The diploma thesis focuses on institution of ombudsman in European Union, Czech Republic and Slovak Republic. It is aimed at questions of legal regulations of this institution in the mentioned formations. Particular chapters of this thesis are structured into following 5 task parts. The first chapter describes the history of the origin of this institution, explains the term of ombudsman by using definitions, classifies existing kinds of institutes of ombudsman and specifies the field of action. The second chapter identifies the European ombudsman. It is focused especially on analysis of received complaints in practically whole period of existence this institution and evaluation of activities in 2008. In the third chapter is described the institution of ombudsman in the Czech Republic and in the fourth chapter in the Slovak Republic. The last chapter of the diploma thesis deals with comaparison of ombudsman institutions in these two countries.

Factors influencing malnutrition among children under 5 years of age in Kweneng West District of Botswana

The purpose of this study was to identify and determine the risk factors for malnutrition among children under the age of 5 years in Kweneng West District of Botswana. A case control study was conducted. The cases consisted of 37 underweight children under the age of 5 (n=37), and the controls consisted of 76 children less than 5 years of age (n=76) recruited concurrently among the under-five children attending Letlhakeng Child Welfare Clinic on a monthly basis. The controls were of good nutritional status. Data collection was done using a combination of a review of records (child welfare clinic registers, and child welfare clinic cards) and structured questionnaires. Following placement of the data in regression models, the factors that were found to be significantly associated with child malnutrition were small number of daily meals taken by the child (Adjusted OR=19.04, 95% CI 3.24-112.13), lack of knowledge of methods of prevention of child malnutrition by the parent (Adjusted OR=4.71, 95% CI 1.41-15.82), parent’s unemployment (Adjusted OR=50.3, 95% CI 4.86-52.1), low birth weight (Adjusted OR=12.34, 95% CI 2.76-55.02), inadequate Vitamin A supplementation (Adjusted OR=13.27, 95% CI 1.94-90.46), child illness (OR=20.95, 95% CI 7.55-58.10), and child raised by a guardian (Adjusted OR=5.67, 95% CI 1.30-24.73). The findings from this study suggest that Socio-economic factors such as unemployment, a lack of knowledge about recommended infant and child feeding practices, the child raised by a guardian, and health-related factors such as low birth weight, inadequate Vitamin A supplementation, and child illness are predictors of malnutrition in under five. Therefore, increasing household food security and reinforcing educational interventions could contribute to a reduction in the prevalence of child malnutrition in the district / Health Studies / M.A. (Public Health)

The Master's dissertation entitled Limitation of legal capacity for persons with disabilities examines problematics of rights and obligations of clients in protected housing and housing for people with disabilities. The thesis is divided into two parts: theoretical and practical. Basic concepts that are connected to legal capacity are outlined in the theoretical part. These are followed by the rights and obligations of the client and the institute of guardianship. Concepts of mental retardation and its diagnosis and methods of working with people with mental disabilities are outlined as well. The end of the theoretical part of the dissertation deals with the approach to deinstitutionalisation. The method of qualitative research was employed within the research survey. Data were obtained by the method of questioning and technique of semi-structured interviews. The research sample consists of addressing two facilities with constitutional service and two facilities with community service. The main aim of the practical part of the thesis is to compare how people with mental disabilities are limited by legal capacity in housing for people with disabilities and protected housing with appointed guardians. Child participation and representation in legal matters

The child’s participation in any legal matter involving him/her is crucial whether received directly or indirectly through a legal representative. The significance of the child’s views in legal matters is accepted internationally and is entrenched in South African law. This is the main feature of the present research. In Roman law the paterfamilias was the complete antithesis of the best interest of the child with his paternal power entirely serving his own interests. The best interests of the child progressively improved his/her participatory rights and the dominance of paternal authority in Roman, Germanic, and Frankish law eventually gave way to parental authority and assistance in Roman-Dutch law. This advanced the child’s participation in legal matters and under Roman-Dutch law, his/her right of participation included legal representation by way of a curator ad litem. The child’s best interests were consistently viewed from an adult’s perspective and resulted in an adult-centred assessment of his/her best interests. Statutory intervention increased the child’s participatory and representation rights, however, the tenor of these items of legislation remained parent-centred. The Appeal Court later dispelled any uncertainty regarding the paramountcy with respect to the best interests of the child. During the 1970s in South Africa, the emphasis began shifting from a parent-centred to a child-centred approach in litigation between parents in cases involving their children. An open-ended list of factors comprising the best interests of the child accentuated this shift. Courts were encouraged to apply the paramountcy rule in legal matters concerning children and to consider the views of children in determining their best interests. The new democratic constitutional dispensation in South Africa, followed by the ratification of the Convention on the Rights of the Child and the African Charter, obligated South Africa to align children’s rights with international law and standards. The South African Law Reform Commission set out to investigate and to formulate a single comprehensive children’s statute. The resultant Children’s Act 38 of 2005 is the most important item of legislation for children in private law in South Africa. The Children’s Act provides for the widest possible form of child participation in legal matters involving the child. It revolutionises child participation requiring no lower age limit as a determining factor when allowing the child, able to form a view, to express that view. The child’s right to access a court and to be assisted in doing so further enhances his/her participatory right. Effective legal representation is the key in ensuring that children enjoy the fundamental right of participation equal to that of adults in legal matters involving children. Comparative research of child laws in Australia, Kenya, New Zealand and United Kingdom confirms that South Africa is well on the way in enhancing children’s participatory and legal representation rights in legal matters concerning them. This illustrates that only the child’s best interests should serve as a requirement for the legal representation of children in legal matters. This study has conducted an analysis of how the monomyth has appeared in the fantasy story Diamond sword wooden sword part 1 and 2 by Nick Perumov. The study has confirmed that the story structure of the monomyth can be detected within several different characters progression. The study does not claim that all of the different stages within the monomyth can be identified within one single characters, but rather that there are several different characters that reinvents the world and the community. Speculations about why the authors story structure follows a ”divided” version of the hero’s journey are presented. The study also conducts an analysis of Perumovs construction of the society, male characters and female characters, which showed no distinct division in the construction of the two genders within the story. The construction of the society is discussed in light of the authors national upbringing, in this case the former Soviet Union, and briefly how the conflict in the world of Melin could be inspired by the Bolshevik revolution in Russia.

I denna uppsats har vi studerat 12 tingsrättsdomar från åren 2017 - 2019, där tingsrätten avgjort frågan om vårdnad, boende och umgänge där den ena föräldern dömts för våldsbrott (bl.a. misshandel och olaga hot) mot den andre föräldern och/eller deras barn. Vi har studerat hur tingsrätten dömer utifrån föräldrabalken 6 kap. 2 a §, men även undersökt i vilken utsträckning tingsrätten har dömt som socialtjänsten föreslagit i sin vårdnadsutredning och vilka de huvudsakliga skälen har varit när tingsrätten upplöst den gemensamma vårdnaden. Resultatet visar att tingsrätten har lutat sig mot bestämmelserna i FB 6 kap. 2 a § i samtliga domar utom i ett fall. Endast i undantagsfall har tingsrätten haft huvudfokus på det våld som inträffat. I de flesta av domarna har förekomsten av våld verkat vara av underordnad betydelse i jämförelse med barnets behov av en nära och god kontakt med båda sina föräldrar. I vår studie har vi även undersökt hur tingsrätten förhåller sig till barnets vilja, med beaktande av barnets ålder och mognad. Endast i en dom skrev tingsrätten att hänsyn måste tas till barnets åsikt med beaktande av barnets ålder och mognad. I det fallet var barnet 14 år. Då det kommer till tingsrättens resonemang kring om den gemensamma vårdnaden ska bestå eller upplösas, kunde vi se att föräldrarnas samarbetsförmåga har haft en större påverkan på utfallet än faktumet att en förälder är dömd för våldsbrott inom familjen. Vad gäller huruvida tingsrätten dömer som socialtjänsten föreslagit, kunde vi se att tingsrätten mestadels dömde som socialtjänsten föreslagit gällande vårdnaden och var barnet skulle ha sitt stadigvarande boende. Angående frågan om huruvida barnet skulle ha umgänge med föräldern som utövat våld, skiljde sig dock tingsrättens dom från socialtjänstens förslag. I en tredjedel av domarna var socialtjänstens förslag på beslut att inget umgänge skulle ske mellan barnet och föräldern som utövat våld. I samtliga av dessa vårdnadsmål dömde tingsrätten ändå till umgänge mellan barnet/barnen och den förälder som dömts för våldsbrott inom familjen. En av studiens slutsatser är att barn, trots att de i lagens mening har en viss makt och rättigheter, i praktiken i princip saknar makt att påverka sin egen livssituation i vårdnadstvister där frågan om vårdnad, boende och umgänge avgörs. Den makten verkar näst intill uteslutande tillhöra vuxna. / In this essay, we have studied twelve district court judgments from 2017 - 2019, where the district court decided on custody, residence and contact. In these cases, one parent has been convicted of abuse against the other parent and/or their children, which includes assault and unlawful threats. We have investigated the extent to which the district court has ruled in favour of the proposals of social services in its custody investigation and what the main reasons have been when the district court dissolved the legal joint custody. The results show that the district court has relied on the provisions of föräldrabalken chapter 6, 2 a §, in all judgments except one. Only in unique cases, the district court has had its main focus on the violence that has occurred. In most of the judgments, the incidence of violence seems to be of secondary importance compared to the child's need for a close and good contact with both of his/her parents. In our study, we have also investigated how the district court relates to the child's will, taking into account the child's age and maturity. Only in one judgment did the district court write that the child’s opinion must be taken into account, due to the age and maturity of the child. In that case, the child was 14 years old. When it comes to the district court's reasoning on whether legal joint custody should be upheld or dissolved, we could observe the parents' ability to cooperate had a greater impact on the outcome than the fact one parent has been convicted of domestic violence within the family. The district court mostly rules in accordance with what social services had proposed regarding custody and residence. However, regarding the question of whether the child should have contact with the parent who has been violent in the past, the district court has ruled against the proposals of social services. In a third of the judgements, social services advised that no contact should take place between the child and the parent who had been violent. In all of these custody cases, the district court ruled to allow visitation between the child and the parent convicted of domestic violence. One of the study's conclusions is that, although children in the sense of the law both have a certain power and rights, are nevertheless almost powerless to influence their own life situation in custody disputes where the issue of custody, housing and visitation is decided. That power, to influence the child's life, seems to belong to the adults.

Samverkan mellan förskolan och vårdnadshavare med barn i behov av särskilt stöd / Collaboration between preschool and the guardians of children with special needs

Syftet med denna studie är att bidra med kunskap om samverkan mellan förskola och vårdnadshavare, som har barn i behov av särskilt stöd. Studien baseras på förskollärares tankar och resonemang som samlats in genom semistrukturerade intervjuer. Analysarbetet utgår ifrån Bronfenbrenners systemteori, vilken avser att synliggöra de komplexa relationer som omger ett barn i behov av särskilt stöd. I denna studie fokuseras de tre första nivåerna i Bronfenbrenners systemteori; micro-, meso- och exosystemet. Genom att arbeta utifrån denna teori kan man få en bättre förståelse för hur olika faktorer i barnets omgivning kan påverka barnets beteende och lärande. Till exempel kan man analysera hur familjen, skolan, vännerna, samhället samspelar och skapar olika möjligheter och utmaningar för barnet. I denna studie fokuseras förskollärarnas resonemang avseende samverkan med barnets vårdnadshavare. Teorin hjälper oss att identifiera styrkor och svagheter i de olika systemen och hur man kan stödja barnets utveckling på bästa sätt. Studiens resultat visar att en god samverkan mellan förskolan och vårdnadshavare gynnar barn som är i behov av särskilt stöd. Vidare vikten av att samarbetet i arbetslagen som möter barnet fungerar, så att ett gemensamt förhållningssätt med entydiga rutiner skapas. Det behövs en nära relation mellan förskollärarna och alla vårdnadshavare för att barnets behov ska kunna säkerställas. Studien visar att förskollärare har en viktig roll i att skapa en inkluderande förskola, där alla barn kan utvecklas och lära utifrån sina förutsättningar. I detta arbete är samverkan med vårdnadshavarna av stor betydelse för att skapa tillit och en trygg utvecklande tillvaro för barnen. Five semi-structured interview with preschool teachers’ is conducted. The analysis is based on Bronfenbrenner’s system theory, which aims to make visible the complex relations surrounding a child, in need of special support. This helps us to gain understanding of how various factors in the child’s environment affects the child’s behavior and learning. For example, you can analyze how the family, school, friends, society interact and create different opportunities and challenges. In this study, I focus on three levels of Bronfenbrenner’s system theory the micro-, meso- and exo-systems. The focus of this study is the pre-school teachers’ reasonings regarding cooperation with the child’s guardian. Using Bronfenner’s system theory, we canidentify strengths and weaknesses that enable us, as preschool teachers, to support the child in the best way. The result shows that it is important that the preschool teachers cooperate with a united approach and keep unambiguous routines. A close relationship between the preschool teachers and all guardians is necessary to ensure that the child’s needs are satisfied. The study shows that preschool teachers have an important role in creating an inclusive preschool, where all children can develop and learn based on their individual conditions. The cooperation with the guardians is of great importance, for the success, creating a trustful and safe daily care and education at the preschool for all children. Ce mémoire porte sur l'interprétation de la Seconde Guerre des Boers (1899-1902) dans la presse britannique et plus précisément au travers des publications du London Times et du Manchester Guardian. Par l'étude de leurs articles traitant de la guerre, nous retraçons l'opinion véhiculée par ces journaux en lien avec le conflit tout au long de sa durée. À l'aide d'une analyse qualitative et comparative, nous étudions s'il y a une remise en question des idées préétablies dans la presse écrite du début des hostilités en octobre 1899 jusqu'à leur arrêt en mai 1902. Nos résultats indiquent qu'il n'y a aucune réelle évolution de l'opinion transmise par les deux journaux au sujet de la guerre sud-africaine. Le London Times s'affiche de façon évidente aux idéaux du parti conservateur qui appuie cette guerre alors que le Manchester Guardian se campe sur le positionnement antimilitariste du parti libéral. Seul l'argumentaire s'adapte aux différents événements marquants de ce conflit qui influencent les débats dans la presse anglaise, et ce, malgré la nature polémique de ce conflit colonial considéré comme la dernière guerre impérialiste de l'ère moderne.

Perceptions of parents/guardians about the effectiveness of future families programme in Olievenhoutbosch

Abstract in English, Sepedi and Zulu / The people with the greatest stake in Orphan and Vulnerable Children (OVC) interventions are the children and their parents/guardians. Unfortunately, most OVC programmes are predesigned and implemented without considering beneficiaries’ perceptions when developing solutions (ALI 2007:15). The purpose of this study was to explore and describe the perceptions of orphans and vulnerable children’s parents/guardians about the effectiveness of Future Families’ children programme in Olievenhoutbosch. This study used a qualitative, explorative and descriptive design. Thirteen parents/guardians of children registered with the Future Families were interviewed on the effectiveness of the Future Families programme using a semi-structure interview guide.
