I uppsatsen har Anom och Operation Trojan Shield analyserats utifrån frågeställning­arna hur domstolarna har hanterat bevisningen som tillkommit genom insatsen, vilka bevisförbud som finns att tillgå i svensk rätt, om de bör tillämpas under förevarande omständigheter samt slutligen om några förändringar av bevisreglerna är påkallade med hänsyn till vad som framkommit i uppsatsen i övrigt. Operation Trojan Shield var en insats som skulle hjälpa de brottsbekämpande myndigheterna att lagföra företrädare för den grova organiserade brottsligheten. Anom var emellertid inte den första krypterade kommunikationstjänsten som domstolarna fick på sitt bord. Föregångaren EncroChat hade redan hanterats av underrätterna. Det föreligger dock väsentliga skillnader i de olika kommunikationstjänsterna uppkomstsätt, vilket borde fått genomslag i domstolarnas hantering. Insatsen Operation Trojan Shield har karaktär av brottsprovokation, eftersom Anom-enheterna började användas i samband med att andra krypterade kommunikationstjänster försvann från marknaden. Amerikanska brottsbekämpande myndigheter har upprättat och marknadsfört tjänsten på ett sätt som väckt en brottslig vilja, åtminstone hos högnivådistributörerna inom nätverksbrottsligheten. Genom att svenska domstolar sedan har tillämpat samma bevisrättsliga regler på Anom-material som EncroChat-material har resultatet varit otillfredsställande i relation till rätten till rättvis rättegång.

Through an argumentation analysis and gender jurisprudence theory, this essay examines the complexity of masculinity norms and their connection with the legal system in western cultures. The analysis  investigates how this connection affects equality and justice within the framework of the right to a fair trial. The results show that courts and juries' values regarding "appropriate" masculinity influence decision-making processes. The conclusion of the essay shows that depending on how men, in relation to masculinity norms, are evaluated by the legal system, as well as factors such as class, social position, ethnicity, age, and sexuality, there will be an impact on how men are judged in relation to acts of violence and crime.

There were many ways of bordering manliness during the historical period covered by my research. Borders have been metaphorically understood as those invisible, often non-enunciated limits that have safeguarded manliness. There were borders separating masculinity from femininity and from childishnes, but there is also a more distant border, separating masculinity from the bestial. The term un-manliness is a useful concept for this analysis, for it can be used to illuminate the different ways in which masculinity has been interrogated. The concept can also be used in comparative analyses of how tolerance towards men deviating from ideas of ideal masculinity has differed according to situation and culture. It has been my ambition to elucidate the particular attitudes, values, customs, knowledge and requirements that influenced the view of masculinity at both individual and the group level. The clearest-cut aspects of manliness and un-manliness expressed in court proceedings were those having to do with sexuality, relations within the household, and the subordinate and dominant masculinities displayed by different court-room actors. The latter, in turn, reflected contemporary social structures, including the social gap that divided the Livonian peasantry’s serfs or former serfs from the ruling Baltic-German elite. Records from the court proceedings have shown the subordinate masculinity of the defendants, subordinate not only to that of the officers of the court but to that of the witnesses. This subordination was an inevitable consequence of the nature of the accusations, regardless of whether they were deemed well-founded or false.  The defendants were placed in a situation where they were forced constantly to be on the alert, ready to defend themselves and show their best sides. As a result, they would often give extremely clear expression to their views of proper masculinity. Such actors stressed, consciously or unconsciously, certain manly traits and behaviour patterns that characterised themselves and others. Their arguments provide insights into what they thought of each other and how they conceived a man should generally be, behave and act in different situations. By the same token, they clearly showed what kinds of behaviours were considered undesirable or outright unmanly. The positioning of the borders of manliness was linked both to time and to space. Deviations have helped different societies set the borders for what they considered acceptable behaviour. There was a clear cultural and geographical border between Sweden as such, and the Swedish province Livonia. This emerges clearly when one compares Livonian results with earlier studies on bestiality in Sweden. This shows that the view of manliness and the tolerance towards certain kinds of behaviour changed as one moved East.

Fair trials’ rights under Swedish law of public administration (FL) are regulated by Article 7 of the Statute. Similarly, fair trials’ right under the European Convention of Human Rights (EU Convention) is regulated by Article 6.1. The essay conducts a comparative study of the two legislations and seeks to determine whether Article 7 of the Swedish law of public administration is consistent and compliance with Article 6.1 of the EU Convention. The essay identifies and examines ten cases that have been handled in different courts in Sweden on a comparative basis with samples of other cases handled by Justitieombudsmannen. The objective is to compare and determine whether fair trial process as provided for under Swedish legislation are consistent, or in compliance, with the EU Convention. In the determination of the fairness or otherwise of the procedural process, including the time-line it takes to dispose of a given case and whether the Swedish Court’s procedure is consistent with speedy trials’ requirements stipulated in the EU Convention, the essay examines the modalities adopted in interpretation of the different laws, rules and regulations by the different courts in Sweden. Where errors are identified, the essay will examine what corrective measures, if any, may be taken to redress these possible mistakes that may have resulted in violations of the rights of an applicant as a result of incompetence, failure or mistake of an employee in the public administration.  The analysis is focused on cases that have been poorly handled in the sense that the process was slow or ineffective and did not meet the threshold of fair trial and good governance. The essay examines situation where, in event of a violation of the applicable law by a public administrator, there are no sanctions provided, or corrective measures in the statute that may be available to an aggrieved party. The essay considers whether, as a result of a violation, there needs to be a provision in the law for compensating that aggrieved party. In conclusion, the essay suggests possible remedies, including compensation or a re-hearing of the application before a different panel of judges. These proposals may be considered if deemed useful or relevant in amending the Swedish law to provide corrective measures to an aggrieved party. / Sveriges domstolar och myndigheter har genom åren fått kritik från domstolsverket och Justitieombudsmannen, (JO), angående långa handläggningstider. Under åren 1999-2008 har Sverige varit part i 25 domar hos Europadomstolen, där enskilda inte fått sin rätt till rättvis rättegång inom skälig tid enligt EKMR, artikel 6.1. uppfylld. Förvaltningslagen, (FL), som gäller för handläggning av ärenden inom förvaltningsmyndigheter och domstol, har under åren ändrats väldigt mycket. Just frågan om förvaltningsförfarandet, snabb, billig och effektiv handläggning, har på olika sätt blivit behandlats i propositioner och motioner. Syftet med lagen är att garantera enskildas rättsäkerhet, som är grunderna för en “god” förvaltning. Hur denna tidsaspekt och tidsfrist inom snabb, enkel och billig handläggning har tolkats, kommer vi med hjälp av olika lagar, förordningar, praxis m.m., behandla i denna uppsats.
