The undefined role of court interpreters in South Africa

In South Africa there is no legislation defining the role of court interpreters. This has resulted in legal officials (magistrates and judges) forming their own opinions as to what the role of court interpreters is. As such court interpreters find themselves performing tasks that are outside their scope of duties, for example acting as magistrates, in turn compromising their own tasks in the process. The aim of this study therefore is to determine the degree to which the lack of a definition of the role of court interpreters affects the quality of court interpreting. In the study, the researcher was guided by the Descriptive Translation Studies (DTS) approach. The research procedures that were followed in the study combined the top-down and bottom-up approaches. In the top-down approach, two legislations, namely, “The Magistrates’ Court Act 44 of 1944 (as amended)” and “The Constitution of the Republic of South Africa, Act 93 of 1996 (as amended)”, were examined in order to determine whether the role of court interpreters is defined and, if so, to what extent. In the bottom-up approach, examples of court proceedings were studied in order to determine specific roles that are played by court interpreters during trials. Extracts from transcripts of mechanically-recorded court proceedings were also analysed to establish whether magistrates made any references to the role of court interpreters in these trials. L’apparition d’un acte de Justice régulé selon les règles substantielles et processuelles adoptées par l’État façonne la construction d’une véritable activité professionnelle attachée à l’acte de Justice étatique : il s’agit de la professionnalisation du juge. Durant un certain temps, la mission de Justice devient l’affaire du peuple avec la création des juridictions de l’ordre judiciaire composées de citoyens en totalité ou en partie. Cependant, plusieurs problèmes sont observés dans l’exécution de l’acte de Justice étatique par ces citoyens. Face à ces difficultés, la conception de l’exercice de la mission de Justice étatique doit être modifiée: celle-ci ne peut pas être considérée comme une simple occupation. Il s’agit d’une activité dont la complexité implique une approche professionnelle dans sa mise en pratique. Il en résulte la création d’un parcours formateur à l’attention de ceux qui souhaitent faire acte de Justice étatique et l’établissement d’un chemin hiérarchique à l’attention de ceux qui souhaitent faire carrière dans la magistrature. Toutefois, face aux évolutions de la Règlementation et de la Société, des faiblesses dans la représentation initiale de l’exécution de l’acte de Justice étatique apparaissent : l’acte de Justice étatique ne doit plus seulement être juridiquement cohérent avec un rôle judiciaire précis attribué à chacun. Il doit être également spécialisé et surtout rapide. Il s’ensuit une confrontation entre l’acte de Justice étatique tel qu’il est exécuté conformément à ces nouvelles exigences et les nécessités de la mission de Justice telle qu’elle a été initialement apprise par les juges. / The appearance of an act of Justice regulated by the substantive and procedural rules adopted by the state shapes the construction of a true professional activity tied to the act of state Justice: this is the professionalization of the judge. For a time, the mission of Justice becomes the business of the people with the creation of the courts of the judiciary composed of citizens in whole or in part. However, several problems are observed in the execution of the act of state Justice by those citizens. Faced with these difficulties, the idea of the exercise of state justice mission should be modified: it can not be considered a single use. This is an activity whose complexity requires a professional approach in its implementation. The result is the creation of a formative career to the attention of those who wish to act of state justice and the establishment of a hierarchical path to the attention of those interested in a career in the judiciary. However, given the changes in the Regulations and Society, weaknesses in the initial representation of the performance of the act of state Justice appear: the act of state Justice should no longer only be legally consistent with a specific judicial role assigned to each. It should also be specialized and especially fast. It follows a confrontation between the act of state Justice as performed in accordance with the new requirements and needs of the mission of Justice as it was originally taught by the judges.

Leke-deelname in die regsplegingstelsel kan terug­ gevoer word na 1657. Deur die latere oorname van Engelse regsbeginsels1 word die juriestelsel in die Suid-Afrikaanse reg geinkorporeer. Na die afskaffing van die juriestelsel in 1969 berus die beantwoording van sowel feite- as regsvrae slegs by die voorsittende beampte. Hierdie situasie is as onaan­ vaarbaar beskou en grater leke-deelname word bepleit. Dit is egter eers in 1991 dat die aanwending van leke-assessore in die Suid-Afrikaanse regstelsel 'n realiteit word. As a result of the adoption of the British law principles/ the jury system was incorporated in South African law. After the abolition of the jury in 1969/ the answering of factual and judicial questions resides in the presiding officer. This situation was unacceptable and lay participation was advocated. The use of lay assessors became a reality in 1991. The prerequisite for the appointment of an assessor is that it should be expedient for the administration of justice. But are the use of lay assessors beneficial at this stage? The Natal Afrikaner and The Anglo-Boer War

The invasion by the Boers of Natal set a process in motion that changed the lives of Natal Afrikaners forever. As a group which shared family, cultural, and other ties with the invaders, but were British subjects by citizenship, they had to make a difficult decision: join the Republican forces or remain loyal to the crown. Factors which influenced this decision, amongst others, were the pre-war suspicion of all Natal Afrikaners by the Natal authorities and the prevalence of a general anti-Republican sentiment. Despite the above-mentioned, and the sympathy which existed for the plight of the Republics, very few Natal Afrikaners joined the commandos. Doing that would have meant economic annihilation. This the Natal Afrikaners understood and the majority remained neutral. Matters were complicated when the British Army and the colonial authorities withdrew south, leaving especially the Afrikaners of the Klip River county unprotected. When occupation did not convince the Afrikaners of the area to join, a well-thought out strategy based upon fear and misinformation, brought most into the fray. Duty on these commandoes was generally slack, subversive in nature, and as much as one can expect from people forced into military combat. A small group, however, managed, despite the pressures placed upon them, to remain loyal to Britain. For these loyalists the greatest rewards were in terms of economics and power. In stark contrasts were the economic experiences of the Natal Afrikaners who were somehow, either directly or indirectly, guilty of high treason. All their possessions were systematically looted or destroyed, leaving most of them in an impoverished state. Secondly, through a range of court cases 409 Natal Afrikaners or associated people were convicted of treason, mostly by the purposefully introduced Special Court and special magistrate. The outlined experiences coincided with victimization on socio-political and cultural levels under Martial Law. Afrikaners resident in the southern part of Natal, and especially in Umvoti county, did not suffer directly because of the war but experienced a different kind of war namely a pseudo war in which they were spied upon, viewed with suspicion and under Martial Law harassed. However, these Afrikaners managed to maintain some political power while economically they carried on as before the war. They attempted to use these assets to assist the Afrikaners who had to endure desertion by their own government and Boer occupation. Natal Afrikaners also experienced other aspects of the war normally associated with the Republics. Some were arrested as POWs, while others were deported to concentration camps within the Colony. Furthermore, as a result of the war, relations between Natal Afrikaners and English colonists and Africans suffered. A Training programme for intermediaries for the child witness in South African Courts

This study concentrates on the development, implementation and evaluation of a research based training program for intermediaries in South African courts in order to improve the intermediary’s knowledge and understanding of the role and duties of an intermediary. The motivation for this study had its origin in the fact that the adversarial nature of court proceedings is a major stumbling block for the child witness. The research problem, namely that there is no national research based training program for intermediaries in South Africa, was discussed. Intervention research was used as research methodology and a two phase research approach was undertaken. A quantitative survey research design was used during the phases. The research question formulated for the first phase was: What are the duties and role of an intermediary? 54 magistrates and 34 prosecutors who attended four workshops, completed a self-structured questionnaire. This data complemented the literature study and both were used to compile a training program for intermediaries. The quantitative approach was also used for phase two of the study. A quasi-experimental one-group pretest-posttest design was used. An assessment by means of a questionnaire was done before the training program started and was repeated again after the presentation of the training program to determine the effectiveness of the program The research hypotheses that was formulated was: If an intermediary is trained according to a research-based training program, the intermediary’s knowledge of her role in assisting the child before and during the trial in a South African court will be improved. A five-day training program was implemented. The hypothesis was confirmed after the data had been analyzed and compared to the literature. In chapter two the legal system of South Africa, in respect to the child, was discussed and in chapters three, four and five all aspects of child development were discussed with specific emphasis on the child witness that needs to testify in a separate courtroom. Cognitive development and language development in the context of the child witness were discussed. This information was used to develop a training program. In chapter six the development of a training program was discussed with specific attention being given to outcomes based education. In chapter seven all the data that was collected was quantified, analyzed and interpreted. The conclusion could be drawn that the respondents did show improvement of their skills and knowledge of an intermediary, his/her duties and theoretical knowledge. They also showed that their practical skills had improved by attending the training program. The conclusion could therefore be made that the intermediary training program was successfully implemented and complied with the requirements of an outcomes based training program. The findings obtained indicate that trainers of intermediaries throughout South Africa can successfully apply the developed training program. Conclusions and recommendations (chapter 8) of this study are put forward in accordance with the process that was followed in developing and implementing the training program for intermediaries who are to assist children when testifying in a court. / Thesis (DPhil (Social Work))--University of Pretoria, 2006. / Social Work / unrestricted

La magistrature occupe une place particulière au sein de l’administration de l’Etat. Elle est chargée de trancher les contestations juridiques entre particuliers (tribunaux civils, commerciaux, etc.), de réprimer les infractions aux lois pénales (tribunaux répressifs) et de contrôler les gouvernants agissant dans les limites du droit (tribunaux administratifs). Eu égard à la particularité et à la délicatesse de ses missions, les Etats proclament son indépendance dans leur constitution.Au Mali, de l’indépendance jusqu’en 1991, la magistrature est restée inféodée à l’Exécutif. C’est sous la IIIème République qu’elle a acquis les garanties formelles d’indépendance. Cependant, c’est sous cette République que les critiques les plus acerbes sont formulées à son encontre : lenteur des procédures, corruption des magistrats, collusions frauduleuses entre magistrats et avocats, etc.L’étude de la magistrature porte sur le cadre normatif dans son évolution historique (accès, organisation, fonctionnement, responsabilité etc.) et l’apport des luttes syndicales dans le sens du renforcement de l’indépendance des juges. Elle s’intéresse, aussi, à l’analyse des difficultés rencontrées par les juges dans leur interaction quotidienne avec l’environnement institutionnel et social (leurs relations avec les pouvoirs publics, les relations sociales, etc.). Cette approche permet d’apprécier de mieux comprendre les contraintes de la construction de leur indépendance pour faire face à leur rôle d’édification d’un Etat de droit.L’étude s’intéresse, enfin, à l’analyse des perceptions du justiciable sur les magistrats et au portrait commenté de deux d’entre eux que nous avons estimé « intègres » dans le respect des règles déontologiques et éthiques. / The judiciary has a special place witthin the state administration. It is responsible for settling legal disputes between individuals (civil courts, commercial, etc.), punishing infringement of the criminal laws (criminal courts) and controlling the rulers acting within the law (administrative courts). Given the uniqueness and delicacy of its missions, states proclaimed its independence in their constitution.In Mali, from independence to 1991, the judiciary remained subservient to the executive. It was under the Third Republic that it has acquired the formal guarantees of independence. However, it is in this republic that most trenchant criticisms are made against it: slow procedures, judicial corruption, fraudulent collusion between judges and lawyers, etc.The study of the judicial is the normative framework in its historical development (access, organization, operation, liability, etc.) and the contribution of labor struggles in the direction of strengthening the independence of judges. The study focused too on analysis of the difficulties faced by judges in their interaction with institutional and social environment (their relations with government, social relationships, etc.). This approach allows us to better appreciate the constraints of the construction of their independence to cope with their role of building the rule of law.The study finally, analyses the perceptions of litigants and the judges commented portrait of two of them that we considered “honest“ in accordance with the rules of professional conduct and ethics.

L’objectif de notre recherche est de préciser comment la conception novatrice de la science politique développée par Jean Bodin (1529/30-1596) dans sa Methodus ad facilem historiarum cognitionem(1566 ; 1572) s’inscrit dans le cadre d’un programme humaniste de restauration juridique de la «science civile». Pour cela, nous dégageons une ligne de réflexions sur cette «science» dans les œuvres de deux de ses prédécesseurs, Guillaume Budé et François Connan, qui la développent, à l’adresse des gens de justice, en élaborant un dispositif théorique, la «méthode», destiné à unifier la théorie juridique avec la connaissance pratique. Ces réflexions les amènent à ériger un nouveau paradigme du jusnaturalisme et à rétablir le droit tout entier sur la base de la droite raison, voire sur la base de la communauté de droit dominée par la seule raison: la civitas universa. Nous montrons que lorsque cette communauté est identifiée à la société mondiale de son temps, censée être régie par le ius gentiumqui incarne la raison, Bodin confère à la «science civile» un caractère politique. Le paradigme du jusnaturalisme le conduit à envisager le passage d’un état sauvage à la société humaine juridique (la communauté de droit), mais c’est la fameuse théorie de la souveraineté (summum imperium) qui permet aux magistrats des parlements d’opérer ce passage, en définissant leur pouvoir coercitif. Nous avançons que la science politique se concrétise dans la «méthode» de lecture de l’histoire et qu’elle détermine, au-delà des limites du droit, le rôle du gouvernement de la «République» comme ce qui réalise la société politique, c’est-à-dire la civitas universa régie par le ius gentium. / Our research aims to examine how the innovative conception of “political science”, developed by Jean Bodin (1529/30-1596) in his Methodus ad facilem historiarum cognitionem (1566; 1572), falls within the scope of a humanist program which restores legal science in the name of scientia civilis. We therefore propose to investigate the line of thoughts which regard the scientia civilisin the works oftwo of his predecessors, Guillaume Budé and François Connan, who develop this “science” for the sake of magistrates-judges of the Parlements by devising a “method” which intends to unify legal theory with practical knowledge. Their considerations lead them to establish a new paradigm of jusnaturalism and to re-establish, in modern times, the very notion of law on the basis of right reason, id est, on the basis of a community of laws dominated only by reason: civitas universa. We bring light to the fact that, when this community is identified with the international society of his time, supposedly ruled by the ius gentiumwhich incarnates reason, Bodin bestows upon his scientia civilis a political character. If the jusnaturalist paradigm allows him to assume the transition from a barbarous state to ahuman society, it is his famous theory of sovereignty (summum imperium) that,by defining the coercive power delegated tothe magistrates of Parlements, allowsthem to realize this transition. We propose that his “method” of reading the history enables him to materialize the political science, which determines, beyond the limits of legal science, the role thegovernment plays in realizing the human society, or in other words, the new civitas universa, governed by the ius gentium.

Droit pénal des mineurs et justice restaurative. Approche comparée franco-belge / Juvenile criminal law and restorative justice Comparative approach France -Belgium

La présente recherche porte sur les rapports entre droit pénal des mineurs et justice restaurative dans le cadre d’une approche comparative entre la France et la Belgique. Au-delà de la révélation de similitudes et de différences entre les deux pays dans ces domaines, la recherche aborde également les difficultés présentées par la France et la Belgique dans l’acceptation de la justice restaurative en droit pénal des mineurs et de son développement au sein des institutions judiciaires. Par l’étude des raisons qui ont conduit la France à manquer le tournant restauratif et de celles ayant permis, en Belgique, l’implantation de la justice restaurative dans le droit pénal des mineurs, des points d’ancrage sont relevés de nature à permettre son épanouissement dans l’ordonnance du 2 février 1945. Une expérimentation dans un service éducatif de réparation pénale a été menée avec le souci de prendre en compte des problématiques intéressant le service lui-même (logiques actuarielles, prudentielles, financières, idéologies professionnelles, craintes diverses). L’analyse des pratiques souligne que les services de réparation pénale, inscrits dans une rationalité managériale du traitement du phénomène criminel juvénile, sont limités dans la mise en œuvre des démarches de justice restaurative. Il s’avère également que quelques prises en compte du mineur et des modalités de l’exécution de la mesure envisagée par les éducateurs facilitent (approche psycho-criminologique du passage à l’acte inscrit dans une dimension psycho-socio-éducative de la réparation) ou bien inhibent (approche criminologique de l’acte inscrit dans une dimension rétributive de la réparation) des programmes de justice restaurative. Pour autant, quand bien même la pratique facilite une telle expérimentation, lorsque les éducateurs disposent de mission de « réparation-directe » notamment, des obstacles d’ordre idéologique s’observent au niveau de l’accueil, du démarchage et de la participation de la victime. Il demeure cependant essentiel de souligner que, par la présentation des principes et des promesses de la Justice restaurative aux éducateurs rencontrés, les écueils identifiés tombent, principalement quant à la présence de la victime lors de la mise en œuvre de la réparation pénale directe. Une telle évolution des postures professionnelles augure d’une intégration harmonieuse prochaine des démarches de justice restaurative en droit pénal des mineurs. / This research focuses on the juvenile criminal law and restorative justice in a comparative approach between France and Belgium. Beyond revealing the similarities and differences of these countries in these fields, the research also carters to the difficulties encountered by France and Belgium in the acceptance of restorative justice in juvenile criminal law and its development in the judicial institutions. By studying the reasons that led France to miss the “turning” of restorative justice and those enabled, in Belgium enabled, the implementation of restorative justice in the criminal law for minors, anchor points have been identified for its development in the order of 2 February 1945. Subsequently, an experiment in youth justice service on the reparation measures was led considering difficulties which concern the service itself (actuarial logic, supervisory, financial, professional ideologies and fears). Our analysis of practices in the youth justice services on the reparation measures, reveals that the experimentation of restorative justice is limited by a managerial rationality treatment of juvenile criminal phenomenon. Also, some of the minor approaches and their implementation in the measure facilitate (psycho-criminological approach to acting out part and a psycho-socio-educational dimension in reparation) or inhibit (criminological approach to act itself and a retributive dimension in reparation) restorative justice programs. However, even if the practice facilitates experimentation and that educators apply “direct reparation”, ideological barriers remain in dealing with victims. However, it remains essential to underline that, thanks to the presentation of the principles and promises of restorative justice educators met, the identified pitfalls fall, mainly with the presence of the victim during the implementation of “direct reparation”. Such a development professional postures omen a harmonious integration of next restorative justice approaches in juvenile criminal law.
