Limitations in Geophysical Processing and Interpretation: Three Canadian Case Studies

With an increasing demand on natural resources, more efficient prospecting techniques need to be developed. One important tool is geophysical methodologies. As technology develops so do these methods and availability of high-resolution information; however if this information is not properly corrected biased results are achieved. This thesis intends to explore common limitations faced by modern geophysical surveys. Processing and interpreting of geophysical data is often accomplished in frequency domain due to speed and efficiency; however this often leads to non-geologically correct results. A spatial domain filter based on potential field signal curvature analysis is a proposed alternative. By isolating specific curvatures, one is isolating specific frequencies, which are generated by sources at particular depths. The method was applied to synthetic and real-world datasets. Following filtering two analytic routines were applied, which showed that the spatially filtered datasets provided cleaner results. Terrain corrections have always been applied to gravity datasets, but rarely are terrain corrections implemented as a pre-processing step in magnetic survey interpretation. Therefore, interpretations based on anomalies from non-corrected magnetic data may be of non-geological features. In a magnetic survey conducted in the mid-eighties, magnetic lows were associated with alteration; however, at that time of initial interpretation no terrain correction was applied. This dataset was revisited and terrain corrected, which showed that the magnetic lows were associated with unaccounted bathymetry. The Bathurst Mining Camp (BMC) is one of Canada's most important base metal mines, but is threatened by a fluctuating mineral resources market. By using high resolution geophysical surveys potential mineral reserves may be located. However, in order to do so a better understanding of geology is necessary, which is often difficult due to limited outcrops. Through the processing and interpretation of recent geophysical datasets, a revised geological map of a selected portion of the BMC has been developed. / Thesis / Master of Science (MSc)

Fiabilité des structures en vibrations aléatoires : application aux systèmes mécatroniques embarqués / Reliability of structures subjected to random vibrations : application to embedded mechatronic systems

Les vibrations aléatoires sont les sollicitations les plus représentatives à celles qui se trouvent dans l'environnement réel. Elles sont souvent rencontrées dans l'environnement de fonctionnement automobile, aéronautique, spatial, ferroviaire et d'autres. La particularité des vibrations aléatoires est l'utilisation de son analyse par fatigue. Grâce aux propriétés statistiques des signaux aléatoires que les méthodes spectrales permettent d'estimer la moyenne du dommage d'une façon efficace et économique mais avec certaines limitations. Une étude numérique sur un système électronique embarqué accompagnée des essais expérimentaux ont été mis en place dans cette thèse pour présenter une démarche complète d'une analyse spectrale des vibrations aléatoires. Une modélisation par éléments finis a été réalisée ainsi qu'une technique du 'zoom structural' en analyse spectrale des vibrations aléatoires a été proposée dans ce travail avec la présentation des équations de cette technique. Une application numérique a montré la validité de la technique proposée en appliquant une étude de l'endommagement par fatigue par l'approche temporelle et par l'approche spectrale. Les résultats numériques de cette application mènent à une estimation d'un temps à l'initiation de la fissure très proche du temps de défaillance observé dans les résultats des essais expérimentaux. Cette technique montre la performance et l'efficacité des méthodes spectrales dans l'estimation du dommage par fatigue aléatoire. Une étude de l'optimisation d'un système soumis aux sollicitations aléatoires a été développée. L'objectif de cette étude est de rechercher la conception optimale du système soumis aux vibrations aléatoires en posant des limitations sur le dommage qui en résulte. Ce dommage estimé par les méthodes spectrales de Dirlik et de Single Moment ne doit pas dépasser un dommage cible pour assurer la fiabilité du système étudié. / Random vibrations are the most representative excitations that can be found in the real environment. They are often encountered in the automotive, aeronautical, space, railway and other operating environments. The special feature of the random vibrations is their important role in damage fatigue analysis. The spectral methods allow to estimate efficiently and economically the mean of the damage using the statistical properties of the random signals. A numerical study on an embedded electronic system with experimental tests was set up in this thesis to present a complete spectral analysis of random vibrations methodology. A finite element model was performed as well as submodelling technique in spectral analysis of random vibrations with associated equations was proposed in this work. A numerical application has shown the validity of the proposed technique by applying the fatigue damage study using the time-domain approach and the spectral approach. The numerical results of this application lead to the estimation of a crack initiation time very close to the failure time observed in the experimental tests. This technique shows the performance and efficiency of spectral methods in the estimation of random fatigue damage. The optimization of a system subjected to random excitations has been developed in this work. The objective of this study is to retrieve the optimal design of the system subjected to random vibrations with limitations on the resulting damage. This damage estimated by Dirlik and Single Moment spectral methods must not exceed defined target damage in order to insure the reliability of the studied system.

O presente trabalho consiste num estudo analítico sobre a prescrição tributária com a finalidade de, didaticamente, buscar identificar um subsistema jurídico próprio, dotado de normas e valores próprios, que permita o estudo destacado do tema dentro do sistema do direito positivo, a partir de uma análise lógico-sintática da expressão prescrição tal qual referido na alínea b do inciso III do art. 146 da Constituição Federal de 1988 (CF/88)2, que outorga competência ao legislador complementar para fixar normas gerais sobre a prescrição tributária, para construir uma significação possível para tal expressão, identificando sua acepção de base3, não se admitindo que se diga que o seu conteúdo seja vazio, a fim de que se possa identificar o regime jurídico aplicável à prescrição tributária, com a completa compreensão dos limites da competência do legislador complementar e ordinário nesse âmbito, de modo que se possa perceber a existência de uma tríplice4 perspectiva pragmática do uso dessa expressão no discurso do direito positivo, no qual por vezes é tomado como norma prescricional, ou como fato prescricional (hipotético), ou ainda como relação jurídica prescricional, o que já foi anteriormente investigado por outros autores, mas não sob o rótulo aqui sugerido, apesar de pouco explorada, daí porque merecendo melhor atenção, compreensão e aplicação na solução de casos da pragmática jurídica, para, ao final, identificar os eventuais acertos e/ou vacilos da jurisprudência do Superior Tribunal de Justiça (STJ) e do Supremo Tribunal Federal (STF) no julgamento dos casos e problemas aqui apresentados. / The present paper consists of an analytical study on tax statute of limitations with the aim of identifying, didactically, a special legal subsystem, endowed with its own normative values and rules, allowing the aforementioned study within the system of positive law, from a logical syntactic analysis of the phrase Statute of Limitations pursuant to as mentioned in Article 146, III, b, of the 1988 Brazilian Federal Constitution5, which grants to the supplementary law competence concerning establishing general rules with regard to the tax limitation, to constitute a possible meaning to such a phrase, identifying its basic acceptation6, not considering to say that its content is hollow, in order to identify the legal regime applicable to tax limitation, with the comprehensive understanding of the supplementary and ordinary laws competence limits herein, in order to realize the existence of a triple7 pragmatic perspective of using such phrase in the utterance of the positive law, in which is sometimes taken as statute of limitations, or statute of limitations fact (hypothetical), or even as Legal Relationship of Limitations, which has previously been investigated by other authors, but not under the approach suggested hereto, though little investigated, hence why deserves better attention, understanding and application in solving cases of Legal pragmatism, to, in the end, identify any adjustments and/or wanderings of the jurisprudence of the Superior Court of Justice (STJ) and the Federal Supreme Court (STF) in judging cases and claims presented herein.

This matter, widely discussed at administrative courts and before the Judiciary Branch, is the topic covered in this paper. With that purpose, and adopting strict assumptions, we shall discuss in Chapter I the importance of language and language used in law, with emphasis on the speeches of law makers and scholars. In Chapter II, we shall cover the juridical norms, establishing the four concepts with which we shall operate: norms introducing instruments, normative documents, prescriptive enunciations and juridical norms in the strict sense (meanings taken from normative texts). In Chapter III, we shall approach the dynamics of the statutory law system, taking as a starting point the operation of the sources of law, to later enter the domain of validity, enforceability, effectiveness and efficiency . We shall also cover normative incompatibilities, revocation, as well as about the criteria for overcoming normative incompatibilities, which are the hierarchical, time (or chronological) and specialty criteria. On its turn, Chapter IV shall be destined to the normative production control, where we shall indicate normative production vices and techniques to exercise such control, i.e.: control over constitutionality (including interpretation according to the Constitution and partial unconstitutionality without reduction of text), control over legality and control over non-application of law rules. In Chapter V we shall focus on the study of supplementary laws and general tax law rules. The topic shall cover the role of supplementary laws related to tax matters, notably the roles set forth by article 146 of the Constitution, and of the special role of system adjustment that it plays. Chapter VI shall be dedicated to the statute of limitations and limitation period for tax matters. We shall discuss these elements that terminate rights in view of the failure of its creditor to act during a specified term. In the tax arena, we shall explore the role of the supplementary law to set forth national rules on statute of limitations and limitation periods, also considering the possibility of establishing said terms. We shall also shed a light on the rules of the National Tax Code on the matter, particularly the statute of limitations and limitation period terms. Finally, Chapter VII shall bring the rules of articles 45 and 46 of Law no. 8,212/91. The ten-year terms for statute of limitations and limitation periods for the collection of social contributions destined to the social security shall then be submitted to the control over constitutionality, control over legality and control over the non application of juridical rules / A discussão sobre os prazos de decadência e prescrição relativamente às contribuições sociais destinadas ao financiamento da seguridade social ganhou novos contornos com a publicação da Lei n. 8.212/91, de 24.07.1991, cujos arts. 45 e 46 estabeleceram prazos de 10 (dez) anos para a Seguridade Social cobrar seus créditos, enquanto o Código Tributário Nacional fixa em 5 (cinco) anos os prazos de decadência e prescrição em matéria tributária. Está questão, amplamente controvertida nas esferas administrativas e perante o Poder Judiciário, é o tema que será enfrentado neste trabalho. Para tanto, e adotando rígidas premissas, versaremos no Capítulo I acerca da importância da linguagem e da linguagem própria do direito, com destaque para os discursos do legislador e do cientista do direito. Já no Capítulo II, trataremos das normas jurídicas, definindo as quatro acepções com as quais operaremos: instrumentos introdutores de normas, documentos normativos, enunciados prescritivos e normas jurídicas em sentido estrito (significações construídas a partir dos textos normativos). No Capítulo III abordaremos a dinâmica do sistema do direito positivo, tomando como pontos de partida a atuação das fontes do direito, para depois ingressarmos na temática da validade, vigência, eficácia e efetividade. Falaremos ainda sobre incompatibilidades normativas, revogação, bem como sobre os critérios para superação de incompatibilidades normativas, que são os critérios hierárquico, temporal (ou cronológico) e da especialidade. Por sua vez, o Capítulo IV será destinado ao controle de produção normativa, quando apontaremos os vícios de produção normativa e as técnicas para o exercício desse controle, a saber: controle de constitucionalidade (inclusive interpretação conforme à Constituição e inconstitucionalidade parcial sem redução de texto), controle de legalidade e controle de não aplicação das normas jurídicas. Dedicaremos o Capítulo V ao estudo da lei complementar e das normas gerais de direito tributário. O tema passará também pelo exame do papel da lei complementar em matéria tributária, notadamente daqueles papéis estabelecidos pelo art. 146 da Constituição, e da especial função de ajuste do sistema que exerce. O Capítulo VI será reservado à decadência e à prescrição tributárias. Discorreremos sobre essas figuras extintivas de direitos em razão da inércia de seu titular por determinado prazo. No campo tributário, será explorado o papel da lei complementar para estabelecer normas nacionais sobre decadência e prescrição, inclusive sobre a possibilidade de veicular os respectivos prazos. Também estarão a merecer nossa atenção as regras do Código Tributário Nacional sobre o tema, em especial os prazos decadenciais e prescricionais. Por fim, no Capítulo VII enfrentaremos as regras dos arts. 45 e 46 da Lei n. 8.212/91. Evaluation des performances de lecture à partir d'un affichage fixé à la tête au cours de la marche : mise en évidence d'effets délétères des mécanismes de stabilisation du regard

Le système visuel humain exhibe une configuration retino-corticale qui confère à seulement une petite région centrale de la rétine (i.e., la fovéa) une haute spécialisation dans la perception des détails spatiaux fins. Ainsi, l’information visuelle nécessite d’être stabilisée sur cette région au cours de mouvements de tête engendrés par des activités telles que la marche. Des mécanismes de stabilisation du regard ont été rapportés comme compensant les mouvements de translation et de rotation de la tête caractéristiques de la marche par des mouvements réflexes de tête et d’yeux, permettant ainsi une stabilisation efficace de l’image rétinienne d’une cible visuelle fixée dans l’environnement. Néanmoins, lorsque la cible visuelle est fixée à la tête, comme lors de la prise d’information à partir de lunettes informatives, ces mêmes mécanismes pourraient engendrer des perturbations sur les performances visuelles puisqu’alors stabiliser l’image de la cible nécessite que les yeux ne bougent pas dans leur orbite. L’objectif de ces travaux de thèse a été de réaliser une évaluation fonctionnelle des performances visuelles au cours de la marche lorsque la cible visuelle est fixée à la tête. Deux études préliminaires (Etudes 1 et 2) nous ont permis de concevoir une méthode d’évaluation fonctionnelle basée sur la lecture d’informations numériques de temps, favorisant l’étude des limitations sensorielles de la lecture. Ces études nous ont par ailleurs permis d’obtenir de nouvelles connaissances sur la psychophysique de lecture des informations numériques de temps. En combinant notre méthode d’évaluation fonctionnelle avec l’analyse du mouvement de la tête (VICON) et des yeux (EOG) (Etude 3), nous avons montré que pendant la marche des performances optimales de lecture sont assurées par des mécanismes de stabilisation du regard qui compensent efficacement les mouvements de tête induits par l’activité en maintenant, dans une gamme fonctionnelle (2,7°/s-6,3°/s), le glissement rétinien de l’image d’une cible stationnaire affichée dans l’environnement. Nous avons également montré que lorsque l’information est présentée dans un affichage fixé à la tête, ces mêmes mécanismes de stabilisation du regard produisent un glissement rétinien trop important (13,7°/s) pendant la marche, au lieu de le réduire, aboutissant à une diminution des performances de lecture pour la plus grande taille visuelle de caractères testée (5°), mais surtout pour les plus petites tailles (0,2°-0,3°), que nous avons attribuée à une perte d’acuité visuelle. Nous en avons conclu que les mécanismes de stabilisation du regard, qui normalement permettent aux performances visuelles d’être maintenues au cours de l’activité physique, produisent des effets délétères sur les performances de lecture lorsque l’information est présentée à partir d’un affichage fixé à la tête. Les résultats de ces travaux ont permis l’élaboration de règles de conception des IHM visuelles, notamment celles de lunettes informatives, adaptées aux propriétés du système visuel humain. / The human visual system exhibits a retino-cortical configuration that confers to only a small central region of the retina (i.e., the fovea) a high specialization in the perception of fine spatial details. Thus, visual information needs to be stabilized in this area during head movements caused by activities such as walking. Gaze stabilization mechanisms have been reported as compensating the movements of translation and rotation of the head characteristic of walking by reflex movements of the head and eyes, thus allowing effective stabilization of the retinal image of a visual target fixed in the environment. However, when the visual target is attached to the head, as when the information is read from “informative glasses”, these mechanisms could lead to disturbances in visual performance since stabilizing the image of the target requires that the eyes do not move in their orbits. The aim of this thesis work was to perform a functional evaluation of visual performance during walking when the visual target is attached to the head. Two preliminary studies (Studies 1 and 2) enabled us to design a method of functional evaluation based on the reading of numerical time information, furthering the study of sensory reading limitations. These studies also allowed us to obtain new knowledge about the psychophisics of reading numerical time information. By combining our functional evaluation method with the movement analysis of the head (VICON) and eyes (EOG) (Study 3), we showed that during walking optimal reading performance is ensured by gaze stabilization mechanisms that effectively compensate for head movements induced by the activity, by maintaining retinal slip within a functional range of 2.7°/s-6.3°/s for a stationary target in the environment. We also showed that when the information is presented on a display attached to the head, these same gaze stabilization mechanisms produce an excessive retinal slip (13.7°/s) during walking, instead of reducing it, resulting in a decrease in reading performance for the larger (5°), but especially for the smaller (0.2°-0.3°) visual character size tested, which we attributed to a loss of visual acuity. We concluded that the gaze stabilization mechanisms, which normally allow visual performance to be maintained during physical activity, produce deleterious effects on reading performance when the information is presented from a display attached to the head. The results of this work allowed the development of visual HMI design rules, including those for “informative glasses” adapted to the human visual system properties.

La contrefaçon en ligne : le traitement judiciaire des atteintes aux droits de propriété intellectuelle / Cyber counterfeiting : the judicial treatment of infringements of intellectual property right

La rencontre intervenue entre les biens protégés par le droit de la propriété intellectuelle et l'internet ne s'est pas faite sans heurts. Ubiquitaire, immatériel, anonyme et transfrontalier sont autant de spécificités de l'internet qui mettent en péril les prérogatives des titulaires de droit de propriété intellectuelle. Dans cette optique, l'identification des usages couverts par un droit de propriété intellectuelle est un enjeu essentiel pour déterminer le périmètre de la contrefaçon en ligne. Ainsi, la portée des droits de propriété intellectuelle sur l'internet détermine le périmètre de la contrefaçon en ligne. Dans cet environnement numérique, la portée des droits de propriété intellectuels ne peut être révélé qu'à l'étude de la masse des atteintes qu'ils endurent. Or, cette analyse ne souffre aucune ambiguïté. Il en résulte incontestablement le constat d'une limitation de la portée des droits exclusifs dans l'environnement numérique. Par ailleurs, la protection des droits de propriété intellectuelle est également affaiblie lors du traitement de la contrefaçon en ligne. En ce domaine, l'intervention du droit international privé est fréquente puisque les atteintes aux droits de la propriété intellectuelle présente souvent un élément d'extranéité. Toutefois, les critères de rattachement territoriaux prévus par la règle de conflit rendent difficile la détermination de la juridiction compétente dans un contentieux partiellement ou totalement dématérialisé. La responsabilité des acteurs de l'internet présente également de nombreuses faiblesses favorisant la diffusion de tout type de contenu / The meeting between property, protected by property rights an the internet has not been easy. In this context the identification of uses covere by an intellectual property right is a key issue in determining the scope of online counterfeiting. In this digital environment, the scope of intellectual property rights can be revealed by studying the mass of infringements they are subjected to. The above analysis is unbiased. This undeniably results in a limitation of the scope of exclusive rights in the digital environment. In addition, the protection of intellectual property rights is also weakened when dealing with cyber-counterfeiting. In this field, the intervention of private international law is frequent since when the infringements of intellectual property rights begin having an element of foreignness. However, the territorial attachment criteria provided by the conflict’s rule make it difficult to determine the competent jurisdiction in a partially or totally dematerialized legal dispute. The purpose of the present work was to study hand impairments and manual ability in children with cerebral palsy (CP) as well as to clarify their relationship. Appraising the degree of hand impairments requires normative data to differentiate the real dysfunctions of CP children from the normal difficulties according to their age, sex, or handedness. As there is no normative data for gross manual and fine finger dexterity, a first experiment focused on the normal development of manipulative functions was conducted to establish these norms. A second experiment was carried out to develop and validate through the Rasch model a measure of manual ability in children with CP since such a measure was not yet available. Etant donné l'absence de normes quant à la dextérité manuelle grossière et la dextérité digitale fine, une première étude a été réalisée afin d'examiner le développement normal de ces deux types de dextérité. Des normes sur les dextérités manuelle grossière et digitale fine ont ainsi pu être établies. Une deuxième étude a été effectuée afin de développer et valider à travers le modèle de Rasch une mesure de l'habileté manuelle chez les enfants IMOC. The purpose of the present work was to study hand impairments and manual ability in children with cerebral palsy (CP) as well as to clarify their relationship. Appraising the degree of hand impairments requires normative data to differentiate the real dysfunctions of CP children from the normal difficulties according to their age, sex, or handedness. As there is no normative data for gross manual and fine finger dexterity, a first experiment focused on the normal development of manipulative functions was conducted to establish these norms. A second experiment was carried out to develop and validate through the Rasch model a measure of manual ability in children with CP since such a measure was not yet available.
