La contrefaçon des droits de propriété intellectuelle : étude comparative en droits français et thaïlandais / Infringement of intellectual property rights : a comparative study in french law and thai law

La contrefaçon est un phénomène de dimension internationale qui constitue aujourd’hui plus qu’hier un véritable fléau. Il apparaît que les principaux pays de provenance des contrefaçons saisies dans l’Union Européenne sont les pays d’Asie,notamment la Thaïlande. Cette recherche a pour but d'étudier les problèmes juridiques relatifs à la contrefaçon des droits de propriété intellectuelle. Ceci nous amène à poursuivre la recherche suivant deux axes. La première partie a pour but de mettre en évidence la comparaison de la définition de la contrefaçon en France et en Thaïlande. Elle se décompose en deux sous-parties, la première s'attachant à décrire la qualification de l’atteinte constitutive de contrefaçon selon les droits concernés (le terme « contrefaçon » en lui-même, tant en France qu’en Thaïlande, désignant différentes formes d’atteintes à un droit patrimonial de propriété intellectuelle). Pour identifier les atteintes constitutives de contrefaçon, notamment l’élément matériel, nous mettons l’accent sur 4 points: l’existence de la création, la diffusion de la création, l’usage de la création et la participation à l’action contrefaisante. S’agissant de l’élément intentionnel de contrefaçon, il semble présenter de multiples facettes. La seconde définit la preuve de la contrefaçon. On observe alors les moyens de preuve de la contrefaçon : la loi prévoit deux séries de mesures principales que nous pouvons regrouper en moyens de preuve en matière civile et pénale. Par ailleurs, il y a des moyens de preuve alternatifs entre les deux régimes. Ce sont des procédures douanières.La seconde partie a pour objet la prise en considération de la répression par les juridictions civiles et pénales. Elle se décompose donc en deux sous-parties : la première concerne les sanctions prononcées par les juridictions pénales. Nous avons déjà étudié la procédure pénale et les sanctions applicables à la contrefaçon. Il se trouve que la situation en Thaïlande est totalement différente de la situation française, notamment concernant la jurisprudence en matière pénale. Il semblerait que la majorité des décisions soient des sanctions prononcées par les juridictions pénales. La seconde sous-partie concerne quant à elle la réparation des atteintes à la propriété intellectuelle. Nous constatons que le préjudice subi, en France tout comme en Thaïlande constitue en un gain manqué . En outre l’évaluation du préjudice en France et en Thaïlande est difficile (préjudice subi en matière de marque, préjudice moral et fixation de l’indemnisation de peine privée). / Counterfeiting is an international problem. It appears that the main countries of origin of counterfeit goods seized in the European Union are the Asian countries, including Thailand. The research explains concisely the entire key factors to this whole problem. The research is divided into two parts; in the first place, I will outline pointly the definition of Intellectual Property Rights law (IPRs law) infringement between French and Thailand. Firstly, we focus on the structure of IPRs infringement. The term "counterfeit" in himself both in France and Thailand indicating different forms of an intellectual property rights liability conception. To identify violations constitute infringements, including the material element, we focus on four points, the existence of the creation, dissemination of the creation, use of creation, participation in the infringing action . With regard to the intentional element of infringement, iconcerned the intention of counterfeiter by the civil and criminal aspects as well as the objectives of my research would analysis on two components. First, the application of substantive issues embodies in the civil action. The second is the criminal action. The intention of counterfeiter are also intersect into two parts of action. The secondly,, we research to the proof of infringement. There provides two measures of proof in civil matters and evidence incriminal matters. In addition, there are a customs procedures as an alternative measure of proof . In the second place, we mainly concerned the IPRs law enforcement: Firstly we concerns the penalties imposed by criminal courts. We have already studied the criminal proceedings. In addition, we studied the penaltiesfor counterfeiting. We find that the criminal proceedings in Thailand is totally different from the criminal proceedings in France. In addition, we studied the penalization of IPRs law. We find that the situation in Thailand is totally different from a France, especially in criminal jurisprudence. It seems that the majority of decisions are the penalties imposed by criminal courts. Secondly were search about categories of damages and criteria for proof of damages. We find that the damages, in France as well as in Thailand, is the recovery of profit. Also the difficulty of assessing the damage, in France as well as in Thailand, are the damage of Trademark law, moral right damage and punitive damage.

Svenska crossfitutövares bakgrund, skadeprevalens & förekommande skadekategorier : En kvantitativ tvärsnittsstudie

Introduction: Crossfit is a modern sport that yearly expands worldwide. The goal of the sport is to develop performance and fitness so athletes can optimize their performance in many training categories. Furthermore, the sports WOD:s is complex, where many physiological challenges occur. The athlete is forced to push their limits of the movements, where there is a possibility for failure between the muscle fibers activation and synchronization. This can risk the sports security regarding injuries because of insufficient motor performance. A study from 2014 estimate the injury prevalence in crossfit to be 20%. Meanwhile a study from 2017 showed that the injury prevalence increased to 31,91%. Method: The objective of this study was to examine the crossfit athlete background, injury prevalence and injury categories between oktober 2016 - april 2017 in Sweden. A Brazilian survey was used in this study. The survey was modified and translated to Swedish before administered to certified crossfit facilities around the country. The method for this study used a descriptive cross-sectional design with a quantitative distribution of an online survey. Result: The common crossfit athlete is preferably 32 years or older, had a sedentary work and strict training routines with years of experience. Furthermore, 58 of 190 participants sustained a total of 87 injuries the past 6 month. This correlates to an injury prevalence of 30,5% for the crossfit athletes in Sweden. Furthermore, the most common injury categories were located on the neck/spine (21,84%), shoulder (18,39%), skeletal muscle (16,09%) and knee (16,09%). Therefore, the sport can cause different injuries throughout participation. Conclusion: Due to a high injury prevalence and a wide variation of injuries does the sport show a high injury risk, despite the athletes training experience. It takes more research to know the exact mechanisms for the injuries and how they can be prevented. / Introduktion: Crossfit är en nykommen sport somårligen växer världen över. Sporten syftar till att förbättra prestation och fitness i medvetenhet att optimera kompetens i alla fysiska kvalitéer. Dock finns det en komplexitet med att inkludera flera fysiska utmaningar i träningen. Utövaren tvingas utföra rörelserna med maximal insats för att inte misslycka samspelet mellan muskelfibrernas aktivering och synkronisering. Sådana misslyckanden kan äventyra säkerheten på grund av otillräcklig motorisk prestation. Studier från andra länder har uppmärksammat crossfitens skadeprevalens de senaste åren. Första studien från 2014 visar en prevalens på 20%, medan nyaste studien från 2017 visar en prevalens på 31,91%. Syfte: Denna studie har undersökt Sveriges crossfitutövares bakgrund, skadeprevalens och skadekategorier mellan oktober 2016 t.o.m. april 2017. Metod: Studien har använt en kvantitativ tvärsnittsstudie genom elektroniska enkäter. Enkäten har ursprung från en Brasiliansk studie som modifierades till svenska. Enkäten blev e-postad till Sveriges certifierade anläggningar i syfte att vidarebefordra enkäten till utövarna. Resultat: Studien bygger på 190 fullständiga enkätsvar som har generaliserats till Sveriges crossfitutövare. Resultatet visade att den generella crossfitutövaren ofta är över 32 år, har ett stillasittande yrke samt strikta träningsrutiner och många års träningserfarenheter, både inom och utanför crossfit. Skadeprevalensen visade att 30,5% av utövarna hade skadat sig de senaste 6 månaderna, då skadorna var lokaliserat på flera delar av kroppen. Vanligaste var nack-/rygg-(21,84%), axel-(18,39%), muskel-(16,09%) och knäskada (16,09%). Slutsats: Studien visade att Crossfitutgör en skaderisk trots erfaren träningsbakgrund. Men det krävs utförligare forskning för att kunna tyda de exakta mekanismerna för skadeuppkomsten. Det är viktigt att studier utförs för att förbättra sportens säkerhet eftersom anläggningar/organisationer ökar och forskning saknas.

The thesis deals with the concept of financial systems of municipal budgets, especially in relation to different categories of municipalities and its size. The aim is to analyze the current legal regulation in this field and suggest legislative changes that could improve its existent state. The first chapter provides the theoretical basis for the subsequent analysis as well as for the recommendations presented in further chapters. Basic terms important to municipally policy, independent competence of municipalities and delegated powers of municipalities are defined here together with the basic principles of municipality finance system. The second chapter deals with the regulation of main sources of income of municipally budgets in the Czech Republic. The content of this chapter is concerned to legislation in Act on Budgetary Allocation of Taxes, Act on Local Fees, Act on Property Tax and legal regulation of subsidies. This chapter contains the characteristics of each individual income, presents a critical evaluation of its main advantages and disadvantages in relation to municipalities finance and a short summary of the issue. Aim: The aim in this thesis is to make a analysis in one season in girls minibasketbal games in all categories to find out how often and why referees are interrupting the game. Than to make a statistic of all games and compare categories between themselves. Primary aim is to make the analysis which will show characteristic of interrupting the game and how often they are happening in game. Methods: Taking into consideration quantitative survey, my dissertation work was based on methods of secondary information collecting that implies secondary statistical analysis and observation with taking records down. Results: In average there are 98,14 interrupting in game of minibasketbal from referee. The travelling and ball outside of playcourt are the most often violations. There are differences between categories. Title: Sports training assessment of the Czech record holder in the sprint events in the youth categories Objectives: The main objective of the thesis is monitoring and assessment of selected general training indicators, special training indicators and control tests during the four-year sports training period of a young sprinter in the category of 15 years and the category of 17 years. Results of the selected training indicators and the control tests were compared. Methods: In the present thesis the method of observation and the content analysis of training documents are used. The training documents are obtained from the coach of the observed individual. The general training indicators, the special training indicators and the control tests are selected from the training documents, which are evaluated by the basic statistical procedures and subsequently they are composed to the tables, charts and comments. Results: Due to the set plan of the thesis, we recorded during the four-year period an annual increase in the volume of the general training indicators of M.B. The volume of load is increasing in all the selected special training indicators. The diploma thesis concerns about the presentation of gramatical verbal categories, mostly verbal aspect, mood and tense. First part follows the verbal aspect. Its presentation in grammar, text and activity books for foreigners is not neither sufficient nor comprehensive or systematic. The second section deals with verbal mood. The way of its explanation in lessons is not sufficient either, for example different explanation of imperative formation, the absence of description of using conditional in communication etc. The third chapter observes verbal tense as well in grammar, text and activity books for foreigners. Its description is also unsatisfactory. The questionnaire is addressed to teachers of Czech as a foreign language with different degree of experience and it conducts a survey of differences, difficulties of explanation, different point of view of educational materials and necessity to complete them. We formulate linguistic-didactic recommendation for explanation of those three grammatical verbal categories on the basis of found difficulties and contradictions. The first part of this thesis is focused on the literature review that is concerned with Burnout syndrome. The work analyses the development of the burnout concept from the early start in 70th of the 20th century till present-day. It covers major topics that include the definition of the Burnout Syndrome, the difference among Burnout Syndrome and other mental states, signs, symptoms, diagnostics and phases of the Burnout Syndrome and last but least the analysis of the factors, that contribute to formation of the Burnout Syndrome. The factors are divided into two categories, the first are external and the other are internal. The second part of thesis consists of the empirical research. The research examines the difference in copying with Burnout Syndrome between the two groups, where the first group represents psychiatrists, psychologists, psychotherapists who work with clients and the other group, that represents IT specialists, who minimally need to deal their job with people. The empirical part provides the differences between scores of these two groups in SMBM (Shirom-Melamed scale), LET (Life Engagement Test) and ICL (Interpersonal Check List). Every day we are exposed to huge amounts of visual stimuli (scenes). However, i tis not yet clear how accurately these scenes are stored and remembered, and what is the role of detail relative to the memory for the whole image. More specifically, to what extent the details are remembered and to what extent we extrapolate the unseen content from the presented details. We used fragmented scenes (broken to 4x4 grids) to investigate this question. Fragmented scenes were composed of three different theme categories (indoor, natural, man-made), each with different number of presented patches (3, 5 and 8). Our main research question is, whether there is any relationship between the number of presented patches and the ability to recognize which patches were presented and which were not (but still patches from the same photograph). In analysis we focus on Signal Detection Theory characteristics, mainly memory sensitivity (d') and bias. We run two experiments and in both the highest scores for (d') were for 3 patches (Exp.1: d'(n3) = 0,67; Exp.2: d'(n3) = 0,66) with bias towards negative answers (Exp.1: c(n3) = 0,27; Exp.2: c(n3) = 0,16). Para verificar como a noção de categoria é utilizada historicamente nas linguagens documentárias, partimos de uma breve sistematização das propostas de categorização na filosofia, tal como ela se apresenta em Aristóteles, Kant e Wittgenstein, na semântica cognitiva, segundo Lakoff, com base em Rosch, e na sociologia do conhecimento, com Mauss. Analisamos, em seguida, reflexões feitas sobre a categorização nas linguagens documentárias realizadas por autores clássicos da Biblioteconomia - Shera, Dahlberg, Piedade, Fonseca, Grolier - e pelos autores contemporâneos - Blair e Iyer. O levantamento permitiu verificar que as noções de categoria e de categorização, embora nem sempre trabalhadas de modo explícito na literatura da Biblioteconomia e Ciência da Informação, permeiam os princípios de elaboração das linguagens documentárias refletindo, de certo modo, as várias formas de conceber os conceitos. Os sistemas enciclopédicos de classificação tendem a utilizar o conceito a partir de Aristóteles, aplicando-o prioritariamente como noção de classe que se divide, de modo apriorístico e sucessivo, em gêneros e espécies etc., procedimento que se altera gradativamente por influência de Kant, quando a noção passa a privilegiar as propriedades dos objetos e fenômenos. Atualmente existe uma tendência fugaz de categorização nas linguagens documentárias de acordo com as variações socioculturais, enfatizando as funções e locais onde estas variações ocorrem. Este procedimento confere maior flexibilidade à linguagem documentária. / In order to find out how the concept of category is historically used in documentary language we start from a limited systematization of philosophy categorization as proposed by Aristotle, Kant and Wittgenstein, the cognitive semantic categorization according to Lakoff who based his proposal on Rosch, and in knowledge sociology as per Mauss. We then proceed to analyze categorization of documentary language as presented by Librarianship classic authors such as Shera, Dahlberg, Piedade, Fonseca, and Grolier. We also looked into the contemporary authors Blair and Iyer. The investigation allowed us to see that although not always apparent in the literature of Librarianship and Information Science, the notion of category and categorization is implicit in the principles of documentary language elaboration which influences the several ways of elaborating concepts. The encyclopedic classification systems have a tendency of utilizing concepts according to Aristotle, applying it as a notion of class which breaks down according to priority, successiveness, genre, type, etc. This classification style was gradually altered by Kant, where the concept of category and categorization first emphasizes the properties of objects and phenomena. Today we see a brief tendency to categorizing documentary language according to social and cultural variations, observing the functions and sites where the processes occur. This tendency allows more flexibility to documentary language.
