Esta dissertação trata do nascimento e evolução do Fundo de Garantia do Tempo de Serviço (FGTS), seu momento histórico, sua evolução, o tratamento constitucional dado ao instituto na Constituição de 1988 e a sua efetividade através da lei 8.036/90. Analisa o tema da proteção do trabalho, demissão sem justa causa, no mundo contemporâneo, com passagens por vários países dentro de um contexto de plena globalização. A proteção do emprego no Brasil como conhecemos, através de um Fundo com natureza jurídica híbrida, com função de direito social do trabalhador no momento de sua despedida e a aplicação dos recursos das contas vinculadas em programas habitacionais, de saneamento ambiental e infraestrutura tornam o FGTS um Fundo de natureza única no mundo todo. Os investimentos realizados com recursos do FGTS são imprescindíveis para o desenvolvimento da economia brasileira, com reflexos diretos na geração de empregos e na melhoria do bem estar social, não só dos trabalhadores filiados ao sistema FGTS, mas a toda população brasileira. A Ação Direta de Inconstitucionalidade 5090/DF trata da inconstitucionalidade do índice de correção do FGTS, a Taxa Referencial (TR), informando que o índice não é apto a representar o fenômeno inflacionário e por isso deve ser considerada sua inconstitucionalidade, por ferir o direito de propriedade (art.5º, XXII, CF), a moralidade administrativa (art. 37, X) e o próprio Fundo de Garantia do Tempo de Serviço (art. 7º, III). A proposta legislativa que encerra o trabalho deve levar em consideração a natureza jurídica polivalente do FGTS, atendendo tanto quanto possível aos interesses dos cotistas do Fundo e ao mesmo tempo os tomadores de empréstimos com recursos do FGTS, não quebrando o equilíbrio econômico financeiro do Fundo. / This dissertation deals with Guarantee Fund for Time of Service (FGTS) origin and evolution, its historical moment, the treatment conferred by Brazilian Constitution of 1988 and the effectiveness provided by the law 8.036/90. It analyses employment protection, unjustified resignation on the contemporary world, according the law of many countries inserted in the context of globalization. Brazilian employment protection policy by means of a hybrid juridical nature fund, the function as laid off worker\'s social right, and investment in housing programs, environmental sanitation and infrastructure projects make FGTS a fund with unique characteristics. FGTS resources investments are indispensable to Brazilian economy development, resulting in job creation and welfare improvement for whole Brazilian population. The Direct Action of Unconstitutionality 5090/DF deals with unconstitutionality of FGTS correction index, called \"referential tax\" (TR), alleging the unfitness of this index in representing the inflationary phenomenon as cause to declare its unconstitutionality, in reason of disagreement with property right (art. 5º, XXIII, CF), administrative morality (art. 37, X), and the Guarantee Fund for Time of Service itself (art. 7º, III). The legislative proposal at the end of this dissertation considers the polyvalent juridical nature of FGTS, attending the interests of fund quotaholders and FGTS resources borrowers, and preserving its economic-financial balance.

Os dados empíricos foram organizados em três categorias: Educação no Brasil; Temáticas públicas na Educação; Ação Direta de Inconstitucionalidade 3330/DF. / The purpose of this document is to examine the University for All Program (PROUNI) through the different sociologic e legal readings presented in the 3330 / DF Direct Action of Unconstitutionality. The methodology used is the case study method, with a qualitative approach, focusing on the Direct Action of Unconstitutionality 3330 / DF, judged on May 03, 2012, by the Federal Supreme Court. In order to obtain the data, documentary sources were used, such as books, articles, theses related to the subject and access to the internet. As a result of the study it was possible to rehearse some indicators that prove to be PROUNI, while an affirmative action policy, guarantor for those who throughout the historical process were culturally excluded, could have guaranteed their rights to access and remain in higher education. Empirical data were organized into three categories: Education in Brazil; Public themes in Education; Direct Action of Unconstitutionality 3330 / DF.

A presente pesquisa intenciona, a partir do estudo teórico da composição e estruturação dos casos de omissão inconstitucional no Brasil, demonstrar que não há um padrão decisório no enfrentamento destas questões: ora o Tribunal adota postura dialógica multilateral, permitindo a emanação da norma faltante pelo órgão responsável mediante a cooperação com os demais poderes, ora adota postura unilateral, justificada pela garantia dos direitos fundamentais. Assim, ao identificar na jurisprudência do Supremo Tribunal Federal a diversidade adotada pelo Tribunal quanto à eficácia de suas decisões em sede de controle da omissão legislativa inconstitucional, e mediante a análise crítica destes casos, a proposta que se defende é a de que o método dialógico multilateral consubstancia a técnica mais eficaz e legítima para a resolução destes casos. Tem-se em vista que, ao permitir a deliberação política necessária para emanação de um ato normativo abstrato, a técnica prioriza o fortalecimento das instâncias políticas e de representação popular. O estudo dos casos do Fundo de Participação dos Estados (FPE) e da criação, incorporação, fusão e desmembramento de Municípios, julgados pelo Supremo Tribunal Federal, visam reforçar a hipótese de pesquisa, já que a complexidade quanto à composição dos interesses envolvidos impõe a utilização desta via dialógica. Nos casos de omissão legislativa inconstitucional, portanto, a atuação da Corte brasileira sugere a manutenção do diálogo entre Judiciário e demais poderes em busca de soluções eficazes, justas e legítimas a toda a sociedade. Diante desta postura, se coloca como imperativo necessário para a melhor disciplina dos casos de omissão legislativa inconstitucional a regulamentação legislativa de seus instrumentos principais, a Ação Direta de Inconstitucionalidade por Omissão e o Mandado de Injunção, para uma maior clareza e transparência quanto aos limites da Corte brasileira e do Parlamento nestas questões. Além de dar suporte à atuação do STF, a regulamentação da eficácia das decisões em controle de constitucionalidade por omissão permite a previsibilidade e o controle destes pronunciamentos. / This study intends to identify the methodological diversity in the jurisprudence adopted by the Brazilian Supreme Court related to the effectiveness of the decisions in the area of controlling unconstitutional legislative omission. It is possible to see in the study of these cases that there is a standard in decision-making when addressing these issues: either the Court adopts multilateral dialogical approach with other powers, enabling emanation of the missing norms by the responsible agency, or it adopts a unilateral approach, justified by the guarantee of fundamental rights. It will be argued that the multilateral dialogical method is presented as an effective and legitimate technique, since it allows the political determination required for the emanation of an abstract normative act and the proper legislative process, strengthening the political and popular representation bodies. The case studies of the State Participation Fund (FPE) and the creation, merger and dismemberment of municipalities judged by the Brazilian Supreme Court reinforce the research hypothesis, for its complexity in the composition of the interests involved. In the case of legislative omission unconstitutional, the Brazilian Court action reinforces the maintenance of dialogue between the judiciary and other branches in search of effective, fair and legitimate solutions to all of society. Therefore, stands as imperative need for better discipline cases of legislative omission unconstitutional the legislative regulation of its main instruments, the direct action of unconstitutionality by omission and Writ of Injunction (Mandado de Injunção), for greater clarity and transparency as to the limits of the Court Brazilian and Parliament on these issues. In addition to supporting the activities of the Supreme Court, the rules in the validity of decisions by default judicial review allows predictability and control of these pronouncements.

A bridge to nowhere: British Columbia’s capitalist nature and the Carmanah Walbran War in the Woods (1988-1994)

From 1988 to 1994, the Carmanah and Walbran valleys on southern Vancouver Island emerged from obscurity to inspire international newspaper headlines, ecotage, and election platforms, and figure in British Columbia’s Commission on Resources and the Environment (CORE), the genesis of the current provincial land-use status quo. With Canada’s tallest tree, first marbled murrelet nest, and proximity to Victoria, the area’s old-growth forests became the site of a touchstone conflict in BC’s War in the Woods (ca. 1980-1995), one which resulted in Carmanah and the Upper Walbran and Lower Walbran becoming designated as Carmanah Walbran Provincial Park in 1995. The Central Walbran remains open to logging, which as recently as 2016 has incited backwoods blockades not dissimilar to those from July and August 1991, the climax of my narrative. This thesis explores how and why the Walbran land-use resolution disappointed Victoria-based environmentalists, Cowichan Lake forest workers, the Nuu-chah-nulth, and the nation-state of Qwa-Ba-Diwa, and why the fate of the watershed remains subject to debate. Analyzing the roots of BC’s wood “exploitation axis” helps contextualize why Carmanah Walbran campaigns in Cowichan Lake and Victoria failed to produce satisfactory outcomes despite significant compromises from provincial governments after much deliberation. In short, dissidence failed to engender land-use consensus because forest capitalism and its co-constitutive partner, colonialism, have since the nineteenth century crafted policy based on a conception of the world rooted in forestry-based development, a durable ontological construct against which other imaginaries of nature have had to compete. The Tree Farm Licence system brought the International Woodworkers of America into a Gomperist bargain with companies and the state after World War II, and contributed to decades of overharvesting, overoptimistic regrowth projections, and corporatization which culminated in falldown and forest community crisis before environmentalists began to shape the public discourse regarding nature in the late 1980s. A fundamental inability to produce a satisfactory vision of sustainable forestry and a narrow state narrow response—wilderness parks—to broad, diverse environmentalist demands allowed nature to remain envisioned as a store of raw material for industrial forestry. This thesis additionally seeks to problematize environmentalists’ “wilderness” narratives to elaborate how green knowledge production can act as discursive violence. Our “natures” are more than workplaces, sites for recreation, or pristine ecosystems. They are environments within which to find and make meaning. Or perhaps more accurately, nature is a symbol with which to construct narratives; narratives which, in Carmanah Walbran, often left little room for work in the woods. Environmentalists’ depictions of unpeopled nature advanced their wilderness-preservation cause at the expense of marginalizing Nuu-chah-nulth land claims, loggers’ paycheques, and ecocentric worldviews based on holistic conceptions of interconnectedness and/or radical dissent against the forest industrial complex. In short, the Carmanah Walbran War in the Woods added 16,365 hectares of new parkland, contributed (along with log exports) to the 2001 closure of the Youbou mill, the last at Cowichan Lake, and ensured that an isolated gravel road still ends at a bridge to nowhere. / Graduate / 2020-09-12

L'action directe contre les clubs de protection et d'indemnité / Direct action against protection and indemnity clubs

L'action directe contre les P&I clubs constitue l'une des principales problématiques du contentieux maritime. Relative à l'indemnisation des victimes par la voie assurantielle, l'action directe s'avère aujourd'hui impossible à mettre en œuvre contre ces institutions. En effet, les clubs de protection et d'indemnité, qui ont un fonctionnement mutualiste particulier ne laissent aucune place à l'indemnisation de la victime à travers l'action directe. Ce constat est conforté par le droit anglais qui régit le contrat d'assurance de ces institutions et qui valide l’opposabilité de la clause « pay to be paid » aux victimes. Cette impossibilité de mise en œuvre a été consacrée aux débuts des années 1990 par les juridictions anglaises, puis réaffirmée à travers le « third parties act » de 2010. Pourtant, l'organisation maritime internationale a entrepris ces dernières années, un travail d’unification de la responsabilité civile du propriétaire du navire en impliquant ces institutions dans le processus d’indemnisation à travers l’assurance obligatoire. En effet, les textes internationaux confèrent pour certains dommages assurés par les clubs de protection et d'indemnité, une action directe aux victimes, la superposant ainsi, à l'indemnisation par la voie de la responsabilité. L'OMI a été ainsi à l'initiative de la mutation de ces institutions. En dehors de l'assurance obligatoire imposée par les conventions internationales de l’OMI, la réhabilitation du mécanisme s’avère possible à travers la solution juridique que nous proposerons. L'action directe serait alors un mécanisme salvateur face au phénomène des « single ship companies » / Direct action against the P & I clubs is one of the main issues of maritime international disputes. Indeed, protection and indemnity clubs, which provides to shipowners "Indemnity" policies, requires a club member to discharge his liabilities to the injured third party before he can be indemnified by the P&I club. It results from a clause contained in the rules called "pay to be paid". Therefore, if the member cannot compensate the third party as result of insolvency, the english law does not allow the victim to bring proceedings against these institutions. Indeed, the third parties act against insurers 2010 transfers to the victim the rights of the insolvent insured against the insurer. At the same time, and regarding the legislation of England, the club is entitled to rely on the “pay to be paid” rule against the third party, which will defeat finally the claim. However, it is well known that some international conventions regarding the liability of the shipowner are conferring direct right of action against the P&I clubs. The International maritime organization does not allow these institutions, for some damages, to rely on the "pay to be paid" clause. From "indemnity insurers", the P&I club become "liability insures". Besides these conventions, this thesis will analyze the function of the direct action against P&I clubs in maritime disputes, and the legal solution which will allow any third party to sue directly the P&I clubs for the other damages

A context-aware collaborative decision making framework for combating terrorism in Africa

PhD (Business Information Systems) / Department of Business Information Systems / Collaborative Decision Making (CDM) is a never-ending challenge in complex-problem situations where multiple actors are involved. Complex-problem situations involve problems that are ill-defined, ill-structured and wicked such as terrorism. Problems of this nature usually warrant a collaborative effort between actors (organizations) with multiple skill-sets and expertise that at times might be at variance with each other. In order to address this gap, three sub-objectives were postulated from the main research objective, “To determine how optimal/effective CDM can be realized amongst counter-terrorism organizations through context-aware technologies.” Using the theory of synergetics and following deductive thematic analysis, the socio-technical nature of the terrorism problem was depicted by postulating a Digital Terrorism Ecology that consists of Open Digital Infrastructure (ODI), Digital Information Ecosystem (DIE), Digital Terrorism Enactment (DTE), Digital Capability and Digital Enslavement. Based on institutional theory and using PLS-SEM technique, Group/departmental relationships, Organizational co-operation, Organizational form, Technical infrastructure and interoperability, Information and knowledge sharing were identified as the factors influencing attainment of Optimal/effective CDM amongst counter-terrorism organizations. In order to explicate the role of context-aware technologies in enhancing CDM amongst counter-terrorism organizations, a context-aware CDM framework was developed following Design Science Research (DSR) methodology. In this study it was evident from the findings that attainment of OCDM in counter-terrorism contexts is challenging even though it is essential. Among the factors considered as possible influencers of attainment of OCDM, Organizational form (OF) was found to influence Organizational cooperation (OC) and Technical infrastructure and inter-operability (TI). Group/departmental relationships (GDR) were found to influence OF and OC. TI was found to influence OC and GDR and further, Information and knowledge sharing (IKS) was found to influence Optimal/effective CDM (OCDM). “If We Stop, the World Stops” – A study on the viability of the strike as a tool of feminist resistance in São Paulo

This study investigates how the feminist movement in the city of São Paulo, Brazil, relates to the International Women’s Strike – a transnational feminist mass strike launched by the Argentinian feminist collective Ni Una Menos in 2017. Based on a qualitative analysis of semi-structured interviews conducted with representatives of 10 feminist organizations in São Paulo, this text explores the feasibility of a feminist strike in the context of São Paulo and highlights the structural challenges in its implementation. In addition, the text employs a qualitative literature review to examine the ways in which women in São Paulo have resorted to the strike as an instrument of their resistance since the early 20th century. Theoretically drawing on the theories of direct action and institutionalization of social movements, this work constitutes a synthesis of previous debates and sheds light on the implications that the institutionalization of the Brazilian feminist movement has had on the viability of direct actions such as the feminist strike. A central finding indicates a relative consensus that the feminist movement in São Paulo must first build a massive and popular feminist movement, before an inclusive and intersectional feminist strike can be carried out.
