Resocializing and repairing homies within the Texas Prison System : a case study on security threat group management, administrative segregation, prison gang renunciation and safety for all

This research is a case study focused on the resocialization of prison gang members through the lens of the Texas Department of Criminal Justice’s (TDCJ) Gang Renouncement and Disassociation (GRAD) process, a nine-month, three-phase voluntary process whereby confirmed prison gang, or Security Threat Group (STG), members renounce their gang membership and disassociate from the gang while still incarcerated. The TDCJ implemented its gang renunciation process to relinquish its dependence on segregating confirmed prison gang members and to provide them a way to transition out of segregation. The GRAD process has been in place since 2000 with more than 2,600 offenders completing it, but little information, other than anecdotal evidence, is available to support or disprove its success or effectiveness at de-ganging and resocializing prison gang members for the long haul. Interviews were conducted with 16 individuals, including GRAD correctional officers and instructors, and law enforcement officers with known expertise and knowledge of prison gang investigations. A limited amount of extant aggregate-level data was provided by TDCJ to supplement the narratives in the qualitative analysis. Findings suggest that the identified goals of the process differ among GRAD staff and non-GRAD staff: GRAD staff focused on offender rehabilitation, and non-GRAD staff focused on gang renunciation. It was also found that resocialization and normative change can and do occur in the closed GRAD environment; however, no tracking mechanism exists to systematically and pro-actively monitor their behavior once they are released from GRAD to determine if they have internalized these new norms and values. Based on the interviews, it also appears that the length of time spent in segregation prior to renunciation renders the offender more grateful and appreciative, and, therefore, more likely to successfully complete the process. Finally, interviews with law enforcement reveal that, upon release to the broader community, these offenders may have renounced the gang – but not the crime. The dissertation ends with limitations to the study, recommendations for future research, and implications for social work. / text

Dias de visita: uma sociologia da punição e das prisões em Itirapina

There are two prisons facilities installed at different moments, the city of Itirapina presents peculiarities in the prisons scene, therefore it is possible to observe the existence of two prisons implanted with distinct models and philosophies operating simultaneously. The first prison was founded in 1978, still under Brazilian s military dictatorship rules, and the second was founded in 1998 in a democratic context. The research realized a literature review on studies on violence, crime, punishment and social control, both globally and locally. The empirical research consisted of an archival research on local media reports, interviews with shopkeepers, prison agents and ethnography of the visit days with prisioners wives and on the meetings of the Itirapina s Community Security Council. It was possible to observe that the subjects involved with prison s daily life in the city of Itirapina, have a different perception and relationship with each one of the prisons installed, thus showing the coexistence of two distinct models of prisons policies where global perspectives cross local instances. The analysis point out a change in São Paulo State incarceration policies directives, in line with the changes that occurred worldwide, where the ideal of punishment as a social reinsertion element of prisoners, fell into decline, giving way to the policies of accelerated imprisonment turned to the control and management of prisoners, beyond the expansion of the prison system to the countryside municipalities. The presence of prisons impacts the local sociality, reordering the moral life and denying integration to the prisoners relatives in city life. / O presente trabalho buscou compreender as transformações ocorridas nas políticas penitenciárias do Estado de São Paulo nas últimas três décadas, a partir de um estudo de caso da cidade de Itirapina, localizada na região central do Estado. Com duas unidades prisionais instaladas em épocas diferentes, Itirapina apresenta particularidades, pois ali é possível observar a existência de duas penitenciárias implantas com modelos e ideais diferentes operando ao mesmo tempo. A primeira delas foi instalada no ano de 1978, ainda sob o governo militar e a segunda em 1998, já em um contexto democrático. A pesquisa realizou um levantamento bibliográfico dos estudos relacionados à violência, crime, punição e controle social, tanto no âmbito global como local. O trabalho empírico consistiu em pesquisas em arquivos da imprensa local, entrevistas com comerciantes/moradores, agentes penitenciários e na etnografia realizada na cidade nos dias de visita junto às mulheres dos presos e nas reuniões do Conselho Comunitário de Segurança. Foi possível notar que os sujeitos envolvidos com o cotidiano prisional em Itirapina percebem e se relacionam de forma distinta com cada uma das penitenciárias do município, mostrando assim a coexistência empírica de dois modelos diferentes de políticas penitenciárias, que atravessam o global e o local. As análises apontam que houve uma mudança nas diretrizes das políticas de encarceramento no estado de São Paulo, em consonância com as transformações ocorridas em um contexto global, onde o ideal da punição como elemento ressocializador dos presos entrou em declínio, dando lugar às políticas de encarceramento acelerado voltadas mais ao controle e gestão dos presos, além da expansão física do sistema prisional para municípios do interior. Através da aplicação de questionários, da presença em 6 unidades prisionais, de entrevistas abertas e semi-abertas, foi possível realizar uma investigação horizontal dos principais aspectos da vivência destes profissionais, sua percepção sobre o sistema penitenciário e consequências dessa ocupação em sua vida e saúde, física e mental. A característica preponderante do poder negociado entre presos, agentes e equipe dirigente, a precariedade das condições estruturais e técnicas e as relações estabelecidas no sistema penitenciário, contribuem significativamente para o impacto desta profissão nestes sujeitos. As condições de trabalho para os agentes penitenciários são precárias em Salvador-BA, especialmente pela falta de infra-estrutura adequada, falta de treinamento e falta de contingente e equipamentos. Dentre as possibilidades de agência destes profissionais, existe a aquisição de bens necessários ao ambiente ocupacional, a relação com os presos e as negociações de plantão. A relação entre os agentes e destes com os demais membros da equipe dirigente apresentou sinais de ambiguidade, de uma divergência muitas vezes velada, mais do que de solidariedade. Aproximadamente 50% dos participantes indicaram problemas físicos e emocionais em decorrência da profissão. Uma parcela significativa dos participantes da pesquisa reconhecem e validam os aspectos punitivos da prisão, mas apresentam pouca crença na capacidade da prisão em reduzir a violência, especialmente considerando as condições sócio-políticas e as atividades de ressocialização existentes. This research aimed to investigate the daily life in correctional institutions from the occupation of Prison Officer, permeated by the need for order and the establishment of control strategies, considering the dimensions of risk, and negotiated power crossing the prison culture, from this category of professionals in Salvador, Bahia. Through questionnaires, the presence in 6 prisons, open and semi-open interviews, it was possible to conduct an investigation of the main horizontal aspects of the experience of these professionals, their perception of the prison system and the impacts of this occupation in your life and health, physical and mental. The prevailing characteristic of negotiated power between prisoners and staff leadership team, poor structural conditions and techniques that have been identified by other authors who have researched this occupation and the relationships established in the prison system pointing to the lack of full control over the institution that are confined there, contribute significantly to the impact of the profession on these subjects. Working conditions for correctional officers are poor in Salvador-BA, especially the lack of adequate infrastructure, lack of training and lack of contingent and equipment. Among the possibilities of agency these professionals is to acquire assets needed for the the work environment, the relationship with the prisoners and negotiations on duty. The relationship between these agents and with the leading team showed signs of ambiguity from a disagreement veiled rather than solidarity. Approximately 50% of participants indicated physical and emotional problems as a result of the occupation. A significant portion of respondents recognize and validate the punitive aspects of the prison, but have little belief in the ability to reduce prison violence, especially considering the socio-political and existing activities of rehabilitation.

The study asks how young people in conflict with the law perceive the experience of hospitalization in their lives. And advocates the thesis that the imprisonment repressive socio along the lines developed in the Educational Center Patativa Assaré (CEPA) precludes the achievement of autonomy and therefore the social rehabilitation of these young people. The scope of the study was to understand the life history of juveniles in conflict with law in internal CEPA considering their perceptions about the meaning of the experience of deprivation of liberty in their trajectories. Aiming at this goal include: discussion was held about the history of assistance to children and adolescents in Brazil to identify changes and continuities characteristics of the current childcare system; problematized the concept of punishment adopted by the State and attendance system socieducativo in Ceará especially given the CEPA, and was related to the perceptions of young people about the hospital with their life stories. To develop the study used qualitative research in the form of a case study in actual field with seven young people under socio hospitalization. Data collection occurred through methodological triangulation (MINAYO, 2005) which used: oral history, recorded and transcribed in full, the field journal, and the medical records as a source of information. Data analysis was conducted by: a technique for generating structure of discourse (FLICK, 2009), which enabled the reading of narratives and communicative validation through appreciation of young people confronting the reports and court reports, contained in records, with accounts who use oral language, and content analysis (Bardin, 1997/2004), to verify the most significant categories in the speech. The results showed negative perception of hospital experience, considered a waste of time. It is suggested to strengthen measures in an open environment, effective public policies to guarantee rights and fighting vulnerable promoting autonomy and support to childcare egress system and develop strategies proposed by the theory of restorative justice. / A presente pesquisa reporta-se a um estudo doutoral efetuado, em Fortaleza-CE, com um grupo de jovens institucionalizados em unidade socioeducativa em cumprimento de medida de internação pela prática de ato qualificado como infração. O estudo questiona como os jovens em conflito com a lei percebem a experiência de internação em suas vidas. E advoga a tese de que o aprisionamento repressivo nos moldes socioeducativos desenvolvidos no Centro Educacional Patativa do Assaré (CEPA) impossibilita o alcance da autonomia e, por conseguinte, a recuperação social desses jovens. O escopo do estudo foi compreender a história de vida de jovens em conflito com a lei internos no CEPA considerando suas percepções acerca do significado da experiência de privação de liberdade em suas trajetórias. Visando contemplar esse objetivo: debateu-se acerca da história da assistência à criança e ao adolescente no Brasil para identificar as mudanças e permanências características do atual sistema socioeducativo; problematizou-se o conceito de punição adotado pelo Estado e o sistema de atendimento socieducativo no Ceará, especialmente, oferecido no CEPA; e relacionou-se as percepções dos jovens acerca da internação com as suas histórias de vida. Para o desenvolvimento do estudo utilizou-se pesquisa qualitativa sob a forma de estudo de caso em campo real com sete jovens em cumprimento de medida socioeducativa de internação. A coleta dos dados se deu por intermédio de triangulação metodológica (MINAYO, 2005) que utilizou: história oral temática, gravada e transcrita na íntegra; o diário de campo; e os prontuários, como fonte de informações. A análise dos dados foi realizada mediante: a técnica de estrutura geradora do discurso (FLICK, 2009), que possibilitou a releitura e validação comunicativa das narrativas através da apreciação dos jovens; a confrontação dos laudos judiciais e relatórios, contidos nos prontuários, com os relatos oralizados; e a análise de conteúdo (BARDIN, 1997/2004), para verificação das categorias mais significativas nas falas. Os resultados apontaram percepção negativa da experiência de internação, considerada perca de tempo. Sugere-se fortalecer medidas em meio aberto, efetivar políticas públicas para garantia de direitos e combate a situação de vulnerabilidade promovendo autonomia, bem como de apoio ao egresso do sistema socioeducativo e desenvolver estratégias propostas pela teoria da justiça restaurativa.

Representações sociais de aprisionados(as) e técnicos(as), sobre programas de ressocialização (atividades de educação e trabalho) no sistema prisional no Estado de Sergipe

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / This research analyzes the social representations of prisoners (as), coordinators and teachers about the programs of rehabilitation by means of educational and larbotheraphy activities, developed in prisons Cadeião intended for persons male and Female Prison in the city of Our lady of Perpetual Help., in view of the expansion of rights and citizenship in this segment. The historical perspective based on dialectics guided the understanding of dynamics inherent contradictions in social relations within the prison system inserted into the logic of the neoliberal state whose priority is the market relations and not human relations. As a theoretical north there are the categories: work, education, gender, prison system and training of teachers, considered relevant to subsidize the production of knowledge about the object. The subjects were approached via semi-structured interviews allow for the issuance of opinions on facts, feelings, action plans and conduct, and analysis of aspects of subjectivity, as it deals with attitudes and values towards the facts. Based on the data obtained we can say that it has similar characteristics to the Brazilian population, it consists mostly of poor with low education. Notwithstanding the day to day in the prison system, although heterogeneous, somehow have common aspects with regard to all forms of control and restraint of prisoners, in the discipline and physical structure. Although the policies are created and implemented under the aegis of recovery and rehabilitation as well as subliminally bring an ideological discourse that sustains the tripod professional work / education / assistance, certainly there are few obstacles that are faced with the implementation of criminal policy, with minimal success, given the political and societal interest in recovering. / Esta pesquisa analisa as representações sociais de presos (as), coordenadores e professores, sobre os programas de ressocialização, por meio das atividades de educacionais e de laborterapia, desenvolvidos nas unidades prisionais Cadeião destina a pessoas do sexo masculino e Presídio Feminino no município de Nossa Senhora do Socorro, tendo em vista da ampliação dos direitos e da cidadania deste segmento. A perspectiva histórica com base na dialética orientou o entendimento da dinâmica das contradições intrínsecas nas relações sociais no âmbito sistema penitenciário inserido na lógica do Estado neoliberal cuja prioridade são as relações de mercado e não as relações humanas. Como norte teórico destacam se as categorias: trabalho, educação, gênero, sistema prisional e formação de professores, consideradas relevantes para subsidiar a produção do conhecimento sobre o objeto. Os sujeitos foram abordados via entrevistas semiestruturadas por possibilitar a emissão de opiniões sobre fatos, sentimentos, planos de ação e condutas, e a análise de aspectos da subjetividade, visto que lida com atitudes e valores perante os fatos. Com base nos dados obtidos podemos dizer que a mesma apresenta características semelhantes a da população brasileira, pois é constituída em sua maior parte de pobre com baixa escolarização. Não obstante o dia a dia no sistema prisional, embora sejam eterogêneos, de certa forma apresentam aspectos comuns a todas as no tocante as formas de controle e contenção dos presos, na disciplina e na estrutura física. Embora as políticas sejam criadas e implantadas sob a égide da recuperação e da ressocialização além de trazerem de forma subliminar um discurso ideológico que sustenta no tripé trabalho profissionalização/educação/assistência, certamente não são poucos os obstáculos que se antepõem à implementação das políticas penais, com um mínimo de êxito, haja vista o interesse político e da sociedade em recuperar.

Internet in geschlossenen Haftanstalten des männlichen Erwachsenenvollzugs

Das Internet gilt als Selbstverständlichkeit und oftmals als unverzichtbar – außer im Strafvollzug. Der vorliegende Artikel geht der Frage nach, welche Online-Angebote für erwachsene, männliche Inhaftierte in geschlossenen Vollzugsanstalten in Deutschland auf welche Weise zur Verfügung stehen. Dabei erfolgt eine bundesländerübergreifende Darstellung. Um ferner einschätzen zu können, wo sich Deutschland bei dem Thema Internet und Strafvollzug positioniert, schließt ein internationaler Vergleich an. Es zeigt sich, dass im Bereich Bildung bereits einige Projekte etabliert sind, wogegen der Freizeitgestaltung mithilfe des World Wide Webs aufgrund von Sicherheitsbedenken eher mit Zurückhaltung begegnet wird. Diesbezüglich könnte sich Deutschland durch anderen Ländern und deren Lösungsmöglichkeiten inspirieren lassen. / The Internet is considered as a matter of course and is often regarded as indispensable - except in the penal system. This article examines the question of which online services are available to adult male prisoners in closed prisons in Germany and how they are at hand. This is presented in a way that transcends the boundaries of the federal states. In order to be able to assess where Germany is positioned in the topic Internet and the penal system, an international comparison will follow. It turns out that some projects have already been established in the field of education, whereas leisure activities with the help of the World Wide Web are rather treated with restraint due to security concerns. In this regard, Germany could be inspired by other countries and their possible solutions.

The diploma thesis "Yoga and its impact on the psyche of children and youth in the scope of a charity project" dealt with a current and socially important topic. The introduction explained the importance of this topic and the author's motivation for its elaboration. The first part of the thesis deals with the theoretical background, the importance of charity and social work, its history and present. The next chapter in the theoretical part was devoted to the concepts of yoga. The historical context of yoga in the Czech Republic as well as abroad was described there. Various techniques and types of yoga were emphasized, including its beneficial effects on physicality and psyche. A separate chapter was then devoted to the 1roces of re-socialization of marginal groups of children and youth along with an explanation of how to use the yoga in this 1roces. In the practical part, the survey has been placed and the respondents were introduced. As part of the charity project, the author of the thesis performed yoga and meditation exercises with children at younger school age. A quantitative survey method with ten respondents from the ranks of pedagogical and educational workers of the children's home was used for the research itself. The dissertation thesis is focused on exploring the psychological context of motivation for change in adult convicted men who participated in and completed the motivational resocialization program named "Get a job". In the first part, selected theoretical knowledge is presented. Introductory chapters (Ch. 1-3) deal with the issue of social control, context of motivation for change in the offender as well as the motivational factors in the penitentiary environment. Subsequently, a system of probation and rehabilitation programs in the Czech Republic and risk factors affecting the process of prison rehabilitation are described. The next two chapters (Ch. 4-5) capture the development of view of penitentiary intervention, provide an overview of therapeutic approaches in rehabilitation, and contain a discussion of the possibilities of verifying the effectiveness of rehabilitation programs. The second part focuses on the description of the "Get a job" rehabilitation program. O presente trabalho tem como objetivo a análise da ressocialização na execução penal, com especial destaque ao ordenamento jurídico brasileiro. Partindo de uma concepção legitimadora do sistema penal, é feito o estudo das posições fundamentais sobre a finalidade da pena desenvolvidas pelas doutrinas filosófica e penal, com ênfase à finalidade de ressocialização. Seguindo o estudo, são expostos diversos argumentos contra a idéia de ressocialização como única finalidade da pena e também contra sua viabilidade como finalidade da pena no âmbito da execução penal. Por fim, analisa-se o ideal ressocializador nos institutos da Lei de Execução Penal brasileira. São estudados os institutos da execução penal tradicionalmente ligados à idéia de ressocialização e também aqueles cujo enfoque de aplicação muda quando desprezamos tal idéia. Conclui-se o trabalho sustentando-se, em suma, que o ideal ressocializador da execução penal é incompatível com qualquer ordenamento jurídico democrático. / This study\'s goal is to analyze resocialization in corrections, with special emphasis on the Brazilian legal system. Beginning with a legitimating concept of the criminal system, a survey is conducted on the ground theories concerning the purpose of punishment as developed by the philosophical and criminal doctrines, with emphasis on the purpose of resocialization. Thereafter, a number of arguments are exposed that are against the idea of resocialization as the sole finality of punishment and also against its viability as one of the goals of punishment in corrections. Last, the resocialization ideal presented by the Brazilian corrections law is appraised. This appraisal encompasses correctional concepts traditionally related to the idea of resocialization as well as concepts whose application focus changes when one dismisses that notion.
