La justice restaurative : étude comparée du droit thaïlandais et du droit français

L’émergence de la justice restaurative est le résultat d’une certaine inefficacité de la justice pénale classique. Le concept de la justice restaurative propose de répondre d’une façon novatrice à la criminalité et aux conflits. La justice restaurative se révèle être aujourd’hui une voie prometteuse de consolidation de l’harmonie sociale. Elle cherche à soutenir toutes les personnes impliquées (les victimes, les délinquants et les membres de la communauté), à leur donner des possibilités de participer et de communiquer et ainsi à favoriser une démarche de réparation afin de rétablir les liens sociaux brisés suite à l’infraction. Ces travaux de thèse ont pour objectif de connaître et comprendre la justice restaurative, les modalités et les mesures rencontrées notamment en France et en Thaïlande. À cet effet, nous avons posé deux questions centrales, à savoir : Quel est le cadre général et juridique de la justice restaurative ? ainsi que : Quelles sont les mesures existantes déclinées pour la mise en œuvre de la justice restaurative ? Grâce aux réponses apportées à ces questions, nous pourrons mieux connaître et comprendre la justice restaurative en France et en Thaïlande. / The emergence of restorative justice is the result of inefficiency of the classic criminal justice process. The concept of restorative justice offers innovative approach to crime and conflict. It appears to be a promising way to consolidate social harmony by supporting all the people involved (victims, offenders and community members). Restorative justice gives them opportunities to participate and communicate; and encourages a process of repair in order to mend the broken society bonds caused by offense. The aim of this thesis is to know about and understand terms and measures encountered during restorative justice programme in Thailand and in France. To do this, we need to answer two questions: what are the general and legal frameworks of restorative justice? and what are the existing measures implemented on the restorative justice? The answers of these questions should give us a better understanding of the restorative justice of both countries.

In the criminal sphere and the accountability of adolescents, there is an unprecedented crisis of the dominant paradigm, which requires, among other issues, a reformulation of prison politics and re-socialization, with the humanization of the process, so that a new path can be found that is sustained and that gives back to the Brazilian society re-socialized individuals and integrated to their communities. Restorative justice is announced as a new paradigm to challenge this crisis and presents a proposal for the sustainable construction of criminal procedures and prosecution of an infraction. This research investigates the importance of values and principles in the construction of the public policy of Restorative Justice and in this context seeks to know the stage in which is the Restorative practice in the area of Juvenile Criminal Law in the State of Sergipe. The study begins by identifying the conceptual, value, principles and methodological elements of Restorative Justice. It addresses the history of practice in order to critically identify the links of importance that help to see practice in the world, Latin America, Brazil and its evolutionary stage in the State of Sergipe, as well as to relate the main developments in practice in the State and the future steps that are projected in the next actions. In a third moment, it seeks to recognize what Juvenile Criminal Justice is about and then to propose a restorative lens under this branch of Law, assessing its actions in its three axes and its initial flow in practice in Sergipe. At the end, the constitutional discussion is held to recognize the frame through which one can see the restorative practice, with an approach to fraternal law, the principle of the dignity of the human person and the principle of the search for happiness. / Na esfera penal e da responsabilização de adolescentes, vivencia-se uma crise sem precedentes do paradigma dominante, que necessita, dentre outras questões, de uma reformulação da política carcerária e de ressocialização, com a humanização do processo, para que se possa encontrar um novo caminho que se sustente e que devolva para a sociedade brasileira indivíduos ressocializados e integrados às comunidades. A Justiça Restaurativa se anuncia como um novo paradigma a desafiar essa crise e que apresenta uma proposta de construção sustentável dos procedimentos penais e dos processos de apuração de ato infracional. A presente pesquisa investiga a importância dos valores e princípios na construção da política pública da Justiça Restaurativa e, nesse contexto, busca conhecer o estágio em que se encontra a prática restaurativa na área do Direito Penal Juvenil no Estado de Sergipe. O estudo se inicia identificando os elementos conceituais, valorativos, principiológicos e metodológicos da Justiça Restaurativa. Aborda o histórico da prática, no intuito de identificar, de forma crítica, elos de importância que ajudem a enxergar a prática no mundo, na América Latina, no Brasil e seu estágio evolutivo no Estado de Sergipe, bem como relacionar os principais acontecimentos no desenvolvimento da prática no Estado e os passos futuros que se projetam nas próximas ações. Em seguida, procura reconhecer do que se trata a Justiça Penal Juvenil e propor uma lente restaurativa sob esse ramo do Direito, aferindo suas ações nos seus três eixos e o seu fluxo inicial na prática em Sergipe. Ao fim, realiza-se a discussão constitucional para o reconhecimeno da moldura por meio da qual se pode enxergar a prática restaurativa, com abordagem do direito fraternal, do Princípio da Dignidade da Pessoa Humana e do Princípio da Busca da Felicidade.

To implement the project in state schools was created the function of Teacher School and Community Mediator (PMEC). In this work, we investigated the understanding of this new professional about their duties and how they unfold in school practices, with the hypothesis that before a non-specific training, for appropriate profile selection of difficulty and of course insufficient training, PMEC runs projects and activities not related to their function and that the actual duties that should play at schools not you are clear, then, each performs them according to their own reading and thus can not be given to introducing legislation or have a critical view of their role. To reach the end, there was a qualitative research descriptive, using the questionnaire as a collection tool and content analysis for data processing. The sample included randomly in the electronic questionnaire sent to the use PMECs activity at the time of the survey. Obtained return 485 PMECs, a universe of 3.210, constituting a representative sample of grade of more than 95% reliability. The answers reveal a lack of more specific training and understanding, about the concepts and processes intrinsic to its function, contrary to the authors consulted. They also reveal that, in the opinion of these professionals, they are responsible for performing any tasks given to them in order to promote the smooth running of the school, easing the weight of the tasks of the managers of school units; however, to encompass such assignments, PMECs end up getting lost in their function. The fact is that once again we see the launch of a project designed for those who do not know the daily life of schools and professionals who work in them and thus this professional is carrying out the possible actions in trying to make the project work. / No final do ano de 2009, a Secretaria de Estado da Educação, em parceria com a Secretaria de Segurança Pública, lançou o projeto Sistema de Proteção Escolar e Comunitária (SPEC). Para a implementação do projeto nas escolas estaduais foi criada a função de Professor Mediador Escolar e Comunitário (PMEC). Neste trabalho, investigou-se o entendimento desse novo profissional sobre suas atribuições e como elas se desdobram em práticas escolares, com a hipótese de que diante de uma formação não específica, dificuldade de seleção por perfil adequado e curso de formação insuficiente, o PMEC executa projetos e atividades não relacionadas à sua função e que as reais atribuições que deveria desempenhar nas unidades escolares não lhe são claras, logo, cada um as realiza segundo sua própria leitura e, assim, pode não estar atendendo ao que estabelece a legislação nem ter uma visão crítica acerca de sua função. Para atingir os fins propostos, realizou-se uma pesquisa qualitativa do tipo descritiva, utilizando-se o questionário como instrumento de coleta e a análise de conteúdo para tratamento dos dados. A amostra foi composta aleatoriamente, no uso de questionário eletrônico encaminhado aos PMECs em atividade na ocasião da pesquisa. Obteve-se retorno de 485 PMECs, de um universo de 3.210, constituindo-se uma amostra representativa, com grau de confiabilidade de mais de 95%. As respostas revelam falta de formação mais específica e entendimento, acerca dos conceitos e processos intrínsecos à sua função, em desacordo com os autores consultados. Revelam também que, no entendimento desses profissionais, eles são responsáveis por realizar quaisquer atribuições que lhes é conferida a fim de promover o bom andamento da escola, amenizando o peso das tarefas dos gestores das unidades escolares; no entanto, ao abarcar tais atribuições, os PMECs acabam ficando perdidos em sua função. Fato é que mais uma vez observamos o lançamento de um projeto pensado por quem não conhece o dia a dia das escolas e dos profissionais que nelas trabalham e, assim, esse profissional vai realizando as ações possíveis na tentativa de fazer o projeto dar certo.

Contribution à l’analyse de la justice restaurative / Contribution to the restorative justice analysis

L’idée centrale de notre paradigme juridique est qu’une peine juste devrait être celle qui régénère les liens sociaux blessés par le crime. Si l’édifice de la justice des hommes a connu de nombreuses transformations, les éclairages historiques et philosophiques demeurent indispensables pour étudier la délicate question du sens de la peine. Les sciences criminelles doivent ainsi prendre en compte les intérêts de la société, de l’auteur de l’infraction ainsi que ceux de la victime. En ce sens, la loi du 15 août 2014 relative à l’individualisation des peines et renforçant l’efficacité des sanctions pénales prévoit, pour la première fois en droit positif, un texte consacré à la justice restaurative. L’objet de celle-ci consiste à permettre de restaurer le lien social rompu par la commission d’une infraction en offrant la possibilité à l’auteur des faits de rencontrer la victime. Réparer le préjudice causé à la victime, réinsérer l’auteur de l’infraction dans la société, rétablir la paix sociale et prévenir la récidive : tels sont les objectifs de la justice restaurative. L’étude particulière de l’article 10-1 du Code de procédure pénale soulève pour autant deux questions essentielles : La justice restaurative est-elle envisageable dans le cadre de toute procédure pénale ? La justice restaurative peut-elle trouver sa place à tous les stades de la procédure ? Pour permettre à la réflexion théorique de se nourrir des réalités concrètes, il convient de s’interroger sur les règles de procédure qui pourraient permettre d’encadrer rigoureusement la justice restaurative afin que, débarrassée de l’image utopique dont elle pourrait être affublée, elle puisse devenir un mécanisme juridique efficace. / The core idea of our legal paradigm is that a fair sentence should be one that regenerates the social links wounded by crime. If the justice built by men has known many transformations, the historical and philosophical enlightenings remain essential to study the tricky question of the « sentence’s meaning ». Thus criminal sciences must take into account the interests of the society, of the offender as much as the victim’s. In this sense, the law of August 15, 2014 on the sentences’ individualization and reinforcing the penal sanctions’ efficiency, provides, for the first time in substantive law, a text dedicated to restorative justice. The purpose of this law consists in allowing to restore the social link broken by the commission of an offense by offering the offender the opportunity to meet the victim. To repair prejudice caused to victims, to reintegrate offenders in the society, to restore social peace and to prevent recidivism : those are the restorative objectives of justice. The particular study of article 10-1 of the Code of criminal proceedings raises two essential issues : is restorative justice possible in any criminal proceedings ? Can restorative justice find its place at each and every stage of the procedure ? In order to allow the theoretical reflexion to feed from practical realities, questions must be asked about the proceedings rules which could help producing a strict framework for restorative justice so that, freed from the utopian image from which restorative justice could be burdened with, it may become an efficient legal mechanism.

The diploma thesis deals with the evaluation of the effects of probation work and brings new knowledge about their effectiveness. It presents data obtained using semi-structured interviews with six probation officers and six former clients of the Probation and Mediation Service. The aim of the research is to identify and map the factors that lead to effective probation work and whether, or to what extent, the view of officials with the views of clients in their views on these factors and their use coincides. The main results include that the most significant factor influencing cooperation is the human approach of officials to clients, their support and positive motivation. The effectiveness of probation work very significantly affects the client's internal motivation to change his current situation and lead a proper lifestyle, this internal motivation is a significant element that results in the termination of an individual's criminal career. A significant finding concerns the excessive workload of probation officers, mainly in the territory of Prague, which prevents more intensive cooperation and thus greater success of probation supervision.

The aim of this diploma thesis is to describe and explain the main features of implementation practice of house arresting in the Czech Republic and consequently propose possible ways out in relation to subsequent (and successful) continuing of implementation procedure. In terms of theory there are reflected approaches of criminal law, criminology, penology, sociology and public policy. Within the research work, the space had been given to those participants immediately concerned and affected with house arresting agenda - judges, prosecutors, probators, ministry officers (Ministry of Justice), attorneys, watchdog organizations and experts on criminal law from academic sphere. House arresting had entered valid legal regulations in connection with new criminal law effectual since 1.1.2010. This new regulation substituted the pristine penal code. In new criminal law is significant shift of accent from tangible to formal conception of culpability. By the analysis of key participants of objective policy, identification of possible goals, adumbration of solution options is finally formulated optimal version. The theme of my diploma thesis is the efficiency of the probation supervision of the system of justice. My aim is to inform wheather and in which way the probation supervision helps to reduce the risk of crime's relapse. This diploma thesis is divided into two parts. The first one is theoretical whereas the second one is practical. In the theoretical paragraph I explain the aims and reasons of probation supervision. The wide scope of taking advantages of this care is also mentioned. I describe all activities connected with the above. The pecularities of youngters's probation supervision are pointe dout, as well. Last but not least I inform about the course of the probation supervision and try to compare alternative sanctions to the imprisonment. A statistic survey of probation supervision in last few years makes a part of my thesis, too. The second part of my thesis is based on my practice in the centre of probation and mediation care. I mention the results of my research among the members of the working team in the above organisation and social worker's for youngsters and adults. The experience and the views of the providers were obtained in the form of a questionnaire survey. As a source of data for addressing service has been utilized to view all registered entities providing their services to the victims of the crimes on the web site of the Ministry of justice. The work was focused on the practical application of selected provisions of act no. 45/2013 Coll. and from its results revealed that providers in your practice are finding that the provisions relating to particularly vulnerable victims, are defined too narrowly. Also the communication between the provider and the police is not yet ideally set.

Préserver sa dignité à travers une démarche de justice réparatrice après un vécu de violence à caractère sexuel : perspectives de femmes ayant participé aux rencontres détenus-victimes du Centre de services de justice réparatrice (CSJR)

Ce projet de recherche s’intéresse aux expériences de femmes qui ont été victimes de violence à caractère sexuel (VACS) et qui ont choisi d’aborder ce vécu de violence au sein d’une démarche de rencontres détenus-victimes (RDV) offerte par le Centre de services de justice réparatrice (CSJR). La littérature souligne que les victimes de crimes violents contre la personne apprécient de façon générale les pratiques de justice réparatrice post-sentencielles. Toutefois, peu de recherches nous informent des spécificités de l’application de la justice réparatrice en contextes de VACS et des façons dont les personnes victimes en font l’expérience. Afin de contribuer au développement de la littérature sur la justice réparatrice en contexte de VACS, cette recherche se penche spécifiquement sur le modèle de justice réparatrice de crime apparenté développé par le CSJR. Afin d’identifier comment cette démarche a pu être, ou non, sécuritaire et positive pour des femmes qui ont été victimes de VACS, des entretiens qualitatifs ont été effectués auprès de 20 participantes. Les résultats indiquent que la démarche de justice réparatrice offerte par le CSJR a été vécue de façon positive et sécuritaire par près de l’ensemble des participantes (n = 19 sur 20). Plusieurs participantes ont identifié que la compétence des animateurs pour maintenir le cadre a été essentielle pour contribuer à leur sentiment de sécurité à travers la démarche. Une participante a souligné que le non respect d’une règle de fonctionnement a nui à son sentiment de sécurité. De façon générale, la démarche de RDV a contribué pour les participantes à un sentiment de libération, à une prise de contact avec leur pouvoir et à un désir de faire de leur histoire un levier de changement positif. / This research project focuses on the experiences of women who have been victims of sexualized violence and have chosen to adress this violence by participating to victim-offender encounters, facilitated by the Centre de services de justice réparatrice (CSJR). The literature identifies that victims of violent crimes are generally satisfied by post-sentence restorative justice practices. However, little research informs us of the particularities of restorative justice practices in the context of sexualized violence, as well as how victims experience it. In order to contribute to the development of the literature on restorative justice practices applied in the context of sexualized violence, this study focuses on a specific victim-offender encounter model developed by the CSJR. A total of 20 women participated to the data collection through interviews. A majority of participants (n = 19 out of 20) experienced the encounters in a positive way and felt safe throughout the process. Most participants mentioned that the competence of the facilitators to maintain the structure was an important factor to make them feel safe. One participant’s safety was compromised by the breach of a rule after the process. In general, the victim-offender encounters of the CSJR contributed to a feeling of liberation for the participants, connected them to their strenghts and personal power and developed their desire to use their personal story in order to drive positive changes.
