The current dissertation is the result of an investigation about the principle of the autonomy of the will. According to Immanuel Kant, the autonomy is the foundation of all morality of the human actions. The autonomy consists in the presentation of the reason for herself of a moral law valid for the will of all rational beings. The moral law is going against the actions that are practiced by selfishness, since she possesses the form of an universal legislation that is expressed in the categorical imperative of the reason. The heteronomy of the will is the principle contrary to the autonomy. Starting from the determination of your will for the moral law the man becomes conscious of your freedom. Consequently, the freedom is what turns possible to the man your self-determination for the moral action. / A presente dissertação é o resultado de uma investigação acerca do princípio da autonomia da vontade. Segundo Immanuel Kant, a autonomia é o fundamento de toda a moralidade das ações humanas. A autonomia consiste na apresentação da razão para si mesma de uma lei moral que é válida para a vontade de todos os seres racionais. A lei moral vai contra as ações que são praticadas por egoísmo, já que ela possui a forma de uma legislação universal que é expressa no imperativo categórico da razão. A heteronomia da vontade é o princípio contrário à autonomia. A partir da determinação de sua vontade pela lei moral o homem torna-se consciente de sua liberdade. Por conseguinte, a liberdade é o que torna possível ao homem sua autodeterminação para a ação moral.

In fact, alternative methods of conflict resolution is a new field of procedures, which are replacing traditional ways of solving problems related to disputes of rights available. The increase in economic transactions has changed the way of understanding the traditional theory of legal transactions, in which a contract is not concluded by the same, but there is a huge difference in the legal position of the parties. The solution demands for arbitration is based on the autonomy of the will of the parties, to provide justice faster, faster, and cheaper in Brazil. For this method to be effective, necessary it is that the convention is held and developed without vices will. The dissertation it is the validity of the arbitration agreement, recognizing, however, that there are several points to be reformed, with respect to special legislation. Thus, on account of such facts, this study will investigate the phenomena of historical facts related to arbitration, until our present day, with emphasis on the advantages of the institute, and shape and effectiveness of the arbitration agreement. / A Arbitragem aumentou seu campo de aplicação nas sociedades contemporâneas, mas ainda é pouco utilizada, apesar de expressa autorização constitucional. De fato, os métodos alternativos de resolução de conflitos são um novo campo de procedimentos, que estão substituindo as maneiras tradicionais de resolver os problemas relacionados aos litígios de direitos disponíveis. O aumento das transações econômicas mudou a maneira de compreender a teoria tradicional dos negócios jurídicos, em que um contrato não é celebrado por iguais, mas há uma diferença enorme na posição jurídica das partes. A solução de demandas pela arbitragem é baseada na autonomia da vontade das partes, para proporcionar uma justiça mais rápida, célere, e menos onerosa no Brasil. Para que este método seja eficaz, necessário se faz, que a convenção seja celebrada e elaborada sem vícios de vontade. A dissertação trata-se da validade da convenção arbitral, reconhecendo, no entanto, a existência de diversos pontos a serem reformados, no que tange a legislação especial. Assim, por conta de tais fatos, este estudo investigará os fenômenos da arbitragem relacionados aos fatos históricos, até os nossos dias atuais, com ênfase nas vantagens do instituto, e na forma e eficácia da convenção de arbitragem.

The thesis describes the relationship between the ancient Gnosticism as we know it from the Nag Hammadi library and as it is described in the works of early church fathers and New Testament. It outlines basic topics similar to all versions of a classical cosmogenic Gnostic myth. The subject of the faith in the resurrection of Jesus Christ and its relationship to the establishing a Church structure is discussed. Another topic is the problem of human free will and that of good and evil and its consequences for human morale. The ways of different understanding to it are presented, based on Old Testament story of Adam and Eve as reffered to in the book of Genesis.

Cette recherche a pour objet le lien conceptuel entre participation politique et lien social dans la théorie politique de Rousseau. Elle présente une réinterprétation de la volonté générale, considérée comme un concept descriptif avant d’être normatif, affectif avant d’être rationnel,attribuée aux membres du collectif avant de l’être à celui-ci. L’activité de la volonté générale mesure l’attachement des citoyens aux lois, dans la mesure où ils y voient le moyen de promouvoir leur propre intérêt, compte tenu du fait de la socialisation. La volonté générale des citoyens ne saurait toutefois se maintenir sans que ces derniers soient régulièrement amenés à contrôler les termes de leur association et à vérifier leur effectivité dans le cadre d’institutions spécifiques. L’exigence exorbitante de souveraineté populaire, identifiée à l’exercice direct du pouvoir législatif, est manifestement attenante à l’idéal de socialité juridique que Rousseau place au coeur de sa théorie politique. Cet idéal trouve une incarnation contrefactuelle dans les pratiques et demandes de la bourgeoisie de Genève, en particulier durant le premier tiers du XVIIIe siècle, auxquelles le Contrat Social donne un fondement théorique ex post facto. Plutôt que d’abstraire le Contrat Social de son contexte, croyant ainsi en étendre la portée, c’est de l’intérieur de celui-ci que s’éclaire son universalité. Nous montrons, en dialogue critique avec les philosophies de Rawls et de Habermas, qu’il soutient l’exigence d’une démocratie délibérative radicale. / This research focuses on the link between political participation and social bonds in Rousseau's political theory. We present a new interpretation of the concept of general will as relevant to individuals rather than the collective, focusing on its descriptive and emotionalrather than normative and rational dimensions. General will measures citizens' attachment to laws in so far as they see them as a means of promoting their own best interests as social beings.However, the general will of citizens could not be maintained if they did not regularly reassess the terms of their association and verify their effectiveness within specific institutions. The exorbitant demand for popular sovereignty, which is the direct exercise of legislative power, is rooted in the ideal of legal sociality at the heart of Rousseau’s political theory. This ideal finds counterfactual embodiment in the practices and demands of the Geneva bourgeoisie, to which the Social Contract gives a theoretical foundation ex post facto, especially during the first third of the eighteenth century. Rather than abstracting the Social Contract from its context in the hope of extending its scope, we argue that, paradoxically, its universality lies in this particular context. Through a dialogue with the theories of Rawls and Habermas, we show that the Social Contract supports the demand for a radical deliberative democracy.

This research work shows how the financing for micro and small businesses in Peru has increased and has greatlyexpanded in the last few years, not only in institutions specialized in this field, focused their efforts in giving financialservices to businesspeople of micro and medium-sized business, but most of the so-called traditional banks havefocused their attention to this emerging sector using the know-how of microfinance lending technology, banking seekto work with people of low income sectors, that were not subject for credit opportunities to develop their business andas a consequence not able to improve their quality of life .Throughout this investigation, we make a diagnosis of macro and micro environment of the microfinance field, itsdevelopment and expectations for a strong presence in the Peruvian financial market. We consider the development oflending technology, where the analysis of the ability and willingness to pay are the fundamental basis for the evaluationof credits in specialized companies in this sector. / El presente trabajo de investigación nos muestra cómo el financiamiento a la micro y pequeña empresa en el Perú seha estado desarrollando en forma creciente y escalonada en los últimos años, donde no solo las entidades especializadasen este segmento focalizan sus esfuerzos para dar servicios financieros a los empresarios de la micro y pequeña empresa,sino que la mayoría de los denominados bancos tradicionales han redireccionado su atención a este sector emergente y,utilizando el know how de la tecnología crediticia microfinanciera, buscan la bancarización trabajando con personas delos sectores de bajos ingresos, que hasta hace poco no eran sujetos de crédito con posibilidades de desarrollar sus negociosy, consecuentemente, mejorar su calidad de vida. Así, a lo largo de esta investigación, se realiza un diagnóstico delmacro y microentorno del sector microfinanciero, su evolución y expectativas para una mayor presencia en el mercadofinanciero peruano; asimismo, se examina el desarrollo de la tecnología crediticia, donde el análisis de la capacidad yvoluntad de pago son la base fundamental para la evaluación de créditos en las empresas especializadas en este sector.

Nemožnost (morální) odpovědnosti u Galena Strawsona / Galen Strawson's impossibility of (moral) responsibility

In this thesis I attempt to introduce Galen Strawson's position, which he adopts in the free will debate followed by the debate about his Basic Argument. While giving a de-tailed account of responsibility as a reflective rational responsiveness, I show that re-sponsibility is in no respect causa sui and therefore it is not impossible for human beings to reach it, explained with the reasons given by Strawson. I refuse steps B, C, 8, 9 and 10 of the Basic Argument. I claim that undetermined self-determination consists in the ability to make a decision in the light of actually revised principles of choice. Such revision is granted by actual ability to reflect the validity and adequacy of principles of choice in relation to motivating values in question by using methodical doubt as a universal tool do to so. Such reflection, with respect to what matters for decision making in question, is potentially ultimate. I claim that Strawson underestimates the uniqueness of reflective rationality especially, when missing the crucial difference between Fido the dog and Nemo the man in the situation of choice. Moreover, I suspect Strawson of excluding the subject of action or choice and its actual principles of choice from the realm of intelligible things. This leads to disruption of request to conception of the world as internally consistent and in principle attainable by human beings. Finally, I show why I find sophisticated fatalism problematic in both of its versions, deterministic as well as indeterministic.

Quando parte o último comboio? : Álvaro de Campos, um seguidor decadente de Walt Whitman e Nietzsche

Este trabalho analisa a produção de Álvaro de Campos – heterônimo de Fernando Pessoa – em relação a duas linhas de força: a poesia de Walt Whitman e a filosofia de Friedrich Nietzsche. Busca comprovar que os poemas da segunda fase, a eufórica, em virtude do prolífico diálogo com o bardo norte-americano e o filósofo, estão investidos de uma vontade de potência, a qual se manifesta, especialmente, no ímpeto sensacionista de experimentar tudo e na analogia entre o poeta e Deus. Herdeiro do Decadentismo, Campos não consegue manter o discurso vitalista e dinamista e, frequentemente, um tom depressivo invade os textos. Nessas ocasiões, o eu lírico, em vez de estar marcado pela vontade de potência, assume uma feição decadente, que predominará na fase posterior. Pretendemos demonstrar que, apesar do cansaço, do tédio, da letargia e da lucidez, há, no Campos disfórico, uma vontade de potência. A fim de examinarmos os poemas do poeta eufórico, nos apoiaremos no conceito de intertextualidade, recorrendo aos estudos de Kristeva, Bakhtin, Laurent Jenny, Gerárd Genette, Leyla Perrone-Moisés e Tiphaine Samoyault. Com vistas à percepção do modo como o heterônimo ressignifica o legado de Whitman e Nietzsche, seguiremos, na análise, a metodologia comparatista de busca das analogias e das diferenças. Serão de grande valia as formulações de George Steiner, Eduardo Lourenço e Octavio Paz, entre outros. Na mesma proporção, serão importantes, para a compreensão do Campos disfórico, as colocações de Nietzsche acerca do niilismo e os argumentos de Steiner a respeito da tristeza inerente ao pensamento. Urdida com os influxos de Nietzsche e Whitman, a vontade de potência leva Campos, tal como os antecessores, a considerar-se divino. Entretanto, por ser demasiado consciente, Campos não pode persistir na embriaguez do Sensacionismo. Resta-lhe, então, manifestar a vontade de potência através da ideia de permanência da obra. / This paper analyzes the production of Álvaro de Campos - heteronym of Fernando Pessoa - in relation to two strong lines: the poetry of Walt Whitman and the philosophy of Friedrich Nietzsche. It seeks to prove that the poems of the second phase, the euphoric, are invested with a power to will which is manifested especially in the sensationist impetus to try everything and in the analogy between the American bard and the philosopher. Heir to the Decadentism, Campos cannot keep the vitalist and dynamistic discourse and often a depressing tone pervades his texts. On these occasions, the lyrical, rather than being marked by the will to power, assumes a decadent feature, which will predominate in the later stage. We intend to show that, despite the fatigue, boredom, lethargy and lucidity, there is in the dysphoric Campos a power to will. In order to examine the poems of the euphoric poet we will seek support in the concept of intertextuality, using the studies of Kristeva, Bakhtin, Laurent Jenny, Gérard Genette, Leyla Perrone-Moisés and Tiphaine Samoyault. With the objective of perceiving how the heteronym gives new meaning to legacy of Whitman and Nietzsche, we will follow in the analysis, the comparative methodology of search of analogies and differences. Of great value will be the approaches of George Steiner, Eduardo Lourenço and Octavio Paz, among others. In the same proportion, will be important for the understanding of the dysphoric Campos, the collocations of Nietzsche on nihilism and Steiner's arguments about the inherent sadness in thought. Warped with inflows of Nietzsche and Whitman, the will to power leads Campos, like his predecessors, to consider himself divine. However, because he is too conscious Campos cannot persist in the intoxication of Sensationism. Then, he left with expressing the will to power through the idea of the permanence of the work. / Este trabajo analiza la producción de Álvaro de Campos – heterónimo de Fernando Pessoa – en relación a dos líneas de fuerza: la poesía de Walt Whitman y la filosofía de Friedrich Nietzsche. I have outlined some objections to soteriologies that presume that only some are given a chance of eternal life. Such soteriologies can include or exclude those mentally competent but lacking human evangelisation. Fundamental to evaluating soteriologies I have looked at both what sin is (being and doing) and what salvation consists in, as regards divine and human interaction. On the one side I have considered God's goodness - would such a being act unethically regarding man's eternity? On the other hand I have looked at whether, and if so in what way, man is required to respond - in what way or ways is chance (if at all) given. Finally I have considered views about those who die in infancy. Here I have tentatively suggested my own theory which seeks to presume that before death every human being may choose to accept of reject God, a choice integral (I suggest) to salvation. / Department of Philosophy, Practical and Systematic Theology / M. O estudo que se segue trata do aprendizado da vontade no que diz respeito a sua relação com o mundo. As dores do mundo são de fundamental importância para que a vontade tome consciência de si e se negue. O pensamento de Schopenhauer defende a ideia de que pela negação dos prazeres é possível a supressão da desgraça universal que é o sofrimento. A vontade consiste na raiz metafísica do mundo e configura-se o fundamento de todas as dores do mundo e quando ela se objetiva é para satisfazer os seus desejos inconscientes. A sublimação da música faz com que a vontade por alguns instantes fique extasiada e se elevando temporariamente acima dos fenômenos consiga distanciar-se dos sofrimentos. Mas a música é a partitura no tempo, não é possível ficar ai por mundo tempo e logo que a ilusão cessa as dores retornam novamente. O aprendizado que a vontade consegue extrair da música não é suficiente para suprimir as dores e Schopenhauer acredita que só pela resignação seja possível extirpar de uma vez todos os nossos sofrimentos e conseguirmos chegar a um estágio de negação total de si. O aprendizado da vontade ocorre quando ela chega a esse estado de total ascetismo. Ao longo da pesquisa são feitas várias perguntas no tocante, por exemplo, ao ato de resignar-se ser uma ação educativa como pensava Durkheim? O aprendizado da vontade é um ato educativo, já que é uma ação prática exercida sobre o próprio corpo? Então, pensar a educação em Schopenhauer é falar de não educação em Schopenhauer?
