L'intégration de la Chine dans l'Organisation mondiale du commerce

Notre thèse a pour but de réfléchir à cette question majeure, de tenter de résoudre cette impasse : le droit du commerce international contemporain a été élaboré à partir de principes libéraux pour réaliser la libre circulation des marchandises et des services (OMC, GATT, GATS…), sans toutefois tenir compte des différentes barrières culturelles internes des pays (par exemple en Chine), ni de considérations « autres que d’ordre commercial ». Comment dépasser les barrières internes ? Comment intégrer les valeurs non commerciales ? La Chine est à la fois une partie du problème et une partie de la solution à cette question. Une partie du problème en ce que les frictions entre les principes de libre circulation et les habitudes propres à une aire culturelle donnée sont particulièrement vivaces dans le cas de la Chine et font sans cesse surface dans le cadre des exigences de régulation. Une partie de la solution aussi en ce que son engagement pour les technologies vertes et les énergies renouvelables donne plus poids à la nécessité d’élargir les lois étroites du commerce pour prendre en compte les considérations autres que commerciales / This doctoral thesis will aim at addressing the following problematic issue: contemporary international trade law has been established on liberal (free trade) principles in order to allow the free movement of goods and services (WTO, GATT, GATS, etc.), without taking into account other countries internal cultural barriers (for example in China), or non-trade concerns (NTCs). How to overcome internal barriers? How to integrate non-trade concerns? China is part of the problem as well as part of the solution. On one hand frictions between global free-trade principles and local cultural habits are overwelhming present in China and continuously interfere with the requirements of trade regulation. On the other China’s involvement in green technology or renewable energies give more weigth to the necessity of extending the international trade framework to include non-trade concerns in its definition

[pt] Esta tese refere-se ao estudo, pesquisa e fundamentação teórica dos vínculos e interações entre o Design e a propriedade intelectual (PI). As criações intelectuais em Design têm características compatíveis com a maioria das modalidades de resguardo definidas na PI. Contudo, é necessário entender corretamente o fluxo que estas percorrerem no sistema legal. O pouco domínio dos seus conteúdos e de suas interações acarreta dificuldades na gestão plena das criações intelectuais utilizando-se do sistema. Para permitir a compreensão do conjunto foi desenvolvida uma classificação sistematizada (taxonomia) dos conteúdos criativos da PI permitindo uma visão panorâmica do sistema a partir das características estéticas e técnicas das criações, dos conteúdos criativos derivados e dos objetos criativos híbridos. Com a taxonomia desenvolvida foi possível identificar os conteúdos criativos mínimos relacionados com cursos superiores de conteúdos projetivos e, especificamente, com habilitações e especialidades em Design. Foram tratados também dos espaços de interação entre o Design e a PI quando da coleta e análise de dados para projeto ou tomada de decisões estratégicas; da proteção, defesa, negociação e apropriação das criações intelectuais; e do exercício de novas competências pelo designer. Relacionadas com cada espaço de interação são indicadas as habilidades esperadas a serem alcançadas a partir do ensino-aprendizagem de PI. São habilidades baseadas nas recomendações de conteúdos curriculares de PI formuladas para cursos de Design. / [en] This thesis is on the study, research, and theoretical basis of the connections and interactions between design and intellectual property (IP). The intellectual creations of design encompass characteristics that are compatible with most protection modalities defined in IP. However, it is necessary to accurately comprehend their flow in the legal system. Limited knowledge of their contents and interactions poses difficulties in comprehensive management of intellectual creations using the system. To allow it to be understood in its entirety, a systemized classification has been developed (taxonomy) of the creative content of IP, enabling an overview of the system from the perspective of the aesthetic and technical characteristics of the creations, the derived creative content, and the hybrid creative objects. With the taxonomy, it was possible to identify the minimal creative content that corresponds to higher education courses of projective content and, specifically, to qualifications and specialties in design. Attention was also paid to the areas of interaction between design and IP related to the collection and analysis of project data or making strategic decisions; the protection, defense, negotiation, and appropriation of intellectual creations; and the exercise of new skills by the designer. The skills expected to be developed through teaching and learning IP are shown to be related to each area of interaction. These skills are based on the recommendations of the IP curriculum content, which is formulated for design courses.

La sauvegarde du patrimoine culturel immatériel en droit international / The Safeguarding of intangible cultural heritage in international law

Le patrimoine culturel ne s’arrête pas aux monuments et aux collections d’objets. Il comprend également les traditions ou les expressions vivantes héritées de nos ancêtres et transmises à nos descendants ; ce qu’on appelle le patrimoine culturel immatériel. L’importance de ce patrimoine ne réside pas tant dans la manifestation culturelle elle-même que dans la richesse des connaissances et du savoir-faire qu’il transmet d’une génération à une autre. Cette transmission du savoir a une valeur sociale, économique, culturelle et juridique pertinente pour les groupes minoritaires et majoritaires et pour le monde entier. Le choix des techniques de protection internationale est directement lié aux objectifs poursuivis par l’UNESCO. Au-delà du texte de la Convention de 2003 et d’autres instruments internationaux adoptés par l’UNESCO, il peut être utile d’aborder plus largement les solutions juridiques de sauvegarde du patrimoine culturel immatériel. L'objet de notre étude consiste à analyser l’action normative en matière de patrimoine culturel immatériel en mettant la lumière sur sa définition, les normes internationales relatives à sa protection, ainsi que sur la question de l’effectivité et de l’efficacité internationale de la sauvegarde de ce patrimoine. Pour conclure, les résultats de l’action normative et d’effectivité n’échappent pas à notre analyse. Il s’agit d’évoquer enfin la possibilité de mettre en place une feuille de route pour une meilleure protection à l’avenir. / Cultural heritage doesn't only include monuments and the collection of objects. /cultural heritage is about more than monuments or the collection of objects. It, also, includes the traditions or the modern inherited expressions from our ancestors and transmitted to our descendants, what we call the intangible cultural heritage. The importance of this heritage doesn't reside so much in the cultural demonstration itself, but in the richness of knowledge, and the know-hows that are transmitted from one generation to another. This transmission of knowledge has social value, economical, cultural and legal relevance for minority groups, as well as for the main social groups, and is also, important for the world. The choice of the techniques used for international protection is linked directly to the objectives pursued by the UNESCO. Beyond the text of the 2003 convention and other international agreements adopted by the UNESCO, it can perhaps be useful to tackle more widely the legal solutions of the intangible cultural heritage. The aim of our study consists of analysing the normative action concerning the intangible cultural heritage in placing the light on the definition of the intangible cultural heritage as well as the international standards important to its protection and also in tackling the question of effectivity and efficiency of the international protection of this heritage. In conclusion, the results for the normative action and effectivity do not escape our analysis. It is, in the end about the possibility of putting in place a plan for the protection of a better future.

Varumärkesrätten innefattar en bred definition av vilka kännetecken som kan konstituera ett varumärke, vilken inkluderar formen på en vara. När kännetecknet består av en varuform utgör således varan i sig kännetecknet och därmed varumärket. Vid en varumärkesregistrering ska bedömningen av olika kategorier av kännetecken inte skilja sig åt, men för varuformer finns ytterligare hinder vid registrering jämfört med andra typer av kännetecken. Ett sådant registreringshinder avser specifikt funktionella former. Många former tenderar att vara funktionella till viss grad, vilket aktualiserar art. 7.1 e) ii) VmF. Artikeln föreskriver ett absolut registreringshinder mot att registerna former som endast består av ”en varas form eller annan egenskap hos varan som krävs för att uppnå ett tekniskt resultat”. Om en varuform hindras registrering enligt artikeln, är uteslutningen från registrering permanent. Det innebär att registreringshindret inte kan övervinnas även om formen förvärvar särskiljningsförmåga på marknaden. EUD har uttalat att det inte vore skäligt att neka registrering av varuformer endast på grund av att de innehar några funktionella element. För att ett kännetecken ska falla inom ramen för artikeln behöver således en forms alla väsentliga särdrag falla inom ramen för bestämmelsen. Detta medför viss problematik när det kommer till hybridkännetecken vilka innehar vissa element som är funktionella, men även andra element som är icke-funktionella. Enligt gällande rätt kan hybridkännetecken registreras som varumärken om de innehar icke-funktionella särdrag som anses vara väsentliga. Hela formen av ett hybridkännetecken kan således registreras som ett varumärke under förutsättning att endast några av de väsentliga särdragen krävs för att uppnå den tekniska funktionen. Genom en undersökning av rättspraxis konstateras att EUD utför en fri och långtgående undersökning vid bedömning av vad som utgör en forms väsentliga särdrag och dessa särdrags eventuella funktion. EUD är inte bunden till vad som anges i varumärkesansökan, utan undersöker även den faktiska varan på marknaden för vilket kännetecknet är ämnat att användas. EUD verkar generellt vara restriktiv med att låta tredimensionella former registreras, inte minst när de innehåller funktionella element. Möjligen beror den negativa inställningen till att registrera hybridkännetecken på bristen av effektiva lösningar att tydligt undanta de funktionella elementen från registrering. Vid en registrering av hybridkännetecken uppstår även intressanta aspekter ur intrångssynpunkt eftersom formen är registrerad som en helhet, även om vissa väsentliga särdrag inte är ämnade att omfattas av ensamrätten. Vid analoga tillämpningar av rättspraxis framstår det som att dessa element, utan att det explicit framgår av exempelvis en disclaimer, ska vara undantagna från den ensamrätt som erhålls varumärkesinnehavaren. / The trade mark law includes a very broad definition of signs that can constitute a trade mark, which includes the shape of a product. When a sign consists of the shape of a product, the product itself becomes the sign and thus the trade mark. In the case of a trade mark registration, the assessment should not differ between different categories of signs. However, when it comes to registration for signs consisting of the shape of a product, there are further obstacles to overcome before protection can be granted compared to other types of signs. Many shapes tend to be functional to some extent, which brings relevance to the absolute ground for refusal found in art. 7.1 e) ii) EUTMR. The article prohibits registration of signs which consist exclusively of “the shape, or another characteristic, of goods which is necessary to obtain a technical result”. If the registration of a sign is prohibited by the article, the exclusion from registration is permanent. This means that the ground for refusal cannot be overcome even if the sign acquires distinctiveness on the market. The CJEU has stated that it would not be reasonable to deny a shape registration only on the sole ground that it has some functional elements. Therefore, in order for a sign to fall within the scope of the article, all the essential characteristics of a shape must fall within the scope of the provision. This causes certain difficulties when it comes to hybrid signs, which possess some elements that are functional, but also other elements that are non-functional. Under current law, hybrid signs can be registered as trade marks if the non-functional elements are considered as essential. The entire form of a hybrid sign can thus be registered as a trade mark only if some, but not all, essential characteristics are required to achieve the technical function. By examining case law, it can be stated that the CJEU carry out a free and extensive examination when assessing what constitutes the essential characteristics of a shape and the possible function of these elements. The CJEU is not bound to the trade mark application but also examines the actual goods for which the sign is intended to be used. The CJEU generally seems to be restrictive in allowing registration for three-dimensional shapes, especially in regard to those incorporating functional elements. This might be the case since there is no good way to clearly exclude the functional elements from the registration. However, when registering a hybrid sign, interesting aspects also arise from the infringement point of view since the shape is registered as a whole but contains certain essential features, which are not intended to be covered by the exclusive right granted. In analogous applications of case law, it appears that these elements, without being explicitly stated in e.g. a disclaimer, must be excluded from the exclusive right granted to the proprietor.

Embora os direitos de Propriedade Intelectual (PI) sejam supostamente instituídos de forma a fomentar a inovação e o bem-estar em longo prazo, seu uso pode ensejar comportamentos oportunistas e abusivos como os Artigos 8.2 e 40 do TRIPS expressamente admitem. Sempre que tal tipo de comportamento afetar a concorrência em determinado mercado excluindo concorrentes, impondo barreiras à entrada, prejudicando consumidores por meio de aumento de preços ou redução da oferta o Direito de Concorrência será chamado a intervir. Considerando tais questões, o objetivo desse trabalho é identificar um quadro de trabalho brasileiro para tratar de questões envolvendo questões de Direito de Concorrência relacionadas à Propriedade Intelectual. O autor buscou delinear os conceitos de uso abusivo de direitos de Propriedade Intelectual, Dominação de Mercado por meio de uso da Propriedade Intelectual e de abuso de posição dominante, considerando o novo quadro regulatório introduzido pela Lei 12.259/2001. / While intellectual property (IP) rights are usually claimed to be designed to foster innovation and welfare in the long run, their use may give rise to opportunistic, abusive behavior - as Articles 8.2 and 40 of TRIPS openly admit. Whenever such sort of behavior affects competition in a given market - whether by dislodging competitors, imposing barriers to entry, harming costumers, raising prices or reducing output - competition law is called to intervene. Considering these issues, the purpose of this paper is to identify a Brazilian legal framework for dealing with IP related competition issues. The author sought to draw the legal concepts of abusive of IP rights, market domination and abuse of dominant position considering the new regulatory framework introduced by Law 12.259/2011.

The exam of the history of the advertising and the several ways as it has been conceived in the last years contribute to delimit the comparative method as a specific technique. Technique marked by the line of the aggressiveness in the formulation of the advertising messages that, under excuse of being mere fruit of the imagination and of the professionals' creativity in it involved, it has the unequivocal purpose of invigoration the economic function. The use of the technique, though, it is absent-minded of concerns with their effects in the sphere of the rights of the contestants, of the own professionals of the area of the publicity, of the consumers and of the citizens in general. The form how the advertising is collected by the legal system ― in the constitutional plan and in the statutory law plan ― it comes as vector to incite inquiries on the licitness of the comparative advertising in Brazil. The possible answer is among the many themes developed in the work, among the ones which, for instance, the fundamental rights, the freedom of expression and communication, the repression rules to the disloyal competition, the prohibition of the right abuse and the respect to the copyright. Starting from those juridical categories, the text shows the perplexity between professionals of the marketing areas and jurists on that aggressive advertising technique. Defenders and opponents of Comparative Advertising are characters of that plot of trade and consumerism of the current communication order. Strong and convincing arguments developed by those characters, solitary of the experience and of conflicts of interests, they allow the choice of an answer to the inquiry on the licitness of the comparative advertising in the Brazilian law / Publicidade Comparativa é tema apresentado em seus aspectos constitutivos, como fenômeno social com reflexos na economia, na cultura e na ordem jurídica brasileira. O exame da história da publicidade e as várias maneiras como vem sendo concebida nos últimos anos contribuem para delimitar a publicidade comparativa como uma técnica específica. Técnica marcada pelo traço da agressividade na formulação das mensagens publicitária que, sob pretexto de ser mero fruto da imaginação e da criatividade dos profissionais nela envolvidos, tem o inequívoco propósito de fortalecimento da sua função econômica. O uso da técnica, todavia, é abstraído de preocupações com os seus efeitos na esfera dos direitos dos concorrentes, dos próprios profissionais da área da publicidade, dos consumidores e dos cidadãos em geral. Le rôle des propriétés intellectuelles au sein d’une économie de l’immatériel et de l’innovation est essentiel. Les contrats d’exploitation constituent les instruments juridiques permettant la circulation de ces sources de richesse et favorisent l’optimisation de leur exploitation, tant au niveau national qu’au niveau européen. La présente thèse traite la question de l’amélioration du cadre juridique actuel des contrats d’exploitation en Europe. Plus précisément, elle a pour objectif de démontrer que, d’une part, l’insuffisance du droit des contrats d’exploitation en Europe est globale et pose problème et, d’autre part, que ce problème devrait être traité à travers la (re)construction du droit spécial des contrats d’exploitation de manière transversale et dans une perspective européenne. L’analyse a pour point de départ l’examen du statu quo à partir des droits grec, français, allemand, britannique et communautaire et aboutit à la recommandation de certaines pistes de (re)construction et d’européanisation, vue de la construction d’un véritable et cohérent droit commun européen des contrats d’exploitation. / Intellectual Property plays an essential rοle in the modern economy based on innovation and intellectual capital. Exploitation contracts of IP rights are the legal instruments that allow the circulation of these assets and enhance their exploitation both at national and European level. This thesis discusses the question of improvement of the actual legal framework of exploitation contracts of IP rights in Europe. More precisely, it aims at demonstrating that, on the one hand, the insufficiency of the law of exploitation contracts is real and far-reaching and, on the other hand, that the insufficiency problem should be dealt with the transversal (re)construction of the specific legal framework of exploitation contracts in a European perspective. The analysis starts with the examination of the deficiencies of the status quo, as reflected in Greek, French, German, British laws, and European acquis and concludes with the recommendation of further steps to be taken for the construction of a true and consistent European law of exploitation contracts of IP rights.

Claims of customization and control by socio-technical industries are altering the role of consumer and producer. These narratives are often misleading attempts to engage consumers with new forms of technology. By addressing capitalist intent, material, and the reproduction limits of 3-D printed objects’, I observe the aspirational promise of becoming a producer of my own belongings through new networks of production. I am interested in gaining a better understanding of the data consumed that perpetuates hyper-consumptive tendencies for new technological apparatuses. My role as a designer focuses on the resolution of not only the surface of the object through 3-D printing, but the social implications to acknowledge consequential conditions of new forms of consumer technology.

Legal and policy aspects to consider when providing information security in the corporate environment

E-commerce is growing rapidly due to the massive usage of the Internet to conduct commercial transactions. This growth has presented both customers and merchants with many advantages. However, one of the challenges in E-commerce is information security. In order to mitigate e-crime, the South African government promulgated laws that contain information security legal aspects that should be integrated into the establishment of information security. Although several authors have written about legal and policy aspects regarding information security in the South African context, it has not yet been explained how these aspects are used in the provision of information security in the South African corporate environment. This is the premise upon which the study was undertaken. Forty-five South African organisations participated in this research. Data gathering methods included individual interviews, website analysis, and document analysis. The findings of this study indicate that most organisations in South Africa are not integrating legal aspects into their information security policies. One of the most important outcomes of this study is the proposed Concept Model of Legal Compliance in the Corporate Environment. This Concept Model embodies the contribution of this study and demonstrates how legal requirements can be incorporated into information security endeavours. The fact that the proposed Concept Model is technology-independent and that it can be implemented in a real corporate environment, regardless of the organisation’s governance and management structure, holds great promise for the future of information security in South Africa and abroad. Furthermore, this thesis has generated a topology for linking legislation to the provision of information security which can be used by any academic or practitioner who intends to implement information security measures in line with the provisions of the law. It is on the basis of this premise that practitioners can, to some extent, construe that the integration of legislation into information security policies can be done in other South African organisations that did not participate in this study. Although this study has yielded theoretical, methodological and practical contributions, there is, in reality, more research work to be done in this area. / School of Computing / D. Phil.
