La responsabilité des centres d'arbitrage / The liability of arbitral instituions

Les litigants sollicitent les centres d’arbitrage pour diriger l’arbitrage dans toutes ses phases afin de donner une garantie supplémentaire qui assure la validité de la sentence arbitrale. Compte tenu du rôle important que les centres d’arbitrage jouent pendant l’instance arbitrale, les litigants mécontents de la sentence arbitrale ou du jugement annulant la sentence tentent d’engager la responsabilité du centre d’arbitrage dès lors qu’il a surveillé, dirigé et participé au rendu de la sentence.De plus en plus la responsabilité des centres d’arbitrage est mise en cause devant les juridictions étatiques différentes, les fonctions et les pouvoirs exercés par les centres d’arbitrage ainsi que le régime de responsabilité leur est applicable font l’objet d’une attention critique de la part de la doctrine dans plusieurs systèmes juridiques. On s’interroge sur l’origine des rapports qui lient les centres d’arbitrage aux autres acteurs de l’arbitrage, sur les obligations et les pouvoirs conférés aux centres d’arbitrage, et sur les fonctions exercées par les centres d’arbitrage pour établir enfin un régime de responsabilité homogène et pertinent à l’égard des fonctions exercées par les centres d’arbitrage qui a une vocation à s’appliquer dans la majorité des systèmes juridiques / Parties to arbitration seek arbitral institutions to administrate their arbitration in order to have an extra guarantee that ensures the validity of the arbitral award. Given the role that arbitral institutions play during the arbitral procedure, parties unsatisfied either by the arbitral award or the annulment of the award tend to claim the liability of arbitral institution for the awards it had supervised, administered and participated in.The more the allegations of liability raise against the arbitral institutions before courts, the more the issue of arbitral institutions’ functions, powers and liability becomes controversial in different jurisdictions. Therefore, the present study tends to clarify the origin of the relationship existing between arbitral institutions and other parties involved in the arbitration at issue, the duties and powers assigned to the arbitral institutions and the functions performed by the arbitral intuitions, which helps eventually in establishing a kind of liability that complies with the functions performed by the arbitral institutions and can be applied in many jurisdictions.

A critical analysis of the application of the sola Scriptura principle in Adventist theological thinking and practical action with special reference to the Zambian context

Theological divisions are threatening the Seventh-day Adventist Church’s unity and focus on mission. Some Adventist theologians suggest that the cause of these divisions is a departure by other Adventist theologians from adhering to and applying the sola Scriptura principle. This study analyzes this problem. Chapter one presents reasons for a call during the 16th century, to reform the church to its apostolic purity. Martin Luther and other Protestant Reformers argued against the medieval church, popes, and church councils’ claim for authority to properly interpret and teach Scripture and Tradition. Differing views of reforming the church sparked divisions among the Protestant Reformers, creating two main streams, the magisterial and the radical Reformers. The Roman Catholic Church responded to the Protestant Reformations with a Counter-Reformation. Chapter two discusses Seventh-day Adventism’s application of the sola Scriptura principle. Although Adventism claims to descend from the radical wing of the Protestant Reformations, its acceptance of Ellen G. White’s prophetic ministry and her non-canonical inspired writings departs from a radical application of the sola Scriptura principle. Chapter three presents Biblical evidences for God’s use of multiple media of communication beside the Bible. Therefore Adventism needs to clearly define its understanding and application of the sola Scriptura principle to accommodate other theological sources in addition to the Bible. Chapter four presents Scripture in Zambian Adventist context, tracing Adventism’s use of the Bible in evangelization. Adventism’s responses to changing socio-political and religiopluralistic trends which threatened to marginalize Bible Instructions, and the development of, but failed attempt to implement an Adventist Bible-based Religious Education syllabus at Rusangu Secondary School are presented. The diploma thesis The influence of digitization on the Czech media law and legal environment deals with the transformation of media law and legal environment during the transition from analogue to digital broadcasting in the Czech Republic. The text describes and evaluates change of the broadcasting legislation, and emphasizes not only the actual changes in legal regulations, but also the legislative process and influences that have affected the final text of the laws. In the introduction thesis describes the development of existing legislation, both domestic and the acquis communautaire. In further parts it answers the question how relevant, understandable and conceptual the change in the media legislation was, how these changes correspond to the current technical and organizational requirements of the media market and how the process have been influenced by jurisdictional dispute between Council for Radio and Television Broadcasting and Czech Telecommunication Office. In the second half space is devoted to the licensing procedure of new digital television and following litigation as well as a comparison with Slovak regulatory framework. Regarding the major changes of the legislation the author recommends adjustments de lege ferenda.

A glorious and salutiferous Œconomy ...? : an ecclesiological enquiry into metropolitical authority and provincial polity in the Anglican Communion

For at least the past two decades, international Anglicanism has been gripped by a crisis of identity: what is to be the dynamic between autonomy and interdependence? Where is authority to be located? How might the local relate to the international? How are the variously diverse national churches to be held together 'in communion'? These questions have prompted an explosion of interest in Anglican ecclesiology within both the church and academy, with particular emphasis exploring the nature of episcopacy, synodical government, liturgy and belief, and common principles of canon law. However, one aspect of Anglican ecclesiology which has received little attention is the place of provincial polity and metropolitical authority across the Communion. Yet, this is a critical area of concern for Anglican ecclesiology as it directly addresses questions of authority, interdependence and catholicity. However, since at least the twentieth century, provincial polity has largely been eclipsed by, and confused with, the emergence of a dominant 'national church' polity. This confusion has become so prevalent that the word 'province' itself is used interchangeably and imprecisely to mean both an ecclesial province in its strict sense and one of the 39 'member- churches' which formally constitute the Anglican Communion, with a handful of 'extra-provincial' exceptions. The purpose of this research project is to untangle this confusion and to give a thorough account of the development of provincial polity and metropolitical authority within the Communion, tracing the historical origins of the contemporary status quo. The scope of this task is not in any way intended to be a comprehensive history of the emergence of international Anglicanism, but rather to narrowly chart the development of this particular unit of ecclesial polity, the province, through this broader narrative. The historical work of Part One in itself represents an important new contribution to Anglican Studies; however, the project aims to go further in Parts Two and Three to identify from this context key questions concerning the problems facing contemporary Anglican polity as the basis for further theological and ecclesiological reflection. Part Two examines how provincial polity has given way to an assumption of the 'national church' as the building block of the Communion. To what extent is it consonant with Anglican tradition? How is it problematic? What tensions exist with a more traditional understanding of the province? How might all this relate to wider political understandings and critiques of the 'nation- state' in an increasingly globalised world? Along with the emergence of a 'national church' ecclesiology, so too has the role of the 'Primates' been magnified. Part Three charts this development, culminating in a critique of the recent 2016 Primates' Meeting. What is the nature of primacy within Anglicanism and how does it relate to metropolitical authority? What is the right balance of honour and authority as it relates to primacy? How do Anglican understandings of primacy correspond to those of the Roman and Orthodox Communions? Finally, Part Four attempts to give some concrete focus to the preceding discussion through the illustrative example of the Anglican Church of Australia, which is frequently cited as being analogous to the Communion in having a loose federal system and resolutely autonomous dioceses. The prevalence of this 'diocesanism' has recently been criticised by the Royal Commission into Institutional Responses to Child Sexual Abuse. However, there has been a recent revival of provincial action within the Province of Victoria in response to these issues which will be evaluated to discern what the Australian example might offer toward a theologically robust and credible ecclesiology for Anglicanism into the twenty-first century.

Fino ad oggi, la storiografia occupatasi dell'atteggiamento tenuto dai vescovi italiani nel corso del primo conflitto mondiale aveva affrontato il tema in base a un’ottica essenzialmente politica, volta a stabilire la maggiore o minore adesione dell'episcopato agli ideali patriottici e il suo grado di sostegno alla guerra. In questo studio, da una parte l'analisi del discorso pastorale pubblicamente prodotto dall'episcopato italiano sulla e nella Grande Guerra, dall'altra l'analisi del discorso indirizzato all'interno della gerarchia ecclesiastica sia verso il basso (sacerdoti-soldati e chierici combattenti) sia verso l'alto (S. Sede), consentono di evidenziare le reali categorie interpretative con cui l'evento-guerra venne compreso e giudicato dai vescovi. Il quadro che ne emerge appare variamente articolato: se la retorica patriottica non mancò di manifestarsi, il discorso dominante fu tuttavia rappresentato dalla lettura provvidenzialistica del conflitto, che, culminando nell'attribuzione di un significato salvifico alla morte per la patria in guerra, svolse una funzione decisiva nel legittimare la partecipazione dei fedeli ad essa. Sede mostra l'esistenza di sfumature e di altre sensibilità, certamente importanti da registrare, ma non sufficienti a mutare il profilo complessivo emerso dall'analisi del discorso pubblico. / Until today, the historiography concerning the attitude of Italian bishops during the First World War dealt with the subject from essentially a political perspective, focused on bishops' commitment to patriotic ideals and the level of support for the war. This research takes into account, on the one hand, the analysis of the pastoral discourse made publicly by the Italian bishops about and during the «Great War», and on the other hand, the analysis of the discourse inside of the church hierarchy addressed both downwards (to priest-soldiers and fighting seminarists) and upwards (to the Holy See). Thus, the actual explanatory categories by which the war-event was understood and judged by bishops are revealed. The picture that emerges is heterogeneous: beyond patriotic rhetoric, the most dominant finding is represented by providential reading of the conflict. By attaching a redemptive meaning to death from fighting for one's country, it proved to be a decisive factor in legitimising the participation of the faithful. The analysis of the correspondence between the bishops and fighting seminarists, and between the bishops and the Holy See demonstrates the existence of different tones and sensibilities. Although worth recording, they do not seem to change the overall picture that the public discourse displays.

Experiments of ethics and economic behavior

The dissertation employs laboratory experimental methodology to study decision-making when people face trade-offs between ethical and economic values. More explicitly, the three chapters investigate 1) consumer behaviour when a substantially equivalent version of a product is more expensive because it was produced without child labour, 2) the interaction between an expert advisor and an ignorant decision-maker, when the former may gain from lying and the latter has to decide whether or not to trust in the advice, and 3) fairness in divisions of an economic gain between two people who were both involved in creating the gain, but only one of them provided real effort. Here, a focus is on the impact of power structure, i.e. who decides, on divisions and fairness judgments. All studies discuss implications of experimental behaviour for market and business domains. In addition, the thesis emphasizes ethical theories as complementary to normative benchmark from economic and psychological theory. / La tesis utiliza una metodología experimental para investigar las decisiones de los individuos cuando hay un conflicto entre valores éticos y económicos. Mas específicamente, los tres capítulos investigan sobre 1) el comportamiento del consumidor cuando se enfrenta a dos versiones de un mismo producto, siendo una de ellas más cara por ser producida sin trabajo infantil, 2) la interacción entre un agente experto y un agente desinformado que debe tomar una decisión confiando o no en el consejo del experto, el cuál puede mentir para ganar más dinero, y 3) el reparto justo de una ganancia económica entre dos personas de las cuales sólo una ha contribuido trabajando en un ejercicio. Este último estudio se centra en el impacto de la estructura de poder, es decir quién decide, en el reparto y en los juicios de que es lo justo. Los estudios analizan las implicaciones del comportamiento experimental sobre los mercados y las empresas. Protecting Eritrean refugees' access to basic human rights in Ethiopia: an analysis of Ethiopian refugee law

Eritrean refugees are compelled to flee their country mainly to avoid forced conscription into indefinite military service, arbitrary arrest and detention for prolonged periods without trial. The majority of Eritrean refugees are young people, who leave their country in search of a better life and sources of livelihoods. The mass migration of Eritrean refugees has started to have adverse effects on the country’s socio-economic landscape. The main destination and country of refuge for the majority of Eritrean refugees is Ethiopia. Although no serious violations of human rights have been reported among Eritrean refugees living in Ethiopia, it a well-known fact that the Ethiopian Government has not fully extended the internationally accepted rights of those who have been forced to flee their own states, to refugees. For example, freedom of movement for refugees is restricted, which is obviously compounded by the encampment policy, which requires that all refugees should be confined to designated refugee camps. This situation seriously undermines the UNHCR’s efforts to enhance refugees’ self-reliance, independence, and chances of local integration. There has not been much research undertaken regarding the Ethiopian Government’s legal framework on refugees and its impact on the protection of the rights of refugees. In 2014, Ethiopia hosted the largest number of refugees in Africa. This phenomenon was largely attributed to the Ethiopian Government’s ‘open door’ policy towards refugees. The present study is an attempt to critically examine Ethiopian refugee law and determine the extent to which the national laws protect the rights of refugees. Although the study is limited in scope to the situation of Eritrean refugees, the principles and standards of treatment discussed apply to all refugees living in Ethiopia. / Public, Constitutional and International Law / LL.
