The model is based on dialogue, respect and empowerment of the parties directly and indirectly involved. The present research aimed to reflect on the facilitators and complicating factors of the adoption of restorative justice by the traditional court system, focusing on the experience developed in the Child and Youth Court of Campinas since 2007. Besides the introduction and a chapter dedicated to methodological notes, the research was structured in three more chapters, starting with theoretical assumptions about restorative justice and its rapprochement towards juvenile justice in the Brazilian context. Next, the empirical field observed in the Campinas justice system was presented, addressing the history of the program implementation, its structure and its operation, and quantitative and qualitative data of the last two years. Priority was given to a qualitative approach to the case study, with interviews regarding the actors involved in the project, follow-up visits (pre-circles and restorative circles) and collection of statistical data on the restorative processes in Campinas. Finally, it was promoted discussions articulating the theory of restorative justice with the results of the immersions in the field, exploring the merits and critical factors of a program developed in the justice system, highlighting the following themes: (a) institutional visibility and structure; (b) the discourses and roles of institutional actors; (c) the symbolism of authority; (d) accountability and responses to the conflict; (e) selection of cases, increased social control and access to justice; and (f) the alternative or complementary role of restorative justice in regards to the justice system. The results of the study were in compliance with previous researches in the sense that, despite its transformative potential, the model has encountered several difficulties to be effectively developed, acting more as a reinforcement to the existing justice system than as a real alternative, considering a broader purpose of criminal policy. It was concluded that, while restorative justice plays an important role in qualifying a response to conflict, it should not be limited in its performance, at the risk of losing its critical power to oppose the current system. / A justiça restaurativa propõe a administração consensual de conflitos enfatizando o dano sofrido pela vítima, a responsabilização pelo autor dos fatos e as necessidades dos envolvidos. O modelo pauta-se no diálogo, respeito e empoderamento das partes direta e indiretamente envolvidas na relação conflituosa. A presente pesquisa buscou refletir sobre os fatores facilitadores e os complicadores na adoção da justiça restaurativa pelo Poder Judiciário, com foco na experiência desenvolvida na Vara da Infância e Juventude de Campinas, desde 2007. Além da introdução e de um capítulo dedicado a notas metodológicas, o trabalho foi estruturado em mais três capítulos, iniciando-se com pressupostos teóricos sobre a justiça restaurativa e a sua aproximação com a justiça juvenil no contexto brasileiro. Em seguida, apresentou-se o campo empírico observado no sistema de justiça de Campinas, abordando-se o histórico de implantação do programa, a sua estrutura e o seu modo de funcionamento atuais, além de dados quantitativos e qualitativos dos últimos dois anos. Priorizou-se uma abordagem qualitativa do estudo de caso, com a realização de entrevistas com os atores institucionais, o acompanhamento de atendimentos (pré-círculos e círculos restaurativos) e a coleta de dados estatísticos sobre os processos restaurativos em Campinas. Por fim, buscou-se promover discussões articulando a teoria da justiça restaurativa com os resultados das imersões no campo, explorando-se os méritos e os pontos críticos de um programa alocado no Judiciário, a partir dos seguintes temas: (a) a visibilidade e a estrutura institucionais; (b) os discursos e os papéis dos atores institucionais; (c) a carga simbólica da autoridade; (d) a responsabilização e respostas ao conflito; (e) a seleção de casos, o aumento do controle social e o acesso à justiça; e (f) a justiça restaurativa como alternativa ou reforço ao sistema de justiça. Os resultados do trabalho vão ao encontro de pesquisas anteriores, no sentido de que, apesar do seu potencial transformador, o modelo tem encontrado diversas dificuldades para ser efetivamente desenvolvido, atuando mais como um reforço ao sistema de justiça vigente do que como uma real alternativa, considerando-se uma finalidade mais ampla de política criminal. Concluiu-se que, embora a justiça restaurativa cumpra um papel importante no sentido de qualificar uma resposta ao conflito, não deve ter a sua atuação limitada, sob o risco de perder sua força crítica de se contrapor ao sistema corrente.

Ambiguous space : representations of forgiveness in Left to tell: discovering God amidst the Rwandan Holocaust (2006), Inyenzi : a story of Love and genocide (2007) and God sleeps in Rwanda : a journey of transformation (2009)

This study aims to interrogate the representations of forgiveness in post genocide Rwandan fiction. The novels analysed are Inyenzi: A story of Love and Genocide (2007), Left to Tell: Discovering God Amidst the Rwandan Holocaust (2006) and God Sleeps in Rwanda: A Journey of Transformation (2009). Inyenzi: A story of Love and Genocide represents romantic love as the possible beginning of reconciliation between the Tutsi and the Hutus after and the devastations of the genocide. Left to Tell: Discovering God Amidst the Rwandan Holocaust reveals that the individualistic portrayal of forgiveness is important to create communication between antagonistic ethnic groups. God Sleeps in Rwanda: A Journey of Transformation demonstrates that forgiveness and reconciliation have the possibilities of being attainable on a national level through political reforms. The narratives succeed in portraying the representations of forgiveness but due to the subjectivities of the authors, the historicity of the genocide is undermined thereby compromising the foundations for forgiveness. This study suggests that future research on post genocide Rwandan could analyse creative works on forgiveness but focussing on the issue of restorative justice / English Studies / M. A. Este estudo focaliza formas de solução de conflitos envolvendo adolescentes autores de ato infracional e suas famílias, por meio do modelo de JR. Para analisar a participação da família em experiências de Justiça Juvenil Restaurativa nas regiões Norte e Nordeste, utilizou-se uma combinação de métodos divididos em três fases interdependentes. A primeira fase constituiu um estudo exploratório realizado entre agosto de 2015 a junho de 2016. Promoveu-se o levantamento da implementação teórico-prática da “Justiça Restaurativa” no Brasil e foram identificados os projetos de Justiça Restaurativa existentes nas Regiões pesquisadas. O questionário foi aplicado com os atores sociais envolvidos em projetos de justiça restaurativa. Foram identificadas vinte e nove experiências no N e NE, sendo dezenove no âmbito da infância e juventude, envolvendo Poder Judiciário, Poder Executivo, Defensorias, Ministério Público, Universidades, escolas, OAB, ONGs e Centros de Referência em Assistência Social. Em sua maioria, os projetos incluem a família por meio dos círculos restaurativos, com acompanhamento psicossocial e recebem orientações acerca do cumprimento da Medida Socioeducativa (MSE). Os responsáveis pelos adolescentes são estimulados a participar das práticas restaurativas desde a fase inicial de apuração do ato infracional até a execução da MSE. A análise dos questionários evoca a repercussão da inclusão da família no processo, além de ter contribuído para a definição da experiência emblemática a ser investigada em profundidade. O projeto escolhido situa-se no juizado da infância e juventude do município de Santarém, Oeste do Pará. Iniciada em 2012, fruto da parceria interinstitucional entre o Tribunal de Justiça do Estado do Pará e a Universidade Federal do Oeste do Pará. A experiência demonstrou que a participação da família nos círculos restaurativos incentiva o protagonismo juvenil, o fortalecimento dos vínculos familiares e o exercício da cidadania. Contudo, ainda são necessárias estratégias auxiliares, de natureza pública, que facilitem o acesso dos membros da família, sobretudo daqueles adolescentes com restrição total ou parcial da liberdade, criando espaços adequados ao exercício do cuidado e a geração de afeto. / The Restorative Justice (RJ) has been consolidating in Brazil as a modern and emancipatory justice project. This study focuses on ways of solving conflicts involving adolescents who commit infractional acts and their families, through the RJ model. In order to analyze the participation of the family in restorative juvenile justice experiences in the North and Northeast regions, a combination of methods was divided into three interdependent phases. The first phase consisted of an exploratory study carried out between August 2015 and June 2016. The theoretical-practical implementation of "Restorative Justice" in Brazil was promoted and the restorative justice projects in the regions surveyed were identified. Twenty-nine experiences were identified in the N and NE, nineteen in the field of childhood and youth, involving Judiciary, Executive Branch, Defenders, Public Ministry, Universities, schools, OAB, NGOs and Reference Centers in Social Assistance. For the most part, the projects include the family through the restorative circles, with psychosocial support and receive guidance on compliance with the socioeducational measure (MSE). Those responsible for adolescents are encouraged to participate in restorative practices from the initial stage of investigation of the infraction until the execution of the SEM. The analysis of the questionnaires evokes the repercussion of the inclusion of the family in the process, besides contributing to the definition of the emblematic experience to be investigated in depth. The chosen project was situated at child and youth court of the municipality of Santarém, in western Pará. This project started in 2012, as a result of the interinstitutional partnership between the Pará State Court of Justice and the Federal University of Western Pará. The experience shows that the participation of the family in restorative circles encourages youth protagonism, the strengthening of family ties and the exercise of citizenship. However, auxiliary strategies of a public nature are still needed to facilitate the access of family members, especially those adolescents with total or partial restraint of freedom, creating adequate spaces for the exercise of care and the generation of affection.

Introduite dans le Code de procédure pénale par la loi n° 2014-896 du 15 août 2014 relative à l'individualisation des peines et renforçant l'efficacité des sanctions pénales, à l'article 10-1, la justice restaurative rejoint désormais l'ensemble des réponses socio-pénales que le système de justice pénale français peut mobiliser pour répondre aux conséquences et aux répercussions du phénomène criminel. Depuis le 1er octobre 2014, date d'entrée en vigueur de l'article 10-1 du Code de procédure pénale, toute personne victime ou auteur d'une infraction pénale peut se voir proposer une mesure de justice restaurative, dans toute procédure pénale et à tous les stades de la procédure. Insérée dans le titre préliminaire du Code de procédure pénale, dans un sous-titre II "De la justice restaurative", la possibilité d'un tel recours à une mesure de justice restaurative prend place parmi les grands principes qui irriguent la procédure pénale et montre l'ambition du législateur en faveur de la justice restaurative présentée comme une des réponses à la crise que traverse le système de justice pénale actuel. Toutefois, au-delà de cette seule possibilité, se pose la question de la place que la justice restaurative peut occuper au sein de ce système, en particulier en ce qui concerne son institutionnalisation concrète et pratique. La démonstration de la forte complémentarité existant entre justice restaurative et justice pénale, au service d'un système de justice pénale répondant pleinement aux attentes des justiciables, ouvre la voie à une application conjointe de mesures de justice issues spécifiquement des deux modèles de justice. Il peut en résulter un système reposant sur une application conjointe de mesure de justice restaurative et de justice pénale et permettant un traitement différentiel, à la fois du conflit de nature infractionnelle et des attentes criminologiques et juridiques des personnes concernées. Cette approche, mise en perspective avec les initiatives naissantes de programmes en France, présente l'avantage de ne pas nécessiter d'importantes modifications du système de justice pénale. Elle consiste en la construction d'une offre locale de justice restaurative, complète et disponible, structurée par des organismes de coordination du partenariat sur lequel elle repose. Elle se manifeste actuellement, tant à l'échelon local, à travers la création de Services régionaux de justice restaurative (SRJR), qu'à l'échelon national, à travers les actions de l'Institut Français pour la Justice Restaurative (IFJR), aux côtés des principales fédérations et administrations concernées. / The law n° 2014-896 of August 15th 2014 on “Individualization of penalties and for strengthening the effectiveness of criminal sanctions” introduced in the Criminal Procedure Code restorative justice. From now on, it belongs to the socio-criminal responses proposed by the French criminal justice system to respond to the consequences and impact of the criminal phenomenon. Since October 1th 2014, the date of entry into force of the law, a “restorative justice measure” may be proposed to any victim or offender during every criminal procedure and at all stages of the proceedings. Inserted in the preliminary title of the Code of Criminal Procedure, subtitle II, entitled "About restorative justice", the possibility of such recourse to a restorative justice measure takes place among the great principles that define the criminal procedure and shows the French legislator ambition for restorative justice, which is presented as a possible answer to the criminal justice system current crisis. However, it raises the question of the place of restorative justice in this system, especially with regard to its concrete and practical institutionalization. The demonstration of the strong complementarity between restorative justice and criminal justice to create a criminal justice system that fully meets the expectations of victims and offenders pleads in favour of a joint implementation of legal measures from these two models of justice. This can lead to a system, based on a joint application of restorative justice and criminal justice, and permitting differential treatment, both of the criminal conflict and of the criminological and legal needs of individuals. This approach, put into perspective with the emerging program initiatives in France, has the advantage of not requiring major changes to the criminal justice system. It involves the construction of a local offer of restorative justice, complete and fully available, structured by coordinating bodies from the parternership the offer is based on.. This approach is currently visible at the local level, through the creation of Restorative Justice Regional Services (SRJR), as at the national level, through the actions of the French Institute for Restorative Justice (IFJR), with the main federations and administrations.

Dignidade da pessoa humana e acesso à justiça : meios alternativos para desjudicialização em matéria penal

The objective of this study is to analyze the current scenario of the Brazilian Criminal Justice, crowded with processes of the most varied species, which generates a great dissatisfaction in the population, due to the delay in the jurisdictional rendering. Given this panorama of crisis of the Judiciary, an approach is taken on the principles of minimum intervention and insignificance, which are real tools to remove certain conduct from the criminal sphere through solutions from extrajudicial processes of social pacification. These instruments are an expression of the constitutional guarantee of access to justice in the light of the constitutional principle of the dignity of the human person. In order to obtain this answer, modern constitutional hermeneutics is used as a way to enable real access to justice through mechanisms for resolving conflicts that are far from the Judiciary, such as conciliation, mediation, arbitration and, in the sphere of criminal law, The Restorative Justice. Disjudicialization goes against the culture of litigation and the universalization of judicial protection disseminated in Brazilian society, but it finds shelter in the avant-garde constitutional hermeneutics. It is proposed to change culture in legal education in order to discourage the culture of litigation in order to assess the culture of peace and the implementation of alternative means of conflict resolution. / O objetivo deste estudo é analisar o atual cenário da Justiça Penal brasileira, abarrotada de processos das mais variadas espécies, o que gera uma grande insatisfação na população, em razão da demora na prestação jurisdicional. Diante desse panorama de crise do Poder Judiciário, é feita uma abordagem acerca dos princípios da intervenção mínima e da insignificância, que são verdadeiras ferramentas para retirar da esfera penal determinadas condutas através de soluções oriundas de processos extrajudiciais de pacificação social. Esses instrumentos são expressão da garantia constitucional do acesso à justiça à luz do principio constitucional da dignidade da pessoa humana. Para se obter essa resposta, utiliza-se da moderna hermenêutica constitucional como formar de viabilizar o verdadeiro acesso à justiça através de mecanismos de solução de conflitos distantes do Poder Judiciário, a exemplo da conciliação, mediação, arbitragem e, na esfera do Direito Penal, a Justiça Restaurativa. A desjudicialização vai de encontro à cultura do litígio e da universalização da tutela jurisdicional disseminadas na sociedade brasileira, porém encontra guarida na hermenêutica constitucional vanguardista. Propõe-se uma mudança de cultura no ensino jurídico a fim de desestimular a cultura do litígio e da judicialização para se valorar a cultura de paz e a implementação de meios alternativos de solução de conflitos.

Restorative Juvenile Justice This thesis is dealing with restorative juvenile justice. It aims to summarise and critically discuss this topic. It seeks to classify terms and theory used in order to help its readers with orientation throughout this issue as different terms and theories may often lead to unclarity and confusion. Subsequently it comes to a deeper analysis of selected parts. In particular, it examines international standards, describes thoughts of world-leading experts and eventually compares them and shows them on practical examples. Last but not least, it depicts selected theoretical foundations and draws connection between human life, inherent human nature, and use of restorative justice that is accepted as one of the main arguments for a higher effectivity in comparison to retributive justice. The thesis is divided into three parts. The first part deals with juvenile justice, children's rights and relevant international documents.
