[pt] Serão as instituições internacionais instrumentos a serviço dos Estados que as criaram ou, na verdade, atores dotados de fontes de poder e autoridade próprias? Durante muito tempo os debates travados entre as perspectivas teóricas dominantes em Relações Internacionais deixaram de lado a questão da capacidade de agência das instituições, simplesmente assumindo a impossibilidade de autonomia destes arranjos. Orientadas por premissas funcionalistas e utilitaristas, as instituições eram vistas como meras arenas para a resolução de controvérsias ou instrumentos de ação coletiva. A realidade, contudo, nem sempre confirma o que prediz a teoria. Na prática, um número representativo dentre estes arranjos parece atuar com considerável autonomia, afastando-se do modelo instrumental que normalmente lhe é destinado. Regimes e, em especial, cortes internacionais de direitos humanos são exemplos interessantes para se discutir a autonomia institucional. Fundada no novo institucionalismo e tomando como objeto da discussão a Corte Interamericana de Direitos Humanos, esta dissertação se propõe a analisar como certas instituições, uma vez criadas, conseguem gradativamente se desvincular dos interesses e, principalmente, do controle estatal, adquirindo considerável autonomia no desempenho de suas competências. / [en] Are international organizations subservient to member state interests or are they endowed with sources of power and authority? For a long time, debates between mainstream theories in International Relations did not consider their capacity as actors and neglected the autonomy of such arrangements. Based on functionalist and utilitarist premises, institutions were perceived as mere arenas for dispute resolution or instruments of collective action among states. Reality, however, does not always coincide with theoretical assumptions. In fact, an increasing number of international organizations seem to shape their own mandate, moving away from the instrumental pattern which is normally assigned to them. International human rights regimes and, more precisely, international human rights courts provide an interesting entry point into the discussion on institutional autonomy. Based on a new institutionalist approach and choosing as object of investigation the Inter-American Court of Human Rights, this dissertation tries to expose how certain institutions, once created, gradually emancipate themselves from state interests - and mainly from state control - and attain a considerable degree of autonomy in exercising their mandate.

A intensidade com que essa instituição se desincumbe de sua importante missão não permaneceu a mesma ao longo dos anos. O protagonismo e autonomia atual não se identificam com o papel secundário exercido pelo Supremo no período anterior ao advento da Constituição de 1988. Com um desenho conformado pelo constituinte de 1987 após o fim do regime militar, a Constituição de 1988, bem como mudanças significativas na organização da sociedade brasileira, possibilitaram a ampliação de uma vida democrática no país. Teóricos que estudam essa mudança confirmam um movimento no sentido de uma judicialização da política no Brasil promovida por essas condições e pelo Supremo, que impõe ao Tribunal uma necessária inserção no jogo político entre os poderes representativos do Estado. Para compreender esse movimento o trabalho realizou estudo comparativo entre os modelos de cortes constitucionais e entre os debates teóricos sobre a atuação das cortes. A judicialização da política e o ativismo judicial serviram como base interpretativa das decisões do Supremo e a sua consequente autonomia. / This thesis aimed to investigate the acts of the Supreme Court as an institution which plays an essential role in the Brazilian democratic life. The intensity with which this institution performs its important mission has not remained the same over the years. The current role and autonomy do not correspond to the secondary role played by the Supreme Court in the period of time before the Constitution of 1988. With a design composed by the constituent of 1987 after the end of military rule, the 1988 Constitution, as well as significant changes in the organization of the Brazilian society, allowed the expansion of democratic life in the country. Theorists who study such change confirm a movement towards a judicialization of politics in Brazil promoted by these conditions and by the Supreme Court, which impose a necessary inclusion in the political game between the representative branches of government. In order to understand this movement, a comparative study between the models of constitutional courts and between theoretical debates about the role of the courts was performed. The judicialization of politics and judicial activism served as interpretative basis for decisions of the Supreme and its consequent autonomy.

Between social harmony and political dissonance : the institutional intricacies of the Venezuelan System of Children and Youth Orchestras

This study explores the narratives of day-to-day practices of the Venezuelan System of Children and Youth Orchestras, one of the oldest social development strategies in Venezuela, and one of the most successful social inclusion and cultural participation programs in the world. Its main objective is to identify some of the policy-based and organizational factors contributing to the success, autonomy, and longevity of this initiative since its creation in 1975. In order to assess the relative importance of these factors, the study reviews the sociopolitical circumstances surrounding the evolution of the program and examines the perceptions of its main actors and clients about key internal processes and organizational dynamics. More generally, this case is offered as a way of better understanding the insularity of bureaucratic efficiency in Latin America. / text

Implementeringen av EU:s tjänstedirektiv i svensk rätt : Principerna om god förvaltning i EU:s tjänstedirektiv och processuell autonomi vid implementering av direktivet i svensk rätt

The aim of this study is to examine how Sweden has implemented directive 2006/123/EC of the European Parliament and of the council of 12 December 2006 on services in the internal market, in the framework of the member states procedural- and institutional autonomy. The study will focus on the contributions to the Swedish law in the form of expressions of the principle of good administration, as a result of the implementation of the directive. The expressions of the principle of good administration were found in the main law "Act (2009:1079) on services in the internal market" where the majority of the directive's provisions were implemented in Swedish law. The study focuses on two expressions of the principle that simultaneously are news in Swedish law induced by the implementation of The Services Directive: the principle of necessity and liaison points of the authorities. With basis in the study of the implementation of The Services Directive as an EU secondary law act in Swedish law and the new expressions of the principle of good administration in Swedish law to fulfill the directive - the purpose of the study will include an analysis of the EU-law's impact on Swedish Administrative Law with focus on the legislation's format. The analysis will, among other things, refer to the different administrative law traditions in the two legal systems regarding the status of general principles of law, mainly the principle of good administration, in the field of administrative law.

Betaltjänstdirektivets inverkan på svensk rätt och dess processuella och institutionella autonomi

Denna magisteruppsats i offentlig rätt är ämnad att behandla implementeringen av direktivet om betaltjänster på den inre marknaden i svensk rätt. Betaltjänstdirektivet är väsentlig vid inrättande av den inre marknaden inom EU:s medlemsstater, då alla inre gränser skall avlägsnas för att möjliggöra fri rörlighet för varor, personer, tjänster och kapital; i det sammanhanget blir det viktigt med en modern och konsekvent rättslig ram för betaltjänster på EU-nivå. Uppsatsen syftar till att undersöka implementeringen av de processuella och materiella bestämmelser i betaltjänstdirektivet som knyter an till principen om god förvaltning och därtill medlemsstaternas processuella och institutionella autonomi. Till de frågor som analyseras hör tolkning av begreppet god förvaltning och hur de utvalda principerna kan identifieras i svensk rätt genom implementeringen av direktivet. God förvaltning i denna uppsats förstås i vid mening som ett begrepp motsvarande vad enskilda har rätt att förvänta sig av det berörda förvaltningsorganet vid handläggning av ett enskilt ärende. Uppsatsen har visat att direktivet innehåller ett flertal bestämmelser som knyter an till principen om god förvaltning och som reglerar hur svenska myndigheter skall handlägga ärenden inom direktivets tillämpningsområde. Uppsatsen har också kunnat påvisa en tydlig påverkan på Sveriges processuella och institutionella autonomi.

The thesis explores the potential of African higher education institutions in assisting the New Economic Partnership for Africa’s Development (NEPAD) in its quest to affectively achieve its goals. My contention is that higher education institutions need to be favourably positioned in terms of institutional autonomy and academic freedom to assist the achievement of the NEPAD goals. Moreover, there is a need for deliberative democracy, if the NEPAD goals are to be achieved affectively, especially from the perspective of higher education institutions.

Omsorgsprincipen vid ansökan om internationellt sydd : En studie av det omarbetade asylprocedurdirektivet (2013/32/EU)

This paper addresses the principle of care in the recast asylum procedure directive (2013/32/EU). The purpose of the study has been to analyze how the principle of care is expressed in the directive regarding procedures for granting or rejecting asylum, as well as to analyze how the directive was implemented in Sweden. The recast asylum procedure directive aims to harmonize EU’s member states' procedures for granting and withdrawing international protection. Initially, this paper describes how the directive was created and how the principle of care is expressed in the directive and the meaning and content of the principle of care at EU level as well as its content and meaning according to Swedish law. To conclude, the Swedish implementation of the directive’s provisions directly connected to the principle of care will be discussed. The principle of care is one of the principles of good governance. The principles of good governance have been important in EU law to ensure legal protection for individuals when they are in contact with authorities of EU or Member States. In the analysis, what is found is that the principle of care can be divided into several sub-principles or requirements: individuals’ right to get their affairs treated; the obligation of authorities to investigate a request in an impartial manner; fair procedure and handling; authorities’ duty to take individual interests in consideration; authorities’ obligation to act within reasonable time and also other requirements regarding routines and procedure. Since a major part of this paper regards analyzing the relationship between EU law and national Swedish law, a discussion about the Member States’ institutional and procedural autonomy towards EU is also included. A conclusion is that the Swedish implementation of the directive's provisions related to the principle of care was deficient and that the directive itself restricts the Member States’ institutional and procedural autonomy. / Den här uppsatsen behandlar omsorgsprincipen i det omarbetade asylprocedurdirektivet (2013/32/EU). Syftet med arbetet är att analysera hur omsorgsprincipen uttrycks i direktivet avseende procedurer för beviljandet eller avslag av asyl, samt hur direktivet har genomförts i Sverige. Det omarbetade asylprocedurdirektivet syftar till att harmonisera EU- medlemsstaternas förfarande vid ansökan om internationellt skydd. Inledningsvis redogörs för hur direktivet skapades och hur omsorgsprincipen uttrycks i direktivet, vad omsorgsprincipen omfattar på EU-nivå, liksom principens omfattning i svensk rätt. Avslutningsvis analyseras genomförandet av direktivets bestämmelser med anknytning till omsorgsprincipen i svensk rätt. Omsorgsprincipen är en av principerna om god förvaltning. Principerna om god förvaltning har varit viktiga inom EU-rätten för att säkerställa ett rättsskydd för enskilda när dessa är i kontakt med EU:s eller medlemsstaternas myndigheter. Analysen kommer fram till att omsorgsprincipen kan delas in i flera mindre principer eller krav: enskildes rätt att få sina angelägenheter behandlade; myndigheters skyldighet att på ett opartiskt sätt undersöka en begäran; rättvis procedur och handläggning; myndigheters skyldighet att väga in enskildes intresse; myndigheters skyldighet att agera inom rimlig tid; samt andra krav på handläggningsrutiner. Eftersom en huvuddel av den här uppsatsen handlar om att analysera relationen mellan EU-rätt och svensk rätt, förs också en diskussion om medlemsstaternas institutionella och processuella autonomi gentemot EU. Slutligen presenteras slutsatsen att det svenska genomförandet av direktivets bestämmelser som anknyter till omsorgprincipen varit bristande och att direktivet har begränsat såväl medlemsstaternas institutionella som processuella autonomi.

This dissertation is a study of academic freedom, an issue which is regarded as a precondition for the university's successful execution of its task, namely the advancement and dissemination of knowledge. To understand what academic freedom really implies and entails, a historical review was undertaken of the various interpretations of academic freedom in the Medieval Italy and France, Imperial Germany, the late 19th century and the 20th century American and South African universities. As an ideal, academic freedom implies the free but responsible search for knowledge and truth. The historical review revealed, however, that academic freedom has at times been misunderstood and abused. The realisation of true academic freedom in South African universities was the motivating force behind this study. Therefore, this study is concluded with guidelines and recommendations grounded in the historical review that will hopefully promote academic freedom in South African universities. / Educational Studies / D.
