Previous issue date: 2016-03-17 / CNPQ – Conselho Nacional de Desenvolvimento Científico e Tecnológico / A presente dissertação se propõe a analisar o papel exercido pela Suprema Corte dos Estados Unidos da América no cenário político-jurídico do país. De uma instituição meramente jurídica, historicamente, a Suprema Corte tem desempenhado importante papel na formulação de políticas públicas nacionais e na condução do debate público nacional. Mediante uma análise histórica do Direito estadunidense, pretende-se apresentar as diferenças e as peculiaridades do Direito dos Estados Unidos, em comparação ao Direito inglês. Nesse cotejo, nota-se que antecedentes do controle jurisdicional de constitucionalidade de leis já eram vistos no Direito inglês, como as contribuições de Edward Coke, e na própria história colonial americana. Com fundamento no common law inglês, mas com influências da tradição jurídica romano-germânica, o Direito estadunidense desenvolveu institutos próprios, aptos a enfrentar os desafios surgidos no novo país. Entre as inovações, há a Suprema Corte dos Estados Unidos, órgão de cúpula do Poder Judiciário, que, entretanto, desempenha importante função política na concretização das disposições constitucionais, na harmonização entre os Poderes e entre os diversos entes federados. Em verdade, a Corte concorre na elaboração de políticas públicas nacionais, voz ativa nas principais deliberações públicas nacionais, influenciada e influenciando os atores políticos tradicionais. / This thesis analyzes the role played by the United States Supreme Court in the legal and political frame. From a legal institution, historically, the Supreme Court has played an important role in the formulation of national policies and the conduct of national public debate. For historical analysis of U.S. Law, it intends to show the differences and peculiarities of the U.S. Law versus to English law. Then, the judicial review`s history started in English Law, as the study of Edward Coke, and even in the American colonial history. Based on English common law, but with influences from civil law tradition, the American Law has developed its own institutions, able to face the challenges in the new country. Among the innovations, there is the United States Supreme Court, a member of the Federal Judiciary, which, however, plays an important political role in the respect of constitutional provisions, the harmonization between the powers and the States. In fact, the Court takes part of the national policies, thus it is an active voice in the national public deliberations, whereas the Court influenced and is influencing for the traditional political actors.

Embora existam estudos relevantes no Brasil a respeito do controle de constitucionalidade exercido pelo STF, o assunto ainda demanda pesquisa. Uma das áreas de pesquisa que precisa ser aprofundada é a dinâmica da interação ao longo do tempo entre o órgão judicial que exerce o controle de constitucionalidade e os órgãos que editam atos normativos sujeitos ao controle de constitucionalidade. Diante disso, o objeto desta tese é o exame da interação entre o STF e o Congresso Nacional nos anos de 1988 a 2013 decorrente da declaração judicial de inconstitucionalidade de atos normativos do Congresso Nacional. A tese baseia-se em uma pesquisa de jurisprudência e de legislação, e adota perspectiva teórica que reconhece haver um contínuo diálogo institucional entre os Poderes. Um dos objetivos da tese é descrever os padrões das decisões judiciais que declararam a inconstitucionalidade de atos normativos, e as possíveis relações entre a deliberação judicial e a legislação subsequente. One of the research areas that needs to be deepened is the dynamic of the interaction over time between the judicial branch that controls the constitutionality of legislation and the legislative branch that make the norms subject to judicial review. In the face of this, the object of this thesis is to exam the interaction between the Federal Supreme Court and the National Congress in the period of 1988 to 2013 derived from judicial decisions that declared norms unconstitutional. The thesis is based on a research of judicial decisions and legislation, and it adopts a theoretical perspective that recognizes a continuous institutional dialogue between the Powers. One of the objectives of the thesis is to describe the patterns of the judicial decisions that declared norms unconstitutional, and the feasible connections between the judicial deliberation and subsequent legislation. Another objective of the study is to provide standards to assess the continuous interaction between the Federal Supreme Court judicial review and the activity of the National Congress. The third objective is to identify challenges that must be faced if one pretend to strengthen the legitimacy of the dialogue between the Powers.

Por que a um grupo de indivíduos não eleitos é dado derrubar uma decisão política tomada pela maioria dos representantes do povo? Para justificar o papel contramajoritário de juízes e cortes, vários arranjos têm sido propostos ao longo de um debate ainda em curso na teoria constitucional. Autores como John Rawls e Ronald Dworkin sustentaram uma qualidade deliberativa do processo decisório judicial - magistrados, especialmente os das Cortes Supremas, teriam destreza e motivação institucional para apresentar argumentos mais apropriados sobre o significado da constituição e cartas de direitos. Críticos negam que a deliberação judicial seja um paradigma de razão pública e, especialmente no Brasil, afirmam que o órgão de cúpula do Judiciário possui um modelo decisório não-dialógico. Neste trabalho, portanto, o desempenho deliberativo interno do Supremo Tribunal Federal (STF) é investigado através de um modelo de análise denominado Escala de Deliberatividade Intrainstitucional (EDI). Os dados colhidos indicam que, apesar da existência de interação entre os membros do colegiado, a decisão final não valoriza os potenciais ganhos deliberativos da sessão de julgamento, tornando a prática decisória da Corte o que a dissertação chama de ação coletiva figurativa - quando, apesar de existir um momento de aparente de deliberação entre os membros, aquilo que faz o colegiado apresenta um produto de algo que os membros individuais fazem sozinhos, ou seja, daquilo que fazem sem pensar que estão agindo enquanto grupo. Sem rationes decidendi que expressem a opinião da Corte como um todo, prejudica-se a formação de precedentes e, consequentemente, a construção de uma jurisprudência constitucional íntegra, estável e coerente. / Why can a group of unelected individuals overturn a political decision taken by the majority of the people\'s representatives? To justify the countermajoritarian role of judges and courts, a lot of possibilities have been proposed throughout a debate that still occurring in constitutional theory. Authors such as John Rawls and Ronald Dworkin sustained a deliberative potential of judicial decision-making - judges, especially Supreme Court Justices, would have the skills and institutional motivation to present more appropriate arguments about the meaning of the constitution and charters of rights. Critics deny that judicial deliberation is a paradigm of public reason and, especially in Brazil, argue that the Supreme Federal Tribunal (STF) has a non-dialogical decision-making model. In this paper, the internal deliberative performance of STF is investigated through an analysis model called Intrainstitutional Deliberativity Scale (IDS). The results indicate that, despite the existence of interaction between the members of the collegiate, the final decision doesn\"t value the potential deliberative gains of the plenary session, making the decision model of the Court what we call collective figurative action - when, despite there is a moment of apparent deliberation among the members, what the collegial does presents a product that individual members do alone, i. e., what they do without thinking that they are acting as a group. Without common rationes decidendi, the Court undermines the precedential value of a case and, consequently, the construction of the jurisprudential integrity and authority.

The methodology of this wok comprises a literature survey based on national and international doctrine and court decisions, especially the Brazilian Supreme Court, as well as the legislation related to the subject and other sources of investigative interest. It is pointed out that the implementation of fundamental social rights listed in the Constitution is mandatory for the public administration and the judiciary must ensure its execution, rebutting criticisms that allude to the political neutrality of jurisdiction, the separation of powers and the constitutional legitimacy. It is emphasized the importance of deepening the knowledge that the public budget should be defined and executed in a responsible manner, aimed at meeting the social needs of the population. It is analyzed the control of the public budget from internal, external, popular and judicial levels. It is emphasized the diffuse constitutional control in individual and collective actions that seek to impose obligations regarding social services on the State to achieve the existential minimum; and the control of constitutionality of political and administrative choices as the most advantageous way to minimize inconvenience to the budget during the financial year. It presents hypotheses in which the direct action of unconstitutionality and the claim of breach of fundamental precept can be used to contest normative and administrative acts or legislative and administrative omissions related to the public budget, before and throughout the financial year. Based on the studies carried out, it is concluded that there is the need for procedural opening in concentrated control of constitutionality of the public budget at the postulation, instructions, decision and execution stages, strengthening the participative democracy mechanisms and permanent institutional dialogue between the Powers and also between them and the society to ensure the progressive realization of fundamental social rights that comprise the existential minimum.

Este trabalho procura demonstrar a irracionalidade do controle e da interpretação constitucionais sem o stare decisis e a viabilidade e a necessidade de correção deste erro com o CPC/15. Analisa-se o anacronismo do CPC/73, completamente inadequado ao Estado Social Contemporâneo. Buzaid baseou-se em teorias vinculadas a uma visão do direito anterior a Kelsen e completamente incapazes de instrumentar políticas públicas e de lidar com um direito no qual as normas-regra convivem com as normas-princípio. Estudam-se as caraterísticas fundamentais da jurisdição constitucional de molde norte-americano e os problemas gerados pelo transplante institucional inadequado e a consequente violação dos níveis do ordenamento. Demonstra-se a essencialidade do stare decisis na jurisdição constitucional e a vinculação do controle e da interpretação constitucionais brasileiras, sob o CPC/73, a uma ultrapassada visão interpretativa das cortes superiores e do pretenso caráter declaratório das decisões judiciais. Demonstra-se a adequação do CPC/15 ao Estado Social Contemporâneo e à CRFB/88. Analisa-se a viabilidade e a necessidade de correção institucional no tratamento tanto do recurso extraordinário cível como da interpretação constitucional com o novo CPC. Demonstra-se a evolução interpretativa e processual inerente ao novo Código e o seu vínculo com o modelo de cortes supremas, que separa os níveis do ordenamento, corrigindo ao menos parte do arranjo institucional brasileiro e alterando profundamente a jurisdição constitucional do país. / This work seeks to demonstrate the irrationality of the Brazilian judicial review and constitutional interpretation without stare decisis and the necessity and feasibility of the correction of this mistake with the new Civilian Procedural Code of 2015. It analyzes the anachronism of the Civilian Procedural Code of 1973 (CPC/73), which was completely inadequate to the Welfare Stare. Buzaid was based in theories linked to conceptions of law previous to Kelsen, that were unable to establish public policies, as well as to deal with a law system where rules coexist with principles. The fundamental characteristics of the American judicial review of legislation and constitutional interpretation are studied, as well as the problems generated by the inadequate institutional transplant, causing the violation of the levels of the law system. This work demonstrates the essentiality of stare decisis in the constitutional jurisdiction and the link between the Brazilian judicial review and constitutional interpretation, under the CPC/73, to an outdated interpretative view of the function of the high courts and the pretended declaratory character of the judicial rulings. It proves the inadequacy of the CPC/73 to the Welfare State and to the Brazilian Constitution of 1988 (CRFB/88). It analysis the feasibility and the necessity of the institutional rectification of both the appeal to the Brazilian Supreme Court and the constitutional interpretation with the new Procedural Code. It demonstrates the interpretative and procedural evolution inherent to new Code and its link with the standard of Supreme Courts, that detach the different levels of the law system, rectifying at least part of the Brazilian institutional arrangement, changing considerably the country´s constitutional jurisdiction.

[pt] O trabalho identifica as bases necessárias para apontar o método adequado
de interpretação das normas do Direito Regulatório. Para atingir esse ponto, no
entanto, perpassa pela discussão a respeito de qual o método adequado de
interpretação da Constituição e da lei em geral. O resultado (prático) das teorias
constitucionais ou das teorias de interpretação jurídica depende de fatores que
muitas vezes são negligenciados, o que repercute, obviamente, na correção dessas
teorias, fazendo com que a discussão a respeito do formalismo jurídico seja
retomada, com argumentos mais robustos a seu favor. A hipótese levantada é a de
que os teóricos constitucionais e os da interpretação jurídica brasileiros
geralmente desenvolvem suas teorias como se fossem ser aplicadas por eles
próprios ou por grandes especialistas e/ou a partir de critérios abstratos,
negligenciando o fato de a regra interpretativa defendida poder acabar resultando
num Direito inadequado, no nível operacional, tendo em vista as limitações dos
agentes responsáveis por sua aplicação e as contingências do mundo real. No caso
do Direito Regulatório, obtém-se um melhor direito caso adotado pelos juízes o
formalismo deferencial (ou formalismo maximilianista) como postura
interpretativa, ao invés de uma postura interpretativa não formalista, como a póspositivista
e a neoconstitucionalista. Existem fatores externos ao Direito que
repercutem decisivamente na capacidade de aplicação da Constituição e da lei que
não são perceptíveis à análise moral e/ou conceitual-teórica. Portanto, se não
identificados e adequadamente trabalhados, levam à construção de uma teoria
constitucional ou da interpretação jurídica sem maior valor prático, gerando
disfunções no sistema constitucional e legal, além de um Direito ruim, caso
empregada. Propõe-se identificar a interpretação jurídica e o direito adequados
sob outra perspectiva que não a moral ou teórico-conceitual-abstrata,
demonstrando que existem teorias sólidas contrárias a uma leitura moral da
Constituição pelo Poder Judiciário, bem como que a defesa da aplicação prática
da leitura moral da Constituição depende de análises prévias geralmente
negligenciadas pelos seus defensores, de maneira que pode gerar resultados
(negativos) bastante diversos do pretendido. Essa outra perspectiva, importante
principalmente para a escolha do método interpretativo, seria a institucional. De
modo que incitar o jurista e o servidor público em geral ao perfeccionismo na
aplicação do Direito pode levar, e leva muitas vezes, a um mal Direito. Pode
repercutir negativamente, inclusive, no funcionamento do sistema republicano (o
papel e responsabilidade das instituições) e da democracia (legitimidade das
instituições que decidem) do Estado. Conclui que a maioria das questões legais e
constitucionais é decidida, no Estado, pelo Legislativo e pela Administração
Pública. Não chegam ao Judiciário. Foi constatada a maior capacidade decisória
do Legislativo e da Administração Pública, quando comparados aos tribunais, no
que toca à escolha das regras e doutrinas interpretativas, bem como na
interpretação de textos normativos vagos, ambíguos e principiológicos,
notadamente em matérias de extrema complexidade e especificidade técnica,
como as normas regulatórias e as normas constitucionais incidentes sobre estas
últimas. Por outro lado, identificou-se uma maior capacidade decisória dos
tribunais no âmbito dos textos normativos claros e específicos (regras jurídicas).
Verificou-se que o STF e o STJ têm, em geral, essa visão, adotando uma postura
formalista deferencial quanto às normas regulatórias, mesmo estando a doutrina
nacional em peso no sentido inverso. Desse modo e, ao constatar o deslocamento
do paradoxo da onipotência para o Judiciário, reforçado após a década de 1990 no
Brasil, acredita-se no acolhimento do formalismo deferencial como postura
interpretativa estratégica pelos juízes. Já a / [en] This research identifies the necessary foundations to point out the proper
method of interpreting the norms of Regulatory Law. To reach this point, however,
this thesis goes through the discussion of which is the proper method of
interpreting the Constitution and the statutes in general. The (practical) results of
the constitutional theories or of the theories of legal interpretation depend on
factors that are often overlooked, which affects obviously in the correctness of
these theories, resuming the discussion of legal formalism, with more robust
arguments in its favor. The proposed hypothesis is that the Brazilian theorists of
constitutional and legal interpretation generally develop their theories as if they
would be applied by themselves or by prominent experts and / or with abstract
criteria, neglecting the fact that the proposed interpretive rule may result in an
inappropriate Law, at the operational level, given the limitations of the agents
responsible for its implementation and real-world contingencies. In Regulatory
Law, specifically, a better law is obtained if a deferential formalism (or
maximilianist formalism) is adopted by the judges as interpretive standard, rather
than a non-formalist interpretive standard, such as the post-positivist and the
neoconstitucionalist one. There are external factors that affect decisively the
ability to enforce the Constitution and the statutes, which are not perceptible to the
moral and / or conceptual-theoretical analysis. So, if not identified and adequately
addressed, these factors lead to the elaboration of a constitutional or legal
interpretation theory that lacks substantial practical value, and which enforcement
will generate dysfunctions in the constitutional and legal system, and also a bad
law. It is proposed that the appropriate law and legal interpretation is identified
from a perspective other than the moral or theoretical-conceptual-abstract
perspective, to show that there are solid theories opposing a moral reading of the
Constitution by the judiciary branch, and that the defense of the practical
application the moral reading of the Constitution depends on previous analyzes
generally neglected by their defenders. This moral reading can yield unexpected
(negative) results. This other perspective, especially important for the choice of
interpretive method, would be institutional. To call the scholars and public
servants in general to use perfectionism in the application of law may lead, and
often leads to a bad law. It may even negatively impact the functioning of the
republican system (the role and responsibility of institutions) and democracy
(legitimacy of the deciding institutions) of the State. The conclusion of this
research is that the majority of the legal and constitutional issues are decided by
the Legislature and the Public Administration. They do not even reach the courts.
It was noted that of the Legislature and the Public Administration have greater
decision-making capacity, when compared to the courts, in regard to the choice of
interpretive rules and theories, as well as in the interpretation of vague, ambiguous
and principle-oriented legal provisions, especially in matters of extreme
complexity and technicality, such as the regulatory standards and related
constitutional provisions. On the other hand, we identified a greater decisionmaking
ability of the courts within legal provisions that are clear and specific
(legal rules). It was noticed that the Federal Supreme Court (STF) and the
Superior Court of Justice (STJ) generally share this view, adopting a deferential
formalist approach regarding regulatory standards, even though the majority of
Brazilian legal scholars tend to follow the opposite direction. Thus, observing the
shift of the paradox of omnipotence towards the Judiciary, intensified in Brazil
after the 1990s, we believe that the adoption of deferential formalism interpretive

In this iter, we intend to define if Brazilian’s Accounts Courts, that have the duty to make public expenses external control, when examine the constitucionality of public’s administration acts and, therefore, of rules and normatives acts that support them, exercite a kind of constitucional control, similar of Unites States judicial review, or just realize its Duty/Power to accomplish, totally, the terms for them assigned by the Constitution, for it’s condition of Custodes in nomine populis.

A presente dissertação analisa o controle abstrato de constitucionalidade exercido pelo Supremo Tribunal Federal quanto ao poder de decreto do Presidente da República no Brasil posterior à promulgação da Constituição de 1988, as medidas provisórias. Neste sentido, o trabalho propõe-se a mapear e a fornecer uma explicação para os padrões de acionamento e decisão da mais alta corte brasileira quando esta é chamada a julgar Ações Diretas de Inconstitucionalidade sobre o instrumento unilateral de ação do Poder Executivo no Brasil. A pesquisa parte da constatação de que boa parcela da literatura existente tanto no direito como na ciência política não conferiu tratamento adequado ao tema, adotando uma retórica no mais das vezes simplificadora da realidade, quando não essencialmente normativa. Em vista da insuficiência das matrizes teóricas empregadas naqueles trabalhos, parte-se para a exposição de outras vertentes analíticas, ainda não incorporadas de modo satisfatório ao exame das instituições judiciais no período recente de democracia no Brasil. Constitui-se a partir disso um modelo de análise centrado nas relações estabelecidas entre os diferentes Poderes do Estado, em especial Poder Executivo e Suprema Corte. A matriz teórica adotada é formada, portanto, tomando por base o chamado modelo estratégico de separação de poderes ao qual se agregam contribuições do neo-institucionalismo e dos estudos sobre a presença de organizações de interesses junto ao Poder Judiciário. A hipótese formada a partir desse construto afirma que a tendência geral a ser constatada é a não intervenção constante do Supremo Tribunal Federal quanto ao poder de decreto do presidente brasileiro. Isso ocorreria porque a corte, ciente de sua posição no sistema político, percebe que o risco de apresentar-se como um entrave à ação governativa pelo Poder Executivo pode redundar em embate com este, possivelmente resultando em saldo negativo ao tribunal. Em vista disso, a corte adota uma postura de intervir de forma tópica e pontual, não se apresentando como um obstáculo constante ao governo, mas nem por isso retirando-lhe importância política. Em especial, de acordo com o modelo proposto, é de se esperar que a corte intervenha apenas quando os riscos de sofrer sanções sejam minimizados, o que se verifica quando o tribunal recebe alguma espécie de suporte político efetivo por outros atores políticos de destaque, capazes de auxiliar na construção da respeitabilidade das decisões e da própria instituição em questão. Quando se parte para a análise das evidências empíricas, as hipóteses centrais são em grande medida confirmadas, visto que a tendência geral ao não intervencionismo é a tônica. Semelhantemente, as situações em que o tribunal intervém se dão majoritariamente em temas que não se refletem diretamente sobre o próprio Poder Executivo, como também há significativo sucesso de proponentes como governadores de Estado, associações empresariais e entidades de fiscalização da ordem jurídica, como o Conselho Federal da Ordem dos Advogados do Brasil e o Procurador-Geral da República, o que corrobora a importância de atores que possam fornecer apoio público às decisões da corte contrárias ao governo. Por outro lado, partidos políticos – em especial aqueles envolvidos diretamente na disputa eleitoral pela chefia do Executivo – tendem a ter significativamente menos sucesso na propositura das ações, o mesmo ocorrendo com associações profissionais, possivelmente em função de seu menor peso político. / The present dissertation analyses the judicial review exercised by the Supreme Federal Tribunal over the Brazilian’s president executive decrees after the 1988 Constitution, named provisional measures. It proposes to map and to explain the patterns of standing and decision-making of the highest Brazilian court when it is called to judge Direct Actions of Unconstitutionality (ADINs) about the unilateral instrument of action of the Executive branch in Brazil. The research begins with the statement that large part of the literature, both in law and political science, hadn’t conferred adequate treatment to the theme, adopting a rhetoric usually simplifier of this reality, and sometimes essentially normative. Considering the insufficiencies of the theoretical frameworks presented in those works, other analytical theories are presented next, still not incorporated satisfactorily in the exam of the judicial institutions in the recent period of democracy in Brazil. By these terms, it is constituted a model of analysis centered in the relations established among the different branches of the State, specially the Executive and the Supreme Court. The theoretical framework adopted is formed, then, taking as basis the so called separation-of-powers model, in to which are aggregated contributions of the neo-institutionalism and the studies about the presence of organized interests before the judicial branch. The hypothesis formed from this framework affirms that the general trend to be found is the non-constant intervention of the Supreme Federal Tribunal over the decree powers of the Brazilian president. This is supposed to happen because the court, aware of its position in the political system, realizes that the risk of presenting itself as a deadlock to the governmental action by the Executive branch may conduce to a shock among them, possibly resulting in a negative balance to the court. Consciously, the court adopts a posture of interfering by a punctual way, not presenting itself as a constant obstacle to the government, but without removing its political significance. Specially, according to the proposed model, the court is supposed to interfere only when the risks of suffering sanctions are minimized by the presence of effective political supports given by important political actors that can ensure the respectability of the decisions and of the institution itself. Passing to the analysis of the empirical findings, the central hypothesis is largely confirmed, since the general trend of non-intervention of the court is the tonic. In the same way, the situations in which the court interferes are preponderantly themes are not directly concerned to the immediate interests of the Executive branch, and the most successful proponents are the state governments, the business associations, and some significant entities of the legal arena, such as the Prosecutor General and the Federal Council of the Brazilian Bar Association, confirming the importance of those actors in giving effective support to the court’s decisions against the government. On the other hand, the political parties – specially the ones involved directly in the electoral competition for the Executive branch – tend to be less successful in the proposal of those actions, the same happening to the professional associations and unions, probably because of its lower political weight.

Previous issue date: 2010-09-17 / Constitutions arose as a proper tool to establish and legitimize the government bound to the sovereign will of the people. Currently, Constitutions are also guarantors of political, social, economic, cultural and diffuse rights. The constitutional concept is founded on the idea of supremacy of the Constitution, and from this idea, results the judicial review of laws. After the middle of the twentieth century, the judicial review was expressly incorporated into various jurisdictions. There is, however, a strong democratic objection to the judicial review, under the rationale that judges are not elected by popular vote and therefore could not control rules issued by those to whom the people delegated the exercise of political power. In this debate, one can identify three positions: a more radical one, defending the judicial self restraint, and two others advocating the legitimacy of the judicial review by the judicial procedure (to preserve the integrity of the democratic process) or by substance (to ensure moral rights to individuals, aimed at the collective welfare). Despite this discussion, the possibility of judicial review is confirmed in the Brazilian legal system since the Constitution of 1891. Under the 1988 Constitution, the task of "guardian of the Constitution" rests with the Federal Supreme Court, which exercises it both by means of concentrated control or when it analyzes, in the higher instance, constitutional issues raised in the sphere of diffuse control. It is worth mentioning that STF is not far from its function of protecting the Constitution, even when it performs other roles conferred on it. From the analysis of decisions issued by Federal Supreme Court in hard cases regarding the political-representative system, this thesis aims at inquiring how the Federal Supreme Court understands its institutional role in defining political issues and to what extent the constitutional jurisdiction contributes to the maturing of the Brazilian democratic system. / As Constituições surgiram como um instrumento apto a constituir e legitimar o governo vinculado à vontade soberana do povo. Atualmente, as Constituições são também garantidoras de direitos políticos, sociais, econômicos, culturais e difusos. A proposta constitucionalista é fundada na ideia de supremacia da Constituição e, deste ideal, decorre o controle de constitucionalidade das leis. Após meados do século XX, o controle de constitucionalidade foi expressamente incorporado a diversos ordenamentos jurídicos. Existe, no entanto, uma forte objeção democrática ao controle judicial de constitucionalidade, sob o argumento de que os juízes não são eleitos pelo voto popular e, por isso, não poderiam controlar normas editadas por aqueles a quem o povo delegou o exercício do poder político. Nesse debate, é possível identificar três posições: uma mais radical, que defende o self restraint judicial, e outras duas que defendem a legitimação da jurisdição constitucional pelo procedimento (para preservar a integridade do processo democrático) ou pela substância (para assegurar direitos morais dos indivíduos, voltados para o bem-estar coletivo). Apesar de tal discussão, a possibilidade de controle judicial de constitucionalidade está positivada no ordenamento jurídico brasileiro desde a Constituição de 1891. Nos termos da Constituição de 1988, a tarefa de 'guardião da Constituição' cabe ao Supremo Tribunal Federal, que a realiza tanto por meio de controle concentrado ou quando analisa, em última instância, questões constitucionais levantadas em sede de controle difuso. Cumpre observar que o STF não se distancia da sua função de proteger a Constituição, mesmo quando exerce outras funções que lhe foram conferidas pelo texto constitucional. A partir do estudo de decisões do STF proferidas em casos difíceis relacionados ao sistema político-representativo, o presente trabalho visa a perquirir como o STF compreende seu papel institucional na definição de questões políticas e, em que medida, a jurisdição constitucional contribui para o amadurecimento do regime democrático brasileiro.

As sentenças aditivas e as sentenças substitutivas da Corte Constitucional italiana e a jurisprudência do Supremo Tribunal Federal brasileiroTaschetto, Fernando Maicon Prado January 2015 (has links)
O presente trabalho tratou das sentenças aditivas e das sentenças substitutivas no Direito italiano e no Direito brasileiro (mais especificamente, na jurisprudência do Supremo Tribunal Federal). Tais técnicas alternativas (ou “atípicas”) de decisão no controle de constitucionalidade foram criadas pela Corte Constitucional na Itália e, com o tempo, passaram a ser utilizadas por outros tribunais ao redor do mundo, inclusive – conforme a doutrina mencionada no trabalho – pelo Supremo Tribunal Federal no Brasil. O objetivo do trabalho foi analisar como tais modelos (ou tipos) decisórios são utilizados pela Corte Constitucional na Itália e como foram “importados” para o Brasil pela jurisprudência do Supremo Tribunal Federal. Inicialmente, estudou- se, de modo detalhado, o controle de constitucionalidade na Itália, que é exercido pela Corte Constitucional por via incidental (ou por via de exceção) ou por via principal (ou por via de ação). Em seguida, abordou-se o “arsenal” de modelos (ou tipos) decisórios da Corte Constitucional no controle de constitucionalidade, do qual fazem parte as sentenças aditivas e as sentenças substitutivas. Por fim, examinaram- se algumas decisões do Supremo Tribunal Federal que – de acordo com a doutrina mencionada no trabalho – são tidas como exemplo de sentenças aditivas e de sentenças substitutivas. Verificou-se que o Supremo Tribunal Federal não utiliza as fórmulas que, na Itália, são encontradas no dispositivo das sentenças aditivas e das sentenças substitutivas da Corte Constitucional nem admite expressamente – no dispositivo das decisões – que emprega sentenças aditivas e sentenças substitutivas, o que pode indicar que tais modelos (ou tipos) decisórios não precisam ser “importados” para o Brasil. Constatou-se, ainda, que as referências às sentenças aditivas, do modo como são feitas pelos Ministros nas decisões do Tribunal, representam grave violação à ideia de segurança jurídica, que está contida no princípio do Estado de Direito, e vulneram, pois, a própria Constituição. / The present essay adressed the additive sentences and the substitutive sentences in Italian Law and in Brazilian Law (more especifically, in the Federal Supreme Court jurisprudence). Such alternative (or “atypical”) techniques of decision in judicial review were created by the Constitucional Court in Italy and, with time, started being used by other courts around the world, including – according to the doctrine mentioned in this essay – the Federal Supreme Court in Brazil. The goal of this essay was to analise how these decision models (or types) are used by the Federal Supreme Court. Initially, the judicial review in Italy, which is exercised by the Constitutional Court by incidental via (or exceptional via) or by mainly via (or through action), was studied, in detail. Then, the “arsenal” of models (or types) of decision of the Constitutional Court in judicial review, which comprises the additive sentences and the substitutive sentences, was approached. Lastly, some decisions of the Federal Supreme Court that – according to the doctrine mentioned in this essay – are considered as example of additive sentences and of substitutive sentences were examined. It was found that the Federal Supreme Court does not use the formulas that, in Italy, are found in the device of the additive sentences and of the substitutive sentences of the Constitutional Court, nor expressly acknowledges – in the device of decisions – that employs additive sentences and substitutive sentences, which may indicate that such models (or types) of decision-making do not need to be “imported” to Brazil. It was also found that the references to the additive sentences, the way they are made by Justices in the Court’s decisions, represent a serious violation of legal certainty idea, which is contained in the Rule of Law principle, and undermines, therefore, the Constitution itself.
