L’évolution de la technologie, nonobstant ses apports, peut enfreindre certains de nos droits
fondamentaux puisqu’elle se développe plus rapidement que ces derniers. Ce mémoire vise à
relever les défis que les technologies intelligentes peuvent poser tant sur la santé des
communautés que sur les droits fondamentaux. La thèse porte sur les contraintes juridiques,
présentes et à venir, notamment sur le droit à la vie privée à travers le développement et l’usage
des technologies intelligentes qui captent notre information personnelle en lien avec la santé. Plus
précisément, ce travail analyse si les bénéfices de l’accès à notre information à travers les
technologies intelligentes en vue d’améliorer la santé et la sécurité des populations surpassent les
conséquences juridiques.
Ce travail explore, entre autres, le potentiel des technologies intelligentes, leurs avantages
individuels et collectifs, notamment en matière de santé publique, et les violations des droits de
l’Homme que leur usage peut générer. Mais encore, il présente des innovations technologiques
qui permettent d’améliorer les systèmes de santé étatiques afin d’être en mesure de mieux réagir
aux futures épidémies, notamment au niveau international, comme à l’OMS. Ces données, suivies
des autres complications possibles du fait d’un usage accru des technologies intelligentes qui
restreignent notre vie privée, permettront de conclure si une telle intrusion peut être justifiée dans
une société libre et démocratique.
Finalement, ce travail regarde les limites de l’acceptabilité sociale de l’intrusion dans la vie
privée en échange à de meilleures conditions de santé afin que les organes étatiques et supraétatiques puissent prendre des décisions éclairées, sans que les droits constitutionnels soient
violés. Ce travail permettra de comprendre les enjeux que notre système judiciaire inévitablement
devra surmonter en proposant des stratégies visant la prévention des maladies et autres problèmes
de santé à travers l’usage des technologies intelligentes. Une des solutions principales proposées
est la création de bases de données nationale et internationale à l’OMS qui captent les données
des appareils intelligents portables. / The evolution of technology, notwithstanding its benefits, can negatively impact some of our
fundamental rights as it develops faster than the latter. Indeed, this thesis aims to meet challenges
generated by smart technologies and the impact they can have on the health of communities as
well as on our fundamental rights. This thesis focuses on the legal constraints, present and to
come, including the right to privacy, through the development and use of smart technologies that
seize our personal health information. More specifically, this work seeks to analyze whether the
benefits of accessing our information through smart technologies to improve the health and safety
of populations outweigh the legal consequences.
This work explores the potential of smart technologies, the interest in using them individually
and collectively, especially in the public health sector, and the human rights violations their use
can generate. Moreover, it looks at technological innovations that help improve State health
systems to be able to better respond to future epidemics, particularly at the international level,
such as at the WHO. These data, followed by other possible complications due to the increased
use of intelligent technologies that restrict our privacy, will allow us to conclude whether such an
intrusion in our right to privacy can be justified in a free and democratic society.
Finally, this work examines the limits of the social acceptability of the invasion of privacy in
exchange for better health conditions so that States and supra-State bodies can make informed
decisions, without violating constitutional rights. This work will help us understand the issues
that our judicial system will inevitably face while proposing strategies for the prevention of
diseases and other health problems through the use of smart technologies. One of the main
proposed solutions is the creation of a national and international database at the WHO generated
by the data of smart health devices.

The content of the presented thesis is the introduction of selected institutes of the laws on political parties and their enactment in the Czech Republic and the Federal Republic of Germany. The thesis is divided into two chapters. The first addresses the fundamental questions of the legal regulations on political parties in both countries. The second deals with the funding of political parties. Because this is a comparative thesis, individual legal regulations are always introduced in the first two subchapters. The third subchapter compares the most significant institutes and their possible use in the Czech law is proposed. The main points of the first chapter are especially the process of political party creation, the comparison of anchored attributes of a democracy capable of defence in the laws and last but not least also the contemplation of the possible expansion of the addressees of the right to form and join political parties and political movements, pursuant to Article 20 par. 2 of the Charter of Fundamental Rights and Freedoms, also to foreigners staying in the Czech Republic for a long time. L’objectif général de la thèse était d’une part d’étudier le rôle de l’impact des politiques menées en matière de respect du droit aux choix et aux risques dans les EHPAD/EHPA sur l’émergence des libertés des résidents et d’autre part sur le choix de leur mode de vie.La première partie de la thèse visait à étudier l’état du vieillissement, le statut des personnes âgées en France et l’influence de nos représentations sociales sur leurs comportements. L’hypothèse d’une association entre les préjugés que porte la société sur les personnes âgées et la réduction de leur autonomie a été induite.La deuxième partie de la thèse visait à mieux comprendre les possibilités d’expression des résidents en EHPAD/EHPA et quels étaient les facteurs qui permettaient leur émergence dans des lieux normalisés. Nous avons fait l’hypothèse que, quel que soit le niveau de dépendance d’une personne (physique et/ou psychique), celle-ci possédera toujours des marges de liberté dont l’expression est déterminée par des facteurs externes et internes à elle.La troisième partie de la thèse s’est intéressée aux politiques de respect du droit aux choix et aux risques des personnes âgées et aux enjeux éthiques, médicaux et sociaux que cette notion soulève. L’hypothèse d’une association entre l’application de ces politiques et un contexte organisationnel a été soulevée.Enfin, dans la dernière partie de la thèse, nous avons étudié l’impact des politiques de respect du droit aux choix et aux risques des résidents sur la perception de leur qualité de vie. Pour cela, nous avons coproduit une grille d’indicateurs nous permettant de distinguer les institutions respectueuses des droits et des risques des personnes âgées avec des résidents. Les résultats que nous avons obtenus montrent l’importance de prendre en compte le respect et la dignité des personnes âgées tant au niveau individuel que contextuel dans l’étude des facteurs protecteurs de la qualité de vie. / The aim of this thesis was first to study how the liberty of the residents in nursing homes for elderly has been impacted by the policies led regarding the respect of the right to choose and to take risks. Secondly, we studied the impact they had on the way of living chosen by the elderly.The first part of the thesis aims at studying the state of the aging process and the status of the elderly in France and the influence of our own social representations, on their behavior. The hypothesis of a link between our Society’s prejudices on the elderly and the decrease in their autonomy is implicit.The second part of the thesis aims at better understanding the nursing homes residents’ expression possibilities. We also focused on the factors which would allow their emergence in standard places at all levels of social life.Our main hypothesis is that the dependency level of a person (physical and/or psychological) is no impediment to his or her capacity to bear in mind their liberty margin, which expression is determined by external and internal personal factors.The third part of the thesis tackles the policies put in place to respect the elderly rights to choose and take risks within their caring homes, as well as the ethical, medical and social stakes raised by this notion.The hypothesis of the link between the setting up of these policies and a certain organizational context has been emphasized.Finally, in the last part, we studied the impact the policies applied on the respect to choose and take risks had on the residents’ perception of their quality of life.An indicator grid has been co-produced to distinguish the institutions respect of their residents’ rights and risks.The results we obtained highlights the significance of taking into account the respect and the dignity of the elderly in the study of the protective factors of the quality of life, both at the individual and contextual level.

La transparence, à travers ses multiples applications par le juge européen, est érigée en principe général du droit de l’Union européenne. Ses fondements juridiques retentissent sur sa portée, impérative et supplétive, son champ d’application matériel et personnel ainsi que sur son extension progressive et sa limitation aux seuls rapports verticaux développés entre les autorités adjudicatrices et les opérateurs économiques. La transparence est rattachée directement aux libertés fondamentales des soumissionnaires potentiels dont elles assurent la protection juridique et indirectement au principe de libre concurrence par la suppression des obstacles privés à la libre circulation des activités économiques. Ainsi, au service d’une finalité immédiate, la transparence garantit l’accès à la commande publique et, au service d’une finalité médiate, elle protège les structures du marché de la commande publique. Le principe général de transparence donne alors naissance aux contrats relevant de la commande publique qui prennent le relais des contrats publics. It is attached indirectly to the principle of free competition by the elimination of private barriers to the free movement of economic activities. Thus, in the service of an immediate finality, transparency guarantees access to public procurements and, in the service of a mediate finality, it protects the market structures of public procurement. The general principle of transparency gives then rise to contracts of public order (contrats relevant de la commande publique) which take over public contracts. Instrument of integration and structural element of the internal market, this new generation of contracts materialize access to public order (commande publique), that constitutes a sector of economic activity as part of the internal market.

L'étude a pour principal objet l'identification et la définition des libertés publiques économiques au sein de la jurisprudence administrative. Au terme de cette recherche, il apparaît que la liberté d'entreprendre constitue la seule véritable liberté publique économique utilisée par le juge administratif. Elle est en effet la seule qui a pour fondement la protection de droits ou d'intérêts subjectifs liés à la personnalité juridique, en particulier celles des personnes privées. Elle recouvre deux prérogatives essentielles : l’accès à une activité économique et l’exercice d’une activité économique. Si l'expression « liberté d'entreprendre » n'est pas apparue au sein de la jurisprudence administrative mais au sein des jurisprudences constitutionnelle et européenne, il importe de ne pas se laisser abuser par les mots employés. Celle-ci est en réalité présente au sein de la jurisprudence administrative depuis fort longtemps sous l'expression « liberté du commerce et de l'industrie ». A ce titre, elle recouvre un certain nombre d'autres appellations qui varient en fonction du contexte. Même si le juge administratif considère - à l'image du juge constitutionnel ou du juge européen - qu'il s'agit d'une liberté de second rang, il n'en demeure pas moins qu'il s'agit d'une liberté de valeur constitutionnelle. La définition et la classification de la « libre concurrence » s'avèrent plus problématiques. Celle-ci recouvre deux aspects distincts :- un aspect dans lequel elle doit être envisagée comme le respect du principe d'égale concurrence, c'est-à-dire comme celui d'une déclinaison, le cas échéant rénovée, du principe d'égalité. Dans cette optique, elle peut revêtir un aspect subjectif, c’est-à-dire qu’elle protège un droit dont le fondement se trouve dans la personnalité juridique, alors même que son objet principal reste la protection du mécanisme de marché.- un aspect dans lequel elle doit être regardée comme un ordre concurrentiel. Dans cette optique, elle ne peut être assimilée à une liberté publique mais doit être envisagée comme un objectif ou un impératif d'intérêt général correspondant au bon fonctionnement concurrentiel du marché. Les prérogatives ou intérêts que les opérateurs économiques tirent de la défense de cet ordre concurrentiel ne leur sont pas accordés en raison de leur seule personnalité. Ces prérogatives et intérêts sont défendus de manière subsidiaire puisque c’est l’atteinte au fonctionnement concurrentiel du marché qui est en premier lieu et avant tout prohibée. Les prérogatives et intérêts que les opérateurs tirent de la défense de l’ordre concurrentiel trouvent leur source et leur assise dans la liberté d’entreprendre. C’est cette liberté qui octroie aux personnes morales et physiques le droit d’accéder à l’activité économique et le droit de l’exercer. La libre concurrence a pour effet de garantir et de renforcer l’effectivité de ces deux prérogatives fondamentales. / The primary purpose of this study is to identify and define economic public freedoms in administrative case law. The research shows that free enterprise is the only genuine public economic freedom relied upon by administrative judges. It is indeed the only one based on protecting the subjective rights or interests that are related to the legal personality, especially when it comes to individuals. It covers two essential rights: access to an economic activity and the running thereof. If the expression "free enterprise" was not created by the administrative judges but by the constitutional and European judges, it has however been known for a long time by administrative judges as "freedom of trade and industry." As such, it has a number of different names, which may vary depending on the context. Even if administrative judges consider – like their constitutional and European counterparts – that is it a secondary freedom, it is still a constitutional freedom.The definition and classification of "free competition" are more problematic, since such freedom covers two different aspects:- it may first be considered the respect of equal competition, as a new version of the equality principle. In this context, it can take a subjective aspect since it protects a right based on legal personality, even though its primary purpose is to protect market mechanisms.- it may also be considered as a competition system. From this perspective, it cannot be considered a public freedom but rather a goal or a requirement of general interest in the market good competitive functioning. The rights or interests of economic actors that derive from the protection of the competition system are not granted on the basis of their legal personality alone. The protection of those rights and interests in only subsidiary; interfering with free competition on the market is first and foremost prohibited. The rights and interests of economic actors in protecting the competition system have their source and guarantee in free enterprise. This freedom gives legal and natural persons the right to access and to run a business. Free competition ensures and reinforces the effectiveness of these two fundamental rights.

En s’inspirant de l’exemple des défis corporatifs, c’est-à-dire, des initiatives déployées par les sociétés pour rendre le marché de l’emploi plus accessible aux membres de groupes perçus comme marginalisés, ce mémoire cherche à analyser le conflit qui pourrait surgir au Québec entre le droit à la vie privé, protégé notamment par la Loi sur la protection des renseignements personnels dans le secteur privé et la Loi sur la protection des renseignements personnels et des documents électroniques et le besoin croissant de l’entreprise d’utiliser les données privées de leurs employés pour vendre leurs biens et services.
Dans un premier temps, ce mémoire effectue un survol des régimes de protection de la vie privée des pays qui ont le plus influencé le droit québécois et canadien soit l’Europe, les États-Unis et le Royaume Uni en soulignant leur influence sur le régime en vigueur au Québec. Dans un second temps, il soulève les entraves que posent la LPRPS et la LPRPDE à la participation de l’entreprise aux défis corporatifs. Dans un troisième temps, il explore des pistes possibles à la fois interprétatives, législatives et contentieuses afin de rendre ces lois plus accommodantes aux besoins de l’entreprise. / This essay uses the example of Industry Challenges - a technique deployed by companies to promote the hiring and advancement of certain members of society - to explore a conflict that could arise in Quebec between the individual’s right to privacy as protected by An Act Respecting the Protection of Personal Information In the Private Sector and the Personal Information Protection and Electronic Documents Act , and that of an organisation to use personal information relating to its workforce to market itself. It briefly reviews privacy protection in jurisdictions with the greatest legal influence on Quebec and Canada: the European Union, the United States and the United Kingdom (Chapter 2). It demonstrates how a blend of these influences is reflected in the Quebec and Canadian approaches to privacy and how existing privacy legislation might prevent a company from effectively and efficiently responding to Industry Challenges (Chapter 3). Finally, the last two chapters respectively explore the interpretive and legislative amendments that could be made to PPIPS and PIPEDA to enable companies to respond to Industry Challenges (Chapter 4) as well as the possible legal action a company could take on the ground that Quebec’s privacy legislation violates its right to express itself commercially under s. 2(b) of the Canadian Charter of Rights and Freedoms (Chapter 5).

Les réclamations pour dommages punitifs en vertu de la Charte des droits et libertés de
la personne se multiplient depuis plusieurs années devant les tribunaux. Pour être accueillie,
cette réclamation implique la démonstration d’une atteinte illicite et intentionnelle à un droit
ou une liberté protégé par cette charte. Les recours en responsabilité peuvent faire l’objet
d’une couverture d’assurance. Or, le Code civil du Québec prévoit spécifiquement que
l’assureur n’est pas tenu de couvrir la faute intentionnelle de l’assuré. Est-ce à dire que
l’assureur n’a pas d’obligation envers son assuré lorsque des dommages punitifs sont
réclamés? Il s’agit donc de déterminer si le concept de faute intentionnelle et celui d’atteinte
illicite et intentionnelle sont des concepts qui s’équivalent ou qu’il est nécessaire de distinguer.
Pour cette analyse, ces deux concepts seront abordés en profondeur. Il sera question de
l’origine de ces deux notions, de leurs fondements et de leur interprétation pour finalement
définir ces termes le plus précisément possible. Ces définitions permettront d’opposer ces
deux notions et de déterminer au final qu’il existe plusieurs éléments qui différencient ces
concepts, notamment à l’égard de l’intention requise, faisant en sorte qu’ils ne peuvent être
assimilés.
Cette conclusion aura un impact certain sur les obligations de l’assureur de défendre
l’assuré et d’indemniser la victime pour ses dommages compensatoires lorsqu’il existe une
réclamation en dommages punitifs et, par conséquent, l’assureur ne pourra faire reposer son
refus de défendre ou d’indemniser sur la seule base de la preuve d’une atteinte illicite et
intentionnelle. / Claims for punitive damages have proliferated over the years before the courts. For
such claim to be granted, it is required to demonstrate an unlawful and intentional interference
with any right or freedom protected by the Charter of Human Rights and Freedoms. Liability
claims can be covered by insurance. However, the Civil Code of Québec specifically provides
that the insurer is never bound to indemnify the insured’s intentional fault. Does this mean that
the insurer has no obligation towards its insured when punitive damages are sought? The
question is thus whether the concept of intentional fault and of unlawful and intentional
interference are concepts that are equivalent or that need to be distinguished.
For this analysis, the two concepts will be adressed in depth. The origin of these two
concepts, their founding principles and their interpretation will be discussed to ultimately
define these terms as precisely as possible. These definitions will then help to compare these
two concepts and determine in the end that there are several elements that differentiate these
concepts, particularly in regard to the required intent, with the result that they can not be
assimilated.
This conclusion will have a definite impact on the insurer’s obligations to defend the
insured and to indemnify the victim for compensatory damages if punitive damages are also
sought. Therefore, the insurer cannot justify its refusal to defend or indemnify solely on the
basis of the evidence of an unlawful and intentional interference.

The purpose of the thesis is to analyze the concept of the freedom of artistic creation and expression in the European Union law, in particular its recognition in primary law, above all in the Charter of Fundamental Rights of the European Union (Charter), and in the case law of the Court of Justice of the European Union (CJEU). Considering that interpretation of human rights and fundamental freedoms in the EU law is greatly based on constitutional traditions of EU member states and on the approach to these rights established within the Council of Europe, this thesis also deals with the conception of the freedom of artistic expression in constitutions of EU member states and in the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), as interpreted by the European Court of Human Rights (ECtHR). While relevant case law of the CJEU is only fragmentary, it refers systematically to the extensive case law of the ECtHR, which provides comprehensive theory of the freedom of artistic expression in Europe and provides for studying the evolution of the conception in time.
