La notion de mutualisation des services des collectivités territoriales / The notion of pooling of services of local authorities

La recherche de coopération entre collectivités territoriales est ancienne. Depuis la création de ces institutions décentralisées, ces dernières, encouragées par le législateur, ont largement participé au développement de procédés juridiques coopératifs dont la mutualisation des services fait partie intégrante. Plusieurs procédés juridiques permettant la coopération entre collectivités ont vu le jour au fil des réformes relatives à la décentralisation ; tout d’abord par la création d’intermédiaires permettant d’assurer ces coopérations, puis par la possibilité pour les personnes publiques locales de mettre en oeuvre leurs propres coopérations. Par ailleurs, l’intérêt du droit de l’Union européenne pour les contrats entre personnes publiques s’est porté par ricochet sur les procédés de mutualisation des services, impactant les dispositifs nationaux. Un droit spécifique se développe ainsi autour de la notion doctrinale de mutualisation des services. Pour autant, la grande hétérogénéité des outils juridiques permettant la mutualisation des services et la constante évolution de leurs régimes juridiques rendent difficile un regard ordonné sur ces modes de gestion coopératifs, et sur la nature même de cette notion de mutualisation des services. / The research on cooperation between local authorities goes back a long way. Since the creation of decentralized institution, motivated by the legislator, they widely took part in the development of the legal cooperative processes, pooling of services of which is an integral part. Number of legal processes may also enable the cooperation between local authorities have been built over decentralized reforms ; first and foremost through the creation of intermediate allowing the implementation of these cooperation’s, then by the possibility for local authorities to operate their own cooperation’s. Furthermore, the interest of the European Union law for the contracts between local authorities were worn by implication on pooling of services, impacting the national devices. Nowadays a specific law develops around the doctrinal notion of pooling services. The great heterogeneity of laws ‘skill allowing the pooled service and the constant evolution of legal system make difficult a measured look on these modes of cooperative management, and on the nature of this notion of pooling of services.

Managing the implementation of universal primary education policy in Ugandan primary schools

This research study sought to understand “how the implementation of universal primary education (UPE) policy in Ugandan primary schools is managed”. Furthermore, in exploring the challenges faced as they relate to UPE planning and organising, the research sought to provide evidence-based solutions in form of recommendations to address the planning and organising challenges identified. Considering the above, in order to understand how the implementation of UPE policy in Ugandan primary schools is managed, as part of the methodological procedures, the research process adopted by the researcher followed a qualitative study approach using a case study research design (collective) as the research design or strategy, and constructivism (interpretivism) as the research paradigm. As part of the triangulation of data, a review of relevant literature was conducted in combination with semi-structured individual interviews and focus group discussions with the purposively selected UPE stakeholders responsible for the management and implementation of the UPE programme in Uganda. The participants included: UPE school principals (school or implementation level); UPE policy makers (Ministry of Education and Sports officials at national level), and district education officials and local government representatives (district level). Inductive thematic analysis was used for data analysis of this research. The main findings concerning the strength of the current UPE planning and organising framework, among others, were: UPE management and implementation is executed at the national, district and school levels and each UPE stakeholder has a role; UPE implementation management is decentralised and authority is delegated to local governments; and UPE management and implementation constitutes of guidelines and directives. On the other hand, the findings concerning the UPE planning and organising weaknesses (challenges), among others, were: inadequate financial resources in form of low UPE capitation grants; the misuse and misallocation of UPE funds; the lack of consultation and involvement of frontline UPE stakeholders and the civil society in the planning and formulation of UPE policies and the lack of qualifications and skills of the UPE stakeholders responsible for the management of the implementation of the UPE programme. Considering the research findings, under decentralisation, the top-down UPE management and implementation framework that constitutes the current UPE planning and organising framework, has failed to address key UPE management and implementation challenges especially at the school level. Therefore, based on empirical and literature review findings of this research study, the management of the implementation of the UPE programme in Uganda, although it has registered some successes, it is still constrained, faces both monetary and nonmonetary challenges and is, therefore, internally and externally inefficient. In this regard, in order to address the challenges, the researcher proposes recommendations for the national, district and school levels for consideration and adoption by the Ministry of Education and Sports in order to address the bottlenecks impeding the efficient management and implementation of the UPE programme in Ugandan primary schools. In determining the recommendations and what constitutes a successful UPE planning and organising framework, the researcher considered among other things, the participants’ suggestions, and trends or lessons from international best practices. / Educational Management and Leadership / D, Phil. MEd (Educational Management) / Department of Educational Management / The aim of the study was to investigate the capacity-building of School Governing Bodies (SGBs) in the area of policy interpretation and implementation. The research was carried out in schools under Klein Letaba Circuit in the Mopani Education District, in the Limpopo Province. This was a qualitative study where the researcher used purposive sampling to select schools and participants and interviews and document analysis to collect requisite data. In analysing data collected, content analysis was used. On the basis of data analysed and interpreted, the research findings revealed that SGBs do not have the necessary capacity to interpret and implement policies in schools. This is as a result of the inadequate training that they receive during their term of office, high level of illiteracy among them and lack of monitoring and support by the Department of Basic Education (DBE). The study therefore recommends that SGBs be adequately trained in their home languages and encouraged to form cluster committees to share experiences to develop their capacity. The DBE should continuously monitor and support SGBs in the execution of their duties.

SecuRES: Secure Resource Sharing System : AN INVESTIGATION INTO USE OF PUBLIC LEDGER TECHNOLOGY TO CREATE DECENTRALIZED DIGITAL RESOURCE-SHARING SYSTEMS

The project aims at solving the problem of non-repudiation, integrity and confidentiality of data when digitally exchanging sensitive resources between parties that need to be able to trust each other without the need for a trusted third party. This is done in the framework of answering to what extent digital resources can be shared securely in a decentralized public ledger-based system compared to trust-based alternatives. A background of existing resource sharing solutions is explored which shows an abundance third party trust-based systems, but also an interest in public ledger solutions in the form of the Storj network which uses such technology, but focuses on storage rather than sharing. The proposed solution, called SecuRES, is a communication protocol based on public ledger technology which acts similar to Bitcoin. A prototype based on the protocol has been implemented which proves the ability to share encrypted files with one or several recipients through a decentralized public ledger-based network. It was concluded that the SecuRES solution could do away with the requirement of trust in third parties for all but some optional operations using external authentication services. This is done while still maintaining data integrity of a similar or greater degree to trust-based solutions and offers the additional benefits of non-repudiation, high confidentiality and high transparency from the ability to make source code and protocol documentation openly available without endangering the system. Further research is needed to investigate whether the system can scale up for widespread adoption while maintaining security and reasonable performance requirements. / Projektet ämnar lösa problemen med oförnekbarhet, integritet och konfidentialitet när man delar känsligt data mellan parter som behöver lita på varandra utan inblanding av betrodd tredje part. Detta diskuteras för att besvara till vilken omfattning digitala resurser kan delas säkert i ett decentraliserat system baserat på publika liggare jämfört med existerande tillitsbaserade alternativ. En undersökning av nuvarande resursdelningslösningar visar att det existerar många tillitsbaserade system men även en växande andel lösningar baserade på publika liggare. En intressant lösning som lyfts fram är Storj som använder sådan teknologi men fokuserar på resurslagring mer är delning. Projektets föreslagna lösning, kallad SecuRES, är ett kommunikationsprotokoll baserat på en publik liggare likt Bitcoin. En prototyp baserad på protokollet har tagits fram som visar att det är möjligt att dela krypterade filer med en eller flera mottagare genom ett decentraliserat nätverk baserat på publika liggare. Slutsatsen som dras är att SecuRES klarar sig utan betrodda tredje parter för att dela resurser medan vissa operationer kan göras mer användarvänliga genom externa autentiseringstjänster. Själva lösningen garanterar integritet av data och medför ytterligare fördelar såsom oförnekbarhet, konfidentialitet och hög transparens då man kan göra källkoden och protocoldokumentation fritt läsbar utan att utsätta systemet för fara. Vidare forskning behövs för att undersöka om systemet kan skalas upp för allmän användning och alltjämt bibehålla säkerhets- samt prestandakrav.

Para alcançar esse objetivo, o estudo está estruturado em três capítulos. Inicia-se dando noções gerais sobre o Estado Federal, para, em seguida, no segundo capítulo, trazer a lume alguns entraves que vêm causando o enfraquecimento da autonomia municipal. Auster: A service designed on the context of a surveillance society in an increasingly connected world

The privacy and surveillance issues that are consequences of the Internet of Things are the motivation and grounding for this thesis project. The Internet of Things (IoT) is a scenarioin which physical objects are able to communicate to each other and the environment, by transferring data over communication networks. The IoT allows technology to become smaller and more ubiquitous, and by being integrated in the environment around us, the world is becoming increasingly connected. Even though these developments will generally make our lives easier and more enjoyable, the Internet of Things also faces some challenges. One of these are the aforementioned privacy and surveillance issues that are the results of transferring sensitive data over communication networks. The aim of this thesis project is therefore to answer, both in a theoretical, as well as in a practical way, the following research question: How can the Internet of Things be more accessible and safe for the everyday user? Accordingly, the Auster online platform, the Auster app and the Data Obfuscation Kit were developed to provide people with the tools and knowledge to construct home automation projects themselves, as an alternative for using applications from governments and corporations alike. The aim is to create a way to endow people with the capability to exploit their talents, realise their visions and share this with a community joining forces. By enabling people to create their own home automation projects, personal data is kept in the user’s possession and the collection of data by governments and companies alike is prevented. Moreover, by giving the control over technology back to the user, creativity and innovation in the field of the Internet of Things in domestic environments are expected to increase.

No / The article aims to provide a synthesis of key discussions within scholarship that is critical of Mainstream Institutionalism. It adopts a thematic approach to chart debate and areas of convergence about key issues. The first section of the article briefly charts the rise to prominence of the mainstream 'collective action' school. Each of the themes identified as central to the alternative critical approach is then examined in turn. These are the 'homogenous community' critique, the avoidance of politics critique (further divided into ideational politics and politics of local empowerment) and the sociological critique. The article concludes by reflecting on the challenge of 'making complexity legible' that faces the nascent critical tradition in institutional analysis.

Towards sustainable development : a participatory model for the water services sector in South Africa

This study is non-empirical and its design is based on three forms of analysis: conceptualisation, theoretical justification and strategic considerations for a participatory model in the water services sector in South Africa. In terms of the conceptualisation, the study addresses the old and new paradigms of sustainable development. First, it argues that for many years the concept of sustainable development has long dominated the development discourse. Second, the theoretical justification traces the evolution and meanings of sustainable development and also patterns and trends of the legacies of colonialism and apartheid. The descriptive analysis of apartheid and colonialism suggests a new development path for inclusive people-centred development. The study therefore postulates that in the South African context, sustainable development is both a political and a historical construct. This is the basis within which sustainable development should be understood. Third, the study concludes that context plays an important part in understanding and challenging the immoral and unjust practices of colonialism and apartheid which have militated against sustainable human development. The study further provides a description of the local government and water sectors and their underpinned legislative and policy framework, and notes impressive results in the delivery of basic water supply since 1994. However, the study argues that in order for municipalities to fulfil their constitutional responsibilities as water services authorities, they need to adopt a participatory model towards sustainable development since this is currently lacking. In doing so, the water services sector needs to overcome dangers of parochialism which were more evident from the supply-driven policy of the government. The study therefore draws lessons from three Latin American countries: Chile, Bolivia and Nicaragua, and proposes a new developmental path which conforms to the principles of sustainability. This development path is represented in the form of a dynamic, diagrammatic model for participatory sustainable development. This model displays successive stages and cycles of transaction between stakeholders. The model represents a decision support system which provides a conceptual framework for the diagnosis, consolidation and analysis of information.
