In the last century, with the beginning of the process of productive restructuring of capital, was instituted a new geopolitical (dis)order wherein the capital, materialized in large multinational companies, seeks to secure new areas of influence with a relative wealth of territorial resources among them, the minerals resources. In Mozambique, these companies take the name of megaprojects. And its process of territorialization that is both contradictory and excluding, is implying in the compulsory expropriation of mozambican rural communities. Hence, this study intends to understand how the political and geopolitical strategies of the insertion of Mozambique in the world circuit of mineral production commodities are developed and what are the socio-territorial implications deriving from the action of the State and the territorialization of mining megaprojects in the local communities in Nampula. Thus, the study defends the thesis that there is a geopolitical strategy of insertion of Mozambique in the world circuit of production of mineral commodities that occurs from the process of productive restructuring of capital. Within the national territory, this process is strengthened by state political strategies, especially through land and mining laws, designed to accommodate the interests of capital in the exploitation of mineral resources in the country. In the scale of local communities in Nampula province, these strategies strive to harness social consensus through persuasion of communities and traditional leaders over relative gains and social welfare arising from the exploitation of natural wealth. Of this fact, results a process of expropriation by spoliation of communitarian territories and, consequently, the precariousness of the living conditions of the communities as a result of the joint actions perpetrated by the power of the State and by the capital materialized in the mining megaprojects. To analyze this process in the scale of Nampula province, were defined the districts of Moma and Nacala-a-Velha, two districts of the province that impacted by the megaprojects of Kenmare Moma Mining and Vale respectively. The built theoretical-methodological foundation considers the territory in its dimension of totality. In other words, an exercise in theoretical reflection was allowed to allow for the historical-dialectical analysis of social relations, more specifically the relations of power and conflict that involve the political and geopolitical strategies of appropriation of the mining territories and consequent expropriation of the communities in Mozambique; from the understanding that the time is in the territory and this, in turn, in time. The results of the study made it possible to understand that given the eagerness of both capital and the state for the exploitation of mineral resources in the country, Mozambican local communities affected by mining projects are compulsively and increasingly losing ownership and control of their land and, with them, their territories, and the precariousness of their material and immaterial conditions of life, in favor of the so-called capitalist development. / A prática da atividade mineradora em Moçambique que, por sua vez, está ligada à trajetória que caracterizou o processo histórico de construção da nação moçambicana, é desde muito um fator importante de acumulação e de disputas pelo território, cujo desenvolvimento foi sempre permeado por processos de expropriação de terras das comunidades nativas e, com elas, o seu território. No último século, com o início do processo da reestruturação produtiva do capital, foi instituída uma nova (des)ordem geopolítica em que o capital, materializado nas grandes empresas multinacionais, busca assegurar novas áreas de influência com relativa riqueza de recursos territoriais, entre eles, os recursos minerais. Em Moçambique, essas empresas tomam o nome de megaprojetos. E seu processo de territorialização que é ao mesmo tempo contraditório e excludente, está implicando a expropriação compulsória das comunidades rurais moçambicanas. Daí que este estudo pretende compreender como se desenvolvem as estratégias políticas e geopolíticas de inserção de Moçambique no circuito mundial de produção de commodities minerais e quais são as implicações socioterritoriais decorrentes da ação do Estado e da territorialização dos megaprojetos de mineração nas comunidades locais da província de Nampula. Por via disso, o estudo defende a tese de que existe uma estratégia geopolítica de inserção de Moçambique no circuito mundial de produção de commodities minerais que se dá a partir do processo de reestruturação produtiva do capital. Dentro do território nacional, esse processo é fortalecido por estratégias políticas do Estado, sobretudo por meio da legislação de terra e de minas, concebidas para acomodar os interesses do capital na exploração dos recursos minerais no país. Em nível das comunidades locais da província de Nampula, essas estratégias se esforçam em amealhar consensos sociais por meio de persuasão das comunidades e das lideranças tradicionais sobre relativos ganhos e bem-estar social advindos da exploração das riquezas naturais. Desse fato, resulta um processo de expropriação por espoliação dos territórios comunitários e, consequentemente, a precarização das condições de vida das comunidades, em resultado das ações conjuntas perpetradas pelo poder do Estado e pelo capital materializado nos megaprojetos de mineração. Para analisar esse processo em nível da província de Nampula, foram definidos os distritos de Moma e Nacala-a-Velha, dois distritos da província impactados pelos megaprojetos da Kenmare Moma Mining e da Vale, respectivamente. O embasamento teórico-metodológico construído considera o território na sua dimensão de totalidade. Ou seja, privilegiou-se um exercício de reflexão teórica que permitisse a análise histórico-dialética das relações sociais, mais especificamente das relações de poder e de conflito que envolvem as estratégias políticas e geopolíticas de apropriação dos territórios de mineração e consequente expropriação das comunidades em Moçambique, a partir da compreensão de que o tempo está no território e este, por sua vez, no tempo. Os resultados do estudo permitiram compreender que dada a ânsia tanto do capital como do Estado pela exploração de recursos minerais no país, as comunidades locais moçambicanas atingidas pelos projetos de mineração estão compulsivamente e cada vez mais, perdendo a posse e controle de suas terras e com elas, os seus territórios e a precarização de suas condições de vida material e imaterial, em favor do chamado desenvolvimento capitalista.

A metrópole antitética: a relação capital-espaço e a expropriação no pantanal da zona leste / The antithetical metropolis: the capital-space relation and the expropriation in the East Zone Pantanal

Esta pesquisa considera a problemática da área denominada Pantanal da Zona Leste, região situada no leste da cidade de São Paulo que corresponde às várzeas do rio Tietê. A partir da institucionalização dos atributos ambientais na forma do Parque Várzea do Tietê se estabelece o conflito para a remoção dos moradores. Tal conflito permite analisar as condições da reprodução contemporânea baseada na relação capital-espaço. Sob a aparência do ambientalismo e da sociedade do risco, as instituições estatais e privadas operam a produção do espaço de modo que os atributos da sustentabilidade social se sobreponham ao vivido ali constituído. Por décadas, a reprodução de populações empobrecidas refletia o cotidiano espoliado em espaços infraurbanos. As metamorfoses da reprodução contemporânea impõem outra lógica para estas populações, uma vez que o espaço torna-se elemento estrutural da reprodução, esta que se relaciona à financeirização de maneira cada vez mais intensa. Assiste-se então a uma acumulação de espaço como centralidade do processo, pela possibilidade de inversões de capital para remuneração financeira, esta que, para o caso aqui estudado, torna-se dívida pública. Há, portanto, uma nova condição para a reprodução dos pobres na metrópole, que é a sua expropriação como meio para se atingir a acumulação de espaço. Tais processos se concretizam, mas o fazem de maneira velada, por meio das representações do espaço, a forma socialmente aceita que culmina nos espaços de representação como realização de todo um processo que define a reprodução contemporânea de maneira antitética, não há urbano para todos. / This research considers the problem of the area called East Zone Pantanal, a region situated in the eastern city of São Paulo that corresponds to Tietê River floodplains. From the institutionalization of environmental attributes in the form of Tietê Várzea Park establishes the conflict for the removal of the residents. Such conflict allows analyze the conditions of contemporary reproduction based on capital-space relationship. Under the guise of environmentalism and the risk society, the state and private institutions operate the production of space so that the attributes of \"social sustainability\" superimposing to been lived there constituted. For decades, the reproduction of impoverished populations reflected the quotidian despoiled in infraurban spaces. The metamorphosis of contemporary reproduction impose other logic for these populations, as space becomes structural element of reproduction, this one is related to financialization more and more intense. We are witnessing an accumulation of space as the centrality of the process, the possibility of capital investment for financial remuneration, this one, in case studied here, becomes government debt. There is therefore a new condition for the reproduction of the poor in the metropolis, which is them expropriation as a means to attain the space accumulation. Such processes are concretized, but they do so in a veiled way, through the representations of space, the mode socially accepted that culminates in the spaces of representation as the realization of a whole process that defines the contemporary reproduction of antithetical mode, \"there is no city for everyone \".

Ersättning vid marginella intrång i fastighet : Särskilt användandet av normer vid värdering av ersättningens storlek / Compensation for marginal property infringement : In particular, the use of standards when determining the amount of compensation

Huvudregeln i svensk rätt är att var och en ska ha sin egendom tryggad från övertaganden genom tvång. Den kan dock åsidosättas om det är befogat av angelägna allmänna intressen. Ledningsrätt för allmänt ändamål kan vara ett sådant intresse. Fastighetsägare som tvingas upplåta mark till ledningsrätt ska vara tillförsäkrad full ersättning för förlusten. Ersättningen ska utgå från det skadeståndsrättsliga perspektivet om oförändrad förmögenhetsställning. Fastighetsägaren ska inte förlora något på upplåtelsen. Bedömningen av skadans värde görs normalt utifrån marknadsvärdeminskningen på den berörda fastigheten. Marknadsvärdet av fastigheten före skadan jämförs med marknadsvärdet efter skadan. Marknadsvärde är dock ett teoretiskt begrepp som enbart kan bedömas, inte räknas fram med fullständig säkerhet. En konsekvens är att det vid marginella intrång är mycket svårt att värdera skadan utifrån de angivna ramarna. Värdet av det upplåtna området kan därför istället direktuppskattas. I praxis har det visats att HD dömt ut ersättning vid marginella intrång för obetydliga skador som inte varit möjliga att bedöma på annat sätt än skönsmässigt. Lantmäteriet har, för att förenkla värderingen av vissa fall av intrång, infört normer för bedömningen. Dessa normer är inte heltäckande, vilket leder till att förrättningslantmätare i den konkreta handläggningen använder metoder som tar tid och inte är kostnadseffektiva i förhållande till de ersättningsnivåer som beslutas. Det finns därför ett behov av att införa normer som förenklar handläggningen, särskilt vid marginella intrång. Vid utformningen av normer är en svår fråga vem som ska stå för osäkerheten som följer av en värdering. Är det rimligt att fastighetsägare blir något överkompenserade genom intrångsersättningen? Normer som syftar till att förenkla värderingen bör rimligtvis ha en viss säkerhetsmarginal som säkerställer att fastighetsägare som blivit utsatt för upplåtelse eller markövertagande får full kompensation.

Les projets d'urbanisme de Tokyo et les projets d'urbanisme parisiens : étude de droit de l'urbanisme comparé français et japonais / Urban projects of Tokyo and urban projects of Paris : comparative study of urbanism in France and Japan

Paris et Tokyo, les deux grandes capitales mondiales attirent les touristes, étudiants, artistes et investisseurs nationaux et étrangers. Pour faire face à leurs compétiteurs, ces deux grandes villes lancent plusieurs projets d'urbanisme. À Paris comme à Tokyo, les chantiers se trouvent dans plusieurs quartiers. Mais la procédure de l'établissement d'un plan d'urbanisme et le processus de sa réalisation sont très différents dans les deux pays. La France est un pays décentralisé comme le déclare l'article 1er de la Constitution du 4 octobre 1958 : « l'organisation de la République » est décentralisée. Le Japon est, par contre, un pays très centralisé. Les Japonais s'adaptent au pilotage directif, les Français apprécient le pilotage participatif. Le plan d'urbanisme est donc établi au niveau local en France, tandis que l'État et les départements prennent l'initiative au Japon, même si le pouvoir de l'élaboration d'un plan local d'urbanisme (Masterplan) est attribué aux collectivités publiques depuis 2000. Le Masterplan doit refléter les opinions des habitants. Mais la participation publique au Japon est plus réticente, alors qu'en France, toutes les personnes concernées peuvent participer à tous les processus de l'élaboration d'un plan d'urbanisme. Au Japon, depuis 1998, l'examen de la demande du permis de construire peut être délégué à une organisation privée, à la place d'un agent de la fonction publique territoriale. Depuis 2002, pour les mesures spéciales, le droit de l'expropriation peut être également confié à une personne morale de droit privé. Depuis 2003, le plan d'urbanisme peut être aussi proposé par les propriétaires de terrains et les opérateurs privés. L'inconvénient de la délégation de certains services aux personnes morales de droit privé, c'est le mercantilisme du projet d'urbanisme. Plusieurs immeubles de grande hauteur sont construits dans les zones commerciales localisées au centre-ville et même dans des zones résidentielles où il n'est permis de bâtir que des pavillons de faible hauteur. Les promoteurs de ces grandes constructions entrent souvent en conflit avec les habitants au voisinage, qui veulent conserver le paysage et l'environnement du quartier. À Paris, les immeubles de grande hauteur sont construits en périphérie de Paris. Depuis 2011, la limite de hauteur est fixée à 50 mètres. Les immeubles de grande hauteur permettent d'augmenter la surface totale habitable. Pour attribuer des logements aux étudiants, immigrés étrangers, gens du voyage et personnes les plus défavorisées, Paris encourage la construction de logements sociaux. À Tokyo, par contre, aucun nouveau logement social n'est construit depuis 1999 sous prétexte que la population commence à baisser. À Tokyo et à Kawasaki (voisine de Tokyo), en raison de la crise économique et de la baisse de la population des jeunes (20-30ans), les nouveaux logements ne se vendent pas bien depuis quelques années. En l'absence de plan d'urbanisme pour les habitants, les immeubles de grande hauteur qui se dressent partout gâchent le paysage. Malheureusement, au Japon, les tribunaux protègent rarement les intérêts privés des habitants. À la différence de la France, il n'existe pas de tribunaux administratifs qui soient compétents pour tout litige avec l'administration. Au Japon, les requêtes sont donc déposées devant le juge judiciaire. Les juges soutiennent souvent les pouvoirs publics. Une voie de recours pour demander la suspension provisoire des décisions a été créée seulement en 2004 dans le but d'élargir la protection des intérêts privés. Le juge examine si les dommages ne sont pas trop graves pour pouvoir être réparés, c'est-à-dire, qu'il évalue si la gravité des dommages produits par la décision administrative caractérise un abus du pouvoir administratif. Dans la plupart des cas, l'administration gagne le procès. Non seulement les habitants perdent le procès, mais il arrive fréquemment que les recours ne soient pas accueillis par le tribunal (...) / Paris and Tokyo are; two world capitals which attract tourists, students, artists and foreign investors. To face their competitors, these two big cities are starting several urban planning projects. In Paris, as in Tokyo, construction takes place in several districts. However, the procedures for establishing city planning schemes and the process of their realization are very different in both countries. France is a decentralized country as proscribed the article 1 of the Constitution of 4 October 1958: «the organization of the Republic» is decentralized. Japan is, on the other hand, a very centralized country. The Japanese people find top-down organization suitable, while French people appreciate the participative approach. City planning is thus established at the local level in France, while the government and prefectures take the initiative in Japan, even if the elaboration of a local urban plan (Master plan) is attributed to the local self-governing body since 2000. Master plans have to reflect the opinions of the inhabitants. The public participates in Japan reluctantly, while in France, all the concerned persons can participate in all processes of elaboration of a local urban plan. In Japan, in spite of the centralization of power, certain powers are entrusted to private citizens. Since 1998, the examination of the application of a building permit can be delegated to a private organization. Since 2002, for certain measures, the act of expropriation can be also entrusted to a private citizen. Since 2003, city planning can also be proposed by property owners and private developers. The inconvenience created by the delegation of certain services to a private citizen is the mercantilism of the urban planning project. Several skyscrapers have been built in shopping districts located in city centers and even in residential zones where it is normally prohibited to build houses with more than 3 floors. The construction of a high-rise building often involves a dispute with neighborhoods wanting to preserve the landscape and the environment of their living area. In Paris, high-rise buildings are built on the outskirts of the city. Since 2011, the height limit permitted 50 meters. High-rise buildings increase total living space allowing more residence for students, foreign workers, travelers and underprivileged persons. Paris thus encourages the construction of local authority housing. In Tokyo, on the other hand, no new local authority housing has been built since 1999 on the pretext of a decrease in the population. In Tokyo and Kawasaki (a neighboring city to Tokyo), new housing has not been able to sell because of the economic crisis and the decrease in the younger population (20-30 years old). Without city planning for the inhabitants, the skyscrapers built everywhere spoil the landscape. Unfortunately, in Japan, the courts rarely protect the interests of the inhabitants. There are no administrative courts which are competent for any dispute with the administration. In Japan, a civil suit is filed. Judges often support the public authority. A way of appeal for the temporary suspension was created in 2004 with the aim of widening the protection of private interests. Judges can now investigate if the damage is not too grave to repair. They consider if the importance of the damage produced by the administrative decision is great enough to overtake the right of discretion or abuse of the administrative power. Nevertheless, in most cases, the administration wins at trial. Not only do the inhabitants usually lose their trial, but also many trials are simply refused by the court because of a lack of interest to act. As a consequence, several urban planning projects in the region in Tokyo region de not take into consideration the interest of the inhabitants.

A Marxist Reading Of Things Fall Apart In The Esl Classrom : Exploring Colonial Socio-economic Exploitation in the Nigerian Context

This thesis aims to explore how a critical reading of the novel Things Fall Apart (1958) can provide valuable perspective for educators and students when examining socio-economic issues in  a colonial context in the ESL classroom. The main issues being analysed are how the novel reveals and explores socio-economic forms of exploitation under colonialism, and how a critical reading of the novel can be used in teaching to inform and persuade learners about social injustices. To show this, the essay examines the novel from a marxist perspective, and more specifically by drawing on the concept of primitive accumulation to understand and explain the changes brought about by the introduction of colonial rule. The changes in this context include the Igbo community's relation to land, its socio-economic and cultural aspects as well as the introduction of trade. The discussion and analysis of the novel centre on social injustices due to land expropriation, breakdown of traditional values and customs, and economic changes brought about by the arrival of Europeans in the context of colonialism. Expanding on this, the essay also reflects on the pedagogical implications of its arguments by showing how a critical reading of Things Fall Apart might provide an opportunity for teachers to underline issues of social injustice, material, and economic forms of exploitation under colonialism and beyond. This literary analysis also discusses and reflects on the practical challenges and possibilities of teaching such issues in the ESL classroom by using the concept of critical literacy.

Expert sets according to the expertise report the amount of compensation for expropriation and expenses connected with it. It also specifies the participation and tasks of the investor, who enters the expropriation. The aim of this thesis is to take into account questionable aspects of participation of the investor and the expert in the expropriation proceedings and to adumbrate their possible solutions.

The aim of this thesis is to define the position of an expert on an expropriating proceedings and creating an expert opinion for these uses. In the theoretical part the definitions connected to expropriation and expropriating proceedings are explained. An expert activity and an expert opinion are defined in other chapters in the theoretical part. Last two chapters deal with transportation infrastructure and evaluating of the immovable assets where there are the established price, the common price and the ways of evaluating. The practical part of the thesis is devoted to the expert opinion in expropriating proceedings. The established price, the standart price of expropriated immovable assests and compensation for moving are set in a comparing way within the expert opinion.

Zur Konkretisierung der Privatnützigkeit von Bodenordnungsverfahren

Die höchstrichterliche Rechtsprechung von BGH und BVerwG und die darauf aufbauende Fachliteratur führen aus, daß eine Umlegung oder eine Flurbereinigung privatnützig seien und aus diesem Grund eine Inhaltsbestimmung darstellen würden; die Enteignung sei im Gegensatz dazu durch ihre Fremdnützigkeit gekennzeichnet. Dabei wird die Privatnützigkeit durch das „wohlverstandene Interesse der Eigentümer“ und den „wirtschaftlich vernünftig denkenden Eigentümer“ beschrieben. Diese Denkweise spielt nach wie vor die entscheidende Rolle, wenn ein Bodenordnungsinstrument für die Bewältigung einer Bodenordnungsaufgabe ausgewählt wird. Das BVerfG hat die Baulandumlegung ebenfalls als eine Inhalts- und Schrankenbestimmung eingeordnet. Das Gericht hat jedoch eine von der oben beschriebenen abweichende Argumentation gewählt und die Einordnung der Umlegung in Art. 14 GG anhand der aktuellen Eigentumsdogmatik vorgenommen. Demnach findet während der Umlegung wie bei der Enteignung ein Entzug von Eigentum statt. Beide Instrumente werden jedoch nicht über die Schwere des Eigentumseingriffs voneinander unterschieden, sondern anhand des Zwecks des Eigentumsentzugs. Ob die Umlegung jedoch privatnützig zu sein hat, spielt im Urteil des BVerfG keine Rolle, da dieses Kriterium eher materiellen Charakter hat. Dieser Umstand bildete den Ausgangspunkt für die vorgelegte Arbeit, nämlich ob der Aspekt der Privatnützigkeit trotzdem noch eine Rolle bei der Wahl des Bodenordnungsverfahrens spielt oder zu verwerfen ist. Dafür wurde zunächst die Eigentumsdogmatik des BVerfG im Vergleich zur Rechtsprechung des BGH und des BVerwG eingehend ausgewertet. Später fand auch noch eine Fokussierung auf die Rechtsprechung statt, die sich unmittelbar mit der Umlegung bzw. der Flurbereinigung befaßt. Diese, für eine ingenieurwissenschaftliche Arbeit ungewöhnlich tiefgründige, Auseinandersetzung mit der Eigentumsdogmatik war notwendig, da nur so eine Annäherung an die Thematik der Privatnützigkeit möglich war. Außerdem werden Bodenordnungsverfahren nach dem BauGB oder dem FlurbG in der Regel von Vermessungsingenieuren durchgeführt, und diese müssen ja auch das geeignete Bodenordnungsverfahren auswählen. Die Annäherung an das, sich gegenseitig ausschließende, Begriffspaar „privatnützig“ und „fremdnützig“ wurde in rechtsprechungsbezogener, in eigentumsbezogener, in philosophischer und in planungsbezogener Hinsicht durchgeführt. Im Ergebnis wurden dem Begriff „privatnützig“ insbesondere die Attribute der „eigenen Wertschöpfung“ und der „Umsetzbarkeit der Nutzung in eigener Person“ zugeordnet, und zwar aus Sicht des jeweiligen Grundstückseigentümers. Dies korrespondiert auch mit der Rechtsprechung des BVerfG zur Baulandumlegung, wo ein Bezug zur Baubefugnis aus Sicht des Betroffenen gezogen wird. Anhand der Kombination der Rechtsprechung und der Ausgestaltung des Begriffspaars „privatnützig“ und „fremdnützig“ wurde ein Untersuchungsschema aufgestellt, nach dem beispielhafte Verfahren der städtischen und agrarischen Bodenordnung analysiert wurden. Dieses Schema sieht eine Vorverlagerung der Untersuchung der Privat- und der Fremdnützigkeit von der Ebene der Bodenordnung in die Planungsebene vor. Dafür werden der Adressat der Planung, der Anteil und die Funktion öffentlicher Gemeinbedarfsflächen sowie die Möglichkeiten und Grenzen der Landzuteilung in einem künftigen Bodenordnungsverfahren analysiert. Daraus sind dann Schlüsse zu ziehen, wie die Bodenordnungsaufgabe zu lösen ist. Liegt eine insgesamt privatnützige Planung vor, ist die Bodenordnung in jedem Fall im Rahmen einer Inhaltsbestimmung des Eigentums lösbar. Dazu gehören insbesondere auch die Erschließungsflächen für die Umsetzung einer privatnützigen Planung. Im Fall einer fremdnützigen Planung verbleibt die Enteignung. Dafür wurden jedoch Möglichkeiten entwickelt, nach denen die Enteignung selbst in ein inhaltsbestimmendes Bodenordnungsinstrument eingebettet werden kann. Anhand der Schlüsse aus den untersuchten Bodenordnungsverfahren wurden schließlich ein Schema für die Wahl des geeigneten Bodenordnungsverfahrens entwickelt sowie Empfehlungen für die Weiterentwicklung der gesetzlichen Grundlagen getroffen. / The supreme courts administration of justice of BGH and BVerwG and the professional literature, building up on it, explain that a reallocation or a land consolidation are serving private interests and that because of this these instruments are contents and barriers regulations; the expropriation is by contrast marked by its common utility. Besides, the private utility is described by its “well-understood interest of the owner” and “the economically rationally thinking owner”. This way of thinking still plays the determining role if a land division instrument is selected for the coping of a land division job. The BVerfG has also arranged the reallocation as a contents and barriers regulation. Nevertheless, the court has chosen an argumentation which deviates from the described ones on top to classify the reallocation into art. 14 GG with the help of the topical proprietary dogmatics. Therefore, a denial of property takes place during the reallocation like with the expropriation. Nevertheless, both instruments are distinguished not about the gravity of the proprietary intervention of each other, but with the help of the purpose of the proprietary denial. Whether the reallocation has to be serving private interests, nevertheless, plays no role in the judgement of the BVerfG, because this criterion has rather material character. This fact formed the starting point for the presented work, namely whether the aspect of the private utility plays, nevertheless, one more role with a choice of the land division procedure or is to be rejected. For that the proprietary dogmatics of the BVerfG was evaluated first in comparison to the administration of BGH and the BVerwG thoroughly. Later a focusing took place on the administration of justice which deals immediately with the reallocation or the land consolidation. This, for an engineer-scientific work unusually profound, discussion with the proprietary dogmatics was necessary, because only that way an approach to the topic of the private utility was possible. Moreover, land division procedures according to the BauGB or the FlurbG are operated by measurement engineers, and these must select also the suitable land division procedure. The approach to this, mutually excluding, concept pair \"serving private interests\" and \"serving common interests\" was carried out in administration of justice-related, in property-related, in philosophical and in planning-related regard. In the result in particular the attributes “own added value” and “feasibility of the use in person” were assigned to the concept “serving private interests”, namely from the point of view of the respective property owner. This also corresponds with the administration of justice of the BVerfG to the reallocation where a relation is pulled to the construction competence from the point of view of the affected person. With the help of the combination of the administration of justice and the arrangement of the concept pair \"serving private interests\" and \"serving common interests\" an investigation pattern was put up to analyse exemplary procedures of urban and agrarian land divisions. This pattern intends a forward displacement of the investigation of the private and the common utility from the level of the land division into the planning level. Then from this conclusions are to be drawn as the land division job is to be solved. If a planning is given which is all together “serving private interests”, the land division is solvable, in any case, within the scope of a contents and barriers regulation. The development surfaces in particular also belong to it for the conversion of a planning which is “serving private interests”. In the case of a planning which is “serving common interests”, remains the expropriation. Nevertheless, for this case the possibilities after which the expropriation itself can be embedded into a land division instrument that is a contents regulation were developed. With the help of the results from the examined land division procedures were developed, finally, a pattern for the choice of the suitable land division procedure as well as recommendations were made to the advancement of the legal bases.

The theme of this diploma theses is surveillance capitalism. Its aim is to provide comprehensive insight into the key aspects of this phenomenon that has a significant impact on the global economy and society as a whole. The first part of the thesis deals with the topic of information society and its transformational effect on the economical sphere and surveillance system. It reveals some of the key issues following this new state of society and postmodern surveillance practices as well. The second part of the thesis aims to define what is meant by surveillance capitalism, to uncover the principles and the economic imperatives that dominate various stages of the development and finally to outline the threats and ethical problems this new logic of assimilation has brought in.

Formulations and Exact Solution Methods For a Class of New Continous Covering Problems

<p>This thesis is devoted to introducing new problem formulations and exact solution methods for a class of continuous covering location models. The manuscript includes three self-contained studies which are organized as in the following. </p> <p> In the first study, we introduce the planar expropriation problem with non-rigid rectangular facilities which has many applications in regional planning and undesirable facility location domains. This model is proposed for determining the locations and formations of two-dimensional rectangular facilities. Based on the geometric properties of such facilities, we developed a new formulation which does not require employing distance measures. The resulting model is a mixed integer nonlinear program. For solving this new model, we derived a continuous branch-and-bound framework utilizing linear approximations for the tradeoff curve associated with the facility formation alternatives. Further, we developed new problem generation and bounding strategies suitable for this particular branch-and-bound procedure. We designed a computational study where we compared this algorithm with two well-known mixed integer nonlinear programming solvers. Computational experience showed that the branch-and-bound procedure we developed performs better than BARON and SBB both in terms of processing time and size of the branching tree.</p> <p> The second study is referred to as the planar maximal covering problem with single convex polygonal shapes and it has ample applications in transmitter location, inspection of geometric shapes and directional antenna location. In this study, we investigated maximal point containment by any convex polygonal shape in the Euclidean plane. Using a fundamental separation property of convex sets, we derived a mixed integer linear formulation for this problem. We were able to identify two types of special cuts based on the geometric properties of the shapes under study, which were later employed for developing a branch-and-cut procedure for solving this particular location model. We also evaluated the resultant bound quality after employing the afore-mentioned cuts. </p> <p> In the third study, we discuss the dynamic planar expropriation problem with single convex polygonal shapes. We showed how the basic problem formulations discussed in the first two studies extend to their diametric opposites, and further to models in higher dimensions. Subsequently, we allowed a dynamic setting where the shape under study is expected to function over a finite planning horizon and the system parameters such as the fixed point locations and expropriation costs are subject to change. The shape was permitted to relocate at the beginning of each time period according to particular relocation costs. We showed that this dynamic problem structure can be decomposed into a set of static problems under a particular vector of relocations. We discussed the solution of this model by two enumeration procedures. Subsequently, we derived an incomplete dynamic programming procedure which is suitable for this distinct problem structure. In this method, there is no need to evaluate all the branches of the branching tree and one proceeds with keeping the minimum stage cost. The evaluation of a branch is postponed until relocation takes place in the lower-level problems. With this postponing structure, the procedure turned out to be superior to the two enumeration procedures in terms of tree size. </p> / Thesis / Doctor of Philosophy (PhD)
