture and sports were identified. The conclusion contains conclusions that characterize the results of the study. Based on the results of the study, recommendations were made to state authorities to ensure internationally recognized human rights.
