A study of translation strategies in Guillaume Oyono Mbia's plays

This thesis is focused on a study of translation strategies in Guillaume Oyono Mbia's plays. By using the sociological, formalistic and semiotic approaches to literary criticism to inform the analysis of the source texts and by applying descriptive models outlined within the framework of descriptive translation studies (DTS) to compare the source and target texts, the study establishes the fact that in his target texts Oyono Mbia, self-translating author, has produced a realistic and convincing portrait of his native Bulu culture and society depicted in his source texts by adopting the same default preservation and foreignizing strategy employed in his source texts. Oyono Mbia's works, his translation strategies and translational behaviour are situated in the context of the prevailing trend and attitude (from the sixties to date) of African writers writing in European languages and it is posited that this category of writers are in effect creative translators and that the strategies they use in their original compositions are the same as those outlined by translation scholars or effectively used by practitioners. These strategies enable the writer and the translator of this category of African literature to preserve the "Africanness" which is the essence and main distinguishing feature of that literature. Contrary to some scholars (cf. Bandia 1993:58) who regard the translation phenomenon evident in the creative writings of African writers writing in European languages as a process which is covert, semantic and secondary, the present study of Oyono Mbia's translation strategies clearly reveals the process as overt, communicative and primary. Taking Oyono Mbia's strategies as a case in point, this study postulates that since for the most part, the African writer writing in a European language has captured the African content and form in his original creative translation, what the translator simply needs to do is to carry over such content and form to the other European language. / Linguistics and Modern Languages / D.Litt. et Phil. Le rattachement des engins à l'Etat en droit international public (navires, aéronefs, objets spatiaux) / The connection between craft / vessels and States in public international law (ships, aircraft, space objects)

Contrairement aux autres biens meubles, les navires, les aéronefs et les objets spatiaux affectés à la navigation internationale sont rattachés à un Etat. Le lien de droit public établi entre ces engins et l’Etat est communément appelé « nationalité ». Mais ce terme n’exprime pas à leur propos une institution à tous égards identique à la nationalité des personnes. Le rattachement examiné ne repose en effet pas sur des éléments de fait (naissance, ascendance etc.), mais uniquement sur un acte administratif interne, l’immatriculation. L’étude de la pratique, notamment des conventions internationales et des législations nationales, montre clairement que – contrairement à ce qu’on soutient souvent – il n’y a pas lieu de subordonner ce rattachement à un lien effectif. Ce qui importe, compte tenu notamment du fait que ces engins évoluent dans des espaces soustraits à toute compétence territoriale, est d’identifier l’Etat qui est seul compétent à l’égard de l’« ensemble organisé » formé par le véhicule, les personnes et la cargaison à bord, et qui est responsable de ses activités. Le droit international interdit dès lors la double immatriculation, mais il laisse aux Etats le pouvoir discrétionnaire de déterminer les conditions d’attribution de leur « nationalité », sans subordonner l’opposabilité internationale de celle-ci à quelque autre exigence que ce soit. Le danger est toutefois que cela favorise un certain laxisme de l’Etat d’immatriculation, ce qui exposerait au risque que des dommages graves soient causés aux personnes impliquées dans les activités de ces engins et – surtout – aux tiers. Mais ce sont les obligations internationales imposées et les droits corrélatifs reconnus dans le chef de l’Etat d’immatriculation qui sont déterminants à cet égard et non quelque mystérieuse « effectivité » du rattachement. Autrement dit, s’il n’est pas nécessaire d’imposer à l’Etat d’immatriculation des conditions internationales limitant sa liberté dans l’attribution de sa « nationalité » aux engins, il est indispensable d’exiger que celui-ci respecte ses obligations, c’est-à-dire exerce effectivement son contrôle et sa juridiction. Cette constatation se vérifie quel que soit l’engin en cause. Le rattachement créé par l’immatriculation constitue donc une institution "sui generis", commune aux navires, aéronefs et objets spatiaux et dont le régime juridique est encadré par le droit international. / Unlike any other movable property, ships, aircraft and space objects that are engaged in international navigation are linked to a State. The legal connection established between these craft/vessels and the State is commonly referred to as “nationality”. However, in this case the term does not represent an institution identical in all respects to the nationality of persons. With regard to vessels, the legal connection to a State is not based on factual elements (such as birth, descent etc.), but merely on the internal administrative act of registration. The study of State practice, notably international conventions and national laws, clearly shows that – contrary to what is often argued – there is no need to make this connection dependent on a pre-existing effective link. What matters most, given that these craft navigate in international space beyond the territorial jurisdiction of sovereign States, is to identify the State that holds sole jurisdiction over said “organized entity” consisting of the vehicle, the persons and the cargo on board and that is responsible for its activities. Public international law therefore prohibits dual registration, but leaves States free to determine the conditions under which they will confer their “nationality”, without imposing any other requirement for the opposability of this legal bond to third States. The danger is that this situation encourages laxity on the part of the States of registry and therefore creates the potential for serious damage incurred by persons involved in these vessels’ activities and – mostly – by third persons. In this regard, it is the international obligations and corresponding rights of the States of registry which are critical, and not a mysterious “effectiveness” of the legal bond. In other words, it is not necessary to impose on the State of registry any international conditions which would limit its freedom with regard to the conferral of its “nationality” upon vessels. It is however indispensable to require that said State complies with its obligations, meaning that it has to effectively exercise its jurisdiction and control over those craft. This statement holds true regardless of the craft concerned. The legal bond created by the registration therefore constitutes a "sui generis" institution, common to ships, aircraft and space objects, and whose legal regime is governed by international law.

The aim of the work is to analyze the theoretical basis of determination of the market risk premium in conditions of the national market in the Czech Republic with CAPM and practical procedures of its determination using the market data provided by Bloomberg. The work addresses some open problems of practical determination of market risk premium as a choice between historical and implied risk premium, determination of credit spread as a representative of country risk and accurate determination of the equity and bond market volatility ratio. The thesis also contains research on the cost of equity and single-factor sensitivity analysis demonstrating the significant influence of a small change in one parameter entering the calculation of the discount rate on the resulting value.

“Entity continuity” refers to recurrent transcendent experiences related to certain places (“hauntings”). The experiences are often interpreted to be due to discarnate spirits or folklore entities. Although the entity continuity experience can be regarded as religious experience, they have yet to be fully explored in science of religion. The purpose of this paper was to describe entity continuity experiences and map out the scientific discussion in order to provide a psychology of religion that provides an understanding of the phenomena. For this purpose a literature study of theories of jungian psychology, parapsychology, and described experiences was undertaken. The material was thereafter analyzed comparatively. The results show that entity continuity experiences can be understood as a form of animism and that the experiences are colored by culture, context, and visual impression. The material also shows that experiences at locations that have played host to entity continuity and poltergeist experiences are equivalent. An altered state of consciousness, a special type of personality, and distinctive environmental stimuli, the atmosphere or “feeling”, is necessary for the occurrence of these experiences. The “percipients” and/or “agents” psychic material is reflected in the atmosphere and becomes expressed as psychic manifestations in the form of entity experiences.

專門職業過去向以其負擔無限責任豎立專業形象,然英美等大型訴訟的發生反使得專業人士成了求償的「深口袋」,這正是英美有限責任合夥制度產生的濫觴。 英美的有限責任合夥立法初衷,係為律師、會計師等專業人士承擔無限責任尋求解套的途徑,而面對我國專門職業者如律師、會計師等,亦遭遇大案,面臨無限責任沈重負擔之際,本論文嘗試從英美法制,尤其是以美國法制為著眼點,尋求制度引進的可行性。事實上令專業負有限責任,在美國尚可組成專業公司或有限責任企業,然此兩種制度除了稅制考量外,也較偏向公司經營管理,甚至因為可以公開招募而容易觸動聯邦證券交易法的干預,也因此,有限責任合夥延續舊有合夥法律關係的組織特性,廣受傳統上以合夥成立的專業組織所青睞。 以美國有限責任合夥法制而言,其本質為合夥,因此其優勢為保有合夥諸多彈性自由的管理規則,賦予合夥人廣大的協議空間,另一方面使合夥人僅負有限責任,免除無限責任的負累,然反面觀之,其最爭議者在於債權人保護的疑慮,美國於2001年爆發恩隆弊案,涉案的安達信會計師事務所正是於伊利諾州註冊登記為有限責任合夥,有限責任合夥在恩隆案中於是受到前所未有的考驗,事實上在美國各州,也透過保險、獨立基金的設置甚至揭開面紗法則適用不同程度保障債權人。 相較之下,英國的有限責任合夥法制,則以公司法為其內涵,因此有限責任合夥法受到更多的管理與限制,除了內部管理沿襲合夥的規定外,在事務執行及破產清算等,均需依循公司法規的管制,在債權人保護上英國法則直接在其有限責任合夥法規定成員擔保及資產取回的機制。 本文認為在立法走向上,得借鏡美國法制,另立新法,使有限責任合夥維持其合夥本質,並賦予法人格,且加強債權人保護之配套措施,期能提供專業組織架構的另一選擇。 / Professionals such as accountants and lawyers used to keep its reputation by taking unlimited liability. However, such unlimited liability makes these professionals to be deep pockets, as the result of the frequent lawsuits in recent years. Due to this reason, adopting limited liability partnership (LLP) seems to be the solution. LLP is a form of doing business, combining the feature of a limited corporation and the flexibility of a general partnership. LLP in United Kingdom and United States all granted the privilege of limited liability to the innocent partners, also keeping their personal assets apart from the creditors’ claim. LLP is available to all types of business in UK; however, in some US states, the LLP is only available to specific licensed professionals. Because of the character of the limited liability, protecting the interest of the creditors would be the most significant problem. To solve this dilemma, US adopt several methods such as using the insurance, doctrine of piercing the veil and creating the asset segregation to balance the interest between the professionals and the creditors. In UK, the company law and insolvency law all tried to cover LLP, in order to keep the LLP’s assets as a guarantee to creditors; such laws also request to disclose important business information of prospective risks to the public. Besides, both UK and US laws require the word “LLP” must be specified in the name of any LLP organizations. In 2001, the Enron scandal was a shock to the world. Arthur Andersen, a well known LLP accounting firm which provides dishonest service for Enron, has triggered the debate of whether LLP is still appropriate. Therefore, my study is going to analyze the pros and cons of LLP in the following chapter. Because of the unlimited liability is the only choice for professionals in Taiwan, we are going to learn from the UK and US laws. As for my conclusion, it is necessary enact an LLP Act to provide an alternative to the professionals.

Presented master thesis deals with description of the gradual development and positions of the church schools in CR during the last 20 years. These schools are then complemented by the schools of theology at CR universities. This thesis is in a certain way a continuation of a bachelor thesis, successfully defended in 2007 at the School of Education of Charles University. The thesis describes in brief the history of education and pedagogy in general, church schools including. Then there are specified all the pertinent valid legal regulations for operation of church schools based on experience of the author from a managerial position of such a school for many years. The role of the general management and management of human resources on one side and the theological reflection of the church schools on the other side is discussed. In detail, the equipment of the facilities and their economy is analyzed as well as the goals and calling of these schools. In a wide spectrum of opportunities open to church schools in 21st century their potential can be used through new and fresh methods for evangelizing, mission and pastoral care.

The development and validation of a high performance model within an IT organisation

What makes one organisation good and another great? What defines high performance organisations? Which aspects within an organisation play vital roles into taking an organisation from good to great? Are some aspects more important than others, if so, which ones? These questions have been explored and researched over the years and various researchers have proposed different theories and models that impact high performance as well as definitions around high performance with mixed results. The general aim of this research was to develop and validate a High Performance Model for an IT organisation. The concept of high performance was explored in terms of how to define high performance, which high performance models and frameworks have been developed within the literature and what sustains high performance. These existing High Performance Organisation (HPO) models and frameworks were evaluated against an identified set of criteria to arrive at a definitive theoretical model of high performance. The theoretical HPO model was developed based on the evaluation of the literature reviews together with the existing HPO model of the participating IT organisation. The main purpose of the empirical research was to gather data by means of three questionnaires, over six years, which were used to statistically determine the organisational and behavioural constructs that influence High Performance in an IT organisation in South Africa. Furthermore, the researcher developed an empirical model to verify the theoretical model. A quantitative empirical research paradigm using the survey method was followed and explanatory and descriptive research was used in this study. An HPO questionnaire was developed and administered to employees. Over the six years and three questionnaire administrations, 3,451 employees participated. A new best fitting HPO model was postulated based on new constructs postulated in the factor analysis. The model indicated that Leadership, Knowledge Management – team, Strategic Focus as well as Job Satisfaction especially contributed to high performance within the participating organisation, as well as that strong relationships exist between the HPO factors. This research should contribute towards longitudinal studies on high performance as well as a comprehensive understanding of the factors that influence high performance, within South Africa but also globally. The new HPO model should assist organisations and practitioners in measuring high performance in any organisation after validation. With increased competition and globalisation organisations struggle to survive, this study can provide a roadmap for organisations to obtain and sustain high performance. / Hoe kan ‘n organisasie goeie resultate in uitnemende resultate verander? Wat maak een organisasie goed en ‘n ander een uitnemend? Hoe word hoë prestasie organisasies gedefinieer? Watter aspekte binne ‘n organisasie speel die belangrikste rol om die organisasie van goed na uitnemend te neem? Is sommige aspekte belangriker as ander, indien wel, watter? Hierdie vrae is al deur die jare heen ondersoek en nagevors. Verskeie navorsers het verskillende definisies, teorieë en modelle wat hoe prestasie beïnvloed word ontwikkel, met gemengde resultate. Die algemene doel van hierdie navorsing was om ‘n Hoë Prestasie (HP) Model vir ‘n IT organisasie te ontwikkel en te bekragtig. Die konsep van hoë prestasie word ondersoek, meer spesifiek, die definisie van hoë prestasie, watter hoë prestasie modelle en raamwerke al ontwikkel is in die literatuur en wat hou hoë prestasie in stand. Die bestaande HP modelle en raamwerke word ge-evalueer teen kriteria wat vooraf geïdentifiseer is om sodoende ‘n beslissende teoretiese model vir hoë prestasie te onwikkel. Die teoretiese HP model was ontwikkel op grond van literatuur evaluasies, tesame met die bestaande HP model van die deelnemende IT organisasie. Die hoofdoel van die empiriese navorsing was om data te versamel deur middel van drie vraelyste, oor ‘n tydperk van ses jaar, wat gebruik is om te bepaal watter organisasie- en gedragsveranderlikes beïnvloed hoë prestasie in die deelnemende Suid-Afrikaanse IT organisasie. Die navorser het ook ‘n empiriese model ontwikkel om die teoretiese model te verifieer. ‘n Kwantitatiewe empiriese navorsingsparadigma, insluitend die vraelysmetode, was gevolg in hierdie navorsingstudie, sowel as verklarende en bevestigende navorsing. ‘n HP vraelys was ontwikkel en geadministreer. Gedurende die ses jaar en drie vraelys administrasies, het 3,451 werknemers deelgeneem. ‘n Nuwe en beter-passende HP model word gepostuleer, gebaseer op nuwe konstrukte gepostuleer in die faktoranalise. ”By the iron hand of oppression" : The performance of the parliamentary election contest in Nottingham and Middlesex 1802-1803

The aim of this thesis is to investigate how politics was done at the level of the parliamentary constituencies at the time of the treaty of Amiens 1802-1803. This is achieved through two case studies of the elections in Middlesex and Nottingham, which are investigated as social practices. This thesis argues that understandings of masculinity and national identity, as well as questions about the nature of the constitution and citizen rights were central to participants in the extraparliamentary political process. Collective emotions were also highly important in the process of mobilising political support, and this thesis emphasises that participation in these elections was a collective effort; men and women from all levels of society were significant political actors. Moreover, this thesis demonstrates the importance of competences such as knowledge about the organisation of crowds and political violence in the performance of the election.
