This thesis discusses the interaction between the concepts of ”justice” (ma‛at) and ”law” (hpw) in ancient Egypt. Ma‛at, one of the earliest abstract terms in human speech, was a central principle and, although no codex of Egyptian law has been found, there is abundant evidence of written law, designed to realise ma‛at on earth. The king, as the highest legal authority, was the nexus between ma‛at and the law. Egyptologists have few sources of knowledge about law and justice in ancient Egypt because the ancient Egyptians used commonplace language in legal documents and they only had a few imprecise technical terms relating to law. For Egyptology to advance, therefore, we need to reappraise its sources. The Tale of the Eloquent Peasant has a strong legal background and should be treated as an additional source of information about how law and justice were perceived and carried out in ancient Egypt. / Classics and Modern European Languages / M.A. (Ancient Languages and Cultures)

Distribution and Differences : Stratification and the System of Reproduction in a Swedish Peasant Community 1620-1820

This dissertation examines the character, conditions and change of peasant stratification in early modern Sweden. Wherever and whenever one looks, one finds that resources were unevenly spread among peasant households. In the literature, there are different, and conflicting, views compatible with this finding. In order to explain its character, this study places peasant stratification into a broader system of resource reproduction. Resource holding, families, and individuals are studied over time. The study is based on an extended family reconstitution comprising the landholding peasants in the Mid-Swedish parish of Björskog between 1620 and 1820. Data has been compiled from cadastres, poll tax registers, parish registers, court records, and maps, and has then been related to the information on resource holding as given by tax lists and probate inventories. Six elements and three general principles are identified as fundamental to systems of resource reproduction among peasants. Starting from these, the book argues that the resource holding of a Swedish peasant household was relatively independent of family demography; that wealthy peasants were able to retain large surpluses even during the period of high rent pressure in the seventeenth century; that the reproduction of poorer peasant households was imperfect whereas the reproduction of wealthier households was extended; that wealthy peasants dominated the local community; that economic inequalities within the class of landed peasants did not increase during the seventeenth and eighteenth centuries; that land accumulation and cyclical mobility became important features of peasant society, but not until the decades around 1800: and that the peasant community was characterized by a large degree of geographical and downward social mobility.

Comme dans presque tous les pays d'Afrique subsaharienne, la majorité de la population sénégalaise est rurale. Elle vit de l'agriculture ou d'activités qui en dépendent. Paradoxalement les investissements publics dans le secteur agricole restent très faibles, alors que l'insécurité alimentaire progresse. Pour faire face aux problèmes alimentaires, les pouvoirs publics multiplient les annonces de politiques agricoles, qui ne sont presque jamais suivies d'effets, parce que ne reposant pas sur des études précises et rigoureuses. A la place de politiques, il y a surtout des stratégies de gestion conjoncturelle des crises alimentaires. Dans ce contexte, nous avons cherché à comprendre les stratégies développées par la petite paysannerie, les dynamiques qui animent les exploitations agricoles familiales pour faire reculer l'insécurité alimentaire en milieu rural, et dans quelle mesure celles-ci peuvent contribuer à la souveraineté alimentaire du Sénégal. Cette question appelle celle de l'accès à une nourriture suffisante et celle de sa production. Ainsi, à travers notre étude que nous avons intitulée « Dynamiques paysannes, souveraineté alimentaire et marché mondial des produits agricoles : l'exemple du Sénégal », nous cherchons à répondre à une série de questions : 1. Comment les paysans sénégalais produisent-ils les biens nécessaires à l'alimentation et l'entretien de leur famille ? 2. Comment les paysans sénégalais sont-ils organisés autour des questions de la vie rurale ? 3. Quelle est l'influence du marché mondial de produits agricoles et de ses règles établies par l'Organisation mondiale du commerce (OMC), sur la disponibilité et l'accès aux produits alimentaires ? De quelle façon les biens alimentaires importés concurrencent-ils la culture de biens agricoles qu'il est possible de produire localement ? Nous avons ainsi consacré une première partie de notre étude au procès de production et à son évolution. En dehors des conditions climatiques, le contrôle effectif par les paysans, des moyens de production et de la tenure foncière, détermine en grande partie, les volumes de biens agricoles et alimentaires produits, ainsi que leur accès. Dans une seconde partie, nous avons analysé l'émergence et l'évolution des modes d'organisation paysanne et examiné leur influence sur la satisfaction des besoins alimentaires et les orientations des politiques publiques en matière agricole. Enfin, dans une troisième partie, nous avons essayé de mesurer l'impact des règles du commerce international sur les productions locales de biens agricoles et alimentaires. Ce travail nous a permis de tirer un certain nombre de conclusions. La majorité des paysans du Sénégal ne parvient plus à produire le volume d'aliments de base nécessaires pour nourrir et entretenir leur famille. Les moyens de production ont relativement peu évolué au cours des dernières décennies, même si la culture attelée et l'introduction de nouveaux matériels ont considérablement amélioré les conditions de production et diminué la pénibilité du travail. L'outil de production s'est dégradé. Il est vétuste et ce qu'il en reste ne survit que grâce à l'habileté des forgerons ruraux. Les connaissances traditionnelles comme les repères météorologiques conditionnent le choix des denrées cultivées et des superficies qui leur sont consacrées lorsque celles-ci sont disponibles. La recherche agronomique a permis d'obtenir des variétés homologuées de semences adaptées aux conditions pédologiques et climatiques. Mais elle demeure inefficace en ce sens que les moyens pour appliquer concrètement ses résultats sont absents et les paysans n'ont aucune maîtrise sur elle. La question foncière reste soumise à des tâtonnements qui sont le fait de sa complexité ; les croyances et les pratiques traditionnelles en la matière ne semblent pas encore prêtes à laisser la place à des règles modernes, ou le cas échéant, à s'y adapter. Les conditions de plus en plus sévères, qui sont ressenties avant tout dans le domaine alimentaire, ont mis en évidence les capacités de la paysannerie à s'adapter. Pour chaque situation nouvelle entrainant des difficultés supplémentaires, des solutions originales sont imaginées et mises en oeuvre par les paysans, leur permettant une adaptation insoupçonnée. La capacité des paysans à prendre en main leurs propres préoccupations a été mise en évidence par l'émergence d'organisations, de groupements, d'associations et d'unions dans tout l'espace rural du Sénégal. Sur le plan du commerce international des produits agricoles, la faiblesse du Tarif extérieur commun (TEC) de la CEDEAO a eu pour conséquence l'augmentation des volumes d'importations de biens qui peuvent être produits localement. Les règles de l'OMC, basées sur une conception ultralibérale du marché portent davantage préjudice aux produits agricoles et alimentaires de l'Afrique de l'Ouest. Les pays les plus vulnérables comme le Sénégal, en renforçant leurs ressources humaines en matière juridique, peuvent cependant exploiter les clauses qui leur permettent de mieux protéger les productions locales. Sur un plan plus global, et à défaut de sortir l'agriculture des accords de l'OMC, il est possible de réclamer avec la CEDEAO, la mise en place d'un autre Accord sur l'agriculture qui redéfinirait le dumping de manière à protéger les pays les plus vulnérables. / As in almost all SSA countries, the majority of the Senegalese population is rural. They earn their livelihoods from agriculture or activities that depend on it. Paradoxically, the public investment in agriculture remains very low, while food insecurity is progressing. To deal with food problems, the government multiplies announcements of agricultural policies, which are almost never followed up, because not based on specific and rigorous studies. Instead of policies, there are mostly management strategies cyclical food crises. In this context, we have sought to understand the strategies developed by the peasantry, the dynamics that drive family farms to reduce food insecurity in rural areas, and to what extent they can contribute to food sovereignty Senegal. This question calls for that of access to adequate food and that of its production. Thus, through our study we have entitled "Farming dynamics, food sovereignty and global market for agricultural products: the example of Senegal”, we try to answer a series of questions: 1. How do Senegalese farmers produce the goods needed to feed and care for their family? 2. How are Senegalese farmers organized around issues of rural life? 3. What is the influence of the world market of agricultural products and its rules established by the World Trade Organization (WTO) on the availability of and access to food? How do imported goods compete with food products that can be produced locally? We have devoted the first part of our study to the production process and its evolution. Apart from weather conditions, effective control by farmers of means of production and land tenure, largely determines the volumes of agricultural and food products as well as their access. The second part analyzes the emergence and evolution of modes of peasant organization and discusses their influence on the satisfaction of food needs and directions of public policy in agriculture. Finally, in the third part, we have tried to measure the impact of international trade rules on local production of agricultural goods and foodstuffs. This work has enabled us to draw some conclusions. The majority of farmers in Senegal can no longer produce the amount of basic foods needed to feed and support their families. The means of production have changed relatively little in recent decades, although animal traction and the introduction of new materials have greatly improved the conditions of production and reduced drudgery. The production tool has deteriorated. It is old and what is left survives only thanks to the ability of rural blacksmiths. Traditional knowledge and knowledge of weather condition the choice of crops grown and acreage devoted to them when they are available. Research in agriculture has yielded certified seed varieties adapted to soil and climatic conditions. But it remains ineffective in that the means for concretely applying its results are absent and the peasants have no control over it. The question of land remains subject to trial and error due to its complexity, traditional beliefs and practices in this area do not yet seem ready to give way to modern rules, or if necessary, adapt to them. More and more severe conditions felt primarily in the food sector have highlighted the capacity of the peasantry to adapt. For each new situation causing additional problems, novel solutions are devised and implemented by farmers, enabling them to adapt in an unexpected manner. Farmers' ability to take charge of their own concerns were highlighted by the emergence of organizations, groups, associations and unions throughout the rural areas of Senegal. As far as international trade in agricultural products is concerned, the weakness of the Common External Tariff (CET) of ECOWAS has resulted in increased volumes of imports of goods that can be produced locally. WTO rules, based on an ultra-liberal conception of the market, are more detrimental to West African agricultural and food products. By strengthening their human resources through legislation, more vulnerable countries such as Senegal, can, however, exploit the clauses that allow them to better protect local production. More globally, unless agriculture is removed from WTO agreements, it is possible to claim with ECOWAS, the implementation of another agreement on agriculture that would redefine dumping so as to protect the most vulnerable countries.

Propomos esta pesquisa para contribuir com o debate sobre participação política, tendo como objeto de estudo as manifestações dos movimentos socioterritoriais do campo no estado de São Paulo e as políticas públicas reivindicadas, para melhor compreensão da questão agrária e do desenvolvimento territorial rural. Entendemos essas ações dentro do processo de luta pela e na terra, pois além de reivindicarem territórios que se materializam em assentamentos rurais, os movimentos reivindicam também políticas públicas visando desenvolver os territórios conquistados. Utilizando o Banco de Dados da Luta pela Terra (DATALUTA), fontes bibliográficas, documentais e trabalhos de campo, realizamos um estudo das manifestações do período 2000 a 2012, tendo como recorte espacial o estado de São Paulo. Com os dados das manifestações e suas reivindicações realizamos trabalho de campo em dois assentamentos rurais no estado de São Paulo: o assentamento Gleba XV de Novembro, nos municípios de Euclides da Cunha Paulista e Rosana, e o assentamento Fazenda Reunidas, no município de Promissão. A intenção foi de verificar se houve relação entre o reivindicado nesses últimos anos e as políticas públicas implementadas nesses territórios. O objetivo deste projeto é compreender a importância das manifestações camponesas como participação política de movimentos organizados para reivindicação, definição e implementação de políticas públicas para o os seus territórios / We propose this research to contribute to the debate on political participation, with the object of study the manifestations of socio-territorial movements of the field in the state of São Paulo and the claimed public policy, to better understand the agrarian question and the rural territorial development. Este trabalho trata da ação coletiva e comunitária dos camponeses indígenas bolivianos migrantes nos conflitos pela posse da terra nas regiões densas do avanço modernizador da agricultura chamadas oriente boliviano. As oportunidades adversas e assimétricas no acesso à terra, motivam constantes produções de luta, combinadas com formas sindicais, indígenas e MSTistas enquanto realizam ocupações de terras públicas e terras pretendidas pelos fazendeiros e pecuaristas. Pelo fato de serem esses sujeitos naturais majoritariamente quéchuas, objetivam perspectivas andinas de produção e olhares de mobilização, além de contribuírem com suas ações nos projetos de mudança nacional, tanto na crise do Estado boliviano, de 2000 até 2005, quanto na formação do Estado Plurinacional da Bolívia, de 2006 até 2010. Oferecem-se evidências da questão da terra da segunda metade do século XX, quando o campesinato se transforma numa poderosa força econômica e política. Combatidas pelas forças repressivas por optar pela forma ilegal das ocupações e, no tempo em que recuam, coexistem com seus contendores optando pelas normas e procedimentos oferecidos de cima para baixo. No presente trabalho, concentra-se menos nas estruturas e mais em pessoas, em indivíduos mobilizados, nas suas interações, em suas emoções, consensos e dissensos cotidianos dos chamados avasalladores, invasores de terras que produzem uma racionalidade própria de luta. Foram estudados depoimentos em quéchua dos protagonistas do conflito, narrativas dos líderes de base, entrevistas a ex-funcionários de Estado, intelectuais, etc. Analisaram-se também documentos manuscritos dos grupos mobilizados; revisaram-se arquivos policiais e do Ministério Público; jornais nacionais; demandas escritas pelas organizações; e, informação seleta dos arquivos do INC e o INRA, ambas entidades agrárias. A pesquisa é apoiada na observação etnográfica de campo e trajetória do pesquisador sobre a questão. / This research deals with the collective action of migrant Bolivian indigenous farmers in conflicts over land, in the dense regions of modernizing advancement of eastern Bolivia called agriculture. The adverse and asymmetric opportunities in access to land motivate constant production of struggles, combining with union, indigenous, and MSTi-like forms, while occupying public land intended for farmer and rancher use. Because these subjects are mostly quechua, they aim for Andean perspectives of production and Andean views on mobilization, as well as contributing with their actions to national change projects, both in the Bolivian state crisis (from 2000 to 2005) as well as in the formation of the Plurinational State of Bolivia (from 2006 to 2010). Regarding matters of land ownership, it is offered documentation of the second half of the twentieth century, when the peasantry becomes a powerful economic and political force. These political agents fight against the repressive forces, when they opt for illegal occupations, and recede in other times, opting to coexist with their contenders and with rules and procedures offered from the top down. This study focuses less on structures and more on mobilized individuals, their interactions, their emotions, everyday consensus and dissent of the so-called avasalladores, land invaders, who produce their own rationality of struggle. This study analyses thee statements produced in Quechua by the protagonists of the conflict, grassroots leaders narratives, interviews with former State employees, texts written by intellectuals, etc. Also, handwritten documents made by the mobilized groups; police and prosecutors files; national newspapers; demands written by organizations; and information from the files of the INC and the INRA, both agricultural entities. This research is supported by ethnographic field observations and the ressearchers trajectory with the issue.

Territorialidades e redes da migração maranhense para o trabalho nos canaviais paulistas / Territoriality and networks of the migration from Maranhao to São Paulo cane fields

Os deslocamentos de homens, mulheres e famílias inteiras, moradoras no município de Timbiras/MA para o labor nas atividades da agricultura canavieira no Estado de São Paulo se desenrola por uma série de redes de relações pessoais, que abrange diversos agentes sociais, tanto no Maranhão - no município timbirense e também em municípios vizinhos - como nas duas principais cidades em que residem durante a colheita da gramínea, no Estado de São Paulo: Guariba e Pradópolis. Por meio de testemunhos orais, colhidos no município de Timbiras (MA) e nas cidades paulistas de Guariba e Pradópolis, buscamos compreender as relações entre a rede de informações familiares e as redes territoriais de apoio que fundamentam o processo migratório. A primeira se sustenta a partir de vínculos de reciprocidade nutridos pelos trabalhadores migrantes nos espaços sociais das referidos municípios do Estado do Maranhão e de São Paulo. Já as redes territoriais de apoio dão suporte a essa troca de informações entre os territórios de migração e o dito local de moradia do tronco ou núcleo familiar, no Maranhão nos anos 2000. Essas redes de relações pessoais, fundamentais para alavancar a experiência migratória, se costuram, se refiguram e se fortalecem a partir de múltiplas formas de trocas de informações entre os que migraram e os que não migraram, bem como entre os possíveis migrantes e os agentes responsáveis pelo processo de deslocamento e recrutamento até a área canavieira paulista. Compreende-se que há uma vinculação estreita entre o processo de construção de territórios de migração e a territorialidade experimentada na área de origem, sustentada por redes múltiplas de relações sociais que cimentam estas territorialidades criadas e ressignificadas com a migração. / The displacements of men, women and entire families living in the city of Timbiras/MA for labor in agricultural activities of sugarcane in the state of São Paulo unfolds through a series of networks of personal relationships, covering many different social agents, both in Maranhão in the city of Timbiras and in neighboring counties as well - and in the two major cities where they live during the harvest of sugarcane, in the State of São Paulo: Guariba and Pradópolis. By oral testimonies, collected in the municipality of Timbiras (MA) and in the cities of Guariba (SP) and Pradópolis (SP), we sought to achieve the understanding of the relationships between the network of family information and territorial networks of support that underlie the migration process. The first is based on the bonds of reciprocity fed by migrant workers in the social spaces of these referred cities in the state of Maranhão and São Paulo. The territorial networks of support gives a base to this exchange of information between the territories of migration and the place of residence of core of the family, in Maranhão in the year of 2000. These networks of personal relationships, fundamental to leverage the experience of migration, sew themselves get strengthened from multiple forms of information exchange between those who migrated and those who did not, as well as among potential migrants and the agents responsible for the process displacement and recruitment to the sugarcane production area in São Paulo. It was possible to understand that there is a close relationship between the process of construction of territories of migration and the territoriality experienced in the area of origin, supported by multiple networks of social relationships that cement these territorialities created and re-signified with the migration.

O quilombo de Pedro Cubas situa-se, juntamente com a maioria das comunidades remanescentes paulistas, na região do Vale do Ribeira. Incentivos financeiros por parte do governo estadual na região e a valorização das terras a partir de meados do século XX criaram um ambiente de tensão e ameaça ao modo de vida dessa população, a qual existe desde a primeira metade do século XIX. Durante as décadas de 1990 e 2000, diversas dessas comunidades foram finalmente reconhecidas e tituladas com base na Constituição de 1988, a qual assegura aos quilombos a posse coletiva de suas terras centenárias. Diversas pesquisas antropológicas e ecológicas foram executadas no Médio Ribeira em parceria com as comunidades quilombolas da região, muitas delas contribuindo para os processos reivindicatórios dessas populações. No entanto, nenhuma destas pesquisas teve por enfoque a materialidade dessas populações. Inspirado nos pressupostos teóricos da Arqueologia Histórica, Ecologia Histórica e Arqueologia da Paisagem, esta dissertação de mestrado tem como objetivo a identificação de antigas áreas residenciais, com ênfase na utilização de vestígios arbóreos típicos dos padrões de assentamento locais. Com base principalmente em entrevistas e visitas guiadas à áreas antigamente habitadas, uma correlação clara entre determinadas espécies de árvores frutíferas e antigas habitações foi estabelecida. Por fim, espera-se também que essa dissertação venha a contribuir para o crescimento recente dos estudos arqueológicos em comunidades quilombolas e rurais em geral. / The maroon of Pedro Cubas is located, as the majority of the other paulista communities, at the Ribeira Valley region. State government financial incentives and land valorization by the second half of the XXth century created an environment of tension and a threat to this population\'s way of life, which exists since the end of the XIXth century. During 1990 and 2000 decades several of these communities were finally recognized and conceived collective land titles based on 1988\'s Constitution, which assures the maroons the rights to their centennial lands. Many anthropological and ecological researches were made at the Middle Ribeira Valley in partnership with the region\'s maroon communities, contributing to their reivindication processes. However none of these researches emphasized the materiality of these populations. Inspired on Historical Archaeology, Historical Ecology and Landscape Archaeology theoretical assumptions, this master\'s thesis has as its objective the identification of former residential areas with emphasis on the use of typical arboreal vestiges from local settlement patterns. Based mainly on interviews and guided visits to formerly inhabited areas, a clear correlation between determined tree species and ancient inhabited areas was established. Finally it is also hoped that this master\'s thesis contribute to the recent growing of archaeological studies on maroon and rural communities in general.
