Indecent assault consists in an unlawful and intentional indecent assault which is and is
intended to be indecent.
There is some controversy in the case law whether the indecency is committed only by acts
which are, objectively speaking indecent, against the view that even though the act is not
indecent itself, may nevertheless found a conviction of indecent assault if it was the intention
of the accused to act indecent and such intention was conveyed to the victim.
It is submitted that the last mentioned approach is to be preferred but that the following test
should be used:
1. If the act, is objectively speaking indecent and there is no doubt about the
unlawfulness as well as the indecent intention of the accused, the crime of indecent
assault was committed.
2. If the act is objectively speaking indecent but the indecent intention of the accused can
not be proven, there is a rebuttable presumption that the accused acted with an
indecent intention. Such as presumption must be rebutted b the accused himself.
3. If the act is not objectively speaking, indecent but the indecent intention of the accused
can for example be proven by the accused confession to such an intention, the act

Decision making and modelling uncertainty for the multi-criteria analysis of complex energy systems / La prise de décision et la modélisation d’incertitude pour l’analyse multi-critère des systèmes complexes énergétiquesWang, Tairan 08 July 2015 (has links)
Ce travail de thèse doctorale traite l'analyse de la vulnérabilité des systèmes critiques pour la sécurité (par exemple, les centrales nucléaires) dans un cadre qui combine les disciplines de l'analyse des risques et de la prise de décision de multi-critères.La contribution scientifique suit quatre directions: (i) un modèle hiérarchique et quantitative est développé pour caractériser la susceptibilité des systèmes critiques pour la sécurité à plusieurs types de danger, en ayant la vue de `tous risques' sur le problème actuellement émergeant dans le domaine de l'analyse des risques; (ii) l'évaluation quantitative de la vulnérabilité est abordé par un cadre de classification empirique: à cette fin, un modèle, en se fondant sur la Majority Rule Sorting (MR-Sort) Méthode, généralement utilisés dans le domaine de la prise de décision, est construit sur la base d'un ensemble de données (en taille limitée) représentant (a priori connu) des exemples de classification de vulnérabilité; (iii) trois approches différentes (à savoir, une model-retrieval-based méthode, la méthode Bootstrap et la technique de validation croisée leave-one-out) sont élaborées et appliquées pour fournir une évaluation quantitative de la performance du modèle de classification (en termes de précision et de confiance dans les classifications), ce qui représente l'incertitude introduite dans l'analyse par la construction empirique du modèle de la vulnérabilité; (iv) basé sur des modèles développés, un problème de classification inverse est résolu à identifier un ensemble de mesures de protection qui réduisent efficacement le niveau de vulnérabilité du système critique à l’étude. Deux approches sont développées dans cet objectif: le premier est basé sur un nouvel indicateur de sensibilité, ce dernier sur l'optimisation.Les applications sur des études de cas fictifs et réels dans le domaine des risques de centrales nucléaires démontrent l'efficacité de la méthode proposée. / This Ph. D. work addresses the vulnerability analysis of safety-critical systems (e.g., nuclear power plants) within a framework that combines the disciplines of risk analysis and multi-criteria decision-making. The scientific contribution follows four directions: (i) a quantitative hierarchical model is developed to characterize the susceptibility of safety-critical systems to multiple types of hazard, within the needed `all-hazard' view of the problem currently emerging in the risk analysis field; (ii) the quantitative assessment of vulnerability is tackled by an empirical classification framework: to this aim, a model, relying on the Majority Rule Sorting (MR-Sort) Method, typically used in the decision analysis field, is built on the basis of a (limited-size) set of data representing (a priori-known) vulnerability classification examples; (iii) three different approaches (namely, a model-retrieval-based method, the Bootstrap method and the leave-one-out cross-validation technique) are developed and applied to provide a quantitative assessment of the performance of the classification model (in terms of accuracy and confidence in the assignments), accounting for the uncertainty introduced into the analysis by the empirical construction of the vulnerability model; (iv) on the basis of the models developed, an inverse classification problem is solved to identify a set of protective actions which effectively reduce the level of vulnerability of the critical system under consideration. Two approaches are developed to this aim: the former is based on a novel sensitivity indicator, the latter on optimization.Applications on fictitious and real case studies in the nuclear power plant risk field demonstrate the effectiveness of the proposed methodology.

Previous issue date: 2015-08-28 / It is proposed to research the urban permanences verified in the initial core of Goiânia, as
from Goiás Avenue, its most symbolic and expressive stretch. It starts with the analysis of
the political discourse disseminated by Pedro Ludovico Teixeira, in favor of moving the
capital to a place better adjusted to his political interests, after the triumph of the Brazilian
Revolution of 1930. Therefore, he builds powerful social representations, based on the
images of the old and the new capital, in order to oppose those against this change and
consolidate his government. In addition to the speech and propaganda, Ludovico uses, as a
statement element, the urban plan designed by Attilio Corrêa Lima, creating a modern
intentional monument to be immortalized, translated by the monumental Goiás Avenue.
Then, the city experiences a vertiginous growth in its territory and population, mainly after the
1950s, resulting in the disfigurement of its pioneering core. The spatial transformations
verified in Goiás Avenue are representative of this scenario, such as its verticalization
process and the changes in its layout to meet the demands from the public transportation.
From these losses, consequences of the progressive mentality that is rooted in the local
culture, arise the first initiatives to preserve the material evidences of the beginning Goiânia,
culminating with its federal preservation in 2003. From this institutionalization as a national
heritage, it is focused the appropriation by the city inhabitants, through the research of the
urban imaginary created since the pioneer’s city until the present day, highlighting striking
points in this trajectory. For that, it is used literature in prose and verse to reach the local
collective memory, focusing on the capital early years and on the current city - violent,
disjointed and that is forgetting its history day by day. / Esse trabalho investiga as permanências urbanas verificadas no núcleo inicial de Goiânia, a
partir da Avenida Goiás, seu mais simbólico e expressivo trecho. Parte-se da análise do
discurso político difundido por Pedro Ludovico Teixeira, em defesa da transferência da
capital para um local mais ajustado aos seus interesses políticos, após o triunfo da
Revolução de 1930. Para isso, ele constrói poderosas representações sociais,
fundamentadas nas imagens da velha e da nova capital, visando combater os
antimudancistas e consolidar seu governo. Além do discurso e da propaganda, Ludovico
utiliza o próprio plano urbano projetado por Attilio Corrêa Lima como elemento de afirmação,
criando um monumento intencional moderno a ser eternizado, traduzido através da
monumental Avenida Goiás. A partir de então, a cidade vivencia um crescimento territorial e
populacional vertiginoso, sobretudo, após a década de 1950, resultando na
descaracterização de seu núcleo pioneiro. As transformações espaciais verificadas na
Avenida Goiás são representativas desse cenário, a exemplo de seu processo de
verticalização e das modificações em seu traçado para atender às demandas do transporte
coletivo. Sentidas as perdas, em consequência da mentalidade progressista que se arraiga
na cultura local, surgem as primeiras iniciativas para preservação dos testemunhos
materiais da Goiânia dos primórdios, que culminam com o tombamento federal em 2003. A
partir de sua institucionalização como patrimônio histórico, volta-se o olhar para sua
apropriação por parte dos habitantes locais, através da investigação do imaginário urbano
formado desde a cidade dos pioneiros até a atualidade, destacando-se pontos marcantes
nessa trajetória. Utiliza-se, para tanto, a literatura em prosa e verso para atingir a memória
coletiva local, com foco nos primeiros anos da capital e na cidade atual, violenta,
desarticulada e que vem se esquecendo de sua história a cada dia.

In this research project the question is raised whether it is possible to detect and analyse differences between incidental and intentional vocabulary acquisition within a traditional, systematic teaching setting of German as an L3. The ten par-ticipating Swedish students at the upper secondary level worked with two differ-ent German newspaper articles in two different ways. One set of lessons focused mainly on textual content (incidental learning) while the other involved both dis-cussions about the contents of the text and explicit vocabulary practice (inten-tional learning). The students were later tested on four separate occasions using a self-report-test involving 16 pre-tested words. The two main research questions are: How many of the encountered words will the students recall and what depth of knowledge does this recall represent? Results point to a very limited vocabu-lary acquisition through incidental learning compared to the acquisition through intentional learning which gave a higher score. The overall tendency is for ac-quired vocabulary knowledge to change over time and more so if intentionally acquired. This raises a further question: How much and what kind of work in-volving texts is needed in the classroom for long lasting vocabulary acquisition, incidental or intentional, to take place? Furthermore the results indicate that the self-report test used in the research project shows deficiencies regarding validity as well as reliability issues, which puts further focus on the test methods used in educationally applied vocabulary acquisition research.

L’irrelevant process, décrit par George Brecht en quelques lignes au sein de son texte Chance-Imagery(1957), est une méthode de création d’ « images du hasard », proche de l’idée de « non-intentionnalité ».Cette thèse analyse cette description et en étudie les enjeux dans le cadre de la création de dessins et depeintures, au travers de l’idée de « machine à dessiner » et de celle d’« image trouvée ». L’étude dequelques démarches artistiques issues de la seconde moitié du XXème siècle et exemplifiant cette typologienous amène à considérer que l’irrelevant process consiste notamment en l’adoption d’une perspectiveintentionnelle et esthétique sur des processus et des traces « non-pertinents » avec la créationd’images. / The “irrelevant process”, briefly described by George Brecht in Chance-Imagery (1957), is a method forcreating “chance-images”, close to the idea of ”non-intentionality”. Our thesis analyses this description andstudies its issues for the creation of paintings and drawings, through the ideas of « drawing machine » and« found image ». The study of some artistic practices which illustrate this typology brings us to think thatthe irrelevant process involves the adoption of an intentional and aesthetic point of view on processes andtraces which are irrelevant with the creation of images.

The present doctoral thesis addresses the insufficient exploration of the concept of play style in current video game player's research. To reach the goal, theoretical framework of style as an intentional model of player's believes and desires is used. The main proposition of this particular paper is based on the presumption that play style works as a tool for predicting opponent's behavior. The research consists of two parts. The first one proposes a categorization which might in greater accuracy explain existing forms of play. The second part researches the topic of intentionality further through the procedural model of style prediction in progaming area, which is exemplified by the video game League of Legends. The results are based on extensive analysis of players' texts, interviews with semiprofessional players, commentators and game journalists. The conclusion implies a significant number of play styles and procedural complexity of recursive theory of mind ("I think about what you think that I think") in the field of video games. Imago relationship therapy was originally applied to couples counselling by Dr Hendrix (1992, 1993). This model was applied to a group of senior managers from the Lonmin Platinum Mine to create an understanding of intrapersonal and interpersonal dynamics to reduce the conflict levels they experienced in the workplace. Imago theory is applicable to the workplace because of the influence of intrapersonal processes on interpersonal dynamics, which is the same influence that causes conflict in romantic relationships.
Love relationships consist of three stages, namely romantic love, the power struggle stage, and the real love stage. In the organisational context, these stages are the initial excitement phase, the power struggle stage, and the conscious relating stage. The study aimed to obtain quantitative and qualitative data on the effects of the Imago theory programme presented to the group of managers. The study thus aimed to determine whether the managers experienced a shift in their consciousness after the programme had been presented. Furthermore, the study aimed to determine whether such a shift in consciousness would have an effect on the individuals’ overall emotional wellbeing and if it would increase their overall life satisfaction. Furthermore, the study investigates if the programme had a positive effect on their interpersonal relationships (particularly with their subordinates).
Twenty-two senior managers and 22 subordinates participated in the study. Certain pre-tests were conducted, followed by the seven-module intervention. The same post-tests were conducted after the training had taken place. Quantitative and qualitative results were obtained. The quantitative results showed that the participants’ problem solving abilities improved and that they experienced marginally higher levels of life satisfaction. The reactivity levels experienced by the participants during conflict situations decreased, and their levels of marital satisfaction improved. The results also showed that the managers responded more positively to their subordinates after the intervention. Furthermore, the subordinates experienced their managers as being more flexible after the intervention. The qualitative results indicated that a shift in consciousness did take place as envisaged. The group understood both intrapersonal and interpersonal psychodynamics. They also willingly applied Imago concepts to improve their functioning in the organisational context. / Psychology / D. New Country, New(s) Habits: How does migration affect news consumption and avoidance behavior? : A case study on young millennial immigrants living in Stockholm, SwedenAdolph, Jasmin January 2022 (has links)
This audience study explores the changes of news consumption and avoidance behaviour by young millennial immigrants from various backgrounds, living in Stockholm, Sweden. Considering various theoretical frameworks, such as the intentional vs. unintentional model (Skovsgaard & Andersen, 2020), the migration change model (Tabor & Milfont, 2011), as well as a combination of a phenomenology of news model (Bengtsson & Johansson, 2021) and media repertoires established by Swart et al. (2017), a qualitative research has been conducted consisting of eight semi-structured interviews. Through a thematic analysis possible patterns have been established and findings show that individuals tend to change their behaviour in news consumption for various reasons. (1) Participants want to be able to establish their own news-routines and use their migration as an opportunity for a new start, (2) there is a certain influence by people closest to them and with their social circle changing, their (news) interests change as well, and (3) motivation and interest play an important role in shaping new consumption behaviours in a new country: the more one is interested in learning more about the new country, its culture and its language, the more likely they are to check that country’s traditional news media sources.
