Cette thèse analyse la vie politique intérieure et extérieure, économique et constitutionnelle de la Mongolie depuis sa révolution démocratique. Depuis qu'elle s'est "détachée" politiquement et économiquement de la Russie, ce petit pays mise sur ses richesses naturelles et la Mongolie veut désormais développer sa coopération avec les autres pays et notamment ceux qui ont de l'expérience dans le domaine minier. Les analyses des investissements étrangers directs en Mongolie montrent l'impact de la législation intérieure: lois sur l'exploration et l'exploitation des ressources naturelles, la protection de l'environnement, et le classement stratégique des sites des ressources naturelles... La thèse s’emploie à expliquer les relations actuelles de la Mongolie avec les pays étrangers, et tente de prévoir ce qu'elles seront probablement à l'avenir compte tenu des engagements vis-à-vis des organisations internationales et des accords bilatéraux et multilatéraux. Cette thèse met en perspective le concept de "troisième voisin" dans la politique étrangère de la Mongolie qui partage la frontière avec la Russie au nord et la Chine au sud: la recherche de l’appui d’une tierce puissance, qui est un voisin virtuel (c’est-à-dire sans proximité géographique) partageant les mêmes valeurs démocratiques. En ce sens, la France, l'Allemagne, le Japon, les Etats-Unis, la République de Corée et le Canada sont des troisièmes voisins. Cette thèse tente d'expliquer en détails, les relations bilatérales entre la Mongolie et la France, sa troisième voisine privilégiée. Elle met en lumière les relations humaines, communautaires et territoriales entre la France et la Mongolie qui permettent d'entretenir de bonnes relations à un plus haut niveau indépendamment des problèmes économiques et politiques. Finalement, en tant que toute première thèse sur les relations étrangères mongoles, surtout avec la France, elle vise à servir de base de référence pour ceux qui s'intéressent à la Mongolie. / This thesis analyzes the internal and external political, economic and constitutional life of Mongolia since its democratic revolution. This small country mainly relies on its natural resources and willing to develop its cooperation with other countries, which have rich experiences in mining. Analyses on foreign direct investment in Mongolia show the impact of domestic legislation: laws on the exploration and exploitation of natural resources, protection of the environment, and strategic ranking of natural resource sites etc. The thesis attempts to explain Mongolia's current relations with foreign countries and tries to predict the future in light of the commitments to international organizations and bilateral and multilateral agreements. This thesis puts into perspective the concept of "third neighbor" in Mongolia's foreign policy: the search for the support of a third power, which is a virtual neighbor (ie without geographical proximity) sharing the same democratic values. Moreover, it tries to explain in detail, the bilateral relations between Mongolia and France, its privileged "third neighbor". It highlights the human and territorial relations between France and Mongolia that allow for good relations at a higher level irrespective of economic and political problems. Finally, as the very first thesis on Mongolian foreign relations, namely with France, it aims to serve as a reference base for those interested in Mongolia.

La protection environnementale face au principe de spécialité de l’Organisation Mondiale du Commerce

Le principe de spécialité des organisations internationales est-il un obstacle à la protection de l’environnement par le droit de l’OMC ? Dans ce mémoire, nous examinons l’impact du principe de spécialité sur les volontés de protection de l’environnement des Membres, via les textes de l’OMC et les décisions de l’Organe de Règlement des Différends. Le postulat de base de cette recherche vient du constat de l’opposition a priori des sphères économiques et environnementales. Toutefois, l’OMC semble vouloir orienter son activité normative vers le développement durable. Tandis que le droit international de l’environnement se développe, l’OMC tente de plus en plus d’intégrer les valeurs non-marchandes à ses réflexions. Toutefois, les principes fondamentaux du droit de l’OMC recherchent la libéralisation des échanges alors que les mesures environnementales sont souvent des obstacles au commerce. De ce fait, le principe de spécialité semble s’opposer à une réelle intégration des considérations environnementales dans le droit de l’OMC. La prise de conscience scientifique, civile et politique sur les dangers du changement climatique, poussent alors les Membres à adopter de nouvelles façons d’aborder la question. La coopération internationale se renforce entre les organes de droit international et le droit de l’OMC. L’adoption de réglementations favorables à l’environnement semble alors envisageable. Ce mémoire cherche donc à observer, dans les textes et la jurisprudence, l’évolution de la prise en compte de l’environnement au sein du droit de l’OMC sous le prisme du principe de spécialité. / Is the principle of specialty of international organizations an obstacle to the protection of the environment by WTO law? In this research, we observe the impact of the specialty principle on environmental protection wills, in both WTO texts and in decisions of the Dispute Settlement Body. The first approach of this research comes from the observation of a priori opposition of the economic and environmental spheres. However, the WTO seems want to direct its standard-setting activity towards sustainable development. As the international environmental law develops, the WTO is trying to integrate non-economic values into its thinking. However, the fundamental principles of WTO law seek the liberalization of international trades while environmental measures are often barriers to trade. As a result, the principle of specialty seems to avoid a real integration of environmental considerations into WTO law. Scientific, civil and political awareness of the dangers of climate change is therefore pushing Members to adopt new ways of approaching the issue. International cooperation is strengthening between the bodies of international law and the law of the WTO seems able, thanks to negotiations, to adopt new regulations favorable to the environment. This research therefore seeks to observe, in the texts and the jurisprudence, the evolution of the taking into account of the environment within the law of the WTO through the prism of the specialty principle.

Balanced interests in the Paris Agreement : Analysis of COP attendees’ interests at multilateral climate negotiations pre- and post-the Paris Agreement

The United Nations climate change conferences are the utmost platform for climate change negotiations and are convened under an international treaty known as the United Nations Framework Convention on Climate Change (UNFCCC). The causes of greenhouse gas emissions are deeply embedded in the economic and social activity on a global scale and yet, developing countries are expected to evolve into developed countries without straining the environment further. Knowledge of the interest of the participants at the COP is limited since no other research projects have measured it quantitively and at a large scale. This thesis aims to examine the professional interest in adaptation of delegates to the UNFCCC relative to other issue areas (mitigation and financing) and if there has been a shift in focus pre- and post-Paris Agreement. This thesis uses quantitative survey data gathered by The International Negotiations Survey (INS) together with two external indexes and data regarding CO2 emissions per capita for each country. While the chosen indexes to some extent overlap, they both contribute to the analysis by allowing to (1) measure the economic and social development of a country (HDI), (2) measure a country´s vulnerability to climate change (ND-GAIN). The results in this thesis show that there is a difference in interest among respondents that represent different HDI-categories. Results show that when comparing interest in adaptation to the external indexes, the more vulnerable a country is to the effects of climate change according to their ND-GAIN score the more interested their delegates are in adaptation. The results also indicate that respondents that represent countries that are most capable of addressing the effects of climate change show the least interest in doing so.

Succé eller fiasko? : - Hur påverkas bolagsavkastning av byte mellan Sveriges MTF-marknadsplatser

Det finns ett flertal tidigare studier som undersöker listbyten och dess effekt på ett bolags aktieavkastning. Merparten av dessa studier är dock baserade på den amerikanska aktiemarknaden. De svenska studierna som har genomförts undersöker effekten av listbyte från alternativa marknadsplatser (MTF) till huvudmarknaden (reglerad marknad). Det har framkommit att det finns ett kunskapsgap vad gäller hur aktieavkastning reagerar på marknadsplatsbyten på Sveriges MTF-er. Genom att endast fokusera på MTFmarknadsplatserna,AktieTorget, First North och Nordic MTF i Sverige och effekten av bytenmellan dessa marknadsplatser blir denna studie ett komplement till den tidigare forskningen inom området. I studien undersöks 39 svenska bolag som mellan åren 2007-2016 valt att byta marknadsplats. OMXPI är det jämförelseindex som använts för att jämföra bolagens avkastning med marknaden. Syftet med denna studie är att undersöka om det finns ett värdeför såväl bolagen som dess aktieägare att byta marknadsplats mellan AktieTorget, Nordic MTF och First North, istället för att stanna kvar på den ursprungliga listan. Detta syfte uppnås genom att studien undersöker bolagens aktieavkastning i samband med flytt till likvärdig, alternativ, marknadsplats för att ta reda på om bytet av marknadsplats skapar en negativ avkastning hos bolagen. Denna studie utförs i form av en kvantitativ eventstudie där marknadsplatsbytet utgör eventet. Studiens avsikt är inte att analysera de enskilda bolagen utan att istället ge en samlad bild av effekten på den aktiekursutveckling listbytet medför. Resultatet av studien visar att en negativ ackumulerad onormal avkastning (CAR) förekommer efter att marknadsplatsbytet genomförts. Vid beräkning av parametrarna imarknadsmodellen finner studien att den genomsnittliga ackumulerade onormala avkastningen (CAAR) för samtliga bolag är hela -47,88 %, 12 månader efter att marknadsplatsbytet genomförts. / There are several previous studies that examine switches between marketplaces and how these changes impact companies share performance. The most foregoing research made on the subject share performance is based on the US stock market. Swedish studies made to the subject examine the share performance when companies move from one of the SwedishMultilateral Trading Facilities (MTF) to main market. The authors of this paper have noted that there is a gap of knowledge regarding share performance when companies move between the Multilateral Trading Facilities. By only examining the Swedish Multilateral Trading Facilities, AktieTorget, First North and Nordic MTF, and how moving between the lists affects the share performance, this study is an addition to the previous research in the field.This study examines 39 Swedish companies, which have changed list between 2007-2016. OMXSPI is the benchmark used in this study to compare the companies return with the market return. The purpose of this study is to examine if there is a value for both the companies and its shareholders to exchange marketplaces between the Swedish Multilateral Trading Facilities, AktieTorget, First North and Nordic MTF. This purpose is achieved byexamine the company’s stock price development before and after the change of market place and identify if the change creates a negative share performance. This study is conducted in the form of a quantitative event study where the marketplace change represents the event. The purpose is not to analyze the individual companies but to provide a comprehensive picture ofthe effect the marketplace changes have on the stock price development. The result of the study indicates that a negative accumulated abnormal return (CAR) occurs after the marketplace change. When calculating the parameters in the market model the study finds that the average accumulated abnormal return (CAAR) for all companies is a total of -47,88 % twelve months after the marketplace change.

Automatic exchange of information: towards a new global standard of tax transparency / El intercambio automático de información: hacia el nuevo estándar de transparencia fiscal internacional

Tax authorities are increasingly relying on mutual cooperation with their foreign peers to enforce more effectively their internal tax laws. After the banking scandals of 2008 and the subsequent global financial crisis, the Global Forum on Transparency and Exchange of Information for TaxPurposes has proposed the exchange of information upon request as the fiscal transparency standard. However, some measures adopted by the European Union, previous initiatives from the Organization for Economic Cooperation and Development (OECD) and, above all, the introduction of the Foreign Account Tax Compliance Act (Fatca) by the United States in 2010 have promoted the need to adopt the automatic exchange of information as the new fiscal transparency standard. Automatic exchange of information allows home countries to verify whether their taxpayers have correctly included foreign income, allowing tax authorities to have early warning of possible noncompliance cases. In February 2014, the OECD published its proposal for a new global model of automatic exchange of financial account information. The new global model contains the necessary legal instruments and due diligence and reporting procedures, mainly for financial institutions. / Las autoridades tributarias dependen cada vez más de la cooperación con sus contrapartes extranjeras para administrar más eficazmente sus leyes tributarias nacionales. A grounded theory of critical incidents impact management among SAPS officers in the Vhembe District, Limpopo Province

A study was conducted to describe and interpret the personal strategies that South African Police Service officers in the Vhembe District, Limpopo Province, use in their line of work. These are strategies to deal with the impact of the primary victims’ critical incidents of rape, domestic violence, murder and road accidents. The focus was on describing the impact of the critical incidents that the officers are exposed to, which manifest in a form of traumatic stress, namely, vicarious traumatisation, and management of this impact. Twenty participants were selected through purposive and theoretical sampling techniques from the family violence, child protection and sexual offences, domestic violence, field training, detective and social crime prevention units. Unstructured open-ended interviews, diaries and follow-up telephone interviews were used as data collection methods and data were collected in the participants’ home languages, Tshivenda and Xitsonga. Data gathered necessitated looking into both the aspects of the officers’ organisational and operational work. Data were thus analysed through the content thematic and constant comparative data analysis methods. The results first presented a profile of police vicarious traumatisation in the Vhembe District, which include the types of critical incidents exposed to, the organisational and operational stressors that lead to vicarious traumatisation, and the description of vicarious traumatisation symptoms. Second, a theoretical framework of the process of police critical incidents impact management (PCIIM) was developed. The framework shows that the management of the impact of the encountered incidents is inspired by various coping needs and subcultures of the officers, and the management takes place through the use of two styles of trauma management, namely, the linear and multilateral styles, which refer to application of coping strategies successively and the combination of horizontal and vertical application of coping strategies, respectively. The coping strategies used by the officers help them to have an objective understanding of the critical incidents encountered, have less severe symptoms of vicarious traumatisation, some symptoms last for shorter periods than before, and other symptoms are no longer experienced. Resilience to the encountered incidents is shown through the development of coping strategies to handle the incidents, facing them, and showing cognitive hardiness. The officers also manage to reflect on the experiences encountered, engage in narratives about them and mutual help thus still working towards attaining posttraumatic growth. / Psychology / D. Les répercussions du plan Marshall sur les comportements économiques du Canada durant la période de l'après-guerre

La période de l’après-guerre posa d’importants défis commerciaux à l’économie canadienne. Les années entre 1945 et 1950 furent effectivement marquées par la rupture de son système commercial traditionnel et la recherche d’une stratégie alternative. Le pays dut composer avec un déficit commercial croissant à l’égard des États-Unis, ainsi qu’une chute de ses exportations à destination du Royaume-Uni, ruiné par les années de guerre. Ce déséquilibre commercial qui menaçait d’épuiser les réserves canadiennes de dollars américains reflétait l’écart entre les capacités productives des deux rives de l’Atlantique. Le programme de reconstruction des économies européennes, ou plan Marshall, fut accueilli avec enthousiasme à Ottawa puisqu’il devait non seulement rétablir les marchés du Vieux Continent, mais également faciliter la mise en place d’un réseau multilatéral d’échanges et la libéralisation du commerce international. Les tensions de la guerre froide limitèrent toutefois l’ouverture de ces marchés aux marchandises canadiennes, puisque l’endiguement du communisme commanda une consolidation européenne qui privilégia le démantèlement des entraves aux échanges intra-européens, aux dépens du commerce transatlantique. Les préoccupations de Washington en matière de sécurité collective devaient néanmoins laisser place à une stratégie alternative pour le Canada, en poussant la coopération économique des deux pays, dans le but d’optimiser une production de défense destinée aux pays membres de l’OTAN, dont la demande était soutenue par l’aide Marshall. L’incorporation du Canada dans ce dispositif de défense élargie à la communauté atlantique permit ainsi d’assurer un accès privilégié à ses marchandises sur le marché américain, et par conséquent de progresser vers l’équilibre commercial. / The postwar years brought many challenges to the Canadian economy in terms of trade policies. Indeed, in the years between 1945 and 1950, Canada experienced growing trade imbalances as imports from the United States market reached new peaks and exports to the United Kingdom decreased dramatically due to financial exhaustion caused by the war. These developments soon raised concerns as the country was faced with the prospect of foreign reserves depletion, a situation mainly caused by the productivity gap existing between the economies of the two sides of the Atlantic. The American sponsored European Recovery Program or Marshall Plan was met with enthusiasm in Ottawa as it intended to restore economic viability of the European markets as well as to establish a multilateral trade system based on non-discriminatory trade practices. The international tensions of the nascent Cold War were to limit these achievements as the need for a strong Europe dictated the elimination of restrictive trade practices between European commercial partners without giving equal treatment to transatlantic trade relations. However, the conflictual Cold War context was to offer an alternative strategy to the Canadian’s quest for dollars, for Washington’s collective security concerns paved the way to closer economic cooperation and privileged access to Canadian exports of strategic materials and other defence related commodities in the American market. The Marshall Plan was a key element of the procurement mechanism of the NATO country whose demand alleviated the pressure on Canadian foreign reserves through greater exports to the United Stated.

Aid effectiveness, performance and vulnerability : new perspectives

La question de l’efficacité de l’aide publique au développement est complexe et protéiforme. L’aide se présente sous de nombreuses formes et implique de nombreux instruments et acteurs, dont les objectifs et mêmes les philosophies diffèrent fortement entre les pays et les organisations. De cet enchevêtrement, les économistes ont jusqu’alors échoué dans leurs recherches de relations macroéconomiques robustes censées guider l’action publique. Ainsi, aucun consensus ne semble pour l’instant émerger de ce débat. Dès lors, l’orientation des politiques de développement a essentiellement été influencée par des hypothèses contestables reposant sur des fondements empiriques fragiles. Ce travail tente d’apporter de nouveaux éléments au débat sur l’efficacité de l’aide au travers de sept essais. Les trois premiers chapitres se consacrent à la question de la relation entre aide et croissance du point de vue statistique. Les nouvelles approches qui y sont proposées tentent de surmonter la plupart des défauts de la littérature empirique existante. Nous y montrons que la relation entre aide et croissance est extrêmement complexe et qu’il est difficile de l’appréhender à l’aide des méthodes économétriques usuelles. De plus, bien que l’aide semble globalement efficace en termes de croissance du PIB, son efficacité dépend de différents facteurs révélés par la présence de seuils aussi bien conditionnels que non-Conditionnels. Parmi ces facteurs, la vulnérabilité économique semble jouer un rôle primordial et sa prise en compte s’avère indispensable pour une compréhension globale du lien entre l’aide et la croissance économique. Dans une seconde partie, les deux chapitres suivants s’intéressent plus particulièrement à l’aide sectorielle, à travers l’étude de l’efficacité de deux initiatives largement reconnues que sont l’aide à la scolarisation primaire universelle et l’aide au commerce. Leur efficacité sera alors déterminée non plus en termes de croissance du PIB mais en termes de scolarisation et de performance à l’exportation. A l’instar des trois premiers chapitres, nos résultats semblent confirmer la présence d’une relation significative entre l’aide et les objectifs visés. Nos conclusions, notamment celles en termes d’éducation, vont clairement à l’encontre de l’idée selon laquelle l’aide aurait fait plus de mal que de bien. Enfin, en se basant sur les résultats précédents, les chapitres six et sept explorent, dans une troisième partie, les possibilités d’amélioration des stratégies actuelles d’allocation de l’aide mises en œuvre notamment par les grands bailleurs multilatéraux. Une de nos principales observations est que la vulnérabilité économique est un facteur important devant être pris en compte dans le design des méthodes d’allocation de l’aide. / Aid effectiveness is a complex issue. Aid comes in many instruments, has many targets and involves many stakeholders whose objectives, methods and philosophy greatly differ across countries and institutions. From this mixed bag, economists have struggled finding strong regularities at the macroeconomic level to guide the political debate and consensus have failed to emerge. Hence, political stances have often been influenced by strong assumptions based on weak or at least hotly debated evidence. This work is an attempt to provide new perspectives on the aid effectiveness debate through seven essays. The first three chapters address the technical question of the aid/growth relationship issue using new approaches and new statistical instruments in an attempt to overcome most of the caveats of the aid empirical literature. We show that the aid/growth relationship is complex and difficult to measure using common statistical methods. Moreover, while aid is globally effective, its effectiveness depends on different factors reflected by the existence of conditional and unconditional thresholds. Among those factors, economic vulnerability seems to be a key component that has to be taken into account in order to identify this relationship. In a second part, we try to assess the effectiveness of two flagship initiatives which are Aid for Trade and Universal Primary Education with regards to the outcomes they ultimately target, namely, export performance for the former and school enrolment, gender parity and repetition rate in primary school for the later. As in the first three chapters, our results support the existence of a significant relationship between aid and the targeted outcomes. Those results, notably for the education sector, clearly argue against the idea that aid has done more bad then good. Finally, based on previous results, in a third part, chapters six and seven explore the mean to improve the current aid allocation strategies used notably by the Multilateral Development Banks. One of the main conclusions is that economic vulnerability is a central factor to be taken into account in the design of aid allocation strategies.

Due to the globalization of economy, the protection of intellectual property rights becomes very important, not only on a national and local basis but also on an international basis. The evidence is coming from the negotiation and ultimately the inclusion of the TRIPS Agreement, or Agreement on Trade Related Aspects of Intellectual Property Rights, into the World Trade Organization. In the TRIPS Agreement, one of the protections to a local intellectual property on an international level is the protection of geographical indications, and such protection can be found in Articles 22 through 24 of the TRIPS Agreement. Geographical indications identify goods as originating in a particular territory or region, and also indicate quality by letting consumers know that the goods come from an area where a given quality, reputation, or other characteristic of the goods is essentially attributable to their geographical origin. The protection of geographical indications has always been on the table and been mentioned in various international treaties, and eventually came together under the TRIPS Agreement. The different ways for geographical indications protection is examined in order to understand the different national regulations used in various countries as a tool to protect the geographical indications, hence, to protect intellectual property rights. The major issue regards the scope of protection is the extension of the TRIPS Article 23; diverse opinions and suggestions are coming from US and EU, the two biggest sovereignties. This also can be seen in the result of the WTO dispute case of EC – Trademarks and Geographical Indications.
