The scope of this thesis in public law discussed the abstract judicial review in Sweden and Germany, which is practiced by a specified organ. In Sweden, the abstract judicial review is practiced by the Council on Legislation, and in Germany by the German Federal Constitutional Court. This study focuses on how the Swedish Council on Legislation and the German Constitutional Court differ in the practice of the abstract norm control. Moreover, a theoretical discussion is applied to regarding whether the Swedish justice system is in need of setting up a constitutional court or whether the Swedish Council on Legislation should be in a stronger position. Throughout this study, we concluded that the Swedish legal system is not in need to establish a Constitutional Court or another organ for the maintenance of an adequate standard norm control in Sweden. To this end, we suggest that the abstract norm control in Sweden by the law's compatibility with the constitution should be strong, but that there may be reason to further strengthen the review of the Council on Legislation. For instance, enhancing the investigation could be done by creating a legal secretariat and subsequently emphasizing the council’s independence from the parliament and government. By reinforcing the council with legal expertise, such as linking draftsmen to the council, can thus make the council’s opinion legally binding.

EUs rätt till effektivt rättsmedel och Sveriges reglering av interimistiska åtgärder : En kritisk analys av NJA 2021 s. 147

The right to an effective remedy in Article 47 of the EU Charter of Fundamental Rights obligates the Member States of the European Union to provide effective remedies for the protection of individuals’ rights. Within this framework, Mem- ber States must offer access to effective interim measures when national courts rule on matters of EU law. Due to varying national regulations and lack of clear EU guidance, there is no consensus on how interim measures should be inter- preted and applied in order to fulfill the individuals' rights to effective remedies. In this context, the thesis aims to analyze the application of interim measures in the Swedish case NJA 2021 s. 147 in order to ensure that Sweden meets its re- quirements under EU law and to safeguard effective protection of individuals' rights.  The Swedish EU case C-432/05 Unibet (London) Ltd och Unibet (International) Ltd v Justitiekanslern is a prominent case concerning interim measures and the right to an effective remedy. The case stipulates that when an individual challenges a national regulation’s compliance with the EU law, interim measures must be available, if needed, in order to protect invoked EU rights. The Swedish Supreme Court ruled that interim measures were not necessary in this specific case because the claim was not going to result in an enforceable judgment and therefore there were no EU rights in need of protection.  Now, 15 years later, a comparable question has come before the Swedish Su- preme Court in the case NJA 2021 s. 147. While bearing many similarities to the Unibet case, the key difference is that it is based on an enforceable judgment. However, the Supreme Court did not follow the argumentation line of Unibet, but decided to dismiss the application because it was considered to be abstract judicial review, which is not allowed according to Swedish law.  This thesis concludes that the Swedish Supreme Court likely breached EU law as it did not fulfill the obligations that follow from the right to effective remedies when applying the rules on interim measures in the case NJA 2021 s. 147. This conclusion is based on the finding that the Court failed to properly assess EU law in its judgment and limited itself to national law only, both in allowing interim measures and evaluating its necessity. This thesis argues that interim measures might have been allowed and necessary from an EU law perspective, hence the Court’s ruling limited the individual in exercising their EU rights.

Föreskrivs normprövningen i Uruguay och Sverige för att leva upp till rättsstatlighetens krav eller visar det på ett verklig skydd av de konstitutionella rättigheterna? Vårt syfte med denna uppsats har varit att beskriva Uruguays och Sveriges regelverk vad gäller den konkreta efterhandskontrollen av rättsreglers grundlagsenlighet samt att bedöma huruvida tillämpningen av den konkreta efterhandskontrollen ger ett rättsskydd för den enskilde. Vi har under arbetets gång presenterat båda systemen vad gäller den konkreta efterhandskontrollen ur ett komparativt perspektiv, för att på så sätt kunna identifiera och förklara de skillnader och likheter som föreligger. Av vår studie framgår att båda staterna betraktar normprövningen som en effektiv och nödvändig kontrollmekanism för att garantera att statsmakterna inte avviker från de föreskrivna reglerna och därmed tillförsäkra den enskilde ett rättighetsskydd. Problematiken ligger i om institutet resulterar i ett reellt skydd för den enskilde i båda rättsordningarna eller ej. Vi har kommit fram till att uruguayansk och svensk rättspraxis visar på ett reellt rättsskydd för de enskilda vid tillämpningen av den konkreta efterhandskontrollen och föreslår en kombination av de uruguayanska och svenska systemen för att på så sätt förstärka rättssäkerheten samt rättighetsskyddet, ur den enskildes perspektiv.
